What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

I started a claim with Lending Stream on the 8th June I received the loan details two weeks later. This Thursday with only 5 days to go I received a final response with a great offer . I have responded via the link and I have not amended bank details as they are correct does anyone know how long I should expect to wait before the payment is my account

They where the only company that didn’t pay redress and admit unaffordable lending to me!
They where very aggressive and rude (when they did reply)
They actually threatened to take me to court for fraud as I didn’t tell them I had numerous other loans!
Even thought the emphasis is on them to do proper affordability checks under fsa rules!!
My guess the way there acting like they don’t give a damm they will be next to fold!

They often say this to people. There are a few lenders that behave like this. But if you send your complaint to the Ombudsman, no one has had any problems, they seem to be just bluffing to get you to give up.
They have been doing this for years – it’s not a sign that they are about to fold.

The 247Moneybox administrators are really taking the micky now. We should have heard something from them by the end of June, that was the date mentioned, yet, nothing from them in July and here we are in August and there is still nothing, not even one email to let us know what is going on or confirm our bank details which they should have done by this time. If there is some kind of a delay, it’s fine but they could at the very least send an email to let us know where things are at, even ICL did that much at least.

It looks as though the manual review process of appeals from people about the numbers of loans upheld has taken longer than expected. That latest repor says they hoped to complete by mid July. After that they hope to sell the remaining loans book.
The eventual payout is expected to be small.

I was hoping to possibly get your guidance as to whether a friend of mine has reasonable grounds for a complaint please? I believe they used lending stream.
The loans she has taken out are as follows.
4/08/19 £600, paid on 24/8/2019 £700

She made extra payments on some of the above in order to try and mitigate interest. However, this led to more borrowing. Her credit file is very poor.
She has advised that they asked for access to bank accounts during some of the applications, however that was just for the account she was paid too. If they read through the Statements, they would have seen that the full amount received was transferred to a different account each month (I believe the account the payday loan was paid to), so her balance was always zero.

That is a lot of borrowing. If they don’t make a her a reasonable offer, i suggest she sends the complaint to the ombudsman.
I haven’t seen any Ombudsman decisions on cases where LS used Open Banking to check a loan was “affordable”. This has only been done more recently and any cases haven’t yet gone through.
But if they only looked at the bank account her salary went into, then that is obviously a good check that on what she earned. But in her case it would have said nothing about whether a loan was affordable or not. So I don’t think this would be a good excuse for LS to reject her complaint.

I’ve just had an email from the FOS regarding my complaint with 118 Money – they recommend that any money i received from loans should be added up and if I paid more than I received this should be refunded along with 8% simple interest – I paid £2355 more than I received in loans – does this mean this is the amount of redress that will be due?

when you say “I paid” is that the total of the cash payments you made to them? Or does it take account of the settlement amounts paid from any top up loans you had?
When you say “More than I received” are you adding up the total value of the loans? or the cash amounts you received?

£2355 is the amount I have paid back over the amount of the loans which has also been paid back. I had 2 loans straight after one another with no top ups. I still have a balance of £328 to pay. ‘More than I received’ is the amount of cash I received for the loans.

ok, the numbers are much easier to work out if there is no top up loan. From what you have said, it looks as though your balance should be cleared and you should get £2355 refunded.
Also any negative marks should be removed from your credit record – if there are any.

Which loans do you believe were unaffordable?
Please could you elaborate on the difficulties that were caused as a result of these loans?
Please could you confirm the reason as to why you believe these loans to be unaffordable?
What would you deem to be a suitable outcome to your complaint?
Once we have received this information we will be able to proceed accordingly.
This is not what they said in their original email.
How do I proceed further? Do I supply them with information?

You should reply that you didn’t respond to their letter because you never received it – but even if you had ignored it, they should still have considered your complaint and responded within 8 weeks.

It is hard to see what is going on there as all the formatting has been removed and some of the dates don’t make much sense.
But these were loans from 2017 to 2020? They are listed in reverse date order, so the most recent first?
And they are refunding some loans where the interest rates were low?

There were 12 loans from 09/2017 to 07/2020 (dates are in Yr/mt/day format above. They are only repaying the interest where the loans were close together.
“We looked at your borrowing pattern and the size of the repayments that you needed to make. While you never borrowed from us straight after repaying a previous loan, the refunded loans are those that were taken within a reasonably short proximity of each other as well as requiring higher amounts to repay each month, which sometimes exceeded £450. The remaining loans were taken much further apart from each other and required smaller monthly payments to repay as the repayment schedule was spread over 3 months and would have had a more manageable impact on your expenditure with most payments being slightly above £200.”

If you list the loans in order and work out the number of days between them, I think that loans 2,3,4,5,6,7,10, and 13 were taken less than a month after the previous loan was repaid. And loans 11 was taken a few days over a month later.
And with one exception (loan 9) all the loan amounts were the same or higher each time, suggesting an increasing problem with borrowing.
You will easily be able to get bank statements going back to 2017, even if you closed the account.
The question is whether you can get them to up their offer so you can have a good compromise and not need to go to FOS.
If you would be happy with an extra £207, you could go back and say you thinkg FOS would also refund loans 11 and 13, and may refund loans 11,12 and 13. But in the interest of a speedy settlement you will be happy to compromise if they just also include loan 13 (the most recent one) in the refund list.

Over the years, I must have had 5-10 loans roughly.
I kept telling them via email to read the email thread which they repeatedly ignored and I advised them I would take them to the FO. I told them I never received any mail but they still want me to answer the above questions and then they will proceed. Even though this was their response to my initial complaint:

In order to verify data protection and to ensure we are speaking to the account holder we will require you to confirm two pieces of information from the personal detail’s list and one piece of information from the account details list.

OK then I suggest you reply that you had a lot of other payday loans which they should have seen from your credit record, which shows the problems you had and how the Mr Lender loans were unaffordable. Say you have asked them for a list of the loans you have from them and how much interest you paid on each and when they send you this you will be able to confirm what you think an acceptable solution would be.
Add that your complaint goes to FOS in a week if they have not made you a satisfactory offer by that point.

I replied as you advised:
I can confirm the address is correct however this does not answer why you haven’t considered my complaint and responded within the 8 weeks.
Over the years, I have had a lot of other payday loans which you would have seen from my credit record, which shows the problems I had and how my Mr Lender loans were unaffordable. I have had to take an IVA because of these loans.
I would like a list of all the loans I had from you including how much interest I paid on each of them. From this, I will be able to confirm what I think is an acceptable solution
If you fail to make a satisfactory offer by 1pm on August 12th 2021, I will take the complaint to the FOS.

Do you know if there are updated contact details for MyJAR to make a complaint or affordability claim? (Although I suspect I may have missed the boat for this). I asked for an update and had the following response from Harrisons:
“Please note that any potential dividend remains uncertain at this time, but it is likely to be very modest. Unfortunately, it is not possible to provide customers with a more accurate estimated dividend, as the quantum is not only dependent on the outstanding legal advice we are awaiting, but also the final level of agreed claims and final level of realisations (which are yet to be completed).”
I wonder what sort of legal advice they are awaiting…

Received an email rejecting my CashEuroNet claim today – honestly, I am not surprised: I only had one loan, and had only paid £132 in interest before I defaulted on it. But if others are waiting for news from the administrators, this may now be on the way (it’s 11 months since I made a claim). Iirc, Pounds to Pocket was the name of the lender. I don’t think it’s worth my time appealing it, though I would argue, with three defaults on my record from the previous six months, and eleven other short-term loans at the time, they oughtn’t to have lent to me – because, whilst I could put the evidence for this together, and write back to them, it strikes me that there’s easier ways to earn 45p!

But lots of people have been winning appeals on QQ administration decisions. If you have the bank statements why not? It’s not the 34p you may get back, it’s getting the default removed from your credit record.

Just heard back from Cash ASAP 1 day before 8 weeks was up. Had 16 loans with them over a 17 month period
I calculated around £712 interest was paid in full. About 10 of the loans were settled early paid with gambling wins or other payday loans, credit cards.
Cash Asap got back to me with very odd initial offer of £345. They said they were looking at what was settled early and gaps between loan chains. They then picked 10 random loans to pay, ignoring loan 15 and 16 the ones I paid most interest on, they stated this was because there was 91 days between these loans being taken out. Despite it still being 16 loans in 17 month period overall.
Went back to them counter offered. Stated that I was willing to drop loan 1-4 and not request the additional 8% if they settled amicably with now for £532.84 ( to pay back the total interest on loans 5-16).
They then come back to me with an offer of £445. Saying they would pay me a further 50% on loan 15 and 16.
I have gone back to them and said I want at least £500 to settle or I am going to the FOS out of principle. Why 50% on loan 15 and 16? I also paid loan 16 late as I contacted them in Feb to make them aware I was struggling to pay this loan, but they still took a further £110 off me in payments. Meaning I had paid £123.50 interest on this loan.
Am awaiting their response. Cash. Asap definitely the worst payday loan company to deal with.

Won my case with drafty. the original credit line was not accepted but I went after due to the spending habit using the credit line I should not have been given the 4 increases since 2017. So the interest paid is correct?
The 8% is calculated from the point they owed you money. If there were gaps of over a month where you weren’t borrowing from them, then there should probably be more 8% interest on the refunds owed before that point. But if you were pretty much continuously in debt, then you will have only gone into “credit ” with them fairly recently. I can’t guess what the right amount is but it may be correct.

I posted here a couple of months ago about 247 Moneybox and how I was struggling to communicate with them. I am still to hear anything tangible from them and am fed up with them now. Does anybody know what the chances are of getting the accounts surpressed from my credit files if I go to the credit agencies directly? Not sure if anybody has done this and had any success of if I should wait it out a little longer.

Great news. Just got a nice £1800 paid into my TSB account after complaining to them about unfair interest charges on my overdraft. Was refunded every penny I have paid to them since opening my account. So basically my overdraft was free. Not charged for. It just shows that if you don’t ask. You don’t get. Never in a million years did I think I would win this complaint but did. That £1800 really will help me out.

Oakam were quite good and pleasant to deal with. I heard back just before the 8 weeks was up with one of the loans out of 3 upheld (which was the biggest one), even though they were statute barred, all interest going to be refunded plus the statutory 8%. Says it will take up to 14 days for refund, day 4 now so hopefully come soon.

I did last year. They tried to make me feel guilty in their response by saying it wouldn’t be fair on their lenders to refund the interest. I took it to the FOS and they said that loan 5 out of 5 loans should be refunded. I’d cancelled that loan just after taking it out so their was no interest to refund.

A few lenders say that but it seems to be a bluff as I can’t remember anyone ever having a problem with it. I’m not sure how it works work is they pursued it as surely it would be you fraudulently giving them money as interest.

Yes I have they were awkward throughout . Initially mentioned fraud upon submission of my complaint . Adjudicator found in my favour for three out of five loans. They rejected this and it went to ombudsman, ombudsman just upheld the last and biggest loan

What is going on with the financial ombudsman?
I have recently submitted several cases where I have proved and sent evidence to them that a loan was unaffordable beyond doubt, had terrible credit etc and I am getting cases back where they are not upheld. All that I am getting is that they did checks etc. Some saying that I had a salary of ££ and for that reason they took appropriate checks.
I’m saying to them just because of your income it doesn’t mean you could afford the loan. They are not even looking at bank statements and outgoings.
Marbles even admitted they didn’t do checks and offered £750 and investigator came back and said my salary was £35,000 all checks were due be despite I can prove it was not affordable.
I get the feeling they have new people in not understanding claims.
1 case was upheld because I had gambling transactions and it was deemed they should have seen this and not have lent to you.
2nd case said if I didn’t gamble I could afford the repayments.
What’s going on?

If you have several claims for one or two loans and the loans were not very large, you had a decent salary and your problems were the result of gambling, you may not win many of these cases.

What you mean what’s going on? They’re making decisions on whether or not people have been given unaffordable loans and stuff. By sounds of it your just trying to get your money back you lost gambling. That not what Ombudsman is for. You could afford your loans but chose to gamble. Others got caught in downward spiral. Needed one loan to pay off another.

Hi Sara, I need some advise. I have about 20 pay day loans on my credit file over 3 years. I have submitted affordability claims and apart from lending stream who I had 11 of them with, the others are not for more than 2 loans with a lender, all around the £500 mark. Lending stream upheld half of the loans and they will be removed from my credit file, the others have rejected my claim but agreed to remove them from my credit file. Mr Lender, cash4unow and cashfloat. None of them have missed payments so is it worth having all of them removed or only some? I don’t want to remove them and my score goes down as I would lost credit history, so not sure what to do. What would you suggest I should consider doing, in general is it just better to not have short term loans on your file? I have a couple of credit cards which are well managed for the past few years so would still have some credit history. Thanks in advance

Loans that have been repaid on time do not harm your credit score, indeed they may help it a bit.
Payday loans have an extra flag attached to them – some lenders – especially mortgage lenders – see that as big danger sign. but most mortgage lenders don’t usually care about payday loans that are over 3 years old.
Sorry there isn’t a simple black and white answer. Unless you are planning to get a mortgage in the next 3 years, you may decide you don’t care.

Moneysupermarket reports on TransUnion records. Clear Score reports on Equifax. It sounds as though the lenders have removed them from Eqifax but not TransUnion.

I’ve just received a final outcome on Friday from using the template from this forum from Morses Club – getting 8% interest on numerous loans refunded and the outstanding accounts I have with them written off which are currently with a debt collector. Apologise if this has been raised a million times before, but I received this response when making a complaint against Money boat
” Should it transpire that information provided by you at the time of application was false or misleading, we may register this attempt to gain redress falsely as a first party fraud with CIFAS the fraud prevention agency. There is always a problem here about whether you want to start complaining about the complaints process – some lenders don’t provide email addresses, others routinely reject any cases about credit over 6 years old, some lenders always make these threats…
It is usually just simpler to focus on the heart of your complaint.
You don’t have to send your statements to them, you can just wait and send them to FOS. But are you more likel;y to get your complaint resolved more quickly if you do send the statements to MB? Hard to say.

The lender agreed they should not have given the loan and removed interest – the standard redress.
Liam took the case to the Ombudsman arguing that he had no way of repaying the balance remaining and produced medical evidence about his mental health and addicition to gambling.. FOS decided the lender should clear the balance.

My case is with FOS and the adjudicator has recommended that the loan was unfair lending and I should get any interest +8%. I had paid off so much of the loan originally before defaulting and it was sold to a third party (Lowell). I’ve since paid a settlement figure to close account as I was wanting to apply for mortgage- is the lender likely to take into account the money I spent settling the case even though it was third party?

Yes, all the money you paid should be refunded. You should also have the default removed from your credit record by the lender and by the debt collector.

I just had some success getting back £1800 in unfair overdraft interest from my TSB account. It was just a chancer thing.
So I then tried the same approach for my LLOYDS account that I swapped to TSB years ago.
Lo and behold. Just got £5000 approx back. I was in my overdraft for years and years and years. So basically having just got redress the overdraft was free for about 20 years.

I used one for my first payday loan complaint before I’d come across this site, and have done all subsequent i=ones mysef. They are nothing but an email forwarding service, the only effect they had on my complaint was to slow down the correspondence between myself and the lender and I had to pay a large fee for the privelidge. It’s annoying to think I wasted momey on their fee but on the other hand if I hadn’t seen their advert it might mever have occured to me that I could complain.

And they could remove misleading stuff about taking payday loans helping your credit score, while not mentioning that they cause huge problems for future mortgage applications.

In most cases, complaining directly with the lender is the easiest thing to do, but now resolver has taken the place of misleading claim management companies which is amazing progress. As for the impact on mortgage applications.. I wouldn’t know, I’ve never applied for a mortgage before and I’ve never heard of payday loans impacting mortgage eligibility….

I raised an affordability complaint with TFS loans in March. They quickly told me as it was over 6 years they could not look at it. I complained to Ombudsman and after disagree with the investigator it had been sent to Ombudsman. The loan finished in June 2015. Yesterday I got an update on my credit report to say TFS had removed account from my file. I thought that would have been done long before this or is it because a complaint has been raised?

I used resolver to initiate the complaint and I’ve been hearing from Morse telling me they have no details (the last loan was three years ago). I’ve managed to locate a copy of my loan agreement in my emails so I have sent this back to them today.

I went through a bit of a rough time and have quite a few defaults on my Credit File. I’m going through them all now and asking for CCA’s and filing irresponsible lending complaints where I think there was irresponsible lending.
One particular default that I am unsure what to do with is Payday UK. The debt was bought by PRAC but under Equifax it shows the default reporting until December 2024 and under Transunion it shows the debt still being under PaydayUK and the default reporting until Dec2022.
I’ve just seen Payday UK are in a scheme of arrangement and they are not taking any future complaints. However, how do you rectify issues with your Credit File if the company is administration and not taking any future complaints?

Hi Mike. I’ve not heard even a whisper from them since the original contact last year to give me my auto-generated redress figure, which I presume everyone else who was deemed eligible for compensation got as well. They haven’t even updated their https://harrisons.uk.com/247-moneybox/ website with any fresh info.
It’s saying the same thing and giving the same dates that are, in fact, now out of date, eg “further updates will be available in our next credit report which will be posted to our website will be posted by the 29th June”….blah blah blah.
We’re quite obviously well into September now and this has not been updated and their latest credit report was in fact published back on the 5th of July.
They really do seem to be giving us the run around here. 247moneybox is the only outstanding creditor redress I have left that has not yet been paid up.
I thought ICL were bad but even they finally paid up a few months ago and at least they made SOME contact in between, not much, however, their very occasional email updates were appreciated. But 247moneybox have beaten their “let’s keep them waiting as long as we can and not bother contacting them” record by a mile and I applied to both of them around the same time. Thanks.

Then I suggest you go back and say that you don’t have any details on these loans, you assume they are earlier, but you would like the length of your borrowing taken into account when assessing which loans should be refunded.
This may mean that you don’t get a refund for the earlier loans but you get a refund for more of the 6 you do have the details for.

Firstly piggybank (DJS limited) have advised they have requested the loans to be removed from my creditfile but they are experiencing a delay in doing this. They have advised to contact request transunion to remove them myself. Has anyone had Experience in doing this and if so what did they do and choose for the reason?
Secondly with the payday loan refunds there is tax charge of 20% I saw people previously mention they got this refunded? Can anyone advise me on this aswell.

Here we go again!! Claim against Peachy £259.58, amount actually received £12.09.
Over this whole sorry mess with other PDL companies, redress amounts agreed by administrators totalled £8,300, total actually received £320.
This is so unfair, people due redress from failed PPI providers received the full amount of redress.
Is there nothing we can do ?

Hi everyone,
I had made a claim against peachy in 2019, they agreed to refund me £1,248.43, from which £973.64. is used to clear my debt with them, leaving a total refundable amount of £274.79. But this July i received and email from Peachy that they have appointed ACI Limited to manage my debt. Now today i received a calculation from Administrators, that i will receive a dividend from my £274.79 refund which is £12.80. The Question is – Whats is happening with the Debt of £973.64 which they sold to ACI limited? By initial agreement, that should be cleared Right?

Yes that sounds right. Ask the administrators to confirm this is happening.
Are you currently making any payments to this? If so, stop!

Hey – I had a debt with ACI for Uncle Buck. Then UB agreed that it was unaffordable lending and wrote off the debt. I contact ACI who were actually really helpfel and very prompt and they did a check and the removed the debt completely from my file and their system. Contact ACI as my delaings with them was very good – specialistsupport@assetcollections.co.uk – That is their email incase you dont have it. Good Luck!
