Before December 2015 Swift Sterling, Pounds Till Payday and My Money Partner were trading names of Northway Financial Corporation Limited, a Maltese company.
In 2016 these brand names were bought by a UK company called MMP which went into administration in December 2019.

If your loans were before December 2015
Then you need to complain to Northway about them. If that doesn’t resolve your complaint you can’t go to the UK Financial Ombudsman, you have to go to the Maltese authorities.
The Financial Ombudsman won’t look at complaints about loans from the Maltese lender
The comments below show how other people have got on. SoO far as I am aware, these complaints are now being rejected as too old (“time-barred”) in Malta.
No-one has received a refund or a write off since mid 2019.
If your loans were after December 2015

Your complaint is a normal payday loan affordability complaint in the UK.
You would have been able to go to the UK Financial Ombudsman, but now MMP is in administration, all claims have to be sent to the administrators using the Claims Portal.
All questions about the administration and these later loans should be asked on the main payday loan refund page.
Why can’t you take these complaints to the Financial Ombudsman?
Both Swift Sterling’s and Pounds Till Payday’s websites said in 2015 in their Complaints Procedures:
“At this stage, if you are dissatisfied with the delay or we have not been able to sort out your complaint to your satisfaction, you can escalate your complaint to an external body (see below).
Step 3 – If you remain dissatisfied
It is important that you give us the opportunity of addressing your concerns first before escalating your complaint as they will only consider your complaint after we have had the opportunity to sort out the matter under our internal complaints process.
You may ask the Financial Ombudsman Service to review your complaint. You should contact the Financial Ombudsman Service within 6 months of receiving our final response letter. Their details are below: [full address and email details for the UK Financial Ombudsman]”
One reader has received the following reply from the Financial Ombudsman:
“Unfortunately Pounds till Payday don’t have offices in the UK and as a result we are still unable to look at complaints about them. As you said below, their offices are based in Malta and they are regulated by the Malta Financial Services Authority. I’m sorry their website seems to suggest otherwise… I agree this is misleading borrowers.“
So if you wanted to complain that one of these lenders gave you a loan that was unaffordable, you have to go through the Maltese regulators, not UK processes. But in 2019 these complaints were being rejected as too old – the legal term is “time-barred”.
Was your debt been sold to Lantern (was called MotorMile Finance)?
Swift Sterling and Pounds Till Payday have sold many defaulted debts to the UK debt collector MotorMile Finance (MMF), which changed its name in 2018 to Lantern. In November 2016 the FCA has made MMF offer a redress package to many customers because of poor way it has handled debt recovery.
Claims against Lantern can only relate to the defaulted debts sold to them.

Exactly the same as me Craig – however, they then sent me another one from MMP (2015/2016) only a small loan so they had forwarded that to them as a different email address.
They were quick in responding with statements – others are not as quick. How long did you give them Craig? I advised it was only open this offer until the 31.3.2018? and on my smaller loan I said within 14 days… Will keep you all posted.

had a response from northway today, i have a balance outstanding but this was sold to mmf, northway have said they are unable to recall my files from mmf so i have to contact them about my last 2 loans with balance of £449, actual loan amount was only £255, one of them is a ccj now with balance of £360, other £260, is that info correct off them? i told them i wanted them to consider all of the loans together but they obviously never.
they said they believe the lent to me responsibly and a unable to offer any compensation but as a gesture of goodwill they will refund £59, i only had 8 loans over a year, with around £250 interest i thought they might have offered to wipe the last 2 loans meaning they wouldnt have to pay out anything.
could anyone advise what i should do now? it would be much appreciated, also any know the email address for arbitrator?

When I requested my statements Northway told me they were responsible up unit August 2015 and sent me that statement explaining that they are responsible for those. Advised that MMF were responsible for any loans after that date. The following day I receive a statement on MMF headed paper with the loans from them so I presume they do work in partnership.
They have to prove they lent you responsibly not the other way round someone said on here. I think they treat each loan separately where as it should be treated all together in relation to roll over loans – however, I am no expert.
I would personally refuse as the 8% along with the 250 would be around £280-£290 that is not even 25%. They may make a second offer. How long did you wait until you received the first offer of goodwill?

The 8% is only really relevant to UK claims. Don’t reject what would be an OK offer because it doesn’t include the 8% element.

thanks louise, i sent them back an email yesterday saying i reject their offer of £59, i dont understand why they cant get my file from mmf so i emailed to ask yesterday along with this, they said they checked my creditworthness at the time but if they had done they would have seen defaults on credit file, other loans from payday lenders, they never asked for bank statements or proof of income if they had done they would have seen the state of my account and i was living on a 1200 overdraft, i put all this in the email and gave them 7 days to get back to me because the letter never said it was their final response, try my luck you never know, i just wanted them to wipe the last 2 loans it works out the same

I haven’t had any offers as yet however, only done this week so very early days for me – Swift Sterling (via Northway) is a big one for me thousands so far they have been quick in response to the statements and then I got the statement from MMF via swift sterling but on their headed paper. I have chanced my arm with the MMF responsibility and worked out what it would be and have deducted £100 but have given a deadline. (14 days as a lower amount) Have you had any luck with other lenders? I have sent them all letters now so a waiting game. Keep us posted and good luck :) They should be able to get your credit file.

Since receiving my statement I have sent a further 3 emails with a gesture of good will offer to Norway and all have been ignored. They have until the 22nd to reply which is the 8 weeks they advised and I am sending my complaint to the arbiter seems they quick to send statements then just ignore you after that.

Did you give them a deadline Jo for the Goodwill offer. They sent my statements very quick and I have done the same when I sent my complaint letter but gave them a deadline. The deadline is not up as yet, They will probably respond on the 22.3.2018 or the day before. It is a waiting game. Which is the worst.

They’ve just come back to me with an offer to write off the outstanding loan (£900) and offered £2300 in comp. I didn’t go via the OAFS and just sent the reg. letters from this site. I’m going to go with that, I could prob could get more after a lengthy process as they are based in Malta? But for now that this will suffice (Just got £900 from Peachy also and again I could prob get more going via FOS but I’m happy to go with this). TIP – Check junk email as that’s were PTP / Northway emails go to!

Lending stream I accepted a £200 refund from almost 2 years ago not realising I could go to FOS and they since wrote to me saying they should have advised that. So I’ve went straight to FOS as I had 26 loans with lending stream :-(

Hi all, I’ve just received a letter back from the delightful Northway to tell me I owe them £176.17 but I’m not sure how they have come to that figure, can anyone help me out?
Loan amount: £200, fees £59.96
Loan amount: £250, fees £74.95
Loan amount: £300, fees £89.94 default £59.00
Loan amount: £100, fees £29.98
Loan amount: £540, fees £161.89, default £59.00, amount paid on loan £50 sold to MMF £710.89
I calculate the fees & defaults to be £534.72, which doesn’t take into account the £50 i’ve already paid them on the last loan.
They say that they cannot uphold the affordability complaint but that will remove all fees and defaults at a total of £534.72 and tell me that I owe them £176.17.
As they have removed all interest and defaults then surely that applies to the last loan as well or how have they reached the figure of £534.72? If so would the loan amount outstanding be £540? I would of thought they would have taken the £50 off that has been paid and then I assumed that there would be no debt remaining.
Can anyone tell me if I do owe them £176.17?

i have the same problem with them, mines got sold to mmf loan total £255, i now have a ccj for £360 and the other one is now £250 default, so £610 instead off 255, they said they could not recall my file from mmf, whicem back i dont understand because they sent me my original loan agreement with their response, never upheld complaint but offered £59 good will, i emailed back and asked why they cannot recall my file, waiting on a response.
as to your question i worked it out as £5 u owe them if they want to be fussy,tell them exactly what you want them to do and if they dont do it tell them you will be sending your complaint to the OAFS in malta.
people have had some luck doing that and i dont think you have anything to lose, they refunding you so surely they were in the wrong then and last loan should be removed from your file and wiped, no cash back but file a little better.

I think you are correct on these calculations. They have sold the debt to MMF for £710.89 – only the last loan is MMF so you need to complain to them directly.
Last loan if taken out I think after end of August 2015 that is when they took over.
That would be correct:
Loan amount £540 fees £161.89 default £59.00 = £760.89 you paid £50 £710.89. You have to separate them if they have gone to different lenders. They sent me two separate statements for mine. I sent two different complaints.
It is probably the difference from the fees and defaults from what you have paid for the first 4 loans on here?

I called their bluff and worded my reply with a figure I thought goodwill gesture should be based on interest I had paid over the years. Gave them 7day deadline otherwise I was going to Arbiter. By 7th day no response so I copied them in my email to Osf enquiring as to next steps and bingo they came back straight away within 4hours with significant increased offer which was only slightly less than what I said so accepted offer and money was in my account within an hour. Base your amount on what you paid only in interest and charges as that is what OSF will be looking at. Good luck hold your nerve.

Mr lender- used resolver. Reply in three days, £600 outstanding written off
Wonga- reply within two weeks, refund of 2k plus I had 1.5k written off back in 2015 as part of the forbearance, still waiting for funds but e-mail received confirming payment within 14days
Sunny- reply within 4 weeks. Write off of £250 and refund of £400, payment made within the week.
Payday express- playing tough, going to ombudsman.
Payday uk- still investigating
Now the interesting bit!
Northway!! E-mailed direct, answer within 1week, wrote off £300 balance and refund of 2.5k!! Money transferred the same day!!!

Interesting that Northway answered you within a week! I had 20 loans from Pounds Till Payday one month after the other between 2007-09. Submitted my complaint to Northway on 27th February including an offer of a goodwill gesture with a 2 week deadline. I asked for an update after the 2 weeks and all i got back was i would hear within the standard 8 weeks so quite curious to how yours went so quick!

oh yes i am expecting them to deny they done no wrong even though i was borrowing every month for nearly 2 years and it got more and more each month! Almost £3k in interest i paid alone!
as for lending stream i complained to them couple of years ago and settled very early at £200 mainly because i needed the money and couldnt wait any longer. at no time during the complaint and their final response did they advise i could take this to the FOS. they have since written to me advising they should have advised this and i am within my rights to do so. this is now with the FOS as i had over 20 loans with them with over £3k in interest so i’m angry that i only settled £200 with them at the time!

Can anyone help? I have had an email in relation to a gesture of goodwill – way too low it was for £2720 and I paid in interest a staggering £9055.45 yes I was stupid but I was in a spiral I couldn’t see a way out I also borrowed from other lenders at that time. This equates to about 28% of interest paid. The loans commenced in 2011 however they have sent me an agreement in relation to the loan only for 2015 not the others. Now I have this offer for full and final settlement – I don’t want to lose this “gesture of goodwill” but what are peoples experiences on this please? Some help much appreciated.

Louise, they doubled my offer once I declined an initial offer and sent my complaint to OAFS. They are very difficult after an initial stage, it is a very long process. I already had a mediation session, sorry, can’t give any details as it is confidential and at the moment waiting for another Skype session, this time with the arbitrator. I sent an initial complaint in October, the arbitration scheduled for end of April.

Finally received a response from Northway / PDUK (12 months after they first acknowledged my complaint!). They have said:
“We disagree with your claims regarding the affordability of your loans as there was no such requirement at the time your loans were taken.”
Are they trying to claim they had no responsibility to check loans were afordable? Any advice on next steps would be appreciated.

I have another dilemma – in relation to Payday UK – I have sent to FOS they requested bank statements from 2011 I don’t have them. Will FOS request them also or will they make a decision based on other evidence.

I would wait for the FOS – Payday UK and Express rejected my complaint and when i sent it to FOS they asked for the bank statements and upheld the complaint and i got refund on all interest paid + 8% so it was a good one in the end it did take a while thought almost a year

Yes I am awaiting FOS – Just didn’t want to wait that long but they have not mentioned the roll over / deferred loans constantly and I had other loans at the same time – I paid them 7k in interest I was so stupid Craig but I have learnt my mistakes. I got no reply’s from any emails so I emailed the arbiter for advice they emailed Norway who came back with an offer of £966 with a write off of £534 however I have paid just under £8000 in intrest I’ve only asked for £2200 n they just seem to be ignoring me some I’m going to put a formal complaint in for full intrest refunded n take it all the way.

Thanks to Sara and all for the very helpful advice. I’ve successfully got compensation from wonga, but Northway have flatly refused to admit irresponsible lending or offer a goodwill gesture. They even cited in the letter that they didn’t have to assess affordability at the time loans were taken! Glad to see people have had joy from Northway though. We’re any of your loans from 2007 to 2009? Maybe that’s why my claims been refused. Nevertheless I’m going to email arbiter now with original complaint and cc in Northway

Hi Dominic – my loans with pounds to payday were between 2007-09. My complaint with Northway is almost 4 weeks. They have yet to reply. I offered a goodwill gesture also emailed OAFS cc’ing Northway but still nothing yet. I take it your loans were during the same period as mine ? I had 20 loans one month after the other almost £3k interest. Final Loan went to debt collector as couldn’t afford.

There is no consistency in northways responses. Some are getting offers others goodwill offers others rejections. They have till the 27th with mine then I’m submitting a complaint with the OAFS as they advised to give Northway 30 days to respond. Let me know if u get any joy.

You can send the supporting documents, e.g. bank statements by email but the complaint form needs to be sent by post. They will send you all correspondence by email and recorded mail as well. For each step if you’ll need them, e.g. moderation, arbitrator meeting you will need to sign forms, too. But they can be sent by email.

I got exactly the same response from Northway as you Craig, word for word. Then asked for advice from OAFS and Cc’d in Northway. OAFS requested that I contact Northway again giving terms that I’d accept before filling complaint form. Within 24hrs I get exact same refusal response from Northway.
So it’s complaint form time with OAFS and quickly as I noticed on OAFS faq’s that they sent me via email that they can only consider complaints related loans taken out before April 2016, if the paperwork is received by the 18th of April. Maybe Northway know this and hope people miss deadline

Mediation session is not the end, OAFS is not really involved at that stage, it’s a discussion between you and people from Northway including a person who seem to be their lawyer. Only if you don’t reach the mutual agreement your case goes to arbitrator and only then the payment will be used before that stage your payment will be returned if you reach the agreement. Mediation session is more or less the same thoughts’ exchange you have now in writing but face to face with the OAFS representative sitting in the room and taking notes but not interfering in the discussion.

I have gave Northway one more chance by email my bank statements to them showing how much debt and other payday lenders i had at the time of their loans and offering a goodwill gesture to settle this complaint without going to the OAFS. OAFS is very slow and it takes a lot of effort to make things moving, I sent them reminders every two weeks. It took them many months to arrange a mediation session and another few to move to the next stage. Prior to a mediation session if one happens Northway will check your bank statements very thoroughly, they note all ‘unusual’ transactions and question them.

I sent my form to the OAFS on the 30th March they confirmed earlier in the week they had received it and would assign it to a handler once they had received the remaining documentation. I had a time of it trying to get bank statements from my old bank (santander) as the statements were more than 6 years old. I eventually got most of them (2 months missing) so hopefully OAFS will still accept this. So i am just waiting on a handler being assigned to review the complaint but i believe this can take some time so will see what happens.

This is probably not the right forum for this query but has anyone had success in reclaiming unfair bank charges on the basis of financial hardship? when i was going through my old bank statements from 2007-09 as part of the Northway complaint i noticed loads of exceeding overdraft and returned fee charges from my bank at the time. these were mainly because i had so many payday loans at the time my financial status was so precarious. i have complained to santander about these bank charges recently and the response i got was:
I am unable to offer to refund charges previously applied to the account. In accordance to the Supreme Court decision on 25th November 2009, it was confirmed banks’ unarranged overdraft fees could not be assessed for fairness. Therefore, there is no legal basis on which the amount of the fees can be challenged.
So i am wondering whether the FOS will look at this complaint on the grounds of financial hardship?

I have made several complaints to payday loan lenders and recieved some good refunds thus far. I am still awaiting 6 “final response letters” and 2 sit with the FOS.
The lender I need advise around is Pounds till payday. I took 30 loans bewteen 2007 & 2010 paying back £7000 in interest, in their final response they dismissed my claim stating they had lend responsibly (even though for a period of 18 months I re loaned each month.) Their offer was to clear my outstanding balance on my last loan of £1000 – I refused this as it statute barred anyway.
I have made contact with the OAFS in Malta to progress this to the Arbiter but I am slightly concerned at the disclaimer at the bottom of the email. It stated if my case was resolved through mediation, I would be refunded the 25 Euros you need to pay for your case to be looked into, HOWEVER if my case is not upheld I would possibly be liable for the cost incurred by the Arbiter and Northway Financials possible legal expenses! Has anyone recieved a payout after going to the OAFS – and is it too much of a risk to progress? I feel I should be refunded some of the interest, but dont want to be lumbered with having to pay costs to Northway which would be the ultimate slap in the face!!!!

As far as I understand it’s not at OAFS level except €25 which will be retained if the decision not in your favour. The legal expenses might be incurred if NW appeals the OAFS decision in court when the decision is in your favour and wins the case. I might be wrong as there is no arbitrator’s decisions on NW cases posted on their site. Other cases’ decisions mention legal fees payable by the businesses and/or claimants but no numbers specified.

They wouldn’t budge with me Craig at first TBH it was the first offer and that was it. Then I got more correspondence and increases. I CC them in to all the emails I sent to OAF’s and explained my reasons – I still don’t know how they got to the figures as it was not clear.
Yes If I had gone to OAF’s I would of probably have got double but I got just over 50% so I made the decision to settle. Also as I have others ongoing and FOS dealing with not only Payday UK (a big one) but also MMF which took over some of Northway accounts in 2015 so I can now go back to FOS and I have a better chance of that being upheld as it was part of the other loans.
I did send an email with my bank account details they requested for payment and was in my account within 2 hours the same day.
I think this happened to settle quickly TBH.

Tax deducted on additional simply interest of 8% and not on the interest you’ve paid to the lender and refunded. And in many cases this tax can be reclaimed from HMRC.

I asked what the costs could be to the OAFS administrator but they were non committal stating it varies depending on each individual case.

I received the initial email that day telling me they would look into it and contact me within the 8 weeks but since then have heard nothing. You just need to keep bugging Northway send your email with high importance cc the arbiter and they will eventually reply.
Some people get very quick responses and payout others dont!

Hello All, I had over 21 loans with Pounds till payday from 2011- 2014. i email northway 2.5 weeks ago and received the’ we did not lend irresponsibly standard responds. I was constantly re applying for loan after loan with multiple payday lenders. I have had refunds from payday uk and wageday advance, I included this in my email to northway. They have replied with a good will gesture of £324.00. How would you recommend that i turn this offer down and who should i cc in? all a bit confusing x

I would take your complaint to the OAFS arbiter in Malta.

Otherwise I would have gone to OAF’s I completed all the paperwork ready. I settled for 52% of my borrowing roughly. The original offer was 22%

I said it wasn’t reasonable and outlined my reasons why as I had my statement of interest – I CC in the arbitrator and then they came back then it went back again then I settled – money was in my account within 6 hours of acceptance! I’ve done it. I achknowledged their ‘good will gesture’ but stated I wouldn’t accept and listed the reasons. How can they stated they did ‘creditworthiness checks’ when both my bank statements showed multiple payday lenders & my credit score was not great. I do feel they lent irresponsibly but doubt they will admit to it. Will wait and see, will keep you updated :)

Just a update. Northeast got back to me today. With the standard ‘we take no responsibility & are not to blame ect ect’ responds, but have increased there good will gesture (slightly) they are staying in bold letters that this is there FINAL response & they have given me the email address for the arbitrator if I do not agree with their response. I took the offer when I thought they wouldn’t increase any more and I wanted it settled TBH. They were the quickest to settle for me tbh Tracy. As soon as you agree and email them its in your account – via Arbitrator it is a long wait. I could have got more if I had waited and quite a few thousand more however, I got a substancial amount based on my borrowing. If that helps? Louise.

It sure if it’s their final ‘final’ offer, as they said the last offer was their final offer but then wrote final in bold this time. & they have given me the arbitrators email address if I don’t agree so I’m just not sure?? I do feel they did lean irresponsibly to me, I think I’ll provide my bank statement and suggest a suitable settlement amount? What do you think? I think they are just picking out amounts to try to settle. What do you think?

Hi Tracy – you can try but I did that and they didn’t budge I tried to get an additional £900 and they did that to me and put it in bold and I accepted I paid over £9k in interest and settled for just about 52% I wanted over 5k. They were irresponsible with me also and I think that is when they offer something. My advice is if it leans to 50% of interest paid if you want the money in your account by the weekend settle if you are not desperate and want to pursue it you will have to go to the Arbitrator and then they may offer slightly more however, it will be a wait. Yes – they could not advise where they got the figure from to me either – It was random lol.
usually they only do two offers and then you have to go to the arbitrator and then they may give you slightly more but you have a 25 euro fee for the arbirtrator also to lay out.

Hello all,
Just found this thread. I sent an email complaint to them on the 28th February.
They sent me details of Loans and interest paid etc.
They informed me they would write to me within 8 weeks.
I have not heard a thing back from them, been sending emails for update with high importance and even cc’d the Maltese authority’s as per previous comments. Tomorrow is week 8 any suggestions.

I am afraid Northway are very random in their responses and offers (if any) they make.
The OAFS actually advise that if you have had no response after 4 weeks then you can submit the complaint to them but you will need to pay 25 euros to submit the complaint.
I have already submitted my complaint to the OAFS. I had 20 loans from pounds till payday between 2007-09. They said they done no wrong and at that time didnt need to make any checks – nice eh?
I have cc’d the OAFS in my replies to Northway but they have ignored every one so I am waiting on the OAFS assigning my complaint.
For info my complaint started with Northway on the 28th Feb – i believe it’s quite a long process going through the OAFS.

I borrowed from S/Sterling every month for 2 1/2 years many of them large amounts but northway replied after about 4 months that they were only offering a goodwill gesture..Last week i sent a mail requesting my loans and i could not beleive they responded in a day..I sent everything to Oafs and just got a reply saying the process will begin..Heres Hoping

Update on my complaint to Northway.
The OAFS have sent me a copy of Northways response advising that my complaint is prescribed (time barred) as Article xxxx provides that a prescriptive period of 5 years applies in relation for any payment of debt arising from commercial transactions.
They go onto say that as it has been past 5 years since the last transaction between both parties undertaken the claim is time barred!
In another letter from the OAFS they are inviting me to a mediation session to try and resolve!
Has anyone else had similar responses?

I haven’t been offered mediation- I’ve gone through a claims company and I’ve been informed that I am awaiting a ‘governing decision’. Will contact them tomorrow to find out exactly what stage the claim is at but does anyone here know what ‘governing decision’ means?

I remember a few years ago I did try and recover interest and fees etc but as they were based abroad I gave up.

Finally a 2nd reply from Northway who are still not accepting responsibility but are offering £1500 goodwill gesture.This offer comes after contact with the OAFS .I calculate that the the interest I paid was £2500.Also it say s that they are time barred. What actually does this mean ?..The loans I had with them where from FEB 2012 to AUG 2014.
£1500 seems a genourous gesture if they believe they did no wrong doing.

Hi Mark, my loans were between 2007-09 they said in their final response that at that time they didn’t need to make affordability checks and made no goodwill gesture at all. I had over 20 loans with about the same interest as yourself.
I submitted complaint to the OAFS who then attached Northway response saying it was time barred also which i think means its been a period of time since the last financial transaction was made between myself and the creditor thus they are within their rights to not look at the complaint??
In the same email response from the OAFS i had a letter to sign accepting that this goes for mediation so i am now awaiting on a mediation officer contacting me!
I suppose it’s down to you whether you feel that the goodwill offer of £1500 in acceptable or do you pursue this further with the OAFS to get the full interest back!

I shall pursue further.. Just noticed the email mentionining time barred looks to have been misdirected ,it dosent apply to me.Upon reading northways reply it seems such a clear case of irresponsible lending yet they admit no wrongdoing.For the first loan they said they checked my credit report ,it would have been very poor at that time and then that the following loans for the next 2 1/2 years where given to me judged on my loan history and imformation i provided (no bank statements.payslips).Also after about a year and half of lending i requested a pay plan of which they did not arrange and then still took the full amount from my account.they admitted this also..It gets worse.Then the following month they loaned to me again for another year.

Just to update anyone who is complaining to Northway.
The OAFS have advised that Northway have not accepted the willingness to refer the case to mediation as my complaint is time barred.
My loans were between 2007-09 and Northway say it’s been more than 5 years since the last financial transaction was made.
The complaint will now be sent to the Arbiter for his review and deliberations

I thought that the same that rather than wasting time they should have stated it was time barred we cut out the mediation and went straight to the Arbiter.
From the OAFS site it looks like we have the opportunity to make written submissions regarding the complaint.
If you was the same as me i was reloaning every month along with other payday lenders so there was no way i could get out of it till it got out of control and i had to come to an arrangement with them all.
As soon as i paid each loan i was reloaning straight away.
Horrible thinking about it all and i just hope the arbiter finds in our favours!

I received a reply from SS yesterday (Northway)
In their reply is this:
“Our records show that the aforementioned loans were paid in full on the scheduled repayment date of 25 July 2013. However, you then requested chargebacks from your bank for both of the amounts and were therefore reimbursed both the principal and interest on these final two (2) loans amounting to £682.40. This balance remains outstanding to date”
Ok so a few things. This is the first I have heard about this. Bearing in mind it was 2013 I find this a bit odd.
I have checked my bank statements and it does look like this has happened, but I have no recollection whatsoever of this happening.
Swift sterling have never contacted me about this and I had absolutely no idea I owed them money.
They are offering to wipe this out as an offer to my refund request.
I have a feeling that my mother in law paid this debt off for me using her debit card but I will need to double check this.
So questions really are…
How on earth have I not heard about this debt beforehand. Should I just accept their offer and call it quits. I am now frightened I’ve opened a can of worms I knew nothing about and I’m going to end up owing a lot of money :(
Any help appreciated I am really anxious about this.

Within a couple of days of OAFS starting the mediation process, Northway got back to them saying they wouldn’t engage in mediation, so my case has gone onto the Arbiter now. No idea of timescale for this.

I have had a goodwill offer from SS for £626 – the interest I have paid is £1400 – I have replied to say yes, I am not sure its worth fighting for this one since they aren’t in the UK, and fortunately or not depending on how you look at it, I have numerous other payday loans to receive offers from/refer to FOS.

I’ve just received bank statements after 5months of persuading my bank and these detail 8 loans, averaging £600 each that I took out in 2009-10 with Pounds Till Payday. I wasn’t aware of these when I submitted my complaints to the other 4 payday lenders and the FOS. I need to read through all the info on here before attempting a complaint but would welcome any help from people in similar situations. I’m glad to have made this discovery as it certainly strengthens my other complaints in terms of irresponsible lending, even if it doesn’t come to anything itself in terms of a refund. Thanks.

Hi Kara – my loans were between 07-09 with pounds till payday was borrowing £500 every month along with other PDL. Northway have refused to look at the complaint as they say it’s time barred as no financial transaction has been made in 5 years. I have an arbiter hearing on the 18th June with the OAFS in Malta and Northway but I’m not sure what else can be done if they are saying it’s time barred. I hope this has not been a huge waste of time as this has been ongoing since February.

I wrote to the Maltese financial authorities regarding Swift Sterling. I got a reply from Northway financial saying they had repaid my money after I went into a DMP. However after viewing my bank statements over the 6 month period they were £881 short. They also said there was an outstanding balance of over £1000 and they would write it of if I was in agreement. I contacted them to say I agreed with them doing that but I’ve not heard anything back. I wanted to make sure it would be written off before contacting my DM company…I’ve emailed every week since March… what do I do now?

As DAS is a statutory scheme, you need to contact your Continuing Money Adviser, in this case MLM and ask that they do a variation and remove the lender from your DAS.
They may try and charge you for doing a variation (I am not sure of MLM’s charging policy). If they do try and charge you, you can go to a free sector money adviser, who will do it for you.
You can also discontinue MLM as your Continuing Money Adviser, although it depends how they charge your fees.
I will soon be joining a Scottish Government Working Group to draft new regulations for the DAS, so I would be keen to hear how you get on.
What area of Scotland do you live in, as I can possibly direct you to a free money adviser if you have any problems.
