How to get a payday loan refund

Did your payday loans cost so much when you repaid one you had to keep on borrowing?

You can get a refund of the interest you paid on unaffordable loans.

It’s easy to ask for a payday loan refund using the free template letters here. The letters work if your payday loans were repaid or you still owe money.

What are “unaffordable” loans?

Was a loan affordable just because you repaid it?

No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!

The regulator says:

 “the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”

That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.

Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.

If the loan was small and it was the first loan or second loan from a lender,  the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.

How much compensation can you get?

You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.

The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.

A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.

But if your first loan was large, or was rolled over several times you could get a refund from just one loan.

Which lenders can you get refunds from?

You can complain to lenders that are still in business, even if they are no longer lending. These include:

Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam:

  • make a claim to the administrators  – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
  • you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.

It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint

Doing these things now will make your life easier later.

Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.

If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.

If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.

Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.

If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.

Start your complaint & get loan details

Find the lender’s email address for complaints from this list.

Put “AFFORDABILITY COMPLAINT” as the subject of your email:

I am making an affordability complaint to you about irresponsible lending.

You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.

You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]

[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]

I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.

[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.

[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector. 

Some ways to improve this

Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.

Some examples:

  • “I took out another loan with xxxx to pay you.”
  • “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
  • if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.

You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.

I don’t know if many lenders actually read what you send them. I

it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.

Only one loan?

The template refers to multiple loans because that is what normally happens with payday lenders.

When you only had one loan and it was large, read Refunds from large loans and use the template there.

If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.

Waiting for a reply from the lender

This email starts your affordability complaint.

They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.

When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.

The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.

Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.

Send your bank statements or other information?

Some lenders ask you to send them a copy of your credit record, payslips or bank statements.

Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.

Don’t send payslips.

It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.

Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.

Lender says No or makes a poor offer

If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!

It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.

Give up?

Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!

Just ignore any of the following comments, they do not mean you have a weak case:

  • they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
  • you repaid some loans early  – this doesn’t prove the loans were affordable, just that you were trying to save interest;
  • your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
  • you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
  • some loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!

A good enough case to go to the Ombudsman?

If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.

Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.

Some points to think about:

  • if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
  • an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
  • if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.

One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:

  • the loan was large. Here is one single loan case that was won even though it was an instalment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
  • you still owe money.

Don’t delay too long  – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is free and easy to do – let FOS make the decision.

How to send a complaint to FOS

Put in a separate complaint about each lender.

Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!

FOS’s “complain online” option is easy and takes you through your complaint step by step.

You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.

If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:

“I knew the loans were causing me difficulty in 2018,  but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2024 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!

Things to attach:

  1. the reply you have had from the lender.
  2. bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
  3. a copy of your TransUnion Statutory credit report
  4. if you dont have the credit agreements, FOS will get them from the lender.

What happens after you have sent a case to FOS

You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender FOS will use the ones they already have.

After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.

If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.

The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.

A few problem cases

Don’t ask for a refund:

  • if you are bankrupt now or have been bankrupt in the past  – any refund would go to the Official Receiver.
  • if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
  • if you are in a DRO now, getting a refund may mean your DRO is cancelled!

    Hi, I recently put in a affordability complaint to Safetynet credit due to feeling that the loans were completely un affordable , used for over 4 years consistently , was always in my own overdraft , and always needing to reborrow due to the huge chunks they took on payday as well as other debt. They can see my bank details and would have seen consistently being in my overdraft , as well as changes in my income due to changing jobs – one year my income changed to quarterly payments instead of monthly due to a grad scheme , and they happily increased my credit without proper affordability checks. Only way I payed back was by borrowing from another lender to “consolidate” . Safety net did not uphold the complaint . Should I go to the ombudsman and if so how long can it take ?

      definitely go to the Ombudsman! It’s easy to send a case, and if it takes many months to go through (this is unpredictable) then you will still be much better off at the end if you win (and it sounds like a good case). What do you have to lose?

      Just to add to Sara’s comments – I complained about SafetyNet, and they didn’t uphold my complaint: FOS said they never should have approved me an account, and should repay all the interest from the start, on the grounds that they had access to me bank account, and could have seen the whole situation there, even without CRA information etc. Obviously, I don’t know your broader situation – mine was existing defaults, late payments, massive evidence of payday lending etc – but I think it’s well worth pursuing in your case.

      My case was last year – it took about six months all in all, from putting it in with the FOS to getting a determination, and then it took about another month to receive payment from SafetyNet. I think it very much depends, though – I’ve currently got one with Mr Lender that’s still not resolved (MrL didn’t agree, so it’s gone to an Ombudsman) and it’s taken about 9 months to get to this point; one with JD Williams has been there over a year, and hasn’t yet been allocated to an adjudicator yet.

    Just wanted to say thank you for this!!
    While waiting for my Quickquid refund and saw your comments about drafty and safetynet I put unaffordable claim in on the 16th march 2022.

    Drafty have already come back to me saying they uphold my complaint and offered me a refund of £425.99 this is interest paid plus 8%. I’m over the moon with amount in all honestly didn’t think I would get anything! SO thank you 😊 hopefully will get a response for safety net soon!!!

        Ok thanks Sarah, what’s usually the turn around time for a response they have sent copies of my loans but I can’t work out the interest I paid 🙈 I know I had them over a few years and was increasing my limit started off at 250 went up to 850 got in but a of a mess but got made redundant and got a chunk of money so I was able to finally pay it off and close the account as I got another job straight away xx

        Is that a few months until they acknowledge the complaint? I complained to Lending stream about irresponsible lending but they refused to uphold my complaint so I have taken it to the Financial Ombudsman. I have complained based on my debt problem history and financial difficulties caused by a compulsive gambling problem. Not sure if this is a valid complaint or not but I feel like it is because when they asked to access my account, I feel like they should have noticed the amount of money going in from various gambling websites which indicates a gambling problem. They only had access to see the money going in and not going out of my account.

    Sorry I’m not quite sure where to find the information regarding contacting transunion asking them to quash loans where a company has been liquidated.

    I have- 24/7 money box, wageday, elevate credit, wonga and quickquid.

    Have any of these got to the stage whereby they wouldn’t reply to transunion?

      There are multiple finance companies (and utility companies) that are not listed on the Resolver website. It doesn’t matter anyhow because their service is rubbish, companies never reply to you and there is no trail to use as evidence if you need to take something to any of the Ombudsman services. You are best to go to the companies directly.

    So Draft have come back to me and offered a refund of £301.70, and wiping off the £450 I still owe.

    They have given me a breakdown of what I said my expenses were and they are not accurate. I can’t imagine putting that my portion of the rent being £250, when it was never less that £375 a month.

    How do I go back and challenge these amounts? One of my symptoms of adhd are not absorbing info and accepting things too quickly without checking.

        They gave me 29 page pdf showing all the transactions. Borrowing since 2017, total interest transactions I calculated was £3700

            They have partially upheld. Sorry, I did read that I had a right to go to the ombudsman. It says this is their final offer and if I don’t agree to go to the ombudsman. One of my main symptoms of adhd is rushing, not reading things through properly, and asking questions.

        The 9% will probably be on a redress figure that includes the 8% interest. But the amount you will be paid will not have any tax taken off it (at least that is what normally happens)

    Hi Sara.. You have been magnificent with all the the feedback you give and understanding everyone’s individual situation. For me gambling got the better of me and reading what people write on here I understand what they write
    But we I believe we knew or know what we were doing when taking out the debt. Our minds have a way of hiding right from wrong but we knew it was wrong to to take loans
    This is why I praise you for helping us.. Its hard being in debt when companies do prey on us because I know we done it for good reasons. Everyone please try to get out of debt and happy and stress free. The hard work will benefit you.

      I definitely had a claim in the system and I’m 50/50 that they told me ecactly how much it was… but the email seems to have been lost somewhere in cyberspace, if indeed it existed at all.

      I’m at the stage where I don’t actually know 100% if I am getting anything at all from my 3 outstanding lenders – MB247, QuickQuid and Satsuma – but all should become clear soon.

    Hi all and sara, i found this page after following updates from QQ,, ive been reading everyones posts and glad to see im not the only one who got their selves into a bad situation with these payday loan companies! Tonight i have sent off emails to those i had loans with so now just have to wait and see what happens! I never would of been able to do it without the information i found on here so thank you for that! Hopefully i can get something back out of the hundreds/thousands i payed out!

If I remember correctly, the original redress sum was something like £580…ish, although they haven’t sent out the breakdown yet, I presume they will soon. Oh well, it’s something I suppose, much higher than ICL that’s for sure lol

    Has anyone heard anything from myjar yet? It says on the Harrisons page if you do not receive an email by 30th April you will not be receiving any redress.

      I had a response that they sold my loan on (strange because I paid off my debt) to a company called ACI and I had to prove to them that I paid the debt. I later found out that anyone who has had their debt sold on to ACI have no redress due to them and their claims are not being upheld so no news is good news. Good luck x

    I have received some responses from lenders, my question is if they offer to pay off an open loan, but deny the complaint and refuse to acknowledge any wrong doing.. Can I at that point still take the refund and choose to go to FOS to see if I can get more?

      No. Their offer will be made in full settlement of your complaint, if you accept it you cannot then go to FOS.

      Who is the lender? Did you have previous loans that you feel were also unaffordable? How large was this last loan and what balance are they writing off?

        I was in a similar position but also found out that they sold Mt debt to lantern so I’m confused, you can’t ring because there number is no longer in use because of Covid and haven’t as of yet replied to any emails

    I just had this response from lending stream, can anyone advise what i can do next regarding this? They payed me a sum of money last year in relation to one loan i had with them but not the other one which i think was for a larger amount! Any help on the matter much appreciated

    This is in reference to the recent correspondence received on 3rd April 2022.

    We understand you are concerned about the affordability of loans offered to you. When we looked into it, we found that we have already investigated your complaint raised in past. As we shared our final response with you on 5th November 2018, we consider this to be closed and we will not be revisiting the matter again.

      What they offered was in final settlement of your complaint. If you felt another loan should have been included, then you should have taken your complaint to the O budsman. You can’t now make a second complaint.

        I made a complaint to them way back when in 2018 and dont think they did anything about that, but last year i had an email from them regarding one of my loans saying this :-

        As an outcome of a periodic review of our customer files, we identified that the checks done on the loan mentioned above did not meet our usual processes.
        We are therefore crediting your loan account.

        But that was only in regards to one of the loans i took out aith them, do i have any case for the other loan at all? If the checks didnt meet thier standards for the first loan they probably didnt for the second either? Thank you

          ah… I suggest you go back to them and say exactly that – say you would like either all your loans reviewed of *this* specific one. And say you will be asking the Ombudsman whether in the circumstances they can look at the case if LS refuse.

    Hi, I have heard today that the ombudsman agree to 16 door step loans ( same company) shouldn’t of been offered to me and advised all interest and charges for these loans to be refunded. They have been given until 16th April to respond. Do they tend to agree with what ombudsman say? Or is it still a long process?

    Ive seen lots of people have been getting 24/7MB redress in their banks, i have a claim with them but not received anything yet, does this mean i wont be getting anything or just have to wait longer? Like many others there is no info on my claim portal about if/how much i will receive. I have emailed and asked but no reply yet :/

    I’ve used your templates and advice (thank you) as i genuinely believe i have fair grounds for claims as guided by your information i.e levels of interest, having a low credit score/multiple lines of credit at the time; two responses so far are very aggressive in terms of saying ” if we investigate this and find you did not tell us your levels of borrowing etc. you may have been committing fraud and we will report you to the relevant agencies”. Is this a typical response, trying to put you off, or just them saying what they are obliged to?

      Several lenders such as Moneyboat send this sort of reply. So far no one who has ignored it and sent the complaint to the Ombudsman has had any further problems with it. They are just being unpleasant and hoping to put you off.

        thank you for the feedback- oh the irony, yes its Moneyboat in question here. They have offered some repayment but ignored entirely my request to amend my credit score as for me, as my main gripe is the way they put me into default when it was only the last payment i was late with. I’ve responded to them as per your previous advice on this matter. Thank you again- i carried much guilt about being caught in a cycle of poor credit and refinancing etc. and only reading your pages has made me realise its something i could of been helped with by these organisations rather than profited from, and indeed to have the courage to seek redress.

    Hi sara, so tonight i had this email back from Lending Stream:-

    Thanks for getting in touch.

    Before we issued the offer of a refund to you on 12th February, 2021, we made a thorough review of all the loans we’ve given you during the course of our relationship to make sure that there weren’t any others that we needed to talk to you about. The email sent on 12th February, 2021 sets out all the changes we want to make as a result of that review.

    Hence, we won’t be opening up any further investigations on the loans with us now.

    Where can i go from here? Do i email them back and say im going to the ombudsman? Is it worth the hassle over a £300 loan? Thank you your help and advice on these matters os hugely appreciated:)

      You can try to go to the Ombudsman. I don’t know if they will accept it. It’s just a few emails from you, but it’s up to you if think it’s worth a go.

    I have a question regarding the Oakam who just went into administration on 24.02.22. They have sent me a standard form back on 18.03 explaining how they are dealing with a complaint.
    On the website the information is different, similar to Wonga and QQ- you get a small % back from your claim after the full amount is known. Do you have any knowledge about that by any chance? I believe that I have a solid case against them, it also stated that I have overdraft payments for about £1500. Any kind of insights would be very helpful. Thank you

        So just to make it clear for myself- it actually will take a year to 3 years to see anything back? There are no dates on the website and no information so far or couldn’t find it. Why would they send the form saying that up to 8 weeks and decision will be made? Very confusing.

        I wrote it wrong:) They have sent me all the statements. There was amount taken, repayment amount and separately Over payments made section: I have £720 and £820 over payments on 2 loans. Those were the loans that I paid off interest and then closed it early so paid more than I should have it seems.

            And then they have enclosed Oakam complaint procedure PDF fail:

            We expect to be able to issue a full response within eight weeks for all complaints. However, if we fail to do so, we
            will write to you to explain the reason for the delay, when we expect to be able to provide a full response and how,
            if you are unhappy with the delay, you may refer the matter further.
            • If you remain dissatisfied
            Upon receiving our full response, should you remain unhappy with the outcome you have the right to refer the
            matter to the Financial Ombudsman Service. This is an independent, free service set up by parliament to look at
            complaints regarding financial matters.

            Not a word about administration way of dealing with complaints. That’s why I got so confused.

            oh just ignore that – it is their old complaints procedure. No longer relevant. You can no longer go to the Ombudsman. And you are VERY unlikely to get a response in 8 weeks.

    Hi,

    Just after some advice please.
    I have taken out several loans with Cash Converters in the past. I owe them £42 but after contacting them, the lady said that they have now stopped giving loans and so don’t need to worry about paying the remainder.
    I was thinking whether I could try and get the money back from the loans I had in the past due to unaffordable lending.
    In all honesty Cash Converters would just borrow to anyone, no credit check and also borrow to unemployed.
    I don’t have any record of the loans that I had as it was all paper based agreements. Could I ask for a copy of these?

    I have had a response from MrLender, with whom I had over £1000 of loans with and paid a lot of interest over the past few years, they have not upheld my complaint but have instead said as a good will gesture they will remove all instances of loans I had with them from my credit file. This is obviously welcome and I’d like this to happen, but I would also like to raise this with FOS as I feel they should offer some kind of interest refund as I feel it was irresponsible lending
    If I accept their offer to remove all loans from my credit file, as I’m theoretically accepting their complaint resolution, does that mean I can’t go to FOS?
    How am I best to play this please?

    I notice Avant Credit have recently been bought out. If I dispute my loan to the CRAs do you know if Avant will respond or if it is likely to get supressed? I was disputing with Avant directly but getting very little communication back, so this would explain why.

      Have they been bought out?
      It may just be that your loan has been sold. In this case your complaint will continue to be decided by Avant. Tell the debt purchaser that you are disputing the loan.
      When did you complain to Avant? Have you had a response?

    There was 5 Mr Lender loans in the space of around a year and a half for around £200 each, basically it was paying one off, then that same month or next month getting another but there was a couple of gaps
    However, the complaint mainly revolves around the fact that multiple loans had payment plans etc set up and missed payments etc, then they would accept me for another loan shortly after eventually paying it off. I am arguing that I was continuously using payday loans and also that if they can see I am struggling to pay the ones I have had with them in the past they shouldn’t really be giving me more
    Mainly, I just wonder if i accept the offer to remove them from my credit file, can I then not go to FOS as I’ve accepted a complaint resolution?

      If you accept their offer, you can’t go to FOS. Basically they are trying to bribe you with something that costs them nothing. But it’s up to you if you think it’s worth it. If you do decide to accept, you want to download a copy of your credit record now with these loans still on it. Then keep this safe for several years. Just in case you many any other complaints.

    If letters from templates had already been sent and the claims dismissed as not eligible. What happens if the date to escalate to the ombudsman is missed is there no way of redoing the letter later on to try again?

      You can only go later to FOS if either
      a) you had a very good reason for not doing it before (you were seriously ill, in prison etc)
      or
      b) the lender did not tell you you had the right to go to the Ombudsamn and that had to be withing 6 months.

          Swift Sterling loans before December 2015 were from a Malta-based lender and it is now too late to make claims about these old loans.
          Swift Sterling loans from 2016 onwards these loans were from a UK lender who has gone into administration and it is also too late to make a claim

    Can I have some advice. I have had the following loans in the past 6 months

    Fund Ourselves £300 Aug 21 (paid)
    Lending Stream – £720 Sept 21 (one final payment)
    Money Platform – £200 Aug 21/ £200 Dec 22 (both paid)
    Fernovo – £300 Sept 21/ £150 Feb 22 (last one still paying)
    Mr Lender – £500 Sept 21 (still paying)
    Dot Dot – £200 Nov 21 (still paying)

    I was gambling loads at that time and if they had done proper checks they would have seen that on the bank that they had on file. Is it worth chasing these companies for a irresponsible lending claim? Now in a better place financially/gambling wise. Is it worth a claim?

      It is very hard to win a complaint about one or 2 small loans. The Lending Stream is worth trying as it was larger, and if they had checked because it was larger, they would have seen a couple of payday loans in August.

I had a reply from Fernovo saying I passed all their affordability checks saying my affordability score was 7 on a scale from 1-7 whereas my clear score affordability is 7 out of 100! So im not sure their transunion company they use is that reliable.

          The regulator says a lender only has to make “proportionate” checks. So for the first couple of loans if they are small they don’t usually have to ask to see bank statements and so won’t see gambling transactions.

          If any lenders did ask to see your statements, or have open banking access to your bank account then YES they should have noticed the gambling and not given you a loan.

          but if they didn’t do this, the ombudsman probably won’t say that they should have.

    Good morning, slightly off topic. So whilst patiently waiting for the quickquid redress. I decided to use the affordability complaint template to send to a few previous lenders. Had a few results thus far of small loans being written off and my credit file corrected so thank you for that. However one of the lenders “Mr Lender” are being difficult. I sent an email to them which they replied by post asking me to clarify which loans and why I was complaining about, however they only included 3 loans when in-fact I have had lots of loans with them since 2013. I also have emails stating reloans and rollovers 🤔
    I have since sent them another email and replied to there letter first class recorded within there deadline. Are “Mr Lender” known to be difficult?

    Also whilst I think of it MyJar Redress. I have used MyJar since they where “txt loan”. There process seems a little cut ‘n’ shut. No room to appeal or complaint on that one apparently. They will decided if eligible for redress and that’s that. They suggest small claims court if your unhappy with their discussion as the only option is that true?

      mr Lender may have ignored loans more than 6 years old – if they don’t include these, just send the complaint to the Ombudsman.

      Myjar are in administration. You can’t take an appeal to the Ombudsman. Did they seriously tell you to take your case to court????

        Thanks for the reply Sara. I may have to go down the ombudsman path with them, but we shall see as they sending me a new statement of loans.

        In regards to MyJar, all they have said to me is I have been registered for my interest in redress.

        The statement about court came from the Harrison’s website in regards to MyJar.

        “Can I speak with you about the decision?
        This decision is final and therefore we are not accepting communication regarding the decision. If you are unhappy with the decision made, as indicated above you have the right to further pursue your claim through the small claims court.“

          Hi Steve, Mr Lender were incredibly difficult and I ended up taking them to the ombudsman. Conveniently they had sent me an email at the time of my applications showing that they knew my outgoings exceeded my income by hundreds even before their loan. In other words, they knew I couldn’t repay without further borrowing but they lent anyway! If you have emails from the time of your loans check back over the emails from the underwriters – it might provide some useful evidence that they knew they shouldn’t have lent. My calculation was at the bottom of an email asking me to confirm the figures were correct. Good luck!

    Also regards lending stream I had a few loans but can only see one on my file, I’ve got the numbers of some of the others and then can’t find the others, should I list all addresses I’ve been at during that period or should they not need this?

        They’re refunding me £310. Apparently that is also the amount outstanding. I don’t profess to understand any of this but I’ll take it.

        They’ve asked for my bank details to process the payment and admitted that ‘the credit checks did not pass our usual standards’.

        My next question is how long does it take to vanish from credit report?

          This sounds very odd. You need to check if they are clearing the balance. Or has it been sold to a debt collector?

          Changng credit reports – Somewhere between a week and 2 months. Most lenders only report changes to the credit reference agaencies once a month, so it depends how long it will be before that happens.

            It was sold to a debt collection who I complained to. They then passed the complaint back to FF who have responded as such by agreeing the loan was unaffordable and informing me if the refund.

            ok, then you need to ask if FF are clearing the debt to the debt collector and getting the debt collector to delete the default too… otherwise you will need need to use the refund to clear the debt to the debt collector.

        Hi Sara, why would that be? The FOS say they allocate in “age order”. I know they are swamped but my case is a month shy of being with them for 12 months and it’s not a relatively complex one as the adjudicator reached a decision within a week of having all info.

          My comment is just a reflection of what I see.
          I could make some guesses – I think there are different teams handling different lenders, also sometimes an issue with one lender can lead to complaints being held up or when it is resolved handled more quickly.

Does anyone know how long they take to pay out and more importantly remove negative marks off my credit file. I know they are a small lender however their interest rates are huge . Even conpared to the likes of Provident. Morses. Loans @ home. I advise anyone who has struggled with their loans to put a complaint in .

    They don’t have to accept an adjudicators decision so unless they have it might not mean a payout – you may have to escalate to an ombudsman and then the whole case is reviewed again, they may or may not agree with the original decision, if they do then yes you should be paid but that could be months away, credit file updates can easily be 2 months

    I just wanted to add a note regarding Lending Stream. I don’t owe them anything but in 2019 and 2020 I was constantly taking out loans from them. I logged on to their website, clicked on ‘complaints’ and selected ‘affordability ‘ I basically used one of the templates that people have been using and added my own comments about why they should refund the interest and remove anything negative from my credit file. I submitted my complaint and they responded 4 days later saying that some loans were affordable and others which were also affordable should not have been approved as there were quite a few. In one month for example I had taken out either 4 or 5 small loans although one was for £510. They made me an offer of £781 which I accepted. They included a link which requested how I wanted to be paid. I selected the account they had on file and within 10 minutes of informing them the money was in my account. Lots of people use third parties to make their claim but so long as you are putting forward a strong enough argument and you ‘win’ it just means you are getting all that’s owed to you as opposed to two thirds or three quarters.

    Hello Sarah :) fantastic work as always. I have question regarding LS. Back in 2018 i think i sent them claim template and they refusef despite i had numerous loans for small and larger sums…i did one again recently after seeing people have received refunds with LS, if they refused second time is it still worth sending my complain to FOB

      This isnt worth going to FOS UNLESS Lending Stream failed to tell you the first time round that you could go to FOS within 6 months.
      You can’t make the same complaint twice.

    I emailed my jar this morning to see what is happening as I processed a complaint regarding affordability last year. They responded advising they will be contacting customers in the next few weeks. An hour or so later I had an email saying my complaint is not upheld and it cannot be changed or referred to the financial ombudsman.
    I completely don’t understand the decision, I sent evidence of how poorly my credit score was at the time and the amount of missed payments on my file, alongside how little I had in regards to affordability to pay back the loan. Do you know if there is anything further I can do? Many thanks

      Those are pretty small loans. It is possible the Ombudsman may have upheld the last £550 loan but that is pretty marginal. Sorry but the administrators may well have made a decision that is in line with what the Ombudsman would.

    Hi i put a complaint in to lending stream they point blank refused to give me a offer and said we investugated it and you cleary said you can afford the loans with the infomation ive provided and said as a result we will no longer borrow you money since i found this site ive asked and they said weve already lookwd into this complaint and closed it we will not reopen or look into any further what can i do as i had 1500 in loans and repeat borrowing thanks

    Hi Sara,

    As you predicted, Oakam has sent a response to me today (4 weeks after raising a complaint). Saying that they are partially upholding my complaint (not refunding the whole interest) . Claim amount is £2714. Obviously, as they are in administration, nothing will be paid until whatever:) They have sent me the administration form, to send the claim. My question is ,as nothing is going to FOS, is there any point in arguing and send the email to administration for their review? To see if they include more interest? Or the fact that at least some of loans shouldn’t have been given? Because from my bank statements and loans given some shouldn’t have been even issued, but I am not expert, of course. Not sure how it works with administration. Thank you in advance

    Hello, I would like a bit of advice really, I made a claim regarding a quickquid loan that was accepted but after my details (I had a brand new phone number) were given to TM legal services who bombarded me with phone calls and this week have said they’ve issued a CCJ against me, I had no knowledge of the debt and they’ve said it’s from piggybank so I’m guessing the loan was sold to them but like I say I have no recollection of this and now I’ve got to pay off a CCJ. What would you consider the best plan would be regarding dealing with this?

    Hi Sara the debt collectors ARC have said my Fair finance account is no longer with them and has gone back to FF so does that mean that’s an end to the matter as they’ve paid out my £310 now?

    I had 9 loans with Fernovo – have just received the below within the final response email:

    This complaint has not been upheld.

    However, because you always repaid in time all your loans before the last one, and you have decided to file for an affordability complaint, we are ready to reduce the interest on the last loan, if you withdraw your complaint, as a gesture of goodwill we are happy to reduce the open balance to £20. Repaying this amount will close your balance.

    To provide you with an incentive to close the account as soon as possible, we are willing to completely delete all your accounts from your credit file, once the last one is repaid.

    In summary, there is no indication from a fair reasonable, and unbiased perspective that you were unable to afford the sums that Quidie had lent to you when you needed Quidie to help you bridge your momentary cash flow issue till payday. We strongly feel we have done nothing wrong, on the contrary.

    Thoughts?

      – can you list the size of the loans in the order you took them, so 300,300,200,150,500 etc
      – were there any big gaps of more than a month between paying off one loan and taking the next?
      – the current loan – how large is it? how much have you paid so far? what is the current balance?

    HI. I made a complaint to Mr Lender last week which they acknowledged by email and I have today received in the post a statement of my loans (just that, no other comments in the letter) and I just wondered do I need to do anything else at the moment or just wait for a while for a response from them?

      Just wait for a response to your complaint.
      BUT make a note of the date you should have had it. If you haven’t had a reply by then email them and ask them why not. Don’t forget about this…

    Dates funded and amounts below – it’s not huge amounts but it does add up:

    12/06/2019 £100
    16/12/2019 £100
    08/01/2020 £100

    19/06/2020 £100
    02/11/2020 £200
    06/01/2021 £200
    29/01/2021 £200

    There is only £75 remaining on the current loan.

    Hi Sara – I had a number of loans with Piggy Bank (DJS Ltd), Uncle Buck, My Jar and 118 money. Most but not all we’re over 6 years ago, is it worth trying with these older ones?

      Uncle Buck went into adnministration and it is too late to make any claim
      Piggybank and myjar are in administration but you can still make a claim – do not delay.
      118 money is still lending and they are losing a lot of complaints at the Ombudsman. See https://debtcamel.co.uk/refunds-large-high-cost-loans/ for a template to use against them. Ignore the 6 year limit and send the case to the ombudsman if 118 money rejects it.

    Hi Sara, just reading through D’s issue with SafetyNet, I hope you don’t mind me sending you a message. My husband took a heart attack which meant no income for a period of time. This hit is really hard and he applied to SafetyNet for some help. We had the exact same profile as D. with credit being increased and repayments becoming more difficult and spiralling out of control. I complained to SafetyNet and it was rejected. I then took the case to the FOS and it was rejected also. I provided statements of the period of time (which was over 2 years)
    showing the increase in payments and how it was spiralling out of control with each month having to increase the amount to offset the previous months re-payment and manage day to day bills. We had to take out further loans to clear it in the end and to help ends meet. We have had loans (majority with Lending Stream that have all been repaid) Can you advise if I would be able to raise this complaint again with SafetyNet or the FOS and if we can raise a refund letter with Lending Stream?     Hi. I made an affordability complaint to moneyboat and they have responded asking for bank statements but have also said the following which I have never had before. Not sure if scare tactics ‘ Should it transpire that information provided by you at the time of application was false or misleading, we may register this attempt to gain redress falsely as a first party fraud with CIFAS the fraud prevention agency. To learn more about fraud and understand your rights please visit cifas.org.uk. Any fraud marker may affect your ability to obtain credit with banks and other lenders in the future’

    Has anyone else had this

      this is Moneyboat’s normal scare tactics. They say it to EVERYONE who makes a complaint. No one so far has had any problem when they have ignored this and sent their complaint to the Ombudsman.

        That’s interesting thanks Emma. I was like everyone else they said they would have me done for fraud if I gave misinformation about my incomings and outgoings. Thing is I ended up with a CCJ because of them and I still have £140 to pay. Can I still complain if it’s at CCJ level?

    Moneybox is becoming a meme! Despite the Harrison’s staff confirming last year they received my appeal they’ve just admitted they somehow forgot to review it so I wont be getting anything. I’ve been passed around between the customer.services@247moneybox.com and 247dividend@harrisons.uk.com emails with nobody seeming to know how to fix the situation. Happy for those who got a payout.
