What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

Safety Net Credit are very reasonable and great to deal with. They came back with an offer after 3 weeks, and kept me updated that whole time. Quick Quid are bad at communicating, not even an acknowledgement email, and no word from them, they now only have a week to reply . I don’t have loans with the others but it looks like lots of people here have had good results.

Hi does anyone have any advice on whether I can complain regarding MyJar when I still currently have a loan with them and am paying off monthly?
I had a loan of £500 last year over 12 months which I paid off and they said I could reborrow 3 months ago and lent me £1000 which I’m paying but now am in financial hardship and really can’t afford it and believe they didn’t perform correct affordability checks on me or my credit score.
Do I have a leg to stand on? How would it affect current payments?

First of all, thank you for this website. I had a history of borrowing that was a seemingly never-ending cycle of borrowing to repay other lenders. I got into a repayment plan nearly 2 years ago and I’m getting close to getting clear of debt, and this website has been very useful in helping deal with some issues.
I got an email today from the FOS about my complaint against On Stride / Cash Euro Net. I got the usual email at the start of the process, explaining that it had been assigned to an adjudicator. Then 4 days later I had another email explaining that they had all the information they needed to start looking into the complaint.
That was about a month ago, so I sent an email to the FOS asking for an update. This is the response I got;
“Because you have a loan with Onstride, I’m unable to look into your complaint for the moment. We’re currently in the process of determining what approach we ought to take with Onstride loans which were lent prior to October 2018.
Once we’re able to look into this matter, we’ll be in touch with you.”
I assume this is related to On Stride being taken over by Cash Euro Net at that time?
I thought this might be of some interest to others with similar complaints. I had 2 loans. One in Aug 2015 for £2400 and the other in Sep 2016 for £1300. These were in the midst of me borrowing quite heavily on a regular basis from various other lenders.

“The question surrounding Onstride loans issued prior to October 2018 is whether the complaint should be set up against CashEuroNet or EuroNetCash which are two separate legal entities.
As of October 2018, Onstride loans fell under CashEuroNet. Prior to this merger, Onstride fell under EuroNetCash.
Once we’re able to determine our approach to this matter, we’ll be in touch with you about your complaint.”

So Day 28/28 and despite getting an email on Day 26 to say the refund had been processed nothing was received on that date or Day 27. Spoke to Lending Stream this morning who advised it would be in my bank by 10pm this evening at the latest. Had a another email about 20mins ago repeating the fact that my payment had been processed and this time the money is actually in my bank!! Thought that would be the end of it but no. Just had an email from CRS on behalf of their client, Lending Stream, offering me a significant reduction on my outstanding balance! Have made CRS aware who then replied that Lending Stream never replied to them after I contacted them at the end of August so it seems that Lending Stream just don’t like communicating! Still, at least that one has come to an end. Only Provident, 247 MoneyBox, Safety Net Credit, Amigo, Loans At Home and various Credit Cards/Catalogues to go!!

My adjudicator upheld both my loans with them but they have declined and asked for an ombudsman to look at it. My adjudicator mentioned that it may be there policy to just decline the views of an adjudicator even in such a clear case that they irresponsibly lent.

Hi JA, I’ve very recently been through the process with Moneyboat and although there were a couple of holdups from their side (they said annual leave and illness affecting their complaints department) they were quite easy to deal with after the FOS adjudicator got involved. I only had 3 loans with them and the last one was upheld. Moneyboat paid out within 3 days of getting the adjudicator assessment. Hope you get a good outcome. PF

Kirsty, tell your adjudicator. They went over the time limit with me so I told the adjudicator, he told LS they were wrong to do this and made them pay me £100 compensation and to also remove the loans from my credit file immediately, which they did. Good luck !

I got this offer from Money Box today i was wanting your opinion I think it’s pretty fair but wanted a second opinion in total i had 11 loans with starting on 31/10/2017 with £80.00 then a gap to the chain of 10 starting on 20/06/2018 running continuos until 26/07/2018 they have offered to refund the interest on loans 6-11 offering £303.52 with the 8% to be added on. In total for the 10 loan chain i paid £416.08 they also claim i did not repay loan 11 but i believe i did they are prepared to waive that £172 in total. I don’t think the FOS would give me much more maybe loan 5 and 4.

As you will see I had 25 loans. Date loan of took amount and interest paid and due date all included.
The ones with upheld are ones that QQ have accepted with amount due next to it. The ones that not upheld they have declined. Total interest coming back to me is 1269 QQ have offered. All of my loans total to interest of 2429. I am wondering whether you think it is worth it to go to FOS, or whether you think they have given me an appropriate offer in which case I would accept. i think you are likely to get quite a bit more by going to FOS. Possibly twice what you have been offered.
It isn’t clear what the wait times at FOS are for new QQ complaints. It could be surprisingly quick or it may be a long while – sorry i know that’s not helpful

Here’s a situation I don’t think I’ve seen discussed on here yet…
I recently had a complaint upheld against lending stream which left me with and outstading balance. After paying this balance via bank transfer as instructed, I was told by LS that the payment was declined. I provided evidence to them by way of bank statements and written confirmation from my bank to prove that the payment had been made by me and accepted by LS. At first I was told that my refund was in process but now every time I call them they totally deny that the payment was made.
Payment was made on 31st July, and I’ve just submitted a General Query complaint to FOS.

Good news from my adjudicator today re P2P/QQ. They have agreed with the FOS findings for £3k redress and removal of several loans from my credit record. Fingers crossed they don’t go bust like the rest of them now.

Uncle Buck have not replied to my adjudicator within the time frame as directed on there decision , they have now been given a further two weeks which is very frustrating, I phoned them myself yesterday and the lady said oh yes we missed the deadline, so I am fed up this will drag on

Two down, one to go for me and I have now made a donation through the Citizens Advice website, hope this helps with funding our local CABs.
Thought I’d also share my experience dealing with MYJAR. My timeline as follows:
August 2018: Original complaint logged with MYJAR
October 2018: Complaint rejected by lender as all loans over 6 years old
April 2019: Forwarded the rejection letter and all my details to FOS
July 2019: Case picked up by adjudicator, who contacted me to advise they have everything they need to investigate
Late September 2019: Email from my adjudicator to advise all interest charges and 8% statutory interest are to be refunded, just under £400 in total, I replied the same day to accept their decision. Adjudicator advised MYJAR of my decision and they accepted too.
October 2019: Emailed MYJAR directly to update my bank details, they replied almost immediately to confirm and advised it will take 10-15 business days to process redress
October 2019: Redress received less than 3 days later after accepting the offer
I have to say that both FOS and MYJAR have been extremely professional and the response rate from MYJAR compared to other lenders was exemplary.

MyJar were one of the best lenders I dealt with in terms of getting a refund(although of course they shouldn’t have lent to me in the first place). Prompt professional replies to queries and prompt payout instead of the delay/ignore tactics from Lending Stream or the threats from Uncle Buck.

I accepted an offer from Elevate/Sunny on 1st October and it was in my bank on 2nd !!
I am shocked but delighted. I think that maybe the fact they had messed up their figures,
reporting them to the FCA and leaving them bad trust pilot reviews helped get this
escalated their end.

HI Everyone,
I am in the process of finalizing claims with ombudsman.
Update below:
Ferratum claimed they werent lent irresponsibly however offered to remove from credit file and reinbursed £150, which i accepted.
SNC was a similar scenario to FERRATUM. Came back within the 8 weeks and offered £200 and the removal from credit file, again which i accepted.
The adjucator for Lending Stream has ruled loans 7 to 11 as irresponsible. 8% simple interest alone in almost £800 so hoping for over £1000 with interest. They also ruled that these loans are removed from my credit file.
I have just had an email saying that my complait against quick quid has been picked up by an adjudicator. I have had 16 loans qeuating to over £5000 so hoping for a good result. This is made up of 6 base loans and ten top ups.
Can anyone please explain how i work out the 8% interested on top up loans?

To anyone else who is in the early stages, keep going. Even if you get rejected by the lender go straight to the obudsman and grin and bear the wait – It should hopefully pay off!

I’ve just been offered a redress by the FSO for a complaint against Quick Quid, however it is much less than expected because they have subtracted ‘Debt written off and any previous settlement payments’. My outstanding loan (pre-2010) was eventually sold to a debt collector (motormile) and over the last few years I have paid off the outstanding QQ amount in full.
Do I have any recourse here given I have ultimately repaid in full (at high interest rates), or do I have to take this on the chin because QQ sold the debt? Incidentally the amount I paid to Motormile was significantly more than the subtraction QQ have made for debt written off.

No I settled for more – I paid Motormile £849 to settle the QQ debt that was originally £550. It’s this £550 that they have seemingly subtracted from my total redress (which they worked out as £701). They’ve also subtracted a further 20% ‘withholding’ amount, which I don’t understand either.

Can I be clear (because these sold debt cases can be very confusing to discuss)…
When QQ sold the debt to MM, how large was it? This is the balance of the debt at that part, not how much you borrowed.
(The 20% withholding amount will be tax taken off the 8% interest that was added. This is normal and you can claim up to £200 of this back per tax year if you are a basic rate tax payer.)

When QQ sold the debt to MM the outstanding balance owed to them was £699.50 – comprised of £550 (the initial loan amount) plus £149.50 in fees and interest.
I then paid back a total of £849 to MM.

Ok so you need to go back to QQ and explain that you have repaid the debt to MM in full already, so you expect them to rework their calculations to take this into account.

Well it’s very hard to win a single loan complaint. this wasn’t huge compared to your income and if this was the first of your payday loan i doubt you will get far with this one.
Do you still have big debts? £750 a month debt repayments before you started taking out payday loans is large! Who are your current big creditors?

Hi I do yes, I have about £8k I’m paying off via a dmp with about 13 different lenders. Everyday Loans and 118 money are my biggest, I’ve had an Amigo loan but I paid this off with another loan as I felt guilty with using a guarantor.

Thank you for your assistance, I have emailed Amigo and I am in the process of email Everyday loans. Everyday loans actually turned up to my home one day unannounced when I was in the DMP, I was off work with anxiety and that made things worse, so I shall add this to my claim, they also recommended that I take a credit card out and and pay for my petrol to help re-build my credit rating whilst I pay back this loan. So again I shall add this to back up the irresponsible lending. Thanks Again

Just received a mail from Wonga, they have upheld 22 loans out of 33
Provisional total = £1900
They’ve said they are aiming to get payments out to customers by jan 2020 but % of this in unknown until they are completely resolved.

It looks as though the loan being refunded was £1000 and you had already paid Avant £243 when the loan was sold. And this was just over 2 years ago?

I just wanted to say a massive thank you to Sara for this site. Cash Euro net have just agreed with FOS findings to pay out almost £6000 for loans with quick quid and pounds to pocket between 2011 and 2012. I am over the moon, I didn’t know that unfair lending complaints were possible before accidentally coming across this site. They are not the easiest company to deal with and reading comments on here has kept me going in the 16 months it has taken to resolve. I also managed to get £3000 back from Wonga just before it collapsed. Thanks to you and this site I’m almost debt free. Ready to tackle Amigo now!

Update on Sunny!
Sunny originally outright rejected my complaint last year.
Sunny rejected adjudicators decision mid august, adjudicator said loans 4-31 and sunny offered loans 11-31.
Case was sent to the ombudsman que mid august, received a letter yesterday apologising for the delay and it might take a few more months, then received a letter today saying ombudsman agrees and loans 4-31 upheld! Super happy! Hopefully this will give some others waiting a little hope that things are moving quicker now. Also my statements were littered with 1000s of gambling transactions. These were taken into account but used in my defence. Thanks Sara!

Congrats on your win! The timeframes for the ombudsman picking up cases are a little perplexing though. I had a case sent for review by an ombudsman in mid July and I haven’t heard a peep since. I also received 2 letters today telling me that cases referred for ombudsman review from mid July were probably going to take another couple of months at least. Very annoying.

Hi Stu, I agree there seems to be no definite pattern which is a little annoying! I sent my complaint last year and heard people who sent theirs 6 months later get picked up by an adjudicator before mine and their cases were very similar to mine. I know there are different departments for over 10 loans, 1 month loans, instalment loans and loans over/under 6 years but it still doesn’t seem to follow a set pattern. When I called the number on my letter to accept yesterday I went through to the PPI department…maybe they are filtering our complaints around the building to try and get through them and some are being placed in departments quicker than others? Lots of people seemed to have try and guessed the pattern but it seems random to us but maybe not to them I don’t know.

How FOS acting on gambling transactions?
I have received decline from LS but I have had several loans from other companies, defaults on my credit report as well as was gambling (for some of the period) so far was only successful with 247moneybox (£450 redress across 3 loans). Mr Lender , Uncle Bucks and LS (that’s my biggest, about 29 loans)didn’t upheld the complaint which I will be sending onto FOS in next couple of weeks.

Hi guys,ive just had a reply off lending stream dismissing my 6 loans over 5 month period,i have a plethora of evidence now showing i was dealing with 11 payday lenders at time to the tune of 3k a month and also lost my job(due to a breakdown due to the debt stress) do i send this info straight to the ombudsman with all my evidence or send it back to lending stream with evidence as i just sent a e mail of complaint the first time and no evidence?? Wee bit of advice on time frames and a strange situ from ombudsman please folks.. Uncle Buck, 9 loans covering 27 months out of 29. Adjudicator ruled loans 3-9 were unaffordable, to refund interest ( minus outstanding balance of 450) plus 8%. U.B. disagreed, only offering a refund on loan 8! So now on way to Ombudsman… What time frame am I looking at?
Secondly, Provident. Adjudicator ruled loans 3-6 shouldn’t of be loaned/rolled over. Ruled a Refund and 8% minus Outstanding balance. I emailed adjudicator back to make the point of all loans as I had defaulted on a Satuma loan ( same company as provy) 6 months prior to taking out first provy loan and that provy should have known I was in financial difficulty… The reply from Adjudicator was that she wasn’t the correct person or department to make this the decision as it was for short term lending amd has now been passed in to another dept…. How on earth did she manage to make the decision in the first place if it wasn’t her department? I’m so confused by how such a situation could arise!? I have had an offer from myjar, again quite a reasonable company to deal with. They sent me a settlement form to fill out and send back to them, but it is in a pdf format and I can’t seem to change it! Rang and rang today but was constantly on hold. Has anyone else done this? Is it easier to print the form and then take a pic/scan it? Also how long do they take to pay out?

With my claim I edited the pdf and sent it back to them. The viewer it automatically opens with in windows 10 doesn’t let you do it, but if you use the Adobe reader you can fill the form in. They were very quick in paying out to me – I sent the adjudicator the bank form on a Tuesday afternoon, on the Thurday morning I had an email to say they would pay out by the end of the week, and it was in my account that afternoon. It just goes to show that the likes of Lending Stream are just delaying to be difficult.

Firstly, thanks for your work on this site. I believe it will be a great help. I’ve had hundreds of payday loans over the last 7 years, I’ve mismanaged my finances and I’ve been a problem gambler. I used to earn well enough and my folks often bailed me out but eventually after years and years of papering over the cracks I reached a breaking point.
I’m trying to put my house in order, so to speak, and when Wonga’s administrators contacted me and subsequently upheld £8000 worth of complaints I realised other companies may be at fault. I’m not expecting a great deal from Wonga, 10p in the £ would be great. I’ve used your template to email QQ, UB and Ferratum this evening, as I had multiple loans with all and am in arrears with UB and Ferratum but I also have loans with Peachy and Satsuma that aren’t in arrears. I was wondering if it was worth emailing them also?
I fudged my figures on the applications, as I had my head in the sand and didn’t know how much I owed, I’ve just about managed to keep up with my repayments, I had multiple loans from peachy plus I was already on payment plans with UB and Ferratum when I took out the loans.

So has your gambling stopped? If not, that needs to be your priority. if you get any refunds and you are still gambling they are going to go straight back into the bookies pockets.
Assuming you have stopped…
You should make affordability complaints to any lender you borrowed from a lot (so Peachy) OR where you only had one or two loans but they were large (probably Satsuma). Do this all soon. Some of your loans are already over 6 years old and these cases go slower. Complain now to everyone to prevent more problems with this if you wait 6 months to see how the current cases go.
If you haven’t already done this, get a copy of your credit record downloaded from Credit Karma NOW. Wonga will be deleting loans, you want a credit report that shows them as evidence for complaints that later have to go to the Ombudsman.
Also set about getting copies of all your bank statements for the last 7 years from all your accounts including closed accounts. Again these get harder to get the further back they are. Wait 6 months and you may have lost another 6 months of data.
What about non payday lending – do you have other bad credit loans? A lot of low interest debt?

Yes I did. Waited the full 8 weeks, they came back with an offer. I rejected it and counter offered which they accepted. The money was in my account the same day I accepted their offer.

I have put in a claim to Sunny. The 8 week deadline is up on Friday. I had 160 loans with them over a 4 yr period for differing amounts but in total over 17,000. Does anyone have any idea what sort of redress I could expect?

That’s obviously a lot of loans, but you need to add up the amount of interest you have paid them, not the amount you borrowed.
In 2019 Sunny typically refuses to refund the first 12 months of any borrowing. And if there is then a few month gap without a loan, they sometimes refuse to refund the next 12 months following that gap…
This is NOT the approach the Financial Ombudsman takes. So in any case with a large number of loans, you are likely to get a larger refund – possibly a much larger refund – by going to the Ombudsman.
So wait until you get the decision on Friday and if you aren’t sure it is good enough, come back here and talk about it? You can’t change your mind later.

Wonga administrators contacted me a while back and have said that I am due 3684 with them, I know I won’t get that, and I’m pretty sure I had the same amount of loans with quick quid as I used to get a loan out with each of them to pay the other back!

That is very odd. Not that they made no offer originally – that’s common with Sunny. But that they offered to refund all your loans, when a typical FOS offer would have been 4-29, which you probably would have been very happy to accept!
Let us know when you get paid out? Sunny used to be fast, then got slow, I don’t remember a very recent comment.

Received a letter in the post today from an ombudsman regarding my complaint against MYKREDIT. He has said they should not have provided me with any of the 7 loans and that was after an adjudicator only said 4 of the 7 should not have been provided. Delighted at the result especially as I received a letter 2 days ago telling me it might take a couple more months.

Thanks for the info. That is frustrating as I asked how the cases were picked up by ombudsman and was told that it was date order based on when they were placed in the ombusdaman queue. Hi I rang the fos today for an update on my case with MyJar they said they upheld loans 4-5 (I only had 5) and that MyJAr had agreed with there decision I also agreed with it on the phone as well, so my question is do I wait for an email to confirm it or will the fos let MyJar know I agreed on the phone and does anyone know how long it takes please.

They have always been obstructive apparently, but the claims must be taking their toll. I think I read that they had had something like 4000 or 5000 complaints in the last year, the FOS charge about £500 per compaint so that’s over £2 million before they’ve paid any interest refunds.

Its been a while since i have posted , i took everyone’s advice and i wrote to all the Lenders i had used using the templates
8 in total
I wrote to them all and they all replied with the same answer , they were not liable and they gave me the funds in good faith etc
So i logged them all with the FOB as when i checked my bank statements it was pretty clear i was reliant on quite a few of them
Anyway all complaints were logged around June/July , basically as soon as the companies came back and said no
Was a little skeptical about whether the FOB could help , but sent it all off
FOB came back saying they were upholding my complaint with My kredit
My kredit again refused the finding and a final ruling was made by FOB in my Favour (Boom)
My Kredit owe £1,239 pounds including interest on several loans the FOB agreed should not have been agreed , not all but most
they FOB sent my acceptance letter to them 26th Sep , and advised they had 4 weeks to make payment
As of typing this i have not heard a peep from My kredit
second letter from FOB again agreeing with me that my loans from MY JAR were also being investigated
My Jar initially refused and said my issue , FOB have taken my side and i am now awaiting final decision on this by FOB , hopefully like the MY Kredit they will agree with me , another potential £650 for me
so i am awaiting the final adjudicator decision on this , but i am hopeful

They took my details on the 02/10/2019 confirmed the refund amount on the 04/10/2019 and the money was in my bank this morning the 07/10/2019 and i went through resolver portal so it might be a quicker if you have done it yourself but they promise pay out withing 7 working days. I found them by far the easiest to deal with so far and there offer was pretty good.

I made a complaint to lending stream and uncle buck re their loans, both complaints were rejected;
Lending stream reply was: Between 9th February, 2015 and 31st December, 2016, you borrowed twenty loans Eighteen loans were successfully closed. In-fact one or more loans were pre-closed before the original loan term.
Their generic summary rejection of each loan was this: “We also checked via a third party source your other credit obligations at the time of your loan approval and these similarly met all reasonable affordability criteria
Based on the above information we conclude that proper and proportionate affordability checks were conducted.
Based on all the loan by loan information provided above, we conclude that proper and proportionate affordability checks were conducted at the time each loan was approved.
Uncle Buck: this was rejected based on gaps between the 9 loans which were from April 2015 till April 2019.
Is it worth taking this to the Ombudsman? Sorry if this is long but tried to give you as much info as possible

Uncle Buck – wee these simple 1 month loans? Were they in groups with a long gap between or 1 loann then a gap, another loan then a gap… were they getting much larger… dud you ever miss payments?

Regards UB, this is what they said in their reply to justify their decision:
“Despite the above you had some very large gaps between borrowing from again for example, you had 31 days between repaying loan 6 & applying for loan 7, 176 days between repaying loan 7 & applying for loan 8 and lastly 599 days between repaying loan 8 & applying for loan 9. We therefore would have not had any concerns about repeat borrowing as the loans were taken as and when required.
I will address the fact that the first 6 loans were consectuvie, but remind you these are instalment loans and repaid over a long term, however on loans 4, 5, 6 & 7, we did in fact call you before funding these loans, during the call you confirmed you were not considering, seeking or involved with any debt management, and the loans were not to repay other debts. On the telephone calls you confirmed your income and expenditure information to be accurate which confirmed your affordability for the loans. If your now saying the loans were unaffordable I have to consider you falsified information to us, in order to obtain funding from us, by misrepresenting your position.”
The first few loans were consecutive and went up in value but as you see from the above they are putting the blame on me.

In that case I suggest you send the UB complaint to the Ombudsman too. It sounds as though you may get a refund for some of the first 6 loans and some of the last 10 loans.
There is no separate template to send a complaint to the ombudsman, the article above describes what to do.

After telling UB I rejected their findings they have have come back and made an offer for the last loan of £411 which I have accepted, but now I winder whether I should have taken this to the FOS, is it too late for that?
Sunny have responded with an offer of £1607, which seems little compared to the amount of loans I had with them but seeing what has happened with Wonga,QQ and paydayuk..etc I have accepted this offer and awaiting payment. Offer was made on 28/10 but still waiting for the payment!

If you have literally just sent off the acceptance email, yes you can change your mind. But not otherwise. You knew all the facts and chose to take the bird in the hand. You could have been waiting a long while at FOS and your case sounds complicated so it’s not clear how much you would have got.

I’ve just received an email after trying to get some information on my Sunny complaint saying that she no longer works for the FOS.

It was in a queue for well over a year and finally picked up by my adjudicator in Aug 2019. The 4th October was the cut off date for it to be passed to an Ombudsman.

OK, phone the Ombudsman up and say now your adjudicator has left, you would like another named contact for your case. When you have a case with an ombudsman, you don’t usually talk to the Ombudsman, the adjudicator remains your point of contact.

Followed your website and eventually got a loan waved off, another two took out from my credit report and also wonga which they said i will be rewarded 1 of my 3 loans, and also will remove from my credit score.
I still have 3 different providers who report the loans to the credit score company.
I raised another complaint against the 3 mostly asking to remove the credit score mark.

It is better to make a straightforward affordability complaint than to ask for a loan to be deleted from your credit record. Even if you care about the credit record more than the loan, lenders are not supposed to delete debts from credit records without an exceptional reason. And winning an affordability complaint is an exceptional reason.

Hi Sara,
I had a successful claim with PAYDAYUK, and received redress if around 2500. I asked them to remove info from my credit file and also contact the company I was in collections with (I still owed around 300 I think) they said that it was up to me to get in touch with them but that it was unlikely that it would do anything. The company was BWLEGAL or PRAC as it’s also known. I emailed them explaining the situation and asked if the balance could be wiped due to loans being deemed unaffordable but I was just ignored and haven’t had any joy since. Was this the right thing to do? Is there anything I can do about the amount I’ve also paid back to them over the years or am I best just writing it off. I only have a few payments left to make now.

They responded in their final decision letter (08/04/2019) with:
“Having reviewed the information you provided, I don’t think we made the right decision in offering you your thirteen loans between 9 September 2010 and 29 June 2012. I cannot see that these loans were affordable for you given your financial situation at the time. Therefore I am upholding your complaint with regards to these loans.
For the loans that I am upholding, I will return any interest you have paid on these loans which totals. I will also add 8% interest on that amount.
If any negative information has been reported on your credit file in respect of these loans, such as late payment statuses or a default, I will amend this.”

And to my previous email about the outstanding debt they responded with:
“Unfortunately, as PRAC Financial Limited is a third party company and we do not have any control over how PRAC deal with these debts.
We only can reach out to the company we sold your debt to, to request the deletion of the data for this loan that is recorded on your credit file, however, we can’t guarantee they will accept our request as the loan is still being paid.
So I can suggest that you better reach out to PRAC directly to deal with this request further.”
This was on the 15th March 2019.
I have paid £30 per month to prac in the meantime as part of a repayment plan that was set up previously as I don’t know if I have any rights not to and don’t want any negative impact on my credit score when I’m trying to repair it.

I don’t know if it was right but I reached a deal with PRAC to clear the two balances I had with them, their arguement was that I still owed the capital – which is right – it was just the interest that was being redressed. And I defaulted on both loans without paying anything of at all as these were the last 2 loans I took So I paid 50% on Money Shop and PUK.

The amount I last borrowed from them/was initially sold to PRAC Financial ltd was £512.78, but they added arrears/default interest, I know it went up to around £680, but I can’t recall if more interest was added after that. I didn’t make any payments before it was sold as far as I can remember. The current balance is at £110. I’ve been paying £30 per month but when I got into difficulty over the years 2016/2017/2018, I wasn’t making regular payments.

I suggest you email them a complaint saying they haven’t responded to your previous email dated dd/mm/yy. Say as PDUK say the last loan should not have been given, they should have removed the interest from the outstanding balance – this means you have already repaid more than you borrowed so you won’nt be paying them any more. And ask then to delete the default from your credit record and mark the debt as settled or delete the whole debt.
And stop paying them. This is money you may struggle to get them to refund to you.

My acceptance date was 10 Sept. Day 28 was yesterday! Was on the phone for 30 minutes and the lady said their was a technical fault ALL DAY so no refunds were sent to anyone….funny they could still lend funds! This is purely the account departments failings from what i understand….the customer service team, as friendly as they are….are helpess in doing anything -they do not even have the ability to contact the accounts team – just leave notes on file which the accounts team can read – but rarely do anything about. Ive rang everyday for 9 days and got nowhere.
Hopefully they pay out day 29 for me! and yours is sorted too hopefully and anyone else due too!

It’s funny how these technical faults only ever affect refunds! They’ve obviously instructed the customer service people to fob people off when they phone about refunds. I had the same experience when I phoned them, they were pleasant enough but just trotted out their fob off script when I pressed them on anything. I emailed the FCA to make them aware of their delay tactics.

Sunny update.
Emailed FOS on Monday afternoon for an update on my Sunny complaint which they’ve had for one year. Received response today finding in my favour giving Sunny three weeks to respond.
Feel a bit foolish letting it go so long without an update. I’ve done well from other lenders and let this one sit with the FOS. Turns out a polite email was all it took to get them moving (I don’t believe it’s a coincidence).
Sunny is my final payday lender complaint. The rest have settled or in Administration. I’ve backed off from this site as the glory days of refunds are coming to an end by the look of it.

I got an offer for 600 from Myjar they upheld 3 loans out of 21 went to fos and they discovered an additional 25 loans. FOS upheld all 46 of them and awarded me just under £5000

They may not be snowed under at all – FOS may have put a restriction on the number of loans they can offer or they may just be short of money to loan to they are blaming the “high volume of transaction” as it sounds better…

Hi just wanted to give an update on timescales and what has happened with my complaint
had an email from FOS today after sending to 2 emails for an update to my adjudicator.
My Sunny complaint is still in a queue to looked at by an ombudsman after sunny did not agree with the adjudicator.
Originally sent to FOS jan 2019 after a final response from Sunny saying no .
Adjudicator assigned June/July 2019

End of may I sent in two complaints one for sunny and one for quick quid.
They both responded exactly 8 weeks after my complaint to them (end of july). Saying they believed I wasnt owed anything and that I didnt have a claim.
Sent to FOS end of July and recieved a email for both of them start of September asking for details. Sent both of them details of my claim.
Quick quick adjudicator came back to me end of September saying they believed I was owed 2,000.
Week later the quick quid adjudicator came back again saying they have agreed to their findings and did I want to agree to then paying full amount back. I agreed and received email today saying they will transfer money in next 28 days .
In regards to the sunny complaint I still havent heard back since September

Just to add my experience with Sunny/Elevate. I made a complaint in May, which they rejected on the last day of the 8 weeks. They did offer to write off the £80 that was outstanding from my last loan, which I declined.
Sent to the FOS very shortly afterwards, picked up in August and a decision was made in September, upholding 10 out of the 15 loans I had. Sunny had until Sep 27th to reply. I didn’t hear anything so I emailed the FOS last week and then again yesterday after no reply.
They told me today that Sunny disagreed with the decision so it’s being passed to an ombudsman. I’ve got until Oct 23rd to provide any additional information that may be useful, so I guess this is the earliest I can expect any decision to start being made.
In contrast, another complaint against Lending Stream was made at the same time. Similar loans in terms of amounts and times. It was upheld in a similar manner and LS agreed. Payment is due by the end of next week. So it seems like Sunny are definitely just denying and rejecting complaints without due consideration. Probably hopeful that some people will give up before they have to pay out.

Can any one offer guidance what step to take next if any – I received this from the FOS today relating to Mr Lender:
” I’m sorry to say that I don’t think we can help you with your complaint. This is because the date of sale of your policy you stated 14 October 2014. Any policies after 31 March 2014 are out of our jurisdiction as PDL Finance Limited T/A Mr Lender were not regulated for the sale of short term loans. Any loans prior to this date, starting from 17 December 2008 to 31 March 2014 we can look at – providing that you show us evidence that loans were taken out between the aforementioned period.”

I rang FOS today, I had already checked FCA website showing PDL was registered – they are. I had also checked FOS site and since July there are numerous ombudsman decisions linked to PDL/Mr Lender.
I informed FOS they couldn’t reach the staff member who sent email but agreed that they can review the complaint. 20mins later I received an email from the guy who sent the email apologising and stated he got it wrong! Now they will investigate, which I’m thankful for.
Scary I wonder if others have just accepted such an email and not checked.
Just wondering has anyone else noticed Moneyboat offices are based in the same building as the FOS?!

Hi! Mine was 8 weeks from adjudicator being assigned and having all the information, to sending decision to the company. He then gave the company a week to respond, which they haven’t done! So waiting for the next step again.

Money boat took about 6 weeks to not up hold my complaint. I then sent to the FOS where my adjudicator upheld all my loans with them.
They declined with no reasoning according to my adjudicator and it is now in a queue for an ombudsman.

Day 28 for me passed yesterday. The excuse i have got is – a glitch, technical fault and my refund bounced back, supposedly happened to a small batch of refunds. Not sure what that is meant to mean….they have no idea when they will able to pay out and cant promise anything. Will be emailing my adjudicator today if i get nothing by 10pm which a adviser yesterday said.

I have just called lending stream who have told me due to “technical difficulties,” I won’t get my refund today. Which means they have gone over the 28 days. I have immediately called my adjudicator to inform him. I’m absolutely disgusted at this company.

That’s appalling. I know they’ve always made life hard for people but surely this must mean a transition from them being deliberately difficult to being in financial trouble? Wage Day Advance had some “technical difficulties” before they went into administration.

Ive had trouble recently with moneybox 247 if anyone can help.
They agreed a third of my loans would be paid back and offered me £780 which I would have accepted.
But I owe them an outstanding amount still from a few months ago which is about £300 and they have said they would call it even.
I have gone back to them saying no, can they take it off and pay me the difference.
But that’s been another 3 weeks and ive only had one reply saying they are again looking into it.
what do I do, cant just keep waiting and waiting.

I took out 12 loans over a period of about 2 years when I got in trouble. there was a 10 month gap between loan 4-5 so they said they didn’t do the relevant checks again.
they rejected loans 1-8 but accepted loans 9-12.
this was their response.
For loans 9 to 12 you have borrowed a total of £766.00 from us, and repaid a total of £753.60 to date. This means unfortunately there is no redress we can offer, as the principal balance is yet to be repaid (refunds are calculated from interest and charges paid over the principal amount funded.) However, to put things right, we are happy to write off your remaining balance in full. In addition to this, we can also remove all negative reporting from your credit file.

As you have borrowed more than you have repaid for loans 9-12, there will be no refund to pay as the principal amount still needs to be repaid and it looks like they are writing off your £12.40 outstanding balance.
Forward your complaint to the FOS as they will more than likely rule that more of your loans should be refunded.

I did say I wanted loans 6-9 too as they were after the break of months in-between.
They just take weeks to come back.

Following loan 4 on the 27/02/2017, there was a 10 month gap until loans 5 to 8 were funded. This is not indicative of repeat, irresponsible lending as due to the gap, the loans advanced would be considered as part of a new lending chain, as it is possible for your financial circumstances to have changed during this 10 month period.For loans 5, 6, 7 and 8 i borrowed £283.00, £200.00, £216.00 and £80.00 respectively.
I am not sure what interest I paid back, I have asked for a summary showing me all my loans but never been sent any.
Plus online nothing comes up when I click on my account info.

OK, this is a rather patchy case. A 10 month break after 4 loans is a good reason to start again, not taking the previous 4 loans into account. Then loans 6 and 7 were a bit less than loan 5, and loan 8 was very small.
You may not get much more by going to FOS. But you may. Hard to predict.

after some advice as to future plans…LS have responded to my initial direct claim with an offer (8 wks would have been next monday).
loans totalling 2.3k from 2010/12. last 2 loans with an apparent o/s bal of 470. LS have agreed to uphold enough of claim to wipe all bar £2.
am inclined to accept an effective actual redress of nearly £470 and for a couple of quid know that I’ll never have to deal with LS again. Or pass to FOS with obvious out of business risks, having already missed payouts from wonga and wageday advance.

– do you know how much interest you paid on the loans that were repaid in full?
– the last 2 loans, how much did you borrow? how much (if anything) did you pay to them?

That’s a risk worth taking. Even if they went out of business your o/s balance loan would be wiped. Take them to the FOS and start the new year with ££££

I took out 43 payday loans over 5 years, they’ve just offered my £700 redress figure on 19 of my loans-when I work it out the interest I paid back on all my loans is £1810.28. They’ve offered no 8% either..what do you think I should do and what is a fair amount I should ask for..thankyou

This is Myjar? 43 loans is a lot, it sounds as though there couldn’t have been any big gaps between the loans? Did MyJar give any specific reason for the low refund, not the general “our brilliant checking decided you were ok for the money” stuff?
They normally add 8% interest and will probably do this if you go back and challenge them, but at the moment the loans being refunded sounds a lot too low.

Yes this was myjar, they sent me a message with a load of dates saying about checks etc and that they never allowed me to rollover on my loans but I got into a dreadful spiral of paying it back okay then it went to paying it back and needing to borrow again to afford the payment.. the biggest gap I think when I got into trouble is 6 days between loans.
Theyve not added any interest into the offer? It just says redress £702.
Obviously I’m grateful for anything as I knew what I was getting into when I first loaned from them but it just got out of control in a bad way

I think you should send the case to the ombudsman. Myjar don’t negotiate, so you would be wasting your time. “Big gaps” means many months not a few days.

I made a complaint to 247moneybox & on 17/09/2019 they gave me a final response. This was an offer of a refund on loans 5 onwards but stated they did not uphold the complaint in respect of loans 1-4 as these were of small value.
Based on their reasoning and also information I have read I wrote back to them saying I would accept their offer if they agreed to also uphold loans 3&4 as these were of equal to or higher value than the loans they have accepted the complaint against. I accepted their explanation about loans 1 & 2. I asked them for a response but have heard nothing since.
I called them on 03/10/19 & was told they could see my response was with the refund department but they could not give me any other information and could not transfer my call. I sent a follow up email but have still had no acknowledgement.
Any advice as to what else I can do?

long story short cash4unow made me can offer which under pressure I accepted.
I subsequently went to the FOS who refused to loom into my complaint as I had accepted the offer.
They have since withdrew the offer and are now demanding full payment in 5 days!!!
There must be a way out of this hell.

He said he pushed them further for more detail and they were extremely vague. He said he is going to continue to keep calling them for an update every few hours. I don’t think I’ll ever get this money. They are quite literally disgusting in the way they treat people.

I can only assume that “technical difficulties” means they are having trouble finding the money to pay you. I made a complaint against them and it really is appalling how they treat people, I’m sure if anyone had “technical difficulties” repaying their loan they would be on to them immediately. You have my sympathy and I hope that you get what’s due to you.

28 days is supposed to be the maximum, not a target. There’s no reason why they shouldn’t be paying out in a week or 2. They are not responsible lenders, they are loan sharks.
Does anyone have a phone number other than the general one?
