What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

Don’t use a claims management company. They are expensive and often incompetent. It’s easy to do this yourself and you can ask questions below and get replies from other readers who have done this.

Mr Lender have made me an offer but we disagree over a few loans and they don’t seem to be willing to budge on them. What is the risk they will go into administration? Do they respond quickly to FOS rulings if I wait to be able to refer to them?

7 loans and offered to refund loans 4, 5 and 7. Loans 4 and 5 low interest so isn’t that big payout. I have argued for loan 6 which I paid interest only for in the first month and then needed a repayment plan for to clear over 4 months. They are saying that loan interest was heavily deducted for the time period I had the loan but it was just frozen not reduced.

They informed me I paid £116 in interest on statement but not willing to refund that loan as they said had undertaken credit and affordability checks and as I had longer to repay than original agreement they had already subsidies that loan. This was all verbal nothing in writing apart from statement containing loan details. They was responding quickly until I didn’t accept and now saying they have 8 weeks but will try to respond in writing with final offer sooner.

I have had the same experience with Mr Lender. Was offered a refund and to clear balance and clean up credit record. Went back asking for other loans to be considered and got same response that their final offer would be in the post within the 8 week period. Upon receipt if I am unhappy with outcome I am within my rights to go to FOS and they would provide details of how to do that. Not sure whether to accept offer or wait ( another 5 weeks) before getting their response. Do I have to wait until the 8 weeks are up before going to FOS… does anyone know?

Some advice/help needed please.
I had 6 loans from myjar and on my affordability complaint they have upheld my complaint on loans 4 to 6. I’ve detailed the loans below to show the frequency I was taking the loans. I asked myjar to consider including loan 3 into my redress and received a reply stating that they didn’t agree with me & only agreed on their original response. Do I have a case to take to the FOS?
Loan 1: taken 29/8/17 – amount £1500 – date closed 28/5/18 – total repaid £2593.92
Loan 2: taken 28/5/18 – amount £800 – date closed 30/06/19 – total repaid £991.46
Loan 3: taken 30/6/18 – amount £1650 – date closed 3/11/18 – total repaid £2315.11
Loan 4: taken 30/12/18 – amount £825 – date closed 26/2/19 – total repaid £1119.15
Loan 5: taken 7/3/19 – amount £725 – date closed 27/5/19 – total repaid £833.14
Loan 6: taken 28/5/19 – amount £299 – date closed (still open)
Agreed redress: £425 – £200 from loan 6 = £225

Well you have a case to go to FOS but including the 3rd loan is marginal. You may win, you may not. I know this is annoying as loan 3 had the nmost interest on it.

I have had a good outcome from SafetyNet Credit. I am getting a refund and they will remove from my credit report. Unfortunately I got to the point of having a CCJ because of this loan. My question is will the CCJ be removed from my credit report? After all they did say they will remove the loan from my report. Thanks in advance.

This was the first email I received. Replied to confirm I was happy with offer of £850 plus removal from credit report. Asked when payment will be made and they said by end of day 21st Feb. So only waiting a week between offer and payment.

I had a ongoing loan situation with safety net for about 5 years. Using the full £1000 by the end of each month. I made a complaint about 5 weeks and today they offered £1000 compensation. I’m not sure weather to accept. I think it should be more, what are my next steps?

If you log into your safteynet account you can download an excel of all of your borrowing and see exactly what interest you paid. I had a similar experience and worked out i’d paid over £4k interest in just 2 years so £1,000 seems low.

the redress doesn’t go on your tax form – that is your money you are getting back and it isn’t taxable.
The 8% simple interest is the “gross interest” to put on the form.
the 20% withheld is the “tax deducted”
The “net interest” is the difference between those two numbers.

Hi
I am wondering whether I should send a complaint to Mr Lender. Although I accept that I applied of my own accord, knowing how really bad my credit is I’m amazed they accepted the couple of loans I had with them. I had a bit of a problem with gambling at the time and it was too easy for me.
When paying back I often got extensions on the repayments because I struggled to pay it back meaning I ended up paying more. This is not a sob story as I was fully aware of what I was doing but if I’m entitled to a refund and possibly a clean up of my credit score then I was wondering what I should do.

Are your loans from 6 or more years ago?? As extensions haven’t been given for a long time now?? If they are over 6 years. You might struggle. But worth a try. Mr Lender usually quite quick. And are negotiable. It’s up to you.

Don’t see much on here about Cash4uNow. But they been quick and fair with my claim. Not using stall tactics. Like others do. No need to go to FO.

I have a complaint I. With the FOS and provident, no reply after 8 weeks sent access. Picked up and investigation started. Up until last week my accounts were still showing in my credit score as open and balance remaining. Have checked this morning and the accounts are now showing as closed. Would there be a reason for this as I’ve had no correspondence at all from either provident or the FOS since the beginning of feb xx

To be honest, it’s a bit pointless sending a follow-up. I am at just over five weeks, and I messaged them on the online chat this morning to find out the status and to close down my account (it’s been dormant over a year), and they just say, “You’ll get a response by 11 March.” It definitely doesn’t speed things up to chase them, I’m afraid. I don’t know why some get a super-quick response and others not, it’s pretty random

Your gunna have to sit it out im afraid. As you need final response from SNC before you can escalate to FO. They have 8 weeks to give u that response. After that, if no response, you can escalate. You never know. You might get a positive response before then. 3 weeks waiting isn’t really that much. I once had to wait a year and a half for outcome with one lender. Good luck.

I just thought I would update with my outcome with MyJar.
I wrote to them end of January with an affordability complaint. They replied within a week saying they agreed with my complaint and are refunding me interests of £2,580. Today I received the money.
I was also successful with safety credit net who refunded £660 in interest charges within 2 weeks of my complaint.
Awaiting results from Amigo, uncle buck and Mr Lender now.
Just wanted to say a huge thank you to Sara and debt camel for the advise, time and effort put into this site. This is a life changing amount of money for me and I would have been oblivious to all this without stumbling across this site. From the bottom of my heart- thank you so very much!

I put in my complaint on 30th jan and haven’t heard anything. Took 6 loans out all within days of paying off the previous ones. I guess it’s just luck that some people hear back quicker than others. Looks like I’ll be waiting for the full 8 weeks.

Myjar have just issued my refund. Only a 7 day wait for it even thought they stated 10-15. Very pleased with the outcome.

I would send them bank statements if you feel it would benefit your case. I did this after they declined any wrong doing then they upheld my complaint after reviewing my statements.

I have had the adjudicator suggest lending stream uphold 27 put of my 30 loans and they have until 27 feb to reply anyone had any feedback if they will stall and then it will have to go to the ombudsman
They declined my first response as said they were all affordable and had been through the correct legibility channels for affordability

Hi Sarah yes they do try and stall it like with mine they were about 6 days late which on that day LS sent me an email saying they had responded and I believe my adjudicator did remind them on the 17th day , now just waiting for the redress should be next few days fingers crossed,

Hi Sarah. Like you LS rejected my initial complaint saying that my (32!!) loans were all affordable. The adjudicator upheld loans 5 to 32 & gave a deadline of today for LS to respond – which they have done this morning & have made an offer in line with what the FOS suggested. I’ve accepted so now it’s a case of waiting until they pay (28 days from when the FOS confirm my acceptance). I get the impression that they are now having to listen to what the FOS is telling them.

Hi R, this was 21 days from when LendingStream contacted me after accepting the offer and emailing back saying the money will be returned within 28 days. But yes it was a waiting game, I’ve been checking my account daily too, and I just about started to believe it would be on the 28th day so give up checking haha, and then randomly it was there! Hopefully you won’t be waiting much longer.

I fell for the trap of applying for refunds through a payday refund firm. I’m just off the phone to them and totally forgot I even had a claim with them as it was 2 years ago I lodged it. The won the case with piggybank and I was compensated over 600 quid. But I was told over the phone this firm is taking 400 of it and sending me a cheque for 200. I learned the hard way. I’m really glad I made my safety net credit claim on behalf of myself as i used them way more than any of the lenders. I guess 200 quid is still something but these firms are like leeches.

I have my last complaint at the FOS with sunny/elevate. It was submitted last June, I’ve just received an email saying sunny have offered on loans 12-16 and a refund of £409.28. I borrowed a total of 17 times totalling at roughly £2.5k and paid back in total £4.5k. In your experience do sunny negotiate? I’m unsure if I should get this finished with or wait, but I have a feeling sunny will not accept an adjudicators decision and it will go to an ombudsman which is a lengthy wait.

Frequent user of the site so just want to thank you for the material posted. I’m no stranger to the payday loan redress claim procedure, but today I submitted a claim to Money Boat (previously slipped my mind) and had a very interesting acknowledgement. They have requested bank statements with a warning that if any of the information provided on my application differs to what my statements show they would file a report to CIFAS. I’ve never seen this sort of warning on a complaint acknowledgment before and was just wondering your opinion on it and whether it’s something they could realistically act upon? I’ve nothing to fear as all my information submitted was correct, I did however get a bit of a shock reading it!

Uncle Buck told me that if I escalated my complaint to the FOS they would be asking to have sought of my statements and would be asking me to explain any discrepancies. I did escalate it, largely because they had made that comment, and I never heard any more about it. I think they were trying to imply that the FOS would send them my statements I’d they asked but I don’t tick they would would they?

Hi Jane, from your previous comments it looks as though this is Mr Lender? They used to be happy to negotiate quickly and (usually) fairly but now a couple of people have reported:
– being given a very poor offer very quickly
– going back and suggesting you would be prepared to compromise if loans x and y were added to the offer
– being told that if you don’t want to accept this low offer, they will take into consideration what you said when you get your final offer which will be within 8 weeks and by letter.
This seems a very recent change of tactics. So no-one knows what will happen. You could get a letter on Monday agreeing with your proposal and be very happy that a reasonable compromise has been reached. You could wait another 6 or 7 weeks and get a letter repeating their original offer which would juet delay your case going to the Ombudsman.
I think this is very poor complaint handling by Mr Lender. And it coincides with Mr Lender deciding to remove its email address for complaints so people have to use their online form, against the regulator’s rules that firms should allow people to put in a complaint “by all reasonable means”.
If you are cross at being messed around, one thing you could do is tell the regulator (the FCA) what is happening. they won’t look at your complaint, that is what FOS is there to do, but they will take account of what people tell them about a firm in their supervision role.

Give your Mr Lender reference number, your name and address.
Then give a couple of sentences summarising your borrowing, just what years and how many, how large the loans were. Nothing long, no point in trying to convince the FCA which loans were unaffordable, they aren’t going to look at this, you are complaining about the process.
Say what and how quickly Mr Lender has offered to settle, how you went back as you think FOS would include more loans and offered to settle if loans 6-8 were included [or whatever the numbers are]. But Mr Lender just said you take their offer or wait for a Final Response within 8 weeks by letter.
Say that you feel Mr Lender is using making very low offers as a way of trying to settle complaints cheaply, which breaches the FCA’s DISP rules which say a firm should learn from FOS offers and make offers to customer that are in line with this.
Say that you think delaying giving you a response also breaches the FCA DISP rules. If Mr Lender have not properly investigated your case, they should not have made you an offer. If they have properly investigated it, then they should give you the Final Response immediately and not delay.
Add that you want to receive the Final Response by email not by letter as it is quicker, more private and sometimes your post goes astray. Say you think this should be your decision about what suits you and not Mr Lenders.
Add that you think they are taking advantage of vulnerable customers who may feel they have to accept a low offer as they are in urgent need of the money and this is not treating customers fairly.
Say you know the FCA won’t look at your complaint and you will be sending it to FOS when you have the Final Response but you thought the FCA should know about this bad complaint handling.

Thanks Sara for the very helpful comment. I think it’s very bad of Mr Lender to do this. As you said they must have investigated as how could they make an offer. They can also see from the SAR that the loans I have asked to be included were back to back. It doesn’t take a genius to see that they were repaid and then reborowed same day. I cant see how this warrants waiting the full 8 weeks.
Do you know when they provide final offer it will be the same as initial? Has anyone else had this?

Just to add the same thing happened to me, initially Mr lender offered £550. I said I wanted to time think and called them back a day later saying I rejected the offer but would reconsider if they added some more loans. She said it had already been investigated but will take the case to her boss.she said it was unlikely they would change the offer. Literally 3 hours later she called back and said they would add two more loans to bring the refund to £1245. I accepted the offer and the money was in my account within two days. This happened last week

Well after putting a negative Trust Pilot review over the weekend I received a call from Mr Lender saying they had taken my comments on board and revised their offer and was their final offer. They only included 1 other loan so loans 7-9 were agreed. I asked for loans 5 and 6 but would accept if loan for was included.
Interest on loan 6 more than total refund offered.
Need to decide whether to take to FOS.

I wouldnt expect any reply from Satsuma. Similar circumstance to you, adjudicator found in my favour, then no response from Satsuma, sent to Ombudsman after 4 weeks of hearing nothing even after repeated reminders.. So if I was you I expect a long wait unfortunately.

They took the full 8 weeks and rejected my complaint .I sent this to the ombudsman last November..his was picked up three weeks ago..the ombudsman upheld in my favour and told snc to returned all interest and charges going back to dec 16..they have given snc 2 weeks to reply …here one left I’ve not addressed yet which is provident has anyone had any luck with these people

From looking at their decisions page they seem to be looking for things that might have indicated to the lender that they shouldn’t have lent, if they had actually asked to see your bank statement. For example they say things like but loan 4 you should have done more to check Mr Xs outgoings and checking his back statements would have shown you that he had a gambling problem.

Has anyone had experience of a successful claim from SafetyNetCredit? I’ve had the FOS adjudicator rule in my favour. Do they tend to agree with the adjudicator or challenge it and force it to go to the ombudsman. Thank you for your help previously. May I check something please. I started taking out peachy loans after wonga suddenly stopped lending to me after more than a year of continual payday loans. There were 5 consecutive loans from start to finish but my credit record would have shown all the previous wonga loans, which were paid back on time, but another taken out again within a few days. yes finally after initially filing my complaint back in sep 18 and leaving it for a while then sending to the fos in apr, 3 adjudicators later, and LS playing delay tactics this was in my account just after midnight on day 25 from me confiming, I can relax a little now but need to find a job after losing mine this week – was only a temp job anyway which I hated!, good and bad news but at least I can move forward from PDLs! I made a complaint back in March 2017 about Cash Converters for pay day loans, and heard back that the loans were underwritten by a company called UK Solutions Limited. So I complained to that company and heard back from them with a real snotty letter. So I took it to the next stage and made a complaint through the FOS. I was told that as 2 of the loans were outside of the 6 year window, it would take longer. I said I was happy for them to disregard the loans outside of the 6 yrs if it would make things easier. Anyway I didn’t hear back from them for a long time and eventually heard back in October that they’d finally got some info from the company, then in Nov that adjudicator had found in my favour for 8 loans. I couldn’t work out from the letter how much redress I was owed but I think around £500-600.
December I heard again that the company didn’t agree. End of Jan it had been picked up by ombudsman. Ombudsman agreed that 5 of the 12 loans shouldn’t have been lent, so I was due a redress of around £300.
Finally yesterday I was told, that the company had gone into liquidation and contact the liquidators.
Will it be worthing contacting them? I feel a bit annoyed at FOS for not disregarding the 2 loans outside of the 6year window that I said I wasn’t bothered about, because it dragged on much longer because of that. But I could tell the lady at FOS sounded a bit p’d off with how it had turned out and felt like she had let me down.

It was the same with me. They tell you when they have sent the response off but it can take the adjudicator a few days to send it on to you.

I have put in a complaint to mr lender, lendingstream etc. I was living a lie and waiting for redundancy every day. It never came. Eventually my partner found those dreaded letters. I ended up on a bridge refusing to answer calls from her and my father who was and has since died of cancer. He paid a large amount of the debts and she did the other bit. We split up eventually after as I could barely face her. I was on medication for a while but then everything sorted itself out. Apart from the guilt I put my father through. I am back with my partner and have put aside the Wonga thing as it is a place u don’t want to back to. Chances of success with mr lender and lending stream? This was 2014 do loans were active but beyond the 6 year limit from when they were taken.

I’ve received letter with Final Response at the beginning of the 8th week. They did offer goodwill gesture, voucher for 25 quid. I did refer it to FOS straight away. Adjudicator pick up the case within 1 month. 2 days later came up with a solution. Interest on the last 3rd loan should be returned. It’s more then 800 pounds. Mr Lender had 2 weeks to respond, took them about 3,5 weeks to agree with his findings.

OK, well I am afraid Mr Lender tends to reject all these, so it’s up to you if you want to go back and tell them when and how* you found out about payday loans refunds in the last three years or not waste any more time and send it straight to the Finacial Ombudsman.
* there are no wrong answers here. You may have been emailed by the Wonga administrators, seen an advert on Facebook from a claims company, seen a newspaper article about payday loan refunds, been told by a friend or relative or work colleague about them. Just say what happened to you!

The good news is that 90% of complaints about guarantor loans are being won at the Ombudsman! Including ones against UK Credit. I have today received a letter in the post from Mr Lender offering as a final settlement to refund some loans and wipe off my current outstanding amount. Whilst I am considering this, there is no mention in their letter the 8% statutory interest. Has anyone else experienced this before I respond to them.

They never offer 8% interest. If the offer is good enough, most people are happy to miss out on the 85 to get this settled quickly. But recently they seem to be making poor offers… sometimes you can get them to improve it. How many loans did you have and what have they offered?

I had 14 loans and they have offered to refund loans 8-11 and write off loan 14. I am going to ask why loans 12 & 13 are not included or 6 & 7.

I think asking them to include more loans is straightforward. In the past Mr Lender has usually responded well to a suggestion about what you would be prepared to settle on. If they change their offer to 6-14, you may feel that is good enough to accept without the 8%.
So far as I know they have never paid the 8% unless told to by FOS.

Got mine on day 28. I put a really really negative review on Trustpilot about them on day 2 I think it is was. Didn’t speed them up like others have said on here. E.g. Day 3. Got on day 28. Can’t say for sure if it was the negative review that made them use the full 28 days. But based on what others have said. Come to your own conclusions.

I am on a dmp currently paying a lot of people back mostly payday loans and catalogue debts . I submitted the template to safety net credit of whom I still owe money to roughly of £200 and is on my dmp.
This is the response back , I didn’t send in any bank statements or wage slips etc . I am just needing to clarify with maybe some in the know as to whether this is a “good” offer does it mean I can continue to pay the £98 on my dmp? If I took it to fos would they request additional information. Very confused if someone could please help :)
Having investigated your claim fully it is our view that your complaint is valid.
Therefore we propose that we redress all the interest that you have paid (£82.70), plus statutory
8% interest (£5.92). In line with HMRC guidelines we will deduct 20% (£1.18) from your statutory
interest and pay this to HMRC, meaning that you will not have to declare this redress in your tax
returns.
We will also remove any interest that has accrued on your outstanding balance (£7.23) and then
deduct the interest you have paid plus the statutory 8% interest from your principal outstanding
balance (£87.43).
This will leave a principal outstanding balance of £98.90 which remains payable.

I have just checked my stepchange statements and yes it is just under £200
And it wasn’t a very long time Sara probably 3 to 5 months tops as I was borrowing to repay and couldn’t do it anymore .
Furthering from what was in the email above this is what the last bit says
If no correspondence is received, no action will be taken, and
your full Outstanding balance of £193.56 will remain payable.
Our offer is made on the basis that it is in full and final settlement of your complaint.

ok, with the “your full Outstanding balance of £193.56 will remain payable.” that makes more sense. So they are proposing to reduce your balance from £193 to £98.

Can I also ask what the total balance is of all your debts in your DMP? 20 creditors is a lot… Is the £100 amount you are paying each affordable? Do you have any priority debts such as council tax, rent arrears or electricity/gas bills?

The total outstanding ATM on my dmp is around £3,200 I have more non priority debts that I am recieving letters for that ideally I need to add on to the dmp. I am just about to go on to maternity leave too so I am looking to go on to a token payment plan if stepchange accept it as I won’t be able to afford to continue paying the dmp amount and the lowest they can offer my creditors on a dmp is £5 a month . My debt total is estimated I believe around £5,000 .. my priority debts are pretty much up to date rent , water, my council tax is a little behind but will be cleared by 13th march for last year as I have about 120 pounds outstanding on that and that’s all . My gas and electric is on pre payment so no worries there.
Obviously I was hoping for a complete write off of my balance to snc but I am wondering if it’s worth going to fos or just better taking that offer and it’s £100 less to pay on my dmp . Currently I am paying each creditor on my dmp plan £5 a month which isnt very significant against the balances owed and so far I have paid around £600 towards my dmp. Estimated end date is sometime in 2023 obviously that will now depend on my maternity leave and extra debts to be added .

After 11 months, THL still haven’t removed the loan history from my credit reports as requested formally by the adjudicator.
The adjudicator has contacted them several times and they’ve confirmed they will be removed each time but nothing.
What could you suggest are the next steps available to me please.

The adjudicator has requested they remove the loans as part of the original decision, which THL agreed to, and twice more they’ve been chased by the adjudicator in the past 9 months.
They report to Equifax and Experian, both say I need to speak to the lender.

So your options would seem to be:
1) to ask the adjudicator to reopen your complaint and send it to the Ombudsman and ask for additional compensation for the delay in doing this.
2) if the adjudicator says this cannot be done, to send THL a new complaint, asking them to delete the loans and give you compensation
3) to go to court, but I suggest you need professional advice before contemplating this
4) to send a formal complaint to both Experian and Equifax, saying the lender is failing to correct your records and as a result they are inaccurate – give the evidence of this – and ask the CRAs to delete the record. Then take those complaints to FOS if the CRAs refuse.
5) to email the FCA, THL’s regulator. The FCA won’t investiogate this, but they will refer it to the group that supervises THL and with any luck THL will hate that…
So email consumer.queries@fca.org.uk and cc it to james@thl-uk.com
Subject: THL not complying with FOS decision (673015)
And give your FOS reference number, the date of the FOS adjudicator decision, attache the decisions and explain how 11 month later they still haven’t done this.

Thank you I was just reading the info on this site . I’m sure it was given to me as an option of the time of setting up this dmp but it just sounded a lot more daunting than the dmp route.
I also wasn’t aware I would be having a child anytime soon triggering a change of income although it’s tight arm it’s about to get a lot tighter. Can I just ask I have two items on hire purchase one due to end June time and one another 2 years away with perfect home . I am not in arrears with them would I be allowed to keep making them payments and keep the goods or would that be deemed as preferential . As with my dmp I was allowed to keep them on there . Thanks

Yes it seemed as if it was touchy ground with hp’s when setting up my dmp but they said it “should” be ok. I will deffo speak to them as I need to put something else in place regardless for when I finish work in a few weeks as the dmp will just be completely unnafordable .

I have contacted opos, regarding irresponsible lending re my mini credit loan. They say mini credit is in administration. However, it would appear I have no where to go with my complaint and will have to keep paying back the loan to opos.although the charges etc were excessive.feeling confused but not sure I can do much more

I put a complaint into the fo about Oakham. The adjudicator came back and advised they should refund loans 4-6. They were given two weeks to reply. They have replied today saying they need another 2 weeks which the fo have agreed to. Why is allowed? Do I have any other options other to wait or can I take it via the courts?

Same here with me. The adjudicator upheld mine and gave Oakam two weeks from 06-FEB-2020 and they haven’t got back to them, which should of been by 20-FEB-2020. My adjudicator has been in contact with Oakam to find out what’s going on but still no reply from them. It’s a waiting game I guess

Wee question folks. Having had Provident partially agree with adjudicator and wipe over £1300 of a £1500 Ballance and the removal of negative markers on cred file ( what I’m most concerned with) after 6 week’s they haven’t done this… I called them but was advised it will be another “14 days” till they can do this….my question is, I’ve agreed to pay the O/S balance at £20pm starting next week, would it be advised to pay this or call them and advice that I’m withholding payment until they uphold their end of the terms that were agreed vis FOS?

Hi Sara, after my complaint with amigos I received a decision from them saying the time I had taken out the loans I could afford it!! Has they done credit checks .. they never asked for proof of my earnings .. the case is closed even tho they stated i had a conversation with them stating I could no longer afford the repayments due to reduced hours in work .. any advice on what to do would be great .. many thanks

I was looking for some advice regarding Sunny. They rejected my claim last year so I went to the adjucator who contacted Sunny saying they believe they should pay back loans 6-15. Sunny came back and offered me refunds on loans 13-15 which I rejected. My case has been sat in a que with the ombudsman since October last year. Sunny have now contacted the adjudicator this week to say they would like to increase their offer to refund interest on loans to 12-15. I find it strange that they have come back with a better offer some 5 months later. Do you think I should hold out for ombudsman which if they rule in my favour would be an extra £400 interest plus the 8%, loans are from 2015/16. I am also concerned that Sunny may go into administration while waiting for ombudsman decision (I was due refund fro QQ 1 week before they went through).

Yes they said probably looking some time in April, just concerned in case Sunny go through like QQ and I lose it all. I would just like to add Sara how grateful I am to you and this site you have created. Myself like many others I am sure would have been to embarrassed to have contacted 3rd party companies to explain how we got ourselves into this situation of borrowing from these people. My story is I earn decent money but after an expensive divorce and having to continue a large mortgage on my own given to me by Northen Rock back in 2007. I found no other way (or so I thought) to survive. Since finding this site I have so far had over £3000 refunded to me which has helped pay off other debts and keep my head above water without debt camel I would have drowned and probably lost my house and sanity. So thank you for helping the under dog.

I also rejected the offer from Sunny and sent to ombudsman in October 2019. Last Friday I had a letter from the Ombudsman for loans 3-23 so accepted so now binding by sunny.
They have 4 weeks to contact me with a redress figure and make a payment. 1 week and 2 emails sent still no contact as yet though.
Could be worth holding on.

Has anyone had a successful claim through Money Platform whilst still owing them money? I’ve got a £500 loan out at the moment but it’s going to cripple me paying it back.
Also if you cancel the CPA with the bank does that not straight away affect the loan or should you only do that if you complain?
