What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

Hi, the Adjudicator found in my favour and requested a response from Lending Stream within a two week period. We’re a couple of weeks past that now and all is silent. I tried nudging the Adjudicator via email, but nothing as yet. Is the Trust Pilot route worth trying or should I sit it out? Thanks for any help.

Had to wait 4 weeks over their 2 week deadline so six week wait in total.
They do seem to be agreeing with adjudicator decisions just taking their good time in doing it.

I was given a decision by my adjudicator, sunny had two weeks, they didn’t reply. I emailed them and they ignored it, I left trust pilot reviews and they asked for my details and still have had no response. They’ve had an extra two weeks now and my case has been escalated. It’s so annoying I don’t know why they can’t just deal with these complaints!

My adjudicator ruled in my favour in Feb of this year .. they ignored the adjudicator decision .. (54 loans out of 58) it was escalated to an ombudsman on 4th March after sunny failed to respond after an extended period of time . I left bad reviews on trust pilot to no avail . it was in the queue and then they came back to offer nearly 3 months post deadline and it was the same as what they did before I escalated to the FOS in Mar / Apr 18. Taking the kick It’s now been in the ombudsman queue for just under 5 months .. sunny have been by far the worst to deal with in my experience.

Update: I called them today and they stated they hadn’t received the adjudicators decision until the 15th July, but it was sent the 27th June and that they have four weeks in which to reply, but they have two weeks the same as everyone else. Was told to email again, like I have done and got no response. My adjudicator has now escalated it and put it in the queue for an ombudsman. Apparently they are ignoring a lot of decisions at the minute!

They replied the last day of the two weeks deadline on mine. Agreeing with the adjudicator however my adjudicator realised she had made a typo regarding amending my credit file.
It took her a further 2.5 weeks for her to get verbal confirmation they her correction was accepted!!
I’m now being told regardless of this delay I still have to wait the full 28 days for the refund.
So not best impressed but they were quick compared to the other companies I’ve been dealing with. My refund isn’t huge which may have been why it was agreed fairly quickly.

Hello Zoe – no, nothing at all. I’ve asked my adjudicator a couple of times and she says she has chased them but heard nothing. I also sent them a couple of messages on their website about it but they just ignored them. It’s incredibly frustrating, I wonder how they would react if someone missed a loan payment and then ignored them for a month.

So I just called Lending Stream….the lady on the phone was very nice, so there’s something good about them! So I’ve been told now that the 28 day timeframe started from when I confirmed my bank details on the 15th July and not from 4th July when I accepted. They were supposed to contact me about the bank details but didn’t so I rang them in the end. Wish I’d done that sooner! So it looks like I’m now 15 days in. She’s assured me I will have my refund in the next 13 days and that she’ll expedite it with the Manager because of the confusion. Whether that part will happen I don’t know!

I made an irresponsible lending complaint to Uncle Buck in February 2018. It has been on hold with the FOS for more than a year. I left a review of Uncle Buck on Trustpilot recently. Below is the standard reply I received:
…”we could not look at this complaint as we could find no evidence of a funded loan on our system. This can indicate that the loan could have been repaid in excess of six years ago.
Uncle Buck also considers that if you are complaining more than 3 years after you ought reasonably to have become aware that there was an issue and therefore we are not obliged to investigate your complaint.
Therefore, we would not give permission for FOS to investigate this complaint due to the information above….
…without all the evidence of credit reports, loan agreements, notes, payment history etc we can not investigate the complaint. GDPR states that we can not keep customers data for longer than is necessary, hence the reason that we delete all customers records 6 years after the relationship has ended.”
I have received refunds from several payday lenders for loans taken during the same period. The only two payday lenders still disputing are Quick Quid (my complaint has been forwarded to an Ombudsman) and Uncle Buck.
Will the FOS be able to look into the Uncle Buck cases? (As the customers accounts have been deleted).

Had no luck with Uncle Buck or Moneyboat. I had 3 loans with Moneyboat and 4 with Uncle Buck – none of them were huge loans and they weren’t consecutive. Is it worth going to the FOS? I still have balances with both and am on repayment plans…..wondering if I just take those loses and pursue the bigger fish I am still waiting on answers from?

for each lender separately, how large was each of the loans, eg 300,200,200,350. And how large were the gaps between the loans, the time from repaying one to taking the next?

Money boat I had 3 loans : 11/12/17 £200 over 3 months; 09/05/18 £400 over 4 months; 28/3/19 £400 over 4 months (last one is on repayment plan)
Uncle Buck I had 4 loans : 15/10/16 £300 over 2 months; 28/12/16 £400 over 8 months; 30/6/18 £500 over 6 months; 01/04/19 £700 over 6 months (last one is on repayment plan)

Recent posts seem to suggest they have been agreeing with adjudicators, but they will do everything they possibly can to obstruct and frustrate the process. It’s now two weeks after the 2 week response time my adjudicator gave them and no response yet. She has chased them a few times and been ignored, and I’ve sent them a few messages to check on progress, all of which have been ignored. I also asked them about it on their online chat but all I got was fob off after fob off.

Most companies won’t work with resolver, so if it has been a week since sending your complaint and they haven’t responded then it’s best to email your complaint directly to them. They will then have 8 weeks to respond once they have acknowledged your complaint before you can escalate it to the FOS.

Hi Sara, I have had a couple of companies not uphold complaints but not sure if worth sending to FOS as I’ve only had 2-3 loans with them and interest was only £300-£350 max. I personally don’t think the ombudsman would look at these due to the short number of loans. I’m going by other upheld claims I’ve had where they don’t uphold the first 3-4 loans.

It depends. I got an email asking for more details after a week or two, and an adjudicator was assigned after 2 months. Other people have reported sending them last year and are still waiting.

I have had a complaint against H&T with the FOS since July 2018. It has still not been assigned to an adjudicator. I have called A LOT to check on it’s progress but I never get anywhere.

Call them up and ask politely how they allocate complaints.
I could understand delays once you get an Adjudicator, like someone off sick or cases which suddenly become complicated, but getting an adjudicator assigned to a complaint should be straightforward first come first served.

I’ve tried that a number of times. Apparently they are allocated in date order but that’s clearly not the case. I get fobbed off every time I call. ‘It shouldn’t be too much longer’ had been the default for the last 6 months.
I rang them again today to ask how I could complain about the time it’s taken. They said someone would be in touch. I have seen a few comments on here about the same company which have not taken as long. It’s really frustrating.

Hi everyone, I have just started a complaint with Sunny, MyJar and 247 Moneybox. I have had acknowledgement emails from all companies with MyJar requesting bank statements and payslips for the period that the loans were taken out. 247 Moneybox has responded with a list of all the loans I had taken out and asked what I would see as a solution to final settlement of this complaint. As this is the first time I have done anything like this I am looking for advice as to whether sending in bank statements and payslips is a must and what to respond with in relation to 247 Moneybox.

247 are the only lender who does this. They are asking if you would like to suggest what you would be prepared to accept. How many loans did you have from them? Did they tend to get larger? were there any bog gaps of months between repaying one and getting the next one?

Hi, I’ve receive an email from an adjudicator today about Lending stream. They’ve said that loans 9 to 39 should be refunded. anyone have any experience of LS and if they generally accept the adjudicators decisions?
Also had my complaint about Sunny passed from the adjudicator to an ombudsman at the beginning of July saying that loans 6 to 46 should be refunded. Same again, does anyone know how long roughly this takes and id the Ombudsman is likely to agree with the adjudicator?

Some success today for me.
The adjudicator has upheld my complaint against sunny for loans 5-15 (originally sent at the end of April).
This is my first decision back from the ombudsman with Myjar, satsuma, Likely loans and uncle buck still to go.
I accepted a goodwill gesture from Ferratum. Myjar refunded 2 out of 6 loans (I asked them to uphold 3 out of 6 but they wouldn’t and I agreed the others can go to the ombudsman).

Three months for me. Adjudicator found in my favour, QQ rejected that within days. Instantly turned over to Ombudsmen and three months later got the Ombudsman decision, paid out 10 days later.

I accepted a redress from 247 moneybox on Tuesday and sent them bank details. I called them today to find out how long for payment but they are unable to discuss and directed me in sending an email.
Does anybody know how long they take to pay out? Do they have a contact number for complaints team.

From my experience they were very slow to pay out, I had to chase them for about 2-3 weeks. They also didn’t include my 8% that was agreed so had to chase a further two weeks for this.
You will get fobbed off if you ring them saying wait for emails etc..
Congrats on your success and you will be paid but will have to be patient.

That was the response I got from Mr Lender in the post to my home address. This seems obstructive/a bit calculated – after all, I’d contacted them by email, and I might have had a good reason for that, such as not being at the same address any longer.
I’d also comment that even disregarding the sarcastic tone of the correspondence, it is not particularly helpful. The details of my loans provided are scant at best. I have made the same request of Payday Express, and have received a full breakdown of my transaction history, including interest, payments made, broken down into whether these related to interest the principal sum or something else, fees, extension fees, dates and pretty much everything else I could have thought to ask for. From Mr Lender, I have Date of funds transferred, Capital Borrowed, Total Capital Paid, Total Interest Paid, Admin Fees Paid and Late Fees Paid. There is no mention of the rollover fees, default interest, or anything else that might be useful. It is also presented in such a way that will make it difficult to prove irresponsible lending.
So, I thought I’d share with you, since the website is (almost) namechecked in their letter. I’m going to reply, since I suspect they’re hoping that I’ll just give up and go away, but I’m not hopeful of a successful outcome. *crosses fingers*

I suggest you send them an email saying you have received a sarcastic letter from them dated dd/mm/yy and that you would prefer to receive future correspondence by email. Say you have already started your complaint on dd/mm/yy, it was clear to your from your experience of living through the period that repaying the loans was causing you hardship but you have asked for the details so you can properly assess any refund offer they make. Say your complaint will be going to the Finacial Ombudsman 8 weeks after that date unless they make you a suitable refund offer.

I used the same letter adding at the bottom the amount of loans, the frequency, and the fact I borrowed off other lenders to pay off my loans, they phoned my agreed that the 6th of 6 loans could have the interest refunded, from the initial email to the money in the bank was 10 days.

LS update. 27 days after accepted an offer still no money recieved. I was chased them calling almost every day I have left bad review on trust pilot but didn’t work for me . Phoned FOS as well also didn’t help even my case has been prioritised. I think they doing this by purpose as an revenge for chasing them.

Ferratum offered £250 “as a gesture of good will in May” which I rejected (having 14 loans, all of which taken the same day as paying off previous. Sent to FOS, and they have today found in my favour for loans 7-14, amounting to nearly £1000!
Hopefully ferratum accept and pay out quickly!

Does anyone know how long MyJar take to payout once you send in the acceptance form for the redress? They state 10-15 days and it’s on the 10th day. They haven’t responded to my acceptance email but have sent a correspondence to close my last loan with them on the back of the redress offer.

I emailed them yesterday chasing acknowledgement of my offer acceptance (24/07) and they have just this minute replied back saying the redress was approved (31/07) to my bank and should be there in the next 15 days.

Satsuma is owned by Provident, a very large company. I don’t think there is much risk of them going bust! Ombudsmna waits are very unpredictable – 2-6 months?

I’ve just had an adjudicator decision on my MyJar case. Out of 6 loans they have said that loans 2, 4, 5 and 6 were unaffordable and should have the interest refunded. I’m very pleased with that as I thought they’d only say one or maybe two loans were unaffordable. Hopeully MyJar will agree.

Adjudicator stated they should refund interest on loan 4 which, as I paid it off early, totals about £90. They have rejected this so will now be going to Ombudsman level!

A quick update on my Lending Stream case, they have finally accepted the adjudicators decision after 4 weeks (2 weeks after the date the adjudicator gave them). No doubt they’ll delay the payout as much as possible but at least I now know that it’s in the pipeline.

E – I had 16 loans altogether and the adjudicator ruled that they should refund interest loans 6-16 as well as remove all mention of loans 7-16 from my credit file. The adjudicator gave them 2 weeks but they didn’t respond until the 4 week point. Both I and the adjudicator tried to chase them a couple of times but they ignored both of us.
Judging from the comments on here they do seem to be agreeing with a lot of adjudicator decisions at the moment, but they delay and frustrate everything as much as they possibly can.

so after MrLender rejected my complaint they actually accepted my offer for a refun on my 4th and final loan. provided them my bank details and within 2 days had the funds.
Quickquid replied today, total i had 15 loans in 4 years from 2009-2013, they upheld my complaint for 1 loan, that was the biggest loan with the most interest, so ive accepted there offer as it is rather large with it being 8 years old.

I contacted sunny and they said they’ve responded but when I called the FO they said that they’ve got a week lag on emails being assigned to cases so to call back on Monday…. so frustrating! Had one with Cashasap. Took full 8 weeks, rejected their initial offer. After a few emails back and forward (the same day) they came back next day with an offer acceptable to us both and money was in my account within 2 hours.

Has anybody had the same situation with LendingStream?
Initially rejected my claim, FOS adjudicator ruled that loans 5-6 and 11-32 should be refunded, LendingStream (on the 14th day of 14 given by FOS) agreed and sent through a settlement amount.
However, when i looked at my statement of accounts for loans 5-6 and 11-32, the cumulative amount of interest i paid was c1,000 more than LendingStream offered/calculated.
Anybody experienced this? Where do i go next? I’m happy to accept the offer of refunds on the loans FOS said but i would like them to pay back the right amount!

Today moneyboat rejected my complaint. I had two loans with them from May to September 2018. In the meantime I was over 2k over draft, had other loans with normal lenders é other payday lenders. They said that they have done credit checks on me and established affordability based on my salary and my expenses. They said that they verified my salary with trans union Ltd. I have put forward the complained to the FOS and attached their final response which I found very threatening as well. There s no way that without payslip and bank statements they could had verified my salary. Also they said that I paid easily and earlier my first loan, that was true but I did cos I borrowed with another lender. I was 2k overdraft.

Complaint submitted to FOS in March following LS rejecting my complaint.
FOS have ruled loans 7-52 irresponsible and have given LS 14 days to reply, they have recommended interest on loans 7-52 refunded plus 8% interest. Fingers crossed as this will conclude my outstanding complaint.

Firstly, I’d like to offer my sincere gratitude for all of your hard work. This website has helped me steady a very precarious situation, and so far two major lenders have addressed my grievances and provided substantial refunds.
I have a question – there is still one outstanding case, which involves the largest amounts by some distance. I waited 18 Months, and was informed an Adjudicator was assigned to the case just over a fortnight ago.
Today I received an email stating “due to the nature of one of your loans with xxx, your case will now have to be referred to a specialist team here at the financial ombudsman service who will be in touch with you”. What does this mean, exactly? They were payday loans, although they rolled over and over for a considerable length of time. Thanks again.

With time to claim PPI almost at an end I’m wondering why with PPI I still received a full refund even though the company went into administration but with Payday loans everyones being bumped for payouts with companies folding meaning you get next to nothing!
I’ve missed out on thousands after first attempts were refused because they were over 6 years ago, when I try the 2nd time it’s too late because companies have went bust.
Also it was made so much easier to reclaim PPI but Payday claims are a nightmare for a lot of people.
Whats the Ombudsman there for as they’ve done little to help the people who need it the most, all the people who live wage to wage each week mostly on low pay who if they received some of THEIR money back it would mean an awful lot to them.

Day 14, still no refund. Chased a few times and still keep quoting 28 days, almost like they will do on day 28 but sure some people had had refunds sooner so wonder if they are now sticking to day 28 to be even more awkward. My trust pilot review has had plenty of views so have just updated again but not sure if Lending Stream have seen it or how I would tell. Also left feedback with FOS suggesting that they should be able to do more, enforce timelines etc as surely 28 days is unreasonable considering they can lend in minutes.

I settled with LS at adjudicator level for just over £11,000 last year. They didn’t disagree with the adjudicator and a quick phone call to LS, after sending my bank details, meant the money was in my account in just under 2 was.

My decision came through 2 weeks after the date the adjudicator gave them. I did ask them about it on their online chat and they said it was being dealt with as high prioriity I should hear within 24-48 hours, although the tone of the chat made it sound like I was being fobbed off. Nontheless I did actually get the decision within 48 hours, I don’t know if contacting them made any difference or not.

How much did you borrow in total in 2019 and how much have you paid?
I’m just a bit concerned that if you accept a goodwill payment from them that they may try and pursue the outstanding debt from 2014 as it’s not statute barred.
Your best option may be to go to the FOS and have everything looked at and see what 24/7 come back with. Accepting a small token goodwill gesture as settlement won’t stop them being able to pursue the balance from 2014. (Although they may not pursue it)
I think it better to err on the side of caution and make sure that you won’t be chased for the older debt.
At least if it goes to the FOS they can make 24/7 come to a reasonable repayment plan with you if there is a balance that they wish to chase.

I received my money from LS within 2 weeks. I did ring them first to confirm they had received my acceptance and also to confirm they had my correct bank details. If you need to change details you have to send them a copy of the bank statement you want it paid into so they can confirm it’s you.

Sign up with https://www.creditkarma.co.uk/ (originally Noddle). Information is supplied by Transunion (originally Callcredit) and is the CRA that most lenders report to.
You won’t be able to get a historical report from the date that you took out the loans but the report will give a picture of your last 6 years history.
There used to be a button to download your report to PDF but it’s no longer there. You need to access the site via a computer, choose to print your report and then choose save as PDF from the print menu.

Just a note about LS.
I complained to them in June 2018, final response from lender not received until April 2019! Now with FOS although was actually sent after the 8 week deadline in August. Not heard a thing.
Also QQ been with FOS since July 2018, not heard a bean. This one had over 6 year loans, post 2015 loans and a flex credit account so probably a nightmare case. I’ll wait though over 45 with LS and 20 with QQ I’m hoping it will go my way.

There is a lot of comments regarding Lendingstream and the 28 day start day.
Can I just suggest that when people receive their settlement letter from the FOS where you need to sign and date it, that you add a paragraph under your signature stating that payment should be made to account 12345678, sortcode 12 34 56 and name of account holder.
This may save the delay in getting your settlement.

Hi me, I can tell you my experience with piggy bank. They got back to me on the 7th week I had 6 loans they offered to refund 4 and 6 I asked them to consider adding loan 5 as well (with good reason) and they accepted so they do negotiate if you get an offer. Uncle buck has just comeback with her final response and they have upheld against me saying that they have made their checks 9n my credit record and what was my budget. Apart that I have never lied in the application process I found the following very threatening from an FCA regulated company.
“If you choose to refer your complaint to the Financial Ombudsman Service and provide them with bank statements or other proof of your outgoings at the time to support your claim that your loans from us were not affordable, we may ask to have sight of these and will ask you to explain any discrepancies between the information you supplied to us at the time of your applications. We would do this because, according to our records, your financial position and outgoings indicated that you could afford to repay, even if you did not have a perfect credit record”
They have never asked me neither payslips and statements and they say that they made the correct checks. Unbelievable. I will take it to the FOS, I am under an DMP how they hell they made their checks?

I had a word for word identical comment in the response they sent me, somewhat ironic given that they were moaning that my complaint seemed to be based on a template! They also said that they considered my complaint “frivolous and vexatious”. I subsequently sent mine to the FOS and I never heard anything else from Uncle Buck, just a phonecall from the FOS adjudicator to explajn the process and later on an email with her decision. As it was only a few loans I would have probably left it normally, but I escalated it because of the threatening nature of their response.

Their response to my complaint seems very treathining and they also have some info that is not accurate. They place down my salary half of what actually it was. I don’t care it is only 400 gbp left to pay however it is the principle

Don’t worry about escalting things to the FOS. I was a bit apprehensive about having someone looking at my bank statements and potentially querying things etc but they were very helpful and not at all judgemental. I sent them all the details inclusing bank statements and credit report etc, after that all I had was a phonecall to explain the process and then an email with the decision.

I had them call me on the 8 week deadline offer a minimum amount when I said I wasn’t very happy she said if I took it further I would get nothing 😮I put that in my complaint

Hi All
I have just received a email from the adjudicator in regards to my complaint to Lending Stream. They have found in my favour loans 4 to 36. They have given Lending Stream until 8th August to respond. Just wondering what my options are at present and what to do?
I have found the posts on here so helpful and it does give me hope I can get back something!

Wait is the only thing you can do really, they are deliberately bad at complaint handling and will delay and frustrate everything as much as they possibly can. Don’t expect a response from then until at least a month after the adjudicator sent them their decision. If you accept then they will wait for about three weeks after they receive the acceptance, and then claim the 28 days they were given to pay out applies from then!
It can be frustrating but the funds do seem to come through in the end. I tried asking them about progress a few times and so did my adjudicator but they ignored both of us. You could try leaving them a bad trust pilot review, don’t expect it to make much difference but it will help show other people how obstructive they are.

Than you for the feedback. My case has been going on for nearly 13 months now.
It has been frustrating as LS seem to not be quick at getting back. The originally only offered a refund on one loan only. I rejected this and went to the FOS, which I explained in my original post they found in favour many more loans I had with them
Just a waiting game now and as yet I’m not sure what I’m entitled to back!

Regarding Lending Stream, don’t expect a reply by the 8th. If all is silent after a week, try politely email the adudcator for a update.
In my case, they took a couple of weeks more to respond to the adudcator. I’m waiting on a pay now, no idea how long it will take.

I’m waiting for mine too. The comments here suggest that they wait until three weeks after getting the acceptance and then say that the 28 days starts from then, with the refund coming anywhere from 14-28 days after that(another of the delaying games they play. Some people have said that Lending Stream use not having your bank details as a reason to delay further, and have not made any attempt to ask for them, so it’s worth contacting them to confirm the details if/when you accept their offer.

Thank you for feedback. I shall see how it goes a week after the date set by the adjudicator to LS. I know that I’m entitled to something back and we shall see what happens from now.
13 months so far my case had been going on for. I’m just glad that the adjudicator has backed me so to speak as originally I was only offered a refund on 1 loan only out of 36 by LS themselves which u obviously rejected at the time.

I have now received their acknowledgement of my complaint which detailed the list of loans I have had with them and how much I have repaid. They have asked for any further information that I feel may support my complaint, including bank statements and a copy of my credit report. I am a bit dubious about sending them this information as I know i’ve previously read comments to state that people are unsure how much notice the lender pays to bank statements, and they should already have a record of my the credit checks that were done at the point of each application. However, I am prepared to provide that information to the FOS if it comes to it. I suppose I will just see how it goes first.

As stated at the top of the page lenders can check your credit report themselves if they want to so they are just asking for it to be awkward. If you are uncomfortable about sending the lender bank statements then just go to the FOS.
Don’t worry about sending statements to the FOS, I’ve done it for a number of cases and they have never asked me about anything on them, they just sent me an email with their decision.

Have posted a few times about my complaint with Cash Converters and that the franchise has gone into liquidation.
My question is, the liquidators are being very vague about everything. They have said they agree to the findings from the FOS and I am due £5600. They insist the liquidation is solvent, so I will get paid once the accounts are unfrozen and the funds released.
To be honest I have no idea what exactly that means? The franchise are trading still, mainly in cash transactions, and they want into voluntary liquidation on the 8th of May. Does it normally take this long to unfreeze bank accounts? How can the liquidators be sure that in a cash heavy business, that assets are not being stripped down and cash going missing, so creditors don’t get paid?
The liquidators are not very forthcoming with any information, and I have no idea what to do.

They aren’t a team of accountants who wander in to do a quicke check everything is OK. 8th of May is very recent. i suggest you take to asking them once a month if there is any progress.

If you have accepted a final response and had payment from a company sunny for example , are you able to re open it again If you think you should have been paid more ?

you had 20 or more Sunny instalment loans (please see attached Loan Summary Sheet(s) for further information); and
ii. taking into account all loans you were charged interest for 18 months or more; and
iii. you had no significant breaks in lending.
They accepted loans 15th on but I think they should have accepted ones way before this

yes, your refund should probably have been from loan 4, 5 or 6. that would have been a lot more. But sorry, you can’t reopen this complaint because you accepted what was offered :(

I have been awarded £2900 back from lending stream, but why do I have to pay 20% of my winnings to the tax man, by the time I’ve paid solicitors and the tax man i’ll be left with £1300, I may sound thick but I don’t understand when I have already paid my debt off

Hi all.
Has anyone had any luck with Loans 2 Go? I stupidly took a loan out with them, even though the interest is ridiculous, and even though I’ve arranged a payment plan with them, I think I would like to try my luck at getting the loan written off.
Any advice appreciated.

I have just had my complaint against Loans2Go picked up by an Adjudicator so will let you know what happens. £700 loan but due to pay £2600 back even though I am in a DMP. Not sure how it will go, obviously, but fingers crossed some of that interest can be cut back.

LS E_mailed me and asked me if I want the refund to be paid into the account they have on record for me. I E_mailed them back to confirm my bank account and they E_mailed me back and said they will pay my refund in next 28 days. I’m on day 16 now

Lending Stream agreed with my Adjudicator to refund two out of the 5 loans that I took with them, so a refund of £555.98. A drawn out process as I put the original complaint into LS in November 2018 and had anticipated on FOS finding in my favor with 4 out of 5 of the loans. But much better than nothing. As always huge thanks to this site for all it’s assistance.

I put in a complaint to FOS on Thursday about waiting over a year to have my H&T complaint assigned to an adjudicator, by Friday it had been assigned and I had their findings.
They have upheld my complaint and said H&T should not have lent to me. They have suggest a redress for all four loans.
Does anyone know if H&T usually agree with the adjudicators and make an offer or will it go to the ombudsman?

I rang the ombudsman and asked to speak to a manager. I explained my situation and she said that she would speak to an adjudicator to push things along. The adjudicator contacted me Thursday afternoon to say she would review my case straight away and I had my outcome on Friday. Definitely worth trying to complain. A year is far too long
