What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

Have had several disappointing outcomes from FOS adjudicators, only 1 out of 4 upheld to any degree. Problem was I had between 2-4 loans with a lot of different PDLs , at the same time, trying to juggle my finances, but they look at them lender by lender even though I asked them to look at the bigger picture, as shown in my dismal credit report from that time. With Quick quid (and Wonga ) I had loads of separate loans but that complaint is in the very long queue. Was hopeful for ladder loans too but email from FOS adjudicator today saying that she’s passing it to someone else after 9 weeks of it being on her caseload, with all the info from the lender in place. Feeling a bit pessimistic!

I’m sorry but it is much easier to win a case against 1 lender for 10 loans (say) than the same 10 loans split across 4 different lenders. A lender only has to make a reasonable decision on your application. Unless the loan is very large, they would not be expected to look in great detail at a the first or second loan.

I’ve had success so with with two upheld complaints (Safety Net and Mr Lender) I’ve a further 4 away to the ombudsman atm. Question, when the lender removes negative markers from your file what date should then be used as the date settled? There was still an outstanding debt on my Mr Lender account with the default date being 06/2018. Now the settled date is 05/2019, meaning it will now take six years to be removed from my credit files instead of 5 of I had left it as a default. I’ve emailed them and asked to change the settled date to the date of the issued miss sold loan, being 12/2017. Am I right in asking this?

A settled payday loan debt with no default or missed payments doesn’t actually harm your credit record. Unless you intend to apply for a mortgage in the next year, it probably isn’t worth bothering about. But if you do want a mortgage you could ask them to change the settlement date to be earlier.

I’ve been addressing my finances with the main aim of credit score/report repair as looking to the future I want to get a mortgage. All the advice I’ve seen says that any payday loan on your files within the full 6 year reach will more than likely result in not being offered a mortgage. With that in mind 4.5 years till they all clear is better than the 6. I just wanted to know what the rules state on when the settled date should be so that if Mr lender won’t change it back, I could challenge it. My tot money score has already jumped 44 points just having this one default removed. I’m still awaiting on the S.N. default being removed. Thanks you Sara :)

Hi All,
I just wanted to share with those interested in UncleBuck outcomes. I have received my adjudicators response today which partially upholds my complaint. The upheld loans were the larger ones which i expected. This will reduce the debt by £1000 which is a god send. I still have to wait for their response which no doubt will go to the ombudsman but definitely looks promising. If all goes well here my debt will be reduced by £8000 since my first complaint. It’s great everyone is still submitting complaints. I’ve finally had the adjudicator rule in my favour with LS, over 30 loans, 26 of which he has submitted to LS as unfair. Now, to say I forgot about sending this to the FOS, is an understatement, but a lovely surprise today. I’m just waiting now on LS response, if any at all, then hopefully a payout.

I have just received a first email picking up my complaint after sending it to the FOS due to P2P not upholding my loans. My question is I have now picked up missed loans that they haven’t mentioned in their final response that were in the same time as the other loans, can I reply back to them or do I need to wait and take it up with FOS?

It would be better if they had written their final response in a more helpful way, but if they have rejected your complaint or made a poor offer it is only worth going back to them if it is clear that there is a totally different loan that they have left off. Just make sure your complaint to FOS is clear about the loans and top-ups.

No offer was made loans were £1000 and £600 with interest paid back £4500, I had 3 missed payments and many payday loans at the same time as well as a debt management plan in place so I will keep fighting on.

Their 8 weeks is nearly up and I received a generic email saying they are still looking In to it and I will have a response by next week .
My loans with them are as follows :

And I have one outstanding which I am in a payment plan for
£1104. Their interest is so large on these loans as well

Hello following on from my last comment with pounds to pocket .
£600 loan 31/10/16 base loan then topped that up to £800 and on that statement it says total interest charged was £1,167.14
Then the top up is classed as a separate loan on their site so £1,018.99 and interest is £817.35 08/08/17
£850 interest is £640 23/04/18

Re Sunny. Just had a response from them. 14 loans over 3 years, total paid back £7443. They have rejected my complaint but as a goodwill gesture wiped the £1304 balance. I think this is a bit of a result. QQ Peachy and MyJar are flat refusal’s so they can go to the FOS. Peachy send a zipped file which you cant open !

Just wanted to know what form I need to reclaim £200 tax form HMRC? Also, do I have to wait until the end of the tax year to reclaim? I was also wondering what tax year my refund falls into and is it just the interest I pay tax on? Is interest counted as earnings? TMS made the offer on 3 April 2019 and I accepted on 6 April 2019. Does this make a difference to the tax year?

I had problems, I went with Experian in the end, yes it’s £15 for the month but you get the most comprehensive report going, a lot of credit companies use Experian, not sure if you get Experian on a karma report, I don’t think you do.

noooo – many payday loans won’t show on Experian, the lenders only report to TransUnion (used to be called CallCredit). Even if your loans do show on Experian, the lender is likely to say well we didn’t check that as we use TransUnion. So sending an Experian report to FOS is a waste of time.
I will try to find out if they are going to change Credit Karma to be downloadable. In the meantime, you need to get your Statutory report from TransUnion. You can then download that by saying you want to print it and changing the print setting to save as a PDF.

Equifax does free statutory reports now and you can generate them anytime and download them. The only payable services are the credit score and a few other bits n bobs that have no interest.
Some paydays loans do show up on Equifax, like MyJar and Active securities (247 Moneybox). I used to have some from Wonga too, but they eventually expired.
Experian is a waste of money and paying £15 wont get you much more, according to personal experience and Martin Lewis.

I contacted Credit Karma, and they were really helpful. They explained that, in the near future, they will reinstate the download option. In the meantime, if you go to your credit report, and print it as a PDF, and save it, you will then have this to send to the FOS. It did mine (over 150 pages), so I knew it had worked. When I opened the PDF, the whole document was indeed there, as an attachment :)

LENDING STREAM
Hi all,
I had an adjudicator rule in my favour with Lending Stream who were to respond by the 7th June. Have spoken to both LS and FOS this morning. LS claim they responded on 7th, FOS haven’t received it.
Has anyone else experienced similar? I don’t want to start pestering either party but the redress would make a huge difference for me (none of us have ended up on this forum because we won the lottery!) and I know they have a 28day window for payment so don’t want it to drag on too long.

Hi, I am in the same position, LS say they have sent it on the 10th and FOS saying not received anything. This also applies to satsuma who replied on the 6th and FOS not received. I will be calling the FOS today chasing this issue.

Yes, I had this the other week. LS sent it on the last day, even last minute. It took about 4 days for the FOS to see and I got the email maybe about 8 days after the deadline for LS from the FOS.

That’s over 11 loans, they partially upheld my complaint offering a redress of £330 loans 5-8 were upheld.
I sent to the FOS 13/05/2019, I have just been assigned an adjudicator 17/06/2019 how long is the wait till I receive a decision?

Well, they seem to agree with Adjudicators decision. After the adjudicator decided, they replied to the FOS in less than 2 weeks. I agreed to their offer and replied to the FOS, copying in My Jar. The business replied very quickly and asked me to send them a scan of my bank statement as proof of bank details before Friday 10 am as it is the cut off for their monthly pay run. i got paid next day.
However, they can take up to 2 weeks, depending on how far is the final decision from MyJar’s pay run.

Hi,
I’m looking for some advice. I’ve recently recieved my final response from MyJar and was wondering what to do next. I had 12 loans from them between 2014-2018. I’ve paid roughly £2800 in interest in that time with another loan taken as soon as one paid off. They have only agreed to payback £793 the interest for just one of the loans as they say they should have done more checks on that one alone. I had other loans after the one in question and was now thinking should I ask them to reconsider or just accept the offer?

That loan was for £1000 the next was taken out the same day as paying the previous one off for £600. The one following that was taken out day after paying off the £600 for £1025. These are the largest of the 12 loans and to be honest the ones I’m wanting to reclaim. They state they only made a mistake on the first large loan the rest they say they did all the checks. They also have jot added 8% interest and stated something about tax (contact them for more info).
I’m just wondering do MyJar reconsider the decision? Or should I send it to FOS?

Hi, I sent an email last week asking MYJAR to reconsider some if the other loans. I included screenshots from my online credit report as some more evidence of my financial situation at the time. Got an email back this morning saying they cant accept screen shots of bank statements I need to send them in. I’ve already advised that I would not be sending them bank statements in previous emails. If it goes to FOS then i would send them in.

I have sent a MyJar complaint to the FOS too, after they offered redress on loans 9-12 of a total of 18. Conveniently, these were the ones with the lowest interest amounts. Bizarrely, they said the ones before loan 9 were lent responsibly, as were the ones from loan 13 onwards. A bit baffling?

So guys tomorrow is Mr lenders 8 week deadline from the first email sent on the 23rd of April 2019.
If I hear nothing back from them tomorrow should I then on Wednesday email them again telling them that as the 8 week period has now passed I will be left with no other option but to pass this over to the FOS?
Or should i hang it out and give them an extra few days?

I hope someone may be able to help. Between sep 2013 – Aug 2016 & sep 2017 – March 2019 I got stuck in payday loan cycles.
I have sent a complaint to wonga (joint administrators site), sunny and quick quid.
During these two cycles o used to hop between these three lenders …so I’d use one for 3-4 loans then go to another so I didnt get denied. I’m wondering since I did it like this will they get out of it since they normally only pay after 4th loan?
I used to get 5-6 a month. Example would be this
Quickquid 2014 sep -dec, sunny dec 14 March 15, wonga March 15 July 15 and I would keep reapeting.
My view and point is that if they’d check my credit history they would see i had upto 50-60 credit agreements from payday lenders every year…so I think they should base it on the entire length not just after first 4 for them?

it makes it harder to get a large refund from a lender when you have done this. But if you did it for years and the amounts you borrowed were generally going up you should still get a refund. Expect Sunny and Q to reject or make poor offers – it’s likely these complaint will have to go to FOS.

i still have open loan with them which ~550, they also sent me an email a week ago Notice of intention to file a Default,We are writing to give you notice that should your full balance remain unpaid we will register a default with one or more Credit Reference Agencies no sooner than 28 days from the date of this email. So i am so confused. i wrote them an email asking about current loan but thought will ask you for advice. Worth accepting,if, they wave the 575 current loan and 525redress or go to fos on this deal?

Quite right that you have to clarify what they are doing with that last loan!
Could you redo the figures with the last loan separately… how much did you borrow on all loans apart from the last one? how much did you repay?
and then the last loan – what did you borrow and have you made any payments to this – ignore what they say the balance is and the interest is, just what you borrowed and have paid.
Moneyox 247 will negotiate on an offer, so its worth trying, not going straight to FOS

If you accept their offer, you can’t take the other lonas they aren’t refunding to FOS.
If the total borrowed is 9971 and you have repaid 11692 then you have paid 1721 in interest.
An offer of 524 refund (plus 8%) – it depends …
– if they are also writing off the balance then it’s okish but not good. You may well get twice as much by going to the Ombudsman.
– if they are using some of all of that refund to clear the balance so you get little or nothing it’s very poor.

I accepted an offer from Payday Express on one loan, they asked for further information on others but didn’t uphold them. I went to the FOS and it went to jurisdiction, the adjudicator looked at my case, she looked at bank statements, credit report and felt they should have upheld the other loans. She wrote to Payday Express on 17th May she gave them till 31st May but they still haven’t replied. She is giving them till 28th June as they are busy but if still no reply will chase them.

I have received responses now from most lenders with pretty bad news. MyJar have agreed partial responsibility and offered around £800 on £3000+ interest. Morses, Satsuma and MrLender have all said they believe the loans were affordable and offered nothing. They also said I provided no evidence. Loans2go haven’t responded.
My question – if I made out my expenses (mainly loan repayments, but everything generally) were less than they actually were, do I still have a case if I go to the Ombudsman? What is my best next move?

Probably send them all to the Ombudsman! Any you borrowed from more than a couple of times or where you still owe money or where the loans were large and definitely loans2Go – the worst of the lot for rip off interest. Yes Lending Stream . I’m 11 days in out of the 28 days and still no refund.
Could it be that they pay out as late as possible because of the 8% statutory interest calculation? . It wouldn’t surprise me, with Lending Stream, that they pay out the refunds so that the timing of the refund equates to the 8% interest offered.
One question I have though is if they pay later than the 28 days can you ask them to amend their 8% statutory interest calculation ?

Glad to hear I am not alone – hopefully when you get yours’s I’ll only be a day or so behind! good questions though – I think the decision (refund) is only up until the date of offer – the 28 days sounds like a generic acceptable timeframe to make a payment to a customer – just like with any other business product.

Another thing with Lending Stream and their slow refund processing.
I dont understand what is so difficult in processing the refunds. Surely , in straight forward cases where there is no outstanding balance on the account, etc, then all the hard work has been done. At the stage they make an offer then should have fully investigated the case and calculated the redress and its just a matter of clicking a few buttons??

I have received response from Sunny that my complaint was not upheld.
I had 15 loans from them, within a 9 month period – most of these overlapped and some were top ups.

I don’t give advice by email. And often it is other people posting here who will say the most useful things as they are going through the same process you are.
Mr lender – if there is a long gap, then Mr lender will probably treat this as two separate groups of loans.
People can win 3 loan cases (and indeed 1 or 2 loan cases) – it depends on your situation. So your claim would be much stronger if you borrowed 200,300,600 than if you borrowed 600,200,300 as with the increasing size, the lender should have noticed you may be in difficulty.
It sounds as though you have several loans outstanding? If so, you need to cancel the CPAs with your bank unless you are sure you can make the repayments and not have to borrow again. these complaints can take a long while to sort out, you can’t assume it will all be done in a month or two.

With reference to my ongoing MyJar complaint, I am becoming increasingly frustrated with the FOS. I know they are snowed under, and are doing a great job (under difficult circumstances), but my complaint is turning in to a bit of a farce. I originally complained to MyJar on 20/03/19. MyJar sent their final response on 08/05/19. They partially upheld my complaint, but I declined their offer and sent it to the FOS the same day. A couple of days later, I received a FOS email stating that the business had until 15/05/19 to give a final response to my complaint, even though I had attached the final response to the submitted complaint? On 19/05/19, the FOS acknowledged my complaint and gave me a complaint reference number, and asked for further information. I sent this (credit report and bank statements) that same day, However, since then, I have received a further email, asking me to return the attached complaint form and a copy of the company’s final response? (By the way, there was no attachment attached!). I’ve never known it be this confusing and I am pretty much losing faith in the whole process. Any advice please?

Just an update. The FOS have just called me, and the adjudicator introduced himself and we spoke at length about the details of my complaint and we answered each others questions. He says he is ready to look at my complaint, which I am absolutely thrilled (and astounded) at. Not bad going really to say that their initial acknowledgment was only on 19/05/19! He dropped hints on how he felt, about my case, and I explained about the persistent lending and online gambling, which I explained I had now been free of since January 2019. He said it was great to hear that I had made that break. I feel a lot better about all of this now and will look forward to what the outcome is. By the way, he couldn’t explain about the other erroneous emails, but he said he had all of the required information to proceed :)

Hi Sara, wonder if you can make sense of this one, FOS has agreed and upheld my complaint with Satsuma with regards to loan 6 and 7 which states that they should refund all interest and charges on these two loans, Satsuma has upheld their decision.
Loan 6 – £1800.00 – interest paid was £1785.60 (interest should be refunded)
Loan 7 – £2000 – interest added was £1984.00 (interest should be removed) (loan still active, I have paid £637.86 to date through a DMP to date)
Satsuma have come back with the following:
1. As such we can reduce Mr ???? outstanding balance by £387.72, this is made up of interest paid, 8% annual interest, and interest outstanding.
2. The above will leave a capital amount £895.68 which remains payable by Mr ????.
I believe that they owe me rather than me still having capital to pay or am I mistaking something somewhere?? please help….

Something is definitely wrong with those figures!
On loan 6, you should get a refund of 1785 plus 8% statutory interest.
On loan 7, the balance should be reduced to 2000-687=1313. So you should get a refund as the interest on loan 6 is larger than this reduced balance.
It’s not just that they haven’t taken account of your DMP payments, there is some bigger error than that. Go back to them and say this looks wrong and ask for details of how they have calculated it. If that doesn’t cause them to rethink, tell your adjudicator about the problem.

Thank you for your email, I have just called to explain a query that I have regarding the complaint with Satsuma. The complaint was that loan 6 (90000####)and 7 (90000244####) interest would be refunded/removed which would be the following:
-Loan 6 (90000240####) was for £1800 with £1785.60 interest paid (this should be refunded)?
-Loan 7 (9000024#####) was for £2000 with £1984.00 interest added (interest to be removed from loan, loan still active).
-I have paid £637.14 to Satsuma since June 2018 for loan 7 through my debt management company.
-My question is that how do I still owe Satsuma £895.68?
-Interest refunded £1785.60 (loan 6)
-Interest removed £1984.00 (loan 7)
-Paid to date £637.14 + £1785.60 = £2422.74. This would clear my loan 7 and satsuma would owe me £422.74 not including 8% interest?

Mr lender have told me despite my first email stating “affordibilty complaint” they say because I l my asked for statements in that one then it wasn’t the start of that and they actually have till the 25th of June to respond.
I’ve told them that as my first email outlined what I was complaining about then this as such should be treated as my affordibilty complaint.

In my opinion, any email sent with the word ‘complaint’ in the title should be treat just as such. After the 8 weeks have elapsed, since you first sent the complaint, forward to the FOS. They will see that you meant complaint, from the outset, as it clearly states this in your original email.

So you had two loans, the first topped up, then a second one of 850. The “separate loan” just sounds like confusing reporting of the top up.
With a loan, a top up and another loan it’s worth taking this to FOS. The loans weren’t small. It will depend on the details of your case what FOS decides but it’s worth a try.

Hi, I have received a response letter from the FOS following a Myjar complaint. The adjudicator has upheld all 5 loans (4 paid and 1 currently owing £1045).
They have said in the response “You should add together the total of the repayments made by myself towards interest, fees and charges on all upheld loans without an outstanding balance” does this mean the four loans I have paid in full the actual loan amount paid back is including rather than just the interest?
These are the loans:
Loan 1 £725 paid back £748.46 10th October 2018-15th October 2018
Loan 2 £1100 paid back £1157.75 15th October 2018-30th October 2018
Loan 3- £650 paid back £654.22 12th November 2018-13th November 2018
Loan 4- £500 paid back £507.50 14th November 2018- 16th November 2018
Loan 5- £1200 currently have £1044.99 outstanding have paid £93.04 in interest/charges so far.
Please could you also help me work out roughly how much I will be refunded please?

You have paid tiny amounts of interest on the first 4 loans. Not much over £100 in all.

So if you remove interest from the last loan, you need to repay wehat you borrowed. You have paid 173 to 1200 borrowed, so you still have to pay £1027 more. You can take the refund of just over £100 on the earlier loans off that so you will have to repay a bit over £900.

Doesn’t actually constitute the start of my complaint despite that being my very first email on the subject. They claim it was an email sent a week later that constitutes the start of this so They have an extra week to reply.
Getting pretty fed up with it all to be honest. I might just go straight to the FOS as they’ve said they won’t deviate from the deadline they believe is correct

It’s up to you. It is incredibly annoying. But Mr Lender are one of the few lenders that will negotiate if they give you an offer which is too low, so it may be worth waiting another week.

I think my irritation is because 118 are being deliberately awkward and it feels like it’s not moving anywhere. I may give them the extra few days and see but I believe both these cases will end up at the FOS anyway as other than SNC all of my other ones have had to go there

Sara Mr lender have come back offering a redress of 200 and odd pounds.
Have offered a redress on 5 of the 6 loans I asked for.
My last loan was the biggest with the interest over £1000. They say the gap was too big. (One and a half months) but paid loan 8 even though the gap between 7 and 8 Was more than 10 and 11.
I’ve told them I don’t want to go down the long route of FOS and even though I believe id win that I will settle for 950 plus 8% statutory.
I paid over 2200 in interest on all loans so I hope they accept this and it’s over with them

I had asked.from 7 to 11 As the earlier loans were actually affordable and I didn’t really have a complaint on them.
I asked them for 950 as I hoped an amicable deal could be reached without need of FOS. They’ve now came back and said 250 is their final offer as they’ve now accepted loan 7 was unaffordable

I had a complaint with SNC and they were a little slow but I imagine they are dealing with alot of complaints.
My final response was at the 6 week mark which they upheld all of my borrowing , I accepted then recieved the money the next working day.

Hi Sara, can you let me know your thoughts on this please ? A payday lender has stated that as I work at a bank I should have know earlier I could complain about pay day loans? I honestly had never considered or thought had cause or right to complain about pay day loans. In my work there is never any discussion or training about pay day loans.

I don’t think it’s a good argument but I know a couple of lenders are trying to use this to block loans over 6 years being considered. If they do, send your case to the Ombudsman and let FOS decide.

Has anyone had any luck with next credit on here?
I have received a final response from them and accepted the settlement, as I only had 3 loans with them. I can’t contact them on the phone and they’re really slow at replying to emails.

I recently accepted a refund from Next Credit on 26/04/2019 – with payment being received on 02/05/2019.
Worth sending a chase up email but i don’t think they delay payments upto 28 days like Lending Steam!
I notice that NextCredit are no longer offering payday loans due to commercial reasons – probably due to the number of complaints and refunds being paid out!

i have had my list of loans back from My jar but they have only put the 1 x loan from 2013 and they state they do not keep the records for older loans? and because there is only 1 x loan after 2013 then they will not be upholding my complaint. If i go to FOS with just bank statements for the older ones can i make a claim? but i don’t have any loan ID or what interest i paid as i had top up and there is 10 x loans prior to 2013? The last loan in 2013 went through a DMP and is paid but showing on my credit report, can i request they take this off?

Yes, send the case to FOS. You should be able to work out from your bank statements what you borrowed and the total you paid and the difference between those two figures is the interest and any charges.

I have an outstanding loan with My Jar. It’s a 12 month loan. I am really struggling with it already. I’ve had another previous few loans with them
Is there any point in sending a complaint if it’s still got most debt outstanding? I think I’ve only managed a couple of payments so far , but I am worried it’s due to come off at start next month

When I made a complaint against MyJar they put the loan on hold for three months with a frozen balance. It might be worth asking if they could do the same for you.

“Is there any point in sending a complaint if it’s still got most debt outstanding?” definitely! If you win a complaint here, the balance is reduced to the amount you borrowed less what you have already paid, so there is no interest to pay. And you can arrange an affordable payment for the balance.
when you complain, cancel the CPA to them and say you want an affordable payments arrangement.

I have a few large loans from them – provided within a few months of each other and within period of substantial pay day loans and high credit usage
I have found the combined payments very hard alongside other loans and payday loans.
I am not sure if they would consider an affordability complaint ??

Hi,
This month. So about a week to be paid. I spoke to several people all of whom told me the party line 28 days. However,I was passed to a manager at one stage and he said he’d try to get it processed sooner saying “ by the end of the week”. This was all later denied so I asked for the recording of the call. Hey presto in my account that afternoon.

Just phoned LS. Normal party line but said I wanted to speak with a manager. On hold for 15 mins and still no joy. He said the manager was still busy but said his manager said to put what I had said through to the refund team, and that it would be completed in the next few days, end of the week, then corrected to Monday.
So come Monday if nonpayment I will be making a call and asking for the same recording!

They paid me out late. After the deadline given by FO which they completely ignored. They did pay me out but made their own rules up. You could be in for a long wsitbut then again I have heard that people have been paid out quick. So good luck with that.

Hi. I sent my complaint against lending stream to the FOS and lending stream has got to refund me 1800. The FOS have told me if lending stream don’t contact me in 4 weeks to go back to Fos. The 4 weeks is up next week

Money shop (Payday Uk) have been a nightmare, I went through an over the telephone interview for loans older than 6 years go back as far as 2011 and in total from then to 2014 I had 43 loans with them, they will only uphold 21, have sent in total 19 different bank statements and they say they couldn’t reach a decision! This has been going on since September 2018. Finally had enough of their delay tactics and escalated to Financial Ombudsman 5 weeks ago, haven’t heard anything. They have been a complete nightmare sending same old email that due to insufficient evidence of some of the loans a decision cannot be made on 22 of the loans!

‘Unable to reach a decision’ is their normal response. Patience is key in all this. You should have got on to the FOS last year, you’d have been paid out by now. Never mind, something to look forward to early 2020.

Anyone has a case go to the ombudsman lately. My adjudicator was in my favour but LS have disagreed so now it’s in a queue for ombudsman only been 15months already. Just wondered how long it took for the ombudsman to look at your case and get back to you?

Hi Katie, I bet thats so annoying having waited so long as well. I expect LS are playing awkward knowing it will probably be in your favour in the end, did they say why they dont agree? I have mine with an adjudicator at the moment but don’t know if they have actually started on it yet as it was just an email to say he had all information required at the time, from your experience or anybody elses does that mean they are deciding on it or just they have it in a queue to look at in the future? This is my first time dealing with FOS so still unsure what the procedure is. Thanks

The FOS told me that they hadn’t agreed a couple of weeks back no reason why just that it will be sent to ombudsman. I was then told today it was in the queue for ombudsman for an independent and final review. I can understand why it’s taken so long as it’s more complicated as there was numerous loans at same time with LS but I didn’t expect it to take this lomg. I’m just hoping the ombudsman doesn’t take so long to pick it up as it will still be another month after that for a refund. With Wonga before the administration and QQ they were pretty quick at fos stage but this is the last one I have to deal with luckily

I have just had a adjudicator rule in my favour for 2 out of 5 loans I had from Uncle Buck. They have till the 21st of June to reply was wondering if they reply on time? Do they usually agree with the ajudicators decision? If anyone was wondering I sent this to the FOS just before Xmas this year so it has taken around about 6 months

Hi Sar, similar position. Adjudicator upheld 2 out of 4, Uncle Buck disagreed and went to Ombudsman. They paid out pretty quickly after that, I think it was about 6-7 days.

No. their Trust pilot rating is already rubbish. And there is no point in trying to escalate it – they don’t negotiate. Send it to FOS.

Sara .wanted to post a positive comment.I had 8 loans in total from Satsuma last two of which were on my debt management plan. Satsuma offered interest on first three plus 8 % statutory interest to reduce my balances.I wasn’t happy as they chose the three smallest loans .The adjudicator has today instructed them to return interest on all eight.Im well aware satsuma may challenge this .But As I didn’t know it was even being looked at has made me happy .Just the other four complaints to go two at adjudicators .Just over the year since start .

I finally received my complaint upheld letter from FOS indp Ombudsman on 13th June.. been trying to chase up/SPEAK to someone at QUICK QUID who CAN clarify payment process- but no joy:

Mine went to fos with qq . Qq agreed with adjudicator the adjudicator sent me an email with acceptance letter I signed it and sent a photo of it. I rang qq with my new bank details and they put the money in straight away it wasn’t a big amount around £400

QQ have not upheld any of my loans. I also don’t believe the table they have sent me of loans I have taken out is accurate when comparing it against my bank statements.
I have two complaints with them, the fact that they continued to lend to me but also, I tried to pay off one of my loans early and I cannot tell you how many emails I sent etc that were blatantly ignored by them, I even got on to their live chat and expressed how irresponsible it was that they lend so easily yet it is so difficult to make an additional repayment (yes I could have rang but I don’t use telephone). Even after expressing all of this months have gone by and I have had no acknowledgement from them. Plus guess what…as a problem gambler, those additional funds have now been spent! So I am stil stuck in the cycle when I tried desperately to get it paid off while I had the funds!
Now sending this to the FOS.
Anyone had any luck with QQ actually upholding anything before going to FOS??

At the moment QQ are making some offers directly but a lot of them seem pretty poor.
Most cases involving gambling have to go to FOS – lenders hope you will just give up on these cases.
The table of loans may look wrong because they will be counting top-ups as a single loan, or multiple withdrawals in a flex account as a single loan. but on your bank statement you will see a lot more credits and think they look like new loans.
Good luck with FOS. The argument that you were trying to pay off a loan early and they ignored this is a good one. I assume you have the emails as evidence of this.
I hope you have stopped paying them at the moment? Are you getting help to stop gambling?

Thank you, I love how supportive this site is! Yes I have all the emails and I even print screened the live chat conversations where they admitted they had recieved over 8 contacts from me and failed to respond, said they would respond but never did!
I am stil paying quick quid £50 per month as an affordable arrangement and have £150 left.
Yes I stopped gambling a number of months ago I haven’t had a new pay day loan for about two years, came across this site by complete chance! Already had £136 from ferratum and cashasap jsut offered £25 which I have rejected!
My biggest lender was sunny and had nothing from them. They extended the 8 week deadline by stating it is from when they acknowledged my complaint…which was 4 weeks after I sent my complaint!! Just going to wait it out for the sake of another 4 weeks to see if they come back with a sensible offer

Elle, Sunny are wrong. Time and time again I was told things like ‘you have to wait working days we don’t include weekends’ or ‘it’s from when we acknowledged/picked up your email’ the 8 weeks starts at. This is completely not true. The 8 weeks starts from when you send the email, the FOS has clarified this to me many times. If they’ve gone past the 8 weeks starting from your email, submit it to the FOS now. Even if they do reply with a great offer, which they probably won’t, at least you’ve already submitted it and it’s in the queue. Good luck!

Sunny are only making very poor offers to most people – refusing to refund any loans for the first 12 months of borrowing (!) so I am not sure it is worth waiting for them to come back to you.

Q or QY is when the account has been queried.
If you’ve put a complaint in then you are basically querying the balance. This doesn’t affect your credit score.
I have a few of these on my report and it hasn’t changed it.

QQ have made me an offer of £2500, decided against FOS, its a nice amount for me and will really help so I have settled.
I used resolver to make the claim, SO ANYBODY READING THIS THINKING ITS NOT WORTH THE EFFORT GO FOR IT!!! Use resolver or the letters on this website, you have nothing to lose!
Money is in my bank just under 2 months after submitting the claim

How much did you lose out on with QQ?
In my experience Payday UK settle the full amount within three months. Payday Express refused to negotiate, that’s been with the FOS waiting for an adjudicator.

Have received some offers today from Peachy Bamboo & Mr Lender and they are all trying to sneak an offer in with no interest. I have gone back and asked for interest to settle bar one as it was only for 1 loan.
