Vanquis is repaying £168,000,000 to over a million customers who had its ROP (Repayment Option Plan) on a Vanquis credit card since 2003.
UPDATE In summer 2018 the first refunds were credited to people’s accounts … but they looked surprisingly low. See ROP – the refunds are too small.
In February 2018, the FCA (Vanquis’s regulator) decided this meant that the ROP had been missold to every customer because the true cost of the extra interest they could be paying was not explained to them. It is this extra interest that customers will get back, not the ROP fees themselves. Full details of the refund are given in this FCA notice.
This refund is automatic, if you are affected you will get a letter or an email. But is there anything you need to do? Yes!
If you are still paying the ROP you should cancel it. Also you need to tell Vanquis if you have moved and you may want to complain if you think you should get a refund of the ROP itself.
How the ROP was mis-sold
The ROP product was supposed to be explained to customers in a sales call by Vanquis. But this call made ROP sound quite cheap – “only” £1.29 per £100 balance.
But it wasn’t explained that this ROP charge was added to a customer’s account as a purchase, so if the customer didn’t repay the balance in full, the next month they were then charged interest on top at the interest rate on their card, which could be 40, 50, 60% or more.
This wasn’t a mistake made in a few sales calls. The FCA says:
In 100 per cent of calls reviewed by the FCA, sales agents did not explain the full cost of the product to customers.
The FCA concludes:
Vanquis failed to make sure customers were informed about the full cost of the ROP when it was offered to customers… Customers are entitled to be told all relevant information when being offered financial products… The FCA found that the firm breached Principle 6 (Customers’ interests) & 7 (Communications with clients) of the FCA Principles for Businesses.
The refunds that Vanquis will be paying
Vanquis has agreed to repay the interest it has added on to the ROP charges since 2003. This is not a refund of the ROP charges themselves, but, for many customers, the interest added was a large amount.
These refunds will stop at the date 30 days after Vanquis wrote to customers with ROP in 2017 saying how much they had been charged and asking if they wanted to continue with the product. So if you got this letter in September 2017, your refund will be for the interest added up to the date of the refund on the ROP which was charged up to October 2017.
Vanquis issued other branded cards (Argos, Aquis, Black Diamond, Chrome, Granite, NEO, Origin, Progress, Vanquis and Xylo) – any of these may have had ROP, in which case it will be refunded by Vanquis in the same way a “normal” Vanquis card will be. Check your statement or phone up and ask if you have a card and you are not sure if you were paying ROP.
How much will you get?
The total refunds will be c £168 million. It is said that there will be 1.2 million people affected so the average payment will be about £140.
The calculation is complicated and it will be pretty difficult for you to try to estimate this unless you have all your old statements. But some guidelines:
- people who often cleared their card balance may get very small amounts;
- older accounts where there was normally a large balance may get very large refunds as the compound interest will have added up over time;
- you will get a larger refund if you were paying a higher rate of interest on your card.
Two examples of refunds people have received in the last six months show how the “interest paid” can be very different – larger or smaller – than the amount of ROP paid:
- ROP 547, interest paid 237
- ROP 216, interest paid 1184.
Vanquis say “Vanquis has agreed to refund any interest relating to ROP together with 8% statutory interest to cover any period your account would otherwise have been in credit.” I think this means that for any periods where you weren’t paying interest to Vanquis – including after your account was closed – you will get 8% simple interest added to the refund. If you have 8% added, this will be taxable, but the rest of the refund isn’t.
You won’t get less if you have used any of the ROP features
If you are one of the few people that used the interest freeze, or the larger number that used the “lifeline” facility, this shouldn’t matter. The point is you weren’t told what the full cost of the ROP was, so you will still be getting back the interest you paid on the ROP charges.
How will it be paid?
You need to work out which of the following groups you belong to as the refund process is different for each:
- you have an open account with Vanquis The refund will first be used to pay off your current balance and any additional amount will be sent to you by cheque. You will get an email or a letter from Vanquis explaining this after the refund has been credited to your account. There will be a line on your next monthly statement.
- you have closed the Vanquis account The refund will be sent to you by cheque from Vanquis with a letter explaining it. If you were in arrears and agreed on a partial settlement with Vanquis (or with a debt collector managing the account for Vanquis) then your refund will be reduced by the amount that was written off.
- your Vanquis account is being managed by a debt collector This will be refunded in much the same way as (1) except the email or letter you get may come from the debt collector rather than Vanquis.
- your Vanquis account has been sold to a debt purchaser Here the refunds will be calculated in the same way, using the balance that is owing to the debt purchaser. This will apply if the debt purchaser has got a CCJ. The email or letter you get explaining this will come from the debt purchaser not Vanquis.
When will it be paid?
In June Vanquis admitted that it can’t make its original 90 and 180 day targets. It is now hoping to have paid “most” of the refunds “by the end of the summer”. In September it gave up hoping to do that and is now saying February 2019.
The first of the refunds started being paid in mid-June. But some of them look very low! See Vanquis ROP refunds are wrong – it’s time to complain which explains why the refunds being sent aren’t correct and what you should do.
What should you do?
Cancel your ROP today!
If you are still paying ROP – I suggest you cancel it immediately so call them on 0330 099 3000 today! It is extremely expensive – it makes PPI look cheap and useful.
When people get into financial trouble, Vanquis has to consider freezing interest on their accounts even if they don’t have ROP – so you may get what most people think was the main benefit of the ROP for free.
You will get the refund automatically
You don’t need to put in a complaint, everyone who paid ROP will get a refund of any extra interest they were charged because of the ROP. Vanquis will calculate the amount and contact you.If you have moved or changed your name, you can give Vanquis your new details.
Should you complain and ask for a refund of the ROP itself?
If you want a “full refund”, not just the extra interest added, complain to Vanquis and say why you think you were mis-sold the ROP. Good reasons for this include:
- you didn’t know it was optional – you thought it was automatically included with your card so you couldn’t cancel it;
- you felt under pressure to accept it or you would not have been given any credit limit increases;
- you feel the sales call did not properly describe it to you because when you tried to claim (eg if your hours were cut) it was rejected.
NB you should not complain if the only reason is that you don’t think the extra interest was properly explained – you are already getting that extra interest refunded.
You can send this complaint to customer.relations@vanquisbank.co.uk . Put a title such as COMPLAINT re ROP PAYMENTS and make it clear you want a refund of the ROP payments themselves in addition to a refund of the extra interest you have been charged.

This is a massive cop out, I was misold ROP and had it for years, paying thousands of pounds when in fact I didn’t need to (I was unemployed when I was originally told I had to have ROP to get a credit card , and secondly I was working within in the Civil Service.) Now all I will get back is some interest. Ive been fighting this for years and well I personally think this is a disgrace and once again those who need these high interest credit cards being treated like second class citizens.

If you think you should never have been sold the ROP for other reasons, in addition to what Vanquis now accepts was its failure to explain the true cost, then you should send Vanquis a complaint saying this and asking for a refund of your ROP fees as well as the additional added interest. If they refuse, you can then take your complaint to the Ombudsman.
Vanquis should certainly never had said that you could only have a card if you take the ROP.

i have only just found all this iv had my account since 2014, i am pretty sure that due to me not being in employment i was told i had to have it (not 100% on that) its baffled me for a while why in paying £45 a month for it. I did ask for a payment holiday last november after i was refused an account freeze would this affect the outcome? I have now cancelled the ROP and made a complaint with regards to this and the amount im charged every month which is causing me to struggle to reduce my account as its maxed out.

This is good news today , but the rop was definitely miss sold to some of it’s customers (me) and I will still be contacting the ombudsman regarding that. And the crazy thing is that shares in provident financial were up 73% today , because the news wasn’t as bad as they thought it was going to be ???????

oh yes, the ROP was mis-sold. The FCA has agreed that and Vanquis has had to accept the decision.
But the question is what refund should you get? Before today, I was suggesting that you should ask for a refund of the ROP and the extra interest added. The FCA has decided that you should only get a refund of the extra interest, probably because that is the bit that wasn’t explained to you.
If you want to argue you should get a refund of the ROP as well, you will have to go to the Ombudsman.

Good news, I very happy that everyone who had ROP since June 2003 will be getting their interest charges back. A shame that the FCA didn’t go the whole way and order an automatic refund of all ROP payments too, seeing as though ROP was suspended and is now being completely re-vamped with FCA guidance.. Proves that ROP itself was totally flawed. Nevertheless, a great victory for all customers, not just those who complained within six years. The possibility to complain about any mis-selling of ROP is still there I suppose, so some people can get their ROP payments refunded.

Wow, was not expecting this at all but so pleased, not just for me but for those previously refused any refund too and anyone totally unaware of this, brilliant!
My complaint was submitted before this update on the situation so will wait and see if their generic response to an upheld complaint will change from ROP and interest refund to, you agreed to the ROP but would not have been aware of the cost so refund is interest only, which will save them some money on ROP fee payouts.
I really don’t mind, it’s gone from will I get a refund to how much will I be refunded, very pleased.

Vanquis turned my complaint down. They said they checked my phone call record and there was no evidence to suggest it was sold incorrectly.
I have referred it to the FOS recently. They also stated “you’ve mentioned that the features of the ROP plan were not explored whilst you were experiencing financial difficulties and in a debt management plan. I have been unable to locate a time when you were eligible to use one of the features of the plan and for them to be offered to you. Therefore my decision not to uphold remains the same.”
Does this mean I will miss out on a refund?

I assume if I only had ROP for two years then this isn’t going to be a huge amount, and I’m not up to the maths of it. I was shelling out about £35 a month on the ROP, getting all those £35’s back would have been nice but the interest even at 35% pa isn’t going to turn into a huge amount. Oh well.

Actually I have just had a go and £2500 x 1.29% gives the £32 a month ROP I was paying, which is £384 a year, 35% is £134 and then the next year compounded will be £134 x 1.35 or £180. So £314 and that’s the minimum because it took about 18 months to get up to a £2500 balance, so there will be other ROP payments, though lower, these will have compound interest for longer.
So i think £500 to £750, even for my relatively recent (2014) account. Some other payouts ought to be huge!
They will have to pay the compound interest right up to now won’t they? Not just till they wrote to people?

In case anyone’s curious I opened the account with a £500 balance in Sep 14, by Dec 15 the balance was up to £2500 and in Feb 17 I cancelled the ROP.

BUT you need to think about cancelling the ROP, because it’s so expensive. Look at what you are paying each month, if it wasn’t for that your balance might actually start dropping… This won’t reduce your refund at all, you aren’t going to get refund for next month’s ROP fee, so phone them up now if you want to cancel it.

I already complained to Vanquis about 5 months ago about this matter and they refunded me £300 (o pay the ROP for 4 years and my balance was £4500) so it seems pretty low, also my reply letter from Vanquis didn’t mention any interest being returned. Do you think I will be contacted again or is this it for me?

I haven’t heard of anyone being offered the ROP back but not the interest before.
I suggest you ask them to explain how this figure was calculated. If that was all the ROP you paid over 4 years, my guess is your balance must have been a lot lower at the start. In which case the interest on the ROP may not be as much as you would think, possibly not more than the refund you have had. But worth asking for more information.

A just received a letter this morning saying I agreed to the terms and conditions of the rop bit to be honest I never understood and don’t recall receiving a welcome pack a had the card for maybe 5 years I did cancel the rop in 2014 because it was a lot I was just lucky that I could eventually pay the card off as it was never going down my partner also had the same card and I know her bill Twice the amount mine was are they paying all rop back

Well I’ve read a few conflicting reports today. The one that stands out is MSE usually a good source. Hopefully they’ve made a mistake. They state that the only dates that will be paid back are 2003-March 2014, but does state should get money paid back within 90 days if account still open 180 days if not. Also I can get it off my Argos card from 2003! So once again thanks Sara

2003-2014 is definitely wrong, it is a misunderstanding. What the FCA said was
“The FCA has ordered Vanquis to pay back the interest customers were charged on the ROP from 1 April 2014 to when customers were informed of the full cost of the ROP. Vanquis has voluntarily agreed to pay back the interest customers were charged on the ROP from June 2003 to 31 March 2014, because before this time the FCA was not responsible for regulating the consumer credit market.”
The FCA can only tell Vanquis what to do after April 2014 – before then they weren’t Vanquis’s regulator. So they have ordered a refund if the interest from that date. But Vanquis has “voluntarily“ offered to do the same from 2003 to 2014, so effectively the refund runs from 2003 until 2017 when people were told of the full cost.

Hi Sara, my partner had a vanquis card from 2003 which he used right up until 2014/15ish which then when into default, he paid ROP all the way through. It’s now been sold to a debt collection agency…any idea how this might pan out? If a refund was due would they pay it to who they sold the debt too first or too him and then he could choose to pay it off himself? Many thanks!

hi sara having just read your latest post on vanquish just a quick question last month i forward my complaint to fos because vanquish had rejected my claim due to my card being taken out in 2009 does the latest news mean i will be due a refund of all intrest paid on the rop from this date and should i cancel my claim with the fos as my main point was i did not know this rop was charged intrest every month or should i just leave my claim in a little longer i dont want to clog up the fos for longer than i need to as a know they are very busy and they do a good job i paid my vanquish account off with the payday refund i recieved thanks to you but the card is still active i did cancel the rop when i found out how much it was costing me ty

“should i cancel my claim with the fos” that is a harder one. In theory it should be fine, but what if their admin goes astray or you don’t hear anything from them for 6 months? It’s tempting to let the FOS complaint stand until you get your refund – you could tell the adjudicator this?

This is excellent news for customers. I have also submitted a complaint using the template that Sara provided. Vanquis responded with a letter which included my complaint number. They also informed me that I should hear back in 56 days. I’m 30 days in. I will keep my fingers crossed after yesterday’s announcement and post an update as soon as I have one.

I think that means that when your account had a balance, you will be refunded the interest you were charged on the card. And when your account had a zero balance – including after the account was closed, you will get 8% simple interest.

I had this and paid it for 2 years. I included the unpaid balance in a trust deed that was completed 8 years ago. Will I receive this back?? It can’t go to my administrator as my case was closed years ago?

If you were still in a Trust deed, it would go to your administrator. So far as I am aware (and I am not an expert on Scottish Insolvency) the administrator would have to go back to court to reopen your Trust Deed to claim the refund, and after so long that would seem to be unlikely.
BUT there is also a chance that Vanquis may decide to set off the refund against the amount you defaulted on. I can’t guess if they will do this.

The current ROP page says the full plan covers you if “you’re self-employed, experiencing a reduction in weekly income by 20% or more through loss or non-renewal of contracts or work”. I don’t know if those were the T&Cs when you took the ROP out. I remember someone commenting that they couldn’t claim because they were asked to send more accountants info than they had.

Thx Sara i understand the t&c’s, however if i never had ROP and i was unable to gain employment for a while then would vanquis have froze my account anyway ? hence ROP mis-sold ?

ok, that is rather a different question. Yes you can try making that argument, first to Vanquis and then to the Ombudsman, that as a regulated lender Vanquis would have had to consider forbearance, see https://www.handbook.fca.org.uk/handbook/CONC/7/3.html?date=2016-03-21 if you couldn’t get work.
The FCA presumably considered this argument. The difficulty with it is that the interest freeze wasn’t the only feature of the ROP. And in a year typically nearly 40% of ROP customers used the Lifeline facility, 20% used the text message near limit reminder facility and 85% used the text alert for payment due facility. Now paying the ROP charge for just these would be a rip-off, but regulators don’t tend to declare something mis-sold because of that.
By going for the “refund interest charges that weren’t explained”, the FCA neatly cut through all the arguments about who would have benefited from the ROP and just refunded everyone some money, even if they used ROP features.

Hope you can help. I have a complaint with the ombudsman at present for rop with Vanquis. I had my account from 2006 with a cl of £500 that rose to £2500 by 2012 always virtually maxed out. My question is as there were varying values to my rop each month dependent upon my balance and I was charged 34.2% does this mean I will get the 34.2% on each top transaction for the time I had my card and then when I was closed in 2012, statutory 8% interest on the total refund from 2013 to date? If so, great, however I understand why it wil be a complicated calculation !!
Also shall I leave my complaint with the fos and assume Vanquis will deal with the interest only aspect directly?

My complaint is now with an Ombudsman after the investigator sided with Vanquis (twice) about the 6+3 rule; but I suppose a small win is better than no win at all. Nevertheless, I’ll take my chances with the Ombudsman hopefully ruling in my favour over mis-selling and grant me a refund of the payments as well.
Its not like Vanquis can renege on the ROP interest + 8% refund, so I don’t have anything to lose in that regard going after the premiums as well.
I have around £1000 still on my Vanquis card; I doubt the ROP interest refund will be enough to put me in credit, but it will at least knock a nice hole in the balance.

I recently had a refund in December of ROP:

It wasn’t for the whole of the card as I had ROP from 2004 to 2010 then apparently from 2012 to 2014 , the second ROP (2012-2014) was the refund I got back as everything wasn’t mentioned in call but got nothing for the first lot of ROP. ,
My balance was virtually £3000 up until 2012 when it was up to the max of £4000 until January where it was cleared, do u think I will be getting a substantial amount of interest back as from 2005 onwards I was paying 59%interst on card (-around £40 a month for ROP)
Like you said the amount of interest paid out e.g. my first refund can be a lot higher than that of the ROP itself, considering the amount of time since my first ROP payments I am looking forwards to the amount I am going to get.

Yes I think you should now get a refund from the first ROP episode. I can’t guess how much but well worth pursuing.
I think you should phone them up and ask if you will be getting a refund for the first tranche – I’m not suggesting that most people should do this, but your situation is highly unusual and I am concerned if you don’t get on to this you may not be considered as you may be sitting in the “we already paid him a lot so that’s sorted” pile. By accepting their offer you were technically agreeing to a full settlement of your claim… but I think the FCA’s ruling and Vanquis’s decision to pay out on older loans means this should be pursued, to the Ombudsman if Vanquis don’t co-operate.

Further to my last comments, received letter 10th January upheld complaint I should receive cheque within 28 days.
35 days passsed I called up, got told sorry they are a bit behind and will be posted.
42 days- still no cheque, call back up told the same thing it will definitely be posted- low and behold still no cheque
Day 47- got told we will post today and it will be recorded with £25 compensation too, please call back Thursday for tracking number if it hasn’t arrived but it should of by then… today Day 50- just called for tracking number and they’re now using the snow as an excuse for why it hasn’t been sent and that it will be picked up by Royal Mail today and with me tomorrow or Monday. Obviously I don’t believe a word of this now- what can I do? Please help!!

I had a vanquis card from around 2009-2014 and very rarely managed to clear the balance with a credit limit of £2500. however I have had a DRO will this affect any payment I am due or will this cancel it out completely does anyone know?!

If your DRO was still running, you would not be getting a refund. As it has completed, it is not clear from the FCA’s paper https://www.fca.org.uk/publication/final-notices/vanquis-bank-limited-2018.pdf if you will get a refund or not.

Looking at my statement today to make a payment, I’ve only just realised I pay ROP on my account which I opened in late 2013. I just googled it and, of course, came across this ongoing issue and the great news of potentially being refunded the interest. I wonder, however, if there was a template letter anyone knew of regarding being missold the Repayment Plan itself entirely. I have no knowledge of this being explained to me, no welcome pack, nothing. I never take out any extras on anything ever! I’m just concerned about what I should be writing to put forward my best case.
Any help or advice would be so absolutely appreciated.

When you got the card, you should have received a sales call to persuade you what a great idea ROP was… if you are sure you never had this call, or didn’t agree to take the ROP, you do not need a template letter just email mailto:customer.relations@vanquisbank.co.uk with COMPLAINT as the title and say that you understand you will be getting a refund of the interest on the ROP but you also want a refund of the ROP itself as you never agreed to take it, as their call recording will show.

I rang Vanquis on Wednesday and asked about ROP. I was told that I did have it and that they would send a cheque within the next 180 days. I did ask if they could fast track it, as I am moving soon and the lady said she would make a note of the system. We shall see!
Has anyone else been told anything like this? 180 days (6 months) seems a heck of a long time.
The account has been closed for a couple of years now.

It is a refund of the interest you have been charged on the ROP, not a refund of the ROP charges themselves.

I have just contacted them they took details of telephone number and address and said they will be in touch within 90 days about a refund on rop depending on how long you had it and the interest paid they will be in touch via phone call or letter. Hope that helps everyone.

Everyone who has paid ROP will be getting a refund, not of the ROP itself but of the extra interest they have paid because of it.
It was only announced by Vanquis this week and they haven’t yet written to anyone about it, but you should hear in 3 months if your account is still open, or 6 months if it is closed.
Some of the comments here make it sound as though the refunds have been going on for a while – well they have for the people that were using my template letter to complain. But now you don’t have to put in a complaint, you should be refunded automatically :)

Hi all I’m the same took the card out in feb 2014, was paying for ROP right up until last year when I was paying at least £80-£100 a month with a £4000 limit never could get my balance down so I cancelled the plan and my minimum payments still haven’t gone down, still having to pay £200+ a month even though I don’t need to as there is always £100 left after my statement has been generated, will I get a refund on the interest as I was paying a lot throughout the 4 years that I’ve had this card

If you are using the card this may not be very obvious to you, but you are in a much better position than if you hadn’t cancelled the ROP.

This FCA ruling is excellent news proving that Vanquis was in the wrong. I had the ROP from 14th March 2007 to 15th January 2012. When I tried to make use of the ROP due to some temporary financial issues, I was told over the phone that it could not be applied because I was self-employed! But they knew I was when they sold me the ROP.
Since Sarah put the thread about trying to get a refund, I put my complaint forward and on 18th October 2017, I received a letter from Vanquis rejecting my claim on the grounds that the ROP scheme I had was over 6 years ago. I contacted them 3 weeks ago to ask them to send me the transcriptions of the call to take the claim to the Ombudsman. To date I still have not received the copies of the transcribed calls.
I am wondering whether I should contact Vanquis and make them aware that I am expecting a refund?

I think you will now get a refund of the extra interest you were charged. On 5 years ROP that may be quite a lot.
But it isn’t a refund of the ROP itself. It sounds as though you have a good case for asking for that back too, as you were misled about it. It’s up to you if you want to take the case to the Financial Ombudsman to ask for a “full refund” – if you want to do this, I think you should do it now, not wait for the call recordings which could take a long while. Get your case to the FOS and the FOS can ask Vanquis for the recordings.
If you would be happy to just get the interest part back (and I must emphasise I am guessing when I say that may be a lot) then I think you should write to Vanquis and say you are happy to settle your complaint on the basis of the automatic refund they are sending everyone. But if you don’t get a reply still send the case to the FOS.

But also think about cancelling it straight away – it is very expensive. If you weren’t paying this, more of your monthly payment would be paying off your balance, reducing the interest you are charged the next month. Most people think the “interest freeze” is ROP’s main feature – but if you get into financial difficulty every lender in Britain has to consider freezing interest, so you don’t have to pay the ROP to get this.

I had a Vanquis card from 2007 to 2013 with rop, I logged my complaint via email in October, I received a confirmation email and a letter stating they are dealing with my complaint. To date I haven’t received a resolution, even though I have telephoned numerous times, should I get in touch with ombudsman?

That’s odd, they are slow but not normally that slow.
If you want a “full refund” – not just the interest which is now going to be refunded automatically – you should send your complaint to the Ombudsman now.
If you would be happy to just get the interest back you should write to Vanquis and say you are prepared to settle your complaint now on the basis of the automatic refund they are sending everyone. If they don’t reply within a couple of weeks, send it to the Ombudsman.

hi :) great news :)) iv e got my yearly statement in front of me for 2017 _2018 iv e been overlimit the whole year on 3000 limit I have not used the card since nov2016 and could not get the balance down !! found this site just before Christmas and used your template to complain and was rejected. was just figuring out what to put in my claim to FOS and came to check on here for help and saw the news :) Now to my question bearing in mind I haven t used the card my statement says purchase transactions £403.34 interest charged on purchase transactions £1481.10 !! how do I figure out what I could get back ?? When I first opened my account in 2013 over the phone, I can remember saying no to the repayment option plan, but then I saw the payment on my statement a few months later and didn’t realise it was the product I declined. Currently I have a payment arrangement in place, so ROP is still on my account but not being charged.
If i believe I said no to ROP at the very beginning, is this grounds for a complete refund of ROP as well as the associated interest?
If so, how should i go about this? Should they have a recording of my call from 2013?

Yes that is grounds to have the ROP itself refunded as well as the extra interest incurred because of it.
Put in a complaint being very clear about this. An email title COMPLAINT I REFUSED ROP BUT WAS CHARGED FOR IT would help. Tell them to listen to the call recording – from 2013 they will have this. Be clear you want the ROP itself refunded in addition to the automatic refund of the extra interest refunded. Send the case to the Ombudsman after 8 weeks.

I last emailed u on the 28th saying about my upheld refund in December for ROP from 2012-2014 and I put down that it wasn’t upheld for the period of 2005 to 2010 , so u suggested I get in touch with them to see if I was to get my interest for the first ROP , I sent them a email that day and just had a phone call from them saying yes I would be getting all interest back from that period, I asked when I may hear from vanquis regarding the refund and they told me that the refund team have been told today that Vanquis will be working on cases from 2003 (longest and probably most refund) up to October 2017 , so if u had it around 2003 you may be one of the first but the later it was the longer u will have to wait….I hope this gives a indication of how long people will have to wait

I had a letter in late 2016 confirming how much I had paid as ROP on the previous year and saying it had been subject to my interest rate of 49.94%.
Oh 2017 I received the same kind of letter, although my balances had been zero for a year, but it stayed that my ROP interest rate was 39%.
I’m glad that it was the higher rate whilst I had a balance as it will make for a better refund! I paid £880 from 2011-2016, but most of it was from 2014 when they increased my credit limit frequently.

i have cancelled the ROP on 27th february and made my complaint in regards to the ROP. I was told on the phone that theyd logged the complaint and to wait 56 days but they also said id receive notification through the post yet still nothing. They only thing i have received is a text message on the 5th march apologising for my experience and they have logged my complaint (including ref number) for investigation. Shouldnt i of received a letter of confirmation rather than a text message?

I put a rop complaint in on the 13th Feb and received a letter at the start of March acknowledging the e-mail and that they would be in touch within the 56 days. So don’t worry I’m sure you will hear soon. After this ruling I imagine they are pretty busy haha.

I had a phone call yesterday saying my case was being dealt with. I had to send confirmation of my change of name and address as these had all changed since I had my account. They were lovely and very helpful. Whilst she couldn’t tell me how much I was getting she just stated that a cheque would be sent to me within the 180 days. I’m hoping it might come before then though. I’m intrigued as I’ve no idea how much the refund will be, I was to the limit on my card all the time and eventually cut it up and paid it off! My final limit I think was £2,750 and I opened this in 2012 and closed in 2015! Anyone know how or if we can work this out before we get the cheque, just so I have an idea of what to expect!

I was in a similar situation and went over my limit by a small amount each month and was charged overlimit fee. Do you think we will get compound interest on the £12 fee if the rop and interest charge caused this ?

I think you should if it was the additional interest taking you over the limit – which I think it would often be. When you are offered a refund, ask them how this was calculated and if it includes these over limit fees.

I complained in January and have just logged in to see my £500 balance cleared, nothing to say if i am due extra. How long did people have to wait before receiving a cheque in the post? Have just made a basic calculation £25 rop per month @2 years @ 39%Apr which is roughly 3% per month is coming out at £28.82p. I think vanquis have got off very lightly, and I for one will definitely be pursuing my rop payments as they were miss sold .never asked for it never used it , and to be honest never even knew I had it until 5 years of paying it just thought it was part of my monthly bill. You live and learn. !

Back of a fag packet calculation – £25 ROP every month for 2 years the interest charged at 40% I make about £200… The first month there is just 1 months ROP to charge interest on. The second month there are two months ROP to charge interest on. etc.
So you may be surprised how much the automatic refund comes to. But if you are sure you never agreed to it, then you should complain, tell them to check the call recordings and ask for a refund of the ROP itself.

I complained in January, got the standard letter saying we dealing with your complaint and have 56 days to reply . Then got a letter saying I took out ROP in 2011 and it’s past the 6 years . Hiya I was also paying rop for vanquis too didn’t realise till 3 year later and when I phoned them they said I opted into it even tho I’m unemployed so I know I didn’t they contacted me and said they would put 600 back on my vanquis card anyway it never showed on my statements or anything my limit was 3 grand and was paying 130 pound a month plus 20 pound rop add to stop paying them due to relationship breakdown so if they paid me that 600 pound my balance would be 2400 and they’ve sent me letters saying I owe 3752 pound and sent my debt to a debt collector have I got a case pls

If you paid ROP for three years then you should automatically get a refund of the extra interest you have paid. This will be sent as a credit to the account with the debt collectors. Let us know how much you get!
But I am not quite clear if Vanquis stopped your ROP after you complained… if they carried on, then I think you should also ask for a refund of all the ROP you paid after that point.

It’s 40% a year the monthly equivalent compound rate is 2.48. So it would be £25 +2.48%. Hope I am wrong. And as I have said before I asked vanquis for my rop payments back , but they told me they do not keep phone recordings after 6 years .

You are right for 1 month. But the next month your balance will have gone up by £50 – the £25 from that month and the £25 from the month before (assuming you haven’t cleared the balance) so interest is charged on that. Etc etc by the end of two year interest is being charged on £600. The “interest on ROP” adds up to a lot over time!

I had masses of personal debt which have completely written off nearly a decade of my life.
Entered a DMP 4 years ago and I can now see a light at the end of the tunnel.
Complained about PPI to Vanquis and was told about the ROP I had activates on my account from 2009 until Jan 2018. Credit limit was £3,500 with minimum payments and always over limit being the norm.
Fingers crossed this will clear another chunk of the debt! ????

This is what I think should happen:
The interest will have carried on being charged on the ROP you had already paid after you stopped paying it any more. This may well be a very large amount – can you let us know when you find out?
BUT I’m not sure whether you will get 8% in addition. I suspect that may on;y kick in if you actually repaid some ROP bu paying off a large amount of your balance.

I took out a Vanquis CC in 2007 with ROP (not sure if i agreed to it or not), 54% APR and a limit of £500. I went over my limit in around 2010 so haven’t used the card since then and although I made the minimum payments each month my balance increased. (End of Jan 2018 my balance had gone up to £1700, £1200 overlimit)
I wonder if I’ll get the overlimit charges back in addition to the interest?
Do you think it’d be worth pursuing the ROP amounts that I paid through the ombudsman?

I sent an email to FOS to find out how my case against Vanquis was progressing due to recent events and he has said they were “trying to determine how this will affect individual complaints,if at all.unfortunately we are not able to confirm how long this will take but it does mean at the moment we are not in the position to investigate complaints at this present moment , as things progress I will keep u up to date as best as I can ”
So the way I see it FOS are suspending cases for the time being ,thought I would share this with this website

Just an update on cancelling and complaining to vanquis about the ROP on the 27th February 2018. They have decided although it seems i agreed to the ROP but luckily for me certain points weren’t met during the call and they have decided to refund ALL ROP fees from February 2014 upto February 2018 with Associated interest plus the notional 8% interest. Thank you im extremely happy with the outcome and help provided from this site. Goodluck to Everyone taking up a case i hope yours is as successful as mine.

I received a letter this morning stating my complaint has been upheld and I will be receiving £1288.47 as a refund, ROP was mis-sold to me in Oct 2012.
I am still waiting for the refund to hit my vanquis account balance but I am sure it will do by Monday.
Once again thank you, I go to New York in April and this helps out massively.

hi Sara xx impatient person that I am I had a go at figuring out :) had my account since 2010 but only got 2015 to 2018 statements so went through every one n wrote down each months ROP :) my apr is 59.9 % :( ROP started out with £12.02 ROP payment so added 5% to that then added following months ROP of £15.93 then 5% again then so on n so on ROP payments rose to £40.37 in the end :\ by using this method the total was a staggering £3,344 !!!! don t forget my claim actually starts 5 yrs before these figures !! does my method seem about right to you lol (hope so ) like to add I feel really annoyed that they re sending me texts to remind me to pay them my next months payment when they owe me !!!

As you still have the card, you should get your refund of the extra interest you have been paying because of this ROP in the 90 day window, so that would be by the end of May.
Don’t worry that you haven’t heard anything – no one has yet had a letter about this new automatic refund! The people talking on here about refunds put in a complaint to Vanquis in early January or before.
It’s your choice whether to cancel it – I think ROP is incredibly expensive, worse than PPI. At least PPI would make your monthly payments, reducing what you owe – all ROP does is mean you don’t have to pay for a while, but your debt stays the same. If you cancel the ROP, you monthly payment is going to mean your balance actually starts falling.
If you want to cancel now, phone them up and say so – don’t wait for the letter about your refund to arrive in a couple of months.

I complained on 11th January , within a week I had a letter to say ROP was now cancelled , yesterday I received a letter from vanquis to say it was more than 6 years and I should have realised I had it , this was added to my account after a call on 26 march 2009 and have been paying for it since April 2009 and they are upholding my complaint and I have the right to complain to the FSA , so although they have taken minimum payment every month since 2009 and I stopped using the card a long time ago , there was never a missed payment and my debt continued to rise , until I found this site , could I ask your advice on next step and how it should be worded please , it seems I have paid them a fortune and am prepared to fight this .

If that is right:
You will be getting an automatic refund of the interest you have been charged on the ROP payments – that is likely to be a lot! You should be getting a letter about this before the end of May.
You won’t be getting an automatic refund of the ROP you paid. If you think this was mis-sold and you want the ROP back as well as the interest, you can send your complaint to the Ombudsman now. Or you could decide to wait and see what you get back automatically? Vanquis’s reply to you have said that you have 6 months to go to the FOS.
I don’t know if the FOS will consider these complaints about mis-selling more than 6 years ago. If Vanquis don’t have the 10 year old call recording, then it may be hard to win this even if the FOS looks into it – there are practical problems with very old complaints. I’m not trying to say don’t do this, I am just saying what may happen.

Hi Sara , I spoke to FSO and emailed a copy of the letter , today I have received a call from them and they are contacting vanquis today regarding my complaint , I will of course keep you posted … and thanks again .

So.. after 54 days elapsed since putting in my complaint VQ have ruled that they can’t uphold my complaint as they put the investigation against my current card which doesn’t have ROP on, not the old account which did even though I explicitly informed them of this when entering into this process, I hope this doesn’t reset the complaint back to 0 days when I get them to correct this detail tomorrow morning!

If the FCA has determined that ROP was missold to every customer then surely all ROP payments should be refunded and not just the interest as it is being missold that forms everyone’s complaint

So far as I can tell, the argument runs that by refunding the extra interest you were charged, the cost of the ROP is then reduced to what you agreed to, so that’s all right.

It would appear to me though that Vanquis can’t argue that ROP wasn’t mis-sold as the FCA has determined that it was in 100% of the cases they looked at. Therefore everyone who claims it was and makes a complaint to Vanquis should be entitled to a full refund of ROP payments and interest. I think Vanquis may be looking at this as the lesser of two evils as the cost of repaying ROP plus interest would be a lot more than £168,000,000.

Let me try again to explain what I think has been decided. Sorry if the example seems simplistic but I am trying to be clear.
Say you agreed to buy something for £50. But you were actually charged £90. The FCA is saying this was missold as you only agreed to 50, so you should get a refund of the bit you didn’t realise you would be charged, the 40. The FCA isn’t saying that it was missold so you should get 90 back as you had agreed to pay 50.
Does this reduce the amount Vanquis have to pay? Well yes but…
1) its automatic so there is no need to look at each individual case, no need for complaints and people won’t get less if they used some of the ROP benefits
2) Vanquis have agreed to pay out on cases before the FCA became their regulator in 2014 – they couldn’t be made to do this
3) Vanquis are paying out even for cases over 6 years old.
Overall this is going to add up to a LOT more than a full refund of ROP as well on the post-2014 cases.
And anyone who feels they have a good case for misspelling for reasons apart from the extra interest can still complain if they want.
It is a compromise, but it seems like a good solution on balance in my opinion.
