What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

I had a response that they sold my loan on (strange because I paid off my debt) to a company called ACI and I had to prove to them that I paid the debt. I later found out that anyone who has had their debt sold on to ACI have no redress due to them and their claims are not being upheld so no news is good news. Good luck x

Who is the lender? Did you have previous loans that you feel were also unaffordable? How large was this last loan and what balance are they writing off?

I just had this response from lending stream, can anyone advise what i can do next regarding this? They payed me a sum of money last year in relation to one loan i had with them but not the other one which i think was for a larger amount! Any help on the matter much appreciated

I made a complaint to them way back when in 2018 and dont think they did anything about that, but last year i had an email from them regarding one of my loans saying this :-
As an outcome of a periodic review of our customer files, we identified that the checks done on the loan mentioned above did not meet our usual processes.
We are therefore crediting your loan account.
But that was only in regards to one of the loans i took out aith them, do i have any case for the other loan at all? If the checks didnt meet thier standards for the first loan they probably didnt for the second either? Thank you

Before we issued the offer of a refund to you on 12th February, 2021, we made a thorough review of all the loans we’ve given you during the course of our relationship to make sure that there weren’t any others that we needed to talk to you about. The email sent on 12th February, 2021 sets out all the changes we want to make as a result of that review.
Hence, we won’t be opening up any further investigations on the loans with us now.
Where can i go from here? Do i email them back and say im going to the ombudsman? Is it worth the hassle over a £300 loan? Thank you your help and advice on these matters os hugely appreciated:)

I’ve used your templates and advice (thank you) as i genuinely believe i have fair grounds for claims as guided by your information i.e levels of interest, having a low credit score/multiple lines of credit at the time; two responses so far are very aggressive in terms of saying ” if we investigate this and find you did not tell us your levels of borrowing etc. you may have been committing fraud and we will report you to the relevant agencies”. Is this a typical response, trying to put you off, or just them saying what they are obliged to?

Several lenders such as Moneyboat send this sort of reply. So far no one who has ignored it and sent the complaint to the Ombudsman has had any further problems with it. They are just being unpleasant and hoping to put you off.

thank you for the feedback- oh the irony, yes its Moneyboat in question here. They have offered some repayment but ignored entirely my request to amend my credit score as for me, as my main gripe is the way they put me into default when it was only the last payment i was late with. I’ve responded to them as per your previous advice on this matter. Thank you again- i carried much guilt about being caught in a cycle of poor credit and refinancing etc. and only reading your pages has made me realise its something i could of been helped with by these organisations rather than profited from, and indeed to have the courage to seek redress.

I have a question regarding the Oakam who just went into administration on 24.02.22. They have sent me a standard form back on 18.03 explaining how they are dealing with a complaint.
On the website the information is different, similar to Wonga and QQ- you get a small % back from your claim after the full amount is known. Do you have any knowledge about that by any chance? I believe that I have a solid case against them, it also stated that I have overdraft payments for about £1500. Any kind of insights would be very helpful. Thank you

So just to make it clear for myself- it actually will take a year to 3 years to see anything back? There are no dates on the website and no information so far or couldn’t find it. Why would they send the form saying that up to 8 weeks and decision will be made? Very confusing.
I wrote it wrong:) They have sent me all the statements. There was amount taken, repayment amount and separately Over payments made section: I have £720 and £820 over payments on 2 loans. Those were the loans that I paid off interest and then closed it early so paid more than I should have it seems.

Not a word about administration way of dealing with complaints. That’s why I got so confused.

Just after some advice please.
I have taken out several loans with Cash Converters in the past. I owe them £42 but after contacting them, the lady said that they have now stopped giving loans and so don’t need to worry about paying the remainder.
I was thinking whether I could try and get the money back from the loans I had in the past due to unaffordable lending.
In all honesty Cash Converters would just borrow to anyone, no credit check and also borrow to unemployed.
I don’t have any record of the loans that I had as it was all paper based agreements. Could I ask for a copy of these?

I raised a complaint with L2G about unaffordable lending yesterday.
They replied back and attached a response that they sent me in 2019 when I raised it before stating they aren’t upholding my complaint.
I cannot recall ever receiving this response.
If I raise a complaint with FOS what do you think there chances are of saying that this is going to be to long as I got the final response over six months ago (even though I never).
I think they are the biggest scam company going.

I have also complained to l2go about a loan I I’d with them.i had repayed much more than I borrowed and feel the loan was unaffordable. Bank state8support this. I originally contacted them as I was diagnosed with breast cancer in May and struggled to pay but did so up until this year as they didn’t respond.
They have said they till write of the balance as a good will gesture but I’m wondering if I should ask for compensation given how much I had repayed. Thanks

And their offer is very poor too. You have already paid £659 in interest…
If you want the full refund – £659 – then you will have to send the case to the Financial Ombudsman. In which case you should also ask for compensation for their failure to respond to a customer who had told them of a severe health problem.
But if you would be happy with less as a compromise to get this sorted quickly, You could go back and say that although you tning the Ombudsman would order a full refund, you would be happy to compromise now on your balance being cleared, a refund of £400 and the negative marks being removed from your credit record. Add that if it goes to the Ombudsman you will also be asking for additional compensation for their failure to respond to your request for help lat May when you told them you had cancer.
Loans2Go are sometimes be prepared to negotiate.

Yes, they said they did reply telling me to send over income and expenditure but I honestly don’t remember seeing the email so continued with payments. It was only when I realised through your website that I could challenge them and cancel the cpa that I contacted them again, it still took several emails before getting a response and I think this was more as a result of payment not being collected.
I will think about next steps, part of me feels I should be refunded but also I’m tired of the hassle and stress of trying to communicate. Thank you so much x

I have had a response from MrLender, with whom I had over £1000 of loans with and paid a lot of interest over the past few years, they have not upheld my complaint but have instead said as a good will gesture they will remove all instances of loans I had with them from my credit file. This is obviously welcome and I’d like this to happen, but I would also like to raise this with FOS as I feel they should offer some kind of interest refund as I feel it was irresponsible lending
If I accept their offer to remove all loans from my credit file, as I’m theoretically accepting their complaint resolution, does that mean I can’t go to FOS?

how many loans did you have? were they more or less continuous or were ther some big gaps between paying one off and taking the next one out? have you missed any payments to them?

There was 5 loans in the space of around a year and a half for around £200 each, basically it was paying one off, then that same month or next month getting another but there was a couple of gaps
However, the complaint mainly revolves around the fact that multiple loans had payment plans etc set up and missed payments etc, then they would accept me for another loan shortly after eventually paying it off. I am arguing that I was continuously using payday loans and also that if they can see I am struggling to pay the ones I have had with them in the past they shouldn’t really be giving me more
Mainly, I just wonder if i accept the offer to remove them from my credit file, can I then not go to FOS as I’ve accepted a complaint resolution?

If you accept their offer, you can’t go to FOS. Basically they are trying to bribe you with something that costs them nothing. But it’s up to you if you think it’s worth it. If you do decide to accept, you want to download a copy of your credit record now with these loans still on it. Then keep this safe for several years. Just in case you many any other complaints.

It may just be that your loan has been sold. In this case your complaint will continue to be decided by Avant. Tell the debt purchaser that you are disputing the loan.

If letters from templates had already been sent and the claims dismissed as not eligible. What happens if the date to escalate to the ombudsman is missed is there no way of redoing the letter later on to try again?

You can only go later to FOS if either
a) you had a very good reason for not doing it before (you were seriously ill, in prison etc)
or
b) the lender did not tell you you had the right to go to the Ombudsamn and that had to be withing 6 months.

I was gambling loads at that time and if they had done proper checks they would have seen that on the bank that they had on file. Is it worth chasing these companies for a irresponsible lending claim? Now in a better place financially/gambling wise. Is it worth a claim?

It is very hard to win a complaint about one or 2 small loans. The Lending Stream is worth trying as it was larger, and if they had checked because it was larger, they would have seen a couple of payday loans in August.

I had a reply from Fernovo saying I passed all their affordability checks saying my affordability score was 7 on a scale from 1-7 whereas my clear score affordability is 7 out of 100! So im not sure their transunion company they use is that reliable.

The regulator says a lender only has to make “proportionate” checks. So for the first couple of loans if they are small they don’t usually have to ask to see bank statements and so won’t see gambling transactions.
If any lenders did ask to see your statements, or have open banking access to your bank account then YES they should have noticed the gambling and not given you a loan.
but if they didn’t do this, the ombudsman probably won’t say that they should have.

I just wanted to add a note regarding Lending Stream. I don’t owe them anything but in 2019 and 2020 I was constantly taking out loans from them. I logged on to their website, clicked on ‘complaints’ and selected ‘affordability ‘ I basically used one of the templates that people have been using and added my own comments about why they should refund the interest and remove anything negative from my credit file. I submitted my complaint and they responded 4 days later saying that some loans were affordable and others which were also affordable should not have been approved as there were quite a few. In one month for example I had taken out either 4 or 5 small loans although one was for £510. They made me an offer of £781 which I accepted. They included a link which requested how I wanted to be paid. I selected the account they had on file and within 10 minutes of informing them the money was in my account. Lots of people use third parties to make their claim but so long as you are putting forward a strong enough argument and you ‘win’ it just means you are getting all that’s owed to you as opposed to two thirds or three quarters.

Good morning, slightly off topic. So whilst patiently waiting for the quickquid redress. I decided to use the affordability complaint template to send to a few previous lenders. Had a few results thus far of small loans being written off and my credit file corrected so thank you for that. However one of the lenders “Mr Lender” are being difficult. I sent an email to them which they replied by post asking me to clarify which loans and why I was complaining about, however they only included 3 loans when in-fact I have had lots of loans with them since 2013. I also have emails stating reloans and rollovers 🤔
I have since sent them another email and replied to there letter first class recorded within there deadline. Are “Mr Lender” known to be difficult?
Also whilst I think of it MyJar Redress. I have used MyJar since they where “txt loan”. There process seems a little cut ‘n’ shut. No room to appeal or complaint on that one apparently. They will decided if eligible for redress and that’s that. They suggest small claims court if your unhappy with their discussion as the only option is that true?

Myjar are in administration. You can’t take an appeal to the Ombudsman. Did they seriously tell you to take your case to court????

In regards to MyJar, all they have said to me is I have been registered for my interest in redress.
The statement about court came from the Harrison’s website in regards to MyJar.

This decision is final and therefore we are not accepting communication regarding the decision. If you are unhappy with the decision made, as indicated above you have the right to further pursue your claim through the small claims court.“

Hi Steve, Mr Lender were incredibly difficult and I ended up taking them to the ombudsman. Conveniently they had sent me an email at the time of my applications showing that they knew my outgoings exceeded my income by hundreds even before their loan. In other words, they knew I couldn’t repay without further borrowing but they lent anyway! If you have emails from the time of your loans check back over the emails from the underwriters – it might provide some useful evidence that they knew they shouldn’t have lent. My calculation was at the bottom of an email asking me to confirm the figures were correct. Good luck!

Changng credit reports – Somewhere between a week and 2 months. Most lenders only report changes to the credit reference agaencies once a month, so it depends how long it will be before that happens.

It was sold to a debt collection who I complained to. They then passed the complaint back to FF who have responded as such by agreeing the loan was unaffordable and informing me if the refund.

ok, then you need to ask if FF are clearing the debt to the debt collector and getting the debt collector to delete the default too… otherwise you will need need to use the refund to clear the debt to the debt collector.

I could make some guesses – I think there are different teams handling different lenders, also sometimes an issue with one lender can lead to complaints being held up or when it is resolved handled more quickly.

Next predicament is with L2G. They say they reduced my ‘balance’ from £1,048.39 – that being the figure I would’ve paid at the end of 18 months – by 50% to £643.46.. The actual amount borrowed was £300.
They say they’re not going to look into my complaint despite several messages but as well as this I want to escalate the fact that they keep texting me despite me explaining I had anxiety and that this was causing me more distress. What to do next?

I emailed my jar this morning to see what is happening as I processed a complaint regarding affordability last year. They responded advising they will be contacting customers in the next few weeks. An hour or so later I had an email saying my complaint is not upheld and it cannot be changed or referred to the financial ombudsman.
I completely don’t understand the decision, I sent evidence of how poorly my credit score was at the time and the amount of missed payments on my file, alongside how little I had in regards to affordability to pay back the loan. Do you know if there is anything further I can do? Many thanks

Those are pretty small loans. It is possible the Ombudsman may have upheld the last £550 loan but that is pretty marginal. Sorry but the administrators may well have made a decision that is in line with what the Ombudsman would.

As you predicted, Oakam has sent a response to me today (4 weeks after raising a complaint). Saying that they are partially upholding my complaint (not refunding the whole interest) . Claim amount is £2714. Obviously, as they are in administration, nothing will be paid until whatever:) They have sent me the administration form, to send the claim. My question is ,as nothing is going to FOS, is there any point in arguing and send the email to administration for their review? To see if they include more interest? Or the fact that at least some of loans shouldn’t have been given? Because from my bank statements and loans given some shouldn’t have been even issued, but I am not expert, of course. Hello, I would like a bit of advice really, I made a claim regarding a quickquid loan that was accepted but after my details (I had a brand new phone number) were given to TM legal services who bombarded me with phone calls and this week have said they’ve issued a CCJ against me, I had no knowledge of the debt and they’ve said it’s from piggybank so I’m guessing the loan was sold to them but like I say I have no recollection of this and now I’ve got to pay off a CCJ. However, because you always repaid in time all your loans before the last one, and you have decided to file for an affordability complaint, we are ready to reduce the interest on the last loan, if you withdraw your complaint, as a gesture of goodwill we are happy to reduce the open balance to £20. Repaying this amount will close your balance.
To provide you with an incentive to close the account as soon as possible, we are willing to completely delete all your accounts from your credit file, once the last one is repaid.
In summary, there is no indication from a fair reasonable, and unbiased perspective that you were unable to afford the sums that Quidie had lent to you when you needed Quidie to help you bridge your momentary cash flow issue till payday. We strongly feel we have done nothing wrong, on the contrary.

Piggybank and myjar are in administration but you can still make a claim – do not delay.
118 money is still lending and they are losing a lot of complaints at the Ombudsman. See https://debtcamel.co.uk/refunds-large-high-cost-loans/ for a template to use against them. Ignore the 6 year limit and send the case to the ombudsman if 118 money rejects it.

Hello Sara, i believe i had already added some initial comments to your site but unfortunately I’m unable to trace it, so apologies for any duplication here…
I took out a 2k loan from Loans2Go over 24 months in feb 2022, having within the last 12 months prior already taken out 4 new credit cards which are about 80% of limits as things stand, and also x2 £500 loans from CreditResource. The repayments are more than 300% interest, total repayment will be 6.5k!
I’ve made a complaint to them and to be fair to them, responded within 1 week.
They have fully rejected my complaint, but offered to reduce interest by 50% over the term and reduce my monthly repayments. At first glance that seems like a win, but i just want to make sure i’m not being taken for a mug before i return to them with my response.

In their response they have commented the following:
Credit Reports are not always up to date, but the issues i mentioned in my complaint such as 8 defaults and arrangements to pay and debt management plans were all evident on my credit report already at the time of application, and all within the last 6 years.
Theyve confirmed they used UK Consumer Averages when determining affordability from rather then my actual income and expenditure, provided in part as part of their online application. This is despite in my complaint me accusing them of this, yet they said they fully rejected all elements of my complaint?!
They calculated my disposable income to be approx £900, yes £900 a month more than it actually was, having used their “online verification tool”.
Theyve confirmed they did not complete a full credit check or require bank statement as i’d already passed their “stringent checks” prior to that stage.
One mistake i did make which they mentioned was not to mark “YES” on their question about drug, alcohol or gambling” question. i misread this and did not see the gambling element, so ticked “NO”, but to be fair, i am registered with Gamstop so cannot use online sites anyway.
Like i say, theyve provided a good will gesture, but i’m on the fence about whether to accept it or not, so any advice woudl be truly appreciated. Many thanks!

For a small loan, there is an argument that a lender does not have to look too closely. But £2000 is a very large loan.
what is your current financial situation like?
What other problem debts do you have at the moment, how much do the other ones add up to and are you making payments to all of them?
Are you behind on any essential bills – rent, council tax, energy etc?

Hi Sara. I’ve been registered with Gamstop since 2018 so gambling is not currently an issue.
I’ve been behind with rent and council tax and utilities in the last 12 months yes, but currently up to date. Just! And that was what this 2k loan was partially used for, to bring those back up to date. I have proof from council tax and utility bills that I’ve been in arrears and also my bank statements would show the bounced direct debits etc.
My other debts total approx 12k and I’m in repayment plans for them all, 8 of those are defaulted from between 2018 and 2021, all evidenced on my credit report so they would have seen them had they checked I’d imagine.

The reason for these questions there is no point in you accepting an offer which still leaves you in a complete mess…
better to tell L2G that you want all the interest removed or the case goes to the Ombudsman. And probably put the L2G debt along with all the others into a debt management plan with StepChange so they can deal with your creditors not you. You can still make affordability complaints when you are in a DMP. Winning them will speed up the DMP a lot.

They did exactly the sane to me. I made an Unaffordability claim which they rejected but said as a ‘goodwill gesture’ they’d reduce the balance by 50%. It’s a joke the way they operate. I get text messages every day several times, despite me asking them to stop and blocking the numbers.

Hi, I put in a complaint to loans to go last Saturday (the 9th) after reading all the comments on here about them. I’ve not even received an automated response to acknowledge my complaint, is that normal? I’ve put in complaints to 3 other lenders and received automated acknowledgments straight away.

Hi. I made an affordability complaint to moneyboat and they have responded asking for bank statements but have also said the following which I have never had before. Not sure if scare tactics ‘ Should it transpire that information provided by you at the time of application was false or misleading, we may register this attempt to gain redress falsely as a first party fraud with CIFAS the fraud prevention agency. To learn more about fraud and understand your rights please visit cifas.org.uk. Any fraud marker may affect your ability to obtain credit with banks and other lenders in the future’

this is Moneyboat’s normal scare tactics. They say it to EVERYONE who makes a complaint. No one so far has had any problem when they have ignored this and sent their complaint to the Ombudsman.

I had this email too which really worried me in case I missed something when applying, and end up in court never fraud!

That’s what they want you to feel – scared. No one has had a problem when they pursued it.

That’s interesting thanks Emma. I was like everyone else they said they would have me done for fraud if I gave misinformation about my incomings and outgoings. Thing is I ended up with a CCJ because of them and I still have £140 to pay. Can I still complain if it’s at CCJ level?

Moneybox is becoming a meme! Despite the Harrison’s staff confirming last year they received my appeal they’ve just admitted they somehow forgot to review it so I wont be getting anything. I’ve been passed around between the customer.services@247moneybox.com and 247dividend@harrisons.uk.com emails with nobody seeming to know how to fix the situation. Happy for those who got a payout.

How did you complaint to Lending Stream? Can’t see a redress scheme on their website to input information?

well if they didn’t, you can still take your original complaint to the ombudsman. But if they did, then it is too late. You can’t just make the same complaint twice.

I emailed Harrison’s regarding my jar as I have a claim with them to and it says email inbox is not responding to emails. There webpage says if you are due a redress you will be emailed by end April if you don’t here anything you aren’t getting a payment. Payments will be made in may.

Hi, just wondered if anyone had received their dividend payment from 247Moneybox yet. I’m still waiting as it was meant to be paid in the last two weeks. All I am getting back from then are automated emails stating that I can see how much I am due back through the portal. Unfortunately I cannot see this information, I did update my bank details when asked.

Hi Sara, yes that’s the email address I have been trying and all I got was 3 of the same emails saying you can check the amount in the portal, but there is no info whatsoever about the amount I’m due. Harrison’s seem as about as good at communicating as the administrators that dealt with Wonga.

Hi Folks,
Just looking for a quick bit of advice, of course. I had an old account with Piggy Bank or DJS LTD which I raised a complaint about. The debt has since been sold to Asset Collections and Investigations and I have been dealing with TM Legal Services for some time in relation to it. This was registered as a CCJ in 2019 and is also showing on my credit record as being defaulted in 2017.
I have been offered a significant refund which will leave me with less to pay than I have already paid to TM Legal Services, and it also says they will remove the adverse credit history. Where do I stand with the CCJ – will I merely have this marked as satisfied or should I aim to have it entirely removed? Is that even possible?

No and my case was messy. I made an affordability complaint which they upheld but then they dragged their feet for weeks, promising that it would be paid but there was an internal delay. That delay was obviously that they were going into administration but they didn’t want to admit it before it was formally announced. I don’t even know if the administrators will respect the complaint decision or not even though full and final settlement contracts were signed weeks before they actually went into administration. I think we’re meant to hear in the next few weeks.

It says on Harrisons website if you do not receive an email by 30th of April you will not be receiving any redress.

Yes. I got £10K from them.
I was basically re-borrowing every month for 5-6 years and paying £200 each month for the “privilege” of doing so.
I can’t remember how long the claim took, but it was weeks rather than months/years.

I had dealings with them. I found them quite easy to deal with! They made things very clear and took about 7 weeks to make their decision.

I recently contacted myjar with an affordability complaint letter. I had heard nothing for a few weeks since the letter and just today they have sold my account to a debt collection agency to pay the outstanding, yet I was writing to them to request a refund for the high interest they had been charging. Are they allowed to do this ? Do I write back to them ? What do you suggest I do ? I still owe £400 but I had not had any contact with myjar since 2018 as I had originally taken out a loan for £1600, I have paid over £2000 in interest charges and payments I have made come to the amount I’ve borrowed, but I stopped paying because I just couldn’t afford it anymore. Any advise would be appreciated thank you.

So happy!! Finally after about 18 months my payday company has agreed with the ombudsman and is refunding all charges interest etc for 15 loans!! Just got to wait another 28 days for them to send the money but I am so happy. They wouldn’t even discuss it with me,i think went through a company who try and get ur back for you which they again couldn’t get anywhere but finally ombsman stepped in and they have agreed
