If you want to get a refund for “unaffordable” payday loans, the first step is to complain to the lender. Often it’s simple as the lender has a Complaints section on their website, but some have been taken over or the website isn’t there anymore, so here is a list of their email addresses.
For all these emails put AFFORDABILITY COMPLAINT as the subject of the email.

There are literally dozens of payday lenders that have gone without trace. The above are just some of the ones people have asked about. There are also lenders who were never authorised such as Loans4U / Loans4You who you can’t take a complaint to the ombudsman about.
The info here may not be up to date. so the safe thing is for you to look in the company’s website to see how to make a complaint or what form to complete if the lender is in administration.
If you can’t locate the website, talk to the Financial Ombudsman about these firms.
Affordability complaints to other lenders

A good place to try to track down old lenders is the FCA Register, as this lists firms’ brand names as well as their company names and also sometimes shows details for firms that have ceased trading.
If you still aren’t having any luck, then try the Financial Ombudsman’s complaints line – they are very friendly!

no sorry. The Ombudsman would only look at a complaint after 6 months if there was a very good reasom, eg you had been very ill or in prison or something.

Used the template and emailed Mr Lender who have responded with a letter;
“We are writing to ask for confirmation and clarity on the reason for sending this as the detail within the email is confusing.
Whilst the start of your email suggests you are making a complaint there is vague information regarding the reason for your complaint just that you feel they were unaffordable, which is followed by a request for a list of loan(s), dates they were taken and the charges and interest you paid.
We are unsure how you are suggesting these loan(s) were unaffordable of you were unaware of the number of the loan(s) you have had with Mr Lender and the value of interest and/or charges paid. We have seen the same email from other customers and have found it to be a template generated off the forum website debtcamel.co.uk/payday-loan-refunds/.

They are being difficult. Just reply that you have made an affordability complaint on dd/mm, they can see from the list of loans you had that the Ombudsman is likely to decide the loans were unaffordable and if they don’t make you a reasonable offer within 8 weeks from dd/mm you will be sending it to the Ombudsman.

I think that was a brand of MCO Capital which was shut down by the regulator in 2012. If so, there is no chance of any refund, it is long gone.

They are in administration. Unless there is some evidence you have about your finances in 2007 – which sounds unlikely – there may be nothing you can do.

Thanks Sara. I’m dealing with pwc the administrator. All I have sent them is the two claim forms about the two loans in 2012, and then found out from pwc that they also realised I had one in 2007. I tried to claim a little more as I had a feeling I had an old one. How come they can accept two from 2012 but not the 2007 one ? All loans were paid back in full.

Great website, I’ve used it a few times for contact details for companies and to find out that moneyshop were in administration nad hadn’t contacted me.
There are some companies I had loans with around 2010/2011 and have tried to contact them to request details of my accounts but contact details I have from old emails do not work and I can’t find anything online about them. I’ve looked at your list but can’t see them there either so I am hoping you can help.

Do you know if credio has creased trading in the UK? Sara, this website is brilliant. Thus far, every single company has final lettered me stating not upholding my complaint, bar one – Safety net credit, which has offered to pay me back my interest of £105.
I have referred the majority to the financial ombudsman, Uncle Buck, QQ, Sunny, Satsuma, you name it. I’ve had some 60 plus loans with these companies over the years.
I have also referred unsecured loans from 118, and Bamboo loans. What is your experience of people getting money back through these sort of companies?

Lots of people have won complaints against 118 and Bamboo, but they are slow. If you have financial problems at the moment and owe balances to these companies, I suggest you look at a Debt management plan while the complaints go through

If they say they don’t accept complaints by email, say you never had a bounce back from the email you sent to the Ombudsman will treat this as having been validly sent and say your case goes to the Ombudsman in a week if they haven’t given you a a suitable offer.

Is there any way to check who you had payday loans with and when?? I have sent standard letter to everyone i have every had a loan with, but not sure if I had others at the same time. Most just reply saying they dismiss my claim. I don’t have old bank statements or anything, is it still with trying to claim. For example loan with handt was for £500, paid back £950 over 7 months.

It normally isn’t worth bothering where you only had 1 loan from a lender unless it was large. £1000 definitely. £500 – that is pretty marginal.

There is no mention in the latest report (https://find-and-update.company-information.service.gov.uk/company/07112031/filing-history) from the liquidators of collecting in any loans or selling the loan book on. I suggest you wait until someone contacts you about this – it may never happen.

I received notice from Uncle Buck’s administrators today that my claim was upheld and I am entitled to redress (£51) but it will not be paid due to lack of funds in the administration. They also stated that they will be removing all records of my loans from my credit record.

Thank you for all your help so far – I’ve managed to clean up my credit report and get a tiny bit of redress from companies.
I am trying to look into my liability in continuing payments to ACS who are collecting on behalf of DHR Capital/ Toothfairy Finance. I have no doubt that this loan was definitely unaffordable, however I worry I’ve left it far too late to do anything about it. All records have long dropped off my credit report which is great, but I’m still paying £10 per month to ACS – my balance still stands around £800 and I’m certain that it’s entirely ancient interest I’m paying now. Is there any argument for stopping payments with ACS based on the unaffordability of the loans in the first place, or is it something I just have to suck up and continue reluctantly paying for 80 more months?

I have a balance of just over £1200 I am paying to Peachy. I have just seen that the deadline to claim has passed – 12th Dec 2020. Does this mean my loan wont be looked at at all? I am gutted I missed the deadline if this is the case as I was sure it would be wiped. I have been in a DMP for the last year and it was this loan that pushed me into it. I thought they would contact me directly – this is what has happened with other lenders – Payday UK, Sunny etc.
Also, I had a loan with Uncle Buck, and was paying through my DMP. They had it passed to Conexus. The balance was over £600. I received a full and final offer for repayment of £97 – which I paid as I thought it was too good to miss. I received an email from UB telling me my account is now paid. However, now when I log in to my Uncle Buck account my balance is -£97, and to contact them because I may have mad an over payment. Do you have any idea why this has happened? did UB wipe my account? I have had no other contact from UB.

So you hadn’t complained to Peachy before? Why not?
If you have other high cost debts in your DMP complaint to them now, don’t wait until the lender goes bust and hope they contact you.

Thanks for responding. Yes, I did complain and they rejected it. Then they went bust very soon after this. So I’m wondering if I needed to put in another claim (and missed deadline) for them to consider wiping the balance on current loan, or if I’ve completely missed out and continue paying loan off.

I’ve emailed an affordability complaint regarding loans taken from money boat…
I took a total of 6 loans from April 2015
They were all taken straight after one was paid off …First 3 was for £200 3rd was for £350 and 4th and 5th loan £400 each, last loan defaulted and took 8 months to pay…they have responded with a fully detail email showing my disposable income at the time etc and they said they have mot acted irresponsibly etc but have offered to pay me 50% of all interest paid ..I paid a total of £449 they are offering to return £232 plus removing the negative default info on my file….
Do you think this is s a good offer or do you think I should go to financial obunsdman to get all interest refunded..my concern is I don’t want to lose the deal they are offering if financial onundsman cannot get all refunded?

Yes the below is what I borrowed and how much interest I paid…the last one was paid off over 8 months as went into arrangement plan and last payment was January 2017
Laon1 borrowed £200 paid £32.18
Loan 2 borrowed £200 paid £71.32

Loan 4 borrowed £350 paid £79.98
Loan 5 borrowed £400 paid £116

It’s not the worst offer I have seen…
If it went to FOS, then FOS doesn’t normally uphold the first few loans. In your case there is a good chance that they would say Moneyboat should have looked more closely at loan 4 – yopu had 3 loans before and now you were trying to borrow a lot more.
That would be a refund of £310 plus 8% intererest would be £400+
If FOS only upheld the last two loans, that would be a refund of £236 plus 8% interest = £300+
You could go back to them and say you would also get 8% interest on the loans, you think FOS would uphold from loan 4 onwards but in the interest of a speedy settlement you would be happy to settle on £350.

Do you have any indication of what progress is with Piggy Bank and 247 Moneybox? Both have confirmed they will be refunding me – Piggybank was in Feb so not long ago, 247 moneybox was sometime last year and I’ve heard nothing off them for ages

I am hoping someone can help me, I had an outstanding balance with Uncle Buck which had been passed to a debt collector. I have now settled with the debt collector, but there is an outstanding sum of £19 showing on my CRA report for Uncle Buck.
Anyone know who I should e-mail to get this marked as settled?

The debt was settled at the end of March for an agreed 40%… It was the company Uncle Buck informed me they had passed the debt to, and they said Uncle Buck had agreed the 40% offer (as they had proposed it not me).
My credit report never shows me as defaulted, just a year of missed payments, but as my only outstanding loans are this and MyJar (actually settled March 2020) I am eager to get it all tidied up.

I suggest you wait another few months and see if the credit report gets corrected.
If not, I suggest email the administrators and ask them to do this.
If you get no reply from the administrators after that, then you can contact the credit reference agencies and ask them to suppress the credit record as it is wrong but you cannot get a reply from the administrators about this. you may be eager to get this sorted, but by waiting a few months it is quite likely you will be able to get the whole debt effectively removed. It is too soon to do this now.

I’ve had my 247money loans redressed but it turns out I have two account with different emails and been told that I have only accept one of the accounts by the deadline. Didn’t even realise, anything I can do? I’ve emailed 247 and they said I’ve missed the deadline :(

Hi Sara I received and email from piggybank saying Upon reviewing my account, I can see that you have not responded or made arrangements with us after the various calls, texts and emails that have been sent to you over the last few months. This is very concerning.
I now only have two weeks to help you take positive steps to resolve your long outstanding account. The account has been looked over by the Head of Recoveries who will be looking to commence Court proceedings against you to recover your outstanding balance if we don’t come to some sort of arrangement. Can a company in Administration take you to court. I think they have been under administration for 20 months now.

The loan was taken out in Feb 2017. It was for £750 the balance is now £1500. About 4 weeks ago I made an affordability claim and the next day received email with final response saying no that piggybank did everything right. I told them that I was borrowing from one payday lender to pay another. I also told them that my income was different to what they had at the time, they still rejected it and told me to go to financial ombudsman and I did but they wont look at it because they are in administration and piggybank knew this. I had 3 loans in total the first two I paid of within the month so I could get another. I never made any payments to the £750 and have had no contact from them until the complaint was made. I am a single parent not working and struggling on benefits.

As a matter of practicality, the costs of doing this, and then keeping a case open for the length of time it would take to get the monies in make it uneconomic for the administrators to take you to court.
You may think that is worrying and uncertain. But look at what they would have to do….
To start a court case they first have to send you a Default Notice (they may have done that a while back)
– Then they need to send a Letter Before Action which has a Reply Form with it. You can sit on this for 3 weeks and then return it saying you are taking debt advice and asking them for documentation.
– They then can’t go to court for another 30 days.
– After 25 days of this you can talk to a debt adviser who will set up a breathing Space which means they can’t go to court for 60 days.
– And when you do get court forms you reply defending the claim saying the loan was unaffordable – defended cases took an average of 9 months to come to court in 2019 – and the backlog has got longer since the pandemic.
– At the end of which you would get a CCJ and you could offer them £5 a month.
They do NOT want to go to court, they are just hoping to scare you into offering a settlement.
I assume you don’t have any money to offer in partial settlement? You should NOT borrow to try to do this.
Do you have other problem loans as well? Are you behind with any bills? Because even if you had won the affordability compliant you would still have owed the £750 which you cannot afford to repay.

Hi Sara Thank you for your speedy reply. I have a catalogue but from 2014 this was passed to Cabot financial who took me to court in Dec 2019 and a decree was registered. I should have taken advice then. The solicitor for Cabot is Nolans and I said to them that the debt was already statute barred and they came back with no your last payment was Jan 2016 and so on. I asked for a credit agreement and was told it was to late as I should have asked at the beginning. The debt now stands at £2270. I have agreed to pay £20 a month. If I had money I would have accepted the partial offer for piggybank but at the moment it is hard times. I have had the default notice so I will wait patiently to see if I get the letter before action. Can I ask how long does Administration last. I believe it was Dec 2019 it started that is 20 months to date. Thank you very much for your helpful advice.

I think you should take debt advice now. With one CCJ already, another one isn’t a disaster, but that’s two debts you can’t afford to repay… it may be sensible to look at a debt relief order (if you are eligible) and get rid of both of them. I suggest you phone National Debtline on 0808 808 4000.
Another option is to reduce what you pay to Cabot to £5 a month and offer £5 to Piggy Bank.

Good evening,
I was wondering if you could help.
I have previously written to a number of lenders and complained about the loans I had with them. At the time, I had a rather bad gambling addiction, was struggling with anxiety/depression, and was unable to gather the evidence required to support all of this and, therefore, when the lenders came back declining my complaints, I didn’t escalate and these matters went no further.
I would like to try to complain about these matters again but I am unable to complain about the same thing. The FoS also will not allow me to go straight to them.
Any suggestions?

I am sorry but there aren’t any other options here. Unless a lender was careless enough not to tell you you had the right to take a case to the Ombudsman, then you are out of time.
