What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.

Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

I’m afraid that RSM can only make payments now by cheque as they do not have the facility to make bacs payments.
Your statutory interest will be calculated by RSM on the payment run day and I am unable to tell you how much this will add to the offered amount. The details will be included within the letter which will arrive with the cheque and unfortunately I will not be advised of this information at any point in time.

Hi Sara,
I’ve just started looking into my accounts, and found that:
Wonga – Since January 2015 I’ve had in excess of 54 loans, often month on month, and increasing in value.
QuickQuid – Since April 2015 I’ve had in excess of 18 loans, again often once paid off another one instantly taken out, including top ups and increases in value.
Sunny – Since June 2017 I’ve had in excess of 12 loans, increasing the repayment lengths to afford it, and taking more out once paid off.
Lending Stream – Since September 2017 I’ve had 4 loans, again 3 of them were ‘top ups’.
And others including Satsuma, Uncle Buck, WDA, Ferratum, Piggy Bank and dotdotloans (these were mainly 1 single loan).
247 Moneybox – Strange one, I signed up, they requested a bank statement to which I never replied, yet a loan of £60 ended up in my bank? Any advice?
From the above, I became nearly £3500 in debt with payday loan companies, do you think I have a case? I recently loaned the amount off a close friend to get out of the trap. I’m 23 years old, still living at home with no dependencies.

The Wonga, QuickQuid and Sunny cases sound well worth pursuing because of the amount of repeat borrowing. Even if you were living at home and may appear to have had low outgoings, the lenders should have noticed the fact you borrowed so much from them and all the other payday lending on your credit record.
Lending Stream too, 4 loans in 3 months is a lot!
The 1 loan cases are harder to win, you need to argue carefully what each would have seen when they checked your credit record.
247, are you saying you didn’t apply for a loan? Or that you applied for £60 and it was paid to you but you were surprised because you never sent them the info they asked for? In either case this is good reason to complain! But be clear exactly what happened.

So, I know a few people got their Ombudsman decisions through for Lending Stream within the last couple of weeks.
Anyone had any progress yet? I’ve had zero contact from LS, or response to my email I sent them a week ago.

Mine got upheld by ombudsman last week on 24th November. I hadn’t heard from lending stream but i called them to make sure they had info from Ombudsman…
They said yes we have “agreed to pay this back” more like you refused at every stage but have now been forced to pay lol… anyway they said they have till the 22nd december and i’ll receive final figures to confirm before then. They also asked me to confirm bank details so worth calling to speed things up, be prepared to get passed around before you get through to complaints dept though!

Didn’t take my bank details though, they told me that they would need to see a copy of my online banking to validate it was my account.

Can this process be used to complain about irresponsible lending on a logbook loan? I stupidly took one out to pay off a couple of payday loans and (obviously) found myself back in the same situation. With my head above the water now I can see how stupid it was of me to take it out, but similarly I wonder how on earth I was approved!! I had to produce a bank statement, which showed my recent payday loans etc. so they knew about them! Just wondering if I would have any luck trying to complain or if I should just forget about it? TIA!

Yes, the affordability rules are the same for logbook loans. It is however not that easy to win a logbook loan case if you only had one loan from them. It will depend what your bank account statement shand credit report showed at the time.

Update- Moneyboat have confirmed and wrote off my remaining balance of £475 which I’m happy with. only a couple of loans and it was exactly 8 weeks to the day they responded

So, the 8 week deadline for a reply from Pay Day Express passed today, and I’ve had no correspondence since 22nd November when they advised that they had not yet completed their investigations and would need more time – “I am sorry for the delay in replying to you and advise that we are not yet in a position to respond to your complaint as our investigation is not complete. The Financial Ombudsman Service gives a business eight weeks to respond to a complaint and, as this time has passed, this means: You have the right to refer your complaint to the Financial Ombudsman Service, free of charge.”
As anybody had any dealings with Pay Day Express, and is it worth chasing or send direct to the FOS?

I had a complaint with PDUK and Payday express . I got the same response and began to loose hope . I submitted to the FOS at 8 weeks . Before being picked up by the ombudsman they came back with responses on both cases . There were some loans that they were unable to determine and requested banks statements and credit report which I sent . I accepted on their initial findings at the same time which they paid in 5 days . Following the information sent they responded on the loans they couldt determine (they found them irresponsible) I will receive payout on that within the next week . I think they are just busy but from my experience they do respond . Hope this helps.

I have complained via resolver with regards to my payday uk loans back in 2013 as being unaffordable the day before the 8 weeks are up they have responded saying they wish for bank statements only for 2 months but loans were over longer time credit report also all income and outgoing expenses at time to be forwarded to them.My building society account I used is now closed as company merged with other I’m not sure why they ask for this as should already have it to use any help please

You don’t have to send them this information. As the 8 weeks are now up, you can send the case to the Ombudsman immediately.
It is possible to get bank statements from closed accounts and most people have found this is easier than they expected.

I had a refund and only had one loan with them, this was part of the response;
I am unable to uphold your complaint, as we believe that the aforementioned checks were proportionate and responsible. Initial assessment of your application accounted for some of the adverse information held at the credit reference agencies and as a consequence you were offered a small amount of credit relative to your stated income. As a gesture of goodwill, we will repay the difference between what you borrowed (£525) and what you repaid (£2013.40) which is £1488.40 and will refund this to your chosen bank account.
It took a while for the money to appear but my initial complaint was 1/07 and they settled on 29/08

I’ve just had a reply from payday express and payday UK 4 loans with payday express and 20 loans that they have on there system with payday UK … They have replied with a big excel spread sheet full of figures and colours and determined I’m owed not a penny even though I have borrowed near 3000 off them .. also on the payday UK loans they have missed numerous amounts of them off what do I do from here and has anyone had and look with the financial ombudsman even after being rejectd from payday UK

If a complaint is sent to the FSO for review, and the complaint isn’t upheld and rules in favour of the PDL company, do you lose your existing offer if one was made?

I am currently going through this process at adjudicator stage, and on one of mine, even though the adjudicator didn’t mention in her findings that 2 of the loans were irresponsible (as per the original offer) when I queried this, she wrote back to me to confirm she had subsequently spoken to the business who had agreed for them to also be included.
So I would suggest not, however, you need to be on the ball to ensure you don’t miss out.
Another one has ruled that there was no irresponsible lending, however, has still suggested that they pay the initial good will gesture of £150.

Good news today!!!!!!!!!!
Safety net credit going to refund me 0ver 600 quid and clear my remaining balance and remove stuff from my credit file. Ombudsman upheld my complaint with wonga. Just waiting on them to get back to me with my refund – I have worked it out to be around 1200 quid after they clear remaining balance. Lending stream complaont sorted at adjudicator level.cleared 1 loan and removed interest off 2 more outstanding loans so only have just under 100 quid to pay them. Wageday advance complaint upheld by ombudsman. Cleared outstanding balance of almost 200 quid and default removed from credit file. So happy that all of this is finally getting sorted out. No more payday lending for me and I couldn’t and probably wouldn’t of made any complaints if I didn’t read this webpage. Thank you very much Sara.
Timeline:
Started complaint in march. Got final response from them after 7 weeks so sent to ombudsman. Was picked up by an adjudicator about 6 weeks after sending it. Got told that safety net credit complaints were not getting looked at for a while back in august as they are different to payday loans. Finally got picked up by and adjudicator beginning of October. Got final decision yesterday. So 9 months total.

Safety net credit going to refund me by 7pm tonight. Sent acceptance letter by email to ombudsman on the 5th. I also emailed and called them on the 6th and got an email back yesterday to say refund will be in my account by 7pm tonight. Wonga refund will take up to 2 weeks to get into my account.

Took settlement with Lending Stream for £2000 of £3000 repaid which I saw fair. Ombudsman decision on Wonga came today at £4049 (fingers crossed they don’t object!). Wonga originally offered £1200. SNC wiped all interest on the balance owed. Piggy Bank wiped all interest on loan (only had one) and Wage Day Advance just passed the 4 week mark. Good mornin. So I’ve been a bit of a behind the scenes poster. And finally I have light at the end of my long tunnel. In order,
Mr lender: cleared full balance
Moneybox: cleared full balance
Wonga: cleared balance plus refund of £480
Quickquid: refund of £490
Satsuna: cleared interest balance of £900plus outstanding £400 (very unusual move as only one large loan)
Paydayuk: yet to contact back but ombudsman will force them to clear balance in two weeks.
I am officially payday loan free thanks to this website!
Each of these companies have/will remove loans from credit file.

i took out payday loans between 2011 and 2014 i borrowed just over 30000 over this period .i was on a debt management plan from 2009 to 2016 .i was in a spiral of debt all the time trying to juggle things should they have done the nessasary checks before they lent me the money .as i am in the process of claimng the interest back. any feedback would be helpful.

It sounds as though you borrowed a lot. A lender should have realised when you kept borrowing that you were in trouble and looked more closely at your situation. I suggest you put in complaints to all the lenders you borrowed from.

Can anyone help with when PDE and PDUK became part of the same group? The reason I ask is that surely if one company had defaulted me, even if the laws state that credit checks are not required, you would assume the responsible thing to do would be to check internal information which should have resulted in a no.
I’ve found some detail that confirms 2009 for PDE and 2011 for PDUK but would be great if anyone has any link to an official website

I submitted my complaint to Lending Stream on 9th October and got a final response on 21/10, however the offer was less than 10% of all interest paid on month after month loans, so I referred to the FOS on 14th November after I got back from holiday and still waiting to hear back

I got reply from LS after a week saying the usual bla bla but also telling me how many loans I had with them but then stated at the end that I have to send £10 for SAR. So they have checked my record first before acknowleding my complaint.

I am not making a subject access request, I am making an affordabilty complaint and i would like you to send me a full list of my loans and intetest paid.
If you are unwilling to provide the details then I would contact the ombudsman regarding my complaint straight away detailing your lack of cooperation and actively obstructing me from processing a complaint through you.

Just got 2nd reply from Lending Stream within a week off sending complaint. They upheld 2 loans out off 11. They also said I disclosed income up to £….. which is no way and my credit score was up to 709. No way my score was ever that high as i had so many payday loans and other late payments etc. Can someone please advice what to do next? Im obviously not accepting what they offer. But the most important thing I need the credit file wiped off which they said they would only do for the 2 loans upheld. Thank you

Hmm I wouldn’t trust LS as far as I could throw um. They rejected my complaint, they rejected my adjudicator who told them to repay all 19 loans I had with them, the case was sent to the Financial Ombudsman who also agreed with the adjudicator. LS has four weeks from the time I returned my acceptance to the FOS which will be up on Tuesday. Nothing from them as yet. They are a pain but others have had success with LS so holding out is the only option!

Yes yesterday but they are still in talks with MMF as they aren’t sure of the actual interest and charges. I have three outstanding payments with MMF so want to wait until they’ve sorted that before accepting their settlement offer.
However even with those three payments knocked off I should still receive a little over £5,000, it’s just a matter of when now.

Just added my payday loans up, back to 2011 and it comes to £32,666 which made me feel very sick and very embarrassed. At the time I was earning about £2500 per month so I wasn’t in a badly paid job but once you get in that spiral its very hard to get out. Thankfully I am now but am going after these companies for the interest, I had sent a few tentative letters out but am making it a priority now. This website has given me some fabulous tips and i’ll keep you updated. To anybody else out there who got in as much trouble as I did there is hope just keep your head up.

I started this process in May on 13 payday compliants. It is a lot of hard work at first if you have lots of loans.
My biggest Wonga case I had a total or 121 loans/including top ups over a 2 year period with a total of £29,549 borrowed. I won this case.
And so far settled 7 of 13 and have got back over 7k at present.
The remaining 6 – worth about another 4k to me have gone to adjudicator stage – 3 of the 6 have now been reviewed in ruled in my favour. 1 of which the payday provider disagreed with the adjudicator and tried to counter offer. I declined and advised this to be referred to the ombudsman to rule at present.
I had a gambling problem and I was honest that this put me in trouble and the payday loans fuelled my gambling habit. Allan my tip to you is f you gambled mention this is your complaints and the frequency of borrowing was to fuel this. Or the adjudicators / ombudsman will not understand why £2,500 was not enough to cover your monthly outgoings / expenses. Good luck.

Just got a reply from Lending Stream saying all credit checks and affordability checks were done and as I never missed any payments and still have two loans outstanding their decision is that I could afford the loans. They also said my Experian credit report figure was 785. I have replied saying I was on a DMP since 2013 (DMP was for just over £30,000 and is now about half of that) That alone should have disqualified me from any loans from them. The fact that I applied to many other companies for loans and they were the only ones that ever accepted me has been pointed out, plus the fact that they have agreed to 45 loans in just over two years which should have sounded alarm bells about my financial position, given their interest rates. I will await a response. If they get back to me this week saying they are not changing the decision can I go straight to Ombudsman despite only raising this with LS on Sunday or do I still have to wait the statutory 8 weeks?

Davy Lending Stream lie about peoples credit score. They did the same to me. You can refer to the FOS exactly 8 weeks from your initial complaint letter or if they state clearly it is their final response you can refer to FOS then. Either way expect a long wait with Lending Stream.
My lending stream case was sent to the FOS in July – picked up in October.
They offered me only £98 at the 8 week stage on 28 loans over 2 year period. Total borrowed was around 21k. In July complaint was initially submitted to the FOS – adjudicator ruled in my favour in late October on loans 6-28 plus the 8% and remove loans 6 to 28 from my credit file. Lending stream came back to my adjudicator following ruling offering me £497 refund on 6 random loans, plus another random 6 loans removed from my credit file, despite not offering to refund these. Declined this offer and instructed the adjudicator to put in the Ombudsman Queue. They are saying I’m likely to be waiting until late January / February for any ombudsman response.

As Lee says, Lending Stream often quote credit score numbers which are simply unbelievable – this doesn’t mean you have a poor case at all!
Your outstanding loans – can you afford the repayments without borrowing any more? If you can’t, then you need to cancel the CPA to LS at your bank and ask LS for a repayment plan for the balance. This doesn’t hurt your complaint, in fact in an odd way it helps it as it shows that you are in financial difficulty.
If these aren’t your only loans, it could be a good idea to talk to StepChange about your situation, see https://debtcamel.co.uk/help-payday-loan/. It’s important that you stabilise your financial situation, otherwise you may feel you have to accept a poor offer from a lender just to help you get through to the next month.

Thanks Sara, I will be contacting LS today to say I can’t afford the repayments and will cancel the recurring payments at my bank. As I advised before I am currently on a DMP with Step Change and am loathe to add these on to my current plan as I have read that I will be in breach of my DMP agreement by borrowing again. I do not want to go through all the hassle of setting up a new DMP with another company. If I can agree a reduced payment with LS until I get a decision from either them or the Ombudsman regarding my mis sold payday loans due to the fact that I was so much in debt they shouldn’t have touched me with a barge pole.

Sorry I forgot it was you who had talked about your DMP. As I said before, StepChange will probably be absolutely fine if you tell them what has happened and that you want to add the LS loans to your DMP. But if you don’t want to to do, this, only offer LS what you can afford – it doesn’t matter if they “agree” or not, don’t increase your offer.

I’ve just put in a complaint to Mr Lender. Can anyone advise if I will have any success? I took out a Loan in 2010 I couldn’t afford to pay back. They allowed me to roll it over 7 times before I contacted them and said I couldn’t repay. A family member had to clear it. They then allowed me to borrow again instalment loans 8 times which I could not afford. My credit score and report would have shown this. On my latest application they questioned
My report and then declined me. They email and text me a lot offering special deals to take out another loan. Will I have any luck? I don’t have an outstanding balance. Thanks

Sounds like a good case. Mr Lender are one of the quickest to respond and you can negotiate with them. They offered me about half my interest and I negotiated it up to 70%

They were very fast for me in replying; just a few days. I paid about £1800 in interest and was offered on just final loan, about £160. They also said I hadn’t informed them about financial difficulties until final loan, even though i had a repayment plan to repay first loan, yet they let me take out new loan within a fortnight of paying first one off and then a further 9 loans. I told them this and said I’d accept a refund of £1700 without the 8% on account of their speed of service. They came back a couple of days later offering around £750 to which I reiterated what I’d be willing to accept and put a time deadline on my offer. Was told I would hear before the 8 weeks and haven’t heard anything for a month now. My deadline passed now so will just wait for the 8 weeks then send it to FOS unless they offer full refund + 8%. They had their chance to make a fair offer!

From what you have said before, you didn’t have loans over 6 years old. the only other “complication” that tends to arise in Wonga cases is if they wrote off a balance back in 2014/5 – did they? Sometimes those cases seem to take longer, I am never sure why, but they usually get a sensible result in the end.
Have you tried phoning up and asking why this is taking so long? It is very unusual.

So a few weeks on and I’ve had a response from Mr lender. They deny irresponsible lending but offered £140 refund of late fees, the actual interest wasn’t much more than this so I took the offer and that has gone well.
However…
I’ve had an email back from CashEuroNet who have grouped together my Pounds To Pocket and QuickQuick complaints and deny irresponsible lending despite having statements showing my borrowing was going up and I was drawing from different lenders. They’ve offered £30 as a good will refund but I estimate my interest at £1500+ as they never provided the statements for Ppunds To Pocket. I’ve argued the case and will pass on to the FOS tomorrow after work. Has anyone had this from this company? Does this sound normal?

Kevin it is typical try and get rid of you on the cheap. Do not accept and go to the FOS, but you need them to clarify this in the final response before you can do that. No point arguing this one further.

Thanks guys. It didn’t seem right, I wouldn’t have made any claims to begin with but I was written to by Wonga last year who said they’d leant me money when I couldn’t afford to pay it back so wiped off my loan, paid back the interest I paid and removed it from my credit history, which helped immensely with the DMP I was on at the time.
I’ve forwarded the complaint on to the FOS and am just awaiting a response from them.

So another quick update. I’ve had an email from PaydayUk (the real PaydayUk) this afternoon to say they are upholding my complaint, that they didn’t ask enough questions during the loan process and they are refunding the full interest plus 8% per year on top for a nice £411 boost just before Christmas so that letter has gone off and I’ve just got to wait for the money now.
That’s 3 refunds so far including Wonga and one complaint in with the Financial Ombudsman Service covering the two companies above.

Hoping someone can advise here hope it’s not too complicated. I put a complaint in to Lending Stream and they rejected it but offered to reduce my balance by around £600 saying it would leave me with £400 to pay, I rejected this offer and the sums were totally wrong anyway I owed less then £700 not £1000 so I should have been left with around £90 to pay. I have now paid this debt off in full. My complaint is now with the Adjudicator I find it hard to believe they won’t rule in favour of me but if they don’t will Lending Stream still refund me the £600 they offered to take off my debts?

My Lending stream case was ruled in my favour on loans 6 to 28. Even when adjudicator ruled this Lending stream tried to counter offer saying they would refund me on 6 loans only but remove 12 of the 22 the adjudicator proposed from my credit file. I refused and told the adjudicator to refer to the ombudsman as I agreed with the Adjudicator.

OK, then I suggest you send it straight to the Ombudsman.
In your complaint to the Ombudsman, you should challenge anything PTP said that you feel is wrong.
So if you don’t think you did tell them the loans were for consolidation, then you should say this. You could also add that they should also have realised something was wrong if you were making three loans for consolidation!
I’m still not clear where they invested the £200 for socialising figure from. You could point out that your bank statements show you were struggling to make ends meet not socialising (assuming that is correct of course!)

The figures P2P say I have given them seem to be completely made up. I can’t remember what expenditure figures I gave them in 2014, however they seem incredibly unreasonable so I am almost thinking they’ve made them up.

If you had 1 loan in 2011 and 1 in 2016 and they were both for low amounts, it’s going to be hard to win this case. especially for the older loan. The more recent one, your credit record will have to be VERY bad to win that. Gambling makes it very hard for a lender to assess your position accurately if you are asking for an amount which looks low in relation to your income.

I have raised this exact thing with the FOS this week.
My adjudicator ruled in favour of PDUK even though I had defaulted on a loan with PDE before my last 3 PDUK loans and PDE admitted in their original response they should not have leant me. (This is why I asked the question does anyone know when they merged)
My point was, even though they had no requirement to complete a credit check, surely a check of their internal systems shouldn’t have been too much to ask?

It’s a common thought, but it often doesn’t get you anywhere very useful. The Ombudsman takes these cases as separate. If you had a pattern of repeat borrowing from one brand, then that should have suggested that they look into your case in more detail, but that could be by checking bank statements or asking you more questions, not just looking at whether you have borrowed from sister companies.

My car was eventually taken from me, but charges, interest etc etc where still added on top
not to mention when they reposess the car it is taken at less than market value, paid off the loan, but then interest and charges still go on top?
My logbook loan at the time was taken out to pay payday loans, and then payday loans to pay the log book loan and repeated etc

In short yes, I did it with Car Cash Point and Varooma, be prepared for a long wait as it will go all the way to the Ombudsman and then they delay the payout to the last possible moment.

As Simon says it can be done. It isn’t easy, but in your situation it is well worth trying, especially if you had more than 1 loan or a top up from them. Be prepared for them to reject your complaint and send it straight to the Ombudsman when it will be considered properly.
When it goes to the Ombudsman, send them a copy of your credit record and bank statements from the time you were borrowing – for payday loans you are always asked at the start for these, but not for other affordability complaints. But they will HELP your case, so send them in as soon as possible even if you aren’t asked. You can get bank statements from accounts which have been closed.
EDIT The approach on this new page https://debtcamel.co.uk/refunds-large-high-cost-loans/ should work better for logbook lenders than the standard payday loan letters in the articles above. Any questions are best asked over on that page.

update: received an email form my adjudicator that sunny responded and made an offer. As I had quite substantial outstanding balance (£1400) they offered to wrote everything off and remove it from file.
Also 24/7 emailed me saying they are willing to write off £4 . I responded that I would like to have the whole outstanding balance of £160 written off and entries removed from my file or I will have to send it to FOS. They have agreed.

Danny. Do not expect to find out by 20th. They will either run late or ask for an extension. Usually an extra 2 weeks so expect 2 weeks on from 20th. Once you agree its another 4 weeks to payment. Im in that stage at the minute and its frustrating.

I have had many loans over the past five years. Some where taken when in was in an IVA plan when as part of my plan agreement I shouldn’t have been getting credit and my credit report would have shown this. Unexpected bills led me to use pay day lenders wich then ( as with others) spiralled. I have took out loans again with the same company literally the day after paying them back.I am 10 months out of my iva but over £7000 in debt to 8 different payday lenders. I am paying min amounts back but am really struggling. On top of this I have now had a direct earnings order enforced on me (long story) so have £536 taken from my wages before it hits my bank.
I am off to see a debt adviser tomorow but just wanted to ask if I can claim even though I was in an iva. I’m grateful for anything I could get to help clear this debt.

My iva didn’t check my bank statements at the end of the plan, they just sent me my completion certificate. My child benefit and child maintenance payments suddenly stopped – no warning – and as such I had to borrow to pay bills. My son (age 17) decided to live with his father so I have been told to pay over £400 in maintanence to him. For 16 years he paid me £113 but the new system doesn’t take any of my bills into account as they did with him. I have been writing to them since May to tell them I am struggling to make payments and now owe them over £2000 in arrears. They have ignored all of my letters and implemented a deductions of earning order. I was getting myself back on track but this sudden loss of income meant that I had no chance to jiggle bills around and had to resort to pay day loans wich I struggled to pay back and had to borrow more to pay them back and to cover the £563 the child maintenance are taking from me. It’s a right mess and I really don’t see anyway out of it. I am paying my mortgage but am really worried that I will one day loose my house or have to resort to selling it. If I can get anything back from these loans it will help a little bit. In total I owe just over £7000 in pay day loans.

OK< well the answer is yes, you can put in a complaint about the payday loans and the money should come to you, not your IVA firm. Another thing you might consider as a means to get out of this nasty hole is to rent out a room for 6 months or a year? It's tax free income.

Hi, After coming across this site I have put complaints to the following companies-Wonga, Wageday Advance, QuickQuid, Peachy, Cash Genie, MyJar, Mr Lender, Lending Stream, 1st Stop and ecashwindow. Its made me feel quite sick going over my bank statements over the years. I am only 2 weeks into the process and have so far settled with Peachy. Today I received a response from Lending stream (I had 26 loans with them)
The are denying any wrong doing with affordability checks as I paid all the loans back , was full time employed and that the data I shared in the applications indicated that “your monthly income was above £2150.00. The disposable income on all your loan accounts was ample to complete the monthly repayments towards your loans easily.”Experian score was 666!
Can anyone tell me is this just the standard response they send back? Do I just check if this is their final response and then send to FOS?

Lending Stream usually quote a credit score number which has no connection with reality. 26 loans is a lot, send it to the Ombudsman as you say.

Yip, I got a very similar response from LS this week. Told me my credit score via Experian was 785, which considering I have been on a DMP since 2013 and my loans from them only started in 2015 is obviously utter rubbish. They are the only company that offered me loans so they obviously didn’t do an affordability check. Told them I wasn’t accepting it and asked them to tell me if that was a final response as I would go straight to the Ombudsman if that’s the case. No response yet, though I have been advised by some of the great people on here that they play it out for the whole 8 weeks. I am happy to wait and won’t be going away!

I contacted LS via their contact us form tonight Sam as I still have two outstanding loans and within 10 minutes I got a response from them which surprised me. It was telling me that they still think they did all the necessary checks and that if I was having trouble with the two outstanding loans (which I am) that they would be happy to put me on a payment plan. They asked for my suggestions. I am due to pay them £270 on payday so have told them that I can only afford £50 (the truth) Will see what response I get from that. There was nothing to say that was their final offer so I am happy to get these payments reduced and wait the whole 8 weeks then go to Ombudsman. Have asked them if interest will be frozen as it’s clear that being on a DMP that I cannot afford them. Will keep you updated

If they don’t “accept” 50, then you don’t pay them anything. They can only charge about 1 months extra interest then they will hit the legal price cap. And it’s a good bet your last loans will be considered unaffordable so any interest they add now will get taken off by the Ombudsman’s decision.
The key here is not to worry at all about these balances. Don’t accept an offer to clear them if you have paid them a lot more interest over the years (which you probably have!) If you can get money back in refunds, you can use this to make full and final offers to debts in your DMP, so getting a thousand back could pay off three thousand of your other debts.

Today I received an email from quickquid rejecting my complaint.
This was part of the response
If there was dependency we would expect to see constantly increasing amounts in order to cover the prior loan interest and principal. However, your loan amounts varied and actually decreased from the previous loan which shows that you were not relying on one loan to repay the previous loan.
You are claiming that you were dependent on loans. Yet if you were dependent on taking out one loan to repay the other then you would have taken out numerous loans, for equal or increasing loan amounts, and with very little time between paying off one loan and taking out the other. When I reviewed your loan history I see that you never had more than four consecutive loans with less than 15 days between loans.

Ignore their stuff about increasing loan amounts and the gaps between the loans – in your case they are nonsense. The gaps were very short and you seem to have had more than one loan out at the same time.
Yes this is worth taking to the Ombudsman. In your case the aim is to get the interest removed from the last loans where you still owe money and also a refund from some of the earlier loans will reduce the balance owed even further.
Make sure yopu tell the debt company that you are disputing the loan with QuickQuid and the complaint is going to the Ombudsman.

I’ve started to get final complaints back from Lenders even though only 5 weeks old saying they’ve lent responsibly and i’m composing complaints to the Ombudsman as we speak so hopefully get something positive in the near future.
I just worry though that when the Ombudsman sees my statements of all the Gambling Transactions that took place and won’t rule in my favour.
Anyway if i get anywhere it will take my remaining debt balance down on my DMP which is currently due to finish in July 2020 if not well at least i can say i tried and it’s not cost me anything to try either.

Got an email today to say that I will be on the next RSM payment run on 12/12/17 so I will receive my refund from Cash Genie… £517.74 plus 8% statutory interest and this was from a loan in 2013 so should be a fair bit of interest. So if anyone has already had redress from Cash Genie like I did, you should definitely send them an email as you may be owed more!

Wonga – I believe I have had over 20 loans with them between 2013-2015 and have asked them for a breakdown. How long does the whole process take?
Leading Stream/Quickquid/Sunny – I have had about 3/4 loans with each of these (all roughly the same time) and had to enter into payment plans with all 3 to finish paying off the loans. Do you think I have a case with them? I have ask them all for a breakdown (step 1).
Satsuma – Until recently I had 2 open loans (£500 and £800 initially) with them, both on repayment plans. I received a refund of £200 for 1 loan which went against paying the remaining balance off. I was notified through a letter last week (hence me now chasing up other payday loans). I haven’t received anything on my other active loan. Should I be chasing this up with them and seeing if I can a refund for the 2nd loan? Should I also be checking to see if I can get a better deal from them?

“The whole process” – well that depends on whether Wonga give you a good offer (in which case about 8 weeks), or if they accept the decision of the adjuicator at the Financial Ombudsmna (un which case somewhere between another 10 and 20 weeks), of if it goes toe the second Ombudsman level (another 8-12 weeks on average).
It is definitely worth complaining about Lending Stream/Quickquid/Sunny. You may not get a refund on all the loans, but still worth doing!
Satsuma – you need to check on this – It is possible the £200 they offered on one loan was to settle your complaint about both loans.

Well it’s 8 weeks on Sunday since I sent the request for a list of my loans to Wonga.
They literally sent me moments ago an £11000 offer. I could get another 2k but they were older than 6years and would need to go to the FO. I think I’ll accept the offer. Not bad for sending 2 emails and just before Christmas. Thanks for all your help.

Hi Sara this is not normally something i would do but so glad i stumbled accross your website and thought i would give it a try i sent my complaint to wonga and there 8 weeks is up on the 18th of December i had numerous loans over 2 and a half years month after month so fingers crossed with that one. I Also complained with pounds to pocket at the same time there responded this week saying they would not uphold my claim as i had 1 loan which is true however it was a 12 month loan which i took to baul me out frim the wonga trap i did not miss any payments but there was a few times when they tried to collect the money and there was not enough in my bank which incured charges i was also still borrowing from wonga at the same time. My question is should i take this to the ombudsman all my loans were before 2014 if that makes any diffrence

Before 2014 doesn’t make any difference. One loan cases are harder to win, but it depends crucially how large the loan repayments were on the PTP loan. Should it have been obvious to PTP that you would struggle to afford these? Did they ask you about your expenditure? What would they have seen on your credit record?

Thanks for your reply sara they did not ask about my expenditure and when i applied for the loan it was almost instant didnt ask for much details just give me a loan for £1000 over 12 months and i paid back approx £1800 my credit report was not great but never had any defaults etc to be honest i dont think they even checked it as i was borrow lots from wonga at the same time i appreciate your advise. I dont really want to take up the ombudsmans time with a poor case so might have to cut my losses on this one i will let you know the outcome of my wonga one (fingers crossed)

I don’t think it’s a poor case if they didn’t ask about your expenditure. And that is what the Ombudsman is there for, to look at situations where a lender has said No. If it was a single £100 loan that you repaid, then no, that probably isn’t worth bothering with… yours was a large loan, they should have asked questions about whether you were going to be able to afford £150 a month for a year? That is a significant commitment.
But you don’t have to make a decision now, you have 6 months in which to take the case to the Ombudsman.

Short update. Complaints logged with various lenders, 2 have already given a final response and both have been referred to FOS. I would so recommend that anyone thinking about a claim but not doing it needs to get on with it and make the time.
One question I do have though is about Minicredit. They are not in business and I had some accounts sold to Kapama so do I need to send my complaint to Kapama and what are the chances of them acting on it? Are they legally bound to respond as a DCA or not?

People have had success with Kapama for the loans that were sold to them – probably the best you will get is to have the interest removed from the outstanding balance but this is well worth doing.

Russ, I had my one and only loan passed to Kapama, I sent off the letter to them and has an offer of some of the interest removed but on a 200 loan they still expect me to pay 577. They knocked 625 off it but im contemplation replying to the offering to pay the loan amount back, it they refuse I may take it to the ombudsman.

I had a loan with Minicredit and they added loads of interest while I was with a debt management company because they were not accepting my payments. I complained to opos/kapama and got no where but took it to the FOS and they have agreed that it was not right so I am awaiting the response from opos to wipe the interest they added on to the loan! I had many a payday loan between late 2011 to 2015. All due to gambling I had a well paid job outgoings £1000 a month and my earnings were between £2500 to £3000. I got myself into a revolving cycle of payday loans. I do feel I’m to blame for the situation I was in but also i feel it was obvious what I needed the money for just by the patterns of borrowing late night getting money at 1am then somemore at 3am. I’ve followed step one got statement of accounts some loans were missing from QQ but I picked this up on my statements and made note of it in my complaint to them . I moved on to step two sent off my letters of complaints to the lenders but only with some of information from the template basically leaving out my expenses and concentrating on the amount and reoccurrence of loans. QQ have replied as was mentioned they would asking for bank statements wage slips. It was point out in a post that I need not send these but how does that stand with them being able to review my complaint when I’ve given them nothing to go on. I have no problem sending the information they have asked for as I will end up sending it to the FOS if it goes that far. Would this be foolish of me to do so or now that some sample cases with gambling have been upheld with the FOS will they recognise I have a case and also if it does go to the FOS at least I can say I’ve shown I’ve given them the facts and opportunity to settle.

You can send the info to QQ if you want, it’s up to you. Many people don’t want to. The Ombudsman will just look at the facts of the case – you won’t gain from the fact you gave QQ the details they have asked for.
You should expect that they will turn you down though and that this will have to go to the Ombudsman. I hope I am wrong here, but it’s rare for a lender to offer a reasonable refund to a case where there is gambling.

I was in the same boat as you. As a result I replied and told them to consider my complaint on the info they had, and anything further I would submit through the FOS.
QQ gave me a full refund, without the bank statements, whilst I was in the queue for the FOS.
I now have been a good girl for more than a year and its lovely to see the money in my account for more than 60 minutes!

Mr lender just called to offer me £250 goodwill gesture. I had six loans and just shy of £1200 interest.
My credit score was 184 at the time of lending and they claimed it was over 500.
Am I better to negotiate up or asks them to finalise their complaint and go to ombudsman?

I would point out a few reasons why too and don’t forget to include updates to credit files in your negotiations.

That doesn’t sound like a good offer from Mr Lender. They are the only lender that seems to listen to a sensible counter offer.
So you could reply saying their offer is inadequate, your credit score was a lot worse than they have quoted (do you have a copy you could send to them?). Say you have paid £x in interest (be precise if you can, so they can see you know the facts). But in the interests of a speedy settlement, you will be happy to [insert a reasonable offer here … exclude the first two loans, so that would be a refund of £y… ]
Of course it’s up to you. if the 2nd loan was much bigger than the first, they should have stopped there so make it all loans after the fiirst one. But if all the first 4 loans were very small, but then they got big, exclude the first 4.

OK – First letter off to the ombudsman.
Savvy approved me for three loans in under 6 months in 2015 – in the previous two years i had borrowed over £15,000 had repayments of over £21,000 and multiple missed payments and rollovers. Savvy have sent me an email saying that i told them in the initial application that i was using the money to pay off another loan – surely that is a red flag? They have attached all the application calls and i did underplay the extent of my loan repayments but surely the fact my credit score was so bad i was applying there in the first place and the fact i told them i was taking one loan to pay off another is pretty bad no?

I have started getting responses back from Adjudactors and I have had the first (and probably the toughest) rules in my favour.
It was with Sunny (Elevate Credit) but it was only for one large loan, repayable over 14 months. I will be getting all adverse marks removed and all my interest back but I wondered if they usually accept a decision or take it to the Ombudsman?

Just had a response from the adjudicator re Safetynet Credit and they agree with me. They state they should refund me all interest and charges from the outset (I’m assuming this is from loan 1) pay 8% interest, write off any unpaid balance and remove any negative info on my credit file. I have just submitted my complaint to the FOS re SNC. Like you I thought I had a good complaint but their final response completely ignored a lot of my points and simply quoted average monthly incomes and their calculations of disposable income (utterly wrong). They even used the fact on payday I would move money into a second account to stop their repayment systems taking full repayment then I would drip feed it back into the account their systems were watching as additional income!
SNC also ignored the transaction history of repaying then then few days later borrowing again almost continually for 3 years and seemingly ignored all my other loans!!
Can I ask if your response from SNC was similar to mine- and how long did it take to be picked up by the FOS?

Basically they said I had more than enough money coming in to repay the loan ignoring the fact I was paying £1000 a month on payday loans with theirs ontop, my salary was only £1100 but they’ve included the incoming loans as income. The adjudicator said they didn’t consider all the data on my bank statement s correctly and they should have been wary of the amount of short term loans I had. They also said
‘It appears to me that you may have included his short term lending credits as part of his income but this indicates a cycle of lending and short term lending dependency’
As it’s the worst possible outcome for SNC I hope they don’t be awkward and send to the Ombudsman.

In my Final Response Letter ..
They seem to have included credits from loans as Income and quoted high disposable income when increasing my limits. Throughout my dealings with them they never questioned the amount of short terms loans. Additionally my priority bills were often late or not paid – I guess that made them I think had lots of available cash.
Also the fact I borrowed in full then reloaned almost entirely for 3 years wasn’t mentioned only a line to say “the test of affordability on a running account is if a borrower can repay in a reasonable period of time” Hmm I could repay then borrow at all back again the next day!!

The problem for SNC is they have read only access to our bank accounts so can see absolutely Everything. My adjudicator said the following
Before agreeing to lend to Mr *** you had to make sure that he could afford to make the required repayments for the credit facility you provided.
Affordability checks should be proportionate. What is proportionate depends on things like – but not limited to – the size of the credit facilities, the required repayments, what you knew about Mr *** and anything he told you about his circumstances.
Before granting the credit facility you obtained access to Mr *** online banking on a ‘read only’ basis. You then had sight of 90 days’ bank transaction data prior to lending and you also carried out affordability checks on a weekly basis throughout the lifetime of the facility. You also checked his credit file.
Based on the information you have provided, I’m not convinced that you considered all the information from Mr *** bank transaction data correctly.

i have just emailed Quidmarket (stagemount limited) and Wageday advance using the template above. Between them since 2012 and 2016 i have had over 50 payday loans which i have rolled over or paid and borrowed back within a few day. In 2016 i had to go through a debt management agency to pay all my outstanding debts off which im wondering if this will effect me ? with asking fora refund ?

Going into debt management in 2016 doesn’t harm your case at all. These sound like two good cases – it would help if you know how much interest you have paid, otherwise it’s hard to assess any offer they make you.

Thats great I thought but then I managed to log in to sunny account and check that Loan was taken 1st Sept 2014 for £250 not as they say 1K .I did pay back £250 interest though .
What’s interesting is that they agreed that I shouldn’t be receiving this loan .Funny enough it was my first loan with them for duration of 6 months .

I suggest you ask for a breakdown of how it was calculated and tell your adjudicator if it looks wrong. That’s a lot of money, if it was £25 you might decide you don’t care but not £500, having come this far its good to be sure it is right.

I had a response back from Sunny. I borrowed from them about 15 times and they only want to refund interest for the first 3.
This doesn’t make sense to me. Surely the increasing dependence and increasing amounts, they should refund all interest.
Have you ever heard of sunny refunding interest on the first few loans only?

But that doesn’t mean the later ones were affordable! It sounds like a pretty poor offer, best to send it to the Ombudsman to look at.

Sara, I can’t explain in words how much you’ve helped me. At the start of this week I called the fos all ready for accepting the first offer from QQ. Out of sheer desperation I was going to take much less than my claim was worth. I was then told a second offer had since come through.
Of course I didn’t know when that would be paid. I got up today feeling sick with 73 pence in the bank and no presents at all for the kids. Then I got an email saying I would be paid within the hour. Relief and happy tears today, thank you so much xxxxxx

Has anyone had a very recent payout from Cheque Centre? I have just had an adjudicator decision in my favour on 17 of my 21 loans over 6 years with them, worth around £4500…..I’m now worried it’s going to be too late due to their impending administration! This is a bonus for me as I really didn’t think they would even allow them to be looked at and I’d written any chance of anything from it off. Adjudicator has asked them to respond by 23rd December. This is great news though as the decision wasn’t in my favour on loans within 6 years and had I sent to the ombudsman for a second opinion I probably would have had the same result as now and they were worth a lot more but hey that’s gone and I settled at the time for the right reasons. Any advice from anyone with any recent correspondence with them would be great. Thanks
It was back in April I made the first complaint to the ombudsman.

I am a lot further behind than you. I have paid around £11,500 interest since 2012 however I am told they won’t investigate even though my 8 weeks was up at the end of December and they have suggested I claim as an unsecured creditor through the administrators
Cheque centre and the administrators advised there is no money available so good luck. I hope you manage to what you deserve from them

That’s not what you wanted to hear Gail..that’s a lot of interest and I’m sure getting at least some of it back would have made a big difference to you. I have had just under 1k from them so if I get nothing more then it’s not the end of the world. I did worry that there would be no money left, however I believe they have a parent company in USA who were bailing them out until the end of December….I can only just wait it out until the 23rd and see if they respond. Otherwise I will end up a creditor and may get something at some point in the future! Thanks for your info Gail and sorry you have not been able to get any refund from them.

Another positive the adjudicator has agreed with me about myjar complaint with the 9 loans I had with them and asked them to repay loans 3-9. On my current loan with them I have paid £2000 including interest so far from a £2400 loan will they use £400 from what I am owed to close the £2400 loan (assuming they agree to close the case) I’m due over £600 in interest before loan 9 so I’m assuming £400 of that will pay the loan off and I will be left with around £200 is that about right? It’s a big result because I still owe £1300 on loan due to interest charges.

Great. My DMP was due to end in January 2019 but thanks to you and the people here using my refunds I’ve already brought it forward to May 2018 and hoping to be debt free even earlier hopefully by Easter 2018 thank you.

I have complained to several different payday loan company’s (Wonga, Quick Quick, Sunny, Wagedayadvance, Lending Stream, PaydayUK and Saftey Net Credit) they all refused to uphold my complaints other than Sunny who offered only to refund the interest on 1 of the many loans I had, and Saftey Net Credit who agreed to refund me the interest on all my loans plus the 8% statutory interest which was surprising! I have sent all the others to the Financial Ombudsman a couple of weeks ago but yet to hear anything.
