the 6 year and three year are as follows

they are excuses/reasons for vanquis not upholding ROP complaints

6 year—-it is over 6 years since the product was taken out

3 year—it is over 3 years from the point you should have realised that ROP was being charged to your account

it should be noted that neither the quoted 6 year or 3 year rule that vanquis have made such a big deal of will have any affect on the interest refunds which are to be paid—-that should be automatic

But I for one have every intention of pursuing vanquis for the actual ROP payments (which may be much less than the interest) and challenge the 6 year and 3 year that they are so good at quoting. I fully intend to pursue this through the FOS as a matter of principle as I strongly believe in my case at least ( I cant speak for others ) that vanquis were at the least economical with the facts

      • Louise says

Thankyou – Are you raising the complaint now? Will it be much less than the interest? they said to me the ombudsman cant look at the 6year rule – I strongly believe in mine too as I never remember signing up to it only when I struggled and they said they can give me a payment break but didn’t say due to ROP and didn’t receive the letters they told me they sent out so that’s why I didn’t complain before this 3 year rule?

        • Sara (Debt Camel) says

If you feel strongly you should have a refund of the ROP itself, I suggest you send your complaint to the Ombudsman.

I suggest you don’t pay any attention to this 6 + 3 stuff – it seems to be being very poorly described. It is up to the Ombudsmna to make the decision about what they can and can’t look at. At some point there will be a clear ruling from the ombudsman but at the moment we do not have that, so there is no point is spending much time in worrying about what Vanquis say.

          • Louise says

As it was an old account Sara I don’t have the account no but I knew in the end I had this ROP with them – they found the account and on the letter they emailed it states this account no xxxxxxx then the last digits will that do for the ombudsman? I do feel strongly about it but will I still get this interest. They told me no good going to the Ombudsman as they cant look at this as I’m under this ruling and weren’t regulated then? The letter that they sent via email makes no sense to me – sorry if I am acting stupid. ROP itself? They haven’t even said how much I have paid and have no statements as back in 2006? Would this be a lot in 18 months ROP or interest higher?

          • Sara (Debt Camel) says

“on the letter they emailed it states this account no xxxxxxx then the last digits will that do for the ombudsman?” yes that will be fine – Vanquis know what your account is and they are not going to lie to the Ombudsman.

“I do feel strongly about it but will I still get this interest.” you will get back the interest on the ROP automatically, taking your complaint to the Ombudsman asking for the ROP itself should not affect that.

When did you open the Vanquis account with the RP and when did you close it? I am not sure what your references to 18 months are to?

          • Louise says

The account was opened in 2004 and closed in 2006. The ROP interest was added the month after – this equates to 18 months I had the account with ROP for? I am taking the ROP charges itself to the Ombudsman – thank you they have issued xxxxxx then the last 4 digits for the ROP account so I will attach their email correspondence when I complain tomorrow morning :)

Thank you so much Sara for your advice and everyone else on here!!

          • Sara (Debt Camel) says

Ah, so when you wrote “have no idea how much I paid in interest for ROP – It was from the November 2004 they said until July 2016” that was a typo and you meant July 2006? That was why I was confused.

Assuming that is correct it may be that the Ombudsman will not be able to look at it as they had no jurisdiction over OFT authorised firms before 2007. But (a) I do not know if Vanquis, which is currently a bank, was OFT authorised in 2004-6 and (b) this is the Ombudsman’s decision to make, not Vanquis’s.

So it is worth sending your complaint to the Ombudsman but don’t get your hopes too high. The good news is that the interest you will get back automatically will in your case be more than the ROP itself.

        • CLINT says

I intend to wait until I have received my refund of the interest—that should be well within the 6 months deadline from the vanquis rejection

and for sara can I just say I earlier explained the 6 year and 3 year situation to someone—I believe this is being pumped out by vanquis to try to discourage customers from going to the FOS but they have upheld other complaints in similar situations—-vanquis are making a rod for their own back

and considering it is now almost 60 days since the FCA ruling they are not doing well and have a lot of work to do to try and fulfil the 90 days for existing customers that they stated

      • Sara (Debt Camel) says

“the 6 year and three year are as follows …
6 year—-it is over 6 years since the product was taken out
3 year—it is over 3 years from the point you should have realised that ROP was being charged to your account”

I don’t know if that is EXACTLY what Vanquis are saying and here the exact words do matter. But neither the 6 nor 3 year rule there is necessarily what the Ombudsman would apply in these cases. And it is the Ombudsman’s decision how they apply the time rules, not Vanquis’s. The Ombudsman could well decide that they will look at accounts which were opened over 6 years ago but which were not closed more than 6 years ago. And the three year point is from the time you became aware you had a cause for complaint, not the time when you knew ROP was being added.

  1. Hayley Anderson says

It’s good though that they are starting to send the letter out about the interest to people as it’s getting towards the end of April now and they are going to be paying out a lot of money. Fingers crossed will hear from them soon

    • Village Idiot says

Vanquis have said the average payout is (only) £180….which suggests they had a lot of sensible customers who would use the card and pay it off. Or lots of cards with low limits? I wasn’t either of them. Anyone who had one of their bigger limits and maxed out their card for any length of time will get more than £180 by my fag packet calculations!

      • Louise says

I wasn’t one of them either mine was maxed out and I recall the extortionate interest that sent me over my limit – Ive sent this guy an email who emailed me the letter just now in relation to the ROP – explaining you tell me you sold it incorrectly I am going to the Ombudsman as I did not know about this 6 – 3 rule and I never received any letters from you so the ROP and the interest should be refunded. Will keep you updated.

  2. Andy Penn says

    Hi,

Myself and my wife both have Vanquis cards and have had them since before 2009 for definite but I believe it was late 2007 when we applied for them. In Jan 2009 we received letter welcoming to the rop, we had not asked to have it added it just came out of the blue. Since before this it was listed as Ppi on the statement we just assumed it was carrying on this under a different name. Again we hadn’t asked for Ppi either. Can we claim back the rop payments as we were never told about fees /interest before it was added to the account. I understand there is an automatic refund due but I think we should also make a complaint about the rop payments as well. It would be a substantial amount for both of us as have had limit of £2500 for most of the last ten years. If it’s possible to complain How do I word the complaint . I wish I had seen this site a few months ago when the complaint letter template was here

    Many Thanks

    • Sara (Debt Camel) says

First thing is for you both to cancel the ROP on your accounts now!

Yes you can complain, first to Vanquis and then to the Financial Ombudsman. Your complaint is that you never agreed to either the PPI or the ROP and that you were not contacted by phone to explain what it was. Say you understand you will be authormatically getting a refund of the additional interest you have paid but you also want a refund of the ROP charges themselves.

In practice it is likely that the automatic refund you will get will be many times larger than the ROP fees you paid, so you should in any case get a good result! Look back in these comments at the amounts Rory has received a refund for and you will see that for old accounts the interest component in much the biggest part. NB I’m not saying don’t complain and ask for a full refund as you sound to have an excellent case.

The previous template was deleted at it mostly talked about why the extra interest was not explained to you – there is no need to make that argument any longer. It didn’t cover your situation withe the “PPI-ROP switch”. But you don’t need a template, you have explained your case perfectly well.

  3. laura says

As I have said previously vanquis have put aside 168 million for ROP interest. I think they have miscalculated hence the waiting game, but take as long as you want as it will mean bigger payment. As for the ROP it’s obvious they have been ripping customers off for years as most people didn’t even need it or use it , or even know they were paying it in some cases, I hope you all get big payouts after all this card was intended for the just getting by people, people who were struggling from month to month and they knew this but their shareholders were recipients of large dividends off the back of this absolute rip off payment. I suggest when you get your money back pay the your balance off and take scissors to the plastic.

    • Hayley Anderson says

Hope so Laura my limit was at 3.5k when I cancelled the rop took the card out feb 14 and by aug 17 I was at that limit, I cancelled the rop June 17 so god knows how much interest I paid

  4. Colin carpenter says

After seeing the article on your site, I complained after the FCA investigation and vanquis have offered me all of my ROP fees back plus all charges and all interest! Nearly £3k! So happy! Worthwhile sending in a complaint. Mine was about pressure to take ROP and perpetual indebtedness.

    Great website thanks!

  5. Andy says

Many thanks for your advic Sara, our letters to request cancelling the rop and request all of the fees back have been drafted . I will let you know how we get on

    • Andy says

      Small update

Received text this morning saying “ Thanks for your enquiry. I can confirm that you may be eligible for a refund of the interest from ROP which will we usually provide to you within 90 days.”

Cheeky though , they have ignored the fact I have cancelled rop and complained that never recieved call to explain rop And requested refund of fees

      Andy

  6. Stella says

I tried a compound interest calculator mentioned in an earlier post , if you paid approx 300 top 5 years ago and always ran a large balance it would now equate to around 2300 .

  7. Tony Wood says

Letter arrived today. Complaint upheld. £4901 refund. Balance cleared on next statement and cheque for £1500 within 28 days.
    Breakdown since 2012 .

    Interest £2595
    8% National Interest £204

Happy Days …… hang on in there folks, did all mine by E.Mail.

    Sara your a star.

    Regards Tony.

    • Sam says

      Hi Tony,

What date did you submit your complaint regarding ROP? I have phoned yesterday and tried to get an update and have been told my complaint is only 15 days old and they still have time to work on this? I am still just going to phone each week for an update so they know I am waiting.

      • Tony Wood says

Sent E.mail 21st March. Within 48 hours had hard copy receipt. Letter arrived today, dated 21st April. So month to resoluve followed by a month to repay. Two months from start to finish.

        • Sam says

          Hi Tony,

Thank you for replying, it might be that you still have an account with them then, as I cancelled and closed mine as soon as I was able to clar the debt.
I will continue to call, thanks.

  8. Tony Wood says

I did not initially complain, more of a confirmation letter about the miss selling and registering for repayment rather than wait for automatic payment.
It snowballed from there and Vanquis did the rest. Fair play to them, but it does go to show what a rip off it was and how it made up nearly the total card cost over five years.

    • Sam says

Yes my thoughts exactly, I took my card out in Oct 2012 I think and it started with a limit of £400 and then just kept increasing almost every 6 months to end up with me having a balance of over £2,500. Don’t worry I know I shouldn’t have spent it but it is worrying when I was only just managing the min payment each month yet they still increased my limit each time. I hope this works out well for me.

Thanks for your information Tony, it really helps, that knowing things are getting sorted.

      Thanks

    • Village Idiot says

Hi Tony, I’m really interested in your timings. I read your earlier posts saying you complained on 21st March and got an outcome 21st April. Oh good, I thought, any day now then, as I complained on 25th March.

I got two letters today, thought, here goes, but all they were was two identical ‘we are still working on your complaint’ letters.

Did you ever get a holding letter like that, and if so what was the gap between the holding letter and the outcome letter?

      Thanks

      -VI

      • Tony Wood says

        Hi VI

        E.mail sent 21st March
        Acknowledgement letter 23rd March
        Letter of Refund 20th April

        Acknowledgement letter stated Complaint Process

        1) Acknowledge complaint within five days, to include reference number and contact number.
        2) Resolve complaint as soon as possible , if not within four weeks they will write to you.
        3) If eight weeks have passed and not resolved or are dissatisfied then to contact FOS

The settlement letter states that even now if not happy I have six months from the date of the offer to complain to FOS.

I was just not prepared to wait for the standard refund of interest only, I wanted the lot back, but was amazed at the offer. Clears my card and give me nearly £2K on top. That said, money not in bank yet , so time will tell, but they do say will show on my next statement which is due in two weeks time. As they say Time will tell.

Doing this myself with the help of this forum, I have now tackled GE Money, and I am at stage Two with them . This site and Sara take all the praise I can give them.

        Cheers, hope that helps

        Tony.

        • Village Idiot says

Thanks Tony, so it sounds like I have just had the letter at 4 weeks, and you didn’t need to get that letter as they had sorted it for you by then.

  9. Sarah Sonnenstein says

Update. I spoke with Vanquis after my brother told me about this. I paid my balance off and closed my account last year. I had to let them know about my name change as I’m now married. I did this all in March. I also complained about actual miss selling.
They spelt my married name wrong, I sent them an email 1-2 weeks ago to get them to change. No response so I remembered today as I am off work to call to see if they had amended, which they have but to also be told that they had resolved and upheld my complaint and that I will be getting a letter detailing refund and also that my cheque will be here within 28 days. Now my balance was never any higher than £500. I took my card out May 2013 and close March/April 2017. My refund is £816 for Rop, interest, charges and 8%. For something I didn’t know about I am really happy with this amount. This might give an idea to some about what they may get!

    • Hayley Anderson says

Do you mean the credit limit was always at £500 or you never spent more than £500 from your credit limit?

      • Sarah Sonnenstein says

My credit card limit was £500 and I only ever paid the minimum payment a month normally!

  10. Dee says

Update on my ROP complaint (not auto refund). I complained on 13th Feb, day 56 was 10th April and an ex-gratia payment was applied to my account clearing my balance so I knew complaint had been upheld. I’ve been waiting for letter showing breakdown of the refund but still haven’t received anything so gave them a call tonight and got a very nice surprise
    Total refund is £2,213.08.
£858.04 was applied to my account clearing the balance and a cheque for the remaining £1,355.04 is on its way to me. Can’t believe it’s this much, so happy to end up with no balance and some money in the bank.
Card opened April 2013. Balance was constantly hovering around 1k with average ROP payments of £12 per month.
I will share full breakdown of the refund when I get it so you can see how much of this is interest only.

  11. Kim says

Hi everyone. This is all very new to me but have had a vanquis account for years. Is there anyone that could be so kind to help me write/draft a letter to vanquis please? Sara are you able to help please? I’ve seen your name mentioned a lot. Thanking you all in advance.

    • Sara (Debt Camel) says

      This is my website :)

You will automatically get a refund of the extra interest you have paid. If you have had a Vanquis account for years, this will probably be a lot more than the ROP itself!

If you want to ask for a refund of the ROP payments as well, just send them a complaint saying why – I can’t give a template as it depends on your actual case. Perhaps you didn’t know you had it? you were told you had to have it? or it wasn’t explained properly? or you had a job with good sick pay and redundancy and didn’t need the cover? or your credit record was so poor it wasn’t worth paying anything to protect? or you weren’t told that Vanquis would have to consider freezing interest if you were in difficulty even if you didn’t have the ROP and you would not have paid for that if it had been explained?

      • Kim says

Thank you for your reply Sara. I’ve just checked emails and received a welcome email on 31/12/13. On the 06.01.14 I received a ‘welcome to ROP standard plan’ but in this it does say “We have not provided you with a personal recommendation as to whether Repayment Option Plan is suitable for your specific needs. A brief summary of the terms and conditions applicable to the Plan are as follows”.
Also when I got accepted for this, I wasn’t working at the time as I a stay at home mum with a 1 year old.
I don’t ever remember ROP being explained to me properly except to say that I can take a payment holiday (which was very appealing to me at the time, especially as I wasn’t working). I also didn’t know that it was something that was charged to my account every month until I logged in a few months ago. I specifically remember them saying that getting this credit card would help to boost my credit score, which was poor at the time.

Where do I even begin? I’ve never written a letter of complaint. Could you help me please? Thanks

        • Kim says

Also to add that my account is still open with them. My credit limit has risen from £150 TO £1750 over the years and I’ve always just done the minimum payment.

And purchase interest of £60+ every month so balance never goes down :((

        • Sara (Debt Camel) says

Email your complaint to customer.relations@vanquisbank.co.uk and put ROP COMPLAINT in as the email title.

Then you just simply need to say that you feel it was mis-sold to you, you were not working and the ROP wasn’t properly explained to you. Add that you understand you will get a refund of the extra interest you have been charged but you also want a refund of the ROP payments themselves.

And also say you want the ROP cancelled!

A complaint doesn’t need to be long or complicated, you just need to be clear it is a complaint (hence the title of the email!)

Hello I’ve just heard from Vanquis today. I complained just over 4 weeks ago, asking for all the R.O.P. to be refunded. I had the card with a rising limit from £500 to £4000, card was always at a limit and always just paying off minimum payment. I had used the payment freeze for 6 months when i lost my job, and payment holidays on numerous times. anyway the letter states that, they are upholding my case as the points on the the script that was read to me was not fully explained to me when I applied for the card.
    the refund is .
    Repayment Option Plan- £2,076.42
    Associated interest-£2,465.72
    Charges-£24.00
    Notional Interest at 8%- £296.57
    Withheld Tax Amount- £59.31
    total £4,803.40
    Very Happy needless to say.

I have an existing account. I cancelled R.O.P. when i made my complaint. 4 weeks ago. My statement reads zero balance as of this morning. A cheque with the remainder after my account was cleared will be with me within 28 days.

      Hi Guy,

Could I ask how long you have held your account for , I submitted my complaint 2 days ago and I have received email today acknowledging the complaint along with reference number. I have held my account for at least 12 years that I know of and limit for most of the time was £2500. Just trying to gauge what my refund might be

      Thanks
      Andy

      • guy argent says

        Hello.
I’ve had my account for just over 6 years now. The turn around time from complaint to refund was just under 4 weeks. I only ever sent two emails to them, first the original complaint and then one two weeks later as I had heard nothing.

  13. Siobhan says

    Hi there,
I wanted to claim back full rop on a closed account. I wasn’t working at the time and was given a free trial which was never cancelled. I have contacted them re refund and was told 180 days. If I want to claim all rop can I say that I wasn’t working so this wouldn’t have been able to make a claim anyway?
    Thanks
    Siobhan

    • Sara (Debt Camel) says

I suggest you make a general complaint saying that the ROP was not properly explained to you. Add that it was also unsuitable as you were not working. So you want a refund of the ROP payments themselves, not just the extra interest you will be getting automatically refunded.

If you thought the “free trial” would just end and didn’t realise they were charging you for it, you could also say that, if it is correct.

  14. Richard C says

I’ve yet to hear of a single person who is an existing customer and complained to Vanquis BEFORE the FCA ruling receive even a ROP purchase interest.
Plenty of people who’ve complained AFTER the FCA ruling are receiving quite quick turnarounds of 2-4 weeks on very large amounts.

Has anyone who had a complaint rejected before the FCA ruling (and may have referred to the FOS) yet received an ROP purchase interest refund?

    • Kk says

I agree …seems those of us that put in our complaints last year are gonna be the last dealt with . Ombudsman been very slow at making progress for me

    • Gail says

I was told that financial ombudsman cases would start to be looked at in May. Does seem a little unfair that new cases directly to Vanquis are being investigated more or less straight away

      • Sara (Debt Camel) says

Vanquis always has looked at the cases straight away. So far as I know, new complaints to the Ombudsman are not getting any priority over the ones made before the FCA announcement.

    • Susie says

I complained just before in Feb. I had a letter back just before the 56 days to say they would pay interest but that is all. I’ve had nothing since. I have complained to the ombudsman and received a letter yesterday to say I should hear something within 12 weeks.
I called Vanquis to ask when at least the payment of interest would be paid. They didn’t know. So I have no idea how much I will get or when. Going by my calculations it’s not a lot anyway. They said 8% ( of what I paid?) I have no idea what that means. I’m checking my account daily. Desperate to pay it off and close it.

      • Sara (Debt Camel) says

You said before that your account was opened in 2014 and your balance is c £4000? If that is right, it is very unlikely that the refund will be large enough to clear your balance I am afraid. But the reference to 8% is unhelpful, the interest you paid on the ROP will be larger than that.

        • Susie says

The balance is £2000. My credit limit started at £500 and has upped since. It’s usually maxed out but I’m on a debt busting mission. The letter is so vague. It just says we made a mistake and will Pay you 8% interest. Yes account opened in 2014. They wrote that they will pay interest from 2014-2016 because they sent letters out in 2016 stating the charges.

  15. Karen says

Any advice please, I have Vanquis account open, for which I had ROP from 2010 till 2012 when I cancelled ROP, been advised today I will be due a refund , but will that just be for those 2 years or will interest be included till now , Thanks for any advice

    • Dave G says

If the account is still open , it would still have interest being charged on up to now ,unless the balance had been cleared wouldn’t it sara ??

    • Sara (Debt Camel) says

We don’t know for sure until the first of these automatic refunds come through.

But I think she should get interest at the card rate up until now on the ROP that was charged in those years.

      • Karen says

Thanks Sara, will wait and see what outcome is, and update on here. Also Sara a big well done on this site, it is fantastic, really informative and a great help.

I’ve just had a break down of the ROP Vanquis charged me amounting to £1259.50 . An apology too saying they what messed up the dates too . I had my card from July 2005 to July 2011 . I’m just wondering how much I’m entitled to as a base line . I’m useless with how they are going to work it out . I’m absolutely mortified that I’m not entitled to the fees back ….. at the moment at least ! Thanks in advance .

Update as promised. Cheque arrived in post today and balance cleared to zero. All this within four weeks of complaint going in.
It can be done and no need to use these ppi companies either. They take a percentage and then claim against company for their costs as well. So by doing it yourself you will be dealt with far quicker.
      Thank you all x

    Hi everyone,

Update – I had a call yesterday in relation to the ROP and they had said in the complaint that they had listened to the call – I asked for a copy of the call and they called me to say they haven’t got it sorry. This was for the ROP charges? I had ROP for 2 years I don’t think it will be much it was from 2004 to 2006. Is it worth the Ombudsman – they haven’t told me how much or anything as it is a past account.

I don’t think there is any chance of the FOS looking at this case as it is pre April 2007. Did you close the account in 2006? or just stop the ROP?

      • louise says

Closed in 2006 Sara – all they said was it was a £1000 limit and I was charged as rop took me over the limit, I don’t understand it tbh. mind blowing. I will just await the refund prob wont be much.

  19. Siobhan says

    Hi there,
Want to make a claim for full ROP from Vanquis my account goes back to 2012 is it still possible to claim and are there any templates I should use? Do I have to send a SAR request or just ask for a full refund of ROP fees applied to my account? Account ended up with dca and was still charged ROP while paying off the debt.
    Siobhan

    • Sara (Debt Camel) says

No you don’t need to send a SAR – if you do that now it will cost you £10, if you still think it’s a good idea you can get one for free after may 25th, see https://debtcamel.co.uk/free-access-data-gdpr/

You can put in a complaint saying you were mis-sold the ROP, there is no template letter you just have to say why: you didn’t know you had it? it wasn’t explained properly? you had a job with good sick pay and redundancy and didn’t need the cover? your credit record was so poor it wasn’t worth paying anything to protect? you weren’t told that Vanquis would have to consider freezing interest if you were in difficulty even if you didn’t have the ROP and you would not have paid for that if it had been explained?

    • Siobhan says

Great thank you letter is being drafted now. Will it affect the other refund if I send this in? My account was at £1500.00 and even though I was paying dca they were still charging me £22.01 a month rop fees so my balance was well over credit limit at the time.
      Siobhan

      • Sara (Debt Camel) says

“Will it affect the other refund if I send this in?” It shouldn’t but there is no past experience about this.

Had they frozen interest when you were paying the DCA?

        • Siobhan says

I only have kept 1 statement from them and it says my account has been passed over to dca and to contact them however the statement has dca payments and a £22.01 charge for ROP but no interest however was also £400.00 over credit limit

  20. Amanda says

I applied for my refund, and Vanquis wrote to me saying I had never had a account with them. I rang them today and they stated they could not find me on the system. As soon as I told them that I had this on my credit file and I had a account between 2009 and 2015,they suddenly found my account. The man stated I had ROP and would be having a refund once they looked into this. He stated this will take 180 days, is this correct? “

    • Sara (Debt Camel) says

That’s an interesting story, so far people haven’t had problems with Vanquis not being able to locate their accounts.

180 days is standard for closed accounts.

    • African Queen says

I also had Vanquis say they were unable to locate my account. I had it from 2004 and closed it in 2013. They asked me to send my date of birth and any historical addresses. I sent them the information and they quickly confirmed that they had located my account. I am now waiting to hear about my refund. I am resigned to the fact that it will be a long wait as it is a closed account. I will update as soon I have one.
      Good luck to everyone.

  21. AnthonyIrwin says

I had a Vanquis card from 2014 with a limit of £2500 which was max out was paying about £100 a month but 1/2 was ROP they refused to
Cancel this so I refused to make payments They sent my account to a DCA which was paid in full.Would I be entitled to a refund and what
    should the refund include Anthony

    • AnthonyIrwin says

About a year I asked what the ROP was and they told me it was there to help if I missed payments if I was off sick or listed my job
I said that it was like PPI and they said it was”nt that’s why I refused to make the payments as I did”nt need it Anthony

      • Sara (Debt Camel) says

Was that the only reason you stopped making payments to the card? If it was, you need to put in a complaint, saying that you want a refund of the ROP and you want to complain about the unhelpful attitude of their customer service team when you called in 2014 to try to cancel it – make sure you ask for any negative marks to be deleted from your credit record as well as a refund of the ROP and the associated interest.

  22. JB says

Has anyone had a letter regarding their respective refund yet? I spoke to someone at Vanquis and they said that the 90 days for active accounts is from the date of judgement therefore the 27th Feb – so 90 days up to the 28th May at the latest – which means that everyone in population 1 of the judgement (active account holders) should receive an auto refund very soon and a follow up letter by 30th April as they have a further 28 days to pay the balance assuming it is more than your existing credit limit. They are clearly hanging on till the 11th hour to recoup interest payments from everyone’s accounts to cover the vast sum of money that they are about to start paying out! My account was opened in 2007 with ROP and is still current although the ROP was cancelled by Vanquis in February when I lodged my complaint in late January which was not upheld on the 6+3 year rule so I am waiting for the auto refund now like everyone else. Population 2 people (former account holders now closed & settled) will have to wait for 180 days according to the judgement unfortunately.

    • Stella says

Hi JB , would that not cost them more in the long run , as they would be paying out even more in interest .

      • JB says

Hi Stella, it probably would cost them more but it depends on the cut off point for interest being applied – I believe that this is 1 month after they sent out the updated letters explaining the ROP product – November 2017 – so it may not be costing them anything more by delaying the payouts and in the meantime they are charging interest on active accounts – for me this has been £100 a month since the potential cutoff point of interest – then multiply this by an estimate of say a quarter of their customers who may have accounts like mine and you end up with a great deal of interest in their bank account to make payouts etc. – £30 million per month since start of December – up to £180 million by the end of May and that’s just me purely speculating!!! Just my own ideas and calculations but it has got us all speculating and discussing on here! I have even designed my own excel spreadsheet calculator and it is giving me some very interesting payout figures! I just wish they would hurry up and refund everyone.

        • Sara (Debt Camel) says

“it may not be costing them anything more by delaying the payouts” as you say, we don’t know this. I think they should be refunding all the extra interest still being charged on the pre-November 2017 (or whenever) borrowing.

        • JB says

There were earlier comments from a chap who is getting nearly £10k – account opened from 2005 to current – his upheld complaint included refund of his ROP payments of around £1600 but even taking these away it is still a figure of around £8400 in interest which is amazing. My account has been active from 2007 to present with ROP all the way so I am hopeful of something similar. It all depends on your credit limit and APR that was applicable to your account over the years.

  23. David Clarke says

I received a letter from Vanquis yesterday regarding my complaint about the rop charges stating that they are unable to hold up my complaint.

    This is what they’ve said:

Rop was applied to my account during a call on 5th March 2008

I was charged on a monthly basis between 11 April 2008 to 11 March 2018

Following the conversation where the plan was discussed I was sent information relating to the product which provides a summary of the product and my right to cancel.

I was sent text messages via the plan alerting me if my account was closed or had exceeded my credit limit. The last text was sent on 31 Jan 2018.

The thing is I’m not questioning whether I had the rop, I genuinely thought it was a benefit of my account!
I called them last night to request copies of any phonecalls or documents they have where the fees were clearly explained to me but the lady I spoke to couldn’t help me and the person who dealt with my complaint had finished for the day, and I have asked for them to call me back later this afternoon.

Th letter also says the under FCA handling rules, the Financial Ombudsman cannot consider complaints where what I’m complaining about happened over 6 years ago.

With my account being 10 years old does this mean their decision is final and this is the end of the road for me as fast as claiming back the rop charges?

    Many thanks,

    Dave

    • Sara (Debt Camel) says

You can send the case to the Financial Ombudsman and ask them to look at it. Point out that although the account was opened in 2008 it is still open now. It is the Ombudsman’s decision whether they will look at these cases not Vanquis’s. Also ask Vanquis to send you a recording of the phone call.

The good news is that you will get the extra interest refunded automatically and this is likely to be a LOT more than the ROP itself is. So whatever the FOS decide you should get a good result, but there is no reason not to take the complaint forward if you want to try to turn this from a good result into a great result.

    • David Clarke says

Well I’ve spoken with my case handler who practically said I don’t have a leg to stand on. I was sent a welcome pack in 2008 when it was added to my account and I getting a copy of that sent through the post in the next 2 weeks.

She also said that as it was itemized on my monthly statements that was prrof enough that I was aware that it was a product I’m being charged for so really it’s my mistake for not reading my statements because the facts were within them.

And data is held for 6 years so there are no copies of any phonecalls relating to the rop available or me opening my account available any longer.

And she flat out said the ombudsman will not look at my case because for one it is over6 years old and two that because the information was on my statements that was proof enough for the ombudsman to decide that I was indeed aware that I was being charged for their product.

On a plus note I did find out that over the years my top payments totalled £1986 so hopefully the interest I’m due will be at least the same amount.

      Dave

      • Sara (Debt Camel) says

Well she would say that, wouldn’t she… It is not Vanquis’s decision whether the Ombudsman will look at over 6 year cases, it is the Ombudsman’s. It’s up to you… but yes, I would expect you to get more back in interest that you have paid in ROP unless you often cleared your Vanquis balance down to zero.

        • David Clarke says

That’s exactly what I thought to be honest, and over the years I think I’ve cleared to zero three or four time but never for too long.

I will keep you updated once I find out.

          Thanks again.

  24. Richard C says

Vanquis is owned by Provident Financial who are the bigger group. Provident are also under investigation for high-APR car leases via Moneybarn, and the FCA are working on this seperately.

it’s fair to say Provident are in a malaise after they experienced a 65% drop in share value mid last year when their CEO Peter Crook (!) left quickly under a cloud.

They’ve just raised a couple of weeks ago £331m.

i honestly can’t think that the £169m advised is going to cover the ROP purchase interest judging by the size of some payouts.

But perhaps they had to secure this £331m first, as they need it for the clearing up this ROP stuff. Who knows.

  25. Chris D says

Both me and my wife have had a letter today from Vanquis. Almost exactly a month since I sent both complaints basically saying they’re still looking at it and advising how long they’ve allowed to take to respond.

Guess they’re getting a lot of complaints at the moment!

  26. Sarah Sonnenstein says

As promised I said that I would give a breakdown once I rec over my letter. My complaint has been upheld. I took my card out May 2013 and closed it lastApril 2017. They have listened to the call and they are not satisfied everything was met last why they are giving me a refund. Not as much as some are getting but really happy with it. My credit card limit was £500 and I only ever paid minimum a month!!
    Here’s the breakdown:
    ROP fees £188.25
    Associated interest £362.28
    Charges £193
    Notional 8% interest £91.68
    Withheld tax amount £18.37
    Total refund £816.84

For something I didn’t know I would be getting, really happy with the outcome.

I complained in March and I’m going to receive cheque in post 28 days from 24th April.

  27. JB says

Hi Bev, yes, based on what I was told by Vanquis. The letter should give payment breakdown and advise of balance to be paid within 28 days if you get your account returned to zero and so doing the 90 day dates for population 1 customers they need to have sent letters by tomorrow to keep within the FCA ruling.

    • Simon chilcott says

I think you’ll find there’s still another 30 days as ruling was made end of February so should be end of may

      • Sara (Debt Camel) says

I think JB is assuming the payment has to be made by the end of the 90 days and as the letter will give then 28 days to pay it,, the letters should be arriving tomorrow.

I suspect Vanquis are aiming to get the letters out within 90 days, not the payments. I will be happy to be proved wrong!

    • Richard C says

I’m ever the pessimist folks I’m afraid.
I think it would be nice if letters were sent out today meaning the 4 weeks until payment is end of May, but I’ve found Vanquis to be less than competent and take the maximum time for everything including stretching rules as much as possible.
Think it’s more likely to be by end of May plus 4 weeks for payment.

      • JB says

Richard C, your probably right. Not sure about the legality of them doing that?
Sara, does the ruling mean that they have to return the money by the end of the 90 days at the latest or can they stretch this?

        • Sara (Debt Camel) says

I have never seen this “90 day ruling” written down so it’s hard to tell – it could simply be a target.

          • Village Idiot says

Sad person that I am, I read the FCA ruling, and if I remember right the only timescale in it was for Vanquis to complete the process within a year, so, yes, I think this is only a target.

I think I read somewhere that the FCA will ge checking in with Vanquis about progress after 3 months so would hope Vanquis wouldn’t enjoy telling the FCA that they hadn’t done anything at that point.

      • CLINT says

Richard—Vanquis are by no means the only ones who stretch it to the limit

After a recent FOS ruling in my favour aqua/Bank of Scotland took the full 56 days after the ruling to contact me with my offer and we are now half way through the 28 days they said that I would be sent a cheque

My account is open but has a zero balance and once I receive the refund it will be bye bye vanquis

  28. Andy D says

Well today I’ve received a letter saying they have checked their records, and if a refund is due they will pay it back to my account within 90 days, so I rung and asked if it was 90 days from the FCA ruling or the date of the letter. I was told the date of the letter, which would take it up until mid July!

Opened my account in 2014. My account is an active one, very little balance and rarely used but still active.

    • JB says

Hi Andy D, it seems to depend on who you talk to at Vanquis – I was told 90 days from the ruling more than once. There just doesn’t appear to be any logic to the way in which they are paying out or their flow of information or lack of it! I was told by them that as a active account customer that I would receive a full refund within the 90 days. They are so quick to take but very slow to give!!!

    • CLINT says

like village idiot I have read the FCA final notice ruling

the FCA have said that refunds must be paid by 28th feb 2019 but vanquis have to report to the FCA every 3 months from the date of the ruling to update them on what progress has been made for example—how many people they have contacted — how many refunds they have made etc

so I suspect many will be in for a long wait

my suggestion would be that any one who has not received any communication from vanquis by the 18th of may that they lodge a complaint with the FCA as they do state in the ruling that at the 3 monthly update reports they will be looking at complaints they are receiving about vanquis

      • Hayley Anderson says

Yes but it is also coming from Vanquis themselves that active accounts will be notified within 90 days of the ruling as to the amount of the refund and either paid off their balance or sent out as a cheque within 28 days and the same goes for closed accounts to have had some communication within that time as to refund amount and then cheques with 28 days

        • JB says

I agree Hayley it is. Everything I have stated regarding the 90 days has come from information direct from Vanquis. I was told as an active good order account holder that I would be refunded within 90days.

          • CLINT says

do you have that in writing?

there does not appear to be anything on vanquis website regarding a time table for refunds unless I have missed it

          • Hayley Anderson says

I was too JB and I have phoned them twice for an update and that’s what they have said to me both times

  29. Claire says

I have received a letter today and it’s says they have listened to a call which took place in Aug 2013 although I did accept the rop they do not feel that all the points were satisfied when discussing the plan with me so have therefore upheld my complaint and are repaying rop fees, associated interest and charges, a refund of £305.52 will be shown on my next statement. This is my breakdown ROP £109.67. ASSOCIATED INTEREST £189.04. CHARGES £AMOUNT. NOTIONAL INTEREST AT 8% – £8,51. WITHHELD TAX AMOUNT – £1.70. Not alot as many but enough to pay off my card.

I put my complaint in in April so really lucky to have this replied already my 1st off credit limit was £250 and was made gold customer at £2500 once I have this repaid in my account its bye bye vanquis. Good luck to all you guys with yours.

    Thanks Sara

    • JB says

Hi Claire, glad you got you refund. At least it will pay off your balance. Well done you. I am still waiting like so many people.

    • Sam says

I received a letter today saying they are still looking into my complaint and have 8 weeks from the date of the complaint (4 April) they have said that no decision has been made yet but they’ll be in touch. I do keep emailing them once a week just so I’m not forgotten about and always very pleasant. Being someone whose account is closed I’m worried I could be cast over lol! Hopefully some positive news soon!
Well done Claire on your refund, I think it’s brilliant that people are getting somewhere.
      Sam

  30. laura says

They have got to be the worst financial company I have ever had dealings with, they are not giving any information regarding ROP interest back payments they are obviously playing the waiting game and recovering as much interest as they can . Well good they will need it I have had my account since 2010 and my card has been maxed most of the time currently at £3000+ and was paying ROP AT £26 until last year they will have to pay intrest up to the current day regardless of any letter they sent out in 2017 so the longer they delay the bigger the payout.

    • Hayley Anderson says

They are just digging themselves into a deeper hole and will have to answer to the fca about why they haven’t started making refunds yet so I’m thinking they will leave it till the end of may because they basically can

      • JB says

I agree Hayley, their problems will be getting bigger by the day!!! Monthly Payment is due tomorrow and statements updated on the 6th so let’s see if they refund any accounts after they have deducted another chunk of interest from everyone!!! But, you’re probably right they will hang on to this as long as they possibly can in May to limit their loss of interest in to June – may as well drag another months interest from everyone before paying out!!! I will definitely be closing my account following this debacle and I’m sure there will be a lot of people following suit!

        • Eve says

Hi JB, I paid my £125 minimum payment by 27th April and they have tonight added on £94 of interest and want me to pay a further £127 by the 27th of this month. So it looks like you’ll def be charged interest again this month. Also, I do remember seeing on the Vanquis site (immediately after the FCA ruling) that all open accounts would be refunded within 90 days and closed ones within 180 days, but it is no longer saying that anywhere on their site so I’m not hopefully that will be the case now …….. but I’d loved to be proved wrong about that.

          • JB says

Hi Eve, me too – I have paid £135 minimum payment today and the interest will be added on the 6th May. Just a waiting game really. I have been quoted the same timescale twice by Vanquis staff so we’ll just have to be patient I guess. The scale of this refund is utterly enormous to them so I think we’ll just have to accept that we will receive a refund at some point soon. I hope it is quick but let’s see.

  31. Sara (Debt Camel) says

I think it may be good to calm down a bit on when you will get “the letter” and when the refund will be paid.

From your point of view it looks like your money which they never should have had and you want back asap – quite right.

But from Vanquis’s point of view they have literally a million complicated calculations to make. Their system has to account for all the complications in these that can arise. That is a different million letters to generate and send to the right person. Some people will have married, moved, died, gone to prison, be suffering from dementia. Many debts will have been sold to debt collectors. Once the letters start going out Vanquis are going to be deluged with phone calls and they have to prepare for that before the letters go out.

They are not making any money by hanging on to your money for an extra month or two. They are not about to go bust. You will get the refund and worrying about when is not going to speed it up!

    • Ian R says

Yes its time peopled stop getting worked up about their refunds including me-I see little point in foning them vanquis will just palm you off with some waffle-complaints staff have bound to have been briefed what to say-

    • John says

Just a waitin game unfortunately but it’s money we never thought we’d have.. so just relax n wait for little bonus to arrive ????

    • David says

I agree with Sarah’s comment above, and if you read the FCA report there’s no mention of the 90/180 days for making refunds – as I understand it, this was something that Vanquis proposed themselves.

I’m pretty sure there was something on Vanquis’ wesbite to this effect just after the FCA decision was announced, but it’s not there now (or if it is I can’t find it).

Anyway, five months after complaining to the FCA I’ve received a letter from them today telling me that they think that I’m outside the time limit for complaining – took out ROP in 2011 so more than six years ago, and Vanquis apparently contacted me in June 2013 clarifying how ROP worked so the three year ‘reasonable knowledge’ period starts then.

Have responded saying that I have no recollection of Vanquis contacting me (which I don’t – I have e-mails from them in 2013 but they’re nothing to do with ROP) and that in my view the six years only started when I opted out of ROP in January this year.

Will see where that gets me, but was slightly surprised, after five months, to be given just a week by the FCA to tell them if I accepted their findings or not.

  32. stephm says

Hi All, I emailed Vanquis last Dec to complain about ROP (following Sara’s email template) they closed my complaint stating I was due no refund (2 days before the ruling) I have contacted them again now and they advised I will get a refund (same 90 days, no amount yet kind of chat) but that its only interest! how would I be best going about claiming for plans fees too? As when I actually wanted to use the ROP ( my hours at work were reducing) they said no! I currently have a 2k limit (gold customer) never missed a payment. When I had ROP my balance went over every month causing £12 charges :( any help greatly received as i’m really struggling with this.

    • Sara (Debt Camel) says

You still have time to take this complaint to the ombudsman – you have the final decision from Vanquis. I suggest you use their online complaint submission because that asks for all the details they need from you, see https://help.financial-ombudsman.org.uk/help

In your complaint, say you want a refund of the fees because it wasn’t properly explained to you at the start – if you had known that you couldn’t use the ROP when your hours were being cut at work you would never have taken it out.

    • guy argent says

Hi I was in a similar situation to yourself. I applied for a payment freeze as I had lost my job. Initially they gave it, but after 3 months said the freeze was over and I would have to start repaying my 3.5 K maxed out card back. Luckily I managed to get another job and carried on paying. 6 months later the repaying of the interest judgement came in. So I said they did not fully explain the full nature of the R.O.P. And to cancel it and I wanted a refund on everything I had paid out over the six years I had had it. 3 and half weeks later my account was cleared and I just got a cheque in the post for 1K so just under 5K in total. Maybe I was lucky, but I was very direct in my communication and never deviated from what I wanted from them. Keep on with it.. Guy

  33. Ap says

I complained to the vanquis and then the fos in feb 2018z the fos comfirmed that this was sent to vanquis on 24/02/18 and advised me that vanquis should be in touch within 8 weeks to advise whether or not they are upholding my complaint.

Just spoke to vanquis and they have no record of the fos communication which I find very strange.

I have went back to the fos to see what they say but hopefully this doesn’t hold up my complaint much more considering they should have responded just over a week ago.

Sara – Do you think they should mark this as urgent for a quick response or do you think that’s hoping for too much?
    Thanks

    • Sara (Debt Camel) says

so you complained to Vanquis directly – what date? and you haven’t had a reply to this?

      • Ap says

Sorry for not being clear, I complained to vanquis in October 2017 and got a response shortly after declining due to the 6 year rule and was told the fos wouldn’t look at it.

I then went to the fos early 2018 and they confirmed they had forwarded my compliant onto vanquis as they had 8 weeks to put it right, ie whether they were going to uphold my complaint or not. It’s now been past the 8 weeks and I’ve heard nothing from vanquis and they have now said the fos have never been in touch in respect of the case but the fos have said they have, so I’m a bit lost. Either party has fallen down somewhere, suppose I’ll just have to see what happens, will get the interest no matter what and it should be a good pay out with a £3k maxed balance since 2010 and still open.

        • Sara (Debt Camel) says

OK, the FOS will have referred the complaint back to Vanquis if they decided the FOS could look it at (good!) as Vanquis hadn’t yet actually rejected your complaint but ignored it because of the jurisdiction aspect.

I suggest you tell FOS that you are unhappy this is taking so long but realistically the fastest way to proceed is for FOS to get Vanquis’s views on your complaint. there are alternatives if Vanquis refuses to do this but they will all take a lot longer than just giving Vanquis another few weeks.

Annoying for you. but as you say you should get a good payout!

      • Stella says

Similar thing with me , sent letter of complaint on 23rd March , phoned Vanquis to check that they received it , was told they had . Phoned this week to check progress ,was told they had no record of any letter . I insisted that they check again to be told yes they had it but it hadn’t even been looked at yet , very angry .

Hi my name is Kathleen. I had a credit card with vanquis. What is the story about the tax you pay on the refund how do you claim it back from the taxman.

    • Sara (Debt Camel) says

A refund you get will be broken down into different amounts. Where you are being refunded for something you paid out (ROP itself, added charges, associated interest) this is not taxed – it is your money they are returning to you.

But some people will have as part of their refund a line labelled something like “Notional Interest at 8%”. This amount is normally a lot less than the associated interest unless you often repaid your Vanquis balance. It is treated as saving sincome by the taxman, because it is there to replace the saving you may otherwise have earned, so it is taxed. But the first £200 of savings income each year should be tax free, so if this is your only savings income in the year and you are a basic rate taxpayer you can reclaim from HMRC up to £200 of the amount Vanquis will have deducted.

See https://debtcamel.co.uk/ppi-payday-refund-get-back-tax/ for how to do this.

  35. Ian R says

Just add to more info-from 28th Feb to 3rd may (today) its 65 days-25 days more to see if there’s any action from Vanquis- the clocks ticking for the mass EXODUS

    • Stella says

I think a lot of folk are hoping to get enough to be able to pay off their accounts and cut up their cards and finish with VANQUIS.

      • Sara (Debt Camel) says

Indeed! But if they don’t get enough back to do that I do hope they at least cancel the ROP!

    • Sara (Debt Camel) says

I don’t think this deadline has any real meaning and I may delete comments that are simply counting down to this.

      • Village Idiot says

Completely agree, the idea that following not a single refund there will be thousands, hundreds of thousands, of credits to accounts all of a sudden just at deadline day…well that doesn’t seem a certainty to me, put it that way. I personally won’t be making any financial decisions or committments that rely on a refund by the ’90 days’. Just my £0.02!

  36. Julie Fuge says

I had a letter off them this week refusing ROP refund but at the end it said
GOOD NEWS – you will be receiving a refund of interest paid bla Bla bla within 180 days. My account went to debt recovery about 4 years ago paid ROP for 3 years with a 2k maxout only ever paid minimum

  37. angela says

I have come home to find a letter for my husband from Vanquis also Julie . It reads the same as yours. I am livid as how can they say that they are only going to refund the interest from the date of his “agreement” to take out the ROP ( NOV 2014) to Nov 2016 ?? the interest was still getting added right up until he stopped it when we realised that he actually had it in March this year . The minimum payments have rocketed so much that they wanted £258 for April. My husband contacted them to get them to accept a payment plan over next three months and told them that they actually owe him money which will bring outstanding balance right down . I am going to take this all the way as My husband is self employed and he said he cannot remember taking out ROP and if he did then he would have been talked into it . It would be useless anyway as these policies never cover for the self=employed and they would have know that when he declared his income . Sara do you think I should send this to the ombudsman now ? Thank you
    Angela

    • Sara (Debt Camel) says

If he feels strongly that he didn’t know about the ROP, then yes, I think he should send the case to the Ombudsman. He could also ask Vanquis to send him a copy of the sales call that they should have a recording of, but don’t delay sending the case to the ombudsman waiting for this as it may take quite a while, so get yourself in the Ombudsman queue.

      • angela says

Thank you Sarah. Yes he said that the first he even knew about having this was when he received a letter in Dec 2017 detailing the interest paid the previous year and what he could expect to pay this coming year . Can the ombudsman be emailed with the complaint ? I will be contacting them straight away .

        Thank you

        Angela

    • Julie says

I have sent mine to ombudsmen, nothing ventured nothing gained eh! I was struggling with paying mine when Hours reduced in work when I rang then they didn’t offer a freeze or break were just interested in getting some money. So I just let it go to DRA still paying it now

      • angela says

Did you email them ? My husband did not receive any letter in Nov 2016 . The first letter he received detailing charges was December 2017 when he was shocked to see the amount of interest he was paying. He did wonder why the payments seemed to be snowballing. I am going to email Vanquis to ask for copy of phone call that they say proves my husband accepted the ROP after it being fully explained to him and that he was happy to go ahead with it !!

        Angela

  38. Linda says

Hi I got a card in sept 2010 paid Rop upto to jan 2016 when I closed the account and paid the full amount off which was max out at £3500. They even charged me interest for that month of £80 which I told the agent that was not fair but she insist I had to pay it. Does anyone know what I’m looking at getting back and should I give them a call?

    • JB says

Hi Linda, the refund of the interest is automatic for everyone who had ROP…just make sure they have your up to date details including address…you can fill their form out which is on Vanquis website and then play the waiting game

  39. tracy hill says

hi, i have just stumbled on this site while looking up how to ask for a holiday from this month’s payment to my vanquis card. i got the card in april 2016, and been payment payment protection all this time. does this refund apply to me?

    • Sara (Debt Camel) says

Yes, but you aren’t likely to get a large refund as you haven’t had the ROP long.

You were just hoping to use one of the ROP features – a payment holiday. Here is the info you were looking for: https://www.vanquis.co.uk/existing-customers/vanquis-repayment-option-plan#Payment%20Holiday.

One option for you would be to take the holiday this month and then cancel the ROP the month after that. The ROP itself is expensive – look at what you are paying each month to it… and on top of that you are being charged interest every month on all the previous ROP payments. people who have had this for years find they have actually paid thousands of pounds for the ROP…

If you cancel the ROP you will find your balance starts dropping much faster every month. And if you could set up a separate account and save the amount you usually pay to the ROP, that would give you an emergency fund there if you ever want a payment break again.

    • tracy hill says

thanks for the reply. i rang them and asked for the holiday to be applied and was told i did not have enough credit because the interest and ROP would still be applied and would take me over my limit. was told i could freeze my account if i was not working which does not apply. no other options were offered so i am stuck with just closing the account if i cannot pay and making a payment agreement which i may will have to do as i cannot afford to pay £110 in interest/charges each month.

      • Sara (Debt Camel) says

That just shows you how useless the ROP product is, when you want to use it they say No…

How much ROP are you being charged every month?

You could put in a complaint and say you want a refund of the ROP payments themselves, as well as the added interest, as it was not properly explained to you and when you wanted to use it you were turned down. It’s worth a try, just an email to customer.relations@vanquisbank.co.uk with COMPLAINT in the title.

Making an affordable payment arrangement sounds sensible – say you want the ROP cancelled and you want interest frozen on your debts. Is Vanquis your only problem debt or do you have others?

    • tracy hill says

hi, the balance on my card is just under £2500. The ROP is £32 and the interest in £69 so i would have to pay at least £100 to bring it below the credit limit before using the holiday and the installment is £119. The ROP was not presented as an option when i applied for the card just told to get it as well as the identity secure pack for £6.99 each month. i am really annoyed as i have never needed to use it in the last 2 years and now i paid the money for nothing.

      • Sara (Debt Camel) says

I would be furious! You do have a good reason to complain if it wasn’t clearly explained that the ROP was optional at the start – it’s worth a try IMO as you could get back an extra £500+ (I’m guessing from thor recent charge being £32 in one month) over what you will get from their automatic refund.

    • tracy hill says

      update.
i have emailed vanquis and explained that after a phone call yesterday the option to use the plan was denied, stating i was not eligible to use the plan due to conditions not being right. due to this i said i was very disappointed and wanted the money refunded along with the interest i was charged. will see how it works out.

  40. Sarah Sonnenstein says

Hi All. Not sure if anyone saw my last comment last week about my complaint. I complained to Vanquis after I found about this in March. I closed my account down last year (April). My complaint was upheld and I have received my cheque today from them. Honestly since the beginning Vanquis have been very good with me and have dealt with it very quickly. Hang in there folks. The way I saw this was it was a refund I didn’t know was happening and it’s a bonus. It’ll be worth it

    • Stella says

      Hi Sarah ,
Do you mind me asking what date in March you complained and what sort of correspondence you had with VANQUIS , I also complained in March , not had much back at all . Well done on your success.

      • Sarah Sonnenstein says

        Hi Stella
I complained around 26/03/18 and I received my cheque today 04/05/18. Thank you

  41. guy says

My complaint was emailed to Vanquis on the 30th March. I simply emailed the customer relations team saying that i did not have the R.O.P. fully explained to and that I was told that I couldnt have a card without the plan. I said I wanted a full refund of everything I had paid out. I then emailed them two weeks later asking for acknowledgement of my complaint. Within the week they said they upheld my complaint and everything would be refunded. I had my card with £500.00 limit that had increased to £4000.00 to date. My card which was maxed out was cleared and I received in the post a cheque for over £1000.00 as the balance.in total less than 4 weeks from 1st contact. maybe I was lucky?

  42. Denise Lawrence-Jones says

Update. I applied for my full ROP about 5 weeks ago. I have pestered Vanquis…mercilessly about this and the interest payments. I have good reason. I am selling my house and moving abroad so I needed them to get a move on.

I called this week and was told that they had upheld my complaint and that they are sending me a cheque for the full ROP and the interest.

I had my card from 2010 until 2012. Not long, but enough time had elapsed for them to not have a record of the recording of “the activation call” on file. So they are paying up regardless.

It seems that pestering and tenacity pays off…

Thank you to all on here. Your help has been tremendous. ????

    • Bex says

Thanks for your story, I also asked for all rop refunded but was denied because of the 6/3 rule, my account is still open and I had it from 2010 until I cancelled in 2017, I have referred this to the ombudsman so hoping for something there, I find it strange they would uphold your complaint and deny mine when we took out the card in the same year?

  43. Hannah says

    Good Morning,

I’m sorry if this has already been covered but i’d really like some help in navigating this one.
I didn’t actually realise was ROP was, i’d never seen this thread or anything but did notice a £40.00 transaction on my account and so i queried it on the phone with customer service. She immediately cancelled it and referred it to the complaints department.
4 weeks later i get a letter saying i’m not due anything back because they listened to the call and it was sold properly, they also mentioned in the letter that i had been paying it every month for the 5 years and 10 months i’ve had the card without raising the query.

i remember being told i needed the insurance but it was a long old time ago so i don’t remember the ins and the outs and i certainly don’t remember being told that it would be applied as a purchase on my transactions so would be charged interest on it too….

is it worth contacting the FOS? The letter kind of made out that it would be pointless because they’ve checked records and i knowingly agreed to it.

Any advice would be greatly appreciated.

    Thank you
    Hannah

    • Sara (Debt Camel) says

Happy to answer this sort of thing because there is no simple “one size fits all” answer.

“i remember being told i needed the insurance” it all depends how this was done. They may have suggested it was useful, that would be OK. But if they implied you had to have it, then this is mis-selling. Many people didn’t realise that they could say No, they thought they either had to have it, or it automatically came with the card or they wouldn’t be given credit limit increases if they didn’t take it. Any of these is grounds for a mis-selling complaint and if you feel one applies to you, send the complaint to the FOS.

” i certainly don’t remember being told that it would be applied as a purchase on my transactions so would be charged interest on it too….” That is not a reason to take your complaint to the FOS because you are automatically going to be refunded the extra interest you weren’t told about.

“is it worth contacting the FOS? The letter kind of made out that it would be pointless ” well they would say that, wouldn’t they…

    • Hannah says

Thanks Sara, i’m going to try to refer this to the FOS this afternoon. Not sure where to start though, is there a template letter somewhere i could modify?

Thank you so much for providing such an informative and helpful website and content!

      Thank you
      Hannah

      • Sara (Debt Camel) says

Read the “Should you complain and ask for a refund of the ROP itself?” section in the article above ^^^ That says what to do, your complaint email only needs to be a few sentences long but they do need to be relevant to your case, which why a pro forma template letter isn’t useful here. You know why you think this was mis-sold – you just have to say this and ask for a full rend including the RP payments.

edited – sorry I just reread what you wrote and you want a template letter to go to the Ombudsman, not Vanquis. The best way is to complete the FOS’s online form here https://help.financial-ombudsman.org.uk/help. That asks you for all the details they need to know. Your complaint is that the ROP was mis-sold, you want a refund of the ROP itself in addition to the extra interest you will be getting automatically. Explain why you think the ROP was miss-sold. Again this can be quite short.

  44. John says

Just checked my bank statements between 2012-2014 .. shocked Vanquis taking £49 some at £89 every month on top of my payments ???????? looking forward to their reply 3 weeks today since I contacted them ????

    • Stella says

      Hi John ,
That seems like a lot considering repayment option plan is 1.29 per hundred pounds owed to Vanquis .

    • Kim says

Hi John, are yours paper statements? I’ve been trying to check my statements online but it only shows me the last 6 months so can’t find anything from 2013 to Nov 17.

  45. tracy hill says

hi, i have just read the article again and noticed it said i should have recieved a letter in 2017 which i have not. i would remember a letter telling me i would get a refund believe me. also they are still charging interest so what is going on? i will wait a couple of weeks then email them again.

    • Sara (Debt Camel) says

The letter in 2017 wouldn’t have mentioned a refund. It would just have said what you had paid for the ROP in the previous year.

  46. Andy D says

    Good news!

I’ve just received a phone call from the FOS, and they informed me that Vanquis have agreed to the mis selling and are refunding me ROP charges, interest and the statutory interest. I only had a small limit for a couple of years, so I will update you when I receive the letter, what the lady did say that there was a bulk of cases that are all being paid back, so for those who complained to the FOS, you may be in luck!

Many thanks for all the help Sara

    • Richard C says

Similar to Andy D, i called the FOS for an update today and she advised me the same thing, they are agreeing to mis-selling and a full refund of all components.
also same information as Andy has, she told me a lot of cases logged with FOS , Vanquis have agreed to resolve along these lines i.e. Full refunds.

      • Kara says

I wonder if this will affect the FOS cases that have already been rejected? Quite a few of us were turned down due to the 6- and 3-year time bars even though we talked about not knowing about the interest situation, but I wonder if similar active complaints will now receive full refunds….

      • Alan Rankin says

I also received a letter today informing me of a full refund of ROP charges even though they refused my first claim on the 6/3 basis
They did make a bit if a hash on the administration of my first claim to the effect of telling me the transcript of the call would take some time to be sent to me,then, despite several letters from me requesting same, they said they did not have a copy of the call as it was over five years and would have been destroyed.
I took my complaint to the FOS and they agreed with my summation that it was for to prove the correct details of the call were made and not me.
The cash won’t amount to much but it’s the principle that counts.
Never give up folks, they will try to bore you into submission.

    • Eve says

That’s fantastic news Andy D, really pleased you got refunded and hopefully this means they are now working their way through all the cases. When did you send your case to the FOS if you don’t mind me asking?

      • Andy D says

I sent my complaint in February. I was told I should here something from them by the end of March, heard nothing so rang them last Friday and someone rang me back today.

        • Eve says

Many thanks Andy, I sent mine at the very start of January so hopefully I should hear back soon as I’m due to pay another minimum payment of £129 to Vanquis by 28th May. I know the FCA decision put everything on hold for a while so they’ll have a huge backlog to work through. Well done again on your success.

    • Dave G says

Well done Andy , can u tell me when ur ROP was from . Was it over six years and had Vanquis already rejected your original claim with them, as you went through the ombudsman ??

      • Andy D says

No, only had it from 2015. They rejected my complaint saying I agreed to the ROP. So I went to the FOS saying that it wasn’t explained to me that it would show as a purchase and therefore be subject to the same stupidily high interest which would never bring my balance down.

  47. Phild says

Received my statement yesterday which was a full statement with no refund at all, just spoken to Vanquis on the phone, enquired about the refund in 90 days and was told it would still be done within 90 days but then the advisor told me I was close to my limit and what my interest payment would be next month so i’m still not convinced the refund will be done by the end of May

    • Phild says

Since I spoke to Vanquis this morning had a phone call from the FOS earlier stating I would be receiving a letter with an offer in the next few days and that a payment would be made within 28 days of the letter, she couldn’t tell me what the offer would be.

      • FourMenHadADream says

Excellent hopefully you get the full ROP refund + interest.

I called FOS today out of interest and was told still no update and adjudicator has still to be appointed, so these latest refunds doesn’t look like it will be applying to all cases.

        • Eve says

FourMen I’m wondering if it’s all the FOS cases that were rejected by Vanquis within the timebar period that are now being notified of a refund. Mine was rejected due to being outwith the timebar and I’ve heard nothing as yet. My case has been with an adjudicator since they got my files from Vanquis in February but everything was put on hold after the FCA ruling.. I hope someone get’s allocated to your case shortly and I’ll update if I hear anything on mine.

          • Phild says

I’m a different Phil to the one who said yesterday he is not getting a refund so have changed my name on here to Phild to avoid confusion but this thread is mine lol. I sent mine off in January after problems with Vanquis last year and many arguments over the ROP which I cancelled and never noticed a drop in my interest charges each month. They refused to do anything despite me pointing out discrepancies in their T&C which I had kept from when they had sent them out in 2012. I had accepted the ROP over the phone but again pointed out they had not informed me of the interest upon interest charges etc during that call. I had my letter off the FOS yesterday stating I will be getting a refund of ROP charges and interest so just waiting on Vanquis now for the figures.

          • Sara (Debt Camel) says

If “again pointed out they had not informed me of the interest upon interest charges etc during that call.” is the main thrust of your complaint then getting the standard refund of all the extra interest added is the accurate way to give you compensation for this. You will only get a refund of the ROP itself if there is some other reason why it was mis-sold.

  48. Moll says

I had a letter back from ombudsman today They agree with Vanquis over the 6 years ruling so I won’t be getting ROP money back even though I didn’t realize what ROP actually was . I have till the 10th to despute it

My account is still active . I cancelled ROP when I seen this website in January . Vanquis quoted the 6 year rule and ombudsman agree .

  49. Julie says

My complaint has been with vanquis from 23 rd October and the ombudsman since 23rd March still no word. If it’s with the ombudsman can you still contact vanquis?

    • PhilH says

Mine got rejected by vanquis in August and has been with the ombudsman since November and then you see all these people who claimed this year being paid out. Very very frustrating for the people who put in claims a lot earlier.

      • Julie says

Your right Phil, more frustrating for you since your account is still open mine had been closed since 2013, glad to see you will get you’re getting a refund soon. Hopefully I won’t be waiting much longer.

  50. Karen says

Just had a look through a few statements and am confused, what’s the difference between default interest charge and cash interest charge , ? Thanks

  51. Paula says

Just read this article from Provident. You will note that it states they have completed a pilot of a small segment of customer refunds and that a roll out of the full refund programme will commence in June 2018 (page 2), no mention of 90/180 days or current customers/closed accounts. May be a longer wait time me thinks! But hey, I’ve waited this long, I can wait a while longer. https://www.providentfinancial.com/media/2176/pfg-ims-may-2018-final.pdf

    • CLINT says

I am not at all sure that sort of response will satisfy the FCA when vanquis have to report to them at the end of May

      • Sara (Debt Camel) says

I would be very surprised if the FCA has a problem with this. Organising over a million refunds is a huge administrative task, needing new systems and dedicated staff.

  52. Maria says

I submitted my complaint to the Ombudsman in mid January and emailed them this morning for an update, they have come back to me within the hour to advise that Vanquis are offering a full refund for my complaint and they intend to send a letter today or tomorrow with the details!

I opened my account with Vanquis in August 2011 and it remains open although I cleared my balance about a year ago. Vanquis rejected my complaint on the basis that everything was covered in the call but did not mention anything to do with 6 years (I complained after 6 years and 4 months). I received a copy of the call and wasn’t happy with their reasoning and so sent my complaint to the Ombudsman. Looking forward to receiving my letter :)

    Hang in there everyone!

  53. Stella says

Hi Sara ,just had a letter from VANQUIS today regarding complaint made in March , they are saying that when I cancelled repayment option plan in 2015 that they treated it as a complaint then even though I didn’t complain ,simply cancelled . They are saying that they have no intention of looking into it again as they checked in 2015 and found that they didn’t mis-sell to me , I’d be grateful for any advice you could offer .

    • Sara (Debt Camel) says

So they never replied to you at that point rejecting your complaint – which you hadn’t actually made?

Have they told you now you can take your complaint to the Ombudsman?

    • Stella says

No word about ombudsmen at all ,they included a copy of a letter sent ten months after I cancelled repayment option plan saying they hadn’t mis-sold but I didn’t get this as it would have alerted me that there was a problem with repayment option plan immediately

Also no mention whatsoever about any interest due to me.

      • Sara (Debt Camel) says

OK then I suggest you reply to Vanquis saying you want them to consider your complaint now, that you didn’t make a complaint before and they can’t have treated it as a complaint because they didn’t mention to you that you could go to the Ombudsman at that point.

    • Stella says

Hi Sara , got in touch with Vanquis as you suggested , apparently in 2015 it was a claims company who got in touch with VANQUIS on my behalf but claims company didn’t come back to me with VANQUIS rejection letter so I’m barred from going to ombudsmen as this was 3 years ago , lady on phone said she doesn’t know if I’ll be getting refund of interest either .

  54. Jackie says

After reading other peoples experiences I cancelled my Rop in March 2018 and also complained about being mis sold it, I explained I wasn’t aware that if I got into difficulties making repayments that they would have to consider freezing payments, I took the Rop out on the basis that if I ever needed help I would be able to use this benefit… I have had a letter back today saying they are unable to uphold the complaint because they are satisfied the plan was correctly applied and charged to the account with my consent, they have said I’m entitled to a refund of the interest from 31 October 2012 (when I opened account) till 9 December 2016, should they not have to pay the interest till March 2018 when I closed account? I had an email of them In November 2017 explaing how Rop works

    Many Thanks

    • Sara (Debt Camel) says

Your first decision is whether to send the complaint to the Ombudsman. Your point that they didn’t explain that they would consider freezing interest if you were in difficulty even if you didn’t have ROP is a good one. If you want to get a refund of the ROP itself, not just the extra interest, then you need to send your complaint to the Ombudsman. Also ask Vanquis to send you a copy of the sales call, but don’t wait for that to arrive, it can take ages, get your complaint into the FOS straight away.

If you decide not to do this, then you can go back and ask Vanquis why they aren’t going to refund the extra interest on the ROP payments after December 2016. But this isn’t worth arguing about at the moment if you are sending the whole complaint to the ombudsman.

PS please don’t put anything in the Website box – that’s meant to be used if you have your own website

    • Dean says

I had the exact same outcome as yourself on day 79 (They purposely drag it out as long as possible) so I sent it to FOS in February, I found out today FOS agree with me and now I’m just waiting for Vanquis to do the math and pay me out

  55. Carey says

    Hi

I just spoke to Vanquis as I hadn’t heard anything from them about the ROP interest refund. My account is still active and I cancelled the ROP when they sent out the letter in September(ish) of 2016 and I realised the true cost of it. They were very insistent that the refund would be done within the 90 days, if they thought I’d paid too much interest. I was told that there would be no contact from them beforehand – no letter, the refund would just automatically drop into my credit card account and come off my balance, but they made it quite clear that they had to decide if I should be refunded the ROP interest. So I just have to wait and see I guess!

    • laura says

It’s not that you may have paid to much interest, it’s the fact that you shouldn’t have been. And as for them having to decide if you get back what was wrongly deducted every month ( rop interest) the fca have made it clear they have to . This so called financial company have got to be the worst ever, and to think they promote the card as a credit builder for the just managing. Mm.

Well this was what I thought Laura. They obviously had no idea if I was getting the interest refund or not, even though they must have had my account in front of them, which must have had a record of me cancelling the ROP last year on it after their letter explaining how much interest I was paying!

    Hi,

I have been reading many of the comments on here and was just wondering if anyone had any advise on where instant. I have had an account with Vanquis since 2011. I have cleared my balance with them in the last 6 months after years of struggling to bring the balance down due to paying the minimum, high intrest and rop.

I noticed sometime in 2016/2017 that I had ROP and cancelled this. I probably would know what it was at the time of purchase but possibly partly due to my own lack of intrest in my early 20s just looking to get accepted for credit.

Now my question is. I know that the decision has been made to refund the I Interest in ROP and I am happy with this and not fighting for the ROP refund itself. I see everyone on here mentioned officially logging complaints with Vanquis or the obudsman, should I do this.

Or wait in good faith that Vanquis will automatically refund as per the statement releases.

There is no need to do anything if you are happy to just get the refund (unless you have closed your account and moved – in which case you need to inform Vanquis of your contact details).

You should get a decent size refund!

Hi , I was rejected by vanquis so complaint was with ombudsman since october2017. Received email today from adjudicator to say vanquis has made me an offer and the letter will be with me on Monday. So will keep u all posted .

Sara did vanquis tell people in2017 or 2016 about the full cost of rop-I’ve seen both dates mentioned-so which is correct please

People seem to have got letters at different times from what I can tell.

My claim was rejected by Vanquis in January so I complained to FOS. I asked Vanquis for a copy of my call when the ROP was sold to me but it was never provided. I have received a letter from FOS today to say that Vanquis are now going to refund ALL of the ROP charges plus the interest in full. I have had my card since June 2015 and I cancelled the ROP in November 2016. For all those people who have had their complaints rejected by Vanquis, it really is worth pursuing a claim with the FOS. FOS have advised that Vanquis will now write to me in the next 28 days confirming the refund I will receive. Best of luck to everyone else!!

well done. how do you complain to the FOS? by letter or email? i emailed vanquis complaint back in the end of march and received a letter saying that they were looking into it and they would respond within 56 days. Hopefully they get back to me within the week.

        Hi James
I completed the template on the FOS website and attached a copy of the letter from Vanquis where they rejected my complaint. Give as much detail as you can – I wrote a full side of A4 paper in word and attached that as well. Good luck and persevere!!
