What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

This has been continuous repeat lending for 3 years and I am curious to know what my chances of a refund would be? Anyone has any correspondence with Moneyboat?

send this straight to FOS if they reject it – continuous lending for 3 years suggests the repayments were not affordable.
Expect MB to reply threatening to report you for fraud if any loan applications weren’t accurate. They do this everyone. No one has had a problem if they ignore this and just send their case to the Ombudsman.

I have outstanding complaint and awaiting a response too. You generally get them “threatening” to put a first party fraud marker but this is all a bluff. They aren’t even a CIFAS member!
I know a couple of people who have complained and also seen reviews online, they’re likely to say they’ve done nothing wrong or at best say 1/2 loans and chance it.

Has anyone ever been successful with Moneyboat or Quidmarket?
I have had 9 loans with moneyboat over the course of just over 2 years with the lowest being £500 and the highest being £700, mostly repeat lending and my complaint has been with them for a couple of weeks now. With quidmarket I have had 2 repeat loans, first one of £400 and the second of £800. When they accepted the second loan of £800 they already knew I was in a financial mess because I struggled to pay loan 1.

I made complaint with SNC on 04/07 … On day of 8 weeks I got email apologising that it taking longer than expected and they appreciate my patience. I passed this on to FOS to which I got email stating there is 4 month wait for FOS. Do SNC not have to give a response? Others on here have placed complaint after mine and received a response. I have chased and they have said they are treating as priority and cannot give timeframe! So frustrating!

So I made a complaint to Money Platform …to which I got accused of fraud in initial response!
I have had 3 loans –
16/12/20 Borrowed £500 Repaid £693
16/11/20 Borrowed £250 – Repaid £318
29/07/20 Borrowed £250 Repaid £360.67
They have sent following final response –
The credit reference checks reported no signs of current financial stress. The reference agencies only showed that you are currently a good repayor of credit. There were no signs of current financial distress. There were no current arrears on any credit products or credit cards over-limit at the point of application. You did then contact us to inform us you where in difficulty so we froze interest for you immediately and set you up on a repayment plan of your choosing – demonstrating our approach to treating customers fairly.
We disagree with your charge of irresponsible lending but we would like to settle this account with you personally.
Our offer to you:
We are able to send you a one off payment of £50
Do you think this is fair settlement? If they haven’t done anything wrong why offer £50?

Is this correct? Had your other borrowing increased a lot from the time you took the first loan to the time you took the the third one?
The first two loans were small. You are pretty unlikely to win a complaint about those at the Ombudsman. The third loan was much bigger and taking out as the previous one ended so there is a better case for that. You won’t definitely win a 3 loan case though.
You have paid £193 interest on it? That would probably be your maximum possible refund here. Plus the Ombudsman would say to remove the payment arrangement/default from your credit record I’d the case is upheld.
They have offered you £60. It’s up to you if you think that’s for or if it’s worth going to the Ombudsman to try to get the rest.
PS several lenders make these fraud threats. So far no one that has ignored them and gone to the Ombudsman has had any problems!

Hi,
I took a loan out with Loans-2-Go (£250 with 17 repayments of £57.14 = £1028.52). This was back in Feb 2020, and then Covid came. I was able to make 6 payments, and then explained that due to Covid-linked lack of income, I could no longer make payments.
Last year I complained to say I had been unfairly lent to, and certainly the repayments were unfair. They said they weren’t, and that was that. This was 05/03/2021.
With one thing and another, I left it there… until now. They have said they gave their final answer last March, and as such I can’t bring it up to the Financial Ombudsman. However, they still are demanding payment of more than £600.
What can I do, please? Thank you.

At the time it was dire. We were days away from having our 2nd child, I was trying to afford the gas/electricity bills and having to write to them to delay payment, and then I was trying to get that money with another payday loan. Retrospectively, it was frightening.
Now I am better off; not so much that I can afford to pay £600 they’re asking for though. I’ve repayed £344.40 of the £250 loan to date.

I complained to Loans2go about a loan I too out telling them I thought it was unaffordable and they are charging too much interest.
They rejected my complaint but offered to write off £431 interest leaving me with a balance of £302. The original loan was £400 and total payable back is £1479 over 18 months.
Do you think I should accept their offer or do you think I will have better luck with the Ombudsman?

Just need an opinion on a PDL I’m complaining about.
Cash Float lent me £900 ( only
Loan ) about £250 repayments a month. At the time of applying I had 5 personal loans, 3 credit cards and 3 other PDL one of which was £800, which was only taken out 5 weeks prior.
12 PDL taken out in 9 months and about £13k debt. Gambling transactions littered on my bank statements.
They have refused to uphold my complaint so it’s gone to the FOS.
I have told them I am only paying back the principal amount ( £50 a month )

Really hope moneyboat are one of the next payday lenders who is forced out, hopefully after people have managed to claim back the extortionate interest they were charging. They knew exactly what they were doing when allowing people to borrow continuously with their high interest loans.
In my experience they also have one of the worst customer experience teams.

A follow up from my post on the 30th august to fundourselves. They got back to me with their decision. Apparently I somehow got the total interest wrong, I calculated it to be roughly £450 but it turns out I paid £657.60 for 21 loans total. They have made me an offer of a goodwill refund of £382.40 to settle my complaint which is a refund of loans 7-21. Im kind of torn on this one, the waiting time at the ombudsman right now is really long, I have a case I submitted in March that still hasn’t been assigned to a case handler. Realistically im wondering if I went down the path of going to the ombudsman would I get much more money if they upheld my case? Also there’s the outside chance this company could close and go into administration during this long period of waiting.

it turns out I paid £657.60 for 21 loans total. They have made me an offer of a goodwill refund of £382.40 to settle my complaint which is a refund of loans 7-21.
That suggests that the loans 1-7 were larger than the later ones, or you repaid the later ones much more quickly – is that right?

I repaid the majority of loans 7-21 within a week, the loan amounts were roughly the same for all 21 loans. tbh im leaning towards accepting as the ombudsman probably wouldnt uphold all 21 loans + the really long wait. I’ve countered their offer with a request for £480, will see what they say

A refund on all three loans I had with them about two years ago, after a few quick emails today the past hour they say will be transferring me my refund within 5 – 10 days! I had an outstanding balance for a Myjar loan I took in 2016, which still have not paid. I have now received an email from ACI who are chasing me for the outstanding amount, but I plan on getting this paid off ASAP as this is the last outstanding debt I have.
I have never had an default or any other indents left on any of my credit reports for Myjar since taking the loan and not paying it. I have done well to build up my credit report the last few years so don’t want to mess it up.
So my question is, if I was to offer them a full and final settlement figure which is accepted and then paid off, would a new entry of partial settlement still be entered onto my report even though nothing for Myjar has ever existed? I know partial settlements reflect badly so want to avoid doing this if that is the case.

It may well be that no credit record is added, but in these cases where there has been some error it is possible in theory that one would be.
if a new entry is added, it should have a default date on 2017 then so it should drop off your record 6 years later next year.
A partial settlement doesn’t actually harm your credit score. And many lenders in future may not care about it at all, they will just be pleased the old debt is no longer a problem.

I’m in arrears with Fund Ourselves but recently they have been trying to take multiple payments of the same amount each payday from my account without informing me..is this allowed? I thought it was a fluke at first but happens a few months on the run now. I made an affordability complaint but sadly missed the time between their response and reporting to ombudsman after having a baby taking over x

Just tell them they cannot add a fraud marker on to your credit file as they’re not even a member of CIFAS. That did the trick for me.
It’s fraudulent of them too to claim they can do something they cannot.

At the Ombudsman you may well get a refund from (that is including0 loan 4 – 4th loan in a row and going up. And you should definitely get one from (and including) loan 6.
Expect MB to threaten reporting you for fraud – they do this to everyone and no-one has even had a problem sending a cse to the Ombudsman.

I have had a claim rejected by moneyboat, I had 3 loans in total (£400, £1000 & £700) and I paid around £650 total in interest. I provided them with statements for the complaint however they basically said even though the statements show I was struggling financially, as they didn’t have the information originally when giving me the loan its not their fault and are not upholding the complaint. I have since asked them to just remove the loans from my credit record without a refund which they also declined to do. If I take it to the FOS and win the claim would they have to remove the loans from my credit records? Or would they just have to remove any negative information? of which there isn’t any in terms of missed payments etc, I did try to argue that the loans themselves are negative when it comes to mortgages as they are marked as payday loans which I wasn’t aware of when taking out the loan but they still declined to remove them. My main priority is to have them removed from my record as they are the only account marked as a payday loan on my credit records. Is the FOS my best option? or would raising a dispute with the CRA’s be an option? along the lines of being misled into thinking these loans would improve my credit record but actually make it harder to get a mortgate?

The 3 loans: September 20 and paid back same month, November 20 and paid off in feb 21, May21 and paid off in June 21. I am hoping to apply for a mortgage next year

OK so all the payday loans have already been repaid for more than a year, and if you apply after June next year, for more than two years. This isn’t an insurmountable problem in a mortgage application normally, there are high street lenders that will make you an OK offer.
NB my comments are based on what the mortgage has been recently. It is in a state of turmoil at the moment and who knows where things will settle.
FOS doesn’t usually tell a lender to delete payday loans unless there have been an excessive number of them, only delete negative information.
But definitely take this to FOS. A refund on the 2nd and 3rd loans wi=ould be a nice dollop of cash to help with your mortgage application!

One other thing, I have had a few refunds with hopefully more to come. All loans over a year old but obviously the name of the company appears on my bank statement when receiving the refund. Some accounts such as mr lender have agreed to remove the loans from my credit file but they are on my recent statement giving me a refund. Will a mortage lender look badly on the refund in the bank statements? It also looks like a loan on the statements as a loan company is paying money into my account. Do you think this would be a problem and for any further refunds should I look at maybe asking them to transfer them to a different place, such as a revolut account or something.

Most mortgage lenders look back over 6 months of statements. They can take into account what they want… but I would be surprised if they are much bothered by one off credits to the account. I don’t know of anyone that has a problem with this – and quite a few people have got mortgages after getting refunds.

You could tell them a responsible lender would not have given you 10 loans since April 2020 and that should have shown that you were in financial difficulty that was not being helped by their loans (assuming that is correct in your case?).
it would also help if sent them your bank statements over this period.
Say you will be sending the complaint to the Financial Ombudsman if they do not make you a satisfactory offer.

Not really it would be a bit of struggle to do.

It can take many months to get a decision from the Ombudsman.
So if you can’t afford to repay them without difficulty, you should consider asking them for a payment arrangement. They should freeze interest, but this will affect your credit record. If you win your complaint any nagative marks of the recir record are removed.

You may remember i contacted you before to ask about loans 2 go and was advised to make a complaint to fos for irresponsible lending. I did this and although i rang and explained my position re cancer diagnosis i was told i would only be allocated a cade worker when there was availability. This all started in around june july time. I had an email from fos last week to say they were still unable to allocate anyone. In the meantime i had an email from loans 2 go stating it was pre solicitor letter that they were sending. I have complained to them numerous times about their aggressive communication, this time ireplied and copied in their professional standards dept, customer services, the litigationdept who had contacted me and their financial CEO who i found with a quick Google search. They have now offered to write the debt off. Im keen to bting this to an end as the stress has been really hard. If i accept does that mean the irresponsible lending claim cznt be pursued? I thought so, i haven’t responded yet so will think about it. The stress of constant calls and texts from l2go was really oppressive and part of me would like this to be recognised in some way. To be honest the only reason not to accept this is to get a payout. If you are happy with the balance being cleared, then accept it. losing a FOS case isn’t going to turn L2G into a more responsible, less aggressive lender I am afraid.

Is there any situation where a lender could argue that it was NOT irresponsible lending for them to give two loans in the space of three months to someone who provided different dates of birth on each application (the first one being incorrect), and claimed their expenditure had halved on the second loan? The loans weren’t for huge amounts but have since snowballed with fees, interest, bailiff fees etc. As far as I can tell, the lender can’t have done any checks at all or they’d have noticed the massive discrepancies.

I suggest you make this complaint and send it to the Ombudsman to make a decision on what is fair if the lender rejects it.
The rules are not written in great detail. All of these cases are “unusual” and will be decided on the facts of the individual case, not general guidelines.

I had one loan with Cash4unow and it was upheld within 5 weeks. The outstanding balance was written off and the remainder has been given as compensation. It takes 5-10 days to make payment.
Cash4unow have been one of the most easy companies to deal with. Quick response and admitting liability even with just one loan back in 2020.

I have seen a few comments on here about Lending Stream, and I’m aware they can be ok sometimes but other times unreasonable, but has anyone had success with their sister company Drafty? Account opened in 2017 with a limit of £350. Increases were frequent and the limit eventually increased to £2050 in early 2019. I entered into a plan with them during the COVID period and it’s almost now paid. I’ve calculated the interest is about £2500/£3000 so don’t expect them to fully uphold it as a lot of lenders are playing on the fact that the FOS responses are so long.
Complaint is at 6 and a half weeks, so not long to wait now, but if anyone has any experience of dealing with them please let me know.

Lending Stream complaint section of their website is back up and working, after being dead for a long time. They have put an almost threatening, “don’t even think about it”, warning on the irresponsible lending section! Just submitted a complaint using the template above. Had 18nr loans between Feb ‘18 and April ‘19. £5.4K with £1.6k interest. Fingers crossed I can get some of it back.

Did any one else receive an e-mail from Fernovo, regarding a redress claim in August 2022. I completed the relevant sections and was told that payment would be made within 21 days, I emailed them in early September to get this response:
We are processing a large number of cases at the moment, and we need to follow a strict process to prevent errors.
We apologise if there is any delay; however, bear in mind that this is a voluntary redress exercise that we decided to put things right and we are doing our best to complete the refunds as soon as possible
There is no need to contact us again.
I still have not received redress regarding my account, as this is a voluntary redress as they say, is there anything that I can do?

I got an offer of redress via a letter from them, totally out of the blue, and also had to chase them last week after 21 days. Got that same auto response back. Hopefully we’re not going to be left hanging on for weeks!

I got a letter off them in August and returned it straight away. I waited until early September after getting a further email and said I wanted the money within the timeframe quoted. They said they couldn’t do it but I said it wasn’t my problem – they shouldn’t quote timeframes if they cannot meet them. I ended up emailing the email address on the FCA website (I believe he’s the CEO) and then got the money within a couple of days.
In all honesty, I think they’ll go into Administration soon.

Hi Sara, yup that’s the one who I contacted and I got an almost immediate response the morning after and the money that day.
As I say, my opinion is they have been forced to do this and, like in most cases, usually the compensation ends up making the business becoming insolvent. Perhaps they’re relying on loan repayments to fund the day to day business hence the delays. Who knows!

I too got the letter from Fernovo back in the summer, I was very surprised by the offer to be honest. I did chase up with them as I hadn’t received the refund and got a generic response as others have said.
I did however receive the payment in September which was great. I hope everyone receives or has received their refund!
On a separate note I got the same offer of a refund from H&T, they actually refunded me within 7 days of me completing an online form.

Hi Sara. Me and my partner took a joint loan out for £6000 and it’s due to finish in Aug next year. We were both heavy in debt at the time, I recently did a sars request and was shocked that we were both in debt up to £31,000 with every card and catalogue maxed out and only paying minimum payments. They still gave us the loan, even though they were adding another £14,000 to our increasing debt. 2 years after taking the loan out, I went on debt management plan with stepchange. This is included on my plan but my partners parents give us the money to make up the monthly payment to them, because they are very unsympathetic to deal with. Should I go down the irresponsible lending route with them?

Lots of cases won against them – definitely make a complaint!
Also stop your partner’s parents paying them extra in the DMP – this just encourages them to be nasty to people in the hope of screwing more money out of some people! You are in a DMP, they can’t have money that you don’t have.

I just had a refund from Loans2Go. They rejected my claim so I had to refer to the FOS. They rejected the adjudicator’s response and I had to wait for an ombudsman. The ombudsman upheld my complaint. Tonight, I received £3300 into my account! Happy days.

I put in a claim against safety net 8 weeks ago today and I am due to receive a final response today as promised at the week mark. Quick overview of my situation. Had the account open since 2017 and borrowed over £37k with about £7k in interest trapped in the cycle of reborrowing due to interest fees to pay priority bills etc . Not a great situation. I had put in a complaint to SNC which they have today rejected on the basis that is was affordable. In total I borrowed around £37k since 2017 and Re borrowed within hours to keep myself afloat as the have a CPA on my bank account. I feel so stupid for using this type of credit as I was so uneducated and silly a few years ago. I was a bit shocked that they completely disregarded my complaint having read so many success stories. sent to the FOS today and hoping for better outcome . I thought it was strange that they only quoted loans up to 2018 even though I had used them from 2017- aug 2022.

Hi I really need help on whether the refund offered to me by Tappily is a good offer? I’ve had the account for nearly 3 years and i asked for a statement and the total amount I borrowed was £18,589. The interest added was £2300 apparently but I have paid off in total to date £18,683. The account is still open so I have a balance of £2,206. They wrote on the interest on the outstanding balance which was £501. So the outstanding balance minus interest is £1704. They then gave me a breakdown and said the out of the total amount I borrowed, the actual amount applied to funds borrowed was £16,884 and the interest they would be repaying me would be £1798 and including stat 8% interest and then minus a hmrc 20% reduction, the amount I’m due is £1948. But because I had still had the £1704 outstanding balance minus the interest they redressed that off the balance I had left and I am left with a refund of £242. Could someone help to see if this is correct? Because surely If the TOTAl amount I borrowed was £18.5k and £2300 of that was interest and I have repaid £18.6k back am I not due back the interest (£2300) and should they not completely wipe out the balance left? As it has already been repaid. I don’t understand the part of them saying the amount applied to funds borrowed (£16,884). Someone please help

I closed my Safety Net account last year in 2021 – I made a complaint at the time for unaffordable lending but it was rejected. To be honest, I am not too bothered about a refund but I would like some clarity as to how this looks on my credit report. It’s listed as a credit card and not an unsecured loan – does this mean this won’t be viewed as negatively by mortgage providers?

Mortgage lenders don’t see the same report as you do.
But it shouldn’t be listed as a payday loan. And loans are no worse than credit cards.

I had a pounds2pockets loan and the administrators upheld my complaint and told me it would be removed from my credit file, the debt had been with lantern and they are saying it’s a default and will still be on there for 6 years. Is this correct or should they be doing as the administrators said and removing the debt fully on my credit record? The balance is zero and showing fully satisfied but with a default on there.

Okay thanks, I did think this. I’ve got onto them and they were adamant it would stay on for 6years then I asked to speak to manager and when the girl went to get the manager she came back to me and said it would be sent to the correct department to take a look at and I would hear back from them but no timeline. Should I go to Ombudsman now or leave it a while. I’m not needing it done ASAP as I’m working on other complaints also and won’t need my credit in good order for another year probably.

I have just put in an affordability complaint to Safetynet for borrowing over a 20 month period (January 2020 – August 2021)
Having gone back through my statements I have borrowed over 9k and paid back in excess of 10k :(
How do I work out what an appropriate refund would be? I can calculate the difference between monies borrowed and payments made but how do I work out the 8% interest when it is a rolling credit facility?

I ended up in so much debt with multiple lenders – I applied for breathing space and then entered a DRO agreement in November 2021.
The amount listed on the DRO for Safetynet was £723.13 owed (just to mention I was released from my DRO Moratorium period earlier this month and I was told not do anything with this until the period had passed)

ok so if you win the claim, SNC will deduct the balance left (after interest is removed, from any refund. this is still worth doing for you.
But that complicates the 8% calculation. I suggest you assume it won’t be a lot.

I have just been going through loans I’ve had. I made a complaint to My Jar in the past. They emailed me back in July saying that my loan was out of scope and too long ago. It was 2011.
Is this correct?
Shall I still take it to the ombudsman?

It was wrong but Myjar are now in in late stage of administration and this is too late.

Complained to Lending Stream in October about 19 loans. Didn’t uphold the complaint for loans 1-5, but are for the rest of them. Just over £1,100 refund on its way to me. Result!

Just wanted to say in here that using the advice both from Sarah and others in this group I got an offer of redress today from SafetyNet, and it wouldn’t have been possible without all the tips and info from here, so big thank you to all.

I’ve been told I think I have a case here but I’m not sure.
I borrowed money from Tappily (SafteyNet) August 2021 and have never been able to pay it off. Everytime I’ve paid an amount back I’ve re-borrowed it so I can pay for things like food etc, now they’ve stopped letting me borrow which has left me completely in the lurch. Do you think I have a case?

Yes. Send them a complaint and send it to the Finacial Ombudsman if they reject it or don’t reply within 8 weeks.
