What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

Don’t use a claims management company. They are expensive and often incompetent. It’s easy to do this yourself and you can ask questions below and get replies from other readers who have done this.

Brilliant news from my claim against Lending Stream. After a six month process from initial complaint to adjuacator decision, the adjuacator has settled in my favour with a £3500 refund!! Thank you Debt Camel!!!
How long do Lending Stream normally take to process this after an adjuacator decides this? It’s been a week so far and I imagine they’ll stall as long as possible. Anything I can do to chase them up? They already have all my bank details from their settlement letter so not sure why it would already take this long?

Did lending stream agree with your adjudicator decision? Adjudicator normally gives them two weeks to agree or disagree then from what I have read if they agree it can take up to 28 days for refund

Yes they agreed with the Adjuicator. It says the Adjudicator has asked the business (LS) to contact me to arrange the refund but they already have all my details that they need. Just worried it will stall and stall now…

I have just had a reply from LS (I only made complaint last week). I had 6 loans with them of £1070 total and they have rejected them all Barr the first loan stating that was marginally unaffordable. They have offered me £397. I sent them bank statements, credit report and loan information from another company I was using at the time. I feel they haven’t even looked at this! Have written back to them saying I want them to look at all time information and if they felt the first loan was unaffordable then why loan to me again?? I hope I have done the right thing?

Could someone please tell me who the final response letter is from? Is it adjudicator? Or sunny. Also does anyone know any email addresses of elevate senior representative s, as they have obviously instructed customer relations not to respond to customers who have been awarded compensation claims against them. I want to point out that they were actually in the wrong not the customers, hence why the FOS came to the decision they did

Yes i did claimed for unaffordablility of my loans which I had an outstanding balance of £155. I recieved £195 for the interest i paid on the loan all of my balance written off and adverse credit findings removed. One of the easiest i have come across. Found Moneyboat and Unclebuck very difficult to deal with.
Hope you get some luck. What i would sat is stay polite and any additional info you can give that may help that can also go a long way.

I thought I would just give some feedback concerning 247 Moneybox.
I asked for redress on 27 loans covering 2015-2017. 247Moneybox upheld 11 of the loans. I accepted their offer on 4th June and they emailed on 14th June confirming that they would pay within 28 days. The funds were paid into my account late afternoon on 9th July.
I received £905 back.

To cut a very long story short I had serious issues (mainly health) from early 2011 to late 2013 which led to a financial nightmare.
Out of the blue Wage Day Advance administrators contacted me and that led to me finding your website.
A few months a go I contacted any still existing lenders that I had dealt with and within 7 weeks got a huge payout from Quik Quid and am in settlement discussion with Lending Stream.
PayDay UK have just replied (after 12 weeks) as follows –
‘Your lending took place between 04/04/2011 and 30/08/2013.
My Decision:
We handle complaints following rules set out by the Financial Conduct Authority (FCA).
One rule is that a customer must complain within 6 years of the problem. Another rule is that if more than 6 have passed, you must
complain within 3 years of knowing you could complain about the problem.
I can see that all of the loans that you are complaining about are more than 6 years old. So for me to consider these loans, I need you
to tell me why you didn’t complain about these loans until now’.
Is it worth me explaining that I did not know of y right to complain for irresponsible lending or is this 6 year period set in stone by law? Quik Quid and others have not even mentioned about how old the loans were.

Have had complaints against Payday UK, Payday Express and Money Shop all upheld by adjudicator. They had until 2nd July to respond but have not replied on any of the complaints. Now in the queue for an Ombudsman decision. Has anyone had any of these companies reply whilst in the queue for an ombudsman decision, or have any indication of how long it will take for a final decision? Having first complained to FOS in November 2016 I’m starting to think I wont get anything if they go into administration even though the FOS have had nearly 3 years to get my complaints resolved!

I would give them a couple of more weeks before sending to the Ombudsman as they are extremely behind with responses. sending to the ombudsman might delay the process even more.
My adjudicator said that they are taking sometime 6 weeks to respond.

Got a second final response from MyJar. They’ve upped their offer from ~850 to ~1100, but they are still refusing to uphold my two biggest loans which have a collective £1700 interest (total interest with them about £3000.
They stated “After review of your credit file we can see that from loan 8 onwards your open credit for products such as credit cards and unsecured loans increases from approximately £2,000.00 to over £6,000.00. Based on this our proposal is to uphold loans 8 to 11. As stated in our final response we will also uphold loan 5”
Any recommendations if I should go to FOS or accept? Loans 6 and 7 are the big ones and were taken out the day after repaying the old loan.
Also, how long does FOS normally take to reply? I have had two complaints outstanding for over a month now and have heard nothing at all yet.

I sent mine to the FOS after they offered £300 redress and I had approx 3k interest with them. My case got picked up within a month and received a decision within a week which Myjar agreed with, and then paid out within 3 days of confirming bank details. I received 3.3k!

I complained to MYJAR and they offered to uphold loans 9-12 of 1-18. Oddly enough, these were the smallest, with the smallest amount of interest (funny that?). I tried to compromise and said if they were willing to wipe the interest, on the final loan, and pay me a modest refund of £130, I would close the case. The refused and I sent it to the FOS. The adjudicator recommended that they refunded on loans 5-18 and removed all adverse entries on my CR. MYJAR accepted his recommendations and ended up wiping the interest on the final loan, as well as a refund of just under £1400, ten times the amount I initially offered to compromise on. Adjudicator picked up my case in June, after me sending in May, and they have paid out today. All in all, just under 2 months. I would hold out and go to the FOS.

Just looking at H&T loans re (Harvey and Thompson) I have a complaint with them since August 2018, I don’t see many complaints against them on your site, although they where comparible to the money shop in years gone by! I did look at their web site to see if they still in business and yes still giving out loans by cheque etc! What intrest me is the comments on their site and other forums is neagative towards them as they have refused countless applications.. for example a lot have been customers who have had several payday loans and have been refused! The customers stating ( I have been a good customer and paid my loan off without any late payments and sometimes paid the loan off early and now they refused me another loan) but aren’t H&T doing the right thing and adhering to the rules of not giving out continuall loans as they will be shot down in future by customers who will want to complain about irresponsible lending! Am not in anyway supporting H&T but I think they are doing the right thing and refusing loans to people who will be on the money go round like I was with them ten years ago.

Five years worth of rolling it over, around 80-100 per month interest. Occasionally paid it off but soon back at it. I gambled too, if you gambled online it’ll show on statements which looks good at the FOS, no responsible lender should be lending to a gambler. End of the day it doesn’t really matter, they loaned irresponsible and need to pay back all those £24s plus eight percent.

I put a complaint to many lenders through debt hackers website on the 16th of May and most of them reply this week with their responses. The ones who has not respond yet is quickquid(had an acknowledgment email on the 17th of May) and Lending stream(not even acknowledge the complaint ). What should I do please? There isn’t anything you can do in practice to hurry QQ along. I suggest you tell the ombudsman that if QQ haven’t replied, you would like the case to go into the queue of an Ombudsman to review it.

Hi all ,
I’ve been through the complaint then wait 8 weeks cycle and all of my complaints have gone to FOS this was expected. So that’s satsuma, pounds to pocket, my jar, mr lender, lending stream and A claims management company . I just thought I’d share my experience so far..
I sent 3 complaints off to FOS on the following dates 18/06 19/06 and 20/06 all 2019
I have had one picked up by FOS on the 09/07 asking for more details on Satsuma like an acknowledgement email from them
I’ve also had an email today asking for more information but it wasn’t clear on the lender so I called them after work and they said they have satsuma and lending stream and to re send and sent over again acknowledgement emails in a reply to the one they sent me to day .
Also from what I gathered they have new systems using new references so he hasn’t received my third referral but did have the first two I sent over he did also mention the new systems” aren’t as good as they thought they may be “

I rang Lending Stream today as 8 weeks up but they said they have never received my complaint! I sent it via Debthacker website. I will now have to start again and email them directly.

Does anyone know if sunny usually agree with adjudicator? It has be ruled in my favour that 6-12s loans between feb 2016- october 2017. to be refunded. They have until 25th july to reply, do they usually leave it last min?

Regarding Lending Stream I don’t wish to sound negative but out of 4 companies I contacted they have been by far the least interested. After 10 weeks offered a derisory £178.00 with no interest added out of 6 large loans I had with them in under two years so do not expect a positive response as they say they are not a pay day lender but a loan company which is different…. not sure if that is true but that’s their position

Sara, WOW… thanks for that info, they were basically saying they are different as a lender and therefore I have no claim against them at all (apart from the one they accepted for around £178) although they don’t explain how they arrived at that figure. I replied nearly two weeks ago and said please let me know how you got to that figure and if they had included the interest but no response at all since. Think I will try the Ombudsman then.

I waited 8 weeks while Ferratum investigated my complaint. They sent me an offer. I had 3 or 4 loans. Total interest was £400. Got an offer of £150 so took it. No chance was I waiting a year for the rest. If I was successful.
I accepted and it was in my account later that day. Couldn’t believe it. So if this lender can do it. Why can’t all the others who choose to span it out making it awkward for all.

My Complaint with QQ has finally reached an Adjudicator who is very helpful and informative. QQ only provided him with a small % of my loans and now I have sent over the complete files so he said is going to re-assess my complaint. Are QQ being sneaky like this regularly? They provided me with the loan info so unsure why they tried to hide it. In terms of settlement if I owed QQ money and it was sold to a debt collector but then paid off/paid off for a settlement figure to the debt collector what happens in terms of the amount QQ pay me? Is it mine or QQ responsibility to find out what was paid off etc? Only ask as I was dealing with lots of DCA at the time and have a feeling I have paid money they claim I still owe.

What is the situation with amounts that were originally owed to a PDL, sold on to a debt collector and then repaid/ partial payment agreed as full and final settlement when you are arranging a settlement figure with the original PDL? IE you owed QQ £1000, you paid debt collector £800 as settlement and now QQ want to deduct £1000 off what they are going to pay me?

QQ should take into account the 800 you have paid towards the debt. This will typically mean that on this debt you have paid some interest which should be refunded.

Haven’t updated for a while so thought I would share. Can now see the light at the end of the tunnel and cannot thank you all enough for all your help, especially Sara and Iain123.
I decided that I would try for the full amount to be redressed but to settle for a lesser amount I was happy with and my credit file would have any negative information cleared.
Results so far –
MyJar – rejected their measly offer and now with FOS.
Satsuma – after initially having waiting 11 weeks refunded £1752.77 and credit file cleared.
NextCredit – refunded £731.09. Happy with this as it was 2 loans from 2012/13.
TrustedQuid – refunded £832.48 and credit file was cleared.
Cashasap – refunded £813.23 and credit file cleared.
MrLender – rejected their offer and now with adjudicator at FOS
Peachy – rejected their offer and now with adjudicator at FOS
247moneybox – refunded £755.89 and credit file cleared.
Ferratum – refunded £1011.88 and credit file cleared.
Uncle Buck – refunded £892.56 and credit file cleared.
Lending Stream – rejected and now with FOS.

Context:
I am making complaints to several payday loans companies. QuickQuid have recently responded to say that they are offering £4800 of the £5800 I believe I am owed. For the loans they did not uphold the complaint for they have given no reason, they’ve only given reasons for the upheld loan complaints. Despite me making a separate complaint about Pounds 2 Pockets they have included this in their offer and not upheld either of the loan complaints which I believe totals £2200 on top of the £5800 mentioned above. I have advised them that I’d be happy to accept their offer against the QuickQuid claims (despite some consecutive loans upwards of 4 not being upheld) but not against the Pounds 2 Pockets claims which I would prefer to take to the Ombudsman. They have said it if I accept the offer it is against both QuickQuid and Pounds 2 Pockets and I would therefore waive my right to take further action for either with the Ombudsman going forward.

Initial loans interest isn’t refunded, say the first 2-6 loans. Only when it becomes a habit with repeat borrowing and only paying interest do the predatory lending rules kick in.
That’s a surprising offer from QQ, best I’ve seen on here. Did you include any 6+ year old loans and the 8% simple?

So you are being offered 4800 out of a maximum 8000. Now you probably wouldn’t get all your loans refunded, that’s really rare, but If your estaimates of 2200 and 5800 are just the interest you paid, then 8% statutory interst would also be added. So although you are being offered a large chuunk of money, it isn’t a great offer. It is very fristrating when a lender doesn’t explain why some loans are included and others aren’t.
It’s your choice if you think it’s good enough to take to get this settled now, or if you want to send the case to the ombudsman.

Wonder if anyone has had a similar experience. Took a case against QQ to FO. Overall I have had for 16 loans since 2012. on my application I stated I was only questioning affordability of loans post 2013 in order to fall in line with 6 year time limit. QQ have now responded to FO to say the beginning of my loan applications begins in 2012 and therefore I am too late. 4 loan applications occur in 2012 – early 2013 leaving 12 post 2013. FO is asking whether I would like to leave the case in the pile with all the other pre 2013 cases or just adjudicate on loans post the cut off date?

So FOS want to know if you are happy for them to only look at the 12 loans that are less than 6 years old at the date you send the case to FOS and not get a refund on the first 4.
Were any of the first 4 loans large or rolled/deferred a lot? If they weren’t, then FOS will often only give a refund from loan 4,5, or 6 anyway, so you aren’t giving up much by dropping them – you can say you don’t want a refund on the first 4 but would like them taken into account, so you could get a refund of most or even all of the remaining 12.
If you do want the earlier loans considered for a refund, the procedure at FOS will be longer as they first have to be looked at by a specialist team that consideres if the older loans can be considered. they usually say yes, but this does prolong things.

I submitted a complaint regarding Lending Stream back in April via Debt Hacker- heard nothing after 8 weeks. I rang them and they said they had never received my complaint email.
Therefore I tried using Resolver and got an email straight away saying that they no longer use that email and to contact customer support.
So I have now tried again via logging in to my account and submitted my complaint thaymt eay and attached my previous complaint.
Just thought I would let others know if they are starting a complaint with them.

Hi all,
Just wanted to leave an update for those dealing with an LS complaint through FOS for a bit of guidance on time scales.
FOS upheld on loans 6-13 24th May, LS agreed on final day of 2 weeks and I heard back on 19th June, I accepted the offer same day, formal FOS notification of offer acceptance went to LS on 25th June, got an email from LS requesting bank details 5th July, money landed in my account this morning. My complaint first went to FOS in July 2018.
This is the first refund I have actually received, albeit FOS have found in my favour with Myjar (who agreed and I’m awaiting business contacting me now) and Sunny (partially agreed in 13 loans less than adjudicator so it’s with ombudsman now).
Awaiting adjudicator response on another 3 large loan lenders (all between £1k and £2k).
All of my complaints were rejected by the companies and I’ve now had 3 of 3 upheld and awaiting a further 3 so to anyone concerned about not having a good enough case – if you genuinely struggled to pay and had to borrow more then they were indeed unaffordable, get the emails sent off!

Had 2 with amigo second loan had 4K outstanding they wiped that off and refunded me £650 as that was total interest remaining after they wiped the loan off. My Uk credit complaint is with ombudsman and bamboo as well. Definitely send a complaint if you think they lent irresponsibly.

Thank you. I have just sent off all of my loans to FOS. The only one I reached a settlement with were ferratum. Quick quid didn’t uphold any and satsuma haven’t even replied and i sent my complaint on 20 April. Sunny offered about 2400 + stat interest – this was on loans 37-42 so not a good offer at all.
Can I just ask as I am a little worried and don’t know if this should mean I should accept Sunnys offer – my financially difficulties were because of a gambling problem. Sunny may not be aware of this but FOS will as I have sent bank statements. Does this mean fos could turn round and say they don’t uphold ANY? or at the very worst do they still have to agree with the offer sunny made as sunny have accepted they shouldn’t have lent loans 37-42.
What I’m basically asking here is at the very worst case scenario will I still get my offer from sunny? Surely I will due to them accepting responsibility. FOS won’t over turn that based on my gambling problem will they?

Although theoretically FOS could say a refund that was lower than a lender has offered, this doesn’t seem to ever happen, except where a lender has made a very small (eg £50) goodwill offer to get someone to go away. Worst case is you will get what Sunny offered – but I will be pretty surprised if you don’t get a lot more…

My question is… do I have a strong enough case for the FOS? I feel so upset going through all this.
Basically, sunny feel that I don’t have a claim as they asked me to outline my expenditures and income and the loans were deemed ‘affordable’.
During a lot of this time I was in fact on maternity leave and I did not update my income. I was also suffering with postnatal depression at the time and was ‘desperate’. Although I paid all loans on time, I was needing to borrow again straight away, every month for 4 years! I became reliant on these loans as a couple of days after payday, my account was near empty.
I also had a history of loans with other payday lenders and a high interest loan with 118, I’m not sure why they didn’t recognise this as a red flag on my credit file.

4 years of repeat borrowing with 70 loans is as cast iron a case as you can get, so get straight to FOS with your complaint. That was a template response from Sunny, a percentage of complainants give up too easily.
I suggest a brief FOS complaint, when they respond with a complaint number you can pile on bank statements and personal details later.
Don’t forget those other payday lenders probably owe you, too.

someone asked above about gambling transactions being on bank statements and I just wanted to reassure them that the FOS have been super, one mentioned it and the other didn’t, the one that did said basically if Sunny had looked at my statements and done proper checks they would have realised and should not have lent as it was not responsible (my statements were horrific back then with thousands of gambling transactions) so don’t panic and sent it to the FOS :-)

Snc replied to me on the very last day of the 8 weeks ..and they didn’t uphold my complaint .even though I was overdrawn by 5k for ten years they still lent to me and kept increasing my credit limit . They said I could easily afford to use them even though over a period of three years not one month went past where k didn’t have to use them as soon as they took their money back I had to re borrow to live..now sent to fos

I have complained to Payday UK via resolver but they keep sending an email saying they need a letter of complaint attached even though i have done this numerous times with all my details, they keep sending the same reply. They are not acknowledging my complaint. Has anyone else experienced this?
Their contact number on their email cuts out and i’m not sure what to do. is there a case to go to the FOS directly in this situation?

FOS sided with me back in April, final confirmation sent via FOS last Tuesday (9th July). They had been stringing it out for weeks saying I hadn’t accepted the right amounts and offers etc. I had left them a poor rating via TrustPilot and had hounded them every day via email for responses to my emails to their customer services team, and eventually they responded last week saying that they had received the confirmation from me and would process ASAP, knowing they had until the 6th August to pay. Received refund today of £6,500 as advised by FOS, wiped out existing balance and removed credit markers (will update when I actually see that though!). Result!!!

They ruled all the loans where afforded responsibly, mainly on the grounds that I had exposable income greater than the repayment amounts.
In reality this wasn’t true and a lot of my expenditure was understated to get the loans.
They did over to refund and over payment of £5.76. (had to re read this, surely that’s a joke)
Total interest paid £1625.83
I’m going to send this off to the FOS today, but just wanted an opinion of my chances with this?

Michael, Fairly good I’d say. I had a similar history with LS (16 loans total). I initially got a flat refusal from LS but when I went to the FOS the adjudicator said that loans 6 onwards shouldn’t have been lent and that I should be refunded the interest. They also said that as loans 6 onwards shouldn’t have been lent, any information recorded about them is averse so loans 7 onwards should be completely removed from the credit report. I’m still waiting to see if LS accept the adjudicators decision or not.
I was a bit apprehenssive about the possibility of having to discuss my financial history and situation with them, but in reality there was nothing to it. I sent them my bank statements and credit report, got an email from the adjudicator explaining the process, and my next contact was an email with their decision. They didn’t mention any of my ingoings or outgoings, they just said that the pattern of borrowing alone should have been enough to make them look further.

Hi. I formally had 6 loans with myjar back in 2012 they were then called txtloan. I opened a complaint with myjar in April. After months of back and forths of them saying they can’t locate my account, me forwarding on all old emails from them. I had to request my bank to post me my old statements. Which were a state, hammered in other loans and gambling. I went through all the statements and highlighted every transaction with txtloan and did all the workings for them. So after 13 weeks I finally submit what they ask for. Within 10 minutes they hit me back with a declined email as the loans are over 6 years. I am devastated. Does anyone have advice for me?

At least you’ve got the paperwork for a FOS complaint, which is what was going to happen anyway. Those bank statements will look good at the FOS, so start the process today.The regulators have ruled 6+ year loans can be looked at.

For anyone dealing with Lending Stream:
If you refer your complaint to the Financial Ombudsman and get to the stage where the Adjudicator sides with you, Lending Stream agree to refund, and a signed settlement form is sent to them, contact their complaints department the next day on 020 3365 0138.
They are supposed to contact you to confirm bank details but 11 days in and I had no contact. I rung them just now and had it confirmed that the settlement form was returned to them, the bank details are correct and that my refund will be processed up to 28 days from my settlement form being received, which was 4th July, so I’m 11 days into that 28 day period.
I was left in the dark for 11 days not knowing what was going on so I would highly recommend phoning them if you are at this stage and getting confirmation.

That’s not good. I’ve just been told that Lending Stream already have a backlog, about a week from Adjudicator deadline. Was hoping for money this week as deadline on 18th but sounds like I will also have to wait for the refund itself?? Been over a year so far so I guess I can wait.

Have raised several complaints against instant cash loans after the fos seemed to want to deal with payday express, PDUK and the moneyshop separately. When an adjudicator looks at these will they combine them as one or treat individually? Quickquid and pounds to pocket seem to be treated as one complaint as I have a live case with an adjudicator and they are looking at the loans collectively?

TMS, PDUK & PDEXPRESS loans will be treated separately. Even within a complaint they will split it, e.g. TMS will split the pre and post 6+year loans and split again for information you can and cannot provide. So your complaint against TMS could be several separate complaints.

So I have had my final response from Satsuma re my 3 loans. Ignoring my 1st, 2nd was £1,000 and my 3rd was 5 months later for £650.
In their response they have included ‘safe guard’ amounts. Does anyone know how they calculate or come up with these? For my 2nd loan they calculated my disposable income at £200, and for the 3rd £90. Considering my other debt repayments were significantly higher than even their calculation of my disposable income I feel they should have carried out more checks??
Has anyone had any experience at the ombudsman with anything similar/or have they made points about the ‘safeguard’ amount?

When I sent the original complaint to MyJar I only used the bank statements I could access online ie. the last 7 years. I later ordered bank statements going back to 2009 which was when I discovered the other 4 loans which were not on my original complaint. The loans were always paid off in full but I had to borrow again from MyJar a few days later along with other payday lenders

My total borrowing on all 27 loans was around £5.5K Interest paid around £2.3K,
My Loans were between 2013-2018 The majority being up to 2016, hence the larger amount of interest refunded.
My refund is just over £3.1K

I’ve had a bit of a false start with my case against Lending Stream. I have loans with Lending Stream spanning between 2010 and 2013 and the FOS received my complaint in Feb and by the end of May I decided to follow up with them.
A week later I received a call early June where my adjudicator introduced herself – RESULT!! … skip forward 7 days later and I received another call saying my case needed a specialist and I was going back in the cue. I’d waited so long, so another few weeks wouldn’t hurt, right?
I let another month pass before I call them again to get a better idea of what’s going on. Long story short (and as far as I understood) it turns out that “Gain Credit LLC trading as Lending Stream” and “Lending Stream LLC” have a dispute over who is responsible for my 2010 loans!
I was then told “a senior from the FOS is in direct contact with LLC to resolve the issue”. Not sure where I stand though. In fact the FOS offered to progress my complaint without the 2010 loans to expedite the complaint but I declined on principle.
To make matters worse, when I requested my info (about my loans, interest, payments, dates, deferrals reference numbers etc.) at no point did they (lending strean) make a distinction between “Gain Credit LLC trading as Lending Steam” and “Lending Stream LLC”
Was wondering if anyone has had a similar experience Lending Stream? Any suggestions about how to go forward?

Hi all got an odd letter from mr lender after complaining.
So they have said I had 3 loans from them borrowing a total of £950 and I have only repaid £848.64 .
I have a current outstanding balance of £631.64 and I have not yet paid the capital lent to me .
They have not upheld my complaint but as a-good will gesture will bring the balance down to the original capital borrowed and I’d only need to re pay £131.36 . they said my last loan was subject to poor proportionate checks in relation to the loan amount and the highest monthly payment

Just to give everyone an update. I sent my complaints off to the FOS in Oct 2018.
H&T was picked up early this year (Feb I think). Had 4 loans. FOS sided with H&T. I accepted this.
Peachy was picked up in March this year. Had 2 loans. FOS sides with Peachy. I accepted this.
MyJar was picked up in April this year. Had 3 loans. 2 in 2018, one for £425 and the immediate second for £3600. FOS sided with MyJar. I disagreed with this and it’s been passed to the Ombudsman.
Both Payday UK and The Money Shop have been picked up by an adjudicator this month. I’m waiting on decisions but I’ve a feeling I won’t get anything due to their recent announcement. Payday Express would be the same if it gets picked up. All 3 combined total over £8K in interest which is a shame.
I’m still waiting for an adjudicator to pick up my Provident, 118 and Everyday Loan complaints.
Within the last week I’ve had rulings in my favour against QQ and Satsuma. Loans 3-6 for QQ, about £1050 with 8% interest and Satsuma loans 5-9, a possible £3500 with 8% interest.
My question is, how likely are both of these companies to accept the adjudicator decision and pay me, or do both seem to go to the Ombudsman? They have until 23rd & 30th July to respond to adjudicator but I’d happily wait longer if it meant not sitting in a queue for the ombudsman!

Well I’ve only posted on here once about a year ago saying was it worth to claim against Sunny after having 53 loans and then I did it haha after a long wait had an email from the adjudicator today basically saying that Sunny offered to refund me from loan 46 to 53 this was news to me unless they have offered that to the adjudicator well anyway the adjudicator has has said in the email that was unfair and that Sunny should refund me from loan 5 to loan 53 they have till the 29th July to respond does anyone know if there any quick at responding and if they will finally agree with the adjudicators decision am happy that this is nearly finally done with haha

Hi Lisa G,
My Satsuma complaint was held in my favor, loans 2-6, they had to respond by 1st July but needed more time.
They came back and agreed with Adjudicator, a bit of a relief as they have been awkward throughout.
Figures didn’t add up though so still ongoing. Check any offer thoroughly before accepting.
Satsuma pay by cheque and take the whole 28 days.

Can seem to reply to your earlier comment so replying to this one.
QQ rejected on the last day of the 2 weeks given to them, adjudicator said they reject 95% of them so wasnt surprised. Just over £1,000 if they accepted. Paying loans 3-8. Now in queue for ombudsman.

They replied about a week late and this sat at the FOS unactioned, it was only when I was chasing FOS 2 weeks after the deadline that i was informed that they had agreed and the offer amount.
You can’t speak to the FOS team at Provident.

Hi Sara not sure if you got my reply as my computer crashed. No the Lender never added charges but the 3rd party when it was passed on to issue a CCJ there were about 200 added on for court fees?? so if the lender takes it back are court fees dismissed or it stays with the 3rd party the fees are still there to be paid aren’t they, thats why I asked whats best to do should that situation arise? I am hoping adjudicator is in my favour and I want to be prepared about the best way forward with the outstanding loans/ccj. Also outstanding loan has now 600 interest/charges added on and its nearly 6 years old but now it is at the FOS level I dont want it being passed on even though I had not heard any further about it until I put in my initial complaint last year.

No I didnt, I was probably scared to if I was found in the wrong and had to pay more fees which I could not afford to pay due to getting in a total financial mess. I had about 20 loans and there was 4 I defaulted on, my financial life was such a mess ever since I started on PDLs but only after being up on my limits with PDE did I start using other loan companies and it just escalated where and who i could borrow from. Also although I worked in legal at the time I never looked at the small print but thanks to your wonderful site and help I now realise I should have done and now feel confident to tackle anything! The lender was LS, who in my opinion were terrible to deal with even then, and when I did tell them I was in a mess did eventually stop the harrassment calls but bombarded me with emails and also got them from the 3rd parties too. One big vicious circle!

OK, it matters that you didn’t try to defend the case because FOS will not usually consider a complaint which has already been considered and rejected by the court. But in your case you will have got a “default judgment” because you didn’t defend it and so FOS should consider the last loan for affordabilty.
If FOS decides the last loan is unaffordable, you should be put back in the position you would have been if it had not been made, in so far as that is possible without a time machine!
So this means a refund of interest and charges added – which include the legal charges added by the debt collector going to court. the CCJ also needs to be removed. This can be done by you applying to the court for a set aside, which would cost you a fee, so that money should be added to your compensation to allow you to do that. Or the CCJ creditor can apply, which would not cost you anything. If the CCJ creditor was the same as the original lender, that would be the simpler approach, but LS may not be able to make the debt collector do this.
Is your adjudicator aware of the CCJ and additional costs?

Hi Sara again just read Adams post previously and his balance has gone to the debt agency but he hasnt got an adjudicator yet whereas mine has, are they actually allowed to do that when a complaint has been made?

Yes a lender can sell a debt while a complaint is in progress. Personally I don’t think that is a helpful thing to do, but legally they can do do it. What they can’t do is try to enforce the debt by going to court. And nor should the new debt purchaser if they are told about the complaint.
