What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

Don’t use a claims management company. They are expensive and often incompetent. It’s easy to do this yourself and you can ask questions below and get replies from other readers who have done this.

With Piggy Bank, I am in an arrangement to repay the principal of the one loan remaining after they agreed to waive all interest in redress. How does administration affect this? I pay £20 monthly for the £600 principal I owe and have only just entered the agreement (1 payment made so far).

The administration shouldn’t make any difference to your agreement. Untilately either they will sell your debt to a debt collector and you can make a repayment agreement with them, or they will make you a settlement offer (“pay us £100 and we’ll call it quits”) or at the end of the administration they may wipe the remaining balance if you have carried on paying. I can’t guess which of those is more likely but there is no reason at the moment but to carry on with the agreement.

I got an email confirmation from both LS and my adjudicator today having already had a confirmation on 3 December. Hoping this is because I was chasing and not that they have started the 28 days from now instead of 3 December. Be pretty rubbish if they go under before then!

They confirmed on the phone they received it on the 3rd and the email states “We confirm that the refund has now been initiated and we will process the settlement in 28 days from the date of acceptance of the offer provided.” So hoping they won’t!
From when my adjudicator picked it up, I was about 4 or 5 weeks before my offer.

If they agree with the adjudicator then they make an offer and have 28 days to refund you, although some people have reported them stretching it out to 32 days.

Anyone had any dealings with MyJar?
Adjudicator just came back to me and told me that they had offered a refund on loans 4 & 5 previously (they hadn’t to me, but apparently did to the adjudicator) and that was the decision that he came to as well.
Just wondering two things;
1, do they generally agree with adjudicator and
2, how long they typically take to pay redress?

I raised a complaint, with MYJAR, and they partially upheld on all of the smallest loans (unsurprisingly). I rejected this, and sent it to FOS, after I tried to counter offer with MYJAR. The adjudicator then upheld, in my favour, and I ended up receiving 3 times the amount MYJAR initially offered. They quoted 10-15 days, as the payout time, but a negative review on Trustpilot appeared to speed things up. They responded, quite sternly, saying it would be paid within the agreed time, but was actually sat in my account 4 hours later. From what I have seen, they appear to agree with the majority of adjudicator decisions.

The funny thing is the adjudicator said that MyJar had made an offer to me previously, but hadn’t (they appear to have done so to the adjudicator, but not to me directly). He’s upheld that decision, meaning that loans 4&5 get refunded, which is what I expected to be honest. I’m just conscious of them potentially heading the way of administration (although there are no signs of that at the moment) before redress!

Just to further update on this..
MyJar unexpectedly paid out a week and a day after the agreement was sent across by the FOS – I was fully prepared for them to drag this out over the Xmas period, but glad it’s all sorted and settled now.
Just in regards to timescales :-
Complaint sent – 4th July
1st acknowledgement from FOS – 10th September
1st contact from adjudicator – 20th November
Final response from adjudicator – 9th December
Acceptance sent by FOS to MJ – 11th December
Payout – 19th December

I just want to say a massive thank you to debt camel. Without this site I wouldn’t have known I could claim a refund on many of my loans. I was in a really bad place and spiralling debt for a number of years, relying on personal loans. A lot of which are now in administration. My latest triumph has been with Mr Lender. So if it helps anyone, I’ll explaining my journey and their resolution.
From 2012 – 2018 I had 17 loans with the company many of which were taken out on a rolling basis. The only gaps I had when I couldn’t afford to pay and a payment plan was set up. But Once I paid that they still lent me money. The interest was over 2K combined. I got all the details of my loans as stated in this group. It has to be said, in my experience they have been fair with me and responded very well (I can’t say the same for others). I wrote to them in October, they offered to me in Middle of November partial settlement. To wipe my current payment plan of £400 and give me £300. I stated this wasn’t good enough and requested a final response letter. I only received it last week (the letter) but I responded today, questioning a few points they made. I said I wanted £1200 (and agreed the outstanding amount could part of that settlement).
They wrote back within the hour and said there offer was fair. I replied and said it wasn’t as even though they’ve admitted partial responsibility. The amount didn’t include 8% interest. I then said I was taking it to the ombudsman and, they replied again very quickly and offered to wipe the debt and refund me £700. I accepted it as I just want rid. They said it would be 3-5 days and they were contacting the credit agencies to update their systems. Again, must said they’ve been efficient in responding, compared to some of the others who are nightmares.
Anyway felt only fair to make a comment as I think this is a massively useful website.

Not sure if anyones asked previous but I do have a question. I currently have outstanding debt with piggybank who’ve recently gone into administration, if I’ve complained should I still be paying them if likelihood is the debt will be wiped? I only ask that because I’ve also had the administrators of wonga and wageday advance contact me and obviously found in my favour and if I had debt with them it would have been wiped. I just feel hard done by if I continue to pay and they say they were incorrect to lend to me, that I will only get pennies to the pound.

I borrowed £930 In February. In April I was put on a payment plan, paying £50 a month which is currently set up to finish paying in February 2021.
I’ve had a number of loans with them probably between 5 and 10. Varying amounts usually between £200-£400.

So this last loan was much larger than the previous ones? And so far you have repaid less than half of what you borrowed? I think you need to look in more detail at how many loans you had from them before. There is a lot of difference between 5, where you may only get the last one refunded and 10 where you would expect quite a few to be refunded.

The reason for doing this is esatblish how much you are at all likely to have a claim for. It may well be the last huge loan is unaffordable so interest would be removed. But at the moment it;s not clear how much you might have the refund from the earlier loans assessed at. If it’s a lot, it’s probably a good idea to stop paying them anything now and rely on the remaining balance being covered by the refund from the earlier lonas. If you only had 5 loans and only the last one was decided to be unuffordable you would still owe a balance.

Possibly – it depends what the administrators set up. But I wouldn’t expect your claim to be upheld if you lost at FOS.

Hi Sara,
Not sure if this is a question that you can answer, I have been successful with a number of payday loan complaints which included 8% simple interest being paid. The standard tax of 20% was taken off these by the loan companies but I still need to pay a further 20% due to just sitting in the higher tax bracket for income. Is this something HMRC will just work out at the start of the next tax year and take over the next 12 months or will they expect payment all in one go and take in one months pay packet?.
Or do I need to inform them of the amount etc?.

If you complete a tax form, just include the amounts on your normal self assessment form. If you don’t, I suggest you phone up your tax office and ask if you need to complete a tax form.

Hello, could I ask a question please?
If a lender (Lending Stream in this case) has agreed with an adjudicators decision and is in the process of closing a loan and issuing a refund (which they say takes up to 28 days) what generally happens if they go into administration while they’re doing that? Does the decision stand and the loan is still cleared?
Sorry if this has been answered already and I’ve missed it. Just thought it would be helpful to ask for myself and other people in that situation (also, keep up the good work Sara, you and your site are amazing!).

In that situation the loan would still be cleared – legally you have the right of set off between an amount you owe the lender and the amount the lender owes you – but you would only get a small proportion of the expected rest of the refund.
There is no indication that LS is about to go under.

So Satsuma were given to the 25th November to reply to adjudicator, no response. I asked adjudicator for update, said to give them one more week, asked adjudicator for update after 1 week passed, no response from adjudicator.
Now 2 weeks later I have asked for another update from adjudicator, awaiting response. Am I right to keep pushing adjudicator to get a response of satsuma or do I just need to be patient?

I think asking your adjudicator every 2 weeks is very reasonable. Every other day would be poitless.

I spoke to my adjudicator about something similar to this. They explained to me that it’s better to give an extended period for the lender to reply to the adjudicator of say “4 weeks” than forwarding it on to an ombudsman. Usually this is because the wait for an ombudsman is anywhere between 12-24 weeks. I think the general consensus is to hold out for them to reply to the adjudicator because it just saves a lot of waiting time. Plus there is nothing to suggest the ombudsman will agree with the adjudicators decision either.

Another early payout from Sunny, my Redress was due to be paid on the 24th December at the latest so I was expecting it to be dragged out until then. I have sent no chaser emails or contacted anyone other than customer services and when I checked bank account today and redress was paid into account. Stunned would be an understatement!

i put in a complaint to peachy loans about my account and current lending. i just went to log into my account to view my current balance and they have disabled my account is this normal??? i have been in a payment plan for only a couple of months but before the complaint i was able to view my account daily if needed.

Just a follow up to Sunny refunds. I just agreed a partially upheld complaint. Wanted to hold out but was concerned in case they too decided to bail out of UK market and go into administration. Accepted on Thursday, sent my bank details immediately, and noticed money gone into account today with no notification, so something is better than nothing :-)
Wish I could have been brave and held out to FOS but skint and needed something !!!!

They have up until 24th December to respond.
Do uncle buck in anyones experience usually agree ? I had 2 loans with uncle buck and both been upheld.

Unfortunately my experience was they ignored the adjudicator for so long they ended up escalating to the Ombudsman (multiple loans). That was three months ago and no update on timings for me. Fingers crossed you have a better experience

They’ve been very slow at replying to my adjudicator and I have also been put in a queue for an ombudsman.

UB’s initial complaint response was for 3 of 8 to be upheld. Adjudicator said 5 of 8. UB came back with same 3 of 8.
Given I’d been 7 months to that point, I accepted that UB weren’t going to budge without going to ombudsmen, and the the 3 of 8 was the majority of the money I was looking for. I accepted in mid-November, and they emailed on 2/12 to confirm bank details, and when I’d confirmed that, further emailed same day to say they’d pay in 7 working days. They paid on the 7th day, without any notification.

same as the others they do not pay on adjudicator , I am now in a queue for last two months rang FO yesterday and lady said likely to be another 3 months before they look at it, said I would check back with them end of Feb 2020 but as the difference for me is what they offered £500 to almost £1800 I calculated plus ccj removal I rather sit it out and if I lose as they go bust I will live with that, hope this helps sort of least you know the worst

Are they being slow? They were with me but I got my full refund eventually. After they upheld my complaint it had to be calculated by a different department which took about 2 weeks to give me the redress figure. Then it took roughly another 2 weeks for me to receive the money

I took a loan with Everyday loans for £5000 in September, at the time I was a compulsive gambler. When I took the loan, EDL asked me for bank statements from within the past 3 months, I purposely gave them statements from July as I was registered with GAMSTOP during this period and knew that there were no gambling transactions although I was withdrawing cash and going into the bookies… in August my registration to GAMSTOP stopped and I ended up gambling away a significant amount of money. I have since stopped gambling (online and in shops) and have entered a DMP to try and get my life back in order… EDL are saying that they won’t accept the offer my DMP has offered and I will have to pay the difference … can you advise if this is correct and if I am likely to win an irresponsible lending complaint on the basis that if they had looked at my statements from august they would have seen gambling transactions running into the thousands of pounds?

I very much doubt you can win an irresponsible lending complaint and I do not think you should try. You deliberately choose to not give a statement that was asked for to conceal your situation. I accept that gambling is an addiction but the lender did nothing wrong here.
BUT that doesn’t mean EL should refuse to accept that you are in a DMP. Could you say some more about your current circumstances? What is the total amount of debts in your DMP including this EL loan? How much are you paying to the DMP each month? Are you buying or renting?
And how large is this EL loan in your DMP?

Total amount of debt is around £14,000 so EL accounts for about a third. I am paying £250 per month to the DMP and I am currently renting. EL have said that they can not reschedule the account until after 6 months – so I would need to wait until March before including this in my DMP.. I didn’t conceal the statement, I sent them my most up to date generated statement which just so happens to be when I was registered to GAMSTOP and could not gamble online

Nevertheless, the lender asked for statements which was the responsible thing to do. You are VERY unlikely to win an affordability complaint.
But EL cannot operate a blanket policy of refusing to take a customer’s new circumstances into account. I assume you have stopped making the normal payments to them?
Send them a formal written complaint (email is fine, put COMPLAINT ABOUT DEBT COLLECTION as the subject and say that you have set up a DMP with [?] but they are refusing to allow your loan to be in it even though the regulator’s rules say:
CONC 7.3.4 A firm must treat customers in default or in arrears difficulties with forbearance and due consideration.
CONC 7.3.8 An example of where a firm is likely to contravene Principle 6 and CONC 7.3.4 R is where the firm does not allow for alternative, affordable payment amounts to repay the debt due in full, where the customer is in default or arrears difficulties and the customer makes a reasonable proposal for repaying the debt or a debt counsellor or another person acting on the customer’s behalf makes such a proposal.

I have been watching the payday and high cost loan market very carefully and I was surprised to find that 24/7 money box had gone into administration. The reason I was surprised is that I have still been receiving emails from them encouraging loans over the past week. The most recent one came through on Monday 9th December, surely it is inappropriate for a company in administration to continue to email customers offering loans

Just wondering if anyone has used the resolver site to lodge a complaint against a company that then went into administration?
The FOS was just about to look at my Swift Sterling complaint before it went into administration. I lodged my complaint via the resolver site. I am just wondering if the FOS is able to forward my information to the administrators or would I have to begin a brand new complaint as I lodged it via the resolver site?

It’s up to the administrators how they handle this situation. You will be able to make a Claim to them. With the larger firms in administration the administrators usually set up an automatic claim for anyone with an open FOS case, but I don’t know if the administrators for smaller firms will think this is worth doing.
Realistically the administrators are going to be very busy at the moment, I suggest you ask them in a couple of weeks what you should do.

Hi, not sure this is the right place to ask this. It relates to the 20 % tax we have to pay. We can claim back £250, what about our ISA allowence could this not come into play as the company’s holding onto our money has deprived us of the opportunity to efficiently reduce tax on our money. Could this be argued as a loss when you put your complaint into the FOS. I am basically saying should the loan company be liable for the tax owed as they have deprived you of the opportunity to put your money into an ISA. Also has anyone tried this argument with the government? Would they be sympathetic due to the number of companies bailing out and going into receivership.

The 8% statutory interest you are given on refunds is provided as general compensation for all other losses you may have incurred because of the interest you paid on the loans being refunded.
You are not going to get anywhere with the argument you are suggesting.

Sorry i thought it was to compensate money you could have earned interest in if you had not given it to the company. So my thinking was if I had not given them the money then I could have put it into an ISA where all my interest would have been tax free. It seems like the taxman is getting a great deal on this one. If this is deemed compensation do people who get compensation for injury’s as a result of being injured in a car crash lose 20% of their money to the taxman?

No tax is charged on the interest being refunded. That is your money and you get it back untaxed.
Tax is just charged on the 8% statutory interest that is added as compensation. Yes if you had invested the money in an ISA it would have been tax free, but you are pretty unlikely to have earned 8% interest in an ISA! The taxman is not getting a “great deal”, you are coming out of these refunds pretty well.
Tax on compensation for injury is complicated, see https://www.ftadviser.com/your-industry/2018/01/10/q-a-when-does-tax-apply-to-compensation/?page=1, but this does not help your argument at all.

We need to be realistic, once a company goes into administration you will get a tiny percentage of what you are owed, no payday loan company that has gone into administration has paid a redress in full, far from it they pay pence in the pound.
Ciaran, you just need to forget about it and then at some point you will be contacted but it will not be this year.
I have family that work as Administrators and they tell me the process. So unfair but the way I view payday loans refunds is some you win some you lose. I was fortunate to stumble across this site 16 months ago. I claimed against: QQ (days away from being paid), Wageday Advance (won), Payday UK (won), Uncle Buck (won), Lending Stream (Ombudsman) Likely Loans (Ombudsman), Trusted Cash (Bust) and Swift Sterling (Bust). All in all not bad, just think you never knew you could claim until this so see it as an added bonus if you get any that’s how I cope mentally.

It is possible to get a large percentage back in an administration. Or indeed be fully paid if there turn out to be more assets than liabilities.
For the largest companies with years of poor lending decisions on a large scale, that isn’t going to happen. But Piggybank are pretty small and they can’t have been in a disastrous shape or its unlikely they would have been allowed to resume lending in the summer.

At a guess, they may have found that when they always make sure the loans are affordable, the business isn’t profitable. I didn’t say they were in good shape, just it may not have been a disaster.

Mr Lender rejected my original complaint. This went to the FOS, they agreed in my favour, Mr Lender disagreed and now this is being passed to an Ombudsman for a final decision….this happened to anyone? Do they usually decide in your favour or the lenders?

The only thing is, my guarantor made a lump sum payment back in June, I still have a balance with Amigo. Just thought I’d post some info on the progress I’ve made on getting refunds from these ‘mistakes’ I’ve made in the past.
So far I have used the template on this site to reclaim :
Ferratum : £600 goodwill offer. (last loan early 2018). Probably would have been a couple of grand or more if I’d taken it to the ombudsman but the rate that firms are closing down I thought I’d better just take it. Paid out same day after leaving it until the final day of the 2 month window.
LendingStream : Admited their fault for £645 interest (nearly all of it). Paid out on the very last day of the 28 day payment window, AFTER the 2 month complaint window. Load of hastle and phone calls from me, but considering the loans were from nearly 8 years ago then I wasnt that bothered. Surpised to get anything.
Quiddie : £200 goodwill offer (last loan 2017). Took it as they also waited until the very last day. Load of hastle to get them to pay it out but they did eventually.
247 : evidently went bust last week, shame as that would have been a grand or so (if they ever responded anyway).
Basically the template does work, but you have to constantly hound these firms once you get a response. I glad I got anything but its a decent amount. Moral or the story is, just try the claim using this site and see what happens (and never go back to that cycle of course)

I submitted a complaint to Mr Lender using the template letters above, they said they sent my statement of account by post, which I never received, I asked for all communications to be sent via email, they said no it’s company policy to send by post (not sure if this MO is acceptable or not). 8 weeks went by and nothing, turns out they sent it to my old address. As it was now well past the 8 weeks I requested a final decision by the end of the week or I’d have to send it to the FOS, which they agreed they would. I now received a letter from them more than 10 weeks after lodging the initial complaint stating that: the loans where older than 6 years (which some were) and that I need to provide proof of how I came to be aware that I could still complain about old loans beyond 6 years so they can conduct a thorough investigation. Now I did explain why i did not complain earlier in my original affordability complaint, but how do I prove what they’re asking for? It appears these are just stall tactics. Would I be able to just go straight to the FOS at this point? Many thanks.

I had 2 loans with them, both being rolled over many times, the last loan had rollover payments that were repaid within the 6 year limIt, this loan was originally taken out just on the edge of the 6 year limit (08/2013).

Ok, so you may well get a refund for the second loan because of all the rollovers on the first. You can either go to FAoS now or you could tell MrL that your case goes in a week unless you are refunded all the interest on the second loan.

This is to remind folks it is worth pestering these companies, nothing ventured nothing gained. Update : Accepted partially upheld complaint with Ferratum. Had 119 loans over 4 year period. Upheld last 50 stating that that although they were at no fault whatsoever, that they should have reviewed my HCSTC loans after a period of 18 months. I accepted the partial as was terrified they would go bust like many others have done recently. After monies paid into my account, I complained again saying they should have made their assessment after 12 months. They came back agreeing (even though I had already accepted the partial, explaining I was terrified) and have now repaid from 12 months of lending in full and final settlement.

Am I correct in assuming the compensation amounts need to be added to my ‘annual income’ for tax purposes? I ask as I think they will push me over the child benefit limit.
Will they show automatically on my p60 as the tax has been automatically deducted at source?

After a bit of advise, Peachy sent me an email and have offered a settlement for my debt reducing the amount from £229.79 to the interest only of £6.53, I rang them to check this amount and they said it was a mistake and the amount I need to pay to clear it is £100. I tried to argue that it was in writing at £6.53 but they wouldn’t accept this. As it is in writing from them do I have any rights to only pay the £6 and say they have to clear it?

It is definitely worth complaint to LS then. An inaccurate application makes it harder for the lender to assess the first few loans but before 8 LS should have realised you were probably in trouble and stopped lending.
Piggybank is more marginal but they have just gone into administration so I suggest sending them a complaint.

Used your template, emailed them last week, got a full and final over today of £173.96 and asking for bank details to send it too and they will remove the adverse details from my credit file.

Complained to Satsuma back in September for Unaffordable lending due to me being made redundant and having several payday loans at the sane time. I have just been chasing for an answer. They came back today offering £30 and upholding my complaint as a sorry due to the late payments recorded on my credit file. But after asking to remove the loan from my credit report they are not upholding that part of my complaint and just amending it to say the payments werent late?
Does that seem fair? I am happy to wave the £30 in exchange for the removal on my credit file?

SafetyNet Credit just responded to my complaint of 22/11/19. I chased it yesterday, as I saw others had responses within 2 weeks.
They have offered full refund of all interest I ever paid them, with 8% interest added, which has written off my outstanding balance and left a tidy 4 figure sum.
I’ve made a number of complaints via a CMC over the last year, 4 successfully, but the success of making complaint yourself on this site encouraged me to strike out on my own with the template letter. When I brought this to their attention it then took another 4 weeks to get a response so my advice is when they do email you with the final decision double check that it is for both accounts x

Hi All,
I’m just wondering if anyone is having a similar problem with the FOS as me.
I submitted a complain for Myjar back in May. The FOS requested the final response letter in June, which I sent the same day.
After 5months I followed upthe FOS in November to understand progress, where they responded that they have not received the final response letter. So I resent this mid-November, alongside my original email attached as evidence I sent it the first time back in June.
Now today, the FOS have asked me again for the 3rd time for the final response letter, saying they asked for it in June! So I have resent it, alongside copies of my two previous replies.
This also happened with my Sunny and Trusted Quid complaints, all going round in circles.
Is anyone else experiencing such ridiculous management of their complaint?
Rant over, I am just frustrated that my complaint is going nowhere.

I am wondering about other peoples experience of Moneyboat. My complaints with the FOS. Initially Moneyboat provided information to the adjudicator, then has since refused to communicate. The Adjudicator decided in my favour – 1 to 12 loans to be refunded. They have given them numerous extensions to reply but have failed, and now its being escalated to Ombudsman.
Not many bad reviews on Trustpilot for them, surprisingly!

I had a few frustrations with Moneyboat over the summer due to slow response times but they put that down to holidays and illness. I did leave a poor review on Trust Pilot and it seemed to kick them into action.
The adjudicator sent his assessment to the business on the 5th August with a deadline to respond by the 16th August, The business eventually responded on the 30th August and i received my redress on the 18th September. Although I have contacted them a number of times since as they still haven’t removed the CCJ and now I am having to refer them back to the FOS as they won’t respond!

So just thinking with a few of us waiting on refunds on 28 days do they include bank holidays? With Xmas coming.

I’ve just had an email, mine is a 30 day wait and they have said it should be in my account before the 5/1/20 so no bank holidays have not been factored into my 30 days

Cheers H I thought this was the case but I expect with my refund being due from lending stream that they are gonna use every excuse they can make to not pay on time.

Has anybody had a successful outcome with MR Lender? My case had been with the FOS for over a year. I had 4 loans, one with rollovers, and the adjudicator initially ruled that loan 4 was irresponsible. Mr Lender disputed this and it took months for the case to be reviewed.
Last month, the same adjudicator contacted me as the Ombudsman had asked him to look at the case again. The adjudicator has now ruled that loans 2-4 were irresponsible due to gambling and other factors.
The business were due to respond by 4th December and I’ve not heard anything. I have contacted for an update. I know the FOS is busy but I have lost out on thousands with previous claims because of the delay in looking at cases and then the businesses going under. I only have this case and SNC left so I’m praying for a happy outcome with both.

The adjudicator has now replied. Mr Lender has rejected his findings again and now the Ombudsman will look at it.
I know it’s like asking how long is a piece of string but does anybody have any idea of timescales. I have already been waiting over year.

Past history isn’t much guide to how long this one will take because the ombudsman queues are now much shorter.

I have a sunny case that was rejected at adjudicator stage and went to ombudsman on 4th November and haven’t heard anything yet so I think it’s safe to say you won’t hear back til after new year at least.

I’m in the same position with Mr Lender complaint. Sent mine to FOS in March last year, picked up by Adjudicator in June but he ruled against my complaint in August. I asked for it to go to an Ombudsman. In November another Adjudicator picked up my case after they were asked to review cases waiting for an Ombudsman assessment and she ruled in my favour of 2 out of the 5 loans. However, Mr Lender disagreed and asked for an Ombudsman decision. I have emailed the Adjudicator as I felt it was unfair for it to be pulled out of the Ombudsman queue for it to be put back in at the bottom of the pile when I had asked for it to go to an Ombudsman in August. She stated that she would request it be out back into the August pile but stated that I would still be waiting for response for up to one year. Almost 2 years to wait for a response is crazy considering many of the lenders have now gone into administration meaning less complaints in the Ombudsman queue.

I just had a surprise phone call from Uncle Buck regarding my complaint made on 7th December. I had a total of four loans with them and repaid a total of £493.48 in interest. They offered to repay me the interest and 8% for loans 2&3 which amounts to £307.88. Accepted their offer and payment should be made within 7 days. I must thank Sara because if it wasn’t for this site I would never have put claims in

Hello,
I have just received a notice of termination from 118118 re my credit card. I fell behind on payments for 5 months, phoned them today and found that they have already terminated the agreement.
I spoke to the agent who was the most unhelpful person ever, the letter stated it would be terminated within 2 months from the date of the letter, 10th December and as it’s been terminated, added a default as well.
He kept talking that he couldn’t reinstate the card, I’m not interested in that, now I’ve got my finances back on track I wanted to setup a payment plan for it. He ended up not being able to explain why it was terminated when the letter said 2 months. He has now raised a complaint .
How can they send a notice of intention to terminate the account, then default and terminate it on the same date, completely different to the letter.

Received an email today for my adjudicator regarding my SNC case. SNC have came back and agreed to pay all the interest, £156 altogether, not much but will definitely be a help for Christmas.
Waited a year for adjudicator to pick up case, received email from adjudicator 12/12/19 and reply today to say SNC have agreed with adjudicator findings. Just to wait on payment now!

Hi Adam! That’s great you finally got it ,I am also waiting for 9 months now for someone to pick up my snc case, everytime I call they say still on the queue but the funny thing is my other cases sent months after has already been resolved can’t understand why

Same for me, 7 other complaints all picked up, snc still not touched. I think the complexity of the case has something to do with it, as they are not a typical lender.

Just wondering if I have had a complaint upheld by cash converters is it worth emailing Elevate Credit International Limited as cash converters works as a broker for sunny to speed up my refund

No. If your loan was from Cash converters it has nothing to do with Elevate.

Oh how I despise Drafty/Lending Stream.
No reply to my emails asking for redress payment. Whenever I call I get so angry with the idiots that work the phones I end up just giving up.

Refund was ordered in 21st of Nov by Ombudsman.
Drafty decided to not look for her email that said I agreed to it so I ended up calling them 5 times to make sure they are aware I agreed to their offer. Useless. So now it’s from 3rd of Dec. So final day will be. jan 1st.

Unless you enjoy banging your head against a brick wall, I suggest you wait for the 1st. there is no evidence that increasing your blood pressure has the slightest effect on speeding up getting your refund from LS/Drafty.

I tried chasing them but I don’t think I got anywhere. They ignored my emails and the people that answer the phone have obviously been briefed to act as a barrier between you and anyone with any authority – all you get is a “computer says no” attitude.

I had the same experience with Drafty. Adjudicator upheld my complaint although they ignored payment for 8 weeks. I emailed them everyday 3 times a day for weeks and eventually they reacted and paid redress. I also said I would be referring them to FOS for poor complaint handling. They then offered me £100 compensation for the delay.
