What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam, Safetynet Credit, Tappily:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips – they won’t help an affordability complaint and the ombudsman never asks for them.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- your loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an installment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2016, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2022 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- a copy of the credit agreements for the loans if you have them. If you don’t, don’t worry, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender they will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

Don’t use a claims management company. They are expensive and often incompetent. It’s easy to do this yourself and you can ask questions below and get replies from other readers who have done this.

Although for the reasons given we deem our offer to be fair and reasonable, we would prefer to resolve your complaint amicably and in a timely manner. Therefore, we would be willing to partially uphold your complaint on loan five and seven as we felt further checks could have been conducted to ensure you were not reliant on short term loans. As you have an outstanding balance on loan seven for the amount of £508.00, we would be able to wipe this balance using the interest paid on loan five (£586.16) and refund you the difference of £78.16. Furthermore, we would also be willing to refund you a total amount of £439.47, for all of the interest paid towards your final loan therefore the total refund would amount to £517.63

So did you repay a debt collector they sold the loan to, or are LS just wrong when they say there is a balance owing on it?
You should go back to LS and say that there is no balance on loan 7, that you paid c £400 of intereest on it so you would like a refund of that plus loan 5 interest (plus 8% Statutory interest).

Tried to negotiate with MyJar after a poor offer on there final response. I wanted them to include a few other loans and add the 8% interest to the refund amount. They replied saying they will not change what they have offered and if I’m still unhappy take it to the FOS.

Myjar have come back on my final response quoting they did all checks correctly and owe me nothing.
At the end of 2017 I had loans of £250, £700,£1075 & £1100 with interest just over £1000, no breaks in the loans and next loans were borrowed on the same day as clearing previous loan.
At the time I had 3 to 4 other loans as well as a gambling problem, should I go back to them with this explanation or send it to the FOS?

I sent myjar bank statements two weeks ago showing I was gambling a lot at the time of when I took 6 different loans out with them one after the other. Pretty similar to you. Two days ago they have responded not holding any responsibility or upholding the complaint however to put things right they will refund all interest and 8% so getting it all back in 15 business days they said. Mainly due to them noticing I was gambling at the time of the loans being taken out.
Send them the relevant bank details and they may change their response but send it off to FOS in meantime.

I have recently made a complaint to Mr Lender. They have asked for my new telephone number so they can call me to discuss my complaint. Is this normal? I feel a little bit uneasy about having a telephone conversation with them about it. If this is a normal practice, any ideas what they are wanting to get from me that was not in my written complaint?
Also, i have a claims company acting on some other payday lenders for me. I know that the lenders have been referred to FOS. Am i able to contact FOS myself for an update or will the FOS only converse with the claim company i have instructed to act for me?

You can always end a phone call, if you are worried, or not clear, or don’t want to be bounced into anything, ask them to put their points or questions in writing and you will reply.
How many loans did you have from them? It may be a good idea to think about what a fair offer would be first.

They phoned me and I said I actually prefer to conduct by email just for an audit trail, but he said I just want to make you an offer which he will then send on email straight after.
Wasnt an aggressive call at all. And is a good chance to explain where you think things went wrong. I pin pointed the exact loan where the amount jumped up and where it plataued for evermore, and he took that in to account and said he would call back the next day, having spoke with his manager, which in fairness he did, and I settled

On the last day of the 8 week period that they are entitled to I have just received a response from Safety Net Credit. They have found my claim to be valid and will repay all interest paid plus 8% statutory interest.
This is more than £4000 and to me is a massive windfall. Thanks to this site I will have received over £7000 and repaid all debts, credit cards and am having a holiday. Thank you Sara.

all these was paid on time but credit file showed many applications to themself and other companys and had other payday loans at same time. are MyJar known to listen if i go back to them with bank details and my credit file or should i send to fos right away advise pls many many thanks.

Just a summary of my complaints logged:
3 loans with piggybank over 4 months 300,1000,1500. Complaint upheld by piggybank and full interest plus 8 % refund. Removed from credit file.
3 loans with satusuma over 3 months 300, 800, 500. Rejected by satsuma.
Sunny: 44 loans taken out over 20 months. Loans ran almost continuously for this period and often had 3 loans running concurrently. Loans varied from 100 to the max. This complaint was rejected by sunny.
The most important outcome for me in these complaints if to have them removed from my credit report.
I am soon to apply for a mortgage and i know that theoretically you can still obtain one with payday loans on the record, however, it is my understanding that the mortgage underwriters will look dimly on so many payday loans even if they are 2 plus years ago which most of them are.
My question is what is the best course of action to have these loans removed from my file? If i simply went back to the aforementioned companies and stated that i will close the matter if they remove all records do you think they would accept and remove these from my credit file?
If i refer to FOS and they uphold my complaints it is my inderstanding that they might not even instruct to have these removed from the credit file plus i dont want to wait a long time to have this matter resolved.
I am in a healthy financial position now so whilst a refund is good it is not my priority.

So you want to know if Satsuma and Sunny will respond to an offer not to go to FOS if they delete the loans from your credit record?
Neither should. It would be against the SCOR Credit reporting principles all lenders who report to credit reference agencies are supposed to adhere to.
I would be surprised if either does. Satsuma are likely to think you may not win a FOS complaint at all. That’s if they even think about your offer. They seem very slow and disorganised.
Sunny appear to have a very rigid approach to considering cases at the moment. Not sure if they ever deviate from it to consider random offers coming through.
Some firms delete any loans that FOS say they should refund. I think this is likely to be your best shot for getting them deleted but it won’t be quick.

They’re busy so responses are taking longer.
You’ll need a Final Response for the FOS, so it’s up to you if you want to wait for a FR or just go to the FOS now and follow up with the FR when it comes, if it’s bad news.

Firstly i want to say thank you for all the advice you offer on this site. I’ve had a couple of great outcomes so far by directly communicating with lenders. Though with my final two have gone through the FOS. They emailed me the other day to say they have disagreed with LS and Satsuma’s decisions, and gave them until 18th June to respond. Well obviously that has now passed, and i’ve Heard nothing.
What should happen next? What’s my next steps? I’ve not usually got this far.

I suggest you ask FOS in another week what is happening. If the lenders ignore an adjuidcator decision, is has to go to an ombudsman which can take another few months.

Hello. So i sent complaint to Fernovo 16.5. and today received the decision. I took 2 loans from them ,first 300£ for 3 months which i paid out with montly payments and when i payed it out i directly took another 300£ because at that time i was in big problems already. I paid on interest 250£.
Their answer was that i took ONLY two loans and both of them i paid out without “problems” and when they gave me a loan they checked creditscore and my salary was enough for it also. I dont know if i should send it to ombudsman,because the interest was 250£ So dont know how much i could win back and if i have some chance to win it

You had 0 delinquent accounts in the last 12 months.
The number of Defaults in the last 12 months was 0.
Your worst payment status in last 12 months was ‘1’ (one month late)
Your total exposure on your first loan was only 3 monthly salaries and on the third loan only 2 monthly salaries.
You didn’t have any BAIs.
You didn’t have any CCJs.

I had my first case picked up by an adjudicator last week.
This ones for 13 loans from lending stream.
The adjudicator called me, explained he’d be handling my case and that he has all the information needed to go through it.
What happens next? And how long does this process normally take?
Any idea how they allocate cases? Oddly lending stream was the last one I sent in, was the end of April and already picked up, whereas others are from Feb/March and when I called for an update on them all they’re all sat waiting.
Just trying to get my head around it all.

I’ve finally received a response from the FOS to my complaint against MyJar. I’m after some advise. Should I accept their finding or appeal it? I’m a bit lost and what would I say anyway? I had 3 loans;
12/06/15, 3 instalments, £300 loan, £146 monthly
27/02/19, 3 instalments, £425 loan, £222 monthly
07/04/19, 12 instalments, £3600 loan, £530 monthly. Has an outstanding balance.
Here’s what they said condensed;
“I don’t think MYJAR irresponsibly provided loans to you. Sorry to hear you were struggling financially, that repaying these loans may have been difficult. Given your loan amounts, what was apparent about your circumstances at the time and your history with the lender, I don’t think it would’ve been proportionate to ask you for the amount of information needed to show the lending was unsustainable.
There wasn’t anything in the information you provided or information MYJAR should’ve been aware of, which meant it would’ve been proportionate to start verifying what you were saying.
You mention you were in a DMP when applying for loan 2, and had only recently completed this plan when applying for loan 3. From credit search results and internal scoring systems, I cannot see anything there that would indicate you were in a DMP, so this is not something MYJAR should have been aware of. The number of loans, amounts for or the time meant your loan history alone didn’t show you might’ve been experiencing underlying financial difficulty.”

yes definitely go to FOS. If you were in a DMP, how could you afford £220 mounds a month for loan 2? And that last loan was huge, they should have looked very carefully at your situation before approving it, including (in my opinion) looking at your bank statements.

I had a letter last week from FOS telling me that they hadn’t picked up my claim against PDUK yet and it was likely to be months before they do. Fast forward a week and it’s been assigned to an adjudicator.
The adjudicator explained that as some of the loans are over 6 years old, the claim against them will be split into 2 claims.

All my PDUK loans were over 6 years and I had the same letter a few weeks back. Then had a call yesterday from the adjudicator to say it’s been picked up and they are starting their investigation. I referred my case to FOS in August 2018.

Safetynet are doing my head in I submitted my complaint and they replied back asking me to fill in my personal details which I did! They replied back to me today saying

How is that even possible ? I have an account with them, the complaint is from the email I have an account with but yet can’t verify me. How is contacting live chat going to solve my complaint.

I recently was successful with my affordability complaint with sunny I had 27 loans with them. Today I have sent the same complaints off to myjar and lending stream. These loans were taken out after the initial sunny loans and were at a time of money struggles. I only had one loan with each of these lenders, Myjar – £150 and Lending Stream £500. What are the odds of success with these loans? I’m not sure as there is only one from each company but all the same gripes apply from my successful complaint with sunny that paid me out very quickly id like to add.

You’re unlikely to have much success with single loan cases. The Ombudsman tends to say that the first few are early in the lending relationship and that it wouldn’t be proportionate for them to look further. Once you’ve had about 3 or 4 + they start to say that the lender should have looked more closely.
I had a couple of single loan cases rejected by the lender and ombudsman, but sucess with Ferratum where I’d had 3 small short loans and then a rolling credit one that went on for a year or so.

You will only win a one loan payday loan refund case if it is very large unless there is something unusual about it. £150 not worth bothering with. £500 may be if your income was pretty low.

Submitted my Mr Lender complaint to the FOS last month. Adjudicator came back to me this week (much earlier than expected) recommending the company redress loans 2-9 + 8% simple interest. This works out approx £4k + the simple interest.
The initial offer from Mr Lender was a £50 Tesco voucher, then £800 then a final offer £1100.
Hopefully Mr Lender agree to the decision and the case can be closed.

My Jar came back to to me with an offer this week, nearly £1650, pretty much amounts to the interest on all my loans I took out. it includes the 8%. But tax deducted. I will send response soon. Thank you so much Sara!!
I have about 9 other lenders, who should get back to me next week hopefully. Spoke to Payday Uk who seem to have progressed my Money shop one more quickly than the Payday UK claim. But customer service rep I spoke with said on the phone, they were questioning why I didn’t contact before, as some of my loans were taken between 2009 – 2012 too, and took my story, I explained, I didn’t know I could complain under unaffordability. and was only only prompted when Wage Day and Wonga emailed me and I did the research. I hope they have completed the investigation and not just taken 8 weeks to ask me the question just now but I am hoping to hear something next week.

So just before my QQ /Casheuronet claim goes from adjudicator to ombundsmdan, QQ have made an offer to pay out on one loan instead of the recommended 10 loans by the adjudicator.
Is that par the course for them? I take it if I reject this offer, it will then go to ombudsman where the chances are the ombudsman will agree with the adjudicator and eventually QQ will have to legally pay out on the recommended ten loans.

I made a complaint to QuickQuid Feb 2018 about loans I took out between 2011 – 2016. They refused my claim so I went to the FOS in March 2018. I finally heard back today that they think the first 5 loans I had were ok but they agree that further loans 6-26 should not have been given. So they have given QQ until July 12th to either agree with their decision or disagree. I will update here after the 12th with the outcome.

I got final response from Sunny today, within the 8 weeks. I had 41 loans with Sunny but they would only look my complaint from 18th loan onwards, “taking into account all loans/draws you were charged interest for more than 24 months;”
However we note that you did fall behind in your repayments at some stage by more than 7 days (albeit if you re-borrowed after that you must have never fallen behind by more than 45 days otherwise you would have been permanently restricted from any future borrowing) and it may have been prudent for us to contact you at the point at which you had held a HCSTC balance for 18 months. According to our records, this was at the time of your 18th loan/draw.”
The offer wasn’t bad:
To put things right, we propose to do the following:
· Calculate the interest paid by you from your 18th loan/draw onwards (£3973.53);
· Pay interest of 8% (simple) on the above refund amount from the dates of payment to the dates of settlement, which comes to £808.29;
· Amend your credit file by removing all loans from your 18th loan/draw onwards
But surely they need to look at the loans 5th one onwards as per recent FOS guidelines? As they need to do further checks, when customer goes back repeatedly? Is this reasonable to ask? So called them, stated my reasoning and they said I have to go to FOS.
Also I feel like the number of loans I had with other lenders at the same time hasn’t been considered as they never asked for these through my bank statements. I mentioned this too but got told to go to FOS.
Can someone/ Sara please advise.

I was in a similar position with you regarding sunny… They agreed to pay from 13th loan onwards when FOS would have probably agreed from 4th, difference in value had I have gone to FOS was £1000, however when I weighed it up, I used the 3600 from Sunny to clear the rest of my outstanding loans etc. For me, the opportunity to get towards my goal of being debt free was too good to pass up, and if I’d have waited I would have had to continue to pay interest etc whilst waiting. It’s your option, they didn’t negotiate financially at all though, However what they did do for me was delete every record of every loan from my report, meaning it cleaned my report up properly. Worth asking for that if you do decide to agree.

I don’t understand why they don’t do it from the 5th or 6th loan, it’s so exasperating. They know if some lone returns and repeatedly borrows they should consider that a warning sign. It’s a pretty poor offer – you aren’t being unreasonable.
But you need to know how poor to decide what to do. Ignore the 8% extra interest and just compare the interest you paid… they are refunding loans 18-41 which is £3973 interest paid. Add up the interest you paid from loan 5 to loan 17 – how much does that come to?

So they are offering you about 3/4 of what you might get by going to FOS (3900 now vs a max of 5200, but FOS may of course decide the refund should start from loan 4 or loan 9…)
It’s not a bad offer, they obviously aren’t excluding the largest loans, and it would get it settled quickly with no stress. It’s quite a personal decision whether you are happy with it or want to push for more. It’s not unreasonable to want the most you can get but there is nothing wrong with taking an offer you think is good enough.

Just got an update on my email/ Resolver….pay day UK “ we are not yet in a position to respond to your complaint as our investigation in not yet complete.
The Financial Ombudsman Service gives a business eight weeks to respond to a complaint and, as this time has passed, this means: You have the right to refer your complaint to the Financial Ombudsman Service, free of charge. The Ombudsman might not be able to consider your complaint if:
* What you are complaining about happened more than six years ago; and
* You are complaining more than three years after you realised (or should have realised) that there was a problem.”
A lot of my loans with Payday UK/ Money Shop go back to 2009. I had to verbally tell them for both claims this week, that I didn’t know I could complain until recently. That’s one of the questions they asked. I explained I only knew to complain due to the emails from Wonga/ WDA. They said money shop one is being dealt with but now pay day UK want more time. Shall I escalate to FOS or give them a few more weeks? Thank you for any advice. Sorry to keep asking so many questions! But just want to be sure is all. I don’t really have many people to ask. I had these loans with Piggybank is it worth complaining as it’s not many. The total interest is over £800 (includes £15 late fees) first loans were payday loans which i deferred sevetal times each and the larger ones were monthly loans. I reborrowed on the sameday i paid off the previous loan everytime.

Hi Sara received my reply from Piggy bank refunding interest on all but the first 3 loans, I’m happy with that but they did say this
“order for PiggyBank to appropriately assess your ability to repay, we must be provided with accurate information. If your income and expenditure information has been falsified, this can be seen as a deliberate misrepresentation, misstatement or omission of financial data for the purpose of misleading the lender. The T&Cs that you agreed to, mention fraud and a fraudulent application; ‘If you give us false or inaccurate information and we have reasonable grounds to suspect fraud or we identify fraud we may record this and may also pass this information to FPAs and other organisations involved in crime and fraud prevention to prevent fraud and money laundering.’ Should the investigation indicate that you have falsified information, PiggyBank will submit your details to Fraud Prevention Agencies and other organisations involved in crime and fraud prevention to prevent fraud and money laundering which may make obtaining credit in the future. I know I gave the correct information but I was gambling a lot at the time should I mention this in my reply ?

I can finally shut the Lending Stream claim.
First complained Dec 17 – rejected within 2 weeks.
Sent to FOS 2 days before 6 month cut off 29 May 18 (hadn’t really realised what could be done)
Heard nothing up until 22 May 19 when Adjudicator sent an e-mail saying they upheld my claim, didn’t realise it had even been looked at then.
LS replied on the very last day 3rd June
My acceptance received by them 11 June
28 day window for payment given – payment received 28th June 19!

LS had until 21st June to adjudicators decision to uphold my claim.
I chased adjudicator up twice last week with no response, then tried phoning but his voicemail said he is off sick until Monday. Then had email from the short term lending email address to tell me LS have yet to reply and they will chase it up.
I’m really hoping I hear next week and get their agreement and refund process started.
It’s agonising being so close to being able to pay my 118 and few other small loans off.
Good to hear the last few days that LS are making faster payments though.

Absolutely amazing result today, with reference to my MYJAR complaint. When I originally complained, they only partially upheld loans 9-12, saying that loans 1-8 and 13-18 were lent responsibly. They offered a reduction of just over £400, on my remaining balance on my final loan. I asked them to compromise, and remove the interest from the final loan, and a modest refund of around £130. They rejected this. I complained to the FOs, and the adjudicator decided that he felt loans 5-18 should never have been granted and recommended a refund of all interest & charges, plus 8% simple interest. He also said that all negative information/loan history, from loans 5-18, should be wiped from my credit record. Today, they have come back to say that they accept his decision. Instead of a modest refund, as originally requested in the compromise offer, they will now be refunding 10 times that amount (over £1370) along with the final loan now cleared and all of the entries, as recommended by the adjudicator. I’m rather glad now that they rejected my compromise, as I would have done myself out of just over £1200! Next stop is Likely Loans! I’m feeling very empowered today!

I had a amigo loan and I made my last payment to them in January 2013, I took the loan out in July 2011 is this worth trying to claim, I made 18 payments to them in total and over 18 months paid around £1200 in interest over them 18 months . The original loan was for £3300 over 3 years. I managed to pay it off early, but was still seeking advice if this is worth claiming or not, amigo will probably say it’s over 6 years so no…I did have a couple of payday loans at the time as well…

Was wondering if you can clarify something for me, I made an original complaint to MYJAR on the 3/5/19. They responded after around 5 weeks stating they only keep 5 years worth of records and therefore I have only had 1 loan with them and they are not upholding the compliant. Since then I have retrieved bank statement showing I had around 20 loans and paid a total of around £3.5K in interest. I sent these off to MYJAR 2 weeks ago.
Do the 8 weeks start again from when they said they were not up holding the complaint? or do I go from the original complaint email which means their 8 weeks will be up tomorrow and I can send to the FOS.

I have taken 13 loans with Myjar over the last couple of years and at least 3 or 4 of them I applied for were applied for with my old address that I could not change on their website. Does this show that they did not perform their checks properly in regards to affordability as I would have thought that checking my address would be the 1st thing they would check. Is it worth me mentioning this in my complaint letter?

13 loans from Myjar is a lot – you have a good case even without this point. You had tried to change your address, so did you also update other expenses such as rent when you moved? It’s up to you if you want to mention it, there is a case for just keeping things simple and only going into detail if necessary at the ombudsman.

Hi Sara I sent off my complaint to Myjar and got the usual standard reply to say it could be 8 weeks and when I logged into my account my collection schedule had been removed and in its place my outstanding balance and a date 2/10/19 that’s 3 months from my date of complaint. Also it had CAA.SHARED.INSTALMENT.STATUS I’m pretty worried about this as it sounds like I have to pay this off in 3 months it’s over 2k. I’ve asked what this is but they haven’t got back to me. Myjar were superb with me. I took out 11 loans with them and paid just over £1000 interest. They got back to me within the time frame, and made an offer to refund loans 4-11 which meant a redress of almost £700. The money was in my bank 2 days after I accepted.
I was very surprised, I didnt expect it to be that easy. I have 3 other cases going on at the moment and they are all dragging on. Well done My Jar! Credit where it is due.

None of those lenders are in the “do give good offers after a few more weeks” category. So send them all to FOS if you don’t get a reply by end Monday – it’s worth giving them the weekend :) Do come back here if you aren’t sure an offer is good enough, or if a case is worth taking to FOS.

Then send the Sunny complaint straight to FOS – Sunny aren’t considering refunds if you borrowed for less than a year – this is not a way FOS decides complaints, FOS is likely to see your continuous borrowing and think Sunny should have noticed you were in trouble well before the 15th loan!

It’s lending stream its been with an adjudicator since last year and had an email may 22nd to say it would now be put in a queue for ombudsman as they don’t agree but today have also received another email to say it’s still in queue.
It’s been in queue since 10th June so I’ve been told . Anyone had theirs go to ombudsman level and how long did you have to wait for it to be complete?

I’ve just had a browse at the Piggybank website and it says that they’re not processing any loan applications at the moment, due to upgrading their systems and normal service will resume shortly. Hopefully, this will put peoples minds at rest who have a complaint in against them?

Lending Stream have finally agreed a refund with the adjudicator. How long do they have to pay me and will I probably need to chase this?
I’m in my 8th week of a complaint to 118, do many people have success with a 1large loan complaint with them?

118 – some people get a complaint settled directly, lots more get a good result from going to the Ombudsman. Most of these are 1 loan only – you can win these complaints because the loan is large. I have had an offer from sunny to which I have accepted but not heard anything from them since the offer which was Friday last week. Do I just sit and wait the 30 day period to see it go into my account. Or will someone let me know they have seen my acceptance and will they let me know when it’s going to be transferred to my account?

I did send a follow up email asking them to confirm they had received my bank details which was the day after I had sent them, they did come back to me and confirm, but not heard anything since.

Still waiting for it. I called them at 6.15pm today to make sure it would be paid. The guy confirmed yes this was the 30th day, he then spoke to his floor manager who said it’d be paid by close of play 7pm. It may still arrive today, we’ll see, but I doubt it now.

I accepted offer from Sunday week Monday… my adjudicator took my new bank details as they have changed since using Sunny.
I haven’t heard from Sunny yet either… im just waiting for my 4 weeks to be up and if nothing getting back to my adjudicator, who told me to get back to him if they dont refund ….
For me i just see it as a waiting game.. as i know from responses only from Sunny they take it litterly to the time scale .. so expecting the same…

Just wanted your view on an offer I’ve had from Lending Stream. Between May 2011 and June 2012, I borrowed eight loans from Lending Stream, as follows:
– 150 GBP on 9th May 2011
– 115 GBP on 12th May 2011
– 115 GBP on 13th May 2011
– 200 GBP on 12th October 2011
– 575 GBP on 12th December 2011
– 215 GBP on 17th February 2012
– 445 GBP on 11th May 2012

Lending Stream have said that loans 2 and 3 may have potentially been unaffordable due to the timing and have offered me a refund on the interest of them. Do you think it’s worth taking this to the FOS or not?

What were the gaps between the loans – the time from repaying loan 3 to taking loan 4, repaying loan 4 to taking loan 5 etc?

They ask me today the payslip and the bank statement when my loans were taken out. I had no issue to give to them. I bank with halifax and it was easy to download the statement . I keep all my payslip. They should had asked those documents when they issue my loan for my case.

You can if you want to, but you could ask MyJar to consider your complaint without them. Say that if you complaint goes to the FOS, you will happily suppy it to them.

I do agree with that however as i have them they cannot make excuses. if had to bother my HR or to pay halifax I would not have done it

I get what you’re saying Alex, but I don’t believe for a second that they will even look at the statements or pay slips…. they are simply trying to put the brakes on and trying to make the whole process daunting and time consuming.
If your complaint was about affordability, then I’m fairly certain that they will have known if they were in the wrong the second the complaint was made..

Thanks for your reply Sara. I have chased up P2P/OnStride and they are saying that because I sent the complaint from another email (not the one they had registered) the complaint wasn’t received. So sent it again today. Whilst researching today, I found a loan from PayDayUK which I have submitted a complaint with also, might as well chance it! Also waiting to hear from Black Horse Finance and Capital One.

I’ve had a complicated history with mental health (Bipolar disorder) that got particularly bad in 2015 after a redundancy. Not long after that I fell into the trap of taking out loans, and because of my bipolar I foolishly kept spending and borrowed more. This in turn led to taking out payday loans in 2017 to just “stay afloat” each month.
During 2017-2019, I had six loans from LendingStream, eight from Piggy Bank and five from MyJar, totalling £17,1500 which by the time all have been closed totals £22,405.84, mostly from loans that rolled over several months. On top of this I’ve had bank overdraft fees for almost every month since 2015, which come to £2962.00.
I’ve been lucky to have had much better help with my health lately, and I’ve been working extremely hard to get out of my debt by myself. I feel like I shouldn’t have had the ease of access to borrowing that I did, and been forced to confront my situation properly sooner. I’ve been afraid to try up until now in case of rejection. Is it likely I will have a case for reclaiming charges from the payday lenders bank in this case? It feels so overwhelming to have so many companies to approach at once it’s been making me scared of taking the first steps. Reclaiming anything at this stage would really help be able to overpay my longer term commitments and work towards being free of debt again.
Any advice on what I should do first would be super helpful!

Can I ask what your total debt is at the moment – everything, including overdrafts.
“It feels so overwhelming to have so many companies to approach at once it’s been making me scared of taking the first steps.” well actually you only have three. And sending off the affordability complaints is pretty easy. If you already have a good list of your loans and what you paid to each, you can skip the step one and go straight to Step two. Read the template – it’s actually pretty simple and only one sentence – the I hax x loans from you – is diffeent for each lender, so once you have written one, you can just copy it and make a small change for the next two.
If you still owe a lender money, add a sentence asking for an affordable payment arrangments if you are still struggling at the moment.
I know it feels daunting, but don’t worry that you will “get it wrong”. This isn’t really going to happen! A complaint can be really simple – it is your loans that are the important part and the lenders already know all about those.
If you get a rejection or an offer which don’t think sound good, come back here and chat about it? It’s pretty easy to send a complaint to the ombudsman, but no need to worry about that unless it’s needed.

Based on my report via Credit Karma, my current short term debt stands at £42,222 (though it should be slightly less I think). It breaks down to:
* £1886 on a credit card
* £7708, £14309 and £12402 on long term loans
* £794, £594 and £1193 on finance purchases
* £3336 on bank overdraft
The loan repayments by themselves are about £303, £460 and £350 respectively – so you can see where my salary gets eaten up! :( I’m hoping to get enough back to make a dent in the overdraft and finance agreements so I have less overall credit accounts on file. I’m back in a decent job now netting about £3k pcm so – I hope – if I can get my head above the water I can start doing some serious damage to the remaining balances with overpayments.

Just to follow up (apologies for the delay!) The Shawbrook loan is at an APR of around 11%, so I don’t know if that’s too high or not?
I’ve also just this moment finished a long phone call with Lending Stream, I saw your other post about how they have removed their email address and decided that since that’s a legal requirement FCA + UK/EU law. They refused to admit they were in breach – no surprise. I let them transfer me to the complaints team who addressed me by name before I’d provided this, so I took them to task over accessing my details to some level without me doing security checks first and having not provided my name. He said his colleague had provided my name when being transferred but I know that’s a lie.
They’ve said I’ll get receipt of my complaint in 24-48 hours, and a final response within 56 days. Is it reasonable to complain to the FCA at this point or do I need to humour their long timeframes?

Shawbrook – it’s not a case of what the interest rate is, so much as whether you could manage the repayments. Obviously there is some linkage – a very high interest loan tends to have larger repayments – but focus on how manageable the repayments were when deciding whether to complain to Shawbrook.
You can’t go to the FCA with a complaint, it has to go to the Financial Ombudsman (FOS). You have to give the lender 8 weeks to investigate first.

SNC update, on final day of the 8 weeks:-
1) Redress all the interest that you have paid (£5,925.42), plus statutory 8% interest (£1,131.59). In line with HMRC guidelines we will deduct 20% (£226.32) from your statutory interest and pay this to HMRC, meaning that you will not have to declare this redress in your tax returns.
2) We will then write off any interest on your outstanding balance (£353.37) and deduct your principal outstanding balance (£999.99) from all the interest you have paid.
3) This will allow us to close your account, discharging your liability with SafetyNet Credit, and leaving an amount of £5,830.70 payable directly to you.
4) Any adverse markers in relation to this SafetyNet Credit Account will also be removed

From 12/01/17 – 05/06/18 and borrowed 27 times? Starting at £100 and finishing at £560 each month and sometimes they would take a part payments halfway through the month and then i would have to take it back out on the same day due to having very little funds left in my account?

I have started my refund path, I have rang my old bank to send all of my staitments through so i can start adding up everything so they cant attempt to alter it, i used your template 1 to start it off and QQ sent me a few questions back ” payslips, bank staitments ect” i told them that any information they need will be on there system and anything they think is necessary I will send to the FOB on there behalf, still awaiting a reply off cash generator, hopefully all will go ahead smoothly! Reconsider the bank statements. If they see on the bank statements you were in financial trouble they may settle so you won’t need to go to the FOS, saving 6+ months of delay.

I had my first case picked up by the adjudicator 2 weeks ago, they phoned to introduce themselves and voice it over, then sent an email summarising our conversation.
Can anyone shed some light on how long it normally takes with an adjudicator – as in how long it takes for them to conclude their investigation?

Couple of weeks to two months, sometimes more.
If they decide in your favour there’s no guarantee the payday lender will agree (especially QuickQuid) and they’ll appeal to an Ombudsman. Most do agree so good luck.

Hi could any letters like the ones here be used on banks? I feel the bank didnt do enough checks to ensure i could afford the borrowing which led to overdraft being increased on regular basis and also a few loans being granted?

Bank loans and overdrafts should also be checked for affordability.
For bank loans, there won’t be the same “repeat lending” that makes it easy often to win payday loan affordability complaints, so it’s best to use the letter over on this page for large loans: https://debtcamel.co.uk/refunds-large-high-cost-loans/. You have to show that the bank should have known you cannot afford the monthly loan repayments. If the bank was the one you used for your current account, you may be able to point out they should have known you would be struggling because they could see your bank statements.
For overdrafts, you can argue they should not have kept increasing your credit limit – see letter on this page: https://debtcamel.co.uk/refunds-catalogue-credit-card/.
If it was the same bank you were taking the loans from that was increasing your overdraft, but both of these comoplaints into a single one and say the bank did not act responsibly by giving you so much credit. It can also help if say you were turned down for a loan by the bank which then increased your credit limit.
These cases are harder to win than payday loans, but they are very case dependent. If you know your bank loaned you much more money than you could repay, make that complaint and take it to the Financial Ombudsman if it is rejected.

I put in complaints with the following,
My jar-only one loan for £350- rejected
Lending stream -7 loans within 2 months for various amounts- rejected
Safety net credit- limit of £700 over a 9 month period- rejected
Wageday- 4 loans over 2 months- rejected presuming due to liquidation
Ferratum- 4 loans offered to waive all interest and deduct from my outstanding loan- I accepted this
I am really disappointed with these outcomes as all the loans were within the same time period and I had other loans/credit cards at the same time as the pay day ones just wondering if it’s worth sending any to fos?

I think its worth sending the Lending Stream and Safetynet Credit complaints to FOS. Unless the LS loans were really small, LS should have wondered why you were making so many applications. SNC could see your bank statements, they should have realised their credit was unaffordable.
