What are “unaffordable” loans?
Was a loan affordable just because you repaid it?
No! If paying a loan left you so broke you had to borrow again – from the same lender or a different one – it was unaffordable!
The regulator says:
“the borrower should be able to make the required repayments without undue difficulty, whilst continuing to meet other debt repayment obligations and reasonable regular outgoings.”
That means a payday loan is only affordable if you repaid it on time and you could still manage to pay your other bills and debts.
Payday loans are meant to solve a short-term problem. If you kept repaying one then getting another loan soon after, the lender should have stopped lending to you.
If the loan was small and it was the first loan or second loan from a lender, the lender may not have realised the loan was unaffordable for you. But it was irresponsible lending to just carry on giving you more loans.
Many lenders ignore obvious signs of problems such as your loans increasing in size, or borrowing again soon after repayment.
How much compensation can you get?
You don’t have to calculate this. Just ask for a refund from the lender and see what you are offered. This is simple and it works well.
The Financial Ombudsman has seen tens of thousands of payday loan affordability complaints.
A typical decision by the Ombudsman is that the payday lender should refund all the interest you paid interest after the third, fourth or fifth loan.
But if your first loan was large, or was rolled over several times you could get a refund from just one loan.
Which lenders can you get refunds from?
You can complain to lenders that are still in business, even if they are no longer lending. These include:
Lending Stream, Cash Converters, CashASAP, Drafty, Dot Dot, Fast Loan Uk, Fernovo, Fund Ourselves, Kabayan, LoanPig, Mr Lender, Moneyboat, MyKredit, My Finance Club, QuidMarket, Savvy, The Money Platform, WageMe, Wizzcash,

If the lender has gone into administration, including CashForUNow, Piggybank, Ferratum, Oakam:
- make a claim to the administrators – there is normally a simple form for you to complete, see the lender’s website for details – but there will be a time limit for doing this.
- you may not get much cash back but this is very easy to do. A balance may be reduced or cleared even if there is no cash to distribute. And if you win the complaint any negative marks on your credit record will be removed.
It is probably too late to make claims to other lenders who gave up years ago, see this list.

Do this before, before you send in a complaint
Doing these things now will make your life easier later.
Get a copy of your TransUnion statutory credit report and keep it. After complaints are started, sometimes loans are deleted and you may want the full report if you later have to go to the Ombudsman.
If you still owe money to the lender, read Will an affordability claim hurt my credit record, and other questions. These looks at your options for stopping paying, the effect on your credit record etc.
If the rest of your finances are difficult, look into a Debt Management Plan (DMP) where you make one affordable payment a month to StepChange. This gets you into a safe financial position as these affordability complaints can take a long time to go through at the Ombudsman. Winning a complaint then speeds up the DMP.
Unless you can afford to make this month’s payment without borrowing again, cancel the CPA to the lender at your bank. Otherwise the lender may take the money and you will be in a mess.
If your loan was sold to a debt collector you complain to the original lender. But also tell the debt collector that you are disputing the debt. It is a good idea to carry on making payments to the debt collector if they are affordable.
Start your complaint & get loan details
Find the lender’s email address for complaints from this list.
Put “AFFORDABILITY COMPLAINT” as the subject of your email:
You should never have given me these unaffordable loans. Paying you each month left me with too little money so I had to keep borrowing to get through the next month.
You should have realised from the number of times I borrowed that my debt problems were getting worse. It was not responsible to continue to lend to me. [Add more details eg how often you borrowed or rolled loans if you know them, how the amount borrowed generally went up etc]
[Include/change this if your credit record would have shown big problems:] My credit reports would have shown all my other debts and problems including late payments/defaults /CCJs/debt management.]
I am asking you to refund the interest and any charges I paid, plus statutory interest, and to delete any negative information from my credit record.
[delete this sentence if you know what all your loans were.] I know the difficulties your loans have caused me but I no longer have all the loan details. Please send me a list, showing for each loan when it was taken out, how much interest and charges you added, and what I repaid. This will enable me to assess any refund you offer me.
[delete this sentence if none of your loans were sold.]If a loan was later sold to a debt collector, please inform me of the date of sale and the name of the debt collector.
Some ways to improve this
Add any other points that help you describe what happened to you. You don’t need to list the loans – the lenders knows them.
Some examples:
- “I took out another loan with xxxx to pay you.”
- “Sometimes I borrowed to pay the rent and then had to top-up to get money for food.”
- if you weren’t treated fairly while you were borrowing or when you could not make a payment, add a bit about this.
You can attach bank statements if you like, This is a good idea as these show how unaffordable the loans were for you. If you have gambling showing, this helps your complaint, it doesn’t harm it.
I don’t know if many lenders actually read what you send them. I
it’s easy to make these complaints – you don’t need to calculate what refund you should get or quote laws.
Only one loan?
The template refers to multiple loans because that is what normally happens with payday lenders.
When you only had one loan and it was large, read Refunds from large loans and use the template there.
If you only had one loan and it was small, this is going to be a very difficult complaint to win. If you have borrowed once or twice from 5 leaders, that is much more difficult to win an affordability complaint than having 4 or 5 loans from two lenders.
Waiting for a reply from the lender
This email starts your affordability complaint.
They may send the list of loans first and later respond to your complaint. So don’t be surprised if you get sent info on the loans but nothing about your request for a refund.
When you get your loan information, you can send in more details about your complaint if you want. You don’t have to do this, your complaint has already begun and the lender has to reply.
The lender should reply to your complaint within 8 weeks from when you send the email, not when they acknowledge it. Make a note in your diary for 8 weeks time and chase the lender up if you don’t get a reply.
Don’t be surprised if you have to wait until the end of the 8 weeks to get response – this is common.
Send your bank statements or other information?
Some lenders ask you to send them a copy of your credit record, payslips or bank statements.
Credit record – the lender can check your credit record themselves if they want. But you should download a copy of your credit record asap as the Ombudsman will ask for it. Don’t put this off, the sooner you get a report downloaded, the further back it goes which is good.
Don’t send payslips.
It is a good idea to send bank statements. But think twice about the cost of copying and postage if there are a lot. Some lenders seem to ignore them if you do send them.
Again this is a good point to get those bank statements even if you do not want to send them as they will help an Ombudsman claim a lot. You can get them going back at least 6 years even if the account has been closed.
Lender says No or makes a poor offer
If the lender rejects your complaint or offers you a small amount, don’t be depressed. You may still have a very good case!
It is easy and free to send your case to the Financial Ombudsman where many thousands of people have won their payday loan complaints, despite being rejected by the lender.
Give up?
Some lenders try to make your case sound bad when it isn’t. People have had large amounts refunded after a complete rejection!
Just ignore any of the following comments, they do not mean you have a weak case:
- they relied on your loan applications and you didn’t give accurate facts – see Lender says I lied for more about this;
- you repaid some loans early – this doesn’t prove the loans were affordable, just that you were trying to save interest;
- your borrowing didn’t go up every time – irrelevant, what matters is that you kept borrowing;
- you had a good enough credit score or they didn’t legally have to check your credit record – if you only had one or two small loans that is true. But if the loans were large or you kept borrowing, they should have looked more closely;
- some loans are over 6 years old – the Ombudsman will look at these even if the lender says they won’t!
A good enough case to go to the Ombudsman?
If you don’t know what to do, ask in the comments below this article. Accepting an offer settles your whole complaint – you can’t change your mind later.
Don’t worry that you will lose a small offer by going to the Ombudsman – this doesn’t happen.
Some points to think about:
- if you are offered a refund on only a few loans, don’t accept it if you think the lender should have realised a lot of the other loans were unaffordable;
- an offer to write off your current balance may sound convenient … but it may be very poor if you should get a refund as well;
- if getting defaults or late payments removed from your credit record is important to you, are you happy with what the lender is proposing to do? Don’t assume your credit record will be cleared if the lender didn’t mention this.
One or two loan cases are hard to win at the Ombudsman. It’s probably best to give up on one or two loan cases unless:
- the loan was large. Here is one single loan case that was won even though it was an instalment loan and the borrower had a good income. And another single loan case for a loan of £1,000. You can win cases for smaller amounts if the repayment would have been a large amount of your income; or
- you still owe money.
Don’t delay too long – there is a 6-month time limit after a lender rejects your complaint to send the case to the ombudsman. When you aren’t sure, send the complaint to FOS. This is free and easy to do – let FOS make the decision.
How to send a complaint to FOS
Put in a separate complaint about each lender.
Don’t wait until all your lenders have replied before sending the first one to the Ombudsman!
FOS’s “complain online” option is easy and takes you through your complaint step by step.
You can just copy what you said in your complaint to the lender. You can add more details, for example, if you disagree with what the lender replied to you.
If some of your loans were over 6 years ago, tell the Ombudsman when and how you found out about these complaints. For example:
“I knew the loans were causing me difficulty in 2018, but I thought this was my fault for being bad with money. I didn’t find out that the lender should have checked the loans were affordable until June 2024 when my brother told me about these claims/I saw an advert from a claims company on Facebook/I read an article about these claims” – change this so it is right for your case!
Things to attach:
- the reply you have had from the lender.
- bank statements if you have them. Ideally from 3 months before your first loan until the last loan was repaid or you defaulted on it. This strengthens your case, showing how unaffordable the loans were. You can still get bank statements even if your account is closed – if you don’t have them, start the process of getting them now, don’t wait until FOS asks for them.
- a copy of your TransUnion Statutory credit report
- if you dont have the credit agreements, FOS will get them from the lender.
What happens after you have sent a case to FOS
You will normally be contacted within a couple of weeks and asked for a copy of your credit record and your bank statements if you haven’t sent these. If you have sent these on one complaint, then when you complain about a different lender FOS will use the ones they already have.
After this initial contact, your case will wait for the lender to send FOS your case file and then wait to be picked up by an adjudicator who will make a decision on it.
If you are still making payments to the lender, tell the lender you want to reduce these to an affordable amount. This will make waiting for an Ombudsman decision much less stressful for you.
The Financial Ombudsman has a two-stage process. Most cases are settled by the first “adjudicator” stage but about 10% go to the second “Ombudsman” stage.
A few problem cases
Don’t ask for a refund:
- if you are bankrupt now or have been bankrupt in the past – any refund would go to the Official Receiver.
- if you are in an IVA, as refunds will go to your IVA firm not to you. If your IVA has finished the refund may still be sent to your old IVA firm.
- if you are in a DRO now, getting a refund may mean your DRO is cancelled!

Sara .wanted to post a positive comment.I had 8 loans in total from Satsuma last two of which were on my debt management plan. Satsuma offered interest on first three plus 8 % statutory interest to reduce my balances.I wasn’t happy as they chose the three smallest loans .The adjudicator has today instructed them to return interest on all eight.Im well aware satsuma may challenge this .But As I didn’t know it was even being looked at has made me happy .Just the other four complaints to go two at adjudicators .Just over the year since start .

I finally received my complaint upheld letter from FOS indp Ombudsman on 13th June.. been trying to chase up/SPEAK to someone at QUICK QUID who CAN clarify payment process- but no joy:

Mine went to fos with qq . Qq agreed with adjudicator the adjudicator sent me an email with acceptance letter I signed it and sent a photo of it. I rang qq with my new bank details and they put the money in straight away it wasn’t a big amount around £400

QQ have not upheld any of my loans. I also don’t believe the table they have sent me of loans I have taken out is accurate when comparing it against my bank statements.
I have two complaints with them, the fact that they continued to lend to me but also, I tried to pay off one of my loans early and I cannot tell you how many emails I sent etc that were blatantly ignored by them, I even got on to their live chat and expressed how irresponsible it was that they lend so easily yet it is so difficult to make an additional repayment (yes I could have rang but I don’t use telephone). Even after expressing all of this months have gone by and I have had no acknowledgement from them. Plus guess what…as a problem gambler, those additional funds have now been spent! So I am stil stuck in the cycle when I tried desperately to get it paid off while I had the funds!
Now sending this to the FOS.
Anyone had any luck with QQ actually upholding anything before going to FOS??

At the moment QQ are making some offers directly but a lot of them seem pretty poor.
Most cases involving gambling have to go to FOS – lenders hope you will just give up on these cases.
The table of loans may look wrong because they will be counting top-ups as a single loan, or multiple withdrawals in a flex account as a single loan. but on your bank statement you will see a lot more credits and think they look like new loans.
Good luck with FOS. The argument that you were trying to pay off a loan early and they ignored this is a good one. I assume you have the emails as evidence of this.
I hope you have stopped paying them at the moment? Are you getting help to stop gambling?

Thank you, I love how supportive this site is! Yes I have all the emails and I even print screened the live chat conversations where they admitted they had recieved over 8 contacts from me and failed to respond, said they would respond but never did!
I am stil paying quick quid £50 per month as an affordable arrangement and have £150 left.
Yes I stopped gambling a number of months ago I haven’t had a new pay day loan for about two years, came across this site by complete chance! Already had £136 from ferratum and cashasap jsut offered £25 which I have rejected!
My biggest lender was sunny and had nothing from them. They extended the 8 week deadline by stating it is from when they acknowledged my complaint…which was 4 weeks after I sent my complaint!! Just going to wait it out for the sake of another 4 weeks to see if they come back with a sensible offer

Elle, Sunny are wrong. Time and time again I was told things like ‘you have to wait working days we don’t include weekends’ or ‘it’s from when we acknowledged/picked up your email’ the 8 weeks starts at. This is completely not true. The 8 weeks starts from when you send the email, the FOS has clarified this to me many times. If they’ve gone past the 8 weeks starting from your email, submit it to the FOS now. Even if they do reply with a great offer, which they probably won’t, at least you’ve already submitted it and it’s in the queue. Good luck!

If you’ve put a complaint in then you are basically querying the balance. This doesn’t affect your credit score.

QQ have made me an offer of £2500, decided against FOS, its a nice amount for me and will really help so I have settled.

How much did you lose out on with QQ?
In my experience Payday UK settle the full amount within three months. Payday Express refused to negotiate, that’s been with the FOS waiting for an adjudicator.

Have received some offers today from Peachy Bamboo & Mr Lender and they are all trying to sneak an offer in with no interest. I have gone back and asked for interest to settle bar one as it was only for 1 loan.

Hi MR, I thought it was a reasonable offer. I had 48 loans with them over 3 years, a lot of which were smallish amounts but were month after month (sometimes 2 or 3 in a month). They offered to pay out on 30 of the loans + interest (comes to a little over £3K). Sunny rejected my claim to start with (that was in October 2018), so I sent it to the FOS. The offer was only made when the adjudicator picked up the case for review and contacted me to say he had the offer. One of the reasons I also accepted the offer is that I have had a few complaints rejected by the Ombudsman, even though an adjudicator upheld my complaint initially so didn’t want to risk that happening again.

I am now past the 8 week period with regards to Sunny, Cash4uNow and Speedy Cash.
I have sent emails to them all over the weekend just gone but so far NONE have replied.
MyJar rejected my complaint. That has been escalated to the FOS. Uncle Buck and Moneyboat have also rejected my complaints. Both were one loan companies so trying to work out what to do there.
With regards to my SafetyNetCredit success, after sending an acceptance email on the morning I received the offer I got a reply a few days later to say I should have the money by close on play on the 21/6/19. Obviously that is tomorrow so fingers crossed for the money by then.

I had my sunny complaint picked up by the same adjudicator who granted my LS complaint in my favour recently this week, she confirmed she had received what she needed from sunny but today has emailed to say that do the nature of the type of lending she has to pass this on to a “special” team to be picked up…. anyone had a similar experience?

I called them today to ask about when it’s likley to be picked up. The chap there I spoke to (William) explained a little more about it…. he said that the first of my 30 loans with them was more of a credit / draw down facility and that this type of lending is not designed for long term… so reading between the lines emphasised more that it’s irresponsible… so I’m feeling hopeful. He said that sunny also supplied some more information on Friday…
He said that worse case would be resolved within 3 months but hopefully will be picked up in a few weeks….
This is a case of sit tight and will pay off (hopefully)

Well THL are the fastest to reply (6 wk 4 days ) with my ongoing complaints with payday loans THL was the ones I had the smallest amounts with, they have rejected my complaints as all amounts where paid on time even early as well as there being big gaps.

Double SUCCESS!! Money Shop also responded at the ten week point, further info required for period Aug 10 to Jan 12 re 3 loans but upheld on all 8 loans from Dec 11 on, interest £3975.21, 8% £2051.88 less tax total £5616.71.
Thats just shy of £12,000 in one afternoon!!!!!!!!!!!!!!!! Ive already had £800 from SafeLoans, £600 from Peachy and £360 from Mr Lender. MyJar gone to FOS as wont look at pre April 2014 as has Cash Converters (20 odd loans over 28 months not irresponsible!!) and waiting on Payday Express, H & T, Cash Generator, Quick Quid, Albermarle and Bond, EPDL, WDA and Wonga.
How the eck did I pay that much??????????????? Just can not believe the amount………..

I had decisions from the FOS yesterday against Money Shop, Payday Express and Payday UK. All 3 decisions uphold my complaint and give the companies until 2nd July to reply. Most loans over 6 years. Anyone have any indication of whether or not they are likely to respond by 2nd July?

I had a letter sent to Payday Express on 17th May by FOS she gave them till 31st May to respond but still no reply. Spoke to the FOS she said they give them an extra 2 weeks before they chase them due to the large number of complaints they are getting. The FOS also sent a letter to PDUK for me yesterday they have been given to 3rd July

I have just had a phone call with uncle buck regarding my final response, I was asked if the expenditure information I gave was accurate to which I replied no as I needed the money and explained they could have asked for bank statements etc.. so I said I’ll send it to the FOS. To which I was threatened with a fraud accusation and they said we have the recording of you admitting it and we will send that to the FOS to?

Uncle Buck do seem to be quite unpleasant in their dealings with people. In their response to my complaint they said it was frivolous and vexatious and made some comments about it looking like it had come from a template (despite their response being clearly based on a template). They also said that if I referred my complaint to the FOS they would be asking to have sight of my bank statements and would be asking me to explain any discrepancies.
If you look on the FOS decisions website they seem to be quite forbearing towards people where the declard income/expenses hasn’t been completely accurate. There are lots of them with comments like “lender should have questioned the impluasibly low figures” or “lender hould have noticed that declard outgoings varied significantly from month to month”

I’m waiting to hear back from quickquid and sunny for a affordability complaint. I sent in the complaint over 6 weeks ago…I know they have two weeks left but does the fact they are being slow mean I’m likely for a repayment?
My second question is does the amount have to be higher then month borrowed before to be affordability vase?…basically Aug last year to March this year I got 22 loans with sunny…I always paid them back straight away but would end up borrowing again later that month.

Hearing in the 8th week isn’t slow, it is average. No one has looked at your complaint yet, it says nothing about how likely you are to get a refund.
The amount going up helps your case if you only had a few loans – 200,300 600 is a stronger case than 300,300,300. But 22 loans in 8 months is a lot, whatever size they were! Mind you, Sunny will probably decline – expect to have to send that to FOS>

I would like to give a update on my complaint
To payday uk I first made my complaint on the 28th of June 2018 I had 12 loans from 17/10/08 till the 24th of October 2012 had 37 rollovers in total in that time they rejected my complaint on the 6 year rule sent to Fos adjudicator picked up December 2018 had a response middle of January payday uk offered £850 on last loan and wouldn’t look at the rest because they were older then 6yrs I rejected offer sent to specialists team at the end of January rang Fos in April for update was told they can look at loans over 6yrs and was awaiting for a adjudicator to pick it up.
Had a phone call from the adjudicator Tuesday just gone upholding loans 3 to 12 and last rollover on loan 2 payday uk have until 3rd of July

I have now received a response from LS for all my 9 loans i had with them, the issue is that they are stating the performed credit checks on all and even though i missed some items off my expenditure i had other payday loans and a gambling problem at the time, they have not provided the breakdown of interest. can i go back to them and request they send me the credit checks they undertaken at the time as this would show i had a CCJ and multiple payday loans?

There isn’t any point in going back to them, they don’t negotiate. Send the case to the Ombudsman, that is a lot of borrowing.

That’s identical wording to mine so it seems to be a generic rejection they just paste loan details into. They also made the following non specific comments on mine:
· A credit worthiness check was completed and the third party credit reference agency confirmed a rating which was satisfactory for the loan obligation
· We also checked via a third party source his other credit obligations at the time of his loan approval and these similarly met all reasonable affordability criteria
I had 15 loans with them, at one point with 6 loans open at once. My case has been assigned an adjudicator and I’m waiting for their decison.

This happened from 2014 to 2015 and I have no payslips or bank statements because I have changed jobs and my bank. Any advice?

You can still get bank statements from closed accounts. I suggest you start doing this now as the statements will be needed if your case has to go to the Financial Ombudsman, which many Myjar cases have to.
Tell Myjar you will provide any further information to the Ombudsman.

I have complained to several PayDay Lenders which I have outstanding balances and and arrangements to pay smaller monthly amounts, regarding irresponsible lending.
I have asked for interest plus 8% simple interest to be calculated and offset against the balances to clear these.
Peachy have come back and said the want bank statements and payslips and have advised my account is on hold for 60 days while they investigate but if I do not pay the monthly installment it will have an adverse effect on my credit rating.
My question is, do I need to provide bank statements etc and am I required to pay while it’s being investigated?

You don’t have to provide bank statements to a lender – if you do it may be more likely your complaint will be upheld. You will have to provide these statements to the Financial Ombudsman. You don’t have to provide payslips.
You should not pay the monthly instalments if that would leave you so short of money that you have to borrow again – that is the point of making these complaints, to get out of the payday loan trap. You could ask to make a lower affordable payment.
If you win your complaint, any negative marks on your credit record will be deleted.

Mr Lender update:-
Complaint lodged on the 1st of May.
They called yesterday to ask what I saw as a fair settlement so I said that I would like all interest repaid from the loan 6 where it jumped up in value from £600 area to £1000+ area, and where it plataued at this amount until loan 11, and removal of negative entry on my credit report. They said they would call back today.
They called back this morning and offered me Loan 8 to 11, write off my existing balance, and remove negative entry from my credit report.
So £1600 remaining balance is gone and £2200 refund. I have accepted as am more interested in the remaining balance and the negative credit report where they are concerened due to it still being so large, so with that in the bag I saw no further need to go to the FOS. And in fairness to them that was an easy one to deal with.

Really chuffed, I followed advise on here and actually got a refund from Quick Quid for my loans in 2016
One thing I’m confused about (and Quick Quid haven’t answered me) is any idea why my money came as 3 separate payments?
I assumed this was because they must have refunded 3 different loans, but this is not the case I had 5 loans refunded.
Would anyone have an answer to this?

Hi Sara,
I wrote on this page a couple of months back regarding a complaint against WAGE ME, I had taken out many loans (over 80 I think), over a 5 year period and have paid them almost £6000 in interest.
I wrote to them complaining on 24th April and received an email back stating that they had received my complaint and I was in a queue to be investigated. It stated that they would reply within an 8 week period.
Anyway, the 8 weeks was up on Weds 19th June. I have heard nothing. So I sent them an email, asking for an update on my complaint. Still no reply as of today, which is unusual as they always did reply right away, when I was taking loans out, and also to my initial complaint.
Can you advise what my next steps should be? Should I go straight to the FOS? Am I allowed to do this, without a final offer from them? I have given them 8 weeks to reply and heard nothing so I am starting to worry now.
Would appreciate any advice you can offer.

There all busy and an extra 8 week wait isn’t unusual. The FOS complaint will eventually need a Final Response letter, you can get the complaint rolling now and add the FR when it comes or wait for the FR and send it or cancel the complaint if they make a good offer.
Some firms stop dialogue if they discover you’ve complained to the FOS.
It’s up to you, really.

I feel very very lucky having just read that the Money Shop is closing store!
I’ve just had my 2nd pay out following request for bank details.
In total I’ve got back £10,292.42 for 46 loans that were taken out from 2010. Complaint was also outside the 6 year cut off but they still paid out!

Just had a final response from 247 moneybox, apparently 67 loans and £30000 borrowing is considered as responsible lending.
In the time I had loans with them I was in a debt management plan and also had multiple payday loans as well as a lot of defaults on my credit file from different companies.
Will now send this to FOS. All failures for me so far, give up with process you send a complaint, get no reply for 8 weeks and then it’s negative response.

Have you sent a copy of your credit file to them showing the defaults and dmp?
They are a hard company to deal with and don’t reply to emails – I had to send email after emails untill they reply.
They didn’t uphold all my loans then I sent them some information showing defaults and they upheld the majority.
Don’t give up, It’s a painful process but in the long run it will be worth it.

They like to ask what you would see as a fair end to the scenario, so I sent them a screen shot of their own website where they boldy claim “short term lender” and then re-attached the statement they I had sent me where they have given 33 consecutive loans (I.E. just shy of 3 years), yielding £6000 in interest.
Gone quiet. Next Friday is their 8 week marker so shall look forward to their justification of “Short Term Lending”

Sunny have replied to me and they have rejected my complaint.
I had 14 loans with them in under a 2 year period with multiple loans on the go at once. I have 3 with outstanding balances totally around £800 that are being laid via my DMP.
Over the loan period I’ve paid back over £7000. They say all checks were done correctly, but as a gesture of good will they will clear the 3 outstanding loans.
Is that worth taking to FOS? I was hoping for a more positive result here.

definitely – that sounds like a very poor offer on a good case! Sunny at the moment are rejecting some very strong cases because they don’t fit certain characteristics they insist on even though this is not what the ombudsman does.

Some good news, just in time for the weekend, about my MYJAR complaint. The adjudicator called me, on Tuesday, to advise that he was in a position to look in to my complaint (email sent, originally, to the FOS on 22/05/19. Today (only 3 days later) he has contacted me again to advise that he has now considered my complaint, Out of 18 loans, MYJAR only offered to uphold loans 9-12. Today, he has advised me that he has upheld loans 5-18, which is an incredible result and I was so glad I didn’t cave in to their ridiculous first offer. It’s just a waiting game now, to see if they agree (or not) with his findings.

I had the same, where they disagreed. Sent it to the FOS back in November and they came back in April this year and said that the FOS were upholding my complaint and asking 247 to sort it out with redress. They have agreed to refund me all of the interest owed, and wipe the remainder of the balance off. Total of over£6k they have to pay out to me in total.
They are a nightmare to deal with though – when you eventually get through to their customer service line, they have a set of rehearsed responses when you ask to speak with anyone outside of the team they are working in – i.e. redress, a line manager etc. The only way you can get them to answer, is to email them, which they boldly ignore.
I accepted my offer of payment from them on Monday 10th June, so they have until the 8th July to pay before the FOS will do anything more. I’ll keep you up to date with it.

I actually found them one of the easiest, they upheld loans 8-33 and to be fair Loans 1-8 were so small it was pointless to argue, they agreed to refund all interest and clear my outstanding balance and have 8%. Processed and completed in less then ten working days. I had somebody could Abel look at my complaint, wonder if it’s different people.

Got my Next credit loan written off today, I had only one loan with them and they rejected my case, I went back to them with more evidence and they wrote it off, which ive accepted as it was small and a single loan.
Still got complaints in with almost all of the other PD Loan lenders, so ill update you all on my progress!

Can anyone help? My claim went to the FOS and an adjudicator looked at the claim and has agreed that Quickquid and Pay Day Express should refund 7 out of 10 loans and they had until the 15th May to look at this. We are still waiting and when we email the FOS she states ‘At the moment we are currently liaising with CashEuroNet in regards to our views. Therefore I have not yet got an answer to give you at this present moment’
How long does this go on for? Any advice

Breakdown of a complaint.
September 2018. Used the template on here an sent it to Harvey & Thompson.
October. Received response from H&T. Acknowledged they were at fault with irresponsible lending, offering £1k, they refused to look at the 6+ year loans. I responded with bank statements, explained my situation at the time asking them to reconsider the 6+ year loans. They refused.
November. Complained to FOS about H&T.
December. FOS responded, acknowledging my complaint and asked for more information. I sent bank statements, account history and an a covering email explaining my situation at the time.
April. Phone call from an FOS adjudicator, taking on my case.
June. Emailed adjudicator asking for update. Responded two days later finding in my favour, giving H&T two weeks to respond. H&T responsed four days later, accepting decision and asked for bank details. Received £5k today.

Taking H&T to the FOS was an easy decision. They’re on the High Street, doing well, so unlikely to fold. Kind of surprised they didn’t hold out and appeal to an Ombudsman, they were adamant in their responses about the 6+ loans.
So: don’t settle with H&T, take them to the FOS for the full amount.

Start them all off, no reason to delay or go after “the easiest” first – what is is easy or difficult for someone else may not be the same for you! Also the difficult ones take longer so the sooner they are started the better.
One loan cases against Myjar and Mr Lender are only worth pursuing if either the loans was large or you still owe a balance,

I sent a complaint to lending stream on 27/04 and other lenders and got my response yesterday and it was a very long dragged out email, I have thirty three loans with them from 2014 to 2017, all loans were paid in full eventually but I did run into financially difficulty in the last year or so due to companies like lending stream along with many others. I have paid all monies back and they have basically said that all my loans bar one were affordable and they carried out the necessary checks and offered me £35.00 back which I thought was an insult, to have struggled for years and I know it’s myself a who got me in the mess I did but if they responsibly lend to me I probably wouldn’t have struggle for years. I have raised a case with FOS do you think this is the right thing to do for my next step?

I have had my first case picked up by an adjudicator at fos, this ones with lending stream.
In total 6 cases settled with the lender, 7 referred to fos.
My question is – every loan history I’ve settled before fos, I’ve managed to get the lenders to agree to delete all record of the loans from my report, as they’d concluded they were unaffordable.
When successful with fos, I believe they describe that negative history should be deleted. For me any record of the loan is negative though as having one would stop you being able to get a mortgage etc. Is it possible at fos level to get the lender to delete all record of the loans? It’s really important to me

Some lenders just delete all the loans whatever FOS says.
If the payday loan was more than a year ago and has no negative marks, you should still be able to get a mortgage.

Hi just. A quick question about lendingstream, do they ever agree with decisions? Or do the reject all like qq & p2p?
I had 7 loans and the adjudicator has ruled that 3 was unaffordable , I’ve paid around £650 in interest in total, the interest on the theee is just over £300, what do you think the chances of Lending’stream accepting the decision and not rejecting it to send to the ombudsman.

In July 2018, I stumbled on this website. I was in circa £17000 in debt and was in a Debt Management Plan. I am happy to say that as of June 2019, I have completed my DMP thanks to Sara and this amazing website. Sara, you are changing people’s lives and I am so thankful – this time last year, I was in despair. I will post about the outcomes of all my loans with the FOS in a few weeks time as there are a few things that I want to comment on in regards to my cases.

If the adjudicator has upheld it then they’ll probably agree. I guess it depends on how many over how long etc.. but again if the adjudicator has made the decision then it should be fine.
LS agreed with adjudicator for me, 13 days into the 28 day to pay refund. Hopefully should come through soon!

Hi all,
Just sent off my LS complaint to FOS as they did not uphold. Had 13loans in less than a year from them which they deemed to be responsible lending! Had countless other loans, a default and missed payments on credit file but they deem that to be ok to lend.
Hopefully will have a positive outcome – have also referred QQ, Onstride, Avant and Pounds to Pocket to FOS.
As yet awaiting responses from MyJar, Safety Net, 118, Vanquis , Satsuma and Uncle Buck.
Mr Lender agreed to remove all interest from account – considering I only had 1 loan of £200 though it was worthwhile instead of referring to FOS.
This site is a god send and am grateful to know that I am not alone in being caught amongst the spiral that is Payday and unaffordable lending!

I had about 15 loans with Lending Stream, and at one point I had 6 open at once with the monthly repayment being £500-£600. All apparently affordable as they rejected the complaint – the FOS have just assigned at adjudicator so I’m waiting to hear their findings.

I have just been assigned an adjudicator for my QQ claim. Sent the complaint to the FOS on 03rd June and had the email saying they are looking into my case on the 21st June. (18 days).
I submitted 2 others to the FOS on the same date but nothing from those yet. My Jar & Sunny.
I take it they review claims case by case and not by person. Can I be assigned different adjudicators for each claim?

I submitted complaints to Lending Stream and Sunny which were rejected so went to FOS in Dec 18. They then requested additional info which I sent in Jan 19. I received some holding letters a couple of months ago and have not heard anything since. I was just wondering what the timescales are at the moment, I know they were long but just thought I would ask out of interest, I am no real rush. I know some people have telephones to get updates, is this worth doing or is it just best to wait?

I gave recieved a final answer from zippa. They believe that all their loans 7 in total were affordable. Started off first one was for 150 as was the second before the last 5 were 250 pounds each. Once again these were all taken out just after one was paid off and it continued.
They believe that as some requests by me were for around 500 pound and they only offered me 250 that this was deemed responsible.
Do you think going to the ombudsmen I’ll have a chance or would you suggest that zippa may well be correct in their findings?
This was 7 loans between March 17 and January 18

Definitely worth asking the Ombudsman to look at 7 continuous loans.

That’s quick! How old are your loans? It is standard practice for the adjudicators to look on a case by case basis, but sometimes people have let their adjudicator know that they have a few more cases open and they’ll end up looking into those as well, but it doesn’t happen very often.
I tried my luck last week, but they said it wasn’t possible,but it’s worth a try!

Hard to know how the FOS are allocating cases. What is being prioritised etc.

Mine were all picked up by different adjudicators. I let them know about the other cases I had open and they said they would use the same bank statements and credit reports for them all.

I’ve had of express settle on 3 loans last year and they were unable to determine 3 more, just started the process on the 3 others and sent bank statements. They made an offer on one of 3 but rejected the other 2.
I don’t want to get caught up on this rumour so I ask- has anyone had a recent quick turn around from logging with the FOS? Has it quickly got to a case handler or adjudicator?
If it’s a huge wait I will take the 400 at risk of losing it, if it’s a quick turn around then may wait a few weeks for the other 1400

Unless you really want the cash, I would wait. You’re in for a few months wait, but it’s worth it for the amount you’re talking about. Then again, if you’re happy, take it now.

I made a few complaints with the FOS in late march/early april and got adjudicators assigned at the beginning of June. I’ve just had a decision on one (which was a single loan case), and I’m still waiting for the others. When I initially spoke to one of the adjudicators she said she can’t give a timescale as it all depends on how long it takes the lender to respond and provide information.
It really depends on what you might need the money for and when. I accepted a couple of relatively poor offers so I could put a bit aside for emergencies and pay a few other loans off to reduce my outgoings. That got me into a sustainable position I was happy with so I sent the others to the FOS to try and get back the maxium.

Just had my payday express upheld by fos how quick are they to pay out said Up to 28 days? Been along journey over 12 months still got 2 out of 8 to go

The FOC are said loan 4 to 25 should not have been given by Sunny. I had 25 loans in 9/10 months, the FOS showed that in one month i had 6 .
Hopefully they will do as the FOS has said.
I did try myself before FOS and was turned down.

Good news claim settled in full… sadly won’t gdt me out the situation im currently in… but it will help me and my family.
They have now 28 days to pay me…

Hi can I have advise pls mr lender I had 7 loans in total
Loan 1 = 30-01-16 £500 till 27-05-16
Loan 2 = 27-05-16 £500 till 25-11-16
Loan 3 = 26-11-16 £750 till 23-06-17
Loan 4 = 26-06-17 £800 till 09-11-17
Loan 5 = 27 -11-17 £1000 till 28-04-18
Loan 6 = 19-05-18 £300 till 29-08-18
Loan 7 = 11-09-18 £1000 on payment plan paid in total £1400 they have refused all Loans any help or advise would be great all paid on time but had 6 other lenders from loan 3

So you had nearly continous lending – never a whole month gap – and amountonly going down once.
You can go back to Mr L – they do listen to a reasoned argumanet and an offer of a compromise.
So the question is what to suggest. I think as a minimum you should be asking to get loans 4,5 and 7 refunded. Loan 6 was pretty small. loan 3 it’s possible you might get upheld if you go to FOS, espeecially if you had other payday lenders when you applied for that one, but possibly not.

Thanks Sara i thought this too I was a bit surprised they never upheld any, Shall I send bank statements and my credit file over as well cos they did ask for them. Have not said it’s there final decision and said I’d send in these documents they will look at them again. On my last loan I’ve still a balance of £548 they say they will write it of as a gesture of good will. I’m prepared to Go fos as 3 other loans I had at same time was for large amounts over £1000.
