What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

I’m in the same position, when I accepted the ombudsman’s decision I got this reply:
“Thank you for your email dated 8 April 2020 letting us know you accept our final decision on your case.
Because you have accepted our final decision it is now binding on both you and the business. We have asked the business to contact you directly to finalise this matter.
Normally we would expect the business to contact you within four to eight weeks of the date of this email. However due to the current circumstances this may take longer. We appreciate your patience with this.”
My question is if sunny do enter administration do they still have to pay me the full amount as it is now legally binding?

HI all. I have a payday loan with Lending Stream. I need just 2 more payments to make . So i got a new debit card now .Just gonna update my new card details , but you unable to update new card . Every time says unsuccesful try again later. I tried this for a week , nothing.
Tried to call them and automatic message only says we are unable to take any calls .If you like to make a payment press 1.
So i press and its says we are unable to take any payment try online …. and it hangs up.
Email them no response just keep sending letter that they keep adding late fee paments please pay now.
And after they the email address stopped working.
Later i got an email from a different address that sayng pay now or use live chat. LOL. there is no live chat options there.

Thank you so much for your help. I received Ombudsman decision that upheld loans 6 to 44 with Sunny. Total turnaround time for the whole process from start to finish was about 11 months but patience is virtue. I got just over £3k back. Sunny are cheeky and emailed me last minute offering about half of this but they had already made it drag on so long and this was not a great offer so waited for Ombudsman decision which came a couple of weeks later. It got escalated to Ombudsman in October.

I wonder if I could get some advice. I’ve just had my claim rejected by lending stream for 25 loans I’ve had with them since 2016. Not pretty reading but details below. I would say refunding just 5 & 6 is not generous. You would be likely to get back loan 4 by going to FOS and possibly loan 3. Loan 2 is pretty unlikely.
Obviously that’s without knowing anything more about your case… but it’s very rare to get the second loan refunded unless the amounts are large. the 3 loan however is twice as large as the first two, so you can argue that should have made myjar stop and think.

Thank you. I added second part with details as I don’t know how much dates / days between matter in the decision.
I replied to them asking to explain why they upheld only last 2 loans as there was the same pattern in previous loans and they were taken one after the other. I also had loans from other companies at that time.
I haven’t sent bank statements / payslips to them though. I don’t have payslips as I don’t have an electronic version for last year, but will wait for reply and maybe send my bank statements – not sure if that helps.

you don’t need payslips if you have bank statements and your wages show on there.
Large gaps are a problem but you obviously don’t have any.
FOS is looking for the point at which a lender should have made further checks. This is often after the third or 4th loan.
You can argue that should have been after the second as they were all in quick succession and the third loan was £600 which was twice as large as the other two, suggesting your problems were getting worse not better.
But FOS may say after the third loan.
It’s possible they would agree with Myjar – it’s not a dreadful offer.

Just got word back from Sunny and they’re not upholding my complaint on 21 loans and only willing to waive off my outstanding default balance as a gesture of goodwill they say..
By sending it to FOS will the outstanding balance be put on hold or can they pass it on to a debt agency?
Also could you please help clarify on the credit file for FOS.. will credit karma do and is the latest one used?

yes sunny can pass the balance to a debt collector, but why do you care? most debt collectors are a lot nicer to deal with than Payday lenders!

The FO got in touch today to say that Uncle Buck has gone into administration and can’t help me with my complaint. The adjudicator had upheld my complaint but uncle buck didn’t agree with the outcome, so it went to the ombudsman to decide.
I still owe about £400 on my loan and don’t feel I should have to keep paying it when the ombudsman said I should be refunded for all of my loans, which was well over £1000 in interest.
Have you got any advice on what I should do? Uncle Buck keep harassing me everyday and it’s just exacerbating my anxiety.

I also have a complaint with Loans2go because of their ridiculous interest on my loan. I stupidly took out a £200 loan and they want me to pay back £1200 altogether.
I’ve already paid back £500 and complained to them about their horrendous interest and my financial difficulties, but they haven’t upheld my complaint and I’m just wondering whether I should bother going to the FO with everything going on right now?

On Friday it will be 8 weeks from my original complaint to LS, i received an email on 27/03 delaying by a further 8 weeks due to Corona. Is it worth me emailing them notifying them that they have till friday to respond or i will be sending it straight to the FOS? are they justified in asking for an extension?

Looking for some informstion. I raised complaint with uncle buck who have gone into administration. I understand the redress will now be miniscule, which doesn’t bother me too much – although id like to know how to apply for the redress anyway, as they informed me they can no longer issue a final response?
Mainly, I’d like to understand that if I do this, can I still get all the negative information removed from my credit file ?

You have a current complaint in. It is likely the administrators will treat this as a Claim in the administration. If not, they should tell you you need to submit a Claim.
It will then take many months before that is sorted but if the loans are found to be unaffordable, they will be deleted from your credit record then.

Some advice please….
I have now closed all loans with various lenders and submitted my complaints. The one area I’m unsure of is sending complaints during an active credit line.
With Ferratum I have a £1000 limit of which I still owe c£800. I have raised a complaint with them however will this lead to Ferratum applying a default marker or putting me on some sort of plan?
I am happy to keeping paying as I expect the limit to be cleared by end of July but conscious that my complaint along with my outstanding balance could have an impact on my credit file?

Well 8 weeks point has passed yesterday for sunny(decision not upheld), everydayloan(no reply), drafty(god knows what is happening with them) and still no final decision on George banco. Had some luck with Ferratum however good will of £65 which accepted. Drafty are really starting to grind my gears as they are still trying to take payment!

They have said 9 in there report however from my credit file it’s 12. Totalling just over 3k and paid nearly 4K back. Would have been more but borrowed again to pay off etc..

I’ve had many successes apart from the obvious ones, lending stream, Sunny etc. I became disillusioned and couldn’t be bothered to chase with the FOS, but now I’m thinking I’m not letting these folk get away with it… what excuse can I use to defend that 6 months has passed?

Had an affordability complaint response from PiggyBank, I know they are doing or gone into administration, I was sent a final response for the 5 loans which I paid in 6 months. Their refund claim is 213.29 not sure if this is correct. How can I check this please. I also am waiting for other lenders to get back so I can apply the same method to calculate this.

Then if the loans were pretty recent the amount sounds right – a bit of 8% interest has been added.
You can’t assume this will happen with other complaints. It’s more normal to get a refund after the first few loans – sometimes 3 or 4, depending on if there any big gaps in the borrowing and how large the loans are.
Your complaint is stronger the more loans you had, the larger the loans are, if the loans tended to increase in size, if there were only samll gaps between the loans.

I had a complaint with Peachy about payday loans. They finally replied with an offer yesterday (not a lot but something), which I accepted.
Today they have replied:
‘We are happy to hear that you have accepted our assessment of your complaint.
Please be informed that Adam Stephens, Gilbert Lemon and Henry Shinners of Smith & Williamson LLP were appointed as joint administrators (the “Administrators”) of Cash On Go Ltd on 5 March 2020. The Administrators are working with the Company to facilitate an orderly wind-down of the business.
Your claim has been agreed and you will now be considered an unsecured creditor of Cash On Go Ltd for the value of the amount specified in that Final Response Letter. This means you will be entitled to participate in any distribution of the cash remaining in Cash on Go Ltd, once all assets have been sold or realised and the secured creditors have been paid. Please be aware that the payment you receive is likely to be considerably smaller than your accepted claim amount. This is because it is expected that the total value of all accepted claims received will exceed the money available to be shared out amongst the unsecured creditors.

I am gathering the evidence that the FOS have asked for with regard to my Sunny complaint. I have everything that they have asked for but the only thing I am not sure about is the credit report. I have got my free report on Credit Karma but I can’t see any way to download this. Also what information from the credit report should I send? The Sunny loans show in my closed accounts but I take it they will want to see all of the finance that I had at the time so do I need to print every section of the report and scan it in? That will be lots of pages!
Any advice would be great! :-)

Good Afternoon Sara, I finally received a response (Sunny) They have ‘partially uphold’ my complaint, offering to pay interest on only loans 21-27, incl statutory interest and removal from my credit file.
– Took out 27 Loans with Sunny totalling £6300 plus £5,600 interest
– Same Period: 10x Wonga loans in 2016 and 3x Wonga in 2017, 2x Credit Cards in 2016 and utilised over 80% of Credit
Sunny Decision:
– No evidence of financial detriment to you as you were never in arrears and you repaid these on time. No evidence on our customer system that you were experiencing financial difficulties or having problems managing your money
– We conduct affordability and creditworthiness checks for each and every loan application. Whilst we see you have taken a number of loans with us we are confident, based upon our checks that these were affordable.
– However, based on our review of your repayment record and the overall pattern of your borrowing, we consider that it would have been prudent for us to have contacted you before we granted Loan 21 to discuss your financial circumstances and determine whether continuing to lend to you was sustainable. I want some advice on how to proceed, as I just want ALL payday loans removed from my credit file, gaining a refund in not my primary objective. I find it hard to believe that they would have to wait until Loan 21 to realise that I was entering a cycle of payday loan debt. How do you suggest I should challenge?

If you send the case to FOS they are likely to agree with you that it should have been obvious you were in a cycle of payday loan debt well before loan 21. Whether that is from loan 4 or 10 or 16 may depend on the loan sizes and whether there were any gaps in the lendeing. So you are likely to get a much larger refund but it could take somewhile.
There must be some chance that Sunny goes into administration in the process. There isn’t any sign they are in immediate trouble though.
But say FOS order a refund from loan 7. It doesn’t normally suggest that loans 7 onwards are deleted from your credit record. It may just say negative marks should be removed. Occasionally it comes up with a later date and says all loans should be deleted after say loan 15.
So although going to FOS may well get you a larger refund, it may not result in any more loans being removed from your record at all.
Sunny aren’t generally responsive to negotiations. You can try offering to settle for some larger number of loans, but if you say many more they are very unlikely to budge.

Okay you raise some valid points thanks. Do you know what typical time frames are when applying to FOS?
I anticipate i shall respond to sunny asking them to reconsider and provide a transunion credit report as supporting evidence to highlight that i was in a cycle of payday loan debt earlier than the 21st loan they have suggested. Hopefully this will urge them to reconsider and offer refund on a few more loans.

Being realistic, I think you should suggest a number of extra loans if you want them to even think about it. And that number should not be large.

I had a similar issue with Sunny, I went back and forth with further evidence and they dismissed my entire complaint (i had 20 loans in 9 months!) – I referred to the FOS and had an adjudicator response last week saying they find in my favour from loans 7 – 20. Pending on sunny’s response (they have to the 5th May)
Sunny are awful at complaints, I’d refer to the FOS.

Just to provide an update. I asked to reconsider all loans from loan 15 to 27, and remove these from my credit file.
This was duly accepted today with a revised full and final offer.
To anyone else reading it’s worth attaching a credit report (I did for Experian and Equifax) and being thorough in your demands by backing with sufficient evidence!
Can’t thank everyone enough for this group! Finally debt free for the first time in 8 years…
Now to have a lockdown drink :)

Hi Sara, I have just heard from Provident in regards to the adjudicators assessment. They were supposed to reply by the 3rd of April but even the ombudsman couldn’t get a response from them. They have agreed to return the interest etc on 16 of my loans. Just reading the problems people are having with nearly all the payday lenders it seems to me that they wait until the last minute to answer any complaint as there is very little we can do about it. It’s a shame there is not a ruling body that can make these companies toe the line and be more helpful. For many years these companies have taken advantage of people that are vulnerable because of circumstances. I also wonder why so many go into administration when they were charging such high interest , where did all there profit go ???

Avant declined my complaint, as well as the adjudicator and then the ombudsman. It was all a bit odd, as it sort of mirrored my LL complaint, which they upheld.

Drafty (a part of Lending Stream) complaint upheld by adjudicator early March, they were given til 27th March to agree/disagree. I had email communication with them on the 17th March about their DCA conduct (terrible) and they put at the bottom of the email they had provided their response to the FOS – they had not, this was a lie! The adjudicator emailed them again and gave them til the 9th April to rely, they didnt do this either! My case now awaiting an Ombudsman to review it – how are they allowed to ignore the FOS (not even have the courtesy to come up with some excuse and ask for an extension or something) but simply ignore two dates? I have emailed them directly myself too, nothing in return. From Trust Pilot reviews they appear to be ignoring many people. They are affected by COVID-19, I get it, it slows the process but surely it doesnt account for their current state of ignorance. They are not the only company or person affected by the COVID-19 situation, I am affected as are millions of others. Any suggestions – negative TP review doesnt impact on them either.

Yes, they were quite quick with me. However, that was well before all of this pandemic business started off. By the way, Likely Loans have come back to saying, basically, they’d already scheduled my refund to go back to an HSBC account they held on file. Thankfully, this account is the correct one but wouldn’t you think that, for a refund of £3k, you’d definitely want to check the account details are correct first?

They have however as a goodwill gesture agreed to remove the outstanding balance of £427 so I will not owe anymore, have they offered it because if the FOS went in my favour the refund of interest plus 8% would be more than the outstanding £427? I’m just curious as I will probably accept the goodwill rather than pursue it through FOS

I complained about 5 loans when was in a debt cycle with PDLs and had a gambling problem. They rejected complaint. Adjudicator upheld loans 4 and 5 and they again rejected that so its been in queue for an ombudsman almost 3 months now
They and quidmarket have been the most difficult lenders for me. Pretty much all others either upheld themslves or agreed with adjudicator

Does anyone know how I can actually speak to some at Lending Stream?
I had a successful claim with the FOS and received my redress on the 19th March; however, the redress was reduced as two loans were being settled.
They have never administered the closure of these and today I have been contacted by a debt collection agency, I am pulling my hair out as I have sent countless emails, every time I try to call you can’t actually talk to anyone and if you try to web chat it’s automated.

The only way I was able to contact them in the end was through the live chat on their site. They have a chat bot that, if you are persistent with, tries to eventually find an agent for you to speak with. It will say they are too busy for a while but keep persisting by either asking over and over again to speak to an agent or closing off the chat and coming back to it later and trying again. I got through to an actual agent after about 20 minutes of trying to be connected then waiting and trying again.

Had some more positive news today, had made a complaint to moneyboat – they did not uphold my complaint, but after some further communication they have agreed to write off my outstanding balance which was in my DMP so one less debt to pay off and they will remove my negative markers on my credit file.

So – final complaint to Ombudsman against Sunny not upheld. Ok, fair do’s, it wasn’t for want of trying, it was a bit of a long shot anyway, and at least it lies as “satisfied” rather than “unpaid” or “defaulted” on my credit report. But the question now remains; would it be worth my while offering the DCA that took on the assigned debt from Sunny an F&F offer, and if so, what percentage? Around £550 was owed of which around £200 has so far been paid.

the debt is presumably showing as “unpaid” to the debt collector? if not, it will soon be added… it’s hard to guess how much a debt collector will accept as a F&F, it depends on your circumstances.

Sort of embarrassing to post but maybe worth a shot for someone else. Cut a pong story short, I’ve been arguing with GT about my Wonga refund I hadn’t got. Turns out I had. 2 months ago !! Kept searching in transactions for ‘Wonga’ but when I searched WFD (or something similar) – I was actually paid on 14th Feb I just didn’t see it. A little foolish of me but an easy miss I think haha

After putting off the advice in this page I decided to finally try and make complaints to around 7 pay day loan lenders starting with Sunny.
I just received my reply from them after 7 weeks they say they are not upholding my complaint and this is their final response. I had total of 37 payday loans over a period of 19 months – no gap in lending and this is confirmed by their email. They say no payment was ever more than 10% of my monthly salary (which would mean I was earning in excess of £5000 per month so clearly they are out by about 5x)
They sent me a very detailed response of they check my credit report each time etc etc and they are satisfied they had no reason not to lend – how could they not see that I was in a spiral of payday loan lenders borrowing from one to repay another.
They mention (I do agree with this) that the total payments over the 19 months I only repaid roughly 25% interest in top of the capital which is far lower than their usual customers. They also say there is no outstanding balance which is not true I have debt collectors for 3 loans.
I am disappointed that despite the very detailed response it is clear that they have not properly looked into my account. I would of settled for easy option – write off outstanding and remove negatives from file – but they as this is their final response I will have to escalate and wait potentially another year.

I suggest you reply saying it is not correct that you have no balances – list what they are – and say you will be happy to settle if they write them off otherwise your case goes to the Finacial Ombudsman.

Hello. Has anyone heard had any recent correspondence from the FOS regarding ombudsmen decisions?
After Elevate (Sunny) disagreed with my adjudicator back in November 2019, my case was referred to an ombudsmen for a final decision. I’ve heard nothing since. The current pandemic will add some time delay Im sure, but I was curious to see if anyone was else was in a similar situation before I contemplate emailing them.
It’s been over a year since the initial complaint was made, this is the last case I have to resolve!

I wonder if you could possibly advise me at all please? I wrote to sunny to bring about an affordability complaint regarding a total of 52 loans from Aug 2019 to Aug 2020 on 3rd March 2020.as of today’s date(26th April 2020)i have not received any form of reply or response from them and it will be 8weeks on the 28th April since i wrote.i sent the letter of complaint via recorded delivery and i can see that it was signed for by someone within their company two days after i sent it.
Of course i do completely realise the situation of the country at the moment with covid 19 but do you think i should give them longer than the required 8weeks to respond to myself under the circumstances or do you think i should immediately write to them again asking for a response as i have not received one as yet or do you think i should be referring my case to the financial ombudsman due to no response.
Any advice anyone could please offer would be appreciated and welcome.

I think you should send your complaint to the Ombudsman at eight weeks. Sunny rarely make good offers so why give them longer as you case will very likely have to go the Ombudsman anyway.

Anyone had any dealings with Onstride although I only had one loan with them for 800 I have paid £1244 so far and it is included my DMP with nearly £300 outstanding. I am aware that they are in administration but am getting no response with regards to my unaffordable lending complaint.
It concerns me that if they do find in my favour I will end up with a percentage of what I am owed so am wondering if I am better off stopping my payments to them until they let me know their decision. And can I appeal to the administrators if they don’t find in my favour.

that is exactly right.
The problem is that isn’t clear if you will win your case. It is only one loan but it is largish.
can I appeal to the administrators if they don’t find in my favour.
There will be an appeal mechanism. But if your loan falls outside their criteria for deciding a loan is unaffordable then you are unlikely to win.

Has anyone got any experience with complaints against quidmarket (stagemount ltd).
I have looked at ombudsman decisions and only
47 cases went to ombudsman compared to other major
Lenders where there are several hundred for each of them. Wondered if this perhaps indicates they uphold and settle most complaints ?
I also can find very little about their way of dealing with complaints online whereas most other lenders you hear about lots of cases and people’s experience with offers/rejection and what their general practice is.

I won a case against them after going to the FO. Quidmarket fight against you every step of the way so at the first opportunity go to the FO because I doubt Quidmarket will uphold your complaint.

Yes – they objected every step of way for me too. Adjudicator upheld all 3 loans and Quidmarket rejected. It has been in queue for Ombudsman decision since Jan 10th.

Dan – My case was resolved about 2 years ago but from my complaint submission to Quidmarket to the Ombudsman final decision took about 12 months.

Hi Sara,
It is very little amount of interest but she gave me a table with the 8 loans and interest and it is all between £5-£10 interest each time. I replied to her email asking if the balance would stay at £600 odd now and no more interest and she replied instantly, i also then asked if she had considered my bank statements in her decision before making her decision and no reply for that one as of yet.
What i don’t understand is she said didn’t uphold complaint, however has done what she has done and reduced balance stopping interest now.

Is there a reason why the interest was so low? did you repay all the loans after only a day or two?

I borrowed and paid back quickly within a month but there table says I borrowed £800 paid £1600 back within the month which is strange as I wouldn’t of been able to pay that in a months wages for sure.

I think you need to look at the numbers. It doesn’t shound right at all that you paid so little interest on 8 loans. Can you pick a loan and look back at your bank statement and see how much you actually paid? Say that £800 loan?

I have requested summary’s of all loan documents from them so i can see what i paid. I will also go back on bank statements now too and see if it matches their table.
Why are they offering this when saying DON’T uphold complaint?

They are hoping you will settle and not go to the Ombudsman.
Sometimes that are offering a good offer, a lender isn’t always trying to get away with something here. But I think you need to check those numbers to be sure.

What part was Partial – was it either affordable to me or not surely?

Partial means they agree some of your loans were unaffordable but not all. That bit is OK.
What sounds wrong is the interest they say you paid on loans 4-11. Can you go back and ask them to check as you think you paid more than they are showing.

Hi Karl,
Generally, MYJAR accept adjudicator decisions. They partly upheld mine, when I complained, but I took it to FOS and they advised that I should be refunded a lot more than what MYJAR offered, in their own response. They accepted the adjudicator decision and paid out soon after.

I just had a really crappy threatening final response from money boat , it was a £400 loan when I had 4/5 payday loans as well . Is it worth taking to ombudsman?

I have just had a decision from myjar not agreeing with my complaint. They say that they complted the appropriate checks however at the time of each loan I had 2 large guarantor loans and was in and out of debt management plans over the years! I have complaints in with FOS for the guarantor loans and awaiting a response! Do I send myjar complaining to FOS too?

I had 4 loans in total 2 in 2017 one for £250 one for £500 one in 2018 for £550 one in 2019 for £800. The last one has half outstanding at the moment and I did repay the others in full along with interest. I am Just awaiting response from FOS for my 2 guarantor loans at the moment, the myjar loans were only taken to cover priority Bill’s due to paying the guarantor loans.

what were the gaps between these loans? The time from repaying loan 1 to taking loans 2? Between 2 and 3? And between 3 and 4?

First loan settled 12-07-2017 2nd loan taken 07-12-17 (settled 28-11-18) 3rd loan taken 17-12-18 (settled 27-06-19) 4th taken 06-09-2019 this is not yet settled.

Then I think that is worth sending to the Ombudsman. there was a gap between alons 1 and 2, But nowt between the next loans, they were all going up every time – a warning signal – and the l;ast one was large.

Hi all
I’m just looking to see if anyone has had any dealings with My Finance Club?
I was caught up in a payday trap and I made a claim for irresponsible lending in early March.
I sent the initial email off on the 04/03/2020 and I have heard nothing from them since I received acknowledgement of it on the same day.
The deadline for the 8 weeks is on Wednesday and I am feeling a little nervous that they won’t get back to me at all, should I start preparing to contact the Ombudsman now? Or wait until Wednesday night/Thursday morning?

I complained and they rejected it the next day. Sadly yesterday the adjudicator rejected it too, which i cannot understand as i had 4 loans and all my other cases with even just 2 or 3 loans have been at least upheld in part.
My loans were one after the other and were 100 300 250 400.
I have asked the adjudicator to reconsider and made my points again that i shouldn’t have been lent to.
Sara the adjudicator said MFC did proportionate checks based on our lending relationship but i feel 4 back to back loans of quite large amounts warranted further checks which i told adjudicator.

Did you sent the initial email through the ‘contact is’ section on the website? Because I sent it through that and on the same day I received an email advising my complaint has been forwarded to the ‘compliance team’ and they’ll get back in touch in due course.
Also, I took out 8 loans since February 2019, all ranging from £300-£400.
Should I be looking at the fact that it’s taken the whole 8 weeks as positive news, or does it not matter?
I won my case just recently with SNC and they are refunding me all the interest of nearly £500.
All these pins were taken out at the same time I though :/

Hi I’ve just had my affordability claim upheld from Peachy and they have offered me £1500 and written off the £549 I still owed!
I’m just not sure I will see any of this as they have gone into administration?
Why would they still be sending out their final response?
If by some miracle I do see all or some of this money how long does it take them to pay out?

I just received an final response from MYJAR who didn’t uphold a complaint of not been affordable. I sent bank statements to them and had one loan of £275 which I’ve paid back £295 already and £156 left to pay. The bank statements show 15 pay day lenders and 4 loans and gambling I was paying a month and they say not upholding. Surely it’s clear with all those on my statements. I even gave them 4 months prior so they could see constant lending. Should I send this to FOS ?

you are very unlikely to win this complaint. The rules don’t say a lender has to look closely at a loan if it is small and they haven’t lent to you before.

Do you have information on Satsuma, lendable, drafty and Mr Lender as they all seem to not communicate into 7th week? Do they usually decline all or are they good at looking at the bigger picture and admitting to wrong doing.

Hi, I’ve been following this advice thank you. I received a refund of all my interest plus the 8% from Safety Net Credit which I was really pleased about. However, I approached Lending Stream in the same way and they came back to say for all my loans that they concluded that they carried out proper and proportionate affordable checks and declined my claim. I then contacted the Financial Ombudsman and have received a response to say, ‘I’ve not seen enough to say it was unfair for you to provide loans 1 – 7, but loans 8 and 9 should not have been lent’ to me. I feel a bit unsatisfied that this goes against some of the findings on here (e.g. refunds from 3-4 loan) and wonder why only loan 8 and 9 were identified as unfairly lent to me, whereas I was in exactly the same position throughout the whole lending period, already on a DMP and obviously borrowing more and topping up these loans constantly. It was an horrendous time. Do I have any recourse to go back to the FO or is this a final case closed? Hopefully you can advise me. Many thanks in advance, Jo

If your FOS decision is from an adjudicator I suggest you ask for that to be looked at by an Ombudsman.

I have an outstanding amount with peachy which they put on hold whilst investigating my complaint.
They recently responded saying my complaint isn’t dealt with in the 8 weeks but will be shortly and I don’t have to resume payments whilst this is outstanding.
I have now received an email stating about them going into administration and is aimed at creditors?

Ive had the exact same thing, but today received a final response and am owed £1500 and they have written off what I owed. But as they have gone into administration I’m not sure how much I will receive if anything
