Varden Nuttall, a mid-size Individual Voluntary Arrangement (IVA) firm, was placed into administration on 24 March 2016.
The administrators discovered that £9million was missing from the client account and evidence of fraudulent practices by Philip Nuttall, one of the insolvency practitioners and a director of Varden Nuttall Limited,
In October 2018, Philip Nuttall was found to be in dishonest breach of his duties as former supervisor of the IVAs in the High Court. The judge concluded that Mr Nuttall:
acted dishonestly as supervisor by enhancing the fees obtained from the insolvency cases in entering into secret commission agreements with third party services providers, and that he was also negligent in respect of his financial management of the Company and its affairs.
David Clements from Harrisons Business Recovery and Insolvency said:
What is particularly saddening about this case is that vulnerable individuals, who were facing difficult debt management situations, turned to Varden Nuttall for help and advice. They trusted that these professionals, would help and manage their situation. Instead they have found themselves caught up in a situation not of their making. The actions of Mr Nuttall have quite simply been a betrayal of the trust that they have shown and this is before any consideration is given to the vast amount of monies that have been dishonestly extracted from the IVA cases and, in turn, lost by the creditors in the IVAs as a result of the dishonest schemes and arrangements that have been entered into by, or upon the instruction of, Mr Nuttall.
In July 2019, the Insolvency Service barred Nuttall for 9 years and Varden for 7 years from acting as a director saying:
Philip Nuttall and Darren Varden abused the trust of their clients, people suffering with debt problems, by failing to adequately oversee the company’s financial transactions. That alone would have justified their disqualifications in this case but they compounded the issue when they used a convoluted trust scheme to repay loans that would otherwise have been assets in the administration.
The rest of this article shows how the story developed.
Varden Nuttall were the twelfth largest in the 2015 IVA League Table when they took on 765 new IVAs. From the Statement of Administrator’s Proposals on 3rd June 2016, the firm has about 2,500 IVA customers. They also had about 300 Trust Deeds (a Scottish form of insolvency) and few bankruptcy cases. The Administrators consider that it will not be possible to rescue the company as a going concern “given the extent of operational issues and the insolvent financial position.”
An unusual situation
Insolvency Practitioners are supposed to be good at handling money! I don’t remember the last time an IVA firm went into administration.
When I heard about the administration I assumed that most or all of their IVA clients would be transferred to a different IVA firm, probably quite quickly. This would mean the administrators didn’t have to deal with thousands of clients and “selling the book” to a different firm would also raise some cash.
This hasn’t happened. The Administrator’s Statement says that “the company has no tangible assets other than the portfolio of personal insolvency cases which the Administrators currently envisage trading to a conclusion rather than marketing it for sale on the basis that this is in the best interests of creditors as a whole.”
There are a lot of rumours about why the book of clients hasn’t been sold, some of them contradictory. I thought it would be worth looking at what is happening, and to suggest some questions which people with Varden Nuttall IVAs may want to ask.
But first let’s look at how IVA clients should be protected against problems at their IVA firm.
Insolvency Practitioner Bond
Every Insolvency Practitioner (IP) has to have insurance against any misuse of client money which is usually referred to as a Bond, see this Insolvency Service description:
“An insolvency practitioner is not qualified to act in relation to a company or individual unless there is in force security (a bond).”
The Bond covers the estimated value of assets to be received in the IVA and the value has to be kept up to date. Each month an IP creates a schedule of new IVAs and any significant new assets that are expected to be realised (if for example you inherited some money which has to be paid into your IVA, or if a PPI refund is being paid) and sends this schedule, called a “Bordereau”, to the insurance company. If you look at the details of your IVA’s fees, you are likely to see a reference to insurance or bond or bordereau costs.
If there was some sort of fraud which resulted in client money going missing, the Insolvency Service says:
“The beneficiary of the bond is the insolvency practitioner’s authorising body on behalf of the creditors of the defrauded estate. In practice the authorising body generally assigns the benefit of the bond to another insolvency practitioner who is appointed office-holder in place of the practitioner whose bond is the subject of a claim and pursues a claim against the bond on behalf of creditors.”
So the insurance should pay out, replacing the missing money, the creditors get the correct amount and there are no problems for the IVA clients.
Change of IP
On 10th May 2016, Phil Nuttall was removed as the IP for all Varden Nuttall IVA cases, see The Gazette entry.
UPDATE on February 1st 2017 the Insolvency Service announced Phil Nuttall’s IP licence had been removed. The report mentions that £6 million is missing. There has been no indication that this will cause any problems (apart from delays) for people with Varden Nuttall IVAs.
The newly appointed IPs are from the two firms appointed as administrators. This suggests to me that the administrators aren’t expecting to sell the client book to another IVA firm very soon.
Administrator tries to close some IVAs
It is likely that Varden Nuttall has several hundred people who have made their last IVA payment and are waiting for their completion certificate.
The administrators are trying to close some of the cases where the client has made the last payment. The administrators asked the High Court on the 18th May to determine that where a client has complied with the terms of their IVA and made all the relevant payments, a completion certificate could be issued. But the judge wanted the creditors to have been given notice of the hearing and have the chance to put their views forward:
“The main thrust of his concerns was based on bringing the IVAs to an end which might have adverse consequences for the creditors who are still to be paid and may wish to keep them open.”
A new hearing was then held on 8th July. The following was added to the Varden Nuttall Website on 18th August:
As regards the issuing of completion certificates the Joint Supervisors are pleased to advise that at the hearing before HHJ Pelling on 5th August 2016 we obtained the necessary Order to be able to start to issue customers with completion certificates. Work has started in this regard and we have a tight and strict process to follow in order to make sure the completion certificates are issued correctly and in the correct circumstances. Telephone calls to the office requesting an update will only serve to distract staff from completing the actual task of preparing the certificates, as a result, we ask that customers please bear with us whilst we undertake this exercise. We will post updates as and when we have progress to report.
So basically “please go away and let us get on with the work because it’s fiddly” … If you have a specific and urgent need for your completion certificate or for the restriction on your house to be removed, I suggest you ignore this and phone up and explain your situation.
UPDATE July 2017 The administrators say that all completion certificates and reports have now been issued to those IVA cases who were waiting to complete.
If your Varden Nuttall IVA is still continuing
If your IVA is still underway, you may want to ask the following questions:
- have any of the payments I made to my IVA already been distributed to my creditors?
- is the rest of the money I have paid, less any allowable fees, correctly sitting in a client money bank account?
- how many of my PPI reclaims have been paid to Varden Nuttall? Have they already been distributed to my creditors, if not are they correctly sitting in a client money bank account?
You should carry on making the normal payments and contact Varden Nuttall if you are having difficulty, are concerned about equity release etc. I hope this would be “business as normal” for most situations, although I suspect any requests for variations such as a final settlement offer will take longer than usual to get agreed.

I had a final settlement agreed with my creditors in January, I’ve since found out via the Internet my Iva firm Varden Nuttall have gone into administration. I have been in touch with them several times since completing to be fobbed off by advisors that seem to know nothing about what they’re doing. Can anyone shed some light on how long it could take to get my certificate please?

Hi, we made the final payment of our six year IVA in November 2015, and were told that our completion certificate would be with us in January. Varden Nuttall stalled and fobbed us off every time we chased it up until we were informed that they had gone into administration. They still won’t give us any information and are bordering on rude when I ask them why my questions are unanswered. Can you suggest how I can get more information out of them when they refuse to answer my questions. Sorry if I sound angry, and thanks in advance for any help you might be able to give me at this time

angry is understandable, in my experience people are more understanding and patient if someone takes the trouble to speak to them personally and explain what is happening… I think you should try asking the questions listed in this post. Thank you, we will just have to pay it i think, it just seems every timeits near the end VN finda reason to add a year, i dont want to pay it for a year…another annual review and slammed with another year taking us into 8 years, we could possibly remortgage as never defaulted but will the Iva then want some of that? Its a vicious circle

Hi I paid my last payment in January 2016 to Varden was told it will take 3 months for certificate to arrive I rang up to be told the company had gone into adminstration and I’d have to wait, I read that the court date is 8th July how long would I have to wait after the 8th, I can’t remortgage until I have the certificate, and feel I was lied to angry that they have been able to get away with it

We made our last Trust Deed installment in May 2014 and as yet, still have not received our completion certificate. We have a letter which states that we have met all of our requirements of the TD, but I’m not sure this is the same as our completion certificate as they were still waiting on some PPI returns?
Would a financial advisor be advisable at this stage to guide us through the last of this process?
We have pressurised Varden Nuttall into completing everyone over the last 2 years, however it has been extremely frustrating with our case being passed from pillar to post, not returning calls, not responding to letters or emails. We started this 3 year process in 2011, 5 years later we are still trying to finish it off. Frustration!

I have recently finished my IVA with Varden Nuttal , and like everyone else awaiting my completion certificate . My mortgaged property was part of the IVA , but in the 66th month was valued by vardens and was reported to be in negative equity , so was removed from the IVA . ( I Have a letter confirming this ) I have been informed that the restrictions at the land requested have now been removed . I just want to move on and sell the property as it carries a large mortgage . Is it safe to do this as I have not received my completion certificate ?. Many thanks in advance for any help and advice .

I competed my IVA in 2012, but because of PPI issues didn’t get my completion certificate until Aug 2014. I am now trying to obtain a re mortgage and to my horror have found out that the property restriction was still on my deeds. So far Nutall have done nothing to remove it and I I have an upset solicitor

I have looked at the Insolvency Service Register and I am not on it anymore. When I found out about the restriction still being on I contacted Nuttalls only to be told that there was no excuse why it was still on but they would look into it. A short while later I was called back and the woman explained about Nuttalls being taken over, Phillip Nutall no longer worked there and she would need to speak with the administrators to try & get it sorted. She asked that I give it a couple of weeks before contacting them again, which I will be doing this week

We made our last payment into our IVA in May 2015.
We where promised our completion certificate by November 2015 but this has still yet to arrive.
We have paid 100% of the debt owing due to us having a lot of miss sold PPI and even received a refund of £12k direct to ourselves due to us overpaying!
Despite this obviously meaning we owe nothing our attempts to get the final completion certificate keep being fobbed off and delayed.
I understand we now have to wait until the court gets around to issuing our certificate and have been told verbally ‘it should be a formality as our case is complete’ …. However until we actually receive the certificate and are officially clear we find it hard to believe anything that’s been told us. It concerns us that we still could be somehow accountable despite paying all dues?

Oh my…. I have just stumbled across this forum.

Had my iva since Aug 2010 nothing but trouble.
I’m desperate to re mortgage. I finished and confirmed in March this year.
I paid 200 a month without fail.
Debt was 24k I had 12k in ppi to add.
I couldn’t afford to pay from December 2015 due to adoption leave. And would resume when back at work but when it came to it I went back part time.
In the end I asked them to write to creditors and ask if they would except what I had. This took 8 months but accepted.
There’s just something not rite about them. Had the equity clause but when it came to it said we was negative equity which wasn’t correct.
That was the final nail for me, and some company they use wanting me to take an 8k loan to pay them off. So glad I didn’t now. Went to see a solicitor and they recommended asking to settle with what they had. If I hadn’t Christ knows where I would be now.
Awaiting certificate now like the rest.
Not even the courtesy of informing me of the administration I was only told when called on the off chance to ask when my certificate would be here.
The lady who got the 12k refund. Was that the whole original debt u paid or half?

We where in for six years having been told the term was 5 with an option to go to 6 if we couldn’t re mortgage which we couldn’t.
As we had a lot of Ppi it cleared 100% of the debt so we got the rest back.
I guess in that respect we’ve been very fortunate.
This was a life saver as I’m self employed and needed to replace my van. I tried Leasing but no one would touch me despite being out of the Iva some 15 months now.
Still awaiting our certificate as you are.
We don’t understand what the hold up is especially as we’ve no more to pay.

Well if you’ve been on the website it had an update from 15th August I think.
And they now have authority to release the certificates.
I received the same update in a letter today.
Stating the more you call to chase it up the more your distracting the staff from doing the completions. I’m just happy it’s getting sorted.
My iva 6 year mark was 24th August (yesterday)
2 defaults have already come off dated 16th a few where 31st which no point chasing up now .
I had to complain to lloyds last week as 3 where dated to come of June next year.
They said they would remove them all but could take 8weeks. And got £75 for my trouble.
Lloyds/tsb were the only creditors I had trouble with, constantly ringing for 8 months after the iva. But vn and lloyds just blamed each other.

Their excuse was at first that the paying of money out to creditors takes time and that we’d have our certificate around September 2015.
Then the excuse was they’re busy and there’s a back log.
Last call I made ( about 4 weeks ago ) they told me about the administration and they’d know more next month.
However….
Yesterday we got a letter basically saying the same as the message on the web site.
Don’t phone us as this only takes staff away from the task of issuing certificates.
This implies certificates are being issued but frankly I smell a rat.
I’m considering taking legal advice.
If the money we all paid included an insurance to cover us from VD going into administration why hasn’t that kicked in, creditors paid and certificates issued?

It was in the last year when they check for equity if your a home owner. First they said they wanted 8k and I had someone from a loan company they had appointed hassling me. Then next minuite varden said there’s no equity in the house so not persuing it. Very suspicious. It was the year after I asked to settle with funds. 8 months later they and creditors agreed.

Simon, I called them last week as mine finished in March this year. I asked about the length of time it will be for certificates to be issued as I’m going for a re mortgage at the end of this month.
Told them my circumstances and he put me on the priority list.
They’ve not even started on them even though the web said they got authorisation in August. It’s a joke! I asked for a covering letter and he said it wouldn’t state it was completed only that I had fulfilled all my obligations.
They’ve always made me feel like an uneducated idiot that got in to debt.
I blame the lenders they shouldn’t offer credit to anyone over 21.

If I had the money I would seek legal advice as well.
I went to a free law clinic last year about finishing with to date funds they said it was all above board but could request to finish. Which I did and they agreed . I also went to citizens advice but didn’t really get anywhere as the lady wasn’t experienced in that. So I never followed it up. They were very helpful though.

I will be left with no choice but to take a high intros sub mortgage as the high street lenders will not touch me. We are desperate to move and house is already up for sale. Which under the fair act will put me back to a financial state of 6 years when I took the iva out.

I have opened a dispute with both equifax and experian tonight.
From what I have read legally unless the take you to court for an extension on your iva then that court info should be removed. I told you I had complained to the gateway as well so will wait and see. Equifax have helped me out removing an old bt default so anythings worth a try. My husbands ccj has just dropped off his file he went from 254 to 750 on experian. Checked with noddle (call credit) and the iva is off so there’s no excuse. Sounds to me like their doing nothing at varden. Somethings going on and their not saying.

Seems like we’re all in a similar situation and it’s really got to the stage now where it’s so unacceptable. It just seems so unfair that we’ve stuck to our side of the agreement with the promise that in 6 years we could start with a clean bill of health, but due to their situation we are being penalised again. I completed my IVA in June last year and have still not received my completion certificate. Am looking to remortgage but as my IVA is still showing as active despite having a balance of £0 my credit rating is still really low. I have called 5 times (after waiting a good deal of time to see if they sent out the certificate without being chased) and each time I get through to a man who promises to get me on the magical priority list and that someone will call me back the same day – they never do and despite them saying on their website that they have authority to complete them and will begin to do so, this Pablo says they don’t! Sorry – rant over, but I just find it so frustrating. I kept to my side of the bargain living on a tiny budget just to be penalised at the end by Varden Nuttalls mistakes. I think I too am going to complain on the IVA protocol – anything has to be worth a try!?

Seems a few of us desperate to re mortgage. Can I be nosey and ask you f anyone has applied?
We went to see a broker last month but as we had a few things clearing a few weeks after we have held off.
I am now 34 points away from being in the fair bracket on experian. And I’ll prob make that when my credit card updates tomorrow.
To me even with the iva it’s not the worst score . We’re under no illusions that we will get the best high street deal but are prepared to pay the extra as our mortgage rate is not the best anyway. Was with Northan Rock but they sold us on in the recession and obviously not been able to re mortgage all these years.
I complained to both credit ref company’s but said they are tied as its down to the insolvency register. So I have emailed them the situation today. Not sure if the outcome but worth a try. My iva is also showing zero on credit report.
Like I’ve said before we are being fobbed off by varden and I believe something is going on but it’s not the completion certificates. Where’s all our money gone!!

We have been told by friend who is a mortgage advisor that there’s no point in applying until the IVA has disappeared from our credit files. But unfortunately due to us being in our mid forties we can’t wait much longer to move. I’ve put in a complaint via the gateway last week and am in the process of getting information from what happened at the 8th of July court hearing. I also have an appointment made to talk to someone at our local citizens advice to see if there’s anything else that can be done. But other than that I’m stuck on how to progress things further.

Well we went to see a mortgage broker and she never said that. No point in applying as in you will not get a high street rate but you will get one, all be it at a higher rate. We are giving it until our house sells then will apply iva or not.
We are left with no choice our house is just to small with two little ones.

An increasing number of people whose Varden Nuttall IVAs should have finished are getting understandably fed up.
I am not recommending you should take legal advice, but if you want to, it may make a lot of sense if people go to the same solicitor and one with experience in IVA disputes.

It sounds like there are a fair few of us waiting for these ilusive certificates, I had a full and final agreed last August and was repeatedly fobbed off regarding the certificate. I have been calling the office and getting nowhere, I too think something is certainly adrift.
I am an ifa and desperately need it lifting off my file for work more than anything, I have even sent them e mails from my compliance regulator whom have put me on a high risk register which i want to be and should be off, getting know where with VN, I don’t want to have my licences restricted which may happen unless I get this dealt with ASAP.
I’m certainly considering legal action and will be calling them tomorrow and explaining that I’m going to be paying them a visit in person, has anyone else gone to the office ?
The situation is a farce, they don’t ring you back they are rude and I am sick of getting fobbed off !

Some of my creditors showed settled and some didn’t before they disappeared off my credit file.
But that’s how they make their money off the interest as they only paid them a percentage once a year which was nothing.

I complained to the gateway via the government website. I had a reply from them a few days later asking for evidence to support my complaint (I have only been communicating with Varden Nuttall via email for a while since I had a particularly nasty employee yell at me for no reason, so getting proof of all of their empty promises and general lack of information was easy), within hours I had a confirmation email saying that it would take upto twenty working days for them to investigate the matter. Yet to hear back from them yet though.

They kept saying it was the ppi that was holding it up but we signed twice for them to access it and they got paid out two times from the banks but still they wanted more I told them I had fullfild my end of deal but they kept saying if I did not sign we would’nt get our completion certificate I rang trading standards and they said I could take them for harrassment I told them this and said I was going to take them for miss selling the Iva since then I have had no contact from them they would not return my calls so I started to think something was going on I just wonder if they have ever paid out to anyone at the same time I told them that they were only out to make as much money from us and not interested in the affect it was having on us that we could’nt move on with our life so we now are at the stage we have paid everything and still in limbo

They told me they were not going to issue my certificate unless I signed for the ppi I informed them that I had signed twice already and was not prepared to sign again so as a result after five years of paying our last payment we have not got our completion certificate

Forgot to say this was four years after our last payment and I said I was not prepared to sign my life away that the agreement was supposed to be for five years and it was now nine years since we had signed up but they still said they could keep it going for as long as they thought they could find more money but there was nothing left to get. I had a feeling that they were delaying paying out to the creditors.

I understand your frustration but it is your choice – sign and end your IVA or don’t sign and be in limbo. There may well be another big round of PPI payments coming in the next few years (google “Plevin PPI” if you want to know more) – it is unlikely your IVA will be completed if you do not sign with these coming up.

First I have say obviously that I am making some guesses here as I don’t know the details of your case…
What you signed before was probably a specific permission for their claims company to try to collect any PPI refunds. What you are being asked to sign now is probably a blanket permission for them to continue to do this after a completion certificate is issued. If you are refusing to sign this, you are unlikely to get your completion certificate.
This is not a VN-specific issue, it would apply what ever firm your IVA was with.

Sara, that’s correct. I signed the ppi form as a condition of my iva ending and permission to collect any ppi after I received my certificate. That was March this year.

A solicitor has said they could write a letter to try speed things up but no guarantees and would cost. I just don’t think it’s worth it. Would just be hit with the administration and court jargon etc…

I was told that they are putting the team together to start the process now but to be honest over two months since the order was granted to issue certificates by HHJ Pelling QC I do not see why they are stalling. Unless the banks account are wrong funds not there ? But one thing is for sure they are not being honest with us which is ironic really since they have held our lives to ransom for on average 60 months dictating what we can and couldn’t do and now they are misleading us. Something smells fishy here and it’s not my super.

I have just called them and been told exactly the same, priority list, should be a couple of months, same as last time I called in July. I paid up in January 2016.

So I called varden again today as its been a month. Got a very frosty reception off.

This is totally unacceptable. At the least we should be told how long.

Been told today that there’s no chance of a re mortgage unless we are willing to pay £1000 a month.
Our house is already up for sale so as they can’t tell us how long the certificates will be we will have to rent.

Been to see someone at citizens advice today. They were extremely helpful and on their advice I have an appointment with a local solicitor. Unfortunately renting is not an option for us due to the average cost of renting a property being three times more than our mortgage payments here. I have also written to both administrators and Varden Nuttall informing them that unless I get my completion certificate soon I will pursue it through legal action. Totally fed up with getting punished for getting into debt eight years ago and will not have another year of my life taken away by these inept people.

I just can’t stand my kids sharing a room any longer, age difference is just constant stress.

I emailed the so called dedicated email from the site last night to explain and that I needed a time frame.
I had an email back saying that my iva is one of many completed and is waiting for varden nuttall to finalise all reconciliation before issuing a certificate.
She said she would look in to it today to be sent to the ip.
But still is avoiding the question of the time frame so I emailed back and said as much.
Someone mentioned in another post about going to the office and that’s something I have thought about but prop get nowhere!
I have had an email straight back from the financial ombudsman also saying they are looking in to it.

I have an active IVA, called VN today to ask a few questions about payment allocation. As I have not had any contact with them for some time I was completely unaware of their administration situation. They were unable to explain how the money I pay each month is allocated or whether any funds haves been sent to my creditors. It also turns out that the creditors I believed I was paying haven’t been paid at all.
I am disgusted by their attitude and failure to answer any of my questions. Now I’m quite concerned over what is happening to my account and whether the IVA is actually valid.

Apparently the writing of the cheques to creditors is taking a long time.
No kidding!
So in effect there’s ( hopefully) a massive load of cash sat in an account that’s not been paid out or rather is slowly being drip fed to creditors.

We’ve paid all we owe. We overpaid actually due to having a lot of Ppi and got a refund.
That’s helped our situation but still no completion certificate.

I too overpaid on my IVA with this dreadful company and received a refund for the overpayment. My IVA was due to be completed in May of this year but like the rest of you, I have got nowhere despite playing email tennis with them. I have checked with my creditors only to find none of them have received any of my payments from VN for 17 months with at least one of them not receiving any payments for well over 2 years. I did read something months ago that it was a “misappropriation of funds” i.e someone with very very sticky fingers that had sent the company over the edge but I cant find this article now so not sure if it is true or not. VN did confirm to me that they had a bond in place prior to entering into administration and I am hoping this is true. I have no faith in either of the administrators and they are not communicating any progress to VN clients which should tell us a lot if we read between the lines. The profile of this whole sorry debacle needs to be raised to not only highlight the plight of ourselves but also the failings of both VN and the joint administrators and maybe one way to do this would be to form an Action Group where a louder voice can be heared? Just exploring different ideas to get this awful situation resolved.

I just wanted to let you know that I got a call from VN today saying that they have processed my completion cert and I should received it tomorrow. I completed in Feb this year and like many of you have been fobbed off on a few occasions. I was extremely worried as it appeared that no-one was getting any certs and I thought I was going to struggle to every get off the insolvency register.
My mum works in legal and I was advised to write them a letter explaining how it was affecting my life etc. and call them every day. I wrote the letter and called them every 3/4 days and 4 weeks later I got it. (fingers crossed it is in the post).
Just wanted to let you all know that there is some hope thank goodness. Good luck everyone.

Told her I had exceptional circumstances and was put on priority list.
Told her but according to sources so is everyone on the “priority list ” she said ” their not.

They never mentioned anything to me about drafting, they said there was a list of people and they had no idea who was in what order. I do think writing the letter and giving them a sob story and threatening to take legal action in 4 weeks if they didn’t respond.
They didn’t respond they just sorted my IVA.

I am in month 54 of my IVA and have a charge against my property. My agreement states the property would need to be valued in month 54. Have heard nothing from VN so emailed them. Apparently a third party called Select would contact me at some time but couldnt say when. Any ideas who these people are?

I had select contact me wanting me to take out an 8 grand unsecured loan which would pay off my Iva. Which my argument was would leave me in the same position I started with. The whole purpose of an Iva is to get you out of that and supposedly debt free.
Select are very pushy. After I put my argument to VN all of a sudden i had no equity in the house and they where not perusing with it.
Don’t rush in to anything sue whatever they say.

Rang VN for an update on my case, F and F paid 12 weeks ago, after months of delayed meetings due to a creditor failing to claim. Anyone know what the cut off is before they say enough is enough and stop chasing this creditor and get on with completing my case?

So, what is happening with the outstanding IVAs? I’ve made a lump sum offer to end my IVA but things are moving very slowly or perhaps not moving at all, if they are not able to put up with the work anymore isn’t better to get some legal help and approach creditors directly?

It’s not possible for you to approach the creditors directly when you are in an IVA. It must be extremely frustrating for you, have you asked them when a variation meeting to consider your offer will be organised? You could try calling regularly for updates – a couple of times a week?

With the current situation is there a chance that some IVAs will terminate early and creditors will get their money via VN insurance? Or am I hoping for a miracle here…

That’s not going to happen – the “insurance” is to cover payments you have already made if all the money isn’t there. It won’t help with the payments that you haven’t yet made.

Guys, as you know I recently got my cert, but before this I put a complaint in about them and I got this response today which you may find useful when calling them.
They said that the governing bodies gave VN 6 months from the court appearance in July to issue all Certs. If you haven’t received yours by January 2017, please contact the complaints gateway.

VN are being closely monitored and I was assured that if you are due your certificate the end is very near!

We had a solicitor draft Varden Nuttall a letter and have called them up twice a week for updates. To all who are still waiting for their completion certificate keep on it, don’t let them forget you. Just saw the news about Varden Nuttall. I finished my IVA and received completion certificate in 2014. However two years after this date i have now received a letter from one of the major banks about a PPI refund.
Now where would i stand about this PPI money as effectively the company is in administration and i have to confirm to the bank that 1. the IVA is complete so there no problem here!! and 2. There are no retained interest in the PPI redress.
My issue here is that after 2 years of completion and no further communication with Varden Nuttall that they would still have a right to the PPI
Not quite clear where i stand on this and where i go next?

The fact that VN is in administration doesn’t make a differnce here. See https://debtcamel.co.uk/ppi-claims-after-iva/ for a description of the problem. You will probably be in case 2 or 3 – I can’t give legal advice on this but it is probably best to wait until the Green v Wright verdict is known.

Hi, I got mine Christmas week. I had been waiting since March.
I got told that the women who was doing them finished at Christmas so I would have it by then. In one ear and out the other but low and behold it arrived with no phone call.
And to anyone waiting on it for a mortgage. I got my Iva removed from my credit files over Christmas as 6 years had passed and marked as completed with the insolvency register.
I have now got a re mortgage with a top lender and due to move in 5 weeks.
Miracles do happen.

Yes it’s TSB it was the fourth best deal.
Tried NatWest first but was declined partly to their system not updating until end of Jan meaning my Iva was still on their files.
But we had seen a house and had a week to make the offer so couldn’t wait for NatWest.
We used a mortgage advisor cost us £499 but goes off the level of work put in. She has been fantastic. Worth every penny.
We got a mortgage in principle and our advisor phoned them to explain about the Iva just coming off just in case there was any issues.
And TSB said if we’ve past the credit check it will go through no problems.

Hi I’m new to this . We made our final iva payment 11 weeks ago 24th November. We did the additional year as we couldn’t release any equity from our house. I have been chasing up our completion certificate as we have major damp in our house and need to nborrow money to do the repairs. I have been chasing them and as usual vn always want more and more I for payslips from 2014 the 2015 then they claimed that we owed and addition £2100.00 . Not a chance!!!! Vn failed to do our income review in 2015 not our fault there’s we have sent everything they have ever asked for made every payment ontime. I even had to tell them to value or house in month 34. I have dealt with an amazing girl called Jessica and she sent my complaint about the situation higher and today I’ve been informed they will take full responsibility for not asking for info 2014/15 and we do not have to pay £2100 and that our certificate is now in pending. Fingers crossed it won’t take long we just want to move on with our lives .

I lost confidence in Varden Nuttall a very long time ago. To put it frankly they do not appear to have a clue on how to resolve the mess they are in and the administrators are no better. Lies, false promises, a total lack of transparency, no communication with clients ……. the list is endless. My IVA finished in May of last year but i actually paid it off in full (100% yield) in September of 2015 and I am still waiting. Emails to them only generate more false hope and hollow promises. After checking with my creditors it is evident that Varden Nuttall have failed to pay substantial dividends to my creditors despite promises that client money is ring fenced and protected. We all know that money was “misappropriated” within the company but this appears to have been swept under the carpet and we know that judge Pelling put a 6 month time frame for sorting finalised accounts out at the last court hearing in August of last year so where is the accountability from the administrators? Why are they not keeping clients informed? Even threats of legal action, reporting to their governing bodies etc doesn’t make the slightest difference. The treatment of Varden Nuttall clients has been appalling to say the least. I am no closer to receiving my completion certificate than i was 6 months ago.

We finished ours in May 2015. Paid 100% of what we owed and even recieved £6000 refund due to PPI clearing the balance.
We’re in the same boat. Can’t re mortgage and can’t get credit. If it wasn’t for the refund I’d have been unable to buy a new van to continue working.
You’re right the administrators just blow smoke up your backside. It’s water off a ducks back with them. I have no idea what to do next. They are impervious to threat. Totally disillusioned with it all.

Got a phone call today saying our certificate was in the post!
I spoke to them last month and explained we needed to re mortgage and my business needed credit. She promised to push us through.
Wether or not this worked I don’t know but finally after almost 2 years since completing we should if they’re true to their word have our certificate tomorrow or Monday.
On top of the phone call I emailed on Tuesday threatening legal action. Whatever the reason we appear to be finally free.
Keep trying everyone. They really are a shocking company to deal with.

I think it’s about time somebody in authority put some pressure on them AND the so called Administrators who are no better than Varden Nuttall themselves. It’s pretty obvious that their relevant governing bodies have no intention of doing anything following all the complaints that have been lodged against both parties. Since I have had no direct communications from them since the administrators took over I will be demanding under the Data Protection Act, copies of all documentation that bears my name, something they have to comply with under the terms of the Act. I am then willing to pay a solicitor to read through the documentation and write directly to the Administrators. Since HHJ Pelling put a 6 month timeframe on the issuing of completion certificates at the court hearing last August I will be making enquiries as to whether the Administrators are in breach of this court ruling. Then there is the matter of the considerable sum of money that was apparently “misappropriated” within the company, this matter seems to have been swept under the carpet. VN have confirmed to me that the required bond was in place to cover client monies in the event of the company becoming insolvent but this seems to have not been documented anywhere aswell. There are too many things being hushed up and a distinct lack of transparency on the part of the Administrator for it not to be challenged. We may have to come together as one voice to prompt any changes and I, for one, am definitely up for challenging them as this debacle has gone on for too long now.

We paid our last payment Nov ‘ 15 – and yes still no completion. I was contacted before XMAS (dec16) to make another final payment as they had misallocated funds so I owed monies. I promptly paid the owing balance, hoping that would be us clear- but No completion and the office cant help at all !??? Longest IVA in history ! I could have paid my debts off fully in the this time which makes me even more cross!!

Mine was exactly the same paid off 8 months before the final date and got a phone call asking for more money as they had calculated the amounts wrong so not only are they inept at running a debt management business but they cant add up aswell.

I wonder if I can ask advice on this – I’m with Varden Nuttall, knew nothing about the administration until I received a letter in December 2016 for my annual review, this was a good 6 weeks before I normally am asked for payslips etc. which is usually around 19th January. I put this down to the fact that my 60th payment was due January 2017 – this has now gone out. I’ve not heard anything from them yet but my question is as all my paperwork describes a 5 year (60 payment) IVA agreement do I automatically cancel the standing order and pay no more – this was my assumption as the right thing to do as I do not want them to keep taking if I don’t need to but having no contact yet I also don’t want to end up suddenly being asked for more money that I do not have (and should not owe)?
I have checked on the link quoted much earlier for the Individual Insolvency Register and am still on there (which I’d expect as only just completing (as far as I am aware).
I do not appear to have had the issues and stress some of you have been through but then I have just given my annual review every year and paid every month and given the extra requested as my wage has increased but would like your advice as to whether to chase now or see what happens? (I will say I do not have the worry of mortgages etc. just the hope my wages are my own now for the first time in a very long time)

It’s hard to know what to do here. You could chase them for an answer. Or you could email them and say you are cancelling your standing order as you have made the last of your 60 payments, but also set up a seperate savings account and start putting your monthly IVA payments into there. Then if something crops up in your final review you have a pot of money waiting. And if it doesn’t, you have yourself a rainy day savings fund!

I’d actually drafted an email to the effect of what you advise Sara, so I will go with that for now.
I was planning on saving as much as I could of my payments anyway (apart from for the odd treat, or necessity) as ideally I need a better car sooner rather than later (not a new one but new to me) so that will be my way forward in the meantime – I just didn’t want to leave cancelling the standing order until it was too late and they happen to take again anyway (if they would) – would be harder to get it back than to have it saved if they request more for some reason (better in my hands for now I reckon)

unfortunately things have changed since I wrote this post Friday – I got home to find my landlord is selling the house I’ve rented for the last 13 years….not sure how the IVA I’ve just finished would affect me renting another place (I know my letting agent will give me and my 2 cats a glowing reference as never has the rent not been paid) so maybe I should chase and push for the certificate sooner rather than later just so I’ve covered everything?
I’m going to view a place Thursday which with luck will be a good choice (more room, private garden, even nearer to my colleague I lift share with) everything crossed things work out as the timing is abysmal – just when I thought my money will be my own and time to save and plan things :(

It takes a few weeks for them to even mark as completed.
But if it’s for special circumstances i.e. A mortgage they will do it for you if u email your completion documents.
I just took pictures on my phone and they were happy with that.
The guy I dealt with was really helpful and efficient at replying.
Find your name on the register and at the bottom it asks if the info is correct then explain your situation.
My Iva was marked as completed straight away. I still got a remortgage even though i wasn’t completely removed off the register.
