What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

I have received an annual statement from wageme. It looks like they have been sending me this annually for a couple of years but not had anything about paying it back. I am in serious financial difficulty and wondering if I should just leave it for now as it doesn’t seem defaulted in my credit file or even be in it. Any advice?

how bad are the rest of your finances? By ignoring a loan you risk it popping up in a couple of years time, often better to face up to your situation now…

I think it was the only loan I had from them. I am in a debt management plan but must have missed this one at the time as I didn’t realise it existed which I know sounds unbelievable but I was mentally not well at the time. Probably I should just add it to my debt management plan

Lending stream – I sent a complaint to the financial ombudsman. Despite having 2 loans simultaneously, they looked at the incomings I had given lending stream (which were correct). Then calculated the amount I would pay back per month. They thought on the income it was affordable. They have not upheld my complaint. I don’t have my credit record from that time as I took them out in 2013 and we are now 2020 as my credit record certainly told a different story. I thought it worth a try but without the proper evidence I have been unsuccessful.

Hey guys just an update for you all on sunny. So adjudicator agreed in my favour and gave them until the 13th March to respond which they ignored so they were then given until 27th March I emailed them including the CEO and they told me they’ve not missed any deadline because they had until 27th March and they would respond by then. I have just spoken to my adjudicator again and they still have not responded so I have sent them another email. The FOS did say that they are struggling to get any response from the company at all at the minute so we will wait and see… will keep you all updated if I hear anything else

Thank you. My adjudicator informed me on 20th March – therefore, I’ve waited just over a week now. I’m not entirely sure what the expected duration is for cases being solved with the ombudsman but mine hasn’t been assigned yet so hoping for the best in the coming weeks. Good luck to you too!

Hi. I used a 3rd party company but for reference it has been with the ombudsman for approaching 12 months (2 adjudicators have looked and they have given me to April 2nd to question anything (it’s all fine) and then they make their decision).
Hopefully you get a speedy response but brace yourself for it taking a while

For anyone waiting for their refund payments from MyJar, I’ve just had mine drop in to my bank today, So obviously they are still working/working from home. What helped me get my payment quicker was leaving a bad review on their TrustPilot page.

Heyy, So I received, signed and sent them my settlement form on Weds 18thMarch. I also wrote to them a day later if they can confirm receipt (so that they have it) had no reply.
So I waited another week (the following Weds) to write a bad review on Trustpilot and literally that same day I had a reply from MyJar confirming they have received my bank details (settlement form) and that the payment will be with me in 10-15 working days from date of acceptance. Then randomly it went into my bank today.
Hope this info helps.
I will say as a heads up ifff you get to that stage of a Trustpilot review make out your really struggling for money atm and that you are on the verge of losing your job etc.

The ombudsman is making a final decision on my case with Sunny by April 2nd. Last year I rejected an offer of £1039 for the following:
You had 27 loans totalling: £6,770.00
Interest and fees totalling: £2,639.11
My question is – does the 8% interest they need to apply fall in to the £2639 figure or will this be added on top to my final redress figure?

I submitted an affordability claim against Peachy on 26th January and despite them going into Administration on 5th March and much to my surprise I received a “Final response to your complaint” letter today dated 30th March stating that they are prepared to “partially uphold my complaint in regards to loans #4 – #13 as well as adding the 8% simple interest per annum”. They asked me to confirm that I accept the offer and provide them with my bank account details.
I replied straight away saying I accept but do you think this offer is legitimate or should I expect to get another email in a few days stating that the company is now in administration and all claims will be settled by the administrators in a year when I will be lucky to get a penny!

I accepted an offer from Peachy just before the administration was announced and they have since confirmed that I will only receive a percentage of that offer. Unfortunately, we aren’t getting our claim value and we should expect pence to the pound.

Hello,
I have received an email back from Sunny, they have rejected my complaint and are offering to write off the remaining balance of 163 pounds and a bit of change. They responded a week before the 8 week deadline. With this information they have given me is it now worth taking this complaint further. In total I had 25 loans with sunny over a 2 year period. I feel I may be in a position to take it further, is them offering me a deal now showing they believe that they could lose a lot more considering the complaint. Or do I take the offer they are providing with writing off the balance as it may be the best I can get?

Hi! I just wanted to share a very small win – I had only one loan with Savvy, but after the Wonga debacle thought I would send an affordability complaint email on the off chance.
They sent a reply to my irresponsible lending mail saying that by providing wrong income/expenditure e-mail I was liable for fraud, etc.
However to my surprise I then had an e-mail 8 weeks after the initial complaint saying they would settle with £200.
Only a little one, and have some much bigger ongoing cases *fingers crossed*. But with all the bad news going around wanted to share a small win!

Hi Sara,
I put in an affordability claim to Satsuma on 30 January.They replied on 9 March and did not uphold my complaint. They discussed only i loan dated December 2014. I know that six years is some time ago, however, since losing my job in 1993 I have been in financial difficulties and i am convinced that there would have been other loans prior to 2014. My on line banking only allows me to go back six years. Is there any way that I can see my transactions from 2010, when I retired and 2013?

I’ve been waiting five weeks now for Satsuma to action my refund. I’ve contacted the FOS who have sent an email chasing them and I’ve spoken to the ‘complaints dept’ who have given me false hope in telling me that it will be paid on a specific date (those dates have passed) I called them today and was told there was no update.
I don’t think I’m going to get the money anytime soon. Do you think it is worth contacting anyone else?

I received a reply from an adjudicator last week that satsuma have agreed. I did comtact Satsuma yesterday and I spoke to there complaints departments they stated due to current situation they are under staffed and cheques are only wrote one day a week (this week being a thursday). They did tell me my cheque was ready to be ‘actioned’ and should be in the post this week. But given the delays everyone else has experienced I’m not holding out on it.

I had placed an affordability complaint with Uncle Buck (as well as Sunny and Drafty) on the 29th of January.
They acknowlwdged my complaint and said they would get back within the 8 weeks but i had stopped making payments to get me out of the mess I am in.
I know they are now in administration but prior to this they were quick enough to sell my debt onto another company to chase my debt. I emailed the company back and advised that I had raised an affordability complaint with them and asked them to give me time and I have not heard back from them yet.
Where do I stand with this now? Will i need to make the repayments to this company now as they have gone into administration?
The company is Conexus and the last email I received stated that arrears due was £173. 97 and outstanding balance £536.10

No, I have emailed them several times, not because of the time taken as I am only at day 11 so leaving a negative review is pointless, but because I got two dodgy emails last week, one of which was a fake bounce back email. I have asked simply for confirmation that they have received my acceptance and they are ignoring me.

Has anyone had a Loans2Go settlement via the Ombudsman? How long did it take? It is my only outstanding case (3 previous resolved by Ombudsman and others resolved by lenders) but has been with Ombudsman for about 9 months. It covers logbook loans and unsecured loans so understand it will be complicated.

Hi Yes I have just got a ruling from the FOS that L2G want to settle all the loans I have with them. This is without the need to go through the normal Adjudicator first Ombudsman next process. I put the complaint in in June 2019. I don’t know how much the settlement will be but around £1000 I think. Mine were all loans (not logbook loans).

Feel like I need to vent re this company and its appalling procedures!
At EVERY stage this company has used delay tactics. It’s gone to the bitter end with an ombudsman reviewing my case but I have come out on top and they have been told to refund all interest paid on all 5 loans + simple interest. Now the hard bit, getting the refund!
It’s been over a week since they’ve been told to contact me and sort out my refund. I’ve had nothing.
I’ve highlighted to these people times are tough right now with the lockdowns in place and they basically don’t care and this was coming from a “compliance manager”!
Anyway, I’ve written to BBC Watchdog and the FCA re Moneyboat because the way they treat people is dreadful! All I want is a refund of MY money! Hopefully someone at BBC Watchdog wants to do some digging into this crowd.
I remember missing some payments with them and they would repeatedly telephone my workplace asking for me. Horrendous.

I tried to negotiate and eventually got a reply saying they thought offer was fair but they would delete last loan from credit file. I tried to negotiate further but was hit by a wall of silence. I am due a refund from Sunny tomorrow which will be the 14 days they advised they would pay this following receipt of my bank details however I have seen a number of comments on here about a 30 day period. Both my offer letter and email confirming receipt of my bank details state 14 days. Has anyone received their refund in the 14 day period?

I received this email today from Sunny (Elevate) after trying to get some information on why they haven’t responded back to my adjudicator. This is the email I have received:
“ We continue to process all Financial Ombudsman adjudications where our respective decisions are aligned. We are also continuing to review all other adjudications, however we have temporarily paused communicating our decision on those cases as it is anticipated that there will be relevant new case law published within the next 4-6 weeks which may impact those adjudications. We expect this new case law will still be published within that timeframe despite wider events associated with COVID19.
We appreciate this may mean a short delay for some customers. However, we believe that it is in the best interests of our customers that this imminent case law is taken into consideration by both Elevate and FOS to ensure fair and consistent outcomes for all consumers.”
Does anyone know what this is about? Is there any truth in this? I’m waiting for an ombudsman to pick up my complaint from FOS but I’ve heard this could take a while.

Some other people have reported this.
I understand there is some court case underway, the result of the case isn’t known yet – and when it is published it could of course go to appeal.
But FOS is not a party to this court case, so it may not be directly affected. FOS takes into account a lot things when it takes a decision, not just legislation and court decisions.
So far as I know, FOS is not halting any work on Sunny cases, they are just proceeding as normal. So hopefully you will get an Ombudsman decision soon.

I received the same email it explains why they haven’t responded. Just sit back and wait for the ombudsman I spoke to my adjudicator and they are still treating sunny cases the same as every other case so I wouldn’t worry about it

Safety net have offered to write off my current balance of approx £1100 and to refund me £500. As I have constantly borrowed off them every month for 2 years at approx as I was in a cycle of borrowing when they practically emptied my account every pay day, how can I work out if this is a good settlement offer? Hi all, just recieved an email response with final outcome from sunny, they have refused to uphold any claims. They said it was affordable. I had paid interest of £1166 on all loans. I believe it wasn’t affordable. They have sold it to s debt collector which I am still struggling to pay nearly 2 years later. I’m not interested in the money as such more my credit score. Just to add to this l had a complaint with sunny, which they denied, went to FOS. One person looked at it and said l needed redress which Sunny still denied which they said would now need to go to an adjudicator. After a very long wait someone else at FOS came back and said it was still waiting for an adjucator but he had looked at it and didn’t think there was a case. I replied that l thought there was and to still continue to the adjudicator. They finally came back to me yesterday and have agreed with me, now waiting to hear back from sunny again! Good luck!

Some good news about Peachy for those that put in their complaint before they went into admin. They have now wiped my remaining debt balance, so I now owe them nothing! They said I was entitled to a £216 refund and as a good will gesture they have also wiped the remaining balance, not much an extra £30 or so. No doubt if they were not in administration I would have got more from FOS but I am just glad it’s over!

I have just received my redress payment from My Jar so they are working if anyone wanted to know. I accepted my offer from them last Wednesday, sent them back the completed form the same day and have received payment today. How are people finding complaints with the FOS for Sunny at the moment?
My adjudicator found in my favour a while ago, and give Sunny until start of March (1 month!!!) ago to respond.
I have no idea if they have or not because my adjudicator’s ignoring me too…. 5 very courteous emails enquiring about whether Sunny has responded to them, and zero back. Are the FOS operating at full capacity at the moment? And are Sunny just taking the proverbial?
Not sure how I can move this forwards without help from either!

Sunny won’t reply or will disagree. It will go to final ombudsman. I’ve been waiting since October 2019 they had the 13th to respond and disagreed.

I am on day 18 with LS. I believe people with outstanding complaints have been emailed to say it will take longer which is understandable in the current climate. However I can’t see why an already agreed payment would be delayed. Maybe the above poster was emailed by mistake as they had already agreed to the settlement.
Lending Streak told me I should receive payment within 28 days and at this point I have no reason not to believe them. If you are still within your 28 days then I can’t understand why people are continually attempting to contact them at a time they are really busy and adapting to working remotely.
However if I reach Day 29 with still no payment turn I will attempt to contact them.

I have an open loan with Uncle Buck. I owe about £240. I have just noticed today that they are administration and have immediately put in an affordability complaint. Hoping that ultimately, the loans will be removed from my credit record in the administration process. I know i wont get much rebate. I have had around 6 loans in the past, ranging from £200-£500. Payments are currently £84 a month and so are affordable. Do i continue on with them?
Also, My Adjudicator ruled in my favour at the FOS with Satsuma months ago but they have still not replied to my adjudicator with a decision about whether they agree! He has sent 3 chaser emails and today told me that he”s preparing my case for the Ombudsman. Do you know roughly how long i will have to wait for the final decision? I made an irresponsible / unaffordable lending complaint to MYJAR back in November 2019, regarding loans that were obtained through “TXT LOANS” approx 10 years ago. Firstly, MYJAR have admitted they have deleted all my records, and therefore the onus was on me to prove that I had obtained the loans.
To cut a long story short I contacted my bank (Lloyds) who were extremely helpful, and they sent a full 12 months of statements to cover the period in question. (The statements showed excessive borrowing from numerous lenders) and also showed in excess of 30 loans taken with “TXT Loans”, that were short term borrowing of usually £100 over a 14 day period. Having forwarded all the additional information requested to MYJAR, they have now replied sending an email stating they are unable to locate my account. I have politely informed them they won’t be able to; as they have already informed me they have deleted it. Despite numerous emails and telephone conversations where I don’t get any further than the security questions (hello you’ve deleted my records so you won’t find me!) I appear to have hit a brick wall! I have left a review on Trust Pilot (just the one!)
Is there anything else you can suggest please Sara (any CEO details or anything) or should I just send my complaint to the FOS and join the queue?

FOS will ask Satsuma to send over their case file. Then it will be in a queue to be picked up by an adjudicator. It’s hard to say anything about timescales – cases had been moving faster but everyone switching to working from home may slow down getting info from the lenders,.

Redress claims are now subject to the administration. I accepted their offer 6 weeks ago and have received no payment. They told me that I will only receive a percentage of the accepted claim based on the administrators findings. Probably best to forget about your claim now, if it’s anything like Wonga and Wage Day Advance, we’re in for a lengthy wait for around 4-5% of our accepted claims.

I’ve a complaint in regards Lending Stream which has just hit 8 weeks (submitted 9th February). Checking back through my emails I have the following from them dated 27th March – has anyone else seen anything like this, and can they do this?

I appreciate that the situation with COVID-19 has made things difficult for a lot of organisations, but I’ve not seen anything official stating that the period to handle complaints before escalation has doubled. Should I give them this time, or just escalate now?

They have worded it to try and imply that the FOS have somehow agreed to it, in reality they mean they are flouting the rules and FOS know that they are. It’s like saying you have started stealing from your local shop and that both the shop owner and the police are aware of the changrs to your food supply process.
Lending Steam are one of the worst companies to deal with and will use any excuse they can to try and delay things. They rarely uphold complaints anyway so send your complaint to the FOS the minute the 8 weeks is up.

In October 2010 I borrowed £200 from One Month loan now Sunny. I made 6 monthly payments of £67.50 and then one final payment of £89.50. In total I paid back £494.50. I had other payday loans at the same time with most other lenders and I also had 3 different guarantor loans. I know it’s very hard winning one loan complaints so is it not worth me complaining? The loan was clearly unaffordable if I had to pay it off over 7 months and I’ve paid nearly £300 in interest. Thanks

Its nice to see a lot of people winning cases. I for one fell into the payday loan circle around 5 years ago (aged 20) and i found myself in a downward spiral of constantly lending once id paid one off getting another right out. If i had seen this site a bit earlier i wouldve got 2.7k from wonga. I Got over 3k back from sunny who i paid over 5k interest to over the years. I think the payday loan situation people will have different opinions on it, but i for one think it is pleasant to see them going bust one by one, and i personally think in a couple of years there will be absoloutely no payday loans it is daylight robbery the fortune they charge on interest and i cant believe they are allowed to advertise themselves on TV. Because of my history with payday loans i have a very poor credit i am trying to rebuild, and i wish everyone the best of luck. Does anybody else think that paydayloans will be abolished in the years to come. Fingers crossed, itll save a lot of people going through the same downward spiral i did.

I’d like to thank this site for all the free help and advice . Having entered into a stepchange DMP, and then made complaints about affordable lending, I’ve had the following results –
Bamboo Loans complaint rejected sent to FOS
Fernovo complaint rejected but balance written off and loan deleted from credit file
SafetyNet Credit accepted complaint and refunded £300, loan written off and deleted on credit file.
Mr Lender complaint rejected but balance written off.
My Jar accepted complaint and all interest removed, will be deleted from credit file once settled.

It’s pretty clear to me that they just delay sending their response for as long as they think they can get away with. My Lending Steam response was clearly auto generated and consisted of exactly the same wording stamped out 16 times, once for each loan. I got my Swift Sterling response at 10:30 at night the day before the 8 weeks was up, and my Cashasap one on boxing day which happened to be the day the 8 weeks was up. They either have very dedicated staff who are slaving away at all hours to get complaints resolved, or they have discovered that Outlook has a delay delivery option.

It sounds like a scare tactic. Many people have been told this, by Moneyboat and other lenders, but so far I am not aware of anyone who has ended up with a Cifas marker or been prosecuted for fraud.

Obviously bank statement will show I had other loans not mentioned, and salary less.
Also do they just refund interest or full amount you borrowed?

Also before I spoke to because I was scared they would report as fraud, I sent one email, sayin I will send in stament and anthor saying you have all the
information pursue the case or drop it.
Defiantly still worth pursuing even though I also put in a slightly larger salary because my salary goes to shares at work and also missed out payday loans and bank loans?

Also on a separate note should I withdraw buffa complainet as I kept make requests to borrow and paid it back in few days normally kept saying yes eventually they said no, after asking for my bank statements
Now they have proof my income, debts etc was incorrect.

I’m sorry, i still don’t know if you had two or three loans? If you only had two loans with a 1 month gap between them t[you are very unlijkely to win an affordability complaint.
3 loans is not easy but you may get the last loan refunded if it was 100,30, 3300 but much less likely if it was 300,100, 100. That is why i have been asking for details…

I’m glad they don’t but just out of intrest how come they actually don’t report people is it difficult to prove

From what you have said, there seems little point in pursuing the MB claim not because of their threats but because you are simply very unlikely to win.

I don’t know, and it could be different for different lenders. But some possible reasons include:
1) fraud requires “intent”, it’s not something you can commit by not thinking very clearly. My article https://debtcamel.co.uk/payday-lender-says-lied/ looks at a lot of reasons application may have been incorrect or incomplete that aren’t fraud.
2) you borrowed the money and repaid it – where is the fraud?
3) for the lender to do anything requires some work on their part which they will not get any money back for. And if you dispute a Cifas marker and take the case to FOS, they will end up paying a £500 FOS fee even if they win. What would they actually gain from doing this?
4) any payday lender that gets a reputation for accusing its customers of fraud will probably soon be out of business.

In terms of you got the money, with incorrect info even though it was paid back, is that not fraud

well it isn’t me you have to ask the questions to, I am just guessing at various possible reasons.
I think you need to look at how good your affordability complaints are.
2 loans you are very unlikely to win. 3 loans pretty unlikely unless the loans amounts were going up and there were no gaps.
And if you have paid tiny amounts of interest, what is the point?
If you can’t manage the current loan repayments without borrowing again, ask for lower monthly payments you can manage. And just stop borrowing!

The reason they mention fraud is to put doubts into your mind so you question whether or not you should do something that will cost them a £500 fee.
When they were still going Uncle Buck sent me a threatening response saying if I escalated it to the FOS they would be asking to see my bank statements and would be asking me to explain any discrepancies. I escalated it anyway, mainly because they were trying to intimidate me, and I never heard any more from them.

After not hearing back from Elevate on my adjudicator’s decision, this was passed onto the financial ombudsman on 23/03/20. Today, I have received an final decision from the ombudsman who has upheld my complaint alongside the adjudicator’s findings. I’m quite surprised how quick I’ve received a response back from the ombudsman as I’ve heard many have been waiting for months. Hope everyone whose waiting will hear back soon from FOS. Thank you.

They have been picking cases up quicker now i raised my case to the FOS on the 25/03/20 and on the 01/04/20 they responded.

Just had an email from Amigo loans as affordability loan its 8 weeks today for response but they have requested another 4 weeks or suggest if I’m not happy to forward Complaint to FOS your thoughts on this Sarah
