How to get a payday loan refund

Did your payday loans cost so much when you repaid one you had to keep on borrowing?

You can get a refund of the interest you paid on unaffordable loans.

It’s easy to ask for a payday loan refund using the free template letters here. The letters work if your payday loans were repaid or if you still owe money.

This article covers everything you need to get started. It’s easy, free and many people are winning large payouts.

What are “unaffordable” loans?

Was a loan affordable just because you managed to repay it?

No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!

The regulator says:

 “the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”

That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.

Payday loans are meant to be used to solve a short term problem. If you kept rolling a loan or repaying one then getting another loan soon after, the lender should have stopped lending to you.

If the loan was small and it was the first loan or second loan from a lender,  the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.

How much compensation can you get?

You don’t have to calculate this. Or work out which loans were unaffordable.

Just ask for a refund from the lender and see what you are offered. This is simple and it works well.

The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.

Payday loans are meant for short term problems and the lender should not have carried on giving you loans, A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.

But if your first loan was large, or was rolled over several times you could get a refund from just one loan.

Which lenders can you get refunds from?

You can complain to lenders that are still in business, even if they are no longer lending. These include:

Lending Stream, Cash Converters, CashASAP, CashForUNow, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, Smart Pig, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

Also use these letters for the very high-cost sorts of “flexible credit”.  The largest lender is SafetyNet Credit – other lenders include Drafty, Polar Credit and Tappily. The Ombudsman is upholding a LOT of these sort of complaints.  SafetyNet Credit and Tappily have currently paused lending, but they may well restart. There is no reason to delay making complaints against them.

If the lender has gone into administration, including Piggybank, Ferratum, Oakam:

  • you can make a claim to the administrators  – there is normally have a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
  • you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.

Myjar, QuickQuid, On Stride, Swift Sterling, Sunny, Wonga, Wageday Advance, the Money Shop, Payday UK, Payday Express, Uncle Buck and other lenders who gave up years ago – it is now too late to make a complaint about these lenders, see this list.

For longer-term loans there are better template letters to use on other pages:

  • Amigo is in a Scheme so you need to claim there;
  • other doorstep lenders and other guarantor lenders,
  • 118 Money, Everyday Loans and other high-cost large long-term loans.

First, before you send in a complaint

Doing these things now will make your life easier later.

Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman. Don’t get an Experian or ClearScore report instead – many payday lenders don’t use those.

If you can log-in to the lender’s website and see your loans, take a copy of them. If you don’t know the details, don’t delay making a complaint by asking for them – use the template below to complain and ask for the details at the same time.

If you still owe money to the lender:

  • unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
  • read the Stop making payments? section in Payday loan refunds when last loan not repaid. If you want to offer a lower affordable amount, add a sentence to your complaint letter saying this.
  • if you have a lot of borrowing at the moment, read Escape from the payday loan trap which looks at how a debt management plan can help you.

If your loan was sold to a debt collector you still complain to the original lender but also tell the debt collector that you are disputing the debt. Don’t skip this bit or a debt collector may go to court.  It is a good idea to carry on making payments to the debt collector if they are affordable.

Start your complaint & get loan details

You can find the lender’s email address for complaints from this list.

Put “AFFORDABILITY COMPLAINT” as the subject of your email:

I am making an affordability complaint to you about irresponsible lending.

You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.

You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]

[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]

I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.

[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.

[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector. 

[Only put this bit in if some of your loans were more than 6 years old. This explains why you haven’t complained before. It’s only an example so don’t copy it, change it so it covers what happened to you!] [I didn’t know that the lender was supposed to check that I could repay the loan without having to borrow more. I only found out in [date/month] when I saw a newspaper article in the Sun/an advert on Facebook for payday loan refunds/a friend said they had made a complaint/whatever.]

Some ways to improve this

You can add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows that!

Some examples:

  • “I took out another loan with xxxx to pay you.”
  • “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
  • If you weren’t treated fairly while you were borrowing or when you could not make a payments, add a bit about this.

Don’t worry that the lender will say you should have cut back on your living costs.

You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.

I don’t know if many lenders actually read what you send them. But it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.

Only one loan?

The template refers to multiple loans because that is what normally happens with payday lenders.

If you only had one loan and it was large, read Refunds from large loans and use the template there.

If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.

Waiting for a reply from the lender

This email begins your affordability complaint.

They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.

When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.

The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.

Don’t be surprised if you have to wait until the end of the 8 weeks to get response, this is common.

Send your bank statements or other information?

Some lenders ask you to send them a copy of your credit record, your payslips or bank statements.

Credit record – this is mostly to be difficult – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.

Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.

It is a good ideas to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.

Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.

Lender says No or makes a poor offer

If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!

It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.

Give up?

Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!

Just ignore any of the following comments, they do not mean you have a weak case:

  • they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
  • you repaid some loans early  – this doesn’t prove the loans were affordable, just that you were trying to save interest;
  • your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
  • you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
  • your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!

Will a lender improve an offer?

You may be wondering if you should go back and try to get the lender to give you a better offer. Most lenders won’t do this, but a few may if you make out a good case – this includes Mr Lender and SafetyNet Credit.

For example if they have offered to refund loans 6-12 you would be happy if they included one or two more, you can say why you think loans 4 and 5 should also be refunded.

A good enough case to go to the Ombudsman?

If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.

Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.

Some points to think about:

  • if you are offered a refund on only a few loans, don’t accept if you think you paid a lot more than that in interest. Some lenders offer a few hundred pounds to people who get ten or twenty times as much from the Ombudsman.
  • an offer to write off your current balance may sound good … but it may be very poor if you should get a refund as well, see Refunds when you have a balance owing for details.
  • if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.

One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:

  • the loan was rolled or topped up several times; or
  • the loan was large. Here is one single loan case that was won even though it was an instalment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
  • you still owe money.

Don’t delay too long  – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS – it’s easy – and let them decide.

How to send a complaint to FOS

Put in a separate complaint about each lender.

Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!

One reader said: They couldn’t be any nicer.

The Chief Ombudsman, says:

It’s really OK to phone up and say, ‘I don’t think it was fair.” It’s not court; you don’t have to turn up with your ‘heads of claim’, you don’t have to write a fancy letter. Tell us your story and we will do the rest.

FOS’s “complain online” option is easy and takes you through your complaint step by step.

You can just copy what you said in your complaint to the lender. Or you can add more details, for example, if you disagree with what the lender replied to you.

If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:

“I knew the loans were causing me difficulty in 2013,  but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2021 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!

Things to attach:

  1. the reply you have had from the lender.
  2. bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
  3. a copy of your TransUnion Statutory credit report.

What happens after you have sent a case to FOS

You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.

After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.

If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.

The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.

A few problem cases

Don’t ask for a refund:

  • if you are bankrupt now or have been bankrupt in the past  – any refund would go to the Official Receiver.
  • if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
  • if you are in a DRO now, getting a refund may mean your DRO is cancelled!

    Hello
    Had an email from instant cash loans saying about closing and my redress
    It says 0.652 for every £1
    Is this correct – Potential Redress Amount – £2161.15
    Additional cash payment – £14.09 (which i will be paid)
    They did pay me £93 prior i beleive.

        that calculation is correct. You are being paid 0.650 in the £, a hundred times smaller than 65p in the £

          The terms of the Scheme of Arrangement mean that we try to replicate what would have happened if Instant Cash Loans had gone into a liquidation or administration. In such a scenario, your outstanding debt to Instant Cash Loans would automatically be set off against the redress awarded. The terms of the Scheme of Arrangement are not flexible in this regard and so we are unable to make any exceptions.

          We appreciate you are disappointed by this, as your irresponsible lending complaint has been dealt with under a Scheme of Arrangement, we are not aware of any further options available that would allow you to pursue this matter.

    Hi the FOS keep on asking when specifically i realised the lending was irresponsible- i dont really remember, is this a common question, if so what are they getting at? Thanks

      Your loans must have been more than 6 years ago.

      FOS can look at cases where the problem happened less than 6 years ago.
      Or where someone has only become aware of the problem in the last three years.

      So suppose you were borrowing from 2013-2016. You may have realised quite early on in the borrowing that it was causing you problems and you had to keep getting more loans. But at that point you probably thought that was your fault for not being good with money and that you should never have taken the first loan (or something like that). You didn’t know then that the lender should have checked the loans were affordable for you and you had no idea that you could make a complaint about irresponsible lending. You may have talked to a debt adviser in 2016 which helped you, but the debt adviser never mentioned irresponsible lending.

      But recently you have found out about these complaints. That is what FOS wants to know about. It doesn’t need the exact date and time – just say what happened. perhaps a friend told you they had got a refund in June last year. Perhaps you saw a Facebook ad for a claims company and did some googling to investigate. perhaps you saw an article about Amigo refunds and wondered if it also applied to other types of loans etc etc.

      There are no wrong answers here – just tell FOS that while you were bowworing you didn’t know the lender should have made affordability checks and so although the loans were causing you trouble, you didn’t realise you had a reason then to complain about irresponsible lending. Then say when you found out about these complaints and point out that this was in the last three years.

      i just told the FOS that i only became aware i could claim for irresponsible lending when i came across debt camel while looking for a way out of my debt problems i had a lot of payday loans some going back over the 6 year mark i never missed a payment but had to pay then borrow again the same month and every single one was upheld by the FOS thanks to Sara i manged to get over 20thousand pound back(i started claiming in 2018 and since have not used a payday or loan company since good luck with your claims Sara once again thank you you are a godsend

    Morning Sara i have a payday loan with uncle buck ive complained to them but because there in administration the fos wont touch thrm and the administraters rejected my complaint this is the last payday loan left on my file i won the other 4 what can I do

      have you asked if there is an appeal process? Offered to supply bank statements?
      if this was the only loan from them then it’s pretty unlikely you would have won the case at FOS.
      Can you afford the repayments – what are the rest of your finances like?

    Hey all, I just wanted to share that I recently got all of my interest refunded for my PDL’s with Mr Lender. They’ve dragged their heals for months, but I finally received the money last week. Advice to anyone on here is to take up your issues with any payday lender with the FOS. Make a complaint, it doesn’t take too long and you won’t regret it, although the process can take a while if the lender refers to an ombudsman.

      The FOS are considering my case against them right now. They did come back and added one more loan to their original offer, but I declined and explained why – they’ve now emailed me again, asking for the reasons, outside of the Ombudsman process: did they do that to you, by any chance? (It didn’t happen to me with LS or SNC, so I’m just wondering)

    Hi, Sara,

    You helped me earlier in the week with responding to a revised offer received through the FOS from PDL/Mr Lender: I would be really grateful for your insights on an email I’ve received from them, saying that the FOS have told them I rejected the offer (they added one further loan, to refund interest on loans 4-6, out of 10 in total) and asking if I could explain why. FOS has given them until the 19th to supply all the information they have (they forwarded the original email to me, which is how I know)

    Should I respond to them? I’m not sure if they are checking whether there’s a compromise to be had, or trying to get advance notice so they can argue against what I’ve said – I am trying not to be suspicious, but they’ve particularly put me through the wringer, initially being very obstructive about providing details of loans (in fact, I still don’t have one date because of this – it took well over a year to resolve) , and then arguing that FOS shouldn’t consider any loans at all (the last was paid off in 2020), then sending it to an Ombudsman to contest the decision that they could, and I am not sure what the implications are of their request.

    Thanks for any advice on this – it’s really appreciated: I’ve had success with LS and SNC, but neither contacted me directly in this way during the process, so I am not sure how standard it is.

      Would you be happy if they just included the last large loan?
      If you would, you could reply saying that as a compromise you would be happy to accept 4-6 and 10, but otherwise you will let FOS look at your case. I don’t see any reason why you should go into any detail.
      If you don’t want a compromise, just say you would prefer FOS to consider your case.

        Hi, Sara,

        Mr Lender never responded, but the adjudicator said he would ignore 4-6, since they’d already offered these, and included 10: he did include some comments in his letter about how they should have seen there were issues with 1 and 2, but did not include these. Mr L left it until the last minute, then demanded to know where the credit reports I had included were from, and to see them (I had sent them to Mr L when I made my complaint) and it then took over a month to find out that they did not accept the adjudicator’s response, and that it should go to the Ombudsman: I realise it’s pointless trying to second guess things here, but this does seem a bit unreasonable, especially since my credit report shows that, at the time of the second last loan (9) I was already in arrears on seven short-term loans, and they lent the final loan, (10) which the adjudicator has ruled should be included, the day after I had paid off 9, and when these had turned to defaults.     I am after some advise re my old Onstride Loan, I was successful in my affordability claim and my balance was re-adjusted and I had confirmation that this would be actioned and any negative markers on my credit file would be removed; however, the loan was sold to Lantern and the Default has now been moved to them. I raised a query with trans union and they have come back saying they won’t remove it, Lantern don’t seem to understand what I’m asking for and when I ring Onstride they inform me it will eventually be resolved?

      Then I suggest you put in a complaint in writing to Lantern – email is fine, attaching what the administrators told you. tell Lantern to remove the default. Send it to the Financial Ombudsman if they refuse.

    Hi I have had over 15 loans from fund ourselves one after another in the space of 8 months I’m struggling financially as I have 8 more payday loans to deal with and I end up in a viscious circle can I make an affordability complaint to fund ourselves or are they not a payday lender?

    Hello, I’m currently in a debt management plan with step change I had numerous payday loans and high interest loans, some I’m still paying off, my question is, can I put a complaint and ask for a refund if I’m in a debt management plan? Will this effect the plan at all?

      yes you can. This is a great thing to do as refunds may reduce or clear the debts in your DMP. And if you get a cash refund, then you can use this to make full and final settlement offers to other debts in your DMP.

    Hi,

    I recently took out a payday loan for £600 for six months with moneyboat, having managed to meet four of the six payments I fell into even worse financial difficulty as I’m on maternity leave and my husband has been ill therefore his pay has been dramatically affected. However when I took out the loan I was in a huge financial mess as all of my loans and credit cards were either in arrears or defaulted on my credit file and started to miss the payments from May last year which they would’ve seen when I applied for the loan. I have a horrendous gambling addiction which I am seeking help for which is still affecting me today due to the losses that I have faced and the financial position I’ve left myself in now. I’ve been trying to get a copy of my loan agreement which they are not sending me in the correct file as I believe after reading a lot of the reviews that they will default your account if you miss one payment I have tried to contact them last month when I had to pay a reduced payment and they have put down on my credit report that I’m in arrears however they said it was an arrangement to pay and the final payment this month there is no way I’m going to be able to afford it. Do I have grounds for an affordability complaint against the company for initially allowing me to have this loan when they could see that I was in £28,000 worth of debt already and as I’ve said above have lots of missed payments and defaults on my report?

      yes you can make an affordabilty complaint – one loan of £600 is a bit marginal, the Ombudsman may or may not uphold it if MB reject it, but it’s worth a try…
      BUT you have much bigger problems than this. Are you buying or renting? How many of your debts are you making the normal payments to?
      With prices (including energy bills, food and petrol) all going up, if you are hardly managing now, this is set to get worse in the next few months…

      PS MB always respond to any affordabilty complaint with an aggressive message about fraud… no-one who has ignored this has had any problems with it if they take their case to the ombudsman.

        Hi Sara, i’m in the process of setting up a debt management plan with step change that helping me control my finances better as currently renting and none of my priority bills are in any sort of arrears it’s just how I’ve been living off credit so they have help me get sorted.

        I have heard about money boat been quite aggressive and that’s what frightens me. So if they were to threatened me claiming I committed fraud do I just ignore that and for Forward to the ombudsman if they decline?

      I am sorry to hear of your gambling addiction it is the devil himself, there is a charity especially for women called Gordon Moody they do gambling retreats and very successfully, can I just ask is your husband await of your addiction or is it hid along with the debt, I would suggest if it is hid and he doesn’t know let him know that is half the battle, contact your doctor for some help too, gambling will never cease until you face up to it and admit to your family there is a problem, I wish you the best

    Hi all,

    Just wanted to say it is sometimes worth pushing the lenders for a better resolution even after their final response. I only had 2 loans with Quidmarket £300 paid early after only 16 days and £600 paid 2 months early. They didnt uphold my complaint but said they will remove the loans from my file as a goodwill gesture. I called them today and discussed the decision and the lady went through eveything and ultimately said she agrees with her colleagues decision and theres nothing else they will offer. She said I can take some time to think about the decision. I rang back 2 hours later as I wanted to know if their offer becomes invalid if I go to fos (I dont think fos would uphold so didnt want to go to them and get nothing) she then told me even if I go to fos their goodwill gesture will remain. She said they really wouldnt want it to go to fos. I told her how my other complaints offered me money off my final payments even when they didnt uphold my complaint (cash4unow and fernovo) so she then agreed to pay me 100 gbp. So always worth discussing and pushing them more

    Hi Sara, you gave me some advice a few weeks.
    I made a complaint to Likely loans in relation to a top up loan I had with them. This is the reply I’ve had.

    They have upheld my complaint in relation to the original loan. In resolution of the complaint, They are proposing to remove all applicable interest from the loan and any negative markers from my Credit Report.

    They are removing interest of £973.59, leaving a remaining outstanding balance to pay on my Top Up Loan of £1,758.88.

    So they have agreed that the original loan wasn’t appropriate.However they haven’t upheld my complaint about the top up loan and I believe in the time of my two loans my financial situation had stayed the same if not got worse since the original loan.
    I have why they didn’t uphold this complaint but my comment is too long haha.

    Is it worth me pursuing this further with Likely Loans and calling them to talk to them? Or should I just accept the
    £973.58 off the current loan I’m paying back?

    My other question is, if I accept the nearly £1000 decrease the amount I have to pay back, how likely is it this could change my monthly payment? At the moment I’m paying over £200 a month which I’m struggling with so wondered if my monthly payment could be changed now I owe less.

        so most of their reply didn’t look very interesting, but they said “Your new payment size was only 10.7% more than your previous loan payment.” which may not sound like a lot, but they have agreed the previous repayments was unaffordable! So unless your income had gone up a lot, that suggests the second loan is too.

        They said “you had remaining disposable income of £429.21.” – I assume your bank statements would have shown that wasn’t the case.

        Also I think they should have wondered why you needed a top-up loan less than a year after taking the first loan.

        So it doesn’t sound a good offer to me, but it’s up to you if you want to accept it. You can contact them and say unless the second loan is also upheld you will be going to the Ombudsman.

        If you accept this offer, there is no reason why they should allow you to reduce your payments on the 2nd loan. They may, but would probably record this as a payment arrangement on your credit record.

          As your irresponsible lending complaint has already been investigated and a final response has been issued, we will not be under taking a new investigation. As outlined in my previous communication, if you are unhappy with the complaint decision you have the right to refer your complaint to the Financial Ombudsman.

          Is it worth me calling likely loans and pushing further or just straight to the Ombudsman?

      Well the choice is yours.

      But if the first loan is unaffordable, why isn’t the second loan?

      if you know the second loan caused you more problems, then why not send it to the Ombudsman?

      This may take some time to go though at FOS. But if you are in a DMP, you just sit back and wait. If you win your case, then your DMP is going to finish a lot earlier!

    Hi About 6 years ago I took a payday loan with text loans which i couldn’t afford but was too scared not to pay so that then escalated in me taking another loan every month for the next 5 years or so until I went into DMP and stopped the madness. Through this time text loan changed to MyJar who are now in administration. Today I have raised an Affordability complaint from your template and sent it to Myjar Harrisons email. I just wanted to check I’m no too late on this? I didn’t even know it was an option until I recently decided it was time to really sort out my credit file and not just put up with what was on it.

    Was just reading up on the administrators report on the quick quid / Pounds2pocket progress. It states in their latest report that payments must be made to us by March.

    Based on the use of the word ‘by’ does that mean they have to communicate to us and pay our redress before March or do you think it will include the month of March? I know it’s hard to say but i thought the use of that word is quite significant.

    Hello, not sure if you have any advice here. In June 2021 I submitted an affordability/inappropriate lending complaint to SafetyNet Credit, with who I had a balance of £1,336. They upheld the complaint on July 30, and the redress left me with a balance of £37, which they said they were writing off so I owed nothing, my account was closed, and they would remove all mention of themselves from my credit file within 6-8 weeks. Last month I started to get emails from them demanding that I pay the balance and set up a payment plan. The balance is still showing as outstanding on my credit file. I have made a complaint to them today, saying they have failed to remove the debt from my credit file and are now chasing me for payment again, and I have sent them the letter they sent to me. What can I expect them to do from this?

      It sounds a lot like someone at SNC failed to carry through with what was agreed. I would expect them to resolve this pretty quickly. If they don’t tell them you will be sending this to the ombudsman and asking for compensation for the hassle.

          I have put in a formal complaint with SNC as they have actually defaulted the account and for the past four months it has been marked with a D on my credit file. They say it will take up to eight weeks to investigate my complaint but in the meantime the erroneous default is still sitting there.

    Received a redress from safteycredit net, for a 500 pound loan over a few months, due to gambling transactions and had a single loan from QM they agreed to remove loan from file as a gesture of good will, after sending affordability complaint in, was a very nice for them to do that! I still feel that these companies not including information about how these loans affect your future borrowing ability is seriously misleading! Still some replies to come back, will update as I get them through!

    Also I have 2 defaults from Aqua and Marbles credit cards which continued to increase my credit limit during already a very tricky time financially ( at the time i had around 10 lenders and a massive overdraft ). Can I go with affordability claim to them, getting rid of those 2 defaults would get my life back on track massively. Thank you for all of your advise on here

      Onstride – too late. If you have a default, you will be able to ask for the record to be suppressed from your credit record in 6 months or so, see https://debtcamel.co.uk/correct-credit-records-lender-administration/ but it is too soon to do this at the moment.

      Myar – in administration, I think you can still send a claim to the administrators, email is in the linked page in the article above.

      Aqua and Marbles, yes you can make a complaint for increasing your credit limit: see https://debtcamel.co.uk/refunds-catalogue-credit-card/.
      You want to ask for a FULL refund from the point they increased it (to just for the amount they increased it) as at that point they should have seen you were in difficulty and offered forbearance. They are both New Day card so make a single complaint for both cards.

    I read somewhere the loan company were charged £500 by the FO but I do t know if that is true or not.

    Hi Sarah, just had a final response back from savvy regarding 2 loans (£500 and £700). They have not upheld the first loan but have partially up held the 700 one. They have removed all interest so i just need to pay a small amount to cover the capital i actually borrowed- this i am extremely pleased with. However they have said they will remove negative info from credit file with regards to loan 2. However every other lender ive been in contact with (Fernovo, cash4unow, quidmarket, mr lender) have all agreed to remove whole loans from my file. Is it worth ringing savvy and asking them to remove the last loan if not both? I dont understand why they would not remove the loan in full!

      the Ombudsman says to remove negative marks, except in case where there has been a very large number of loans from the same lender.
      Some lenders just take a shortcut and remove the whole record, but they don’t have to.

      no, send the complaint to the Finacial Ombudsman as the article above says. Include a bit saying when & how you found out about these complaints – if this is within the last 3 years FOS can choose to accept the complaint and it often does,

    Ok today I’m annoyed with Harrison’s acting on behalf of MyJar despite an affordable lending complaint being outstanding and knowing my mental health issues. They have sold it to Perch but have provided me no update on my affordable lending complaint which has gone from My Jar to FOS to Harrison’s in relation to my older My Jar loans but found in favour for my latest two loans one of which has been sold . Any ideas or suggestions

            To Whom it may concern
            Further to my previous emails this loan was the subject of an earlier affordability complaint which was upheld in my favour. Along with the previous loan. I made complaints about seven earlier loans which I had with my jar but were rejected and sent to FOS before you went into administration before these were passed back to the administrators.

            These affordability complaints are still outstanding and I would have the right of set off if found in my favour against the loan which has been assigned to Perch. You are also well aware of my mental health issues with depression and PTSD .

            In light of this please consider this a formal complaint which I am fully prepared to escalate to your regulator. If Perch update my credit file with negative information then bearing in mind the previous finding in my favour. I will make a complaint to the FOS.

            Please in addition advise what happening with my affordability complaint which I have been chasing since December 2020

            I’m starting to think the administrators are idiots. They’ve sold the debt on and as a result of my complaint stated “ Hi,

            Unfortunately, there is no further update at the moment. The redress is ongoing but is moving towards the final stages and should be concluded in the near future.”

            Are they really that incompetent , they’ve just undermined any redress of set off by selling off the debt

            So the update is they have admitted the loan shouldn’t have been sold and it has been bought back by them due to the right of set off . I asked for compensation of £30 due to the stress caused as a goodwill gesture but they have refused this. So do I have any recourse regarding complaining about the administration in this case ?

    Like others, my outstanding Myjar loan (£943) has been sold to Perch Capital. Myjar registered a default on this in 2018 but in late 2021 they removed the loan from all 3 CRA’s.

    However the email says ‘ Perch Capital may start to report account conduct information to the credit reference agencies in the near future. This will include providing them with information on any payments made or missed, defaults, payment arrangements, and settlements.’

    Does this mean Perch have the right to start giving me a ‘missed payment’ in respect to this loan every month from now on? I *could* make the payment or at least offer a settlement but obviously I don’t want to throw money at something that may not have any consequence anyway – and thats also without considering my affordability claim on this loan is still unresolved.

    I’m nervous because my record is clean since 2018 and am hoping at applying for a mortgage in the 2023/24 year…. So missed payments being reported in 2022 would be a disaster.

      how was this loan recorded before the administrators stopped reporting to the CRAs – up to date? defaulted? missed payments?

        On MSE credit club it was reported as ‘in default’ each month since around mid 2018. In early 2018 it went through -1, -2, -3 before the default was applied.

        It seems like I stupidly made a complaint on this back in late 2018 via a claims company and this was rejected. I did do another one myself to the administrators in April 2021 but can find no response subsequent to the copy/paste response I got at the time that just explained the administration process (that complaints were being looked at).

        I feel like a settlement offer of an amount that brings my total payments on the loan as equal to the original advance amount would morally be the right outcome…. but this is only about 30% of what they say I owe so I doubt it’d be accepted.

          It is a shame you did not take the Myjar complaint to the Ombudsman back in 2018.

          You need to ask the administrators what they have decided about your complaint. Sometimes administrators will let you put in a second complaint. Sometimes they won’t.

          If the administrators will not consider your complaint, then I am afraid you need to settle the loan with the debt collector who now owns it.

    Hi sara i had outstanding loans with myjar £3000 i complaint about to loan to Ombudsman in 2020 which i won both parties agreed my loans as now be sent Perch Capital, I’ve sent them all information about what Ombudsman and myjar agreed now Perch Capital, told me they will not except this agreement . What can i do about this?

          So you are saying the balance was £2,300 say and after the FOS decision this was reduced to £1000 but your debt has now been sold to perch as though it is £2,300?

          This was an adjudicator decision that Myjar agreed to before they went into administration?

            No go back to Myjar. FOS can’t get involved in an administration.
            They should only have sold the reduced balance to Perch. If they don’t immediately agree this is wrong and that they will correct this, complain to the administrators directly.

        Honestly can’t remember as it’s so long but the reasons they gave are below and I’m not inclined to argue to be honest.

        Your claim was deemed not eligible to receive compensation due to one or more reasons stated below:

        o You took out fewer loans over a longer period;
        o There were longer periods of time between each loan you took out;
        o The amount of your loans did not increase by enough in a year;
        o You did not have loans with other loan providers at the same time; or
        o Your loan was not used to pay off a previous loan.

    Nor sure if this is any cause for hope, or concern, but I have just logged in to my 247 Moneybox account to find that the redress section, and bank details provided, have both disappeared from the account section. For what seems like ages now, there’s been a redress section, showing my claim value as being ‘TBD’. It’s a bit ominous it’s now all disappeared? Might be worth logging in to yours to see if the same has happened? If so, they might (finally) be dealing with the redress, which I know isn’t going to be much but, just to put a lid on this would be good, after what feels soooo long.

          Hi Ross, yes if you go onto Harrison’s website it has an update from middle of January stating that redress payment will hopefully be March, but we will wait and probably wait more 😀there do doesn’t seem to be many of the 247 club members on here not like moneyshop😂😂

      Yes, it’s disappeared on mine too. Hopefully that means they are getting ready to pay up finally but as Faye said, communication from the 247 administrators has been very bad, I’d say it’s been even worse than ICL. Let’s hope they can a least beat ICL’s redress percentage which was ridiculous!

            Active securities (247 moneybox) went officially into liquidation on 21/02 according to companies house so I think this is why the redress section has disappeared. Wouldn’t hope for much though-62,000 claims and only 3.4 million to pay them

    Wondering if anyone has heard anything from MyJar or Harrisons regarding the selling of existing MyJar loans to Perch Capital? I emailed both MyJar and Harrisons on the 10th Feb (same day as received email from ACI stating perch have bought the debt) asking them to clarify the situation as I still have an affordability claim from over a year ago still open as far as I know. Neither have told informed me they weren’t upholding my complaint and neither have bothered to reply to me yet, 12 days is a joke.

      I too have a complaint with Myjar since February 2021 and heard nothing. Yesterday I received an email from ACI saying the debt had been sold to them. So I immediately emailed Myjar/Harrison’s asking for an update on my claim. Then I emailed ACI in reply to their email advising that I have an outstanding complaint with Myjar and I copied in Myjar/Harrison’s. I have not heard back from Myjar/Harrison’s, but ACI replied to me to say they have forwarded on to Myjar and will put my account on hold until I get a response from Myjar.

Once Harrisons are in a position to provide customers with an update on the redress scheme, they will be in contact – however, as of yet, there has been no update to provide which is why no contact has been made.

    I just want to ask I had a payday loan from Kabayan Finance since 2012 until 2020 and I had complaint to FOS kabayan did not include my loans from 2012 to 2015 as it is more than six year and FOS had decided my case and the investigator said that if I will included the case will be re investigated and will take a while again. My question is can I make a different complaint of my loans from 2012 to 2015? As kabayan was given until March 8 to settle the amount for my current complaint.

    Hi. Not sure if this is in the right section but I wanted to post a thank you to both Sarah and someone who posted a comment on here a couple of weeks ago who’s name I cannot remember.

    The user had mentioned that they had put an affordability complaint to lending stream which was successful. I decided to do the same and used the template on this website. It was sent off last week anticipating that I would have to progress onto the ombudsmen.

    It is a good job I was sitting down at my work as I have just received an email a week later confirming they have agreed to refund £12500 and this will be sent to me within 3-5 working days!!!! I had to get my partner to check the amount as I thought I was seeing an extra digit by mistake.

    Thank you for all your hard work Sarah (and the person who posted about lending stream a couple of weeks ago)

    Bit confused. Got an email last week to say my provident claim wasnt successful. On Sara’s advice I contacted them asking for a list of loans I’d had. They asked me to confirm name dob and address which I did, and now the reply I’ve got is this!

      Update – I’ve managed to log in and it just confirms the email I got last week saying I was t eligible for compensation. So they’re not even going to tell me what loans I had!

      I’ve put in an appeal with provident based on the fact that I think I had quite a few loans and re-borrowed and they’ve failed to provide me with the evidence of the loans I had so therefore how can I accept their decision.

    I made a complaint to Indigo Michael Ltd (Tappily) due to irresponsible lending. They initially refused to offer any refund and said I still owed the full balance. So, I have taken my case to the Ombudsman, and pending their final decision, Indigo Michael Ltd have ‘changed their position’ and offered £476.49 redress taken off my current balance. This will still leave me £433.79 left to repay.

    Do you think I should accept their offer to write off roughly half of the balance or refuse? It was my thinking that they may have changed their position as they think the Ombudsman will award me more, but similarly I don’t want to lose out on this offer if it’s the best I’m going to get!

      do you know how much interest you have paid in total with them? They may have given you this information in rejecting your complaint?
      Unless you do, it’s hard to say whether this is an OK offer or a dreadful one…

      how do you feel about this? if they had offered you that at the start would you have been happy?
      it sounds as though don’t think your complaint will be rejected by FOS. But I can’t guess what FOS would decide.

        Well, it’s an okay result, but I really thought they would write off the total interest balance as I don’t believe their lending was responsible from the start. The interest they are writing off is roughly how much I accrued since a credit limit increase which caused me to get into further debt – which I assume Tappily now views as irresponsible lending. To be honest, I do want to see what the FOS come back with – my main concern is whether refusing this offer now will mean if the FOS side with Tappily I will not get any of my current balance written off.
        I’m guessing that it’s just a gamble, right? If I refuse the offer, and the FOS reject my complaint, I’m still going to have to cover the full balance. I would rather have the guarantee of ~50% of my balance being written off than the possibility of 0% being written off.

          That seems unlikely – if what they have offered is a refund from the point they increased your credit limit, FOS may think that is fair, so you would get the same as you are now being offered, not less.
          Them making this offer means they do not expect to win the complaint and you get nothing.

        They expect they will lose and you will win. Otherwise why would they offer anything?

        This sort of product – which FOS calls “running account credit” – had the highest uphold rate of any product in FOS’s statistics for the last quarter of 2021 published last week. FOS agreed with the customer in 80% of cases.

        Of course that doesn’t mean the customer got a “full refund”, but it shows how few cases are actually being rejected by FOS.

I won with FOS in 2020 that my loans should reduced to £1056 only now with ACI now say that i own £ 3067 i’ve sent all information to ACI about loans what was agree with FOS. ACI told me they will not reduced loans. So i contact myjar and the Administrators of my jar told me nothing they can do about this. What can i do about this?

    I made a complaint to savvy on 13/12/2021 and the 8 weeks had passed and I received no response therefore went to the Ombudsman . Savvy have now been in contact with me claiming they did not receive my dispute and can’t find any details on their system ( they provided me with a summary 12 days before I complained ). They have said they are starting the complaint from 28/2 and the 8 week timeframe is effective from this date . I have refused this and stated the 8 weeks should start from my original email and have gave them until COP Friday (4/3) to respond . Should I do any more ?

        I asked for a borrowing summary for the loan I took out in 2017. This summary was provided to me on 1/12/2021. On 13/12/2021 I made my complaint and included the summary that was provided as I was worried savvy would say they couldn’t find any information like they have just done after I complained .

        8 weeks passed and I had not heard from them so took my complaint to the ombudsman, they are now saying the process has started from now but I argue it should have started on 13/12/2021 not when they have now decided to acknowledge it due to the ombudsman being in touch with them.

          Well for anyone else reading this, it’s much simpler and quicker to ask for details at the same time as you complain.

          The Ombudsman isn’t going to do anything until Savvy has responded anyway, so this is all a bit academic. At the Ombudsman you can supply the evidence of the date of your claim and ask for compensation for Savvy’s poor complaint handling.

      well that suggests taking a copy and complaining, not delaying the complaint by asking for details. I will remove that sentence as it really isn’t an issue in 2022. There is a problem of general wiping of old loans because of GDPR but that is done en masse, not when someone makes a complaint.

      Anyway, you are where you are. This is very annoying for you, but FOS won’t do anything until Savvy have responded.

    Hi Sara, I wondered if you had read Harrison’s report(companies house) active securities, now I tried to absorb it, on my reading Harrison’s are now 10 million in, I think there was 3 million left for 60 nearly 70 thousand people 😆😆now I’m no clever Einstein but surly if they had just liquidated the company in the first place there would have been a lot more for redress, so the only winner is Harrison’s and their other company that was employed to help in the wrap up of 247. I feel sorry for people who debt has been sold on, for Harrison’s to thrive!!! Thief’s in my opinion and about time this was looked at by the he governing bodies.worth a look Sara hopefully I have read it right.

      No I haven’t looked in detail.

      The problem is that someone has to deal with the assets and sort out who has valid claims. That is the administrator.

      Yeah I read it as 3.4 million for 62,000 claims which doesn’t bode well for getting much! And no idea when it will be paid either, last update on website November 21 👀

        Yes I’m kinda thinking there will be nothing left soon…hope I’m wrong but no communication and all bank details etc gone from the website now seems weird.. but as usual the fat cats get fatter🤪I’m sooo skinny😂😂I just really feel for the people who now will be hounded for money it really sticks in my throat I would rather they just wiped all debt from everyone and no one get the measly scraps they might throw us!!

      I wonder how much the debts were sold on for… Just before they sold the loanbook I had £328 outstanding balance, offered them £25 full and final settlement and they accepted it! 😆

    Does anyone have any experience or dealings with United Kash? They suddenly started chasing me for a loan with Diffetent Money (who now no longer exist). As well as this, the loan was from 2010 so I informed them I had no records of this loan and that as it was over 6 years old surely it would be considered statute barred. They said not and that I’m still liable but that seems hard to believe as it’s 12 years old?

    Although I marked their emails as spam one has today managed to get to my inbox and now they’re saying they’re offering me 50% discount to settle. I just keep ignoring them but this has gone on for a year or so now.

    I’ve had an email from a company called ACI to say they’ve bough the log book from myjar and now own my loan which was strange because I’ve paid it off. Just incase anyone has outstanding debt with them they might want to chase it up. I don’t even and I’ve still had to raise a dispute and prove it x

      Some of the admin in Myjar’s loan sale has been poor :(

        It really has, I spoke to ACI to sort it and asked if the redress will still be coming from myjar and they said it’s all been done and paid already. Rang myjar and they said no that’s still an on going process. Messy all round I think x

    I got a letter in this morning from Harrisons, its regarding 247 Moneybox.
    Has anyone else got one?

    Its basically for potential creditors, yet they want proof of debt.
    Also included is voting forms.

      It is clear that borrowers with affordability complaints do NOT need to submit a proof of debt:

      “CUSTOMERS / REDRESS CREDITORS DO NOT NEED TO SUBMIT A PROOF OF DEBT
      FORM (These claims have already been agreed by the Administrators)”

      Hi John, yes one dropped in the letterbox this morning, but as Sara has said it is for creditors not redress customers. I had a little giggle that they must have sent these to everyone (66,000) customers first class quite bulky letter maybe a £1.00 a pop…£66,000 less in the pot now, for a letter that doesn’t concern redress customers 🤷🏼‍♀️🤷🏼‍♀️

    This is relating to Lending Stream

    I think I may have emailed them a couple of years ago re an affordability claim which they rejected. At the time I didn’t think it was worth pushing but I have more of an understanding of the process now. Can I submit a claim again or have I missed the boat?
    I feel I have a very good claim as I had 12 loans in 12 months, often running alongside each other and several times I paid a loan off only to take another out the next day.

        Hey Sara! The same happened to me..but they just sent an email years later saying this: “As part of a business review, we’ve been looking at some loans we made in the past.
        One of the things we looked at was whether the information we had at the time we gave you the loan was enough for us to be confident that the loan was affordable for you.
        It’s important to us, as a responsible lender, to make sure we only give loans to customers who we believe can afford to repay them.
        We’ve identified a loan or number of loans we gave to you where we may not have had enough information for us to be sure that the loan we made was affordable for you. The details are shown below” (loans for £290, £170, 400£, £600 then £400 again). I filled some info on my housing at the time but what do you think will happen? I’m surprised they looked at this again so even if they say this was affordable, I will argue for a refund or at least removing the default from my credit file…

            I wondered about that too, that’s why I came to the site and see if there was anyone else!! Why do you think they’re doing this?
            After I answered the questions they asked on housing – how many ppl I lived with, it if was private rent or council etc… I received a vague automated email that said this: “Many thanks for taking the time to submit the additional information we needed to evaluate if we made the right decision on some of your previous loans.
            We have looked at what you told us, and we are confident that for the loan or loans in question (and we’ve set them out again below) , we made the appropriate decision.”
            I will argue for the refund on the interest of these loans and deleting the default from my credit file…

            Why do you think they’re doing this?
            either they have been told they should do this by their regulator, the FCA. Or they are worried that the FCA may say that and they want to look a bit better by doing it voluntarily.

            I had 9 loans from them with amounts increasing over time, but they only referenced these 5 loans, which I do think were the ones that were unaffordable. At the time they didn’t uphold any of them.. First loan I took was in 2016 but then I took the last one in 2018 and shortly after it defaulted and then I made an affordability complaint to them back in 2018. I think you are right and they are worried about FCA..but I will definitely fight it this time! When I first complained, I was doing that with PiggyBank, Myjar and a couple of others and was overwhelmed and Lending Stream were the most unresponsive, but will now take the opportunity to argue for a refund!

            Ask for a complete list of the loans and the dates and the interest paid on each.

            it helps to have this so you can point out things like the loan amounts were tending do go up, there were few gaps between the loans etc. And to note if you sometimes had more than 1 at once.

        They got back to me and said the following:

        “We write in regards to the correspondence received from you on 7th April, 2022.
        We understand you are concerned about the affordability of loans offered to you. When we looked into it, we found you’d already raised this complaint. As we shared our final response in October, 2018 and we consider this to be closed, and we will not be revisiting the matter again.
        We appreciate your understanding in this matter.
        If you have further questions or would like additional information, please reply to this email.”

        I don’t understand why they’re sending out those emails if they’re not actually willing to look into it or give out any refunds or reassess the loans affordability.

      Money platform are a nightmare! If you do go to FOS be prepared for them to use every type of defence with the adjucitor (first said they are not covered under FOS due to the type of lending they provide and secondly if you ever had to borrow and pay back early to borrow a higher amount (repaying in the cool off period) they will argue also)!

      Fernovo are very reasonable, I did not need to go to FOS and they dealt with my complaint swiftly

      I have been back and forth with my adjucitor many times over the last few months as they are really digging their heels even though my adjucitor already gave them the first outcome (in my favour)!

      Nothing apart from the fact that the redress and bank details section appears to have dropped off peoples accounts on the 24/7 site. This may be a positive, as all it ever said was ‘TBD’ under the figures. I wouldn’t hold your breath, for March, as they’re still in the process of liquidating the company.

      *** UPDATE ***
      The redress section has now reappeared, after logging in to my account, with a green tick ✅ saying ‘Claim acceptance received’ and that theres nothing further to do, until being contacted by the administrators. They also say any attempts to make contact won’t speed things up and ‘could cause delays’. Just a case of sitting tight now.

    Hi,
    Has anyone ever had payday redress from PoundsTillPayday part of Northway Group & based out of or registered in Malta I believe.
    I’d managed to find a Northway Group site 2 or 3 years ago & filled in the online query form about my loans but it was bounced back with error of some sort. Anyway I handed over a small fortune to that lot & just wondered if any lucky people out there got a refund from them?

    my finance club came back today on the last day
    said they’ll agree to 4-8 out of the 11 loans i had with them.
    i paid about £300 for borrowing it.
    they’ve said £143 back
    would you accept or ask for maybe extra couple loans?

        and no, loan 8 was May.
        9 was June
        10-11 was 1st and 31st August.

        Having reviewed this situation, loans 4-8 would not now have been issued to you under our current lending practices and therefore, as full and final settlement of this matter I am willing to refund the interest paid by you on such loans to you.

          I suggest you ask them why loans 9,10 and 11 were not included. As you will send the case to the Ombudsman if you do not get a reasonable explanation for this.

    They have said those loans were within the first year of the first loan taken out.
    I think il take what they are offering to save another huge timeline for not much return.

      That is a nonsense reason. Well it is a reason to refund those loans AND ALL SUBSEQUENT LOANS unless there was a large gap of several months.
      But it’s your decision. It would only be another £90-£120 from the last three.
