Guarantor loans are very expensive. Often the lender didn’t check properly that you will be able to manage the loan repayments without having to borrow more.
If proper checks would have shown that you couldn’t afford the repayments, complain! There is a template letter in this article to help you.
You can get an existing loan reduced so you only repay the amount you borrowed, or get a refund if your loans have been repaid. If your complaint is rejected you can send the case to the Financial Ombudsman (FOS) who is upholding a lot (90%!) of guarantor loan complaints.

What is an affordability complaint?
A loan is not affordable if paying it left you so short of money you had to top up the loan, or borrow more from another lender or get behind with bills.
Does this sound like you? Then make an affordability complaint.
Just making the payments doesn’t prove the loan was affordable! You may have been repaying with difficulty, taking out other loans, because you didn’t want your guarantor to be affected.
You can complain if you are still paying the loan or if you have repaid it all.
If you win your complaint:
- interest is removed from a loan you still owe, so you only repay what you borrowed;
- your guarantor is released from the loan; and
- you can arrange to pay the remaining balance at a reduced rate.
When your loans have been settled, you get a refund of the interest you paid.
What should the lender have checked?
Guarantor lenders should have checked the loan was affordable for you before giving you the money.
The lender should have made sure you were likely to be able to make the repayments for the whole length of the loan.
Guarantor loans are large financial commitments. So I would expect a lender to have asked for evidence of your income, to have checked your credit record, and to have verified your expenses.
Some things a lender may have got wrong:
- It doesn’t matter if your guarantor is well off, the loan has to be affordable for you!
- You may have given said your expenditure was lower than it was, because you were guessing or desperate. The lender should have checked your figures.
- If you were self-employed or had wages that varied, the lender should have looked at how your income went up and down.
- The lender should have checked your credit record to see all your debts. If you had recently taken more loans or missed payments/defaulted, the lender should have been careful as your position was getting worse.
- When you top up a loan, the lender should check the new larger loan is affordable. If the current loan was causing you problems or your finances had got worse you shouldn’t have been given a larger loan.
If you feel there was something else unfair about your case, add that into your complaint as well!
What would a “fair solution” be?
If the lender or the Ombudsman decides the loan wasn’t affordable, this is what happens:
- The loan has been repaid, then any interest you paid should be refunded to you.
- The loan is still outstanding, then interest should be removed from the balance that is owing, so you only repay what you borrowed. Your guarantor should be released from the loan. The lender should accept an affordable monthly payment from you to repay the rest.
- Any payments made by the guarantor are refunded to the guarantor, not to you.
Will a complaint affect your guarantor?
Complaining won’t affect your guarantor if you carry on making the payments. The guarantor shouldn’t be told you have complained unless your complaint is being upheld.
If you stop paying the loan when you make a complaint, the lender may decide to get your guarantor to pay it. If you don’t want this to happen, you have to somehow carry on making the payments even though it’s hard.
If you can’t afford to carry on paying and you don’t want to hurt your guarantor talk to a debt adviser about your options in this difficult situation.
Making an affordability complaint won’t make things worse, and it may help in a few months time, but it isn’t an immediate escape from your problem.
Think about whether your guarantor also had a good reason to complain – see Complaining if you are a guarantor for details. If they win a complaint, they will be removed as a guarantor, which would take a lot of pressure off you.
How to complain to the lender
A template complaint to use
Don’t use this for Amigo of Buddy – see the update at the top of the page.
For all other guarantor lenders, including ones that have stopped lending, send your complaint by email – here is a list of lender’s email addresses.
Use SAR AND COMPLAINT BY BORROWER as the email title.
Here is a template. Change it to describe what happened to you and delete what doesn’t apply.
Only put this in if it applies to you: I took a top up of [£2,500] in [March 2018]
Add a reference number for the loan or give some other details such as your date of birth and your address when you took the loan out.
Please send me a copy of all the personal information that you have about me, including but not limited to all credit record checks, a copy of my loan application(s) and recordings of all phone calls from me. You have 30 days to reply to this Subject Access Request (SAR).
I am making an affordability complaint. This loan was/These loans were unaffordable for me and you would have realised this if you had checked properly before giving me the loan(s).
Delete or change any of the following so they are right for you:
[You would have seen from my credit record that I had recently missed payments/had defaults/was in a DMP/IVA.]
[I was on a low income/My only income was my pension/benefits.]
[You did not ask me for proof of my income or expenses and you did not ask about my expenses in detail.]
[I get ESA/PIP/DLA but you did not ask me if I had any extra expenses because of this.]
[I had a gambling problem which you could have seen from my bank statements.]
If you topped up the original loan: When I topped up the loan you should have seen from my credit record that my financial situation had got worse. [delete if not relevant: You ignored the fact that I had made several payments late to you.]
If you still owe money:[I am asking you to remove the interest from the balance so I only have to repay what I borrowed, release my guarantor and allow me to make lower monthly payments.]
If the loan has been repaid change that to [refund me the interest that I have paid plus 8% statutory interest.]
If you don’t want your guarantor to be told: [I want to carry on making the normal monthly payments because I do not want my guarantor to be affected. Please note I do not want my guarantor to be informed about my complaint unless my complaint is upheld.]
You have 8 weeks to respond to my complaint before I send it to the Financial Ombudsman.
If you would like some help with this, then go to your local Citizens Advice.
Definitely send bank statements!
It’s good if you can attach bank statements to your complaint. Send three months of statements before each loan or top-up and two months afterwards. So if you had a loan in August 2017, send statements for May-September 2017.
These statements will show how unaffordable your loans were. Don’t worry if there is gambling showing on the statements – that helps your case!
Don’t delay starting a complaint if you are trying to get your bank statements – just add them later. But now is a good time to get the statements as they can help your case.
Also get a copy of your credit record if this will show defaults, that your debts were increasing, that you had a large overdraft etc. Download this and keep it.
What to do with your personal information (SAR)
Copies of personal information (SARs) are often sent out by post, so if you have moved, make sure the lender has your new address. You should get the information within 30 days. It is often sent on a CD with a password.
This information is not the lender’s response to your complaint. Most lenders will send that separate from the SAR, usually a few weeks later.
You don’t need to do anything with the SAR, just keep it safe. You have asked for it now so that you have the details in case the lender rejects your complaint or makes a poor offer so your complaint has to go to the Ombudsman.
Taking a complaint to the Ombudsman
If the lender rejects your complaint, go to the Ombudsman
Don’t delay in sending a case to FOS – it has to go within 6 months. And while you have an “open” complaint at FOS, the lender cannot take you to court.
Lenders seem to reject many complaints and hope you give up! So don’t be surprised if a lender says No, the loan was affordable or We based our decision to lend on your application which was inaccurate.
If the lender says No, or you haven’t had a reply 8 weeks after sending your complaint, send your case to the Financial Ombudsman (FOS) the best way to do this is by using the FOS online form.
This is free to do and easy – you don’t have to quote laws or regulations. You can just send FOS the complaint you sent the lender. And if they have replied and said something that’s wrong, mention that as well.
You don’t need to go into details – a short FOS complaint is fine. If you want to add more details, read How Subject Access Request information can help an affordability complaint. But you don’t have to do this.
If only some loans are refunded, is this fair?
Sometimes a lender will say that just a few loans are unaffordable and remove the interest. Which is good, but should it be better?
If the rejected loans caused you difficulties and led to you needing a top-up, send your complaint to FOS and say you think the earlier loans too should be refunded.
Are you likely to win your Ombudsman complaint?
The Financial Ombudsman is agreeing with the customer on 90% of cases!
It is much simpler to win a case at FOS than a court case. If a lender has already started a court case against you, Citizens Advice can help you get the court case “stayed” (that’s legal jargon for put on hold) while you take an affordability complaint to the Ombudsman.
Complicated cases & help with guarantor loan complaints
If you want help with these complaints, Citizens Advice can help. Every Citizens Advice has access to the national Specialist Debt Advice Service if this isn’t something an adviser has come across before.
Leave a comment below this article to discuss what to do or talk to Citizens Advice if:
- your guarantor has made a lot of payments.
- you have been bankrupt, in an IVA or a DRO – read guarantor loans & insolvency .
- you have a CCJ from the guarantor lender – read guarantor loans & CCJs.
- if your debt has been sold to a debt collector.
Do not use a Claims Firm or a solicitor that is acting as a claims firm. There are two good reasons why you should avoid them:
- they will probably do a very poor job. They are not experts. They won’t put time into looking at your personal case.
- if you win a case but still owe a balance, this is usually just reduced. But the claims firm may expect you to pay their high percentage fee immediately even though you have not received any cash refund and still have the rest of the loan to pay.

hi Sara im a little confused – how can amigo charge for unpaid interest when there website claimed if you pay the loan early you save on interest – by taking a top up loan you are effectively paying everything back early and starting fresh with the new topup loan ? ( not had any results yet just been reading other posts)

Quoted from Amigo website it self ” We calculate our interest daily. This means you only pay interest for the time you have the loan.
If you settle your loan after 30 days, you only pay interest on those 30 days. So the sooner you settle, the more money you can save.”

Indeed. But they are arguing as the top up loan would not have been given the previous loan was never settled so you still owe interest on it. This is poppycock (to use a polite term). Because when you took the top up loan, they retained the money to settle the previous loan, and in the refund accounting for the top up loan you only get a refund of the interest paid not the capital. So you are still expected to repay the full amount borrowed on the top up loan even though you never received the amount of the money they took to settle the first loan. It is a nonsensical argument. And I expect FOS to say that.

Spoke to Amigo yesterday and the let the chap know mine still has not been looked at and complaint was raised in Jan. he seemed to think they have caught up with their backlog?
Either way, the man put me through to the complaints department and a lady said that the reason i have not received a final response is that i have gone to the ombudsman and they do not need to issue me a final response now they just have to wait for the FOS decision! I did think this was BS as they need the final response to work from. Went back to the ombudsman and they said this is untrue and they need to send this asap.
After going BACK to amigo to explain they have put the case as a high priority (apparently) so hopefully i hear soon.
Thought i would let you guys know that it seems Amigo are just making things up.

I send my affordability complaint to Amigo last july 14 , 2020 today i received their final response to my complaint
they sent me a redress offer but i felt like the amount they offer is not right can someone help me and check the calculation.
so here are the details of my loan.
1 loan of £5000 in Sept 29 ,2017
2 top up £ 9500 in may 3 2018 received £4766.30 as previous balance was paid off
3 top up of £15,000 in June 12 ,2019 received £ 6477.88 as previous balance was paid off
loan 1 at (243.95 x 36) paid 8months
loan 2 at ( 463.50x 36) paid 11 months
loan 3 at (592.87 x 60) paid 8 months

I am assuming they are refunding all three loans and that the guarantor didn’t pay anything.
On those figures, I make the interest you paid as follows:
loan 1 £1,678
loan 2 £4,116
loan 3 you have only paid 4736 so far, so still another £10,264 to pay until you have repaid the £15,000 you borrowed.
But the interest form loans 1 & 2 should be used to reduce that balance to £4,470.
So that is about £1,100 less than Amigo says your balance should be. The “no 8% interest” is right the way Amigo calculate it.
Have a look again at your numbers. If you have recently made a £592 payment that may not be taken into account yet, but that still doesn’t account for the discrepancy.
I suggest you ask Amigo to break down the “total interest” calculation by loan.

Hi Sara, some good news today. Amigo have informed the ombudsman that they are going to remove the interest from my loan and any payments I have made took off the original loan amount. It leaves me with about £6000 to pay back instead of over £20000. This is exactly what I wanted and it is such a relief after 8 months of waiting. I’d like to thank you so much for your advice, both to myself and everyone else who contacts you. You are a legend and there is probably a photo of you on a dart board somewhere in amigos offices. Hi Sarah I received my final response from amigo saying they are not upholding my complaint, in the response it says my earnings where higher than what they where and it says they’ve checked it with a third party(they must be lying as I know 100% my earnings where not that high) I sent it to the ombudsman 4 weeks ago does anyone know how long it is usually with the ombudsman as I haven’t heard anything from them just the initial acknowledgment of my complaint

Hi all, I wondered how long people have been waiting for a SAR from Amigo? I asked for one when I submitted my complaint mid-June but still haven’t received it.
They have this week rejected my complaint saying that the loan was affordable but no mention of when I will get the SAR. I have challenged this with them and they just say it will be sent as soon as possible (despite being way over the usual deadline for this) .
I have sent my complaint to Ombudsman in the meantime as naturally disagree with the outcome but having the SAR will hopefully be useful for my case.
Any SAR-related tips or insight would be greatly appreciated. Thanks in advance.

Keep checking with them to make sure it gets sent to you, my guarantor got hers 3 months after she complained, they said they forgot to register the request. I didn’t even get mine at all, I didn’t bother chasing because my complaint was upheld but nothing has come through till date. They should be able to provide you with a progress on DSAR request.

It wont make much difference having your SAR. They will either uphold your complaint or the FOS wil ask to see your business file. You can report Amigo to the ICO for failing to comply with your request. All the SAR will have in it is information regarding the loans you have taken out etc. I wouldnt go worrying about it. In general I agree, but for a few people the SAR can be very useful eg if phone recordings are helpful or they may show that Amigo’s constructed income & expenditure was a long way from accurate.
Also if you have the SAR and FOS is giving your case priority, FOS may sometimes start work using the SAR while Amigo still haven’t sent over their case file.

I took my complaint to the FOS and they emailed me 2 weeks ago to say that they were looking in to my complaint. I’m currently on a payment break “breathing space” with Amigo which is due to end 1st September. They have emailed me to say that if I want to extend it by another further month I can do so but they will start adding interest again. If I take the extension and the FOS uphold my complaint would they refund this interest too?

I decided to give them until the end of this week. I received a final response from Amigo yesterday evening, this is below (taken other parts of the email out as it was long).
Having looked at your observations and carefully considered the information available on our systems, we have concluded that Amigo cannot be completely confident that the loan agreements were affordable for you.
Accordingly, Amigo is prepared to offer you redress in respect of the loan agreements shown in the appendix. The redress provided will consist of:
The removal of all interest charges under the loan agreements;
A refund of any payments you may have made in excess of the capital amount of the loan agreements, along with 8% simple interest; and
The removal of any adverse information from your credit file in respect of the loan agreements.
Total redress I will receive is £3,583.58. Plus my guarantor has been released and the Amigo debt now cleared.
*Special thanks to Sara as without this website I would never have put in the complaint and would have continued to pay the very high repayments. I will very soon be debt free, so thank you again.

it’s not normally worth going back to Amigo – unless you think their decision is so wrong they have been looking at someone else’s case, don’t bother. Tell FOS you have had a rejection and send them a copy of it.

Took out a £9000 loan over 60 months 2 years ago.
Been paying £355 for 24 months and my balance is £8072. Shocking when you think after 2 years of paying it woth interest I’ve paid of £930.
finally had my redress upheld. I am awaiting my offer to accept.

The payments you have made are 24 * £355 = £8520
The capital amount of the loan agreement was £9000
So you haven’t so far paid more than 9000 – you won’t get a cash refund.
But your balance should be reduced to 9000 – 8552 = £448.
Your guarantor should also be released.
You can now arrange to pay the £448 in affordable monthly payments.

Hi Sara thanks for all the advice on here, I got my final response from Amigo and upheld both loans. So balance owing is £900 which is what I worked it out to be. This has been a absolute life saver. Now Amigo and Trusttwo sorted I will be £600 better off. Timeline for me was complaint submitted on 26th May and final response on 14th August. Just waiting on balance to be adjusted on my account.

Yes they have. I’m still on my payment freeze until September but once that’s up I will be expected to resume normal payments im presuming. I won’t be able to make full payments as I’m still furlough and even when I return it will be on reduced hours

So as your guarantor has been released, when the payment break ends, just tell Amigo you need to make lower, affordable payments. If you are on reduced hours that could be as low as £1 a month.
If you have other debts, talk to StepChange about a debt management plan. This Amigo balance is now just a normal loan and can go into a DMP.

Hi Sara I’ve finally received my SAR which come through email. When I spoke to amigo they pointed out that when I had my first loan they did a credit check and said I had a decent credit history. Well that’s wrong cause looking through the SAR I had quite a few Defaults and missed payments, so that lies. Also checking through the phone conversations they only sent the ones from the 19th February 2018 when I had my £5000 top up. There no phone conversations from the other 2 loans I had. Fisrt one 1st of December 2017 and the 29th of December 2017. Any ideas why they didn’t send the phone conversation from first and second loan

I’m the guarantor and I accepted on 25th June. I’m still waiting for my payment. The borrowers complaint was upheld for all loans and has not received their figures yet. We have both sent numerous emails and when they do reply they just say its being dealt with

There seems to be no rhyme or reason to how they are sorting through them. I just don’t understand why they are giving dates when they know they have absolutely no intention of sticking to them. This redress will be a complete lifeline for us, I wish they would have even an ounce of decency and sort what they’ve got wrong.

I was told (throughout 8 different phone calls) different dates each time, (originally due to pay out on the 15th June, and the last one was told 28th August) I continued to ring them up weekly and complain about the undue delay and finally this week managed to get my refund last night. I recommend you keep calling them out on the delayed times as it doesn’t take them that long to give out the money in the first place so a refund when they already have the figures should be almost instant.

So what happens when the guarantor paid off the loan in full (2yrs ago) and obtained a cheaper loan for the borrower? Which had been fully repaid.
I am writing to you to confirm that following an investigation into Mr D loan agreement with us, Amigo has decided to release you from your liability. This means we will no longer expect you to make any payments. Amigo will also contact credit reference agencies to ask that any traces of the loan agreement is removed from your credit file. Details of the loan agreement are shown in the appendix at the end of this letter.
Amigo is entitled to collect the capital on any loan that has been made, irrespective of whether that loan was affordable or not.
Amigo would also like to offer you a refund of the payments you have made towards the loan agreement, along with 8% simple interest.
You should be aware that if you accept the offer, we will add the capital element of your refund, totalling £10,128.23, back to the outstanding balance for the borrower to pay. This will increase their outstanding balance. In making your decision whether to accept our offer, you may wish to consider the potential impact on the borrower. You are able to accept the offer of a refund and use any proceeds to help the borrower repay the capital. However, that is a decision for you. it looks obviously as though you have been sent a standard template reply by someone that hasn’t noticed the loan has been cleared.
do you know how much you paid in total to Amigo, any monthly payments plus the settlement amount?

Yes made a complaint and that what they came back with. A full refund totalling £10k which I’d been insane not to accept. Free money as they say but reading between the lines they will pursue the borrower for the outstanding capital. I took out a loan for the borrower and the interest rate was ridiculous. The loan has since been paid in full. The borrower made about 12 months worth of payments towards the loan and never defaulted before I said enough paying that amount of interest.
So what I’m asking is, if I took the money would the borrower have a case to tell them to do one as the loan has been repaid in full so in effect there isn’t any outstanding debt. If Amigo got their fingers burnt and FOS smacked their bottom then surely that’s not the borrowers problem?

I think if you take the money the borrower could make a complaint that it is unfair of their loan to be reopened. I have not seen a case like this go through the Ombudsman but it is worth a try.
You haven’t said what your relationship with the borrower is. It is possible (but I am guessing) that the Ombudsman might feel that the borrower has more of a real complaint if you don’t live together.
At the same time they could also complain that the loan was unaffordable for them and that interest should be removed. So even if they lost the “unfair to reopen” argument, they would have less to pay back.

It’s my sister, and I’ve told her not to pay a penny to Amigo if they reopen the account. I will help her use the it’s already been paid off argument as it’s not her fault that Amigo got their fingers burnt and she has already paid the loan I got for her in full. As I said if Amigo want to refund me that’s not her problem as far as I’m concerned.
Didn’t FOS realise that when making their decision It would put the original borrower back into the position they were in in the first place? All this will do is make matters worse when they thought their financial position was getting better ffs

If your sister complains to Amigo that she couldn’t afford the loan and wins thus complaint, interest will be removed, so she will owe Amigo less than you are getting. Depending on whether she had a previous loan from them and how much had paid to the last one, thus could mean she owes them a LOT less than the refund you are getting.
It seems hard to blame FOS for this. She hadn’t complained to them and they knew nothing about her case.

Just got off the phone with Amigo, it’s utter shambles, I called up to ask for an update and the dude said he would send an email to them directly for an update, then I left it a while and called back and got through to the same dude, he forgot about me, and I asked again for an update, and he said he would send an email and I said yeah you done that last time, and he couldn’t find it. Left it a while, called again, someone els said they would send an email. Left it a while again and i called and got the same woman and she said she couldn’t find the first email she “sent” 🤔🙄 uhuh “sent”. It’s like they are just there to fob people off or something. I called up today to chase up my SAR request and she said it wasn’t on there but she would put in the request but can’t give specific time. Still waiting since January 4th for a final response, and been waiting since March from FO even on priority to give anyone my time frame atm.

Should I carry on paying amigo whilst waiting for them to confirm if they’re going to uphold my loan? Or will I cancel the direct debit? I really can’t afford to be paying it if I’m honest which is why I’m complaining etc. Will it hurry the process or not?

If you stop paying they will go after your guarantor. Do you mind that? If your guarantor has also complained that the loan was unaffordable for them then you could both cancel your direct debits at the same time?

When do you send your complaint to FOS? I had my redress in July but only sent it off to them this week. I’m a bit shocked they have not said or done anything about it yet. What would have happened if people had paid off their top up loans? Would Amigo have went after them and said oh you have unpaid interest and are still due us x amount because you topped up 🤷🏼♀️

So amigo never responded to my adjucator at FOS so they have said they will make the decision on 12th August still haven’t heard anything from FOS so contacted amigo and they have told me that the readdress team are sorting out the calculations does this mean they have accepted the decision from the FOS ?

Hoping for some advice here. I originally started my complaint with Amigo back in January 2020. They told me 8 weeks, this passed and was told another 4. Now nearly 30 weeks down the line I’ve had little to no contact other than delay emails.
Ombudsman picked this up finally on 3rd June and emailed to say Amigo had 8 weeks. Again this surpassed and I proceeded with FOS. FOS, due to back log stated it could be 4 months before a case handler picks this up.
Today I received a response from the complaints team that they are “awaiting calculations from FOS”
Has anyone else had this? What does it mean?
I’ve had no other emails from Amigo or contact from FOS after the email of upto 4 months for a case handler to pick it up.
Any help greatly appreciated.

For me to look at numbers I need to know
– how many payments you actually made to each loan
– how much you received in cash for each top up.
One thing to look out for when you get the numbers – there may be a deduction for “unpaid interest” because they did not uphold the first loan. Amigo are making some sort of convoluted argument that as they upheld the next top up loan the first loan was never properly settled so they are trying to sting people for the interest – it’s just wrong. If you get this come back here.

Hi just wondering if anyone’s been in the same position as me.
Currently on top up no 5 from a few years ago. Complaint been with amigo 8 weeks and just got the generic extra 4 weeks needed email.
I have an agreement with them from about a year ago to pay less than original amount/month. ((Was paying £395 but they agreed £230 (I had set up a dmp so I think that’s why they agreed) – by the way they’ve never asked guarantor for money during this agreement although the account does go into arrears and it’s recorded as such on credit file)) Anyway about 2 weeks ago the daily interest wasn’t being added to my account so called them up to see if it’s because of complaint. It turns out their ‘new’ policy is that if the account falls into arrears by 7xnormal payment. ie £2765 (7×395) they stop adding interest, apparently indefinitely so “there’s light at the end of the tunnel” according to the call handler (very generous of them) I’ve already paid back 12k so was a couple months from the interest cap anyway. Think it saved me £500 odd. So if people have fairly fresh loans and don’t mind the default it’s an option to save quite a lot in interest.
My account has now changed from ‘you can’t borrow money while in arrears’ to ‘you can’t borrow money from amigo’. Is this the change people are seeing when their complaint has been picked up?

I escalated my complaint to FOS in May and received an email Two weeks ago to say I’ll have up to a four month wait this month so that gives you an idea :)

Unfortunately it could be up to 4 months or more to be allocated. Has it been put on their system yet? You will get an email with reference and name of business you are complaining about if it has.

It shouldn’t make a difference. If you were going to pay her back from the refund, you may as well say Yes.
If you have paid c 14000 to a 10 k loan the balance should be cleared and you should get a cash refund of about 4k. (I am assuming you didn’t have previous loans.)
if you are still making payments, it’s best to stop these now.

Hi, I was hoping you may be able to shed a little light on my situation.
My complaint was upheld by amigo on all 7 loans (1 initial + 7 top ups) I was sent a final response email on August 17th.
My guarantor (mum) has not receives any correspondence however they state they have been in touch, several phone calls later they havnt which doesn’t at all surprise me.
In the email it suggests that I will receive
1 The removal of all interest charges under the loan agreements;
2 A refund of any payments you may have made in excess of the capital amount of the loan agreements, along with 8% simple interest;
and
The removal of any adverse information from your credit file in respect of the loan agreements.
It also states that my guartor will receive a refund of all monies paid.
They have not included any figures in my email and I am at a loss as to what I would be liable for should she accept her offer.
She paid the remainder off £8278 and a further £3985 12 months previous towards the final loan.

What is confusing me is how they will work out what I am liable for as over the phone they said it would be liable for the capital that she has paid towards it but not any interest. I had also made payments towards this figure including intererest.

so loan 4 – is it possible you took loan 5 before you had made a payment? If not, can you look at your bank statements to see what you paid?
Assuming you didn’t make a payment loan 4 (but I suspect you did, so please do check), then let’s look at what would happen if all the payments had been made by you, so you get some feel for the numbers.
In this case the the interest paid on each loan would be:
loan 1 £70
loan 2 £455 *
loan 3 £288
loan 4 £37
loan 5 £592
loan 6 £5,483
loan 7 £3,798 *
which is a total of £10,723
You mum only made payments to the loans 2 & 7 – correct? I put an asterisk beside them. All the other results must be correct for you.
Your mum has paid £12397 to Amigo (the payment to loan 2, the monthly payments & settlement to loan 7). She should be offered a refund of these plus 8%.
If she accepts this, what should happen is £12397 is taken off your account AND the interest on the loans should be taken off your account. This would then leave you owing 12397-10723 = £1673. If your mum gave you all the money, then you can clear the Amigo balance and be back with the 10723 refund.
Which looks like no gain whether she takes the money or not.
EXCEPT that your mum will also get 8% interest on top which will come to more than you would get (for technical reasons). This won’t be a huge amount as the loan was only paid off recently, but it will be a few hundred.
BUT I said that is what should happen. Some of the figures i have seen for guarantor refunds and the residual state of the borrower seem odd. I can’t guarantee that Amigo will do the calculations the way i have said. I don’t think this changes my point that you will be slightly better off if she takes the refund but I can’t be 100% sure.
One situation where the guarantor should definitely take the refund:
– where the rest of your financial situation is so bad you are thinking of going bankrupt or for a DRO. Here it’s better for her to get and keep the money and your remaining large debt to Amigo will be wiped out. But it doesn’t sound as though that is the case for you.
I suppose a possible one is where you have made your claim through a claims company. You will need to look at the claims company paperwork to see how their fees work out if the refund goes to the guarantor not to you. I can’t help with this.

I did this off my own back through resolver so no company involved. If they refund my mum her payments and then I am liable for the £1673 is that correct?
Would I also get a cash payout of the interest paid on the account? This is so confusing indont know why they’re sending some peoples responses wirh figures, some without. They habnt even sent my mums email and i got mine last Monday stating that they had already contacted her.

No – all the interest you paid on the earlier loans has gone to clearing the “hole” in the account that the payment to your mother made.
So my advice is for her to accept what is offered and then settle up with you. BUT I had forgotten that she hasn’t actually had an offer.
If she wants to accept she needs to get in touch with Amigo tomorrow and ask where her offer is?
I can’t guess if it will go faster if she just sits tight and you later say “she isn’t accepting it” as at that point amigo may realise she hasn’t been sent it and then send it wich would delay things more.

The DSAR can provide useful information for you at a later point when your case is being looked at at the Ombudsman if Amigo reject it.

Hi any help appreciated I had my first loan in April 2013 of £3000 I paid 7 x £146.37
I was then offered a top up in November 2013 Which I took, they then proceeded To close the first loan and open a whole new loan (£4250) not sure if that’s standard or not. I paid this loan off Monthly by using payday loans Or help from family Most months to cover the costs Total paid 32 payments of £167.98.
In July 2016 due to ill health I had to ask a family member to lend me the money to pay the debt off in full in 32 months I had only paid £800 off the debt everything else (over £5000) was interest.
I have read you can only apply for a refund if the loan was in the last 6 years but does that mean 6 years from the date I took the loan out or from when I paid it off? Thanks.

We received around £1400 for the top up loan and final payment was £3381 in July 2016. We changed the payment date a few times I think we only missed one payment date but paid the following day.

Could you please advise my mum has had a number of Payday loans with H&T pawnbrokers 13 over 14 months I believe & she definitely couldn’t afford them she is going to try & put an affordability claim in however I tried to do this on resolver & the company wasn’t found have you had anybody who has been successful with this company? I recently done the same and they rejected it. I have sent it to the FOS. Just send in a complaint about affordability and send bank statements with it. They went to the last week of the 8 as I suspected they would. Their response was laughable.

Hi can you advise me please I have taken out a loan and top up from Amigo, £10,000 loan I have paid £395.95 x 29 totalling £11,462.25 they are stating that the balance on my account is £8,085.08, I’ve sent a hardship letter requested SAR, I have asked for a settlement figure which they will not give me.as my MIL has kindly said she will give me £5,000 to settle, I offered this to Amigo the Directors have declined the £5,000 stating I would be better off ??? How ? as I’m unemployed and have been for 9 Months I’m robbing Peter to Paul every month , I’m suffer from depression and this I making me ill …. I have contacted the Financial Ombudsman after my rejection from Amigo, sent several email correspondence to the CEO , managers, complaints department no one is listening or responding. The just seem to want me to continue to pay the monthly amount so they can get the interest whilst a very small amount is paid off my loan.
What do I do now. ????

Is you MiL your guarantor? If not, who is your guarantor and what is their financial position like?
Have you looked at making an affordability complaint? The article above describes these complaints – when to make one and how they work with a template.
Obviously things came off the rails when you lost your job, but was the top up really affordable before then, back at the point you took it out – could you make all the repayments and still pay all your other bills and debts and living expenses?
And was the original loan affordable? For many people the difficulty of paying the first loan meant they got into deeper financial problems and then they took the top-up out. In that case, the original loan wasn’t affordable either.
The reason for asking this is if you can win an affordability complaint, your current loan will be closed and you will get a refund as you have already paid more than you borrowed. And the default on your credit record will be removed. So a massively better option for you than taking 5k from your MiL.

I’m starting to get really disheartened. I originally complained in April 2019. Obviously Amigo rejected my complaint. I sent this over to FOS straight away. I didn’t hear anything until June if this year, sent bank statements to FOS as requested and now playing the waiting game again.
Had an email from Amigo a week again stating they need extra time to look at my complaint. It’s just the one loan. How is it taking so long, everyone else seems to be getting their decision far quicker. 16 months is ridiculous

You are still just in the 6 month period to go to FOS. But Bamboo May say you accepted their offer so can’t now reopen the complaint. If you want to try you need to do this now, but keep your hopes low as it may not work.

Hi Sara thanks again for all your help previously I’ve successfully obtained refunds from Amigo UK Credit and Bamboo. I’ve got two queries I wonder if you can help me with pls. First is TrustTwo I’ve never submitted bank statements but my income and expenditure wasn’t completely corrected that I submitted as I needed the loan and they also fed me the answers so to speak on the call to finalise my income and expenditure. For example when they were going through my credit file the girl was saying your going to bring that up to date with this loan aren’t you. Is it worth submitting to ombudsman as trust two rejected my complaint. Second one is TFS Loans they came back to say they gave me the loan on the basis it would clear my debts and had I have used the loan exactly how I said I would then it would have made the loan affordable so they rejected my complaint. No they wouldn’t have and my credit filed showed defaults and missed payments etc with Trust two same as TFS. Was just worried about inaccuracies in income and expenditure submitted to TT and with TFS no using the loan to pay off something as I said in my application

What I wanted to know was if my first 2 loans are upheld but the last 2 were not woukd they take off unpaid interest? I currently have a balance outstanding at 8940 for a 10000 loan, this was not upheld and the one previous to this for 7500 not upheld but first 2 for 4000 and 5000 respectively were upheld. I’m still waiting on my figures.

I’ve been reading and commenting on this board since December last year! I submitted my claim in January and hadn’t heard anything. Numerous emails and calls chasing up got me no further. The FOS picked up in June saying 4 months to wait, then out of the blue today an investigator from the FOS called to say Amigo had been in touch and in principle have agreed to refund all interest and charges on all (3) of my loans! No mention of 8% interest yet, and I’ve had no figures through, but a very positive step. The FOS are aware of Amigo’s new interest calculation method and are looking into it. She said in my case, which is a very small number now, it shouldn’t apply as they are likely upholding all loans.
I will keep people posted once a calculation is presented to me. Thanks to Sara for all of the advice in getting me this far….one final push and this nightmare could be over forever :-)

Hi DLMB I’m the same as you. Had my complaint in since the beginning of march and not heard anything from amigo. Sent to FOS beginning of June and was told they were wateing for my case file. Got an email today saying amigo are willing to pay back all intrest paid on all 7 loans. FoS told me I should have a email from amigo today or tomorrow to get a brake down of there offer.

I sent my complaint in January 4th, got put on priority by the FO, they have had my case for a while, I’ve emailed them 3 times and 3 times they say Amigo has not yet sent over the case files to them so they will chase it up, it’s mental, they keep ignoring her. Congratulations on your ones, I’m hoping they hurry up and send over the documents because it’s getting beyond a joke now. Also still waiting for my SAR for weeks :/ I feel like my case is being forgotten lol

Exactly same thing happened to me and I had to send email explaining that waiting ages for business file was unacceptable. Supervisor referred to higher level in FOS and miraculously the file arrived 3 days later! Dont be afraid of expressing how the process is making you feel and the impact it is having on you.

I simply explained that the messing about from Amigo had gone beyond a joke and that my circumstances were not particularly good. A supervisor emailed me back and that’s when things progressed. It doesnt hurt to call them and explain your case.

I need really need some advice. I sent an affordability complaint to bamboo loans regarding my initial loan and my top up loan. They have responded on Friday and given me 7 days to accept their alternative option. Today is the 2nd day of that offer and I was wondering if I should take the issue forward with FO or not? They have offered to take £495 off of my £2103 loan as a gesture of “good will” as they feel that I could afford the loan comfortably. I wish I could include their response to make this clearer but do let me know what needs clarification and I will do my best.

We have come across countless people that have had amigo loans and many more, so would be extremely grateful if anybody would like to share their amigo stories with us.
I would also like to point out, if anybody is still being affected by gambling addiction, then I am here to help in any way I can.
I myself took out an amigo loan to gamble and had debts upon debts. So I can completely related and empathise with anybody that has struggled.

I agree that guarantor loans also are. If you don’t mind the sweeping generalisation, people with a gambling addiction tend to be over-optimistic, either that they will win big and clear everything owed or that they are going to kick the habit next week. And their guarantors may have no idea gambling is an issue – people tend to suspect if their son or co-worker has a big drug or alcohol problem, but gambling is the secret addiction. So the guarantors may be deceived and indeed the borrowers my be deceiving themselves, see https://debtcamel.co.uk/guarantor-loans-extra-protection/.
I hope that in future lenders, including guarantor lenders, make proper checks that would detect gambling, eg through Open Banking. Cutting off/reducing the supply of funds for gambling will mean less wrecked lives.
PS have you looked at whether you yourself would have a case for an affordability complaint against Amigo?

Hi Sarah, currently 24 weeks in waiting for a response (yawn) thanks too this website hopefully some good will come from it.
In a very large portion of cases guarantors become affected others, and are deceived and manipulated into taking these loans out. Gambling related harm affects much more than just one person in each case. Estimates currently say that 10 people are affected by each person with some level of gambling addiction and affected others need just as much help and support. There is an all party parliamentary group campaigning for affordability checks within gambling which will go some way in protecting those most vulnerable, and the people around them. Lets hope that goes through.

And often someone may not mention gambling in a comment if they are asking about how much redress they could get, or what the timescales for a response are or something else which has nothing to do with gambling as an issue.

I initially took out a £3000 loan in 2006 when Amigo was known as FLM. In June 2008 when the name was rebranded to Amigo I was offered a £5000 loan over 48 months which included the repayment in full of the existing FLM loan and repayments of £197.89 per month. I continued to pay the amounts monthly but my circumstances changed and missed a number of payments which my guarantor had to pay. The account was eventually passed to a debt collection agency and my guarantor paid the outstanding amount in full, I reimbursed her accordingly in June 2017. Unfortunately, my guarantor passed away last year so if a claim for miss selling is successful who gets the redress payment?

You can’t win a claim for the 2006 loan as the Ombudsman only had jurisdiction from April 2007.
The later loan, do you have any evidence about what you paid and what your guarantor paid? Also about your circumstances when you took the top up loan so you can show it was unaffordable? Sometimes with very old cases it can be hard to show what happened.
Amigo are likely to reject it because the loan was more than 6 years ago. If they do, send it to the Ombudsman who typically decides they can look at older cases if you have only recently found out you can complain.
If you win the complaint, I have only seen one case involving a deceased guarantor, so based on that Amigo is likely to offer the refund to the guarantor’s executors to accept or decline. If you can show the executors you repaid the money, I would expect them to decline because if they don’t you would have a potential court case against them.
If the executors can’t be found or don’t reply, my guess is the refund goes to you.

A quick question in regards to amigo. I’m expecting my refund from amigo but with the new loans I taken out against the loan, would I receive the refund for them ?
For instance the original loan amount was 4500 from which I took out a new loan of 6000 and then 7000 and then 9000. So when the new loan is taken out, the 6000 pays off the 4500 and I receive the difference. Would I receive that 4500 as a refund as it is essentially a payment made by myself against the loan ?
They have offered to refund all of the loans. Just waiting for the amount

ok, so the starting point is that you only get back the interest you have paid on a loan. And if you still owe a balance on the last loan, interest is removed so you only have to repay what you borrowed.
I can help you look at the likely refund amount if you know the numbers. For each loan I need to know:
– the amount borrowed
– if it was a top up, the amount your received in cash
– the monthly payments you actually made eg 7 payments of £178
I assume your guarantor didn’t make any payments?

I can’t find the email exactly stating all the figures I had.
Roughly it’s around :
£4500 initially taken out -£4500 receives
£6000 top up of roughly £1400 received
£7000 top up of roughly £900 received
£9000 top up of roughly £1500 received
I made around 25 payments of £355 off the 9k loan and then 2 payments of £160 towards 9k loan
1 payments off £255 towards 6k loan
3 payments of £266 towards 7k loan
6 payments of £171 towards the 4k loan
Guarantor didn’t make any payments

So assuming your guarantor didn’t make any payments, I make the interest you have paid as follows:
loan 1 £3,998 * not being refunded
loan 2 £2,082
loan 3 not yet repaid the 10k borrowed, still a balance of £4,037 to go.
So the refund from loan 2 will reduce the balance owed to £1955. Your guarantor should have been released so you can make a lower more affordable payment arrangement to repay this.
But you may want to take the complaint to the Ombudsman to try to get the first loan included. If it was, the balance would be cleared and you would get a cash refund of £2043.
As your guarantor should have been released, you can anyway make a lower payment arrangement whil an ombudsman case goes through.
And look out when you get the figures for a line saying “unpaid interest”. They may try to sting you for a deduction for that – Amigo’s logic here is weird and not in line with anything the ombudsman normally says so I am hoping that FOS complaints that is unfair will be upheld.

I’m not sure if i am working this out correctly – if anyone has any ideas then let me know but i work my redress out at 50 payments of my current loan interest to be £6833.50 (Not including then ten left) and the first loan they upheld the interest was £2142.82 plus 8% – I think thats right but if anyone has any other numbers let me know as its confusing me a fair bit.

yes that sounds right. The 8% gets complicated though.
Do you know what cash you received for the last top up? If you know that, i can say how much extra you would get by sending your complaint to the Ombudsman and trying to get the second loan refunded too.
Also look out to see if they deduct “unpaid interest” from your refund – they shouldn’t!

If all loans from six years ago are upheld, it should be pretty straight forward. The latest chunk have been upheld, so it’s just referring the older ones on and by looking at the credit report from back then, and my bank statements, I can’t see how it won’t be upheld. Prior to topping up two loans, I went into default on three account in the six months before, both times.
Anyway, will have to wait and see.
Doesn’t make sense Amigo want so many cases to go to the ombudsman, because I looked it up and they have to pay over £500 for each complaint investigated. Oh well, their loss.
Can’t wait for these years of stress to be over.

Some hope for anybody with a complaint with UK Credit,! I had heard that they are rejecting every case almost generically, however today at 7 weeks they have confirmed they are upholding my complaint in full. I have to say they have dealt with my complaint professionally and courteously and have were always pleasant and understanding when asked for updates, even if this had been a less favourable result I could not take that away from them.
Of course I can only comment for my own case but hope this gives others some Info / hope for non Amigo related. Good luck all.
