What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

Hi hope someone can help. I made a complaint to the financial ombudsman about Satsuma months ago, they asked Satsuma to provide information by May which they still have not done. I asked Satsuma to freeze my account until the complaint was resolved however this ran out earlier in the month. I have asked them to not take any further payments until the complaint was resolved – today I have received a letter of notice of default and threatening court action / debt collectors if I do not make payment by 14th September, despite them telling me I would receive regulatory letters only and not demands for payment. They are taking the mickey as they are nearly 4 months over the deadline of providing the information. I cannot afford the payments or monthly payments (966 overall and £200 monthly respectively) and that is why I want to wait until the complaint is resolved before continuing payments. Do you have any advice please, I dont know what to do. Dont want this to go to court or be sold to debt collectors. Thanks

Thanks Sara, yes I complained to Satsuma first and they didnt uphold the complaint. Ive had 12 loans with them, the first one I took out in Dec 2017 and the final one (outstanding) in June 2019. Ive managed to settle my other payday loans this year, all upheld, so they are cleared now but I have credit card debt (at its limit) and pay back signifcant amount of money to family each month ( all due to previous gambling problems). As you have a live complaint at the Ombudsman, they shouldn’t start court action. And big shrug if they sell it to a debt collector, why would you care? Debt collectors are often nicer to deal with than payday lenders.
They can’t carry on adding interest for long – the loan will hit the “price cap” soon. And any interest added will be removed if you win the FOS case.

This month I have on my TransUnion reports (totally money and credit karma), 3 loans open with Lending Stream dated from 2017, which were closed a long time ago. Why they have been re-opened on my credit report is anyones guess. As there is no-one answering the phone at Lending Stream I have raised dispute with TransUnion themselves

In that case the redress (interest paid) figure looks wrong.
It looks as though you have paid the following interest on the first three loans 494, 992.396 which adds up to 1882, not 1211.
The numbers for the last loan look right. If you take the interest off it you have to pay 2000, but you have already paid 771, so that means 1229 still to pay. So they take that off the redress on the other loans.

You are the second person i have seen recently that have had a positive outcome directly from Provident (Satsuma) without the need to go to the Ombudsman. Maybe a sign that they have changed their policies on rejecting everyone.

They’re no friends of mine! They probably won’t even contact you. If you’ve accepted through the adjudicator, they will accept with lending stream on your behalf. This is what has happened with me. Didn’t get a written confirmation off them but follow up with their live chat and check progress.
Pretty much guaranteed you will not receive the refund until exactly 28 days later or possibly even later from the various posts off other frustrated people. I actually asked them yesterday, is there any chance i will receive the payment before 28 days? They said no, and gave no reason why. Probably the most honest thing they’ve ever said!

They paid mine out at the 26 day point, I sent them my bank details as soon as I accepted their offer to give them less opportunity to come up wtih excuses for delaying payment. I did phone them up at one point to see if it could be speeded up but they just acted like the complaints department was a different company that they had no access to (they had obviously been instructed to fob off anyone asking about their complaint). I’m sure they’d be on to you in hours if they wanted money from you,

I have just spoken to a lady on the live chat who first said they were waiting for me to send an acceptance email and my bank details, when I told her it was accept by Adjudicator on my behalf, she then said she has limited access to my account and that she will get complaints team to get in touch.
I am not waiting for that, so I have now sent them my bank statement showing my bank details (it’s the same account they have on file). I also sent a screenshot of their email to adjudicator upholding the claim with figures shown. I guess I have done all I could so it’s basically a 28day wait now.

I have outstanding loans with satsuma. 1 has £298 left to pay, and the other has £489 left to pay. Both unafordable at the moment and I wasn’t in a great credit or financial position to start with when I borrowed.
I’m tempted to put in a complaint against both but I’m worried they might just try and take money out of my bank for the remaining balance on both…. Any suggestions as to what I should do would be greatly appreciated

Anyone had a payout from lending stream with some advice please? I’m 20 days and waiting, but refreshing my bank account every hour isn’t doing me any favours! Do they email you to say when they’ve made the payment? Is it during the day, or an overnight payment? I’m so stressed with worry that they go into administration before I get paid. I’m due over 2k. I had over 6k coming from sunny and then they went under. Will prob end up with 50 quid in 2 years time.

Mine was paid in at about 10:30 in the morning on day 26. I had an email to say they’d made payment about 10 minutes after I saw the credit appear in my account.

Hi all,
Noticed a few people saying that Provident / Satsuma send out refunds by cheque. Is this always the case if they uphold your compaint or can you request a bank transfer?
I have a complaint in against Satsuma and whilst not jumping the gun, if it was upheld i’d have difficulty paying a cheque into my account due to the location of my bank and work commitments.
I’ve had a number of complaints settled over the last few years and have always been paid out by bank transfer so would find it strange if they only paid by cheque.

They do only seem to pay out by cheque which is very odd in the day and age, I can only assume it’s to make it difficult for people and to slow things down (we posted the cheque within 28 days so it’s not our fault if it took longer to reach you etc).
There are a number of options for paying in cheques though. It depends on the bank but you can often pay it in via the baking app (if it’s less than £500), at one of the post office counters you get in newsagents etc (if you have a paying in slip), or by posting it to them (Nationwide for example have a form you can fill in on their website and print, and then post if off along with the chque to the address they give.)

I had one loan with them and complained on the off chance not expecting much but they offered to write off the remaining interest It was something like a £150 loan I had already repaid £230 on and they offered to write off the remaining £40 or so. They said they had lent responsibly but made the offer because they didn’t like having unsatisfied customers or something.
Bizarrely they said they could only give me a final response by posting a letter to me, although they asked me by email where they should post the final response to and the final response letter asked me to respond to it by email. I did query it but all they said was that our was company policy. .

Hi, wondering if all can help please.
I have received a claim form from Quidmarkets lawyers, however on my own mistake I attempted to make a reasonable repayment offer which they didn’t accept however I didn’t contact them to follow up.
I was on furlough as well which is why my repayment offer was too low. I am now back in employment and off furlough but I’ve already received the claim form.
I do want to raise an affordability complaint against them, can I still do this even though I have already received the claim form?

they did send the letter before claim first some time ago and that is where I proposed multiple plans and got rejections and now they have proceeded with the court claim form. What am I able to do?

ok, it is shame you didn’t put the affordability complaint in at that point. Can I ask how many loans you had from them and how large? You can make an affordability complaint now but you also need to defend the court claim.

Hi, there were two loans both a year apart, however I did borrow with multiple other lenders inbetween them.
Both loans were £600 each. If I defend the court claim, would that not give me a CCJ? As I work in the finances sector, I can’t have a CCJ otherwise I risk losing my job.

That is a rather marginal claim – you may well not win that at the Ombudsman. It’s OK to put in a complaint and try, but you need to have a Plan B in case you lose.
If you don’t defend the court claim you will get a CCJ “by default” within a month or two. If you pay the CCJ with 28 days, it will be removed from your credit record. Do you have the money to do that? If not, then one option is to defend the case and prolong it for as long as possible to let you save up the money so, in the worst case, you can pay off the CCJ.
I can’t give you advice on defending a court claim. You can talk to national Debtline on 0808 808 4000. And/or post on the Legal Beagles forum https://legalbeagles.info/forums/forum/legal-forums/court-claims-and-issues. It may be possible to try to get the court case “stayed” (that is legal jargon for put on hold) while a Financial Ombudsman case goes through. In any case if you defend th case and take it to a court hearing after mediation that will very often take a long while.

My case against Satsuma has now been with FOS for 6 months, and assigned to an adjudicator for 5 months and I’m still yet to get a decision. My adjudicator has now stopped responding to my requests for updates (of which I send one every 2-3 weeks), and I’m at a loss as to what I should do next. Are people still making progress with cases against Satsuma? Are FOS progressing other peoples cases quicker? I fully appreciate the volume of complaints that they are having to deal with, but 5 months of “there is no update yet, the case is still being worked” is very tiresome.

This you can complain to FOS about. Ring them up and say you want an update about exactly what is happening as your adjudicator is not responding to you.

I’ve heard back from safetynet credit ref a complaint. The first email offered me £1000 and close my account. However due to having been lending from them for over four years constantly irresponsibly and having paid over £4000 in interest I pushed for a slightly higher amount to settle (£1500).
The second email they’ve sent has now offered me £100.
I’ve asked why the amount has dropped so drastically but I’m wondering if you’ve heard anything about people taking them to the ombudsmen with success if it went that way or if I will have to suck it up and accept the £100 if it came to it.

Hi Sara/All,
Please can you provide some advice on a response received from Mr Lender.
I had 3x loans with ML, 1x £300, all paid back on time, 1x £500, all paid back on time (taken out on same day previous loan was paid off) and 1x £700, defaulted and not paid back (taken out a week after the previous loan was paid back).
I am now paying the defaulted loan back via SLL Capital, the balance currently at £1202.50, of which I have paid £110.
I have complained to ML and their response was to not uphold my claim, however, as a gesture of goodwill, they will recall my account, remove the interest paid and that leaves my balance at £640. They will also remove any negative markers on my credit file when this is all paid off.
Do you think this is worth further pursuing via FOS or is this better to accept their final decision and accept the offer of goodwill?
It very much seems like they are accepting guilt, without accepting the guilt, any advice appreciated.

so your loans were 300,300,300,500,700 in that order? Were there any gaps between the loans – the time from repaying one loan to taking out the next?

Hi Sara,
No, I had 3x loans in total, £300 (loan 1), £500 (loan 2) and £700 (loan 3). There were 0 days between loans 1 and 2 and 7 days between loans 2 and 3.
I have paid £110 towards loan 3 via SLL Capital.
At the time, I applied for loan 3 in Oct 2015, I had no accounts in default, but my debts were mounting up quickly and in the following 3 months I had various accounts fall into arrears and default, amounting to a total of £9k or so. Things only got worse from there.
Currently, my finances have massively improved, earning approx £2100 p/m. However, I am currently using approx £1300-£1400 p/m of that to pay off lenders and debt collectors from debts accrued due to gambling problems approx 2-5 years ago. I buried my head in the sand initially, but have recently seen the light and working hard to improve my situation as I have now got over my gambling problem.

Right, sorry i misread your perfectly clear first comment.
With just three loans, getting interst removed from the last loan is a reasonable offer. You probably wouldn’t get any more by going to the ombudsman. There is a small chance you would get a refund on the 500 loan, but FOS may well say only the third loan should be refunded.
But the balance on the 3rd loan should be 700 minus the £110 you have paid = £ 590, not 640. I sggest you go back to me lender and explain that and say you are happy with repaying a reduced balance of £590.

Hi Ferratum decided not to agree with my complaint but offered to clear the interest if i paid the remaining amount of the loan off and mark it on my credit report, question if i accepted this and didn’t realise that they wouldn’t wipe the default from my report can i still push it to the FOS?

I also have a complaint with an adjudicator for Satsuma since March. On 15th June they said they had now received all information to look into complaint. I chased on 15th July and she responded saying they had not completed their assessment. She then e-mailed on18th August saying she had asked Satsuma for more information. Then nothing since. It’s so frustrating, I don’t like to chase too much as I realise it must be a difficult time but at the same time I just want an answer.

I had a loan with Ferratum and it was passed on to CRS which was then paid through stepchange. Now Ferratum have come back to me and said that I owed a balance of £1,274. I explained to them about the complaint and now they are saying I owe £324 and it’s with Opos. I asked why CRS balance was 0 but they didn’t answer that question and kept sending texts and emails saying I had to pay the balance immediately. Is there any way of proving otherwise?

Hi, hope you can help. I put in an affordability complaint and also made an SAR request. Today I’ve had a response from said company, they have sent a confirmation of the complaint, no breakdowns of the loans or any other information requested. They have asked for bank statements from may 2009 to may 2014 I no longer have these and cannot get them from the bank due to them only holding them for 5 years. The issue is until I know what loans from them I had and when should I have to send these yet?
The lender was mobile money, I had a few loans with them over the years to which I’m unsure of (I know this could be a problem) but after looking at my credit file I can see it says I opened a loan in May 2014.

I suggest you reply that when they have sent you a list of your loans you will try to get bank statements for the relevant period. Expect MM to reject your complaint – they usually do. Send it to the ombudsman.
the Ombudsman likes to see bank statements but if you had several loans and they were continuous, you can still win cases without.

Which bank are you with? When I requested statements older than 6 years, they said they could not produce them but due to all of the PPI claims etc, they started being able to send out a list of transactions (which is pretty much like a bank statement anyway) maybe you could try for one of these? It did take me calling and speaking to a few people before I got through to somebody who suggested this for me.

So that is a lot of borrowing. From Loan 4 it was contunous – taking a new loan the day you settled the old one.
On that basis you may win an Ombudsman case for the later loans even if you cant produce bank statements – but if yiou can get bank statements it will be better. As Kerry said, the old bank may be able to provide lists of transaction even if they can’t reporduce the exact statement.
I suggest you go bank to MM and say you would like them to consider your complaint as it stands, as you think the fact the last 8 loans formed continuous borrowing means you will win your case at the Ombudsman.

I have had a complaint with lending stream back on January and they paid out on March without the need to go to Fos, today I randomly received an email from them today with a tax certificate and confirming they will be transferring an amount of £72 to my account this is a different figure than what they had paid out to me in march and I thought it had been settled. It also says on the email they will remove the adverse marks from my credit file – does this mean there going pay me an extra amount of 72 again or what it is? Has left me confused

Hi I wonder if you could help, I have just received an email from Safetynet credit who have confirmed that they Irresponsibly lent and have offered the following? I just wondered if this is an acceptable offer? I have attached a copy of what the have said and also the transactions they sent me,

What a headache.
I agree that you have had £81.38 in interest added. This isn’t the amount you have paid, as there is some interest included in the current balance.
But this should be taken off the current balance of £171.55 which includes interest still owing.
That leaves a balance of 90.17. Less the 8% calulation (which I can’t check but doesn’t look obviously wrong) of £8.10 when tax is taken off. Leaving a balance owed of £82.07
So I think I agree with their numbers.

Has anyone had issues with getting reply’s from lending stream? They no longer accept emails so i have used their contact us webpage twice now but no reply’s. My Jar and safetynet credit both came back to me pretty quickly and i paid off the balances remaining but lending stream have not even confirmed they are looking into it.

I’d give them a call to check they had got it, and send it to the FOS the minute it gets to the 8 week point if you haven’t had a final response by then. They are horrendous and take as long as they can with everything and often ignore messages you send them, so don’t give them a minute longer than you have to.

I’ve placed a claim with 247 moneybox which has been rejected. I had 5 loans with them over a period of a few years and struggled to pay them all back. The last one I took out for 600, I owe 1900 back which is still outstanding. They have rejected my claim and they are asking for the 1900. I feel due to my circumstances, the loans were unaffordable. There was a pattern of refinancing and if they checked my credit report at the time they would have seen I struggled to pay my bills.
I wanted to escalate to FOS but they say I can’t as the company is in administration.
Can I get some advice please

They have given me a redress of 2/3 of the outstanding balance.
Think I might accept as this is just £50 more than the difference between money borrowed and net outstanding, excl any interest.

Has anyone had any experience with Moneyboat? Getting CCJs removed?
I am in tens of thousands of debt from dozens of high cost lenders and have (stupidly) buried my head in the sand because all correspondence went to an old address.
When I finally plucked up the courage to check my credit report I was actually quite surprised to only have 1 CCJ which is turned out was from Moneyboat for a 3rd loan in 6 months. the first 2 had been paid up fully and the third was for £1,000 (13 days after I paid them £870).
I had paid £933 of the £1k I borrowed but the CCJ is for £1,400 which must have included interest up until the end of the contracted loan period.
I have sent an email of complaint of affordability which if fully upheld would see them owing me about £280….but what I am wondering is if they accept they shouldn’t have given me the loan, will the CCJ be removed from my credit file?

Hi Peter, sorry to hear about your situation. I read your comment and yes, I won a complaint agaisnt Money Boat. I only had 1 loan with them for £500 but like you but burried it away and then regretted it later. I argued clearly about this to my adjudicator who upheld my complaint, Money Boat refused and then ombudsman agreed with adjudicator. 1 loan complaints are hard to win but it all depends on your current situation and on a case-by-case basis – but shouldn’t put you off complaining. Good luck with your impending complaints process! From someone who’s had A LOT of payday loans, I’m in a much better place now after this website, and you will be too soon ! Joseph.

I am not familiar with the SHARE financial data but on a credit report U typically means “unclassified” ie no information was provided ant 1 means 1 month in arrears.
That looks like a large number of accounts opened in a 6 month period!

You know one loan cases are not easy to win, but you can say that this was a large loan so they should have checked your credit record and seen how much other debt you had.

I took a loan with Everyday loans for £4000 whilst I was heavily addicted to gambling. When I took the loan, EDL asked for a copy of my last months bank statement but because this was not yet available I had to send the previous months. Both months show a large amount of cash withdrawals ( but not specifically gambling transactions ) although the statement that had not yet been generated for the month prior to me taking the loan showed over £2000 of gambling online as my GAMSTOP registration had expired … can this be taken into account when raising my complaint or will it be seen that because they checked one set of statements that they did proportionate checks? This asks for a SAR as part of the complaint – this should show you how Everyday Loans calculated your income & expenditure – if that did not tally with the bank statement you showed the (how did they account for the very large cash withdrawals?) then that is a good argument they did not properly check the loan was unaffordable.

Well had some positive news from the ombudsman in that the adjudicator has agreed with me over the loans that I had with the Money Platform, for interest to be removed on three loans including the last one. This is the subject of inclusion in my debt management plan and I have now paid more than the capital borrowed.
The Money Platform however have disagreed with the adjudicator and want it escalated to the ombudsman. Am I right in thinking it might be an idea to stop payments now?, just in case they end up going under in the time it takes to deal with the matter and given the fact that the capital has already been repaid.

Yes.
As this is already in a DMP, you don’t care about any effect on your credit record while it is being sorted.
The lender should NOT start court action if you stop paying. This doesn’t seem to be a problem in practice.

Some positive news – having accepted a refund offer from Lending Stream on Friday, the money was paid into my account in the early hours of this morning, so they seem to have improved their speed of paying out, at least in my case. For clarity, this was a complaint direct to them which they upheld without involvement from the ombudsman.

I am really struggling with my adjudicator.
I replied to him on 19th August after our conversation above, on 28th he replied stating that ‘there wasn’t any information on your credit file which prompted them to do a further check. However, 118 118 Money still carried out a further check – income and expenditure check. This was also because the term of the loan was 24 months and it was a larger amount.’
I replied saying that this was false and no further checks were carried out and to refer my case to the ombudsman. Today I have received another email from the adjudicator stating ‘118 118 Money have provided evidence of income and expenditure checks which were carried before approving loan one and two. This was using the information you declared on your application form.’
How is my application form further checks?

‘If You give Us false or inaccurate information and We identify or suspect fraud. We will record this with the fraud prevention agencies. Law enforcement agencies may access and use this information.’
You agreed to the declaration and confirmed everything on the form was true. So I can understand why 118 118 Money didn’t need to see ask for any further documentation. ”
He then said do I still want it to go to the ombudsman. Is it normal for the adjudicator to seem so biased to the lender? I am annoyed because I asked it to go to the ombudsman nearly two weeks ago.

Hi Sara,
Lending Stream have said my 3rd loan was un-affordable but the first 2 were affordable, they are the only company who has said that my loans were affordable so i am going to take it to the Ombudsman as i believe all were un-affordable and they have said that they wont remove my file from the credit reference agency, if they did this i would have probably accepted having a £500 balance left.
Issue is i have never reported anything to the Ombudsman, is their a template for this? I am confused on what i need to add to this?

The loans were £200, £900 them £700.
The 700 I still had a balance so they have reduced this to £573, I would have been happy to accept that but I want it removed from credit file. I was in just a bad situation for all 3 of the loans.

What does the rest of your credit report look like – unless it is very good, there may be little point in going to FOS just to try to get a default removed.

Thanks Sara, to be fair i think the other loans were unaffordable too and myjar agreed which made my balance for from 1900 to £93 which i paid off, i was hoping for the same from Lending Stream and Satsuma but both has rejected my claim so i will be going to FOC about them. I have never went to FOC, quite confusing.

Do you know or any friends know how long satsuma takes to send you a cheque. They accept the FOS decision last week. Not heard back from them, tried ringing Satsuma and sent emails but no reply. Is it a long wait to recevie the cheque?

Yiu Dan send them case to the Financial Ombudsman at 8 weeks, or sooner if a ksnder gives you a Final Decision rejecting your complaint with a poor offer.
“Loads of Claims” if these were payday loans and not large, you aren’t likely to win complaints if you only had 2 or 3 loans from a lender of if you had large “gaps” in borrowing from a lender.

Thanks. Is the Ombudsman ‘the adjudicator’? I keep seeing people refer to the adjudicator but I’m unsure if this is the same as the Ombudsman.
When I say ‘loads of claims’ I mean really loads of lenders – but with most lenders I have had at least 3 loans, nearly always simultaneously with other high interest loans.
I have heard people say they have won cases for loans if they were large, just wondering what you class as large?
My loans have typically been a minimum of £250 right up to £2,000.
I just want to say thank you as well to you personally Sara for helping me through this site. I contacted 30 lenders on Sunday and on Tuesday SafetyNet Credit waived a debt of £1,320 AND paid me £560 in redress and the money was in my account last night!

The Financial Ombudsman (FOS) has a 2 stage process. 90% of complaints are settled at the fir stage by a FOS employee called either “an adjudicator” or an “investigator”. If you or the lender object to the adjudicator decision, it will be looked at by a senior employee called “an Ombudsman”.
There is no simple guideline as to what is large. I would assume that any loan over £1000 is large, smaller ones may be if you are on a very low income.
So you know what interest you paid to SNC? Always check this before deciding whether to accept an offer.

Yes I worked it all out on a spreadsheet. Their offer actually far exceeded what I was anticipating the full amount because I didn’t know about stat interest then (I have now educated myself).

No, you have to take a complaint to FOS within 6 months of getting the response from the lender. there is no max time limit on FOS – it will take as long as it needs and if it has to go to the second ombudsman level cases are often over 6 months.

I have had loans with multiple payday loan providers for many years and am in the process of complaining to them all. I received refunds from Wageday Advance and Wonga via the administrators, and I complained to Sunny who I had over 40 loans with but now they are in administration. I am now waiting for responses from Lending Stream (27 loans), Satsuma (8 loans) and Mr Lender (2 loans).
I have been offered a refund from MYJAR for 19 of the 29 loans with them, but have responded to ask that a further 5 of the loans be included in the offer (thanks to your advice). Their initial response and offer was within the 8 weeks but my question is do they have to respond to this request to include more loans within the initial 8 weeks too? I received a response to say they would reinvestigate after I provided my reasons but have not heard anything since and I’m not sure if I should chase them at the 8 week point next week?

Just wanted to say thank you for this forum. Today I received my offer from Provident for my Greenwood loans and it is pretty much to the penny what I worked it out to be. The cheque should be arriving in the next 14 days. And The person who has dealt with my complaint after it came back from the FOS adjudicator is also dealing with my provident loans and is now waiting for confirmation that my debt was cleared with the debt collectors before he calculates my redress from my provident loans which he’s hoping to sort next week. He’s apologised that it wasn’t originally dealt with last yet when I first complained.

Hello, I’m just wondering whether anyone could give any advice? In 2012 and 2013 I had loans with quickquid and poundstopocket. I defaulted on both and they were both passed on to debt collectors. These have since changed hands a few times and I don’t know exactly what I have paid to who over the years. I now have logged a claim with casheuronet but I am not sure what to do about the solicitors chasing me. For one of them I think my initial loan was £800 but I still owe over £900, I can see from old emails that I have lots of confirmations where I made my monthly payments before it defaulted so I think I had paid quite a bit of it back anyway. I’m just lost with what to do at the minute as I can’t afford to pay it all back to the solicitors.

I have a number of debts at the moment but this is the only historic one which is with a debt collector. None of my current debts are in default and all are regularly paid if that makes sense.

Not having your current address will not prevent them from going to court but it may mean you do not get the court papers. I suggest it probably is better to give them your current address.

yes you can still dispute it. I’m not saying this is going to be easy, but the aim is just to get the debt collector a to hold off until you have a decision on your Claim from the administrators.

I am now in the kind of waiting around for responses period, having made all my complaints to the companies so I am wondering if there is anything I can do to strenghten my cases in the meantime?
Eg, I when I have had replies with DSAR data I have been able to say, look how many loans and missed payments I had out when you granted me the loans.
I have read that just before the 8 weeks is up some complanies might ask to see bank statements, so want to avoid this and be in a position where they have to issue their final response (and hopefully offer) bang on 8 weeks.

All are multiple loans bar Avant Credit.
I have ordered my bank statements just in case but don’t have them yet. Because the companies have to reply to your DSAR within a month my plan is to see what they hold on my/what checks they did before I send them the bank statements.
Cash 4 U Now sent me my DSAR yeserday and there was no evidence of them undertaking any credit checks whatsoever at the time of them granting me the loan! surely that isn’t responsible lending!

no, a lender only has to make “proportionate” checks. The Ombudsman usually says checks arent need for the first few loans if they are small. Thats why a common offer is a refund from the 4th or 5th loan.

Just a quick update for people that are dealing with Lending Stream.
I was refunded yesterday, after 21days FOS accepted on my behalf. I didn’t receive any formal communication from Lending Stream after adjudicator ruled in my favour but as someone suggested here, I just chased them up through their live chat, submitted my bank statement showing my bank account details for the redress. I had defualted on these loans and was owing about £1k which is now gone and I had £515 in my bank account yesterday. I first lodged my complaint in May, LS rejected in July and forwarded to FOS immediately.

I’m enquiring regarding Satsuma Loans. I sent my initial letter back in 20 June 2019. They came back in the September of 2019 with a response throwing out my case. I was working away at the time and once I had time I referred this to the FOS and they contacted me on the 31st of January, asking for my final response letter. They then contacted me again on the 14th of February, my Adjudicator then summarised my concerns. I’ve had numerous emails since then stating that they are awaiting additional information from satsuma. Then on the 14th of July I received another email from a different Adjudicator, saying they were now dealing with my case and they had all the information but were awaiting additional information from Satsuma regarding my loans. They also said they have chased this up and hope to have an out by the end of the month (July). I’ve then had same style emails since with this new adjudicator, how they are awaiting additional information etc. I have recently sent an email on the 11th of September after no contact for 4 weeks and no response. Have you heard of any cases been settled with satsuma recently? Seems like I’m getting nowhere.

My partner made a complaint with Satsuma and they came back quickly with a standard rejection which has gone to the FOS, I have complained and it seems to be taking forever, I’ve had another email today saying they require a further 28 days but O can’t understand why there is such a difference in the time they take.

Well since I first heard from the FOS it’s been 9 month. Yet they are still awaiting information from Satsuma. Think they are using Covid to their advantage, which is wrong and people shouldn’t have to wait this long for an outcome.

Anyone had any luck with lending stream?
The adjudicator upheld my loans – 30 of them and asked them to recalculate Redress etc but they did not reply so it went to ombudsman. Ombudsman have now upheld 30 loans also and given them until 27th to show any additional evidence to argue it and they still have not replied.
No idea what will happen if they don’t reply by the 27th when the ombudsman said to both party’s to rely by.

The ombudsman made a provisional decision and and gave till the 27th sep for both party’s to reply With additional evidence. Lending stream have not replied as far as today. In ombudsman’s decision they said their final one would be the same if no additional evidence provided. What will happened on 27th because. Pearly lending stream have no intentions. Will ombudsman say so long to pay me and they have to by that date? As there isn’t any further up the ladder I can go with this redress they owe. It’s been since March and gone all the way to the ombudsman and still no reply from them

3 weeks ago FOS informed me that lending stream had agreed to pay me redress for 25 out of 27 loans & would be in touch with me directly. Very happy with offer. I hadn’t heard anything from them so contacted them a couple of days ago via their chat & was told they needed my bank details. Offered to give details there & then but they said that they needed to have them via FOS! I’ve emailed my adjudicator & waiting to hear. Think LS are giving me the run around!

They are definitely one of the worst companies to deal with. They ignored messages I sent them to ask about updates and even ignored my adjudicator when she asked for an update. I’ve dealt with other lenders and although some have been slow to pay out or provide a final response they at least had the decency to reply when you asked them something.
