QuickQuid (QQ) and its smaller brand Pounds To Pocket (P2P), which in February 2019 rebranded as On Stride, have been getting large numbers of affordability complaints from customers asking for refunds of interest.
You may be able to get a refund if you had loans from QQ, P2P or On Stride you couldn’t repay without borrowing again. You can get refunds for all type of loans, including instalment and flexi loans.
Summary – QuickQuid complaints
QuickQuid is now the most complained about banking and credit firm in Britain (ignoring PPI), according to Finanical Ombudsman statistics.
At the end of 2018, there were about 9,000 complaints against QQ and PTP with the Ombudsman. Many had been there for two years as QQ had been refusing to give refunds on loans over 6 years old or for loans given after 2015.
In 2019 the Ombudsman started upholding large numbers of these cases. QQ then rejected many of these decisions.
But in August 2019 QQ agreed to pay thousands of outstanding Ombudsman decisions within the next 6 weeks. These are being referred to as “the spreadsheet complaints” as many customers were told by FOS they “were on the spreadsheet“.
How to start a complaint (this no longer applies now QQ is in administration)
The main Payday loan refund article has the template letters to use for making these complaints.
If you had loans from both QuickQuid and Pounds to Pocket, you only need to make one complaint, covering both sets of loans.
If you rolled a loan repeatedly or repaid the loan and soon after took out another one, this suggests the loan was not affordable.
One loan complaints can be hard to win, but if your loan was large, as some of the loans from On Stride are, read Getting a refund for a large bad credit loan which has better template letters for your situation.
A list of your loans is usually enclosed with the response to your complaint.
Has your data been deleted?
This is a new problem. In mid-April 2019, QuickQuid seems to have deleted information about some loans over seven years old from their records. See Why is QuickQuid going to delete old customer data?
This won’t be a problem for you if you have the details of your loans, from your email records or from your bank statements. Here tell QuickQuid you can supply them with a list of your loans so they can consider your case. If they refuse to do this, send it straight to the Financial Ombudsman.
If you don’t have all your records, ask QuickQuid if that is their final response and then send the complaint to the Financial Ombudsman. You can complain not just that you were given unaffordable loans but that QuickQuid has not treated you fairly by deleting your loan data when it should have known from other customers complaints that you may have a good affordability complaint. Ask for compensation for this.
You may feel that without evidence your case is very weak. But you have an excellent case that QQ has treated you unfairly!
If you have closed your bank account, it can still be possible to get old statements but there may be a limit on how far back you can go. So try to do this as soon as possible – don’t wait for several months until the Financial Ombudsman asks you for them as that may mean there are another few months you can’t get.
QuickQuid’s standard response was designed to put you off
QQ uses a template letter to reply to you.
When you read what they have written, you may feel depressed and that you don’t have a good case. That is what QQ want you to believe! But in many cases the checks QQ did were far from adequate and the wording in their replies may mislead you.
Here are some bits from one recent QQ response (in italics) together with my comments on them.
We have assessed loans funded before FCA regulations were implemented using the “other credit commitment” (OCC) value taken from your credit report at the time of funding and used a reliable average for all remaining expenses.
From some published Ombudsman decisions, it seems that QQ hasn’t kept the details of many credit checks it did for loans before 2014, see this decision for example. You won’t win your case just because QQ can’t produce this information, but if you kept borrowing or rolling loans for months then you shouldn’t worry that QQ has some brilliant way of showing they did great checks.
In assessing loans funded after FCA regulations were implemented, we used validated expenses figures. We arrived at those figures by validating your declared expenses for various categories from your loan application against credit reference agency and Office of National Statistics data.
Here QQ usually has kept more records. But they were validating your expenses against some national averages. that may have been fine for the first few loans, but if you kept borrowing, QQ should have wondered if your real expenses were larger than their estimates. So they should have done extra checks on your later loans, not just kept repeating the same checks.
In assessing whether your loan(s) were affordable, we evaluated whether your total repayment across the loan term was sufficiently less than your total estimated disposable income across the loan term, after taking into account your expenses.
They were estimating your income and your expenses, without verifying them.
Also did you have had one of QQ’s “three month loans” where they only charged the interest for the first two months then the whole of the capital repayment plus another months interest in the third month? If you did, QQ assumed you would save up money in the first and second months. But the Ombudsman often doesn’t think this is fair, for example, here is one Ombudsman decision.
We further assessed affordability by viewing your account history for hardship. If we concluded that any of your prior loans were in hardship status, we evaluated whether any subsequent loans were issued without an adequate gap in time in between.
But QQ doesn’t seem to take account of whether you had to roll a loan, ask for a top-up or ask for extra time to repay a loan, even though that is also evidence that you were struggling.
we closely reviewed whether you took out multiple loans in short succession and whether there were negative changes in your individual circumstances such as a decrease in income and/or an increase in “other credit commitments” between said loans. We further analysed dependency by examining whether you had any loan(s) with numerous extensions or rollovers and if so, whether any subsequent loan was funded in close proximity thereafter.
QQ says they “closely review” these, but often they just seem to reject a case even if often you had to roll a loan or borrow again soon after repaying one.
You may feel this letter doesn’t actually reflect your situation at all – and you are probably right! QQ doesn’t explain why they have refused to refund some loans, or why they picked the ones they did.
For several years QQ didn’t add 8% statutory interest to goodwill refunds it offered. But inAugust 2018 sent an unexpected additional refund to some customers who had been affected by this.
QuickQuid cases at the Ombudsman (you can no longer send a QQ case to the ombudsman)
The Ombudsman service is easy to use but has been slow for QQ complaints, but in summer 2019 that seems to be improving as a large number of cases have been decided.
Three things not to worry about:
- you won’t “lose” an offer from QQ if you go to the Financial Ombudsman. So far as I am aware, in every case where someone was offered an amount by QQ the Ombudsman has increased the amount.
- the Ombudsman won’t reject your case because you had a large income or your partner kept bailing you out etc. Lots of people have won these cases. If you kept borrowing then QQ should have realised you were dependent on the loans and stopped lending.
- cases where there was a lot of repeat borrowing and gambling are getting good refunds.
How do they respond to the adjudicator’s decision?
The Adjudicator is the name for the first stage of an Ombudsman complaint. Only 10% of cases have to go to the second stage is when it is looked at by an Ombudsman.
QQ accept have been accepting some adjudicator decisions. But sometimes they offer a lower amount, in which case you have to decide if it’s worth taking that or asking for the case to go to the Ombudsman.
In June one person has just reported being offered c £8,000 by QuickQuid when the adjudicator’s decisions would have been about £9,500 – he decided that was a good enough offer to accept.
Rejecting too many adjudicator decisions
But QQ has been rejecting far too many adjudicator decisions.
The ombudsman could take all these adjudicator decisions through to the second “Ombudsman-level” where a decision is legally binding and QQ have to payout. But that would take a lot of Ombudsman resource to get thousands of cases through at that level. It shouldn’t be needed. the Ombudsman-level is intended for the few difficult cases, not for run-of-the-mill standard decisions.
Both the Ombudsman and QQ’s regulator, the FCA, have been pointing out that the FCA’s rules say a lender has to learn from ombudsman decisions and apply them.
This is why in August QuickQuid agreed to accept several thousand adjudicator decision it had previously rejected.
QQ started to send emails with the refund amounts and asking for people’s bank account details in September.
Good news that QQ is paying out on some FOS decisions but…
I’m very pleased QQ agreed to pay out on these decisions. Not just for those customers getting their refund at long last, but because by removing a large number of complaints from the queue for an ombudsman, I hope a lot of other FOS complaints will move forward faster.
QQ’s American parent, Enova, released its second-quarter earnings figures last month. Overall they were fine, but there were some comments in the Earnings Conference Call about Enova needing to reach a satisfactory resolution with the FCA and FOS about complaints. It’s not clear what they mean by this.
Enova’s third-quarter figures contained the announcement that they would be closing their UK business due to “regulatory uncertainty”.

I have just had the Ombudsman rule in my favour for my quick quid loans. In fact the Ombudsman has improved the result for me from the adjudicators decision.
I have a couple of questions for people who have been in this position.
1. Myself and QQ have until 2nd December to reply, how long after that do QQ have to have paid by.
2. I can quite easily calculate the interest on the loans but how do I calculate the interest on the Flex loan? I want to make sure QQs offer (when the finally make it) is reasonable.
I’m hoping for in the region of £3500 over all

I’m not sure what stage you are at. If an Ombudsman changes an adjudicator offer there is usually a provisional decision. Then when a final decision is made it is legally binding and the lender should refund the money within 28 days.
Re calculating interest, do you mean how much interest you paid? Or the 8% extra?

Thanks for your speedy reply Sara, yes this is a provisional decision. The Ombudsman has stated the interest refund due on the standard pay day loans and this comes to £2443, some of these go back 5 years so I have calculated the 8% to be about £800.
The Flex loan was for £1400 and I was pretty much at the limit of this for a year, and this is where I’m struggling to work out what the refund might be on this.

The “simple” way to work out how much interest you paid on a flexi account is to add up all the amounts you paid to it and then take away the amounts you withdrew. I don’t know if you are working from QQ’s statement, but it can be easier to do this from your bank statements which just show money in and money out. Once you have got that, you can do a rough shot at the 8% on top if you assume all the interest was paid half way through the time you had the flex account open for. Calculating that exactly is tricky because you need to know how much of each payment you made on each date was interest.
Out of curiosity, how did the Ombudsman change the adjudicator award?

Hi was this offer because of Over 6 year old details or were the loans based on the the last couple of years? I the reason I ask qq have offered me £1300 based on loans that were less than 6 years but my adjudicator has confirmed I can now claim for over 6 years which was the majority of all my loans

Its a great result but shows how much trouble I was in at the time and it still feels quite raw at times. I now realise there are far better options than these lenders when times get hard. I only wish I have turned to them.

They are either confused or being obstructive… This has nothing to do with whether you have a good complaint, so don’t give up!
You need to reply that you do not want a new loan, you are making an affordability complaint about your previous loans. If they say they won’t consider it, ask if that is their Final Response because you will be going to the Ombudsman.

Add up everything they paid to you. Add up everything you paid to them. The difference between these two totals is the amount of interest plus charges you paid on the loan.
This works for all loans which you have repaid. Are there any you didn’t?

Don’t bother to go back to QQ, you don’t need a number from them, just put in your complaint to the Ombudsman. You could then email QQ and say you have done this.

As the article above says, you don’t have to provide this information to a lender if you don’t want to. Often people don’t have bank statements and pay slips! Just email them saying you have no further information which you wish to add to your previous email which set out your complaint.

I have been getting loans from QQ for years and years. What I thought was something affordable turned into me constantly rolling over ever single loan just to be able to afford to live. I’m thinking about putting in a complaint as it is now affecting my mental health with stress about finances. I have logged onto my account with QQ and it only shows my loans dating back to the beginning of last year. Is there a way for me to get the information for the loans before this?

QQ should give this to you, definitely put in the complaint and stick with it, it is a lengthy process and frustrting at times as it could be much quicker if QQ didn’t wait until the final deadlines and drag their heels. However, it is worth it. If it goes to ombudsman the adjuicators I dealt with are great and are not judgmental at all. I was embarrassed to send my bank statements but I did this and it has all worked out.

I’ve been lucky enough to receive a refund from QQ yesterday – almost 9 months after I submitted the first email to them!
It’s not quite resolved as yet though, as in the end their response was pretty slapdash / quick &I think that they may have calculated the 8% statutory interest incorrectly. Am I right in thinking that statutory interest is added on yearly? So for example, if you had taken out a loan in 2010, you would accrue 8% interest on the initial interest paid, every year since then?

Having read this article, I was encouraged to complain to QQ but they refused to accept any wrongdoing. Latter I took the complaint to financial ombudsman service. The adjudicator agreed that apart from first two loans all other 15+ loans should not have been issued. QQ then made an offer to refund only on two loans but I refused the offer.
I am not sure what would be the process now? And if I could potentially lose this complaint?

The procedure now is that if QQ will not accept the adjudicator’s decision (and it sounds as though they won’t) then your case gets passed to the second stage and gets looked at by an Ombudsman.
In 90% of cases an Ombudsman upholds the adjudicators decision. But it is possible the Ombudsman could change it to be more (all loans say) or less (all after the 4th loan say). But QQ’s offer is now effectively the minimum you will get.

This is what I replied to their ‘standard questions’ they sent as a reply to my complaint…
Unfortunately, I do not have access to past bank statements or payslips.
If these are required, I will supply them to the Onbudsman if I feel the need to take this further.
With regards to my financial situation. If you have a look at my lending routine, you will notice that on every single time I have requested a loan, I have ‘rolled over’ the balance multiple times. If you were being a responsible lender you would have noticed what was happening and not allowed a further application. This has caused unnatural amounts of stress to me and I have since been diagnosed with mental health problems which I believe have stemmed from the worry of how I was going to repay these loans.

After reading this website I’ve complained to Wonga who were great and refunded me interest and charges for all apart from the first loan without going to the ombudsman. Quickquid I have gone to the ombudsman I’m now at the adjuducator stage although she agrees after the 4th loan they should have done more to help but she isn’t forcing them to do more, they have offered £682 but my interest is more in the region of £4k plus. Should I proceed to the ombudsman?

Just to let you know I’ve settled for just over £4900 from a goodwill gesture of £350. It has taken since me since August but without your website I would never have even challenged them. So far I’ve got 2500k from wonga and 4900 from QQ and I am now about to take Payday UK and Payday Express to the Ombudsman.

I originally got offered £65 as a goodwill gesture, I rejected it and went to the adjudicator who said 15 odd loans should have the interest on it paid back, they then came back and offered me £455 for admitting that 2 of the loans were given wrongfully. I think im due £1600 so I rejected it and its now going to the Ombudsman. Here’s hoping for some good news in a few weeks

The arbitrator found in my favour on mid-October, gave QQ 1 week to respond (which they didn’t do) and it has been with the Ombudsman since then. Hi, I took my QQ case to Ombudsman after they rejected the adjudicators decision. It went to the Ombudsman in August and I got my final decision on Monday. It takes a while but worth sticking with. The ombudsman added a loan which the adjudicator didn’t which was nice.
I am now waiting for the final calculation from QQ with the amount they will be refunding, I’m getting really impatient now as I know it is so close. I would love for it all to be over by the end of the year but think it may go into January.

Yes I did, I had to go back to my old employer and ask for a copy of it. I wouldn’t worry too much if you cant get your payslip as they will be able to see the funds going into your bank account from your employer on your bank statement

Hi all looking for some advice and also to share my story I first complained to quick quid in June they sent the standard mail back to which I replied with the information they requested,it sent the 8 weeks and no reply whatsoever I sent a email everyday on the last week hoping for a response they never bothered,so I sent to the ombudsman I have then waited until November for an adjudicator to take the case amazing how quick they replied to him ! Anyway they accepted that one loan was unaffordable and offered £110 to clear the outstanding loan and take the default of my credit file,they refused to look at the other loans around 10 of them as they was older than six years the adjudicator asked if I would accept the offer or if I wished for him to look into if we could take the older loans into account to which I agreed him to do I am now awaiting a phone call from the jurisdiction team to see wethere or not they will allow the adjudicator to look at the older loans that where I am now I’m unsure of what they will aks me so if this had happened to anyone any advice appreciated.
Just to not be prepared to have a bit of a headache concerning what information the adjudicator needs i have had to get statements from 2009-2010 I totally understand why they need it but I’ve had a nightmare obtaining them and cost £3 each from the bank 2010 was not so bad as I could do these online I shall keep you all updated

Got my first refund back from QQ, They didn’t accept them all like the adjudicator recommended but we reached a compromise and they agree to remove them from my file but not refund the ones they disagreed about.
Adjudicator offered £850, we agree £750 with all loans removed!

Following my complaint QQ came back to me stating they cannot agree that they Irresponsibly lent to me but offered me £200 as a goodwill gesture. Is this how QQ normally operate? I have rejected the offer and continued my complaint with the Ombudsman.
Has anyone else had this? Surely if QQ are offering £200 as a good will gesture they know that they are in the wrong?

QQ offered me absolutely nothing and disagreed to irresponsible lending.
I went to the ombudsman and the adjudicator got them to agree £1800. They then tried to go back on that offer and revised it to £1500 but the adjudicator was fantastic all the way through and made sure they honoured the £1800.
I didn’t send in a payslip, bank statement or anything. I said my account was cancelled years ago and I didn’t have the payslips.
The rollover loans were enough for the adjudicator to build a case.

Started in May this year. QQ took about 2 weeks to send the standard response and then 8 weeks to say they weren’t in the wrong.
Ombudsman took about 4 weeks before I got my introductory letter then a few more weeks with a proposal.
Went backwards and forwards for a few weeks with the revised offer and once that was sorted QQ get 4 weeks to make the payment and they do take FULL advantage of the timescale!
I received the money in my bank 4th November.
It definitely is drawn out with QQ compared to the other lenders but it’s worth waiting for.

Just a quick thanks to debt camel, I’m unsure of how I came across this page and the information but I had no idea I could possibly raise this for compensation after I struggled for years with QuickQuid loans.
I submitted my complaint last night to QuickQuid after getting all records of my Payday loans yesterday morning (They were surprisingly quick at responding with them considering I sent the query the night before, although they sent each one individually in 28 PDFs)
Quite surprised as I was borrowed £4050 which interest of £1015 over a 4 year period (Being under 22 throughout) when my account details said I was earning 500 per month with only 100 extra cash to myself but they still chose to borrow to me amounts of up to £300 in some cases , do you think this will go in my favour ?
After I submitted my complaint last night (Thanks for the example by the way) they got back to me around 10AM this morning to say they had acknowledged my complaint and requested some details off of me, should I respond with I will only submit bank statements and payslips to the Ombudsman?

Hi CJ, that sounds like a good case but whether QQ will offer you any more than a few hundred pounds is doubtful. They don’t usually make good offers :( You should expect this one to go to the FOS.
If you have the bank statements and payslips, then you could send them to QQ – it’s up to you – some people prefer not to.

Hi all, Qq have just offered me a gesture of goodwill of £380. I wonder, has anyone gone back to them direct with an alternative settlement or gone straight to the ombudsman? I ask as my current outstanding debt with them is £404 and I would be happy if they wrote that all off, I am not out for more than the existing debt owed as I simply want it repaid and removed from my credit file. QQ usually take the view that their offer is final and non-negotiable. As you won’t so little more, it’s worth going back to them and asking for them to write off the debt and delete it from your credit record.
BUT QQ don’t usually give reasonable goodwill offers. If they have offered you that much, you may be able to get 5 or even 10 times that amount by going to the Ombudsman.
If you do go straight to the Ombudsman, you may fuind they come back with a better offer in a few weeks time, before the Ombudsman has even started dealing with the case. Let us know what happens?

So today’s question is how long should I expect to wait for a payout from QQ?
Upheld Ombudsman decision from 5th December its now the 19th. I know they have the 28 days. They are however being the usual unhelpful selves with no information at all when queered on the phone.
So really looking for experiences of payout timescales please.

I think it is around £9,300 as I worked out plus 8%. This included all the flexi-credit style of loan. I have asked for a breakdown as I got a rather generic email with just the full amount on. But to be honest I am just delighted that its all over with them.
Everything removed from my credit file within 30-45 days
I have now had a total of around £34,000 back in the last 6 months.
I have still got battles Money box 24/7 and money-shop being the 2 biggest.
Also just starting out on the Maltese based Pounds to payday. So will keep you all informed of that progress.
But today was a good day.
Worth the wait? You bet it was.
I really hope that this gives people hope

Its taken over 6 months from initial complaint. It took a while to get picked up at the FOS from then I had an excellent adjudicator. It was then around 8 weeks from that decision to uphold to the final ombudsman decision. Then another two weeks till QQ paid out. If you have a great case don’t accept any low offer they may give you. Its a lot about having the patience to see out the long process. It will be worth it in the end as my case shows.

I have had a final response from QQ. They have refused my claim but offered £166 as a good will gesture. If they don’t believe they are in the wrong, why have they offered anything at all. Do you think I should take this to the Ombudsman?

What I thought was something affordable turned into me constantly rolling over ever single loan just to be able to afford to live. ” On that basis, £166 sounds a very inadequate refund! We often have people here who receive 5-10 times as much or more by going to the Ombudsman after one of QQ’s poor offers. I think you should take it to the Ombudsman.

Back in November I submitted my complaint to QQ in regards to the loans I had taken out, in which they replied with the normal coly and paste questionaire, completed this and they had written back a week later with a final decision not to offer me anything and deadlocked the complaint.
As above the made me make the ombudsman aware of the case in which the adjudicator agreed that loans 3 and 4 of mine were unaffordable, this roughly equates to just under £700 in which this includes the statuary 8% and to be taken off of my credit file, what my main question is, as this had been now passed from the adjudicator to the ombudsman will the ombudsman find this complaint in QQ’s favour due to large gambling transactions being on my bank statement, qouting from the letter my adjudicator sent me.

In addition to this, I have recently received an offer from QQ for £200.80 which is apparently for loan four which I am looking at right now, the total interest and charges for the base loan and top ups are £324 which im not sure how they can miss this, can this have a detrimental effect towards then, I have notified the ombudsman of this and advised this is incorrect with the pdf files and screenshots as evidence.
If someone could give me some insight to my above comment and this that would be great.

I can’t say what the Ombudsman will decide, but they usually do agree with the adjudicator. The reference to your gambling transactions sounds just like a statement of fact, not a criticism – it doesn’t seem to have adversely affected the adjudicator’s decision.

Further to my case with the QQ they have offered me £458 yet when I have checked the loan agreementd this should be £700 in interest, adjudicator has sent this to QQ in which they havent replied within a week.

Looks like my complaint is getting somewhere!
QQ originally offered me a very random £166 compensation. I forwarded the complaint to the FOS. I got an email today from the adjudicator stating that QQ have now increased their offer to £466 in relation to 2 of the loans. This is even before the adjudicator has looked through my file…. I have just emailed back saying that I have rejected the offer again as I have paid nearly £2000 In interest.
Do you think the adjudicator will now come back with a lower offer?

I have put in a claim to the Ombudsman for QQ and they came back and offered me £250 (total interest I paid was £1,500). However, I was wondering if they might think I was living beyond my means at the time. I was earning £1,700 a month and paying £950 in rent/mortgage. Could the ombudsman come back and say I should have been able to live within this salary and refuse to pay me anything at all?

The Ombudsman very rarely makes judgements about what people should have spent their money on. I think we have seen a couple of people have claims refused because there was a lot of foreign holiday spending on cars and hotels showing. There was also one case where the borrower was putting aside money each month for a house deposit – she lost that case because she copuld have repaid her loans if she hadn’t been saving.
We have never seen a case where anyone ended up with less than a lender offered if that is worrying you.

Thanks for the info. The adjudicator was really unhelpful. She kept saying that she couldn’t advise me because she hadn’t looked at my case yet, but could see a lot of small loans for £100 and would have to check my expenditure. Her tone implied that my loans were probably affordable. She also said that QQ might withdraw the offer and I would end up with nothing. I got worried and accepted the QQ offer of £250, which they paid within a day. I am now wondering, of course, whether I could have had a thousand instead! I got the feeling she just wanted the claim closed to make her job easier, because she sounded very negative about my prospects.
The fact is that in most of these months I was paid around £1900 net (some months it was £1700 and in the last year 1400), so I kind of blame myself for overspending. I was very disorganised, with two overdrafts and lots of different small payday loans. I didn’t go on expensive holidays but did buy nice clothes at the time. Also was paying a £300/month mortgage for small property in Spain as well as my rent in the UK and wondered if they would agree with that. Anyway, I think I’ve made a mess of the whole claim!

Technically QQ could withdraw their offer. However we have never seen a case where an adjudicator offered less than a lender had done, so it really wasn’t a risk.

I emailed QQ on Sunday 19th Feb 17, asking for statements of the accounts i have had. They have just emailed me received a s/sheet detailing this info with a standard response. On 27 loans between 09/08- 08/14 i repaid interest of £2331! Despite me only asking for a statement they advise they are going to investigate my complaint (which I havent actually sent them yet!). However, as they treated my initial email as a complaint, I guess the 8 week clock starts ticking from then?
I will happily provide statements (when i get them that far back) to the Ombudsman, but dont feel happy to provide them to QQ. Will this be an issue?

following on from a debt collection letter last year for motor mile finance I found this site through google, after reading all the articles and comments, I decided to put in an affordability complaint against Quick Quid and Wonga, today i have had confirmation from the ombudsman that they agree with my complaint to Quid Quid, Wonga is still ongoing.
I first put my compliant to quick quid on 2nd december, they took 8 weeks and stated they did not agree with me, they also specifically stated that payday loans and flexi credit accounts where separate and could not be looked at under the same complaint, this is to defer liability and try to get you to complain twice dont do this please put it all in one compliant.
I then took this to the ombudsman in Jan and the adjudicator has already looked at the complaint and agreed that all loans and flexi credit except the first loan, were unaffordable. the adjudicator has stated that all interest and charges should be repayd plus statutory interest and deducted form any outstanding debt which is great, also will remove all default notices. now this can still go to the ombudsman however the adjudicator has stated in the letter that the ombudsmen will agree with her and therefore she advises against that in so many words.
The ombudsmen were very helpful and went through everything in details, on the phone and via email, they are a really credit to this nation.
I would just like to say thank you to this site because if i did not stumble across it i would have never put a complaint in as i didn’t even know you could do that. Please put in your complaint you have nothing to loose . also only taken three months from beginning to end.

I’m not in any rush, I don’t need the money Im in a fortunate position whereby I am now secure financially.
If QQ decide to take it further I am happy that the Ombudsman should find in my favour.
The main thing is I hope other people read this and have the confidence to put a compliant in, as being in a cycle of debt is horrible and not everyone is in the same position as me and are secure financially.
This might be the starting point for people to get out the cycle of debt with payday loans.

I think if your loans are in the last 6years the process is a lot quicker. My ajudacator mentioned QQ objected mine due to “jurisdiction” which was the 6 year rule. This meant to would need to go to another team. Since I said to ignore older loans I got a reply within a week to say mine had been upheld. They have until the 3rd march to reply. It was 2 initial loans so I’m quite lucky they are all that are missed.
As long as you have bank statements and statements of accounts, it’s quite a quick and painless process. After reading the comments sections on this and the main pdl thread, I was expecting it to take a lot longer to get to this point. I know it’s not done, and may go to another level if QQ reject it, but it felt more daunting than it actually is following the comments. I started mine on 12th Dec.

When I submitted my complaint to QQ in November they responded after 8 weeks offering a goodwill of £60 with no liability on their part. I now have FOS reviewing my complaint and QQ have offered me £400. The adjudicator couldn’t advise if this was a fair offer as they hadn’t fully reviewed my case, so I’ve rejected the latest offer.
I estimate that I’ve paid £2900 interest and £560 interest to QQ and P2P, with multiple rollover and new loans as soon as they were repaid.
I’m hoping for a positive response from FOS.

My adjudicator has responded with her findings that QQ loans four to seven from nine in total shouldn’t have been provided, which amounts to around £2,200 interest with 8% simple to be added. Waiting to see how QQ respond however I’m expecting to having to got to Ombudsman for final ruling, as many have done on this forum.
Loans one to three were outwith the six year ruling and I never bothered pursuing those further. Loans eight and nine were affordable as they were small amounts and my circumstances had vastly improved at that point.
She also ruled that she feels the two pounds to pocket 12 month instalment loans were affordable and I’ve agreed with most of her findings.
My PDUK complaint has went to the jurisdiction team at FOS to see if they have legal basis to review as these meet six + 3 criteria.

QQ responded to my adjudicator today. They have disagreed with part of her findings and offered £660 recompense for loans four and seven, as opposed to loans four, five, six and seven which the adjudicator deemed to be unaffordable.
I have rejected their offer, again, and will sit and wait for final Ombudsman decision. They are crooks IMO with poor business practices and I will be going to FCA to raise my concerns.
How long have people on this post usually had to wait for final Ombudsman decision?

Quick Quid have now made me another offer of £1800 to settle on three loans while my case is the the queue to be reviewed by an Ombudsman.
My Adjudicator responded today with the following –
“They’re upholding loan four XXXXXX six XXXXXX and seven XXXXXX which will mean repaying all the interest and charges you paid for these loans, plus 8% simple interest and the removal of these entries on your credit file.
The refund equates to £1791.80 to be paid to you, should you wish to accept this.”
I’m puzzled as to how this figure is reached and I’ve asked my adjudicator for clarification.
Does anyone know if the refund figure quoted here includes the 8% simple? I don’t think it does as the amout should be over £2,000 when the 8% is added.

Hi all,
I have had a recommendation from an adjudicator who has found in my favour in regards to several pay day loans with PayDay UK. They responded (several weeks late) to this recommendation and rejected the offer, making me a very measly counter-offer which did not offer to remove any information from my credit file. Therefore, the final decision on this case is to be made by an ombudsman.
Does anyone know of any situation where an ombudsman has upheld the lender’s side? Obviously you’d have to know the fully details of the situation but is this at all common?

In most cases the Ombudsman upholds the adjudicator’s decision. Occaisionally the Ombudsman changes the the decision to decide that more or few loans were unenforceable. I have seen a few cases where the Ombudsman has upheld the lender’s side, these were what I would describe as very weak cases so I wasn’t surprised. Because you have received an offer from Payday UK, it is unliekly that you have a very weak case. And this offer is now effectively the minimum you will get back.

Had email today to confirm the complaint asking for pay slips, bank ststemrnts etc, by the time I had read this email, I received another email with my statement of account. 9 loans, interest amounts to £5360.53. Received an offer today from QuickQuid for £244 in relation to one loan. I had loans for a period of 22 consecutive months! I also got this nice bit of word play to try and disprove dependency on loans;
“When I reviewed your loan history I see that excluding loans which you repaid early, you never had more than four consecutive loans (< 15 days between loans) where the loan amount increased over the prior loan amount."
Doesn't change the fact it was still 22 consecutive months though!
Off to the Ombudsman with this complaint now.

I think the best approach when waiting on responses from the loan company is to expect nothing, and then wait for the real assessment from the FO. They will try to palm you off with the lowest amount the think they will get away with. People shouldn’t be intimidated by the copy and paste comments they make in the final responses. The FO will actually assess the affordability, so worth raising the complaint with them unless the loan company offers a full refund.

I’ve investigated your complaint and would like to bring your attention to the following points:
AFFORDABILITY
In your complaint you allege that QuickQuid did not perform a credit check or affordability assessment. We have reviewed your file and can confirm that, in line with our internal process, at the time of each application, we conducted our standard credit assessment, which included pulling your credit report. As part of our assessment, we analyse your current financial commitments, insolvency records, delinquency records, County Court judgements, credit enquiries and other credit accounts currently open.
For instance, when I reviewed your file I found that you were never charged a late fee, which shows a sound financial history and ability to sustainably repay with us.
Lenders are required to make an assessment that is proportionate to the type and amount of the loan as well as the associated costs and risk to the borrower. It would not be proportionate for a lender which provides small loans, which are unsecured and which do not require a guarantor, to conduct the same assessment as a bank which provides high loan amounts which are secured by your home or vehicle. Your loans were unsecured. We did not provide a guarantor loan where you would have needed to have had someone else share the responsibility of repayment .
At the time you first applied for a loan with us, the regulator was the Office of Fair Trading (OFT). The OFT published guidance on irresponsible lending which stated that as a general principle, the checks done may well be less for a small sum or short-term loan. The OFT also explicitly stated that it would “normally consider it appropriate for a relatively high level of scrutiny to be undertaken in the case of secured credit”; however, the OFT made no such statement for unsecured credit such as the credit we provided you.
Your credit report is not the only thing we analyse when we make a lending decision. We also look at the information you provide us in your application, as well as your loan history with us when we decide to approve or decline your loan application.
This information is all input into our internal credit model which is run to obtain your credit model score. If your credit model score does not meet the minimum approval threshold score then we will decline your loan application.
Looking at your record, I see that your credit model score was never under the minimum approval threshold for any of the loans for which you were approved. For instance, on 20/08/2013 you had a credit model score of 0.5376 when the minimum approval score was -0.25. Your credit model score is substantially higher the minimum approval score which shows that our affordability assessments properly ran per our internal policy.
It is in our mutual interest to have a well-designed affordability model. As a responsible lender, we provide customers such as yourself with access to credit and take upon ourselves the risk of default. While we will not reject a customer simply because there is a late payment on a credit file, we will critically assess the details of your credit file to provide you with a reasonable and affordable loan.
The investigation of your complaint also considered all relevant information contained in your application. It was noted your monthly income was stated as £1197 per month. I compared your income to the average monthly repayment for each loan you took with us. From this I can see that the income you made during each loan with us was always more than enough to cover the amount you had to repay us for each loan and thus I cannot agree with you that your loans were unaffordable.
DEPENDENCY
You are claiming that you were dependent on loans. Yet if you were dependent on taking out one loan to repay the other then you would have taken out numerous loans, for equal or increasing loan amounts, and with very little time between paying off one loan and taking out the other. When I reviewed your loan history I see that you held a total of 1 payday loan which given the low number does not exhibit financial dependency. I also note you had a Flex Credit account which is not a payday loan but a running credit account which is designed to provide customers with the option to drawdown credit up to their approved credit limit and repay it over a maximum of 10 months. Just like a credit card, we are not under an obligation to conduct an affordability assessment each time you drawdown on your credit limit.
CONCLUSION
Therefore it is for the above reasons we cannot agree that QuickQuid irresponsibly lent to you.
As this is our Final Response regarding your concerns to the above referenced account, if you are not happy with this outcome I need to ensure that you are aware of the ultimate availability of the Financial Ombudsman Service. You have the right to refer your complaint to the Financial Ombudsman Service, free of charge but you must do so within six months of the date of this letter. If you do not refer your complaint in time, the Ombudsman will not have our permission to consider your complaint and so will only be able to do so in very limited circumstances. For example, if the Ombudsman believes that the delay was as a result of exceptional circumstances. I have provided you with a link to the leaflet for your information to assist you if you decide to pursue this further course of action.

I got exactly the same response back fromantic quick quid almost word for word and the financial ombudsman still found in my favour.
Take it to the ombudsman you have nothing to loose.
The affordability will all be based on your income and expenditure at the time of the loans anyway and if these show minimal disposable income the loans will be judged unaffordable.
Take it further see what the ombudsman says quick quid will say anything to not admit liability.

Wow, barring one or two minor differences, that is almost word for word identical to the final response I have received from sister company Pounds to Pocket. I was a little dismayed (even though it’s already been sent to FOS) as it came across as though someone had taken the time to type an individual mail to me, however it’s clearly just a copy and paste job with a word/sentence changed in a handful of places.

yes this a typical fill in the gaps template response.
Sentences such as “When I reviewed your loan history I see that you held a total of 1 payday loan which given the low number does not exhibit financial dependency.” give it away – no one would write that sentence from scratch, they would say “I see you only had 1 payday loan which does not exhibit financial dependency”, but they just took the standard letter and plopped in the number of loans.

I was initially using a payday loan that ranged between £100 – £400. That was paid off (via using another payday loan company) and then was offered a flexi loan of £750 to which I knew at the time would help me clear off a few debts. I paid back sporadically although after two £96 payment I cleared balance with £750 only to then use again a month later – £200 – then £400 then £150…
I don’t know exact score number but I would imagine at that time I was ranging on fair / boarder line – good.

Thanks all for you feedback, I have since completed my online from to the Financial Ombudsman, to which I stated what my complaint was and what I want the outcome to be. I attached all correspondence from Quickquid and myself and have attached my copy of Statement of Account along with my bank statements from 2013 – 2014.
Now we wait.

i just need some advice pls. I got a response from adjudicator end of jan regarding my complaint against QQ . he said QQ wants to offer 500 pounds as a gesture of goodwill which i refused.. the adjudicator said he will further assess my affordability complaint and go through my bank statment,. on feb 22 i receive a letter saying that his findings is 4 out of 6 loans were unaffordable. yesterday i receive a call from adjudicator asking me if i want to accept QQ offer of interest and charges for only 2 loans. the refund equates £1672 inc interest but to subtract the principal i borrowed in my last loan (1,400), this will leave A refund of £ 272 and remove entry in my credit file QQ said that it is fair reasonable resolution to my complaint..
i dont want to accept the offer because although i dont know the exact amount ofthe interes and charges i paid off but i know that it is too far more than what they offered.. I hve 19 loans in total. maybe the 6 loans that the adjudicator mention in his letter are the principals loan that i took.. the rest are roll over.. i still kept all the loan history (loan ID, Funding date and loan amount ) but i dont have details of how much i paid in every roll over i did. What would be the next step if i didn’t accept the offer? or should i accept it as they said it is a fair reasonable resolution? thanks in advance.

That don’t make sense to me if they have said at least 4 are unaffordable why would you accept the offer on two.
I would fight it all the way and take it to the ombudsmen of I was you, you have nothing to loose as stated by a lot of people on here it is very very rare the ombudsmen will come back and say any less then the ajudicator and in a lot of cases they add more loans.
My opinion is don’t expect the offer.
However it’s your choice and other people on here might have better advic.

Made my complaint in April 2016 and after 7 weeks I received the standard offer of £150. As I calculated that I had paid approx £8,000 in interest from May 2011 to December 2014, I rejected the offer and went to FOS.
The adjudicator looked at my bank statements and credit report and rejected my complaint saying that because I paid on time they must have been affordable, and that £150 was a fair and reasonable offer! I was astounded so I asked for the ombudsman to review the decision.
The ombudsman notified me of their provisional decision February 2017, ruling that all interest should be repaid from May 2011. QQ then made an offer to refund interest of £3,928 including 8% interest. I rejected this and received the ombudsman’s final decision on 11 March 17 and on
14 March £9,513.29 was paid into my account.
So, it took almost a year but was worth it in the end.

Counter offered QuickQuid and got a no answer this morning, but already made my complaint with for anyway.
Total interest paid £470 over 2015.
QUICKQUID offered £100 I countered for £250(i disregarded first few) and they declined.
This is over 8 loans in the year. Amounts fluctuated as I was using other companies such as wonga at the time, I also had a credit card maxed out at 1500 and a 2000 overdraft at the time. They told me because it didn’t increase every time I wasn’t obviously dependant. I disagree. I was just taking the minimum I could survive on each month.

So QuickQuid offered me £100.00 goodwill at the time of my complaint, which I rejected and sent to the Ombudsman.
My adjudicator called me yesterday saying they’ve revised their offer too about £400.00 and this is without the adjudicator coming to a decision, which I’ve rejected again.
Haven’t really worked out what interest I’ve paid them but it would be a lot more than this, so I’m hoping this offer is their way of trying to get rid of me and they know the adjudicator will decide I’m owed a lot more too.

I have had payday loans through various companies and have used the FOS as a means to make my complaints.
They have been excellent in helping me through the process,allowing a sizeable refund from Wonga (which I was advised to accept)
Quickquid made an offer of just over £900 immediately but the adjudicator told me to hold out for more. We waited the requisite 8 weeks and on the final day QQ offered £1800.
The adjudicator calculated that the figure that he requested was nearer £3k.
The adjudicator is not allowed to advise me what to do,accept the offer or go to the ombudsman.
There is a 6-8 month wait for cases to be seen by the ombudsman.
I can wait for the money but my concerns are that QQ could retract their offer, or that they could go bust or something and I will get nothing.
I almost feel greedy holding out for a higher payout but I did pay in excess of £3.5k in interest.
I am a bit nervous waiting for all that time knowing they have offered a decent amount.
Has anyone been in a similar position where they have had an offer and held out for a bigger one?

I understand why this must seem risky – but we have never seen a case where an Ombudsman has offered LESS than a lender has offered. There is no sign of QuickQuid going out of business, they are a subsidiary of a lerge US company. Also many cases don’t wait that long for an Ombudsman.

I think I will try to forget about it and wait it out, after all I never expected to get a penny back from any of them.

I just sent a letter to payday uk stating they sold me in affordable loans I’ve had 3 in total with them and and various with others.
They have come back asking me to provide evidence of finanacial difficulties at the time but credit files won’t indicate missed payments as I always borrowed to get payments.
How can am I able to show eveidence of financial difficulty?

i wrote my complaint letter like the example below, then when they said no, i took it to the ombudsmen and won, basically it will all come down to income and expenditure each month, e.g. you outgoings on bills and living not leaving enough for the loans to be affordable. I think i got the template off Debt Camel, i think in relation to the question above just state income and expenditure was X at the time.
(I have had several loans from you between 2010 and 2013 totalling thousands of pounds. I had been borrowing more often and the amounts tended to go up each time. Your payday loans trapped me into a debt spiral, with the loan repayment taking so much of my wages that I had to borrow again from you and other payday loan lenders to cover my next month’s living costs, which trapped me further into a cycle of debt which got out of control.
For this period my income averaged about £1100 a month and it was unrealistic to be able to pay back the increasing amounts you offered me. At no point did your company do any due diligence and you should have highlighted that you felt these loans where unaffordable and unstainable and refused to give them to me. I also had dependants that relied on me for their basic needs including food, clothing, nappies and nursery ect.
My living expenses varied but were roughly: rent/mortgage £400 Council tax £120 Utilities and bills £150. Transport costs £75 Clothes £50 Food, toiletries, nappies £300 Child expenses £50 other debt repayments £300. Total £1,145 per month.
This shows that there was no way I could afford these loans. When I repaid them, I had to borrow more to survive the next month. You should have realised from my loans that my debt problems were getting worse and it was not responsible to continue to lend to me.
My credit reports and borrowing habits would have showed my other debts and problems including late payments / defaults / repayment plans. I also had to take out additional payday loans, defaulted on credit cards and agree repayment plans with loans due to the increased borrowing from yourselves which you took each month. This was unsustainable and irresponsible borrowing and created serious financial problems for me.
You should never have given me these unaffordable loans. I would like to ask you to refund the interest and extra charges I paid, and remove all traces of the irresponsible borrowing from my credit file across all three credit reference agencies. The Financial Ombudsman suggests that statutory interest is added to this sort of refund.
If we cannot reach agreement I will forward my complaint onto The Financial Ombudsman to reach a conclusion.

Hi all. After being declined an offer from QQ back in December, my case has been sown progressing with FOS through an excellent adjudicator.
Just found out today that they have ruled in my favour and upheld my complaint, so QQ have until the 10th April to respond. All 6 of the loans were deemed to be unfair and of poor judgement/controls, so looks like they may be making an offer.
Quick question though. Should I ask them to remove the loans from my credit file too? I can still see them on both Experian and Equifax credit reports.

I got another letter from FOS today saying that QQ did not agree with my adjudication and so it has now gone to an ombudsman for final decision. This may take up to six months apparently. Anyone else had this? Now worried that I’m not going to get anywhere.

“Up to 6 months” means just that, it could be less. From people’s comments in the last few weeks, it feels as though some lenders are starting to settle some cases earlier – if that is right it will be taking the pressure off the Ombudsman level decision so I hope your case may be quicker.
You said that your adjudicator had said all 6 loans were unaffordable. Statistically 90% of decisions are upheld by the Ombudsman across the whole service. The only payday loan complaints I can remember that have been approved by an adjudicator and then rejected by an Ombudsman were either very small (1 or 2 loans) or rather odd, very big gaps between the loans say.
As a generalisation – I don’t know anything about your case – Its likely that the worst you would get is the Ombudsman only deciding the later loans should be refunded not all 6. But the most likely result is that the Ombudsman will agree with your adjudicator.

This happened to me, two weeks later Quick Quid made me a offer, please see my comments above I said no then they come back and agreed with the adjudicator initial findings and settled.
Please don’t take thier first offer if they come back and offer you a refund on 3 loans or something silly, just respond back and say as the adjudicator found all 6 loans unaffordable you feel quick quid should refund all of these otherwise you will let the Ombudsmen make a decision.
As Sarah as said it’s very rare the ombudsmen will not agree with the adjudicator, quick quid make reasonable offers at this stage hoping you will agree!! Don’t take it unless you are really happy, I personally fell you should hold out.

I’ve waited 6months for ombudsman, but after emailing them 10 days ago then have sent me a final decision, so I would wait if I was you. I had a strong case and they offered me £150 then offered my adjudicator £ 545 which again I declined. Ombudsman just ruled the same as the adjudicator. Have now got 1 month to accept offer. ? Although the waiting is frustrating it’s so worth it.

Just got a decision from my Adjudicator about QuickQuid.
Loans 3-7 shouldn’t have been given to me so hoping for a substantial payout here on this one, need to cross reference with my Bank statements
To start with at the time of my complete QQ offered me £100.00 goodwill then without the adjudicator looking into it they upped it to about £400.00.
I’ve seen people say once QQ have agreed they are very quick at paying out, but my question is what are they like with agreeing to the Adjudicators findings?

I also had a good will offer of £100 on 5 loans (including 3 top ups). My adjudicator said none of the loans should have been given to me.
QQ disagreed but upped their offer to include the last loan and top up. I rejected this, and since they have come back to offer the last 2 loans and all 3 top ups which amounts to what I was expecting as the first three loans were small.
I would suggest standing your ground and going along with what your adjudicator says.

You need to work out how much you borrowed and take it away from the payments you made. It’s difficult to pluck a number out the air as it depends how much you borrowed each time and how often you rolled over etc.

re: QuickQuid Complaint. I borrowed £5088.00 in total paying an additional interest amount of £4667.00 on top. This borrowing included a £1200.00 flex account plus a couple of loans prior taken out in January 2012 which I fully settled with struggle by the end of August 2015.
I submitted my request for my statement of account on 14/08/16 to QQ. I received my statement of account on 18/08/16. I then submitted my Affordability Complaint on 20/08/16. I received my final response from QQ on 20/09/16.
I submitted my complaint to the FOS in the beginning of October 2016. They requested a copy of my credit file, bank statements and QQ’s final response. My adjudicator uplheld my complaint a refund plus 8% per year simple, remove adverse information on credit file and gave me their decision at the end of November 2016.
QQ disagreed with my adjudicator and it was escalated to the ombudsman. I received a letter from the FOS on the 2nd of April 17 that my complaint has been upheld by ombudsman.
I have sent my acceptance of FOS decision today although they have given me till the beginning of May to decide.
Would anyone know long does QQ take to refund?

I only ever had 7 loans with them and I don’t think any of them ever rolled over. Looking at your record, I see that your credit model score was never under the minimum approval threshold for any of the loans for which you were approved. Your credit model score is substantially higher the minimum approval score which shows that our affordability assessments properly ran per our internal policy.

The investigation of your complaint also considered all relevant information contained in your application. It was noted your monthly income was stated as £1225 per month. I compared your income to the average monthly repayment for each loan you took with us. From this I can see that the income you made during each loan with us was always more than enough to cover the amount you had to repay us for each loan and thus I cannot agree with you that your loans were unaffordable.
DEPENDENCY
You are claiming that you were dependent on loans. Yet if you were dependent on taking out one loan to repay the other then you would have taken out numerous loans, for equal or increasing loan amounts, and with very little time between paying off one loan and taking out the other. When I reviewed your loan history I see that excluding loans which you repaid early, you never had more than four consecutive loans (< 15 days between loans) where the loan amount increased over the prior loan amount.
In addition, the principal amounts borrowed fluctuated throughout your lending history. If there was dependency we would expect to see constantly increasing amounts in order to cover the prior loan interest and principal. There were several instances where the loan amount you applied for actually decreased from the previous loan which shows that you were not relying on one loan to repay the previous loan.
In fact, there were large gaps in your borrowing history. There were 391 days between your 4th and 5th loans, further demonstrating that you were not simply taking out one loan to repay the next one.
CONCLUSION & OFFER
Therefore it is for the above reasons we cannot agree that QuickQuid irresponsibly lent to you.
However, while we do not uphold your complaint, in an attempt to resolve this issue and as a gesture of goodwill, we would like to make you an offer that we believe is fair and honest. In full and final settlement of your complaint, we offer to:

This is the exact same response I got. I’ve taken to the fos but no word yet. Like you I had only 8 loans and got the same goodwill offer. As I said I’ve taken it further but as of yet adjudicator hasn’t came to a decision as I still need to submit statements etc. I’ve heard that you’ll never lose an offer. It’s exceptionally rare for an adjudicator to go lower than an original offer.

This is QQ/PTP’s fill-in-the-numbers template reply. A lot of it is carefully selected to pick out certain points whilst ignoring others. So;
– Loans over 6 years old are being considered by the Ombudsman. You can ignore the reference to the FCA’s rules;
– How QQ made up that score no-one knows and so it can’t be verified. I suggest you ignore it and think what your credit record would actually have shown when you were being given loans by them – defaults? late payments? a lot of other borrowing?
– it is impossible to tell from your income whether a loan was affordable. I don’t think PTP used to ask customers about their expenditure – if they had they might have seen why you couldn’t afford the loan! if you weren’t asked, this is a point to make to the Ombudsman.
– “you never had more than four consecutive loans (< 15 days between loans) where the loan amount increased over the prior loan amount" let me rephrase that as "you had 4 loans where you borrowed more very quickly after repaying". - their yardstick of less than 15 days between loans was invented by them. What matters is if you could get through the the whole of the next month without borrowing again. - there is no reason to exclude loans you repaid early! Many people repay early because their payday was earlier one month or because they took out a bigger loan with someone else. It doesn't mean the QQ/PTP loan was affordable. - there is no reason to not count times where you borrowed the same amount again! or where you borrowed less - the point is you couldn't repay their loan without further borrowing. - "There were 348 days between your 3rd and 4th loans" could be rephrased as "there was only 1 large gap bewteen loans" ... sounds quite different that way, doesn't it! It sounds as though you borrowed quite a few times. Do you know how many loans you had? How many were older than 6 years old?

Quickquid have offered 621 on only two loans-why would qq only make an offer of 2 out of 6?. I have declined the offer

So you had a series of loans, all for the same amount, every month for 6 months within the 6 year period – how many months before the 6 years period? I’m not suggesting you should be claiming for these, but they support the idea that you should get a “full refund” for all the loans within the 6 year period.
I assume the interest was £100 on one loan for a month … were any of these rolled? Even adding on 8% interest I’m not clear how 4 loans can get up to £1200. If the other two they aren’t refunding are similar, you would expect to get an extra £600 refund if they were included.

Hi sara thanks yes the loans towards the end were rolled over….late fees etc which how they amounted to that. The ones that qq have disputed are the ones i paid back without having to roll over. I had 4 loans prior which jurisdiction was held against all taken out monthly but for smaller amounts of 100.

You will be fine, as mentioned above not very often an ombudsmen overturns an ajudicator, also doesn’t matter the company if it was unaffordable you will get a refund.
I won against quick quid after they told me to bugger off, and the adjudicator found in my favour on Wonga which is with the Ombudsmen now.
I’m so happy so many people are putting in complaints there companies preyed on the desperate and vulnerable with no oversite!!

I first started my claim vs QuickQuid back in June 2016. In November 2016 I received word from the Adjudicator that they agreed with my claim and that all loan interest should be refunded to me totally over 3.5k! Since then I have heard nothing, I have spoke to the Adjudicator on the phone who doesn’t seem to know what’s going on other than “Its with our legal teams”. This is now nearly a year, has anyone else been told the same regarding QQ?

I complained to the FOS at the same time as you and waiting for the ombudsman since November… they’re trying to come to an agreement with QQ to look at older loans but they are digging their heels in … the legal team are looking at the cases to see if they can apply the 6+3 rule

QuickQuid rejected my complaint, as well as both adjudicators that ruled in my favor (my first adjudicator who ruled in my favour against Lendingstream and Sunny moved departments halfway through QQ complaint, the second one picked up the complaint and agreed totally with the first adjudicator’s decision to repay everything). Based on QuickQuid’s own calculations, I paid £1,216.73 in interest across 2 small loans and a Flexicredit account which ran for almost 2 years. Today, the adjudicator came back with their offer- they still don’t agree they did anything wrong but as offer 50% of the FlexCredit interest £539.67 and to remove the entire FlexCredit loan from credit file as a gesture of goodwill. I rejected and waiting to hear further steps. Hoping the offer means that I have a good case….I wonder how long it takes to get the case to an ombudsman

Hi quick quid did the same to me, I asked my adjudicator to ask quick quid to reconsider as I was more then happy to wait for the Ombudsmen, 2 days later Quick Quid stated they did not fully agree with the findings but agreed to pay the whole refund as a matter of good will and recall the debt and remove from credit reference agencies.
Wait and see or alternatively ask them to reconsider.

My complaint against QQ took a while to be picked up, but once it was I was happy for the few loans older than 6 years to be excluded, in order to speed things along. My adjudicator agreed with me that the majority of loans shouldnt have been issued, wrote to QQ who then disagreed. The adjudicator is now telling them once more that she has not changed her mind, in effect giving them 2 more weeks to agree or it goes on to the ombudsman. It sounds like the adjudicator is trying to give them every chance to reconsider and agree to their findings.
I so far haven’t had any further offers from QQ, so will see what happens..

Hi, my complaints are in. They are huge but I had quite a good salary so don’t know what to expect as I was jockeying multiple facilities on different dates to repay one another. We’ve all been there haven’t we. I got the standard reply from QQ and p2p with statements quite quickly but then asking for payslips etc but my claims are for 2011-2014 so I just sent them photos of my noddle credit file that is like a horror movie. Anyone else tried that tactic? I really don’t want to go down the FOS route and wait six months, I just want half of all interest back. Full total is 34k so even 10 would be good. Thoughts anyone, Sara?

No, it’s a confidential service. Your employer won’t be told. Decisions that go to the Ombudsman level are published, but the consumer is referred to as Mr F, not by name.
Hopefully at least some of your claims will be settled direct, but with large cases that is less likely.

I made a complaint last year to QQ it then went to the financial ombudsman who went in favour of QQ this confused me as I had already won to complaints with wonga and sunny. Would I be able to raise the complaint again with QQ or the ombudsman.

Anecdotally most lenders seem to say 1 year, so that should fine. Go through a broker and tell them the issue, not direct to a lender.

i have a complaint with FOS currently awaiting adjudication due to stalling tactics from QQ, FOS claiming they are still in dispute over their interpretation of the over 6 year “ruling”. i’m hooing for a positive result looking at other comments on here but understand this could be a long wait…

My adjudicator has got back to me with an offer from QQ. A seemingly random refund of interest & charges on my 6th, 7th and 10th loans (of 11 in total). This would be £4500, although total interest and charges paid on all my loans was £7500 the early loans were smaller amounts and over 6 years ago, which I said I was happy to ignore.
So I have some thinking to do over the weekend, but am tempted to accept it, and is still very much better than the original £200 ‘goodwill’ offer they made !

On loans 8 and 9 I paid off quickly and only paid £221.25 interest. Loan 11 seems complicated, because it’s got the same ‘base loan’ reference number as loan 10. So it must’ve been a flexi loan type, and difficult to understand which borrowing the interest and charges relate to. If that makes sense.
Looking at the 6 years and older loans at the start, I have paid £538 interest and charges on those. So it does seem that this plus the £221 for loans 8 & 9, plus the offer of £4500 is still a way off the £7500 I’ve paid in total.. (Im shocked at how much this accrued over time). But it unrealistic to expect all of it back.. it’s a tough decision but am pleased to have got the offer from them

I made complain to QQ two weeks ago. I have calculated that I had about 26 loans ( might be more !! ) for amount £10750 in total – between 2012-2014. I am wondering if you are able to advise me how much money should I request as a refund? I do not want to take too low offer.

I don’t know. I got these loans from my bank statement. I have just asked for a list of my loans from QQ account.
calculated 8% interest = £4125 plus 1250% APR of £10750 = £8559
I hope my calculations do make sense.

So you borrowed £10750. Do you know how much you repaid in total? Were all the loans repaid?

All loans had been repaid. This amount of £10750 is total that I borrowed between 2012 and 2014. I haven’t got all repayments on my bank statement. It is possible that I repaid some loans by credit card.

Ok, you can’t calculate what interest you paid then, you need to wait until you are sent the loan details by QQ. If they make you an offer before this, tell them you can’t consider it without the list if your loans.

I have a quick question about time limits on loans if you can assist please?
I have a complaint with QuickQuid which was submitted on the 10/01/17. Surprisingly they took the full 8 weeks to reply so my complaint to the FO was not submitted until the 03/03/17. QuickQuid are now objecting to the loans taken between the 10/01/11 – 03/03/11 being included as they are over 6 years old. (First loan taken 31/01/11).
Surely this can’t be accurate when my complaint was submitted to QuickQuid within the 6 years…?
Any advice would be appreciated.

Can anyone provide any information regarding the current dispute between QQ and the FOS and the over 6 year ruling please?
what i don’t get is why they are claiming they are still in dispute when there are some comments on this site, and others, where claimants are reporting they have already had refunds from loans older than 6 years via the FOS… why have they been adjudicated on if they are still in dispute, surely the rule should apply universally?
Is this the FOS simply trying to palm off the query temporarily due to massive demand?

Well I don’t have any hard information, but so far as I understand it, the FOS is talking to lenders about a few cases in the hope of getting an approach agreed that will be generally useful in other cases.
This has to be case by case – the FOS will want to know that someone has only just become aware that they can complain. It is very unlikely to ever be a “universal” rule and that is not what the FOS is after.
One major lender has apparently accepted and paid out on some of these cases. This obviously encourages people with loans from other lenders to think there will be a good resolution for them at some point.
It certainly isn’t the FOS try to palm off queries due to massive demand. These queries aren’t going anywhere.
