What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

Don’t use a claims management company. They are expensive and often incompetent. It’s easy to do this yourself and you can ask questions below and get replies from other readers who have done this.

Satsuma are due to respond to me on my affordability complaint by tomorrow. They have just sent me an email advising they have been unable to resolve my complaint at this time and I can refer to the FOS now. Is this their standard response to everyone by reading posts on this forum and should I just send straight to the FOS?. They haven’t even sent me a summary of my loans and interest/charges paid.

Just had an email to state that NextCredit have decided to voluntarily liquidate. Frustrating as I submitted my claim 3 months ago, and they kept delaying saying “we are still collecting information”. I only escalated this to the FOC 1 month ago, and expect I’ll now get pennies should my claim be accepted.

Hi Sara, after a bit of advice if I can please, had my offer back from SNC today. I calculated I had paid around £4,000 in interest over the 2 years of lending. I also have an outstanding balance of £840 with them. They have come back and offered to wipe the balance and refund £1,000
Do you think it’s worth going back for more? Seems a little bit tight to me given the other offers I’ve seen on here. I would probably be happy with the balance clearing and a £2,500 refund or do you think this is unrealistic?

Satsuma gave me my final outcome today. Working out my expenditures etc they stated this was responsible lending etc etc, but twice in my outcome he said he was upholding my complaint..?! But then said i need to contact customer relations to pay my remaining balance. Very confusing.

Hope everyone is keeping well. I’ve got an ongoing claim with Satusma.
– 6 loan over last 18 months
– £4k total value
– escalating amounts
– Other payday loans held at the same time.
In short Satusma dismissed my claim stating it was affordable. FOS adjudicator stated loans 2-6 were unaffordable and asked Satsuma to refund.
Satsuma haven’t replied for 4 weeks and no sign of refund. FOS gave them until 26.03 to reply. They replied 25.03 stating they will be providing “a more detailed response soon”. I guess they are going to fight this one.

I had my loan with drafty and finally got a response from an adjudicator at ombudsman and he has agreed but ignored a lot of points in my emails and feel that he hasn’t really responded to a lot of stuff mentioned. Hi Sara, it was rejected from an adjudicator. My complaint was they gave me 1000 lending and I was making minimal payments back but I couldn’t afford to after a while after taking many more loans out following this and before this. Adjudicators response almost seems like he’s missed off. Half my complaint and ignored it. I suffer from stress related ulcers, severe mental health issues and lost my rented property along with a gambling addiction and he didn’t mention any of this. Along with a huge long line of bad borrowing. Said my credit file was in good order but it couldn’t have been that good where I felt I needed to take out a high cost loan instead of a small interest bank loan…

well you still owe the debt then. If you had a claim against them , you would have the right of set off, but as you haven’t this is a debt that still exists. the adminstrators may want you to carry on paying them or to sell the debt.

People often say “a loan is being refunded” because it’s quicker than saying “the interest on a loan is being refunded”.
It’s VERY VERY rare to have the whole loan amount refunded. Much less than 1% of refunds. You did right to only ask for a refund of the interest.

Good afternoon Sara.
I am really struggling to get many companies to give me a positive reply, I feel I am in the same or a worse position than most of the people on these forums who have received refunds. I have had over 60 loans from 12 different companies from 2012-2016. The only company to reply positively was Safety Net credit, who agreed to refund ALL interest and I have had an offer of £150 back to my bank account.
Am I doing something wrong when asking these companies for a refund? I have referred all to the FOS. I had family bail me out of tens of thousands of pounds and I rolled over many loans and often had 6 or 7 payday loans at one time.
Any advice would be appreciated, in dealing with the FOS moving forward.

Expect it to go another two weeks before they respond. They were given until 13th March to respond to my adjudicator but they ignored that and so they were given another two weeks. When I spoke to sunny they informed me they would get back to my adjudicator before the end of work on Friday. I will let you know if I hear anything tomorrow

Vix. If your reply was from the ombudsman he has told Sunny they need to give you redress. Which is a refund on interest paid on your loans. Plus an extra 8%. So more money for you. They have 2 weeks to disputes that. If they don’t you’ll be asked to nominate a bank account you want your money paid into. They have 28 days to do that and usually take the full 28 days.
So your due money back. Hope this makes sense. If you don’t understand what I have put. Just ask me. And I will happily explain again for you.

I’ve worked it out to be around 4K before the 8% where does the 8% come from? The total off loans or just the total off intress?

Nothing paid out yet, they said before or on 31st march although with what’s happening at the moment I suspect that the deadline will slip.
I included in my redress figure 8% and they made no mention of it, just agreed with the figure. They never mentioned tax, forgot to ask them….

I replied asking for some information as to how they reached that figure and enquiries asto wether 8% will be added.
I have just had a response simply asking for my mobile number to explain, as a rule I tend to keep everything to email but I’ve sent my mobile number anyway so will wait and see!

Ok so I had a reply but no phone call.
They have used the phrase “for the avoidance of doubt” and as I understand it they are saying the claim hasn’t been properly adjudicated and they made their offer based on what I asked in my initial email.
They then added 8% which totalled £20.52?
If I would like them to relook at the claim I need to submit further information before 3rd April.
I KNOW FOR A FACT I paid more than £300 in fees but providing information more than I have already provided is not possible?
I think I may have to be greatful here and close the claim £300 better off than I was before I started?
I’m more annoyed at myself for putting a value in my claim (as requested) that was much lower than I believe it should be, I was really relying on them to do their own research to find this out but it seem this has not been the case?

I had some time to think on my claim and I think the interest calculation was very wrong.
I have not asked them to revise my claim but to revise the interest added.

Money was in my account by 5PM yesterday so they kept their word.
I calculated it as the normal 8% and included it within the final figure which they accepted and paid. Was happy with what I got, another one down.

Great news, I’m really pleased for you!
Mine has not been paid yet but that is not their fault as I guess if I had simply replied to their email accepting the amount they offered then it would have probably been paid yesterday too.
I must say they have been very good to deal with throughout and I’m sure they will pay, my claim is relatively small I would imagine.
I emailed them this morning asking for statutory interest at 8% to be added as I do not see how the £20.52 they added could be correct.
I’m hoping they will simply reply with the new amount to be paid with the correct interest amount added.

Although we try to help as much as possible, unfortunately we only have access to limited information. As this is the case, we have consulted with management and the Financial Ombudsman and agreed our approach to the adjudication process.
In relation to your question around interest, a valid mis-selling claim results in the return of all interest and charges imposed on the capital amount borrowed. Therefore, the principle amount claimed of £300 reflects all interest and charges applied to your account during that period. Statutory interest is an additional amount applied to claims paid within a liquidation. However, we are only required to apply 8% to your claim from the date of liquidation, being 8 April 2019. On this basis we have applied the additional £20.52 representing statutory interest to the principal amount claimed.
Guess I’ll be greatful in getting something back but this just not seem right!!!

I agree Lee but I am grateful to get anything back as it wasn’t expected. This was a smaller case for me than others, Wonga/WDA. If they hadnt gone bust, I could have recouped over £10,000 but it wasn’t to be.
I feel your frustration and agree it isnt right but they have limited information which makes me wonder what EPDL did with their accounts!
Lending stream will be a nightmare for sure, still this is nearly over for me (only Money Shop and QQ to go), grateful to be rid of them all.

it was a condition of the claim to put in an amount I was claiming for and as it was goodwill of them to extend the deadline I complied.
I did state I wasn’t sure but it was at least £300 and asked them if they could work it out.
The offer was £320.52 which today they have said is the value of my claim with £20.52 added as the interest, surely this calculation in its self is wrong?
I can only find details of 3 loans and it does not include deferrals so I think it’s best to accept this one?

OK, if you put in a claim for an amount then that is what you are being given. The extra will probably be statutory interest added on – that would have stopped accruing when the company went into administration – I don’t know what date that was.
If you are being told you can provide extra information by 3 April, then why not?

Great news I’ve just been paid by the administrators for EPDL 🙂
This has prompted me to get on with some other claims I should be due redress for!
I was sure that I responded to the administrators of WageDay Advance however my last correspondence from them was then when I registered my claim, is this the case with others? Surely I should have heard something back by now given that they are supposed to be paying out next month?
I am going to send claims to some of the others I have outstanding loans with too, some are in default and some I am still paying! However I only have taken 1 or two loans with these so don’t think it will be easy!

Hi Sara I have a repayment plan set up with Safety Net Credit for £18 per week which I am up to date with. I also have an affordability complaint in with them. This morning they have taken £705 from my bank account as my wages have gone in which will leave me unable to pay my Bill’s.. The transaction is showing as pending, I have rung my bank to stop it but they cant. I have emailed Safery net to request they stop the payment and apply for the correct amount of £18. Will call them when they open at 8am but dont hold out much hope of getting through. Do you have any suggestions?

Oh dear, this used to be a big problem with them but no one has reported it for a while. This is why I always say people should tell their bank to cancel the CPA to SNC. You can set up a standing order for any payment arrangement.
I hope you can get the money back. If not, cone back and we’ll talk through what bills you have problems with and. Your options.

I had an email off LS last night saying I had successfully repaid my loan!! They have been on my dmp since 2011 and I only pay a few pounds per month to their debt collection agency. I complained to them last year but they made a ridiculous offer of saying the first loan I had with them that I repaid in full on time was unaffordable but the 2 later loans that I defaulted on were affordable!!!! I’m still paying these back 9 years later. The email said I’d made the majority of payments back and there was only a small balance left but my balance was still over £700. I sent my complaint to the FOS months ago as I borrowed £680 in total but have so far paid back over £2000. I’m still waiting for my complaint to be picked up by an adjudicator. When I logged on to my account it showed both loans repaid in full as of yesterday’s date. Have they done this with anyone else?

My adjudicator wrote to Provident In January and recommended a refund. They had until 12th Feb to reply and still haven’t to date. The adjudicator has said this will now to an ombudsman to review. Does this mean it goes in the queue and I can wait the normal time length for a decision?

Satsuma have emailed to apologise for not having got back to me and said they’re still looking into it but I can now go to FOS, whereas 118 have just gone silent but I appreciate they had website issues recently.
Sara; I saw you recently advise someone to go straight to FOS with one firm last week, I think Satsuma, but to hold off with anyone from going straight to FOS. Why was that, surely the moment you can go to FOS you get the ball rolling as the 8 weeks has past?

Absolute bandits, aww well… £1500 would have been good but I’ll be glad just to have the default removed from my file. I even left them a trust pilot review 6 months agosaying I knew what game they were playing by making us all go all the way to the ombudsman and they would be out the game soon… They replied with their usual nippy attitude “We can assure you we are no where near administration” I had a look at their companies house returns for last year… Huge turn over, tiny amount of asset’s, so we’re going to see next to nothing back.

Uncle Buck is the absolute worst, they knew exactly what was coming months and months ago. £4,500+ I’d it be looking at in another few weeks at most.
I hold the FOS partly to blame on this, they have been terribly slow, changed adjudicators, wasted huge amounts of time for now valid reason. £4,500 will be more like £45 in a years time

I feel the same…. It’s been as clear as day for the past year what was coming… Very poor working from FSA FOS and yet again we’re all let down. My ombudsman agreed with my adjudicator the day before they went under… Not a coincidence…. For me loosing the £ is one thing but it’s now this over 12 month wait to have the negative markers removed from my Credit Files that’s the really sad but for me.

Mine had totally gone round the houses at FOS. Passed from person to person new adjudicator etc etc. The delay has not been good enough. I know they are inundated I totally get that. They lost my bank statements and all my paperwork which I sent them 8 months ago. I arranged for everything to be sent to them again (with a new adjudicator who started from scratch unbelievably) I basically did all the work for them. So annoyed by this. Just got knocked back by the FOS for MyJar.
They said —”I’ve reviewed all the limited evidence provided by both sides in this case and I’m not upholding your complaint. I cannot reach a sound conclusion based on the information visible on this case that MyJar provided these loans irresponsibly.”
The initial complaint including a table of 8 lenders, 36 loans overlapping each other during a 14 month period in order to paint a picture of my financial health at the time. I said if they had checked my credit report they would of noticed a trend of multiple loans, from multiple providers overlapping each other.
They said —”Our website sets out what we typically think about when deciding whether a lender’s checks were proportionate. Generally, we think it’s reasonable for a lender’s checks to be less thorough – in terms of how much information it gathers and what it does to verify that information – in the early stages of a lending relationship”
The concluded with — “There wasn’t anything in the information you provided or the information Myjar should’ve been aware of, based on the limited information available that meant it would’ve been proportionate to start verifying what you were saying. Finally, I don’t think that the number of loans you took, the amounts they were for or the period of time you were borrowing meant your loan history, on its own, should’ve shown Myjar you might’ve been experiencing underlying financial difficulty.”

Yes, of course. It was actually 6 loans. I paid back all 38 loans apart from 2 (Wonga) and I had my redress.

So I think that loan 4 & 5 should have been considered for refunds. Not 6 – too long a gap since the previous loan. I suggest you ask for the case to go to an ombudsman.

You will now not be able to send the complaint to FOS.
The administrators may ask you to submit a Claim or they may treat your exisiting complaint as a Claim.
Then they have to find a way to decide which claims to uphold – that is usually a computer program.
But you are now only likely to get a small proportion of the assessed refund back and that will be after a very long process.

Literally one day left in my 8 week period since raising my affordability complaint, I have received an email from lending stream advising that due to the coronavirus outbreak they envisage requiring a further 8 weeks to review my complaint.
Should I hang fire or go straight to FOS?
The email says FOS and FCA are aware of the change in their complaint handling process ( it doesn’t necessarily mean they agree with it though)

I’ve got an active complaint with Lending Stream at the moment (6 weeks lapsed) and they’re just emailed me saying under the current situation they will require an additional 8 weeks to assess the complaint. It then mentions that the FCO and FCA are “aware” of this change in deadline, do you or anyone else have an information on the situation and if “Aware” means the regulators have signed off on this or are LS trying their luck to buy a bit more time?

I found out yesterday that Cash Genie tried to send me a cheque back in August 2015, it was for unfair practices rather than affordibility (Ariste Holding Limited, trading as Cash Genie, has entered into an agreement with the FCA to provide over £20 million redress to more than 92,000 customers for unfair practices). I’ve tried to contact Cash Genie but have had no luck and i called the administrators yesterday and they asked me to call back on Monday. When i click on the FCA link it says ‘Cash Genie has voluntarily entered into a solvent liquidation. The firm handed over to liquidator RSM Restructuring Advisory LLP on 5 January 2016. This will not affect the payment of redress to customers.’.
My question is a) Will it be RSM i need to contact about the cheque and b) whether you think i’ve left it to late. I used to use Cash Genie quite a bit and so i’d imagine the payout is likely to be the 000’s rather than 00’s.
Also many thanks for the help on your site, i sent complaints to all payday lenders and in total have recieved or due tor recieve over £11k in total. Got a bit of fortune as received my refund from uncle buck about 2 weeks before they went into administration!

118 118 have still not fixed their website, app or phone line. It’s been at least 10 days now. People have left comments on trust pilot about direct debits not being taken and the reply is use this bank account. I have no intention of transferring money to a bank account based on that. My question- if they do go into administration what happens to the money you owe them? I wanted to repay my loan early to save me a few months interest. Will the interest be frozen at date of administration- if indeed that is what happens? Seems strange to take so long to fix their systems.

if you ask for a settlement you normally pay interest for the next couple of months anyway, so you will save very little.

you had 32 Sunny instalment loans throughout your entire lending relationship with us (please see attached Loan Summary Sheet(s) for further details);
ii. taking into account all loans you were charged interest for more than 24 months; however
iii. during this time, your average loan amount was less than £150; and
iv. the total amount of interest you have paid is more than 25% but less than 50% of the capital advanced to you; and
v. you never fell into arrears (namely you made your repayments on time or within 7 days of them falling due)
Is this really just to dissuade me from taking it any further? I was getting loans from wonga at the same time, sometimes to pay off sunny and vice versa, sometimes getting a sunny loan, paying it off 3 days later when I got paid then the next week getting a loan for a similar amount but for 4 months or so etc

They are trying to suggest you have a weak case. But it is common for people to get a refund for many of their loans from FOS when they had 32, even if they weren’t large.
if Sunny have rejected your complaint, then you haven’t got anything to lose by asking the ombudsman to make a decision on this.

I recently got a response from 1 month loans (which I think Is sunny?!) saying that they didn’t uphold my complaint but they’re offering £230 as a goodwill gesture. I initially calculated around £800 in my complaint but I decided to take the Gesture as I’m could really do with the money and I don’t want them to go into admin while I’m still fighting.
I’ve now just got LS to sort out and that’s with the FOS and then my journey is done. Thanks a million Sara, I’ve had several hundred pounds back I never thought I’d see again and it’s literally all thanks to you.

I got my latest credit report from Credit Karma and I have seen that my last loan with Satsuma has been moved to settled but none of the adverse information has been removed. The adjudicator said any adverse information should be removed. Case was settled in early December. Who should I contact about this?

I received an email from FOS stating Peachy have gone in to administration so I would need to take it up with them.
Is this correct ?
I emailed Peachy making them aware but they have replied stating they have provided FOS will all the information for them to look in to it.

Hi Sara – I’ve had a complaint upheld regarding LS by the FOS and LS have agreed to settle the amount the FOS adjudicator said they should, and this has been confirmed and LS have said they will pay within 28 days – the question is ‘if’ they happened to go into administration before I’m paid am I correct in saying that I would be classed the same as everyone else and have to wait to be paid a much lower value?

Hi – safety net upheld my complaint and advised I was due a refund of £241. I chased this up on Friday and they advised it was being paid that day.
The money didn’t arrive so when I chased this morning they have come back saying there was an error in my full and final settlement letter and they will wipe the balance but no refund is now due.
Any ideas what I do here?

I owe them £880 and had paid interest of £1490 so I knew the refund amount wasn’t the full interest but I was happy to settle as it wasn’t too bad.

Then I suggest you reply that you accepted their offered settlement and unless they pay you that you will be sending your complaint to the ombudsman. And cancel the CPA to them at your bank so they can’t take any money from you.

That sounds like a complaint then. MB often don’t make good offers, so i suggest sending it to FOS now. Or you could tell them it goes to FOS in a week if you haven’t had a reasonable offer back from them.

Hello! I have had a final letter from Sunny today offering to write off my outstanding debt with them to the sum of £674.82. Not sure whether I should accept this pr push further? I part of their response
By way of background, we undertook the assessments detailed below before we granted credit to you and note that:
· you had 49 Sunny instalment loans; and
· taking into account all loans you were charged interest for 40 months; and
· there were no significant increases in Sunny Loan amounts granted to you;
· your monthly income was verified by CRA data when you first applied to us;
· you were required to use 13% or less of your monthly income to make your contractual repayments to Sunny (even where you were repaying more than one Sunny Loan at the same time);
· there is an outstanding balance on your account of £674.82
Interest on our loans (whether running account or instalment) has always been charged on a daily basis and since January 2015 has been capped in accordance with the FCA’s rules. In addition, we have never charged default fees or any other type of fees on our loans.

In the meantime I can confirm that as you have borrowed a total of £22,650 and repaid £24,267 you have only paid £1,617 in interest, your outstanding balance is £674.82 and so if you repaid this in full the total interest paid by you across all loans would be £2,291.

so you would be likely to get some refund if you take this to the Ombudsman, at least a few hundred, possibly more than a thousand.
The loans sound to have been quite large (average over £400) but often short term?

then I think you should send this to FOS. As Sunny has offered to wipe your balance, the chance of you getting less than this by going to FOS with a 49 loan case is very, very small.
And if you are still paying them, I suggest you stop. This will mean you are more relaxed about the time the case takes to go through FOS. It will harm your credit record, but
(a) my guess is it isn’t good at the moment and
(b) any negative marks will be removed from the last loan(s) when you win you complaint.

I have received an annual statement from wageme. It looks like they have been sending me this annually for a couple of years but not had anything about paying it back. I am in serious financial difficulty and wondering if I should just leave it for now as it doesn’t seem defaulted in my credit file or even be in it. Any advice?

how bad are the rest of your finances? By ignoring a loan you risk it popping up in a couple of years time, often better to face up to your situation now…

I think it was the only loan I had from them. I am in a debt management plan but must have missed this one at the time as I didn’t realise it existed which I know sounds unbelievable but I was mentally not well at the time. Probably I should just add it to my debt management plan

that is probably the best thing to do. How much do you owe on your DMP and how much are you paying each month? is interest frozen on all your DMP debts?

Lending stream – I sent a complaint to the financial ombudsman. Despite having 2 loans simultaneously, they looked at the incomings I had given lending stream (which were correct). Then calculated the amount I would pay back per month. They thought on the income it was affordable. They have not upheld my complaint. I don’t have my credit record from that time as I took them out in 2013 and we are now 2020 as my credit record certainly told a different story. I thought it worth a try but without the proper evidence I have been unsuccessful.

Hey guys just an update for you all on sunny. So adjudicator agreed in my favour and gave them until the 13th March to respond which they ignored so they were then given until 27th March I emailed them including the CEO and they told me they’ve not missed any deadline because they had until 27th March and they would respond by then. I have just spoken to my adjudicator again and they still have not responded so I have sent them another email. The FOS did say that they are struggling to get any response from the company at all at the minute so we will wait and see… will keep you all updated if I hear anything else

Hi. Unfortunately, I have a similar situation going on as they didn’t respond back to my adjudicator. I am now waiting on an ombudsman to take on the time but I’m unsure how long the wait will be until they are assigned. Hope they don’t go into administration. Thank you. My adjudicator informed me on 20th March – therefore, I’ve waited just over a week now. I’m not entirely sure what the expected duration is for cases being solved with the ombudsman but mine hasn’t been assigned yet so hoping for the best in the coming weeks. Good luck to you too!

Hi. I used a 3rd party company but for reference it has been with the ombudsman for approaching 12 months (2 adjudicators have looked and they have given me to April 2nd to question anything (it’s all fine) and then they make their decision).
Hopefully you get a speedy response but brace yourself for it taking a while

For anyone waiting for their refund payments from MyJar, I’ve just had mine drop in to my bank today, So obviously they are still working/working from home. What helped me get my payment quicker was leaving a bad review on their TrustPilot page.

Heyy, So I received, signed and sent them my settlement form on Weds 18thMarch. I also wrote to them a day later if they can confirm receipt (so that they have it) had no reply.
So I waited another week (the following Weds) to write a bad review on Trustpilot and literally that same day I had a reply from MyJar confirming they have received my bank details (settlement form) and that the payment will be with me in 10-15 working days from date of acceptance. Then randomly it went into my bank today.
Hope this info helps.
I will say as a heads up ifff you get to that stage of a Trustpilot review make out your really struggling for money atm and that you are on the verge of losing your job etc.

The ombudsman is making a final decision on my case with Sunny by April 2nd. Last year I rejected an offer of £1039 for the following:
You had 27 loans totalling: £6,770.00
Interest and fees totalling: £2,639.11
My question is – does the 8% interest they need to apply fall in to the £2639 figure or will this be added on top to my final redress figure?

Hi Sara,
I submitted an affordability claim against Peachy on 26th January and despite them going into Administration on 5th March and much to my surprise I received a “Final response to your complaint” letter today dated 30th March stating that they are prepared to “partially uphold my complaint in regards to loans #4 – #13 as well as adding the 8% simple interest per annum”. They asked me to confirm that I accept the offer and provide them with my bank account details.
I replied straight away saying I accept but do you think this offer is legitimate or should I expect to get another email in a few days stating that the company is now in administration and all claims will be settled by the administrators in a year when I will be lucky to get a penny!

I accepted an offer from Peachy just before the administration was announced and they have since confirmed that I will only receive a percentage of that offer. Unfortunately, we aren’t getting our claim value and we should expect pence to the pound.

I have received an email back from Sunny, they have rejected my complaint and are offering to write off the remaining balance of 163 pounds and a bit of change. They responded a week before the 8 week deadline. With this information they have given me is it now worth taking this complaint further. In total I had 25 loans with sunny over a 2 year period. I feel I may be in a position to take it further, is them offering me a deal now showing they believe that they could lose a lot more considering the complaint. Or do I take the offer they are providing with writing off the balance as it may be the best I can get?

Hi! I just wanted to share a very small win – I had only one loan with Savvy, but after the Wonga debacle thought I would send an affordability complaint email on the off chance.
They sent a reply to my irresponsible lending mail saying that by providing wrong income/expenditure e-mail I was liable for fraud, etc.
However to my surprise I then had an e-mail 8 weeks after the initial complaint saying they would settle with £200.
Only a little one, and have some much bigger ongoing cases *fingers crossed*. But with all the bad news going around wanted to share a small win!

Just had my final response from SNC they are clearing my outstanding balance of 1254 and also refunding 781 to me and removing adverse info from credit file. Finally 6 weeks in and a great result, I am very happy, thanks for all the help on this site.

Good news! How much interest had you paid on loans with them? Is your offer fair? I’m currently 5 weeks into waiting for a reply from SNC I owe 800 pounds and have paid 3000 in interest over the last few years!
