Correct credit records by “suppressing” them if the lender has disappeared

If you feel that your credit report is wrong, the normal first step is to ask the lender to put this right.

But when the lender is in administration, the administrators may not respond to requests from you to correct your credit files. And if the lender has been liquidated, there is no-one for you to contact.

Here the Credit Reference Agencies (CRAs) should help if you ask them to. Incorrect reporting is against the data protection rules.

picture of a credit record being put through a shredder - how can you get your credit record corrected or deleted if the lender is in adminstration or no longer exists?

Dos, don’t and better options

Do not ask for a record to be supressed if the lender is still going. This is not a short cut, it will just waste your time. Complain to the lender instead (not the CRA).

Do send the complaint to the administrators first if is not too late to make a claim. The suppression process should only be used if you missed the deadline to claim, it is not a quick alternative to making a claim as the the CRA will ask the administrators about your request and the administrators will reject it.

D0 use this suppression process when the administrators agreed to correct your credit record but failed to do so.

Do not think this will clean up your credit record if the debt was sold to a debt collector. Suppressing the record will only affect the credit record with the lender. You will need to complain separately to the debt collector if their record is wrong.

Problems that need correcting

Some of the possible reasons for an incorrect credit record include:

  • the debt has been settled but it still shows as open;
  • the lender had agreed to delete the credit record or to remove the default before administration but didn’t do this;
  • identity theft – you never took that debt out in the first place;
  • the default date isn’t correct, or the dates of missed payments arent correct or the payments you made were not correctly reported.

You may feel the lender should have not have given you the debt as it was unaffordable but it is too late to make a claim in the administration. In this case it is usually simpler to complain about one of the above problems.

The error may be showing on the records of more than one CRA. So you need to check the Statutory Credit Reports from Experian, Equifax and TransUnion.

You need to check those CRA reports, not other reports such as ClearScore or Credit Karma, because you want to talk directly to the CRA, not through a third party.

First ask the administrators

It is best to first ask the administrators to correct any problem. If this works it will be the fastest option for you. Check the lender’s website to find how to contact them.

For affordability concerns, you should send the administrators a Claim. If this is upheld, the administrators will correct or delete the credit record.

Sometimes the administrators will refuse, saying you need to contact the CRAs.

But if this is late on, then you will not get a reply. For example the Sunny administrators have passed the point in the administration where they reply to CRAs. And Wonga has been liquidated – there is no one anymore to contact.

In this case, you can go to the CRAs and you can say you have tried to resolve the problem with the lender but they don’t reply, or there is no-one to contact.

Will the CRA correct this?

This is what Experian says about correcting data – Equifax and TransUnion say similar things:

We can only change this information once your lender has told us about it, or with their permission.

But when the CRA asks the administrators they are unlikely to get any response…  So the CRA has a problem – it can’t leave inaccurate data on your credit record and it can’t correct it unless the lender agrees.

The CRAs get round this by “suppressing” a record. If they do this, the record still exists but it will not be shown to lenders who make a credit check on you.

Ask the CRA to “suppress” the record

Contact the CRAs where the problem is showing:

  • Experian – select Get in touch about > Errors on my Experian Credit Report > I think there’s an error with an account;
  • Equifax – select Do you still have questions then log in to your account (you will have created one when you asked for a copy of your Statutory Credit Report) and complete the form;
  • TransUnion – go through the Disputes process.

Tell the CRA:

  • which records are wrong, listing the individual loans.
  • explain what is wrong and that you have asked the administrators to correct this on dd/mm/yy but they have not replied/told you to talk to the CRA. Or say administration has ended and the lender no longer exists;
  • ask the CRA to “suppress the record” as it is incorrect.

If the CRA refuses (or sends an irrelevant response such as saying the account will be deleted six years after the settlement date), explain again what the problem is and why you need the CRA to suppress the record.

Be persistent – this seems to resolve the problem in the end. Say you want to make a formal complaint if necessary.

The final option if you make a formal complaint and the CRA rejects it is to send the complaint against the CRA – not the original lender – to the Financial Ombudsman. I haven’t come across anyone having to do this when they have asked for a record to be suppressed.

Evidence that may help your complaint

Sometimes there is evidence to support what you are saying.

For example you may have reported identity theft to Action Fraud and have been given a crime reference number. You may have the email from the lender agreeing to delete the record or remove the default.

But sometimes there may be little or no evidence or it may be complicated.

It isn’t clear how much effort the CRAs will put into investigating these complaints. But if your complaint goes to the ombudsman they may ask you for some evidence.

So for Sunny, the administrators have said that “We have transferred the control of maintaining any remaining records to the credit rating agencies, as we will not be maintaining these records going forward. Any further queries regarding entries on customers’ credit files in relation to ECIL loans should be raised with the relevant agency directly”

You can quote that to the CRAs.

Or do they keep your credit score the same until paid at the end of a trusted, this includes debt collection agency’s, I have informed everyone one on my credit file but nothing has changed, could you advise please.

Sunny administrators will no longer respond to you – there is no point in contacting them. They say “We have transferred the control of maintaining any remaining records to the credit rating agencies, as we will not be maintaining these records going forward. Any further queries regarding entries on customers’ credit files in relation to ECIL loans should be raised with the relevant agency directly.

Instead you need to contact the Credit Reference Agencies where the Sunny loans appear asking them to suppress the Sunny/Elevate loans. As the article above says. You should quote what the administrators say in your email to the CRAs.

You need a reason to say the current reporting is wrong. You can’t just say you want the debts gone. What is your reason? Any of the following could potentially be valid:
      – the date / amount of the loan was wrong, or the settlement date.
      – a default or missed payment was incorrectly added. pwerhaps the default should have been earlier?
      – the administrators said your loan would be deleted but it hasn’t been.
      – you were misled into taking the loans as you were told repaying them on time would help your credit record, not you find they make it hard to get a mortgage.

Hi, I’m in a similar position. I had around 26 settled accounts re. Elevate with Equifax, I raised a case for each account (yes I raised 26 separate cases on their site), all I said was, please delete the credit entry from my credit file, they should’ve been deleted before the lender went into administration and they are still showing. That’s all I said. Equifax came back about two weeks later, saying Elevate have gone into administration, and they said as the lender no longer exists, they have agreed to delete the records from my file. So all 26 were deleted in one afternoon. Experian, I’m just waiting for the 30day window to pass, as they are following their own internal protocol. No answer after a certain period then they will suppress. I will update once I get an update which is another week away or so.

Hi there, yes also deleted from Experian. What you need to do is dispute they’re incorrect and we’re deemed unaffordable and should’ve been removed, then Experian will go through their dispute process, I.e. contact lender > wait 28 days > lender disappeared > no response > Experian will either delete or suppress.

ok, you need to ask the administrators if they are going to use the redress to reduce the amount you have to pay on the CCJ.
I am not answering your question about the CCJ because it’s important to first be clear what the administrators are going to do.

This is what it says on their response.

Unfortunately, whilst we have added your unsecured claim to the list of creditors within the Administration, regrettably due to the lack of funds in the Administration, there is no prospect of a dividend being paid to unsecured creditors. This means that notwithstanding your entitlement to Redress no payment towards your unsecured claim will be made. More detailed information on the reasons for this can be found in the Customer Redress Scheme and FAQs, which can be found by clicking on the link above.

We can confirm that as you are entitled to Redress, it is acknowledged that your loan(s) with Uncle Buck were unaffordable and should not have been made to you. We will therefore be informing the CRA’s to remove any record of the loan 1***** that you had with Uncle Buck. Due to the substantial number of customers affected, we would kindly request that you bear with us in completing this process

If the loan was unaffordable you can send the administrators a complaint – if that is upheld the record may be removed.

If not, then it is too soon for the approach in the article above to work. At the moment the administrators are still likely to respond to CRA questions.

Not “unaffordable” as such – I did claim back £121 from Myjar from an affordability complaint in 2019 though, long after the loan was settled in full (it was not a default)

It will not be visible to any lenders who check your credit record.
My assumption is that it will not be taken into account in calculating your score. But in any event, lenders do not use the credit score that you can see.

Experian has now agreed to remove all elevate accounts but say that there is a chance this may have a negative impact on my credit score as they will be removing accounts which show no missed payments and now settled. My question is, is it worth having them deleted?. Thankyou

Just got this reply from Experian what can I say in response, how do I reply raise it again

In October they ceased sending us updates and their active/open CAIS records are now being deleted from the report.

However, settled accounts and satisfied defaults will remain on the file for the six years from the date of settlement and default respectively.

Furthermore, if you have anymore concern about these accounts then please contact the lender directly at:

Elevate Credit International Ltd: Ross House, Kempson Way, Bury St Edmunds, IP32 7AR.

You should reply that you think the records that are still showing should have been deleted by Elevate (assuming that is what you think?), however the administrators have said that
“We have transferred the control of maintaining any remaining records to the credit rating agencies, as we will not be maintaining these records going forward. Any further queries regarding entries on customers’ credit files in relation to ECIL loans should be raised with the relevant agency directly. ”
so you want Experian to suppress these records as they are incorrect.

And because the loan is closed they can’t supresss it anyway.

Affordability complaint last year thrown out. So now, only option is to suppress, but they still exist and surprised the administration is still going on!

Hi Sara. I have 2 defaulted accounts with sunny, defaulted in 2020 taken out in Sept 2019. I feel I was missold the loans as I was already in financial trouble. Many defaults, low credit score, a ccj and no wages coming in to the account used. The accounts have been sold and are now with lantern. Can I make an unaffordable loan claim? If not is there anything I can do?

It is too late to make a claim to the Sunny administrators. Unless the loans were large you would have been unlikely to win a complaint with only two loans anyway.

You could make a payment arrangement with Lantern. It sounds as though you have a lot of other problem debts – I suggest talking to National Debtline on 0808 808 4000 about your options for this debt and your full situation.

Hello I have been in contact with Myjar as the loans are meant to be deleted from credit reports I have received the below:

We are having a lot of trouble with Equifax. Experian and TransUnion records have been deleted. Please note ClearScore is not a credit reference agency, it gives you access to data held and managed by Equifax.

Equifax will not agree to remove data and will only remove settled accounts once the Administration has ended – which is not anticipated for a further 12 – 24 months.

Equifax have agreed that we can have a “Stop Press” facility, which we were finally granted permission on 1 September 2021.

We will forward your request to My Jar Limited. Once they have taken the necessary action, they will contact you to inform you of the outcome. You will not receive communication from us once the action has been taken.

If there are still entries on your credit record that you believe should no longer be there, please take a screenshot of this and email My Jar limited – info@myjar.com with the information. They should be able to investigate this for you.

I have five Elevate accounts showing on my credit report as closed and zero balance, updated on 9th June 2019. Sll Capital are claiming to have bought (and sold) these accounts (before administration but didnt give date) and that they are still active. They have changed the amount owed due to redress for Sunny’s accessing affordability aproach. Very confusing. No Debt collector searches on my credit file and no hard searches. Do I now owe this balance to new company?

          yes it can.

You need to ask SLL Capital for a statement of the account – you may then be able to check if it is right from your bank statements.

SLL may accept a settlement offer from you if you decide you do owe the money.

Wait at least 6 months and then ask. This is too early, the administrators are currently responding to the credit reference agency queries. You want to wait until the point where they have paid out all the money and are in the final winding down stage.

    13 x Wonga (deleted)
    8 x Elevate/Sunny (deleted)
    3 x MyJar (deleted)
    4 x Uncle Buck (deleted)
2 x MoneyBoat (removed by company as a gesture of goodwill upon asking them)

Just two left showing for Cash on the Go/Peachy that in one more week may be supressed if they don’t respond.

That would be every single payday loan I’ve ever had not showing on my credit file.

So far as I know, suppressed records are ignored when calculating a credit score.

BUT in any case no lender sees the credit score that is is calculated for you. If a lender can’t see that disputed debt, they can’t take account of it.

Pounds 2 Pocket loan from 2018 showing as a default on my credit file with Lantern. Raised a dispute with Equifax (18days no response so far) Also raised complaint with Lantern as pounds 2pocket went into administration and stopped taking my money, applied default without telling me and then sold loan to Lantern. Currently refusing to remove the default but they are very hard to get a reply, had to keep demanding on the online chat and took them 2 weeks to reply. I’ve sent a response battling the default but will take them forever to reply again.

Is my best option to hope they don’t reply to Equifax? or keep arguing the default. If the Dispute is suppressed will Lantern re raise this at some point if I don’t pay?

I’m trying to get a mortgage and they’ve gone and ruined it!!

They stopped taking the monthly payment and the company were uncontactable at the time! So left me no option than to do nothing. I paid every month, they then didnt take feb 2019 payment and put a default on the same month then sold the loan to lantern. So i did not even have 1 missed payment before they added the default

My bank shows the payments stopping, I tried to email + Call, nothing ever happened.
My argument is that to apply a default you need to miss 3-6 payments, I didnt miss any, they just stopped taking payments as they went bust! Also never received any form of communication from them or Lantern, not any. So i had no idea about this default until now

If they stopped taking payment, you should not have a default.
them going bust though is not relevant because in most cases they did not stop taking payments, they just continued. If you have copies of emails that you sent that were never replied to, this will help your argument.

If Lantern don’t reply to equifax within 21 days, they said they will supress the disputed information. Is this right ?

      Hi,

Lantern have not responded to my Equifax dispute – they will now suppress the record. Have you found out what this will look like on your report? I am curious too.

Also do i need to raise the same dispute with all of them? Lantern still taking ages to reply to my complaint, giving excuse’s and no proof of anything! Ombudsman have replied today, They have sent the dispute to Lantern – Can only presume that will also take FOREVER,

      Thanks :)

    Hi all
Just looking for some advice/help on getting 2 defaults removed:
One is with wonga and one is with moneybox 24/7
Both had said once I made the settlement payment they will remove the default from my credit file to which they didn’t, plus wonga has updated one CRA as satisfied but not updated the other. Any advice would be very helpful

Wonga, contact the CRAs and ask them to suppress the information as the article above suggests.

247 – did you make a claim to the administrators? was the claim upheld?

These comments have been left at the bottom of an article all about suppressing debts at a CRA. Scroll up to find it

Moneybox administrators have now paid out, if you have managed to claim it is too late. Wait another few months and you will be able to suppress the Moneybox loans too

Hi Sara – thanks so much for the great information. I have managed to have Wonga loans removed from all three CRA reports.

I also have an Instant Cash Loan record that I wish to suppress, could you please advise me on the latest regarding my options for removal/suppression please. Looking at the link below, ICL entered a scheme of arrangement, whatever that means.

THey too won’t be answering CRAs, so you can get those loans suppressed as well.

Thanks, I’ll get back in touch with the CRAs in that case.

With regards to my Wonga loans, Experian didn’t actually have these on their records. Was is common for Wonga not to report loan information to Experian and send the info to Equifax and Transunion only?

yes, many lenders only report to 1 or 2 CRAs not all 3.

Please could you kindly advise out of the below companies who are at the point of administration / liquidation where they’re not answering CRA’s anymore (IE I can then request the CRA’s to remove / suppress?):

    Payday UK
    My Jar
    MMP
    Emergency Cash Ltd
    Cash on the Go
    DJS
    Wageday Advance

Thanks for the advise Sara I wish I had read this a few months ago.

26 loans from a few years back mainly elevate (sunny). Took me a good few hours to dispute on Experian, Equifax and TransUnion but looks promising.

Equifax has the longest process for disputes but in 3 working days they have removed (I presume not suppressed as I can’t actually see them anymore) all loans. Experian have replied saying they can’t remove so I’ve asked them to suppress but suspect this will take the full 28 days. Nothing from TransUnion yet.

    Thanks again.

    Hi Sara,

I don’t know if you or anyone else had an up to date list of lenders who are no longer responding to CRA queries.

If anyone has one please can you share, just as an idea it would be useful if we had a full list which is regularly updated.

    Thanks

    Hi Sara,

So I’ve had a pounds to pocket that went to lantern debt collectors claim won and been told that it would be removed from my credit file. Now this morning I have an email from lantern saying “
Please accept this email as confirmation that the account has now been closed. Any information that we share with credit reference agencies will be updated within 6 to 8 weeks to show the account as satisfied.”.

Would this be the same as it not being on my credit or should I contact them asking for it to be removed like it was supposed to be?

No that is not good enough. Either the debt should be removed or the default should be removed and it should be marked as settled.

Hi Sara so I did reply and now lantern have responded this morning with the following email.

“Thank you for your recent communication.

We would like to make you aware that your credit file will appear as fully satisfied, however your default will not be removed for six years from the default date.

            Yours sincerely

            Lantern“

What do you think I should do now? It was clearly stated from casheuronet that it would be removed from my credit record.

            Thanks

Send Lantern a complaint in writing be emailing them at complaints@lanternuk.com. Send the complaint to the Finacial Ombudsman if they do not change their minds.

Hi, I’ve tried to get some records with Transunion suppressed. They have emailed me back saying the below on all of my disputes:

“Further to our previous correspondence about case reference xxx, we can confirm that yyy Ltd has not supplied a response to the dispute raised on your behalf.

TransUnion is unable to amend an entry without the permission of the organisation responsible for supplying it and as a result, we cannot assist you further with this dispute. We would advise you to contact yyy Ltd directly in order to discuss this matter.

The disputed entry will remain suppressed from your credit report; however, please bear in mind that yyy Ltd can remove the suppression at any time.

We trust that this information is explanatory.”

So I’ve looked into my CreditKarma report, which now shows a notice of correction against the accounts that I’ve suppressed. My TransUnion statutory report still shows these accounts as well. So I’m a bit confused as to if this record has actually been suppressed, or if they’ve just added a notice of correction with my note to say this loan should have been deleted. Do you have any idea at all what TransUnion have actually done and how this will appear to lenders?

      Hiya,

Seen your post in emails and exact same thing happened to me. I think it was actually a delay. At first mine showed as “notice of correction” then they deleted the next update.

As far as I can see now they are gone, although I know they are just suppressed.

    hi there,

i fooloishly took out 2 items with brighthouse and was struggling to pay, lost my job and ended up getting the accounts defaulted in 2019.
i previously contacted them multiple times to discuss the account and it’s so difficult.

i’m now wondering if i can have the defaults supressed as they went into administration

you will be able to get these suppressed but I think this is too soon. You need to ait until it is very late in the administration so there is no chance of the administrators reponding to a query from the credit reference agencies. At least another 6 months I am afraid.

    Hi

I had a defaulted 2019 loan from quickquid, and I missed the claims deadline (wasn’t even informed it was an option, only found this out today). I have emailed them directly asking for no compensation but for the default to be removed from my file. Is this likely to be possible? If not, when would I be able to ask the CRAs to suppress this information? Hoping to get a mortgage next year. Thanks

Then getting the record suppressed from QQ will not change it on the Lantern record. This default needs to be repaid asap. At least a year before a mortgage application.

You have to ask Lantern to do it. A record only gets suppressed from a vanished lender because they aren’t there to tell the CRA that it is correct – unless you can argue to Lantern that there is something wrong with it, they are unlikely to agree to remove it.

It’s really rare to win an affordability complaint with a debt purchaser. Sorry but this needed to be taken up with the lender before now.

Out of curiosity, it shows on my credit file as a lantern loan, will future creditors know that it was a quick quid loan? Or will it just be listed as lantern. Quickquid doesn’t appear to be on my file, just the lantern default. Thanks again :)

I have just checked my Experian (I was using clear score) and the quickquid loan is showing there along with the lantern debt, so it looks like 2 separate defaults rather than one? Is this correct or can that be rectified? The dates aren’t the same on them both either which is a bit strange

That is normal – the credit scoring system only counts one of them.

What is different about the dates?

The most important thing for a mortgage is that the current debt is cleared at least a year before the mortgage application. (as with any other problem debts). Also is the debt markes as a payday loan?

Yeah on Experian it’s marked as a payday loan unfortunately. I will clear it in full over the next 2 months. Strangely, the lantern debt default appears to be earlier than the one listed from QuickQuid. My It’s still categorised as ‘very poor’ so a long way to go. I have several open accounts and haven’t missed a payment since 2019 and all are categorised as ‘in good standing’ so hoping this stands me in good stead regardless of the actual credit score number

how many defaulted debts do you have that have not been cleared? They ALL need to be settled a year before a mortgage application if you are to have a hope of a decent rate mortgage from a high street lender.

Did you have other payday loans as well?
Did you have other high cost loans or other debts?
