Guarantor loans are very expensive. Often the lender didn’t check properly that you will be able to manage the loan repayments without having to borrow more.
If proper checks would have shown that you couldn’t afford the repayments, complain! There is a template letter in this article to help you.
You can get an existing loan reduced so you only repay the amount you borrowed, or get a refund if your loans have been repaid. If your complaint is rejected you can send the case to the Financial Ombudsman (FOS) who is upholding a lot (90%!) of guarantor loan complaints.

What is an affordability complaint?
A loan is not affordable if paying it left you so short of money you had to top up the loan, or borrow more from another lender or get behind with bills.
Does this sound like you? Then make an affordability complaint.
Just making the payments doesn’t prove the loan was affordable! You may have been repaying with difficulty, taking out other loans, because you didn’t want your guarantor to be affected.
You can complain if you are still paying the loan or if you have repaid it all.
If you win your complaint:
- interest is removed from a loan you still owe, so you only repay what you borrowed;
- your guarantor is released from the loan; and
- you can arrange to pay the remaining balance at a reduced rate.
When your loans have been settled, you get a refund of the interest you paid.
What should the lender have checked?
Guarantor lenders should have checked the loan was affordable for you before giving you the money.
The lender should have made sure you were likely to be able to make the repayments for the whole length of the loan.
Guarantor loans are large financial commitments. So I would expect a lender to have asked for evidence of your income, to have checked your credit record, and to have verified your expenses.
Some things a lender may have got wrong:
- It doesn’t matter if your guarantor is well off, the loan has to be affordable for you!
- You may have given said your expenditure was lower than it was, because you were guessing or desperate. The lender should have checked your figures.
- If you were self-employed or had wages that varied, the lender should have looked at how your income went up and down.
- The lender should have checked your credit record to see all your debts. If you had recently taken more loans or missed payments/defaulted, the lender should have been careful as your position was getting worse.
- When you top up a loan, the lender should check the new larger loan is affordable. If the current loan was causing you problems or your finances had got worse you shouldn’t have been given a larger loan.
If you feel there was something else unfair about your case, add that into your complaint as well!
What would a “fair solution” be?
If the lender or the Ombudsman decides the loan wasn’t affordable, this is what happens:
- The loan has been repaid, then any interest you paid should be refunded to you.
- The loan is still outstanding, then interest should be removed from the balance that is owing, so you only repay what you borrowed. Your guarantor should be released from the loan. The lender should accept an affordable monthly payment from you to repay the rest.
- Any payments made by the guarantor are refunded to the guarantor, not to you.
Will a complaint affect your guarantor?
Complaining won’t affect your guarantor if you carry on making the payments. The guarantor shouldn’t be told you have complained unless your complaint is being upheld.
If you stop paying the loan when you make a complaint, the lender may decide to get your guarantor to pay it. If you don’t want this to happen, you have to somehow carry on making the payments even though it’s hard.
If you can’t afford to carry on paying and you don’t want to hurt your guarantor talk to a debt adviser about your options in this difficult situation.
Making an affordability complaint won’t make things worse, and it may help in a few months time, but it isn’t an immediate escape from your problem.
Think about whether your guarantor also had a good reason to complain – see Complaining if you are a guarantor for details. If they win a complaint, they will be removed as a guarantor, which would take a lot of pressure off you.
How to complain to the lender
A template complaint to use
Don’t use this for Amigo of Buddy – see the update at the top of the page.
For all other guarantor lenders, including ones that have stopped lending, send your complaint by email – here is a list of lender’s email addresses.
Use SAR AND COMPLAINT BY BORROWER as the email title.
Here is a template. Change it to describe what happened to you and delete what doesn’t apply.
Only put this in if it applies to you: I took a top up of [£2,500] in [March 2018]
Add a reference number for the loan or give some other details such as your date of birth and your address when you took the loan out.
Please send me a copy of all the personal information that you have about me, including but not limited to all credit record checks, a copy of my loan application(s) and recordings of all phone calls from me. You have 30 days to reply to this Subject Access Request (SAR).
I am making an affordability complaint. This loan was/These loans were unaffordable for me and you would have realised this if you had checked properly before giving me the loan(s).
Delete or change any of the following so they are right for you:
[You would have seen from my credit record that I had recently missed payments/had defaults/was in a DMP/IVA.]
[I was on a low income/My only income was my pension/benefits.]
[You did not ask me for proof of my income or expenses and you did not ask about my expenses in detail.]
[I get ESA/PIP/DLA but you did not ask me if I had any extra expenses because of this.]
[I had a gambling problem which you could have seen from my bank statements.]
If you topped up the original loan: When I topped up the loan you should have seen from my credit record that my financial situation had got worse. [delete if not relevant: You ignored the fact that I had made several payments late to you.]
If you still owe money:[I am asking you to remove the interest from the balance so I only have to repay what I borrowed, release my guarantor and allow me to make lower monthly payments.]
If the loan has been repaid change that to [refund me the interest that I have paid plus 8% statutory interest.]
If you don’t want your guarantor to be told: [I want to carry on making the normal monthly payments because I do not want my guarantor to be affected. Please note I do not want my guarantor to be informed about my complaint unless my complaint is upheld.]
You have 8 weeks to respond to my complaint before I send it to the Financial Ombudsman.
If you would like some help with this, then go to your local Citizens Advice.
Definitely send bank statements!
It’s good if you can attach bank statements to your complaint. Send three months of statements before each loan or top-up and two months afterwards. So if you had a loan in August 2017, send statements for May-September 2017.
These statements will show how unaffordable your loans were. Don’t worry if there is gambling showing on the statements – that helps your case!
Don’t delay starting a complaint if you are trying to get your bank statements – just add them later. But now is a good time to get the statements as they can help your case.
Also get a copy of your credit record if this will show defaults, that your debts were increasing, that you had a large overdraft etc. Download this and keep it.
What to do with your personal information (SAR)
Copies of personal information (SARs) are often sent out by post, so if you have moved, make sure the lender has your new address. You should get the information within 30 days. It is often sent on a CD with a password.
This information is not the lender’s response to your complaint. Most lenders will send that separate from the SAR, usually a few weeks later.
You don’t need to do anything with the SAR, just keep it safe. You have asked for it now so that you have the details in case the lender rejects your complaint or makes a poor offer so your complaint has to go to the Ombudsman.
Taking a complaint to the Ombudsman
If the lender rejects your complaint, go to the Ombudsman
Don’t delay in sending a case to FOS – it has to go within 6 months. And while you have an “open” complaint at FOS, the lender cannot take you to court.
Lenders seem to reject many complaints and hope you give up! So don’t be surprised if a lender says No, the loan was affordable or We based our decision to lend on your application which was inaccurate.
If the lender says No, or you haven’t had a reply 8 weeks after sending your complaint, send your case to the Financial Ombudsman (FOS) the best way to do this is by using the FOS online form.
This is free to do and easy – you don’t have to quote laws or regulations. You can just send FOS the complaint you sent the lender. And if they have replied and said something that’s wrong, mention that as well.
You don’t need to go into details – a short FOS complaint is fine. If you want to add more details, read How Subject Access Request information can help an affordability complaint. But you don’t have to do this.
If only some loans are refunded, is this fair?
Sometimes a lender will say that just a few loans are unaffordable and remove the interest. Which is good, but should it be better?
If the rejected loans caused you difficulties and led to you needing a top-up, send your complaint to FOS and say you think the earlier loans too should be refunded.
Are you likely to win your Ombudsman complaint?
The Financial Ombudsman is agreeing with the customer on 90% of cases!
It is much simpler to win a case at FOS than a court case. If a lender has already started a court case against you, Citizens Advice can help you get the court case “stayed” (that’s legal jargon for put on hold) while you take an affordability complaint to the Ombudsman.
Complicated cases & help with guarantor loan complaints
If you want help with these complaints, Citizens Advice can help. Every Citizens Advice has access to the national Specialist Debt Advice Service if this isn’t something an adviser has come across before.
Leave a comment below this article to discuss what to do or talk to Citizens Advice if:
- your guarantor has made a lot of payments.
- you have been bankrupt, in an IVA or a DRO – read guarantor loans & insolvency .
- you have a CCJ from the guarantor lender – read guarantor loans & CCJs.
- if your debt has been sold to a debt collector.
Do not use a Claims Firm or a solicitor that is acting as a claims firm. There are two good reasons why you should avoid them:
- they will probably do a very poor job. They are not experts. They won’t put time into looking at your personal case.
- if you win a case but still owe a balance, this is usually just reduced. But the claims firm may expect you to pay their high percentage fee immediately even though you have not received any cash refund and still have the rest of the loan to pay.

HiAmigo are very frustrating, we originally put a claim in to amigo in October 19, got a big no in December 19 and sent straight to the fo, the fo now are waiting on amigo to send the info over. What I don’t understand is how the fo has settled claims about amigo that have been sent way after ours? It’s now over 6 months since the fo has had it and nothing?
Is there anything we can do?
We are both chasing the fo and amigo weekly?
Also finally had a yes from the fo over provident, that’s taken over 18months and now 8 weeks after the fo said yes they are still waiting on provident.
Just seems that people who have complained this year to amigo are all getting sorted and older ones are just sat there?
Although I’m happy others have won.

I understand your frustration. Although you may not find these points very satisfactory, here are my thoughts:
What I don’t understand is how the fo has settled claims about amigo that have been sent way after ours?
FOS does prioritise some cases because of certain things in the case eg domestic abuse, customer vulnerablity. And cases involving loans over 6 years need an extra step which slows them down.
Is there anything we can do?
Not at the moment. Amigo has told the FCA it will sort out the backlog – which should include your case – by the end of the month.
As a result, FOS wont look at your case now as there is simply no point, it would just be wasting FOS’s time.
And you cant get Amigo to speed up your case, they are trying to get through thousands, all of whom want theirs sorted asap.
Just seems that people who have complained this year to amigo are all getting sorted and older ones are just sat there?
No. Older cases are being sorted. There have been a huge number of new claims since December so if you look at the numbers they tend to dominate but that doesn’t mean older cases are being ignored.
Othe people have have worried about other types of cases being ignored: large refund cases. 1 loan cases. cases where the loans have been repaid. cases where the loans are over 6 years. etc etc So far as I can see ALL sorts of cases are being sorted and none are being prioritised.

I have had a email back from Amigo after I sent proof yesterday on a bank statement from 2013 that I had a loan with them.
They have replied today to say they can find no record of it as it may of been deleted due to time lapsed.

So my guarantor has accepted the refund. On Friday after receiving email on thursday.
I received an email on Thursday also stating I will receive my redress fingers within 5 working days.
But I then sent an email
Asking for a rough time frame for my redress calculation to arrive.
The reply I got was
“Hi
Thank you for your email. Once the guarantors refund has been processed, we will issue you with the redress calculation from our transactions department, that takes into account any payments made to your guarantor and the impact on the balance. As soon as we have this information we will send you the details.”
Then I asked again how long will it take as the email I received says I should receive within 5 working days

Mate, exactly the same as you. Guarantor accepted on 9th June and he hasn’t had anything yet and nor have I. Not even had the redress figures.
I’ve sent loads of emails and phoned them but keep getting different answers. Can’t believe that it takes so long as they must’ve worked out the figures when assessing the compliant to begin with!? It’s ridiculous – they’re pretty quick to take the money and pretty quick to hassle you if you don’t pay on time!
I think they’ve muted my emails or something now. Tried everything from angry to basically pleading with them. When I first had the offer I was told 5 days for me and guarantor to be paid and whilst the money is a bonus, I had planned on using it based on the time they told me.

Well it’s a bit weird they say I’ll receive my redress letter in 5 days but say it wont come till the guarantor processed.
I’ve lost my job due to this rubbish were going through. So to be honest getting a refund would help me out right now. Stressed to the hills worrying about bills. And this is just topping it off now.

Hi, I took out an Amigo loan in July 2014 and paid £125 for 28 months. It was a £4000 loan. I then topped up £2806 in November 2016 and paid 19 months at £195, taking my loan amount back up to £4000. I have a complaint pending, awaiting their reply. I paid the loan off in full for an amount of £2700 in April 2018. Would the fact I paid it off ( took extra money on my mortgage to consolidate), go against me? If my claim was successful, how much do you reckon I would get. Won’t ever be so stupid again!!

Amigo is a bad credit lender. It doesn’t matter directly how bad your credit score was, but what your situation at the point of application was. Of course in practice a bad credit score and payday loans usually means you were in big trouble and Amigo would have seen that if they looked in detail.

Hello,
I took out £10,000 for loan 1 in 2017 with Amigo.
I then took out a second loan for £10,000 in 2019 £9,499.20 was used to pay off loan 1.
They have agreed to remove the interest off both loans and refund.
Loan 1: £10,000 borrowed and paid off in October 2019. £9,059.20 interest owed
Loan 2: £10,000 borrowed and still outstanding. £2,385.53 interest owed
They are claiming that they will refund £1,049.16.
By our calculations, as all the outstanding interest is being refunded (£11,444.73) and we have paid off Loan 1, we therefore only owe £10,000 for Loan 2. Which should mean a refund of £1,444.73.
However, as Loan 1 has been paid off, are we entitled to have the interest from Loan 1 fully refunded? As we still have £35k in debts which still has interest attached, including council tax and gas and electric and as Loan 2 is now interest free, we’d like to have a repayment plan and pay off the higher priority debts and higher interest debts.
I hope this makes sense and thank you for your help.

We are in private renting and owe money on: council tax, gas and electric and a Hire Purchase as well as other low priority debts so £32k of total debt not including Amigo.

Hi Sara,
We’ve lodged a complaint with the Ombudsman but we’re not sure if it will be upheld to refund the interest from loan 1 and go into a repayment plan for loan 2 so we can pay off priority debt.
As they’ve agreed to refund all interest paid minus what we still owe for loan 2 (£10,000). So we’d only get £1.444.73 paid out. Is it worth waiting to see if they’d refund loan 1 interest in full £9,059.20 and go into a monthly repayment with loan 2? or do we just accept paying off both loans and accept the £1,444,73?
It’s a win win for us either way, but with other debt still accruing interest, it is in our best interest to have it all refunded to pay off the higher rate debts first.

But I think you (and your partner? you have said “we”) should talk to a debt adviser about your debt situation. Now your guarantor has been released, this is the time to look at the best option for all your debts.

Hi I had a few loans with amigos and paid most of them off untill my guarantor paid a chunk of the remainder off to settle the loan beginning of the year. They have wrote to me and said my guarantor can claim for the money paid. How does it work out with what I paid and who gets the money? Thankyou

Amigo knows what you paid and what it asked your guarantor to pay.
I think that in general Amigo will refund your guarantor first, then remove the guarantor’s payments from the account and assess your refund (or balance owed) based on that.
Are you on good terms with your guarantor? Because if you are, then between the two of you you will get more money back if your guarantor takes the refund and then helps you out with some/all of that money than if your guarantor refuses the refund.
If you are planning to refund your guarantor from your refund, letting Amigo refund your guarantor is probably best.
If you have already repaid your guarantor and you are not on good terms and they may claim the money from Amigo this is a very difficult situation and you will probably need to go to the Ombudsman and may not win there.

FOS recently contacted me (about 2 weeks ago) asking for more info. Yesterday I received an email from FOS informing me that they have now all needed info and they will get back to me once they finish the investigation. My loan was paid off almost 2 years ago.

So received my final response on Friday! They upheld through fos last Monday. Amigo upheld 3-9 loans gave no reason to why they didn’t uphold first 2 not flm quick loans they didn’t include my loans in the final response nor figures. So I emailed back and today they have sent me the list of loans no calculations so i have no idea (well a little) at to what I’ve accepted!!! I’m astonished as to how they can keep getting away with what their doing ?

Accepted redress last Monday 16/06/20. Was told the monies will be paid “within 10 days” statement.
Only 5 working days have passed – no money paid.

I am aware that they state 14 working days for guarantor to approve and I will get my calc 5 days later.
However I want to know how it’s worked for those who have had refunds.

Disappointing news today that Amigo now say they won’t be able to clear the complaints backlog by Friday (there’s a surprise) like they said they would in May, so who knows when myself and many others who have been waiting 5 months plus now will get a reply. I guess it depends what sort of extension they can agree with the regulators.

Where did you see this I am gutted 16 weeks so far others waiting a lot longer and they have given decisions on complaints for complaints raised less than 8 weeks ago. This is not good for anyone and the lack of customer contact is deeply disheartening. Did it give a deadline at least?

I’ve just read the reports and they are blaming a surge in the number of complaints received since entering that arrangement with FCA…I thought the arrangement was to clear the backlog not the complaints which have been received since. Surely this is the lack of organisation around how they have been responding to complaints which has caused yet further delay. I’m genuinely really pleased for all those who have received responses but this is just another kick in the teeth for those of us who have been waiting 20+ weeks already, especially when some people have received responses in under 10 weeks. It really does feel like some of us have been forgotten about and won’t get a response at all. Also as FOS have not been picking up complaints about amigo while this arrangement has been in place, does it mean that any chance of having a complaint looked at by FOS is going to be further delayed if an extension is approved?

Hi there , ive been woth amigo from probably about 5 years on and of settled some and then taken out new loans had multipule top ups with them i pay so much money to them im half way through a 4 year loan term now and ive about paid of the intrest i think only recently have seen my balance dropping down , ive never really thouught about the fact i might have been misold but after reading these maybe i was i went thought a stage of topping my loan up everytime it let me , they only questioned my guarantors loan i was nevef asked to prove my earnings .

I’ve just received full interest refund on 3 loans! I’ve continued to pay throughout! Still upheld! I still owed £5000 on latest loan and it’s now gone plus cash refund! So yes I’d say so! My circumstances were other debts, lie income and they didn’t check before payout so do it! It’s a long drawn out process! But mine was pretty good at 15 wks hope that helps! They wanted bank statements for a month before and after each loan and any other info you can give! Be honest with everything! I used Sara’s templates and did it myself so no company to rely a cut! I phoned this morning and a lovely lady said they would speak to the finance team and call me back before the end of the day. 4.37 she did ring back and said my refund had been sent and can take hours but it will be with me shortly as sent by faster payment. They are not sure what has caused the refund not to be in yet but hopefully it will hit my account soon and i will keep you all updated. Thanks :)

Just had an email from Amigo Complaints to say that they are still investigating my complaint but cannot give me a timeframe for when I can expect a final response. This is really frustrating, as it implies I won’t be getting a decision by 26th, a date that they’ve previously committed to 3 times! I’m 17 weeks in and have had absolutely no updates on my complaint. I hope FOS start progressing these again soon because some of us are being fobbed off by Amigo. Here’s hoping for a miracle later this week…

I have been struggling with Amigo debt for five years and had to re top up to keep a float and then apply for other loans on months I am short,I was I debt before and had a CCJ they didn’t investigate the affordability when applying for the loans and I’m worried I won’t be successful In my complaint. but my disabilities are getting worse and it goes in hand In hand as I’m stressed I get sick and need to be off then money doesn’t come in. I have never missed a payment I was offered no support during covid when I didn’t know if I was going to get furlough or full pay. They told me not to pay and it won’t go over the original loan amount And I wasn’t willing to get my guarantor In trouble. I have paid nearly £15,000 over five years for the loans. So I have paid the £10,000 I have been loaned but I just am so low and worried how I am going to cope in future I have sent the email yesterday using the outline on this amazing forum, I’m hoping even if the interest is stopped and I pay anything outstanding, I hope you all get what you need or outcomes. It’s a very stressful/ distressing time.

Unless you want them to go after your guarantor, you have to keep paying.
EXCEPTION – if your finances have been hit by coronavirus you can ask for a 3 month payment break.

on those figures – and guessing that you have so far made 10 monthly payments to the current loan – I make it that you have paid the following interest:
loan 1 1758
loan 2 7719
loan 3 still 6050 to pay until you have repaid what you borrowed
So if all three loans are upheld as beung unaffordable, the interest from the first two would repay the redunced balance on the last loan and you would get a refund of £3427 plus about £100 in 8% interest.

Use the template on the first page of this thread, it tells you what you need to put and what to take out if it’s not relevant to your case, and send bank statements with it, which you may have to go in branch for since it being 8 years on. We have all been there. Good luck!

Reading the article it seems because complaints after they committed to completing the backlog have started to build that why they’ve requested the extension. I would really like to see the FCA take a stand with the order they have been dealing with the complaints and ensure the apply chronological order at least. Its seems there are more people now waiting on refunds than there is on a decision. For such a big company everything seems so disorganized

I have just spoke with a guy from customer services, he said they have applied for an extension but may not get one, he said my complaint is still being looked at and that some cases are easier than others and said they do a small amount of work on each complaint at a time and they don’t just have one complaint to work on at a time. The guy was very pleasant but I still don’t think it really helps us with timescales he told me to ring back up on 27th if I haven’t had a final response by then and if I haven’t they can hopefully give me some more information. My complaints been in since Feb :(

Do they take the total amount of interest paid by both of us together, total it up, add 8 percent and then refund the guarantor from that OR do they just add up the interest on the payments I made and then refund the guarantor from that…?
Example with terrible made up numbers ignoring 8% interest…
loan taken £10,000. Interest £10,000. Total repaid £20,000. Guarantor paid £5000 towards it.
Is it £20,000(total paid) – £10,000 (capital) – £5000 (what guarantor paid) = £5000 refund to me.
Or…
£15,000 (what I actually paid, not my guarantor) – £10,000 (capital) – £5000 (what guarantor paid) = £0.00 refund to me!?
Big difference…

I have just spoken to Amigo, they have said the 10 working days to send the figures is from the date you receive the email. So for example; although I accepted with FOS on 9th, I didn’t receive an email from Amigo themselves until 15th. So they class 10 working days from then, so for me they have until close of business on 29th. Which seems ridiculous and different to what I have been told until now.
He then said, once you get the email you have to ring and provide them with bank details etc for a form. They then take 10-15 days to process that and for the money to be paid out.
So basically…. by the end of July I should have the money. Seems like a long time away when I really hoped for some closure this month.

Nothing but excuses now on waiting list for financial ombusman…that’s the short story!! Literally unbearable!!! I’ve given up ringing and emailing now. For months I was told itll be dealt with by the end of the month then this week I’m told I’ll have to wait for financial ombusman to make their dissision!!! I’m sorry this is all soooo stressful.
We now know (https://www.londonstockexchange.com/news-article/AMGO/update-on-complaints/14585525) that Amigo had 9000 complaints in before the start of May.
That’s a lot. And they have had a lot more since the start of May.
But they still have a lot of money in the bank, more than enough to settle these complaints. And the FCA and their auditors are presumably happy they don’t have solvency problems, or they couldn’t continue to trade.
So at the moment my best guess is that all these complaints will be settled, even if it takes a bit longer.

Here’s some snippets of the email they sent back:
“normally 8 weeks is more than adequate time for us to fully investigate and respond to a complaint, however, we are currently experiencing unprecedented complaint volumes”
“To reassure you, it’s nothing specific to your complaint that’s causing the delay, it’s simply down to the volume of complaints and obviously we work through these chronologically as this is the only fair way to do it. We still have a number of complaints which pre-date yours which are under investigation.”

I got my offer of redress yesterday!!! Been battling this since February 28th!! Total ammount I’ve paid is 20,110.68!! For 9750 loan. Can somebody tell me how much I’m due get back? Would it be 20110.68-9750= 10,360.58 + 8%? (11188)
Also there telling me theres a 20% basic rate tax deduction on the redress? Can they do that? Can I akso claim that back as I’ve already been taxed on that money before I paid it. So 11188-20%=8951?

Never missed any payments. Payments total since november 2016 £11,511 to February 2016.
Paid it off in a lump sum of £8600 February 2020. So tatal I’ve paid them is £20,110.

amount will be 8%percent per year so I think yours is a 3 years by the looks on what you paid so 32% is £13675 and they only take 20% off of the 8% interest part not the other funds so they wont tax your other amount only 8% and if the garentor paid any funds you wont get that and it be given to them of what ever they paid towards it

My guarantor made the final £8600 payment, they received a letter yesterday offering them £8600+8% interest (167-20%=134)

Does that mean I’d get 8% interest per annum on the 11500 I’ve paid in since November 2016, or just 8% interest per annum on the overpayment of £11500-£9750= £1750
If my guarantor chooses not to take the refund it gets paid towards my capital.
So therefor £11500+£8600=£20100
£20100-£9750=£10300
So then £10,300 would then be my over payment and I’d get 8% interest per annum on that instead?

So that is a total of about £9867
There will be very little 8% interest because of the way Amigo calculate this as it was settled recently. At a guess about £400, less 20% of the 400, not of the full refund.

You will get slightly more between the two of you if your guarantor takes what has been offered.

Hi mines is with the FOS, amigo never responded to investigator, so put in the que for the ombudsman, investigator maybe thinks amigo will respond before it gets to ombudsman, or are amigo just letting it go to the ombudsman as they said they are awaiting a final response, seeing mixed messages everywhere, just hope they do come back by the end of the month and answer the investigator.

I thinks its partly with me getting this far (awaiting offers) with both Payday UK & QuickQuid when both went into administration. Happy some people are getting paid but frustrating when these people have only submitted a complaint in Jan/Feb and mine & others submitted ours in Sept/Oct yet still dont have a redress figures.

Just read an article from yesterdays Financial Times about the surge of complaints.
In it they have said they won’t be realising their full year report until 23rd July instead of the end of June.
I reckon they will extend till mid July to deal will backlog. Any thoughts?

There are two different things going on here.
a) Amigo’s annual report. This is for the year to end March 2020. All the numbers for that financial year are known, but a report often says something about events after the end of the financial year and there will be a provision in the accounts for future complaint costs. The auditors will need to feel comfortable that those figures are accurate.
b) the “extension” refers to an agreement with the FCA to resolve a lot of complaints quickly.
There is no direct link between these. The FCA could allow them an extra week or an extra 6 months but they will still want their annual report out asap.

Hi mate amigo told me that it can take upto ten days to process refund for guarantor then once that’s done expect the redress figure within 5 days

So if they are all refined you would get a total refund of £5157 and 8% interest would be one years worth so about £400 less 20% tax on the 400 part.

Not posted on here regarding my claim. I sent a complaint to amigo on 24th Feb. Got an email today upholding my complaint (week 17). They said they “cannot be completely confident the loan was affordable”. Also they said they will send me a letter no later than 5 working days after July 7th with details of interest paid & refund offered. Don’t know if that applies to all? Any way – hope more people get good news this week and the money starts coming back. Sara – what an amazing website- you’ve helped so many people – will be making a donation to local CAB for sure. Can you help me with what I may be due please so I know what to expect when I get the offer please? I originally took out £2750 in Oct 2013 – paying £134 over 36 months but topped up to £5000 in July 2014- this was paid off in Oct 2017.
I currently now have £1250 loan with them paying £60 a month which started in May 2019.

I think I made 8 payments on Loan 1 until
I topped up – then loan 2 I don’t recall how much cash I received – I assume around £3500..
for that 2nd loan I made 38 payments of & £197 I think before paying it off in Oct 2017 For £3185..
I’ve since made 11 payments of £60 towards my £1250 loan which is down to be 36 months in total. Thank you so so much again Sara

Had a look back through –
Loan 1 taken on Oct 2013 for £2750
(£134.17 a month for 36months)
In July 2015 I paid this off & topped up to a £5000 loan in July 2014.
The amount I received was £2620.53.
(£197.62 for 60months)
Paid off in Oct 2017 for £3185
Then loan 3 was £1250 taken separately in May 2019 – £60.99 for 36 months – and I’ve currently paid 11 months.

Sorry I didn’t spot your reply.
On those figures (and you have said “I think” a couple of times so you don’t sound quite certain about them…) I make it you have paid the following interest:
loan 1 702
loan 2 5671
loan 3 still 480 to pay before you have repaid what you borrowed so no interest paid so far.
If all 3 loans are refunded, the interst from the first two would be used to clear the balance of 480 and you would get a refund of c. £5893. Plus over £1000 in added 8% interest.
BUT there must be a reasonable chance that Amigo will say the last loan is affordable – it was smaller and the monthly repayments were much smaller than the previous two. I am not sure how Amigo would do the calulcation there, Come back and talk about it if that happens?

Thank you so much Sara – that’s really helpful to know exactly what to expect them to offer. In the response they sent me it said that the interest would be refunded on all loans in the appendices at the bottom & the third loan was listed so fingers crossed.

Hi all,
Payment received yesterday, over £3k refunded. Complaint lodged October, rejected in January, then reversed and upheld in June.
Worth noting that I overpaid the loan regularly! One month I knocked £1000 off, this had no bearing on the affordability complaint.
It took about 15 working days to get the payment after accepting and providing bank details.
Shout out to Emma at customer services, she has been absolutely brilliant. She was very clear at communicating the delays in payment.

Just spoke to a very polite person at Amigo he said sorry but he could not give me an update yet as the email had not been approved!! once l receive the email l need to call and either accept or decline the redress but he said as of yet he did not have anything more he could update me on. I accepted my redress on 16th June to be told 10-15 day for settlement and refund due 3 days after that.
Wish would hurry up.

Does anyone know how they work out the final figure if your guarantor made payments?
It is confusing me… Can anyone help?
Loan 1 – £3000 at £185.45 p/m for 24 months in Dec 2011.
Top-up – £5000 at £197.62 p/m for 60 months in Jan 2012. £1847.92 went towards loan 1 and I received 3152.08.
My guarantor made 6 payments to loan 1 (I think… It may have been 5 or 7… Still waiting on SAR) and 4 payments to loan 2.
Guarantor said he has been offered £2500 (assume that is approximate as he sent me a text) but I can’t see how they got that figure and now despite using my best spreadsheet skills and all of the great info on this site, I can’t figure out what I am expecting when the 8% interest is included.

Hi all, this is what I received on 17th June – haven’t had any figures sent out to me yet.
I had taken the loan on 30th May 2013 (£5500), paid per month £268.4 and fully paid it off – last payment was in November 2016. I sent my complaint on 3rd March 2020, SAR received on CD.
“In particular we note, for example, that there were a number of apparent inconsistencies in the information you provided.Accordingly, Amigo is prepared to offer you redress in respect of the loan agreement shown in the appendix. The redress provided will consist of:
The removal of all interest charges under the loan agreement;
A refund of any payments you may have made in excess of the capital amount of the loan agreement, along with 8% simple interest; and
The removal of any adverse information from your credit file in respect of the loan agreement.
We will send you a separate letter detailing the breakdown of your redress amount and confirm any outstanding balance or refund amount no later than five working days after 1 July.
If a balance remains due under the loan agreement, we will use any redress amount to reduce the balance due. If this pays the full balance, you will no longer owe money under the loan agreement and may also be entitled to a cash refund. If you are due a cash refund simple interest of 8% will be included within this offer to compensate you for not having access to this money up until the date of settlement.”

Amigo have got back to me in writing to say DSAR will take 30 days and the complaints team with be in contact within 3-5 working days regarding complaint?

I’m so happy to hear everyone is getting refunds. However share the same concerns as people like me that have been waiting since last year for the complaint to be resolved. Raised to FOS and they didn’t respond. Would be unfair for them to get an extension since if we miss one payment all hell breaks lose!

I have been reading these comments with interest. I submitted my claim first week in May and wasn’t honestly expecting a prompt reply but I see people getting replies and settlements a lot earlier than some who have had claims in for months. What’s the earliest anyone has ever been successful and us there any rhyme or reason as to how Amigo are handling these complaints?

I put my complaint in with Amigo 16 Feb and received my SAR just before lockdown. Emailed complaint to FOS in week 10. Now on week 18 heard from FOS who said they’ve been I touch with Amigo and I should have a response from them within 8 weeks. 7 more weeks to go then :-( So much for the FCA clamping down if they are willing to give them an extension.
