If you want to get a refund for “unaffordable” payday loans, the first step is to complain to the lender. Often it’s simple as the lender has a Complaints section on their website, but some have been taken over or the website isn’t there anymore, so here is a list of their email addresses.
For all these emails put AFFORDABILITY COMPLAINT as the subject of the email.

There are literally dozens of payday lenders that have gone without trace. The above are just some of the ones people have asked about. There are also lenders who were never authorised such as Loans4U / Loans4You who you can’t take a complaint to the ombudsman about.
The info here may not be up to date. so the safe thing is for you to look in the company’s website to see how to make a complaint or what form to complete if the lender is in administration.
If you can’t locate the website, talk to the Financial Ombudsman about these firms.

A good place to try to track down old lenders is the FCA Register, as this lists firms’ brand names as well as their company names and also sometimes shows details for firms that have ceased trading.
If you still aren’t having any luck, then try the Financial Ombudsman’s complaints line – they are very friendly!

I sent a complain to 1st stop and they reply the same…
I went trough my bank statements and realize that my loans were issued by payday 1st stop loans . They deposited the money in my account but when the repayment was due , 1st stop home loans was the company taking out the money.
Im sending my complain to FOS to have a look at it .

It says that 1st stop payday loans was previously clear recoveries ltd.

Hi Joanna , I had to emails back from vivus , one from info@ vivus which just said this email address is not monitored anymore and one from George Taylor @ vivus ,,, I sent my complaint again to the George Taylor one and have no response as of yet ,,,, however I do have bank statements which are quite clear in showing I took out a second loan with them to pay off the first ,,, so I hope I have a good case ? I have also emailed MMF and asked them to stop harrasing me while my complaint is being looked into ,,,,, anyway fingers crossed

I’m starting my claim against a few that include Wonga, PDUK and Lending Stream.
I have on my bank statement a company called W Ltd T/A AS P SW crediting my account and PayDay Overdraft withdrawing. Can’t find any info about the company to claim against them and can’t see nothing on the list. Can anyone advise?
Also, during my peak borrowing back in 2013 I used a 6-7 different payday loan companies. Taking out loans to pay another and also had a terrible gambling problem as a result. My smallest loan with Uncle Buck £285 defaulted, ended up going to court and a CCJ was awarded against me. This has since been marked as satisfied as i had no choice to pay. Do I have a case to have the CCJ removed from my credit file given my circumstances at the time?

It sounds like this company https://www.fca.org.uk/news/press-releases/fca-decides-cancel-payday-lender%E2%80%99s-interim-permission-and-ban-its-sole-director. You won’t be able to get a refund from them.
Complain about all your other lenders, including Uncle Buck. It’s not possible to delete a CCj from your credit record without it being set aside. I would be surprised if the Ombudsman decides that should happen.

Hi last week I emailed Money Plus – if you google Cheque Centre top result is their website with contact details for Cheque Centre. They replied telling me they were in no way affiliated. I googled again and the site now says page not found.
I’ve heard (if you go back through pages on this site) if you go to the Ombudsman there is no chance of getting your interest refunded in full but small chance of getting a token payment from the administration company. As the company has gone into administration all moneys have gone to priority – as in Cheque Centres creditors, there is nothing left for much else.

Has anyone successfully claimed against Kapama/Oops previously Mini/Micro credit?
I never heard of them until I looked at my credit file, I emailed them when the notice of assignment was sent to me and the breakdown of the whooping £861 of an original £100 loan which I only received £80. There was £515 of attempted charges, what even is this?
I know all you guys have or are in the same boat here so any advice on how to handle this account would be great, I am about ready to tear my hair out and cry.

Hi I had the exact same problem with these last year. Unfortunately minicredit are no longer in business so kapama/opos now own the debt. I went through the complaints process with this last year and when going the FOS managed to get the balance of £400 reduced by £80. I only had a loan for £100 to which I received £80 but when I calculated all the interest and charges I had paid I had literally cleared the originals loan and more. What I am now paying is just interest. I would suggest trying to make a complaint as you may get a better result but you have to make the complaint to opos… that’s what I did. I explained the affordability etc but if you have a complaint about opos itself the outcome may be different to mine altogether. Worth a try.

Ps the attempt charges are where they have tried to take payment from your account so many times without success… mine wasn’t too bad and this is where the FOS managed to get a reduction of £80. I don’t want you to get your hopes up but you may end up getting this figure reduced

I have had a response from 1st Stop Home Loans saying that they have no record of ever giving me a Payday loan. Looking at my bank statements I had three loans from 1st Stop Home Loans. They have responded by saying that previous trading names for Clear Recoveries Ltd are not connected to the current First Stop group Ltd. I’m confused.
Is this the end of the line for this complaint? Or should I go straight to the FCA with the information I have? Any advice gratefully received!

I got a loan with Avant Credit which I’m still paying, I was on a debt management plan when I got this loan and was also suffering anxiety and depression. Could I still put in a complaint? I’m having to spend on credit cards to cover my monthly costs too.

Yes you can. Have a look at your credit record now and work out what Avant should have seen when they looked when you applied for the loan – there would presumably have been defaults and arrangement to pay markers. In this situation they shouldn’t have given you a new loan for new purchases. And if you said you wanted to consolidate date, they should have enquired more, as consolidating debt when you are in a DMP and interest is frozen doesn’t make any sense.

Hi, I contacted Avant and they said because of what my expenses said on my application form the loan they gave was affordable despite me borrowing on credit card which were nearly maxed out and on a debt management plan they deemed the loan affordable. I have looked at their application form now and it states include all debt for your monthly outgoings. I have a copy of my application and it doesn’t state this on the monthly outgoings section so I didn’t include it.
I have made all payments on time only because I didn’t want a missed payment on my credit file because I’m looking to get on the property ladder and I was still borrowing on my credit cards.
Should I still pursue through the ombudsman. I have finished my DMP now but I don’t think I should have been given the loan in the first place.

Definitely send it to the Ombudsman. Tell Avant you are doing this. The fact that you have a copy of your application form and it didn’t say to include other debts is a very good point – they have clearly changed the form as they realise the old one wasn’t accurate. Aavant should also have checked your record, and if that showed debts that you hadn’t put on your form, then Avant should have stopped and looked into your situation in more detail.

Hi ya
I recently realised I could claim irresponsible lending after 11 companies lent me £19,000 over 15 months and I payed back £23,000. At the time I was 2 years out of a bankruptcy which was still on my credit file. I had a good job but once I took out one I was caught in a spiral, at my worst my wages 3K was going in and straight back out so I had to borrow again.
I hope I can get some back but still embarrassed about being so stupid, finger crossed.
Can I ask what to do if a company say they were a broker not a lender ?

I had only four loans with Vivus .Initially starting with a £100 loan then three consecutive loans upon repaying of £300..Is this a case worthwhile with about £210 interest on the three larger loans.

You can use the standard payday loan template letters above. Skip step 1 and go straight to step 2. Change the templates to make it clear you had 1 loan, or 2 loans, or 1 loan that was topped up – whatever actually happened to you.
Are Avant suing you or has it been sold to a debt collector? Have you actually had a Claim Form from the court or just a letter from their solicitors?

ok, it is ESSENTIAL that you also follow the court procedure to defend this case at the same time as putting in the complaint. You may be able to ak for the case to be suspended (the term in an english court would be “stayed”) until your complaint is sorted. I can’t help on that – try calling National Debtline as they have Scottish debt experts.

You can make an Application for the Action to be Paused by the Court when a Simple Procedure action is used. The form is here

You should also state you want to defend the action, otherwise they will just get decree (a Scottish Court Order). You will need to state why want to defend the action. I would suggest you seek advice from your local Citizen Advice Bureau, local authority money advice service or local law centre if you have to defend it as you may have to rely on what is called the unfair relationship test under the Consumer Credit Act 1974 and this can be complicated.

Sent an email to Capital Resolve (debt agency for Liquid Advance) on Saturday regarding 3 loans I had with Liquid Advance ( no longer trading), they have stated that the complaint is nothing to do with them. May I make a friendly observation? Your Template 1 is encouraging a very rude approach from your Customers whereby folks are sending accusatory emails to lenders who have never heard of them before. Could you not rather suggest that your Template 1 is for those folks who know who loaned them money and have an alternative DSAR-only request for those who have forgotten who they borrowed from and who they banked with at the time and therefore have no record?
It would make for a much more polite approach, don’t you think? Or is it fine to be rude to innocent parties? :)
Also, deleting negative information from your Credit Record is not something anyone can do. Wouldn’t it be great if that was possible? To cherry pick all the bad things from our Credit Files. Sadly, even GDPR doesn’t make that possible. GDPR does mean you can request Lenders remove all your Data, but this will not affect your Credit File, negative or otherwise.
For your information: Credit Reference Agencies have a lawful justification to collect, retain and share certain types of personal information without the consent of the data subject. Lenders refer to CRA’s for your Credit History and will be able to do so despite GDPR.

I have never suggested that people send the template 1 letter to a lender they haven’t used. If someone asks me how to tell which lenders they have used, I recommend they check their credit records and bank statements.
My template letters do tend to be copied out in other places but I am not responsible if one of those or a claims Management firm advocates a scattergun approach. Also I don’t accept that Template 1 is rude.
Your point about credit records is not correct. The decision about Wonga’s refunds in 2014 was that negative information should be deleted from loans that were being written off, see https://debtcamel.co.uk/wonga-warning/. It is now standard for the Financial Ombudsman to order that negative information is deleted for any loans that it decides are unaffordable. And it is, of course, good practice for a firm to apply the same approach that the FOS would apply.
This has nothing to do with GDPR and the right of erasure. I have never suggested that CRAs don’t have a lawful justification to retain and share information.

I think many feel a rude approach is very much in order, I have had like many some very bad experiences with these company’s. They were often rude to me and often harassed and hounded people with very underhand tactics, like phoning people upto 20 times a day. You maybe under the impression that I knew the rates when I took out the loan so should not be moaning but many people who took these loans out were desperate. This could be having no money to feed your kids , risk of losing your home. Desperate times lead to actions. Often the lenders them selves admit to their wrong doing, but many will try every trick in book to try and deter you from taking your case any further . I also think the tone you are using: “For you information” is very patronising especially as the information you are giving is incorrect.. I guess you have the right to defend as you call them the innocent parties but I prefer to defend the innocent customers.

Think I might just leave them alone then, unless the fo day anything about there conduct on my statements, mini credit used to try and get there money from my card and when they couldn’t they tried everyday for £1 when that went through applied for the rest .

Cash Genie have been paying out refunds where appropriate, definitely worth contacting them.
CFO Lending, no point I’m afraid. Harrisons bought them and have confirmed there will be no redresses.

I had so many loans /credit cards etc over a period of time and I honestly can’t remember it . It was only when I was going through my bank statements I saw it . I can’t see any payments made to them for a loan , could it be under another company name as I have lots of payments going out on a monthly basis for many loans /credit cards etc

Different money are in administration. I haven’t heard anyone comment about this for a while so I don’t know if they still have any money left to pay out. If you had a lot of loans from them, talk to the ombudsman urgently to see if this is worth pursuing now, if you delay it won’t be.

Send the QuickQuid claim to the Ombudsman – it will be slow but you may get a good result in the end!
MyJar – no need to send payslips – and the Ombudsman never asks for them. Bank statements, you don’t have to send, but it may help your case if you do. It is a good idea to get your bank statements as you will need them for the ombudsman, so start getting them now. It’s unusual to be charged much for them – often they are free, tell your bank why you want them.

Currently have 2 cases with the Fos at the moment and expect to be in for a long wait now. I was just wondering if anyone had ever tried getting a refund from Balmoral Financial? It was always with the same lender, Cheque Centre. I know they have ceased loans and I’m sure went into administration.

I contacted the Ombudsman like you suggested. They advised I raise the complaint with the administrator and get listed as a creditor.
I am in the process of doing this, but would appreciate some help from other forum members here.
As they are in admin, they no longer have my information and specifics. I used them over a period of 5 years and therefore trying to work out what my claim is for is proving difficult.
The administrator has gave me a 2 page form to complete where they ask for:
1. Particulars of debt (would this be interest on pay day loan?)
2. Amount of debt (would this just be the estimated interest?)
3. Preference claimed for debt – ??
4. Security for debt – ?
5. Total amount of debt – ?
I’m unsure what to put on the form, so any advice or guidance would be greatly appreciated.

You could talk to National Debtline on 0808 808 4000 about what to put here. I haven’t seen this form before and am not a solicitor or an accountant…
If I had to complete it, I would do the following:
1. Say the debt arises from a complaint for irresponsible lending as CC never established if you could afford to repay the loans and it is in line with the typical award – a refund of the interest paid – ordered by the Finanical Ombudsman in these cases
2. estimated interest – attach a list of your loans (date, amount borrowed, interest) to back this up
3. leave blank
4. none
5. same as 2? not sure why this is different – it may be you can add on 8% statutory interest here? ask National Debtline)

Andy, I couldn’t agree more. These companies have treated people disgracefully.
Mr Lender used to phone my work multiple times a day if i had a late payment despite me telling them on multiple occasions (over the phone unfortunately) to remove my work number from their records, each time they told me it had been removed but then they continued to call. I told them my work email address should be removed as it had multiple people accessing the inbox, they continued to email my work email, they even sent an email with my full username and password for everyone to see. The fact the regulator hits banks so hard and lets these crooks get away with this is unbelievable.
I’ve started my complaints using Debt Camel’s fantastic guidance re affordable lending. Over the years I paid tens of thousands in interest with multiple roll-overs and top-ups. Debt Camel – Do you think i have any kind of case against Mr Lender for harassment given the above?

I’m just reading your experience with MrLender. I also had a really bad experience with them. Luckily for me I had left the job that I had at the time I applied for the original loan but I knew they would have been calling my old work non stop. Recently I’ve had a good experience with the complaints department. I sent off the first letter and received lots of communication from them to let me know they were looking at the complaint etc….They made an initial offer of writing off my balances but they said in the response email that they would respond consider if I could provide supporting evidence. So I submitted bank statements along with my credit file and they came back with another offer. Wrote off the outstanding balance, deleted negative information from my credit file plus I got nearly £400 back from them as a geasture of goodwill. Considering my initial loan was for about £500 I was quite pleased. Contact them with the first letter and you’ll be surprised at how keen they are to resolve for you.

Have you used a hire car from budget in the last 6 months or so?
They have a habit of adding ‘free’ insurance products to hires that start charging after 6 months if you don’t opt out or cancel them.
Otherwise, just call your bank and tell them you don’t recognise the transaction.
If it was taken by DD then you should be able to easily find out who it was and take back the payment and cancel any future payments.

I have had a response from Kapama today. They have said no to my complaint as they refer to one loan of £300. My history with minicredit i had over £7000 in loans from minicredit. Do Kapama answer for all of this or only what they/opos purchased from MC.
