How to get a payday loan refund

Did your payday loans cost so much when you repaid one you had to keep on borrowing?

You can get a refund of the interest you paid on unaffordable loans.

It’s easy to ask for a payday loan refund using the free template letters here. The letters work if your payday loans were repaid or if you still owe money.

This article covers everything you need to get started. It’s easy, free and many people are winning large payouts.

What are “unaffordable” loans?

Was a loan affordable just because you managed to repay it?

No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!

The regulator says:

 “the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”

That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.

Payday loans are meant to be used to solve a short term problem. If you kept rolling a loan or repaying one then getting another loan soon after, the lender should have stopped lending to you.

If the loan was small and it was the first loan or second loan from a lender,  the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.

How much compensation can you get?

You don’t have to calculate this. Or work out which loans were unaffordable.

Just ask for a refund from the lender and see what you are offered. This is simple and it works well.

The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.

Payday loans are meant for short term problems and the lender should not have carried on giving you loans, A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.

But if your first loan was large, or was rolled over several times you could get a refund from just one loan.

Which lenders can you get refunds from?

You can complain to lenders that are still in business, even if they are no longer lending. These include:

Lending Stream, Cash Converters, CashASAP, CashForUNow, Dot Dot, Fast Loan Uk, Fernovo, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, Smart Pig, QuidMarket, Savvy, WageMe, Wizzcash,

Also use these letters for the very high-cost sorts of “flexible credit”. These have the highest uphold rate (80%!) of any product at the Ombudsman in the last quarter of 2021. The largest lender is SafetyNet Credit – other lenders include Drafty, Polar Credit and Tappily.

If the lender has gone into administration, including Myjar, Piggybank, Ferratum, Oakam:

  • you can make a claim to the administrators  – there is normally have a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
  • you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.

QuickQuid, On Stride, Swift Sterling, Sunny, Wonga, Wageday Advance, the Money Shop, Payday UK, Payday Express, Uncle Buck and other lenders who gave up years ago – it is now too late to make a complaint about these lenders, see this list.

First, before you send in a complaint

Doing these things now will make your life easier later.

Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman. Don’t get an Experian or ClearScore report instead – many payday lenders don’t use those.

If you can log-in to the lender’s website and see your loans, take a copy of them. If you don’t know the details, don’t delay making a complaint by asking for them – use the template below to complain and ask for the details at the same time.

If you still owe money to the lender:

  • unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
  • read the Stop making payments? section in Payday loan refunds when last loan not repaid. If you want to offer a lower affordable amount, add a sentence to your complaint letter saying this.
  • if you have a lot of borrowing at the moment, read Escape from the payday loan trap which looks at how a debt management plan can help you.

If your loan was sold to a debt collector you still complain to the original lender but also tell the debt collector that you are disputing the debt. Don’t skip this bit or a debt collector may go to court.  It is a good idea to carry on making payments to the debt collector if they are affordable.

Start your complaint & get loan details

You can find the lender’s email address for complaints from this list.

Put “AFFORDABILITY COMPLAINT” as the subject of your email:

I am making an affordability complaint to you about irresponsible lending.

You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.

You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]

[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]

I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.

[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.

[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector. 

[Only put this bit in if some of your loans were more than 6 years old. This explains why you haven’t complained before. It’s only an example so don’t copy it, change it so it covers what happened to you!] [I didn’t know that the lender was supposed to check that I could repay the loan without having to borrow more. I only found out in [date/month] when I saw a newspaper article in the Sun/an advert on Facebook for payday loan refunds/a friend said they had made a complaint/whatever.]

Some ways to improve this

You can add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows that!

Some examples:

  • “I took out another loan with xxxx to pay you.”
  • “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
  • If you weren’t treated fairly while you were borrowing or when you could not make a payments, add a bit about this.

Don’t worry that the lender will say you should have cut back on your living costs.

You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.

I don’t know if many lenders actually read what you send them. But it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.

Only one loan?

The template refers to multiple loans because that is what normally happens with payday lenders.

If you only had one loan and it was large, read Refunds from large loans and use the template there.

If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.

Waiting for a reply from the lender

This email begins your affordability complaint.

They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.

When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.

The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.

Don’t be surprised if you have to wait until the end of the 8 weeks to get response, this is common.

Send your bank statements or other information?

Some lenders ask you to send them a copy of your credit record, your payslips or bank statements.

Credit record – this is mostly to be difficult – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.

Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.

It is a good ideas to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.

Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.

Lender says No or makes a poor offer

If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!

It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.

Give up?

Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!

Just ignore any of the following comments, they do not mean you have a weak case:

  • they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
  • you repaid some loans early  – this doesn’t prove the loans were affordable, just that you were trying to save interest;
  • your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
  • you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
  • your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!

Will a lender improve an offer?

You may be wondering if you should go back and try to get the lender to give you a better offer. Most lenders won’t do this, but a few may if you make out a good case – this includes Mr Lender and SafetyNet Credit.

For example if they have offered to refund loans 6-12 you would be happy if they included one or two more, you can say why you think loans 4 and 5 should also be refunded.

A good enough case to go to the Ombudsman?

If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.

Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.

Some points to think about:

  • if you are offered a refund on only a few loans, don’t accept if you think you paid a lot more than that in interest. Some lenders offer a few hundred pounds to people who get ten or twenty times as much from the Ombudsman.
  • an offer to write off your current balance may sound good … but it may be very poor if you should get a refund as well, see Refunds when you have a balance owing for details.
  • if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.

One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:

  • the loan was rolled or topped up several times; or
  • the loan was large. Here is one single loan case that was won even though it was an instalment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
  • you still owe money.

Don’t delay too long  – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS – it’s easy – and let them decide.

How to send a complaint to FOS

Put in a separate complaint about each lender.

Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!

One reader said: They couldn’t be any nicer.

The Chief Ombudsman, says:

It’s really OK to phone up and say, ‘I don’t think it was fair.” It’s not court; you don’t have to turn up with your ‘heads of claim’, you don’t have to write a fancy letter. Tell us your story and we will do the rest.

FOS’s “complain online” option is easy and takes you through your complaint step by step.

You can just copy what you said in your complaint to the lender. Or you can add more details, for example, if you disagree with what the lender replied to you.

If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:

“I knew the loans were causing me difficulty in 2013,  but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2021 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!

Things to attach:

  1. the reply you have had from the lender.
  2. bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
  3. a copy of your TransUnion Statutory credit report.

What happens after you have sent a case to FOS

You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.

After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.

If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.

The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.

A few problem cases

Don’t ask for a refund:

  • if you are bankrupt now or have been bankrupt in the past  – any refund would go to the Official Receiver.
  • if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
  • if you are in a DRO now, getting a refund may mean your DRO is cancelled!

    No Sara me lender doesn’t show on my credit record. I just wanted them to admit the loans were unaffordable.

      have you checked all three credit reference agencies? Experian, Equifax and TransUnion? It may be under the name of the debt purchaser not Mr Lender.

    Hoping you can help, I am looking to place affordability complaint with everyday loans due to loan I took out few years ago – the loan is fully paid etc and account closed. When i took it out at the time they knew it was to pay other payday loans off as they went through this in the meeting and asking for screenshots when i paid these. I was just hoping for advice on where to start? Thank you

    Hi Sara
    If I forward a complaint to the FO will they need to see old bank statements? As I don’t have access to that old bank account anymore ?
    Also if for example safetynet go into administration while my complaint is being looked at, is there a chance I won’t get the original offer they have given me ?

      Safetynet Credit should have kept those details.
      For the more recent account you should be able to get old statements anyway, even from a closed account.

      If they go into administration you could lose out, that is a risk. I have no reason to think that is likely but there must always be some chance.

    I complained with Loans 2 go who didnt uphold the complaint. They kept texting about the loan so I asked them to stop (for about the 10th time). They replied by saying because I don’t have an arrangement to pay in place that the messages can’t be stopped.

    My reply was that they needed to acknowledge that the loan wasn’t affordable in the first place and that it’s now with the ombudsman. They just replied ‘Could you please confirm if you are looking to make a complaint regarding your loan?’!!

    Hi Sara,
    I put in an affordability complaint and complaint about the rate of interest to loans2go as per your article. The below is their response. I have just read a comment from someone which is quite old but they were advised to go back to loans to go after they received an offer to wright off half their outstanding balance (which is what I was offered) and ask for all their interest to be refunded. Is this still what you suggest? This is the reply I received in relation to costs/interest and refunds (the first loan was repaid early as my partner let me transfer my balance on some loans to his interest free credit card and I repaid him.)

      This depends on your situation.

      So you paid about £510 interest on loan 1. but there was then a large gap until the second loan.

      What is the rest of your current financial situation? I am asking because I guess you must have been desperate to borrow from them again knowing how horribly expensive they were the first time. Do you have other high cost loans, credit cards or catalogues? Do you have defaulted debt – are you making payments to that? Are you behind on any important bills, rent, council tax, energy etc?

        Thank for your reply. Yes I was desperate, I was making repayments of around £500 in total over several loans (with about 5 different providers I think) over the Christmas period. I defaulted on 2 of the loans. All priority bills are up to date but they are paid by my partner not me.

      If you were in an OK situation, then you could just try to get a bit more off the balance and start repaying it.
      But with a lot of other problem , you can’t pay much if anything to this, can you?

      One option is to go back to l2G – who will often negotiate – and say that as you paid £510 interest on the first loan, which is more than you borrowed on the second one, unless they clear your balance you will be sending the case to the ombudsman.

      Another option is to talk to National Debtline on 0808 808 4000 about your whole financial situation. Your partner should not be paying all the bills so you can pay your debts. National Debtline will explain what your options are, this could include a debt management plan or a debt releief order, see https://debtcamel.co.uk/debt-options/dro/. If a DRO is a good idea for you it will wipe all these debts and there is no point in stressing about trying to negotiate with your creditors.

    Anyone here had any experience claiming from Mr. Lender?

    Sent in my complaint on the 22nd of March and they got back to me on the same day and asked for bank statements which I promptly sent. A few days later I received all my loan history in the post. I know they have up to 8 weeks to respond but has anyone had much luck in claiming? Have listed my loan history with them below which are all fully repaid:

    I sent an affordability complaint to mylar with one of your wonderful templates Sara and 3 days latter I received an email that they have moved me to ACI a debt collection agency. I have written asking what is the status of my claim and they wrote back saying to speak to ACI and start making payments to them for the money i owed from 5 years ago. They said they will respond to my complaint but not for 8 weeks. Is there anything else I can do as I feel like there fobbing me off !!!

    Hi all, I am one of those people that fell into the whole payday loan vicious circle and was lucky enough to receive payouts from QQ today.
    Now that is that issue sorted I took loans out with Lending Stream too but can’t find any details as it was back in 2013 and my bank statements only go back 7 years.
    Am I able to put a complaint in to LS as it’s clear I was in a spiralling mess back then?

    Hi So My Myjar debt was being paid off through Overdales. They stopped collecting last month and advised ACI would be taking over the account.
    I had previously put in an affordability complaint with Myjar and was advised to register for a redress payment, which I did and am still awaiting an update on that.
    I have received an email from MYjar this morning advising that my account has been transferred to ACI but that:
    Access to your online account with MYJAR will continue for a period of time, although your ability to make payments to MYJAR is no longer available.
    The Credit Reference Agency (“CRA”) records are being updated for this transfer of ownership.
    You may notice when you receive contact about your balance, that it is less than you were expecting. Since their appointment, the Administrators of MYJAR have undertaken investigations into the historical lending practices of MYJAR and have determined whether a loan qualifies for Redress. They have now concluded their investigations and will be writing to customers whose loans have qualified for redress to provide further details on any balance reduction if applicable. If you do not receive a letter confirming a balance reduction, then your loan did not qualify for redress.

      So an update

      I have just been contacted by ACI and my new balance is reduced to £77 from the £1000 I was due to repay when Overdales stopped collecting.

      Great result, I will be using my QQ redress to repay this immediately.

        I’ve given mr lender my previous as well as current address and DOB etc, in terms of tracing previous loans and they say I haven’t satisfied their ID procedure and to send a photo of me holding up my drivers licence! I’m not quite comfortable doing that. Anyone else had this issue?

    Offer reduction £405.03.
    Balance after offer £643.36.

    So they’re not prepared to ad it it was unaffordable so it’s with the Ombudsmsn now anyway.

    Is there any way to you can resend a complaint to a lender who previously denied a claim and it wasn’t sent to to Ombudsman within 6 months.

    Can you request for your account history to be reviewed under different specific criteria such as specific information on your credit report

    With Quickquid I was able to get a refund before the redress and another payment during the administration so just wondering. Also the company have updated ita criteria for what is deemed unaffordable.

      No there isn’t.
      Unless the lender did not tell you you had the right to go to the Ombudsman OR there was some real emergency that means you couldn’t go within 6 months, there is nothing you can do.

            Lending Stream should respond about all the loans including the ones that were sold on. If the loans that were sold are upheld as unaffordable (and with 7 ! that sounds likely) then LS has to sort everything out with the debt purchaser, including cleaning your credit record. Come back and say what happens?

            They sent me details for 7 loans which included dates and amounts etc but for the 7 that were sold they only gave me the loan number so no dates and amounts for these should they include the 7 sold in any amount they offer me?

        I used the template, sent an email stating I couldn’t afford the loans and should never have been given them and they emailed back 6 days later and said that of the 4 loans I had 3 were affordable but the fourth one should have been looked at closer so while accepting no blame and as a good will gesture would I accept £618. I clicked the link in their email to accept it and 5 mins later it was in my account

    We’ve spoken before x
    So I had 2 accounts with safety net. The 1st account they agreed to refund me the interest on and the second they said I owed £575 and they rejected the redress.
    I excepted the redress on the first account and on the second account I did not respond as I had intentions of taking it to the FO, as it makes no sense that they excepted redress on one and not the other. Anyway I recieved my redress tonight and they deducted the debt from the second account from it ! Can they do that ! I didn’t agree to that. There 2 separate accounts ! I’ve written just now to the FO regarding this, do you think they were wrong to do that ?

    Do you have any advice for claims against Morses? I had 12 loans in total (amounts of £300, £500 and £600) 3 loans at a time while I was unemployed and desperate. I put a complaint in a couple of months ago but they just keep saying they need more time, do you think I have a chance? Do I just wait for them to respond? Thanks in advance

      if it has been 8 weeks, tell them it goes to the ombudsman if you haven’t had a reply by Friday next week.
      This sounds a good claim and you should expect a lot of the loans to be upheld.

      Maybe they are looking at the customers who still owe loans before they look at others

    Folks just got an email from Harrison’s re the myjar redress –

    Hi,

    Unfortunately, there is no update yet.
    Should you qualify for redress, you will be sent an email. We haven’t started the redress communication yet and we anticipate it to be started within the next few weeks.

    I’ve emailed back and stated on their website it advises April 30th and that people are anticipating some correspondence by then, if there’s a delay to email the relevant audience and make it known.

          Hi I emailed myjar 2 weeks ago and she emailed back saying they were running behind, emails will be sent soon. I’ve looked at there website today and it now says if your due a redress thru will start and be sent from 15th may and money to be paid by the end of June, which was originally to be paid by end may. Tbh I don’t think it’s anything to get excited about as on there website this morning it says they expect to be between 1p-2p in the pound. So it doesn’t even sound like it’s worth doing the bacs payments for tbh, I think I will be lucky if it’s £30 🙈

        I think you were supposed to claim tbh, I did a while ago and just waiting on the response. They were supposed to send an email to people if there claim was upheld by tommorow but that’s Saturday so don’t think it’s coming, she did tell me they were running behind schedule and a response if it’s successful will come in a couple of weeks 🤷‍♀️

    How do people generally when making complaints to Morses? Had 12 loans between June 2019 and October 2020 all either brand new loans or reloads as soon as the came available. This was while having loans with provident, uncle buck and a number off defaults and one CCJ:

      Just be aware of the standard response you’ll get from them saying they’ll get you for fraud if you’ve been found to have submitted fake income and expenditure and salary when you first applied. They do it with everyone.

      This is what the administrators have told me about loans that were sold to a debt collector before the administration started:

      “we have worked with the various debt purchasers to ensure those loans that were deemed unaffordable were either closed or have had the appropriate set-off applied.”

      So the administrators should have worked this out with PRA. I can’t tell what has happened in your case.

    Hi All,

    Does anyone know anything about THL Direct? I had loans with them in 2014 on which I eventually defaulted before me they were sold to PRAC Financial and are now being administered by BW Legal.

    THL tell me they have ceased trading and informed the FCA that all balance are now zero. How will this work for a debt that is already sold? Also, does this mean my affordability complaint cannot be addressed?

      I put in a complaint on April 15th – I got a load of info from them on the 29th about past loans and interest paid etc
      I replied asking when I’d receive a final response I got an email on the 2nd referring me to their complaints procedure – could take up to to 8 weeks etc so trying to forget about it until I hear anything now.

    I raised an unaffordability complaint with cash converters two weeks ago, they said it can take up to eight weeks.
    I hope it isn’t that long. Strongly believe and hope they I hold my complaint as I was unemployed, on benefits, gambling and in mountains of other debt plus a CCJ.
    Do you know if they are usually good with refunding?

        I’m with Stepchange and pay an affordable amount each month and credit cards/loans have froze the interest.
        I’m in a better place, going through the last few complaints now. Had five refunded and now just waiting on cash converters/ provident/my jar and piggy bank!

    My complaint has been upheld last year and they said that they would refund all interest and charges but then below it states it’ll be significantly smaller.

      Sara how is the 8% interest calculated is it that we get the full 8% or will that be given it at 1-2 pence for every pound?

    Hi Sara I’ve just used ur template and put an affordability claim against safety net credit and I’ve just had a response stating they’ve got 8 weeks to get back to me. Bearing in mind I had to go in to a debt management plan to pay them off and everytime I’d pay them back I had to borrow again so I just really wanted to know what’s the success rate with then as not a lot in the comments regarding them. And further more they had access to my internet banking seeing that’s I was always overdrawn by 3000 the whole time I used them.

      SafetyNet have a somewhat mixed record. They sometimes make a good offer but often make a poor one – If they make a poor one they can sometimes be persuaded into increding the offer, so come back here and talk about your offer if you aren’t sure?

      In the last quarter, the Ombudsman had an uphold rate of 80% for short-term lending (running account credits) which is their name for this odd sort of credit. SNC is much the biggest provider of this sort of credit so they are losing a high proportion of cases.2running account cr

    Hi I just made a complaint to lending stream like 10 days ago I’ve had at least 15 loans with them all unaffordable. Up til today I could see all my loan history now it’s disappeared for what ever reason . I did screen shot each loan I took out but is this something to worry about and how long does it take them to give a final response thank u

      Hi Jo, my loans vanished too and I got a really quick response from them saying not only were they refunding all the interest etc but they were wiping them from my credit file. I thought they were one of the best and easiest to deal with.

      They have simply said to me that I told them I could afford it and what I owe is still due

    Hi I complained to safety net in thr 15th of march and have been told I will have a response by the 20th of May. Does this seem quite drawn out to you? Some have been sorted in days? I have noticed they have re opened it on my credit file.

      Lenders are allowed 8 weeks to reply. Many take all that time.

    Is it likely to be similar to what provident are paying 4-6%?

      Hi I am waiting redress from my jar. They were running behind in sending emails so on there website it now says by the 15th may, there payout, if accepted isn’t looking great it says between 1-2p in the pound so it’s not great 😓

    Just wondering about refunds people have received for payments made to loan companies after they have gone into administration. I have carried on paying my loans at home loans but just wondering since I have seen payments from provident if I should continue to do so? I always thought that the loans remain active so need paying or is this something different?

    Hi Sara,
    I have sent affordability complaints to all the companies I used over the years. Fernovo are the first to respond, they have basically said my complaint has not been upheld with a very detailed email. As a gesture of goodwill they have offered £160 and to remove all loans from my credit file if I accept the offer and withdraw the complaint.I don’t really want to drag this out with the ombudsman but I have no idea if this is a good offer or not. I understand you must be busy but any advice would be much appreciated. I can forward their response over to you if that’s possible. Thanks

      can you summarise how many loans you had from them, how large they were and how much interest you paid?

      Have you downloaded a copy of your credit report to keep that shows these loans – you do not want them to delete loans until you have done this as otherwise with a case that has to go to the ombudsman, you won’t be able to produce a true copy of your credit record including all the Fernovo loans.

        14 loans over 42 months ranging from £100 to £400. Total borrowed was £4100 total interest paid was £1800. I haven’t downloaded my credit report yet, I will do that tomorrow.

            Mostly 3 or 4 months. A couple were 5 months. The majority were paid off early. Normally to allow me to pay the final payment and borrow more straight away. The breakdown of loans shows that some of them were paid off early and then I took out a new loan the next day.

    Today is the last day of the 8 weeks that safety net credit have to answer my complaint. Still not heard from them yet. Feel like they maybe are deliberately waiting 8 weeks not to give me a result or a knock back to drag the process out. What should I do if I don’t hear back?

          I accepted the offer they said up to 5 working days to pay out (this was direct through safety net not through fos) they paid on the 3rd day

            It was actually over 8 weeks, I sent them an email on the final day and said I expect an email with the result by the end of the week of it will be going fos, they came back next day with the offer

      I just read the below statement on Harrison’s/Myjar Q+A page for anyone still awaiting a response to their claim…..’If you do not receive an email by 30 April 2022, but you had previously made a complaint, it should be assumed that your complaint has not been upheld as no Redress is due to you. As indicated above, due to the volume of customers and value of total customer claims, it is simply uneconomic to respond to all customer complaints individually.’

        Hi Sara l put a claim in with my jar there reply to me was the did not have any record of loans except one got£53 back the A C I took over trying to to tell me that l owed money on outstanding loans funny they find paperwork when they think you owe them when l first claimed unaffordable loan My Jar said there loans are not unaffordable because they never issue a loan untill previous one is paid off l sent my paperwork to A C I who got back in touch apologize to say l did not owe anything keep documents and don’t let these companies rip us of again

          I honestly don’t think Harrison’s or Myjar know what they’re doing at all. The amount of grief I have had with them selling off a loan despite knowing that I had the right of offset is incredible and funnily enough aren’t prepared to compensate me for their mistakes.

        They updated their webpage somewhere on it it states its now the 15th of May we should hear by, which is tomorrow, I doubt we will get an email on a Sunday then further down it says they expect to pay between 1 and 2 pence in the pound so really its not worth getting excited about, unfortunately.

        I borrowed off them a few years back when finances were bad and I was already in a £1509 bank overdraft then borrowed more money to pay it off but unfortunately borrowed again off them last year up to £1000 and can’t make minimum payments also still have £1500 over draft and bad finances

      In that case I think you need to do two things. First send the complaint to the Ombudsman – Drafty should have seen that your finaces had not got better at the point you asked to borrow more money.

      Second ask Drafty for a payment arrangement and for them to freeze interest. An Ombudsman complaint can take many months to go through and you need to get yourself into a safe finacial situation while it does.

    The Joint Administrators have already assessed all loans provided to you by 247Moneybox to determine whether you are due redress. You would have received an email notifying you of this.

    This email was sent to the email address we have on file for you.

    The deadline to log in and view the outcome of your redress and take necessary action regarding the assessment was 31st January 2021. The deadline has now passed.

    Everyone seems to have positive things to say about Lending Stream yet I had 7 loans from them in a period of 2 months and they rejected my complaint saying they conducted all the necessary checks

      I got the same response initially but I got onto them again and it was looked at, refunded, loan records closed down and credit file wiped in a matter of days.

    Hey,

    So I have basically put forward a complaint to Moneyboat for 3 loans over the course of 2 years and bar their threatening response I still sent them my bank statements based on the threads I have read on here. They responded back implying that based on their research they had lended to me responsibly but not only that, if I am “claiming” still that they didn’t lend responsibly and I might have potentially put the incorrect income and expenditure they then threw out the we will need to report me to the fraud agency rubbish. They also tried to mention my first loan was paid early so how could I have not been able to afford it.

    Sounds like they have a really weak case and they’re just dishing out threats but just to confirm I am going to the financial ombudsman I just want that clarification from yourself just for that peace of mind that this is the right idea as the term fraud sends shivers down my spine and I don’t want this to be a situation that might have gone left for someone else and I’m unaware.

        so the first two were like 200-300 around that first date was oct 2020 and the next one was September 2021 then after I paid that off I took one out for £1000 shortly after.

        so to be clear I am currently paying off the £1000 one as I only took that out about 2 months ago

      It’s unlikely you would get a refund for the first two small loans. But the last loan was so much larger I think they should have looked closely at whether it was affordable.

      If you can’t afford the repayments at the moment, you need to ask for a payment arrangement – the FOS case will take a while to go through. Do you have other debt problems as well?

        Yeah so I currently have a case with FOS for money barn waiting for that to be picked up. Recently won a case for 118 loans where my interest was removed and now I’m just paying back minimum payments and I complained to Everyday Loans but they settled everything outside of me going to the financial ombudsman.

    Hi,
    Just wanted some advise. I had a loan back on 2012 from Minicredit for £200. I defaulted on this and and I believe was sold to OPOS. I have a default on my credit report in the name of Kapama. The default says Opening balance £239 – Current balance £630. I have looked Kapama up and eventually found my details still on OPOS customer portal. OPOS statement is showing the debt went from £200 to over £900 in interest and charges. I did pay some of this through Gregory Pennington but don’t recall paying anything else to them for years. I doubt there is anything I can do by way of complaint about this payday loan as I guess Minicredit have long gone but is there any way I can get the outstanding balance down as I borrowed £200 have already paid £360 yet there is £530 still outstanding.
    I’d really like to get this off my credit report.

    Hi sara and everyone else, just wanted to let you all know i sent a complaint to cash4unow on 3/4/22 and have just had an email back saying they will pay compensation for the interest on one of my 2 loans i had with them, i will accept this as although it would be nice to get money back from both loans its better than them saying no to them both! They were only a small amount too so im not going to refer it to the ombudsman as im just happy to get something back :) thank you sara without this page I wouldn’t of had anything back! Just hope they pay me soon lol

They upheld some of my loans and I am due to be paid £189 – which is a fraction of what I was owed, but something back nonetheless. Anyway, I received an email to say I would receive my money within two weeks. This time has now come and gone. Has anybody else received money from the lender? Many thanks.

        Wasn’t sold to debt collector, but marked default on credit file. Below information
        Amount borrowed: £300.00
        Length of original loan: 169 days
        Length of extension: 60 days
        Amount repaid: £524.90
        On response they have said …
        Based on the information provided above we believe we have acted fairly and responsibly. As such we would not be willing to refund any interest.
        We would however be willing to remove all negative information regarding the loan from your credit file.

        Would this mean the default would be removed?

      so it was a single loan of £300? It is very unlikely the ombudsman would agree that was mis-sold.

      Yes they are saying that they would remove the default. If you go for this (and it may well be the best you can get) then you MUST make sure you have saved a copy of your crediot record showing the default, incase you are making any other complaints, we=hen you want to be able to show how bad your crecord was with this default still on there.

    I see many who have had claims against LS gor a response and outcome within a week or 2.
    I complained on 18 April been acknowledged and sent all loans history of which there were 16 over 4 years last in 2013 and one only went to third party. I calculated that I paid back about £7.5k overall including interest!
    I know they have up to 8 weeks been 4 so far and seems longer than many have had response from them with outcome
    Could it be cause they have so many to look at and think about?? Although I only defaulted on one the last one, there was a lot of repeat borrowing after repaying last etc
