Was your car finance unaffordable?
The FCA, who regulates car finance lenders. and the Financial Ombudsman (FOS) say:
a loan is only affordable if you can make the repayments on time, without hardship and still meeting your other commitments.
That means you need to be able to pay all your other debts, your normal household bills and expenses as well as the new car loan payments.
You may have made your car finance a top priority as you don’t want the car to be repossessed. As a result you may have had increasing credit card balances, more loans or got behind with bills. That means even though you kept making the payments, the finance was not “affordable”.

Affordability checks
A lender should have checked you could afford the car finance. This may mean checking not just your credit record, but also your income and expenses as well.
These checks have to be “proportionate”. If you have got a great credit record and a good income and are only borrowing a small amount, the lender isn’t going to have to look in great detail to be confident you can afford it.
But with a poor credit record, or where the repayments will be a large proportion of your income, better checks are needed. The FCA rules don’t say exactly what has to be done, but a lender often can’t rely on what the customer says their income and expenses are. Other ways to check include:
- your credit record shows what you are paying to other debts each month;
- there are national average figures for some expenses, so your estimate that you spend £60 a month on food or nothing on clothes isn’t realistic;
- the lender could look at payslips or bank statements to be sure.
These checks are often inadequate
The regulator thinks some car finance lenders are not checking properly for affordability. In 2019, the FCA said:
Here is an extreme case ‘Car payments are ruining our lives’ where a 23 year old student with a part-time job was sold a 21k Audi on finance, with apparently no affordability checks at all.
But it’s probably more common that a quick and inadequate check was done.
A car finance expert makes a lot of excellent points in this article: The car industry need to be more honest when selling car finance. He says:
It’s time for the car industry to do better, even if it’s to save customers from themselves.
“Affordability” is a test of your situation when you took the finance
The car finance company may have done a good assessment of affordability. At the start, you may have been able to manage the loan repayments.
Then something went wrong – perhaps you had your hours cut, or you split up with your partner. Or rising bills in 2022 mean what was manageable before isn’t any more. Here it’s not the lender’s fault that the car finance is now unaffordable and you won’t win an affordability complaint. But should the lender have seen that the loan was too expensive at the start if they had looked properly when you applied for the credit?
In this case, you can make an affordability complaint to the lender.
How to make a car finance affordability complaint
The affordability rules for car finance are the same as for other loans. So you can follow the approach and use the template letter for an affordability complaint in this article: How to ask for a refund from large, bad credit loans.
The template letter in that article asks for:
- a refund of the interest on the finance;
- for the remaining balance to be repaid at an affordable rate; and
- for any negative marks to be removed from your credit record.
If you have other serious complaints about the car, such as poor quality, you can add those into the standard affordability complaint letter.
A lot of lenders reject even good complaints. So don’t be depressed if this happens – just send it to the Financial Ombudsman – the process is all described in the above link.
What happens if you win the complaint?
If you win an affordability complaint for a normal loan, you get the interest refunded and if the loan is still running, your balance is reduced. It’s more complicated with car finance complaints.

These complaints may take many months. You will have to keep up the loan repayments during this time, or your car may be repossessed.

Other sorts of car finance claims
€ar finance commission – cases won at the Ombudsman
In January 2024, 2 major cases were won at the Financial Ombudsman were people had been charged to high an interest rate on car finance in order to increase the commission the car dealer got.

But if you think you may have a good affordability complaint it’s probably worth trying that first, as in an affordability complaint you get all the interest refunded, but in a commission complaint you would only get some of the interest back.
“Dieselgate” – a totally different sort of claim
You may have seen ads saying you may be able to get £,000s back as diesel cars were mis-sold because they produced more harmful emissions than advertised.
MSE has written a good article on these claims, with a list of the law firms you can use and what they charge. This is not a complaint you can sensibly try to do yourself. I have no idea how likely a payout is and it may take a long while.

A time ago I have a credit to buy a car. £3500 pound 36 x 130.14 = 4685.04. (November 2015 – november 2018)
I complain against them for unaffordability, and they offer to pay me back only the late fees plus interest which is 254.28. Plus delete the record.
Should I accept that?

The maximum you could get back would be £1185 (the interest) plus about £150 for extra interest plus the late fees which they are already offered to refund.
I don’t think we have yet seen a car finance affordability complaint go to the Ombudsman so there is no track record to go on here.
How unaffordable was the £130 a month payments? What would your credit record have shown at the time you got your car – were there recent defaults, missed payments, large amounts of payday loans?

I have been reading your posts now for sometime and find them all very interesting. If you could advise me on the following. Took out finance for a car, term over 5 years at 39.9%. My agreement finishes November next year. I have met the monthly payment £176 for the last few years up until now as my financial situation has changed and I have 2months arrears sitting on the account at the moment, struggling to make ends meet. Do you think I should apply for a refund in interest ?

I think it would be good for you to talk through your options with National Debtline on 0808 808 4000 because that far through the agreement, you have another option to VT the car. If you really can’t manage the payments this may be a better option but it may well have to be exercised quickly in your case – hence speak o National Debtline as soon as possible.

Hi. I’m after some advice regarding this.
I stupidly took a car out on finance with moneybarn, my credit was poor at the time so this was all that was accepted.
The car was worth around £8000 but the credit total was around £18000. I have paid around 27 months so far with a struggle on a 5 year payment plan. I don’t want to terminate and lose the car as I feel I have already paid so much into it.
Is there anything I can do? Or do I just need to continue to pay it all off.
Any advice would be hugely appreciated.

It is HP. which is why I don’t want to cancel the whole thing. As I do not have the money to get a good reliable car outright.
I would say the car is now worth around £5500. My credit is now a lot better yes. And in terms of struggling I have had to put off my rent in order to pay the car finance this month. So I am literally on the edge of affordability at the moment.

I think you should talk through your whole situation with National Debtline asap. Getting behind with the rent is huge big warning flag. Unless there was something very odd about this last month, if you are struggling that much you may not get to the end of this HP contract however much you want to.
A couple of other points:
1) you need to forget what you have already paid to this car and just decide what is best to do from here on. I know that’s easy for me to say and it’s harder when you have been struggling to make the payments, but making the right decision now depends on your current situation and what may happen in the future, not what has happened in the past.
2) it sounds as though you can VT it in 3 months time. If at that point you still have a good credit record, you may be able to get another car on HP at a cheaper rate?
3) do you have a case for saying moneybarn didn’t do proper affordability checks at the start? If you can show they should have known you would struggle, getting interest removed from the finance would be a huge help. But was the finance really unaffordable for you at the start?

Just a reality check for you but you don’t have any money in the car. Even though you have been paying it for a while, it is worth a lot less than is outstanding. Just think of it as renting it. Remember that you can VT a car when you have paid half the amount back including interest and DEPOSIT. If you call them they have to tell you your position regarding VTing or exactly how much you have paid so far. This might be sent by letter.
I’d also advise doing a soft credit check(many websites have this) which may give you the chance of starting afresh at a better rate and cheaper payments.

Interesting one this. My son took out a finance deal with Volkswagen Finance. He was also sold a gap insurance and a lifeshine package which consisted of autoglym. After a year it became obvious he was struggling as he is a pizza delivery driver/shop worker. I had to take on the finance and I calculate we will end up paying about £1800 in interest over the 3 year term. The Lifeshine package which was about £250 and the gap insurance at £300 were added to the loan. I gave him the deposit. When the contract is over, there is another £4200 to find to keep the car. The cambelt needs changing which he could not afford the cost of that with the dealer is around £700. Is there a case here?

The question is, should VF have known that the monthly repayments – including any extras bundled into the finance package – would be too expensive for him?
One thing you could do is send VF a SAR (see the first letter in https://debtcamel.co.uk/refunds-large-high-cost-loans/ which says what to ask for) and see what comes back. Also get hold of your son’s bank statements for the three months before the finance application and see what his actual expenses were.
That will give you more information about whether VF should have been able to see that the loan was unaffordable.

I have to ask the question but as his father, when you gave him the money for the deposit, did you go with your son to the dealer at any time or did you talk about the finance and what it would cost? Did the conversation about affording the car take place and could your son have bought a cheaper car?
The final payment of £4200 which you mentioned is optional, so your son can just hand the car back at the end of the agreement if he wants, as long as he has stuck to the agreed mileage. The fact that he had the paint protection as well means that the car will hopefully be in a good condition and there is a good chance of the car bring worth more than £4200 at the end, which means he could always sell it to the dealer and walk away with some money in his pocket.
I guess that if your son hadn’t taken out the PCP and just taken out a normal hire purchase agreement over the same term(length of time) it would have cost another £100-£160 a month so the PCP was the best option, other than your son buying a cheaper car?

Hi Chris, thank you for your response. I originally took him there but did not get involved in any discussions with the salesman about what was tacked on. I note that the paintwork has damage on the bumper so am wondering if the lifeshine package will cover this. Apparently, it must have happened when he was parked. A conversation about affordability never took place with the salesman. He said the salesman just kept looking for things to add on and was quite persistent. The mileage is going to be about 5k over when the contract is up in July, so I there will be another £500 to pay if the car is returned. I have been making the payments on his behalf and paying the servicing costs/MOT. He is earning more now than he was at the time of the deal. Of the monthly payment of £129, over £50 a month is interest. It is hard to answer if he could have afforded a cheaper car, the deposit I paid was the maximum I was able to give him, it was money from my Mum’s estate. The car he decided on was one of the cheaprest available at the dealership and he picked Volkswagen as he needed something reliable to get him to work.

I’m looking at this from a dealership point of view but trying to be impartial. I’m sure a conversation would have taken place where the salesman would have asked about budget, it’s part of our qualification to make sure we don’t show a customer a car completely outside of their budget. That’s wasting both the salesman and customers time and we wouldn’t do that. To be fair £129 a month sounds quite low per month for a VW unless the deposit put down was a lot which would have kept the payments low.
The lifeshine is a resin polish designed to look after the cleaning condition of the car. To make it shinier without needing to polish. It would also protect it against bird droppings and tree sap for a longer period of time than without it. It’s not an insurance to cover damage. Some dealers sell Smart insurance for that purpose.
I suggest looking at the finance agreement again as the interest you say is being paid, £50 a month on a £79 a month loan is extremely high. VW PCP is branded as Solutions and they do have a limit to what the rate can be. Also. You mentioned paying for the services, but historically VWFS normally include a free number of services if you take out a Solutions agreement. Maybe worth looking at.

Re the cambelt, you could always go to a specialist if the main dealer is too expensive. Bear in mind the cambelt is recommended to be changed, not essential, but if something was to go wrong with it the warranty would check that it had been done or not which could affect any warranty payment.
There has to be some responsibility from your son on agreeing the deal who probably thought he could afford it at the time. You say he is earning more now so hopefully he can take back responsibility from you.
Final point, if he sells the car to the dealer or part exchanges, he won’t be liable for the excess mileage, he’ll just get less than forecast as the mileage is over, but 5000 miles on a four or five year old car isn’t a huge price adjustment.

“There has to be some responsibility from your son on agreeing the deal who probably thought he could afford it at the time.” The Financial Ombudsman takes the view that the bigger responsibility is on the part of the lender to make sure the finance is affordable… asking for a SAR will provide some evidence about what checks (if any) were made before the finance was agreed.

Thanks Chris. I will look into the points you have raised. He brought me the finance agreement today. I think I gave him about 2k as a deposit about 2 and a half years ago. It became apparent about a year into the agreement that he could not afford it. His Mums boyfriend wants him to move out but he cant afford to rent so is a bit stuck at the moment. I will do a SAR and take it from there.

I currently have a complaint with FOS regarding the car finance company.I complained to the company regarding affordability and they looked at my complaint and came to a decision within 2 hours.
They told FOS they checked my credit file and bank statements and decided i could afford it but FOS asked me for a copy of my bank statements and over the 3 months statements sent to FOS i had gambled over £4000 to an online casino and was in arrears with a lot of debts including rent and utilities.
When i bought the car in the January it has many faults and i complained and complained it wasnt until the december the finance company sent a guy to look at my car and he found the faults i had mentioned but said they could of been done yesterday theres no way of knowing when they happened even though i had been complaining about them for nearly 12 months.
In the end the finance was too much for me to afford and they took the car off me i had paid nearly £3000 off the car and my current balance is over £5000 remaining.
After i lost my car the company i bought the car from Fowlers Finance was on bbc watchdog program laughing at people like myself buying car from them saying they buy at auction cheap and just sell them straight away.I am sure that is wrong but i will just have to wait for FOS to make a decision.
It is currently at the investigator stage and he says a decison should be made by end of this week.

No i havn’t.All i know is i rang about an insignia and ended up with a citroen c4 piccasso i gave details over phone rang me back after 10mins said everything ok bring some id with you and can have car .that was it regarding checks.It been with FOS a while and in final stages sorry its not with investigator its with an adjudicator

If it is turned down, you can ask for it to go to an Ombudsman (ignore the adjudicator saying that the ombudsman will reach the same decision – they always say that) and that will takes weeks or months, so you will have the copy of your personal data before then.
Also read a lot of the comments on that page – that will give you an idea of how to frame a good affordability complaint.

Actually one other thing i had a log book loan out at same time to loans to go for my other car my wife used and FOS upheld my complaint due to affordability and L2G had to give me money back and it was at exact time too with same bank statements so hopefully i may get a result will just have to wait and see

I took HP out though The Car Finance company in 2016 and at the time provided credit reports, wage slips and bank statements which at the time would have show the HP was unaffordable.
Because I had poor credit, the car was fitted with a black box which would disable the engine if payments were not made.
I continued to make the payments however, I had a lot of issues with the actual car and the black box. Even though I was making the payments, the black box continued to disable to engine. This device was refitted several times as there was issues with it.
In the end, because of all the issues with the car, I gave the car back voluntarily, without penalty or so I had thought.
Fast forward to last month and I received a batch of letters from the Car Finance Company with a default notice attached dated in 2017. All of these letters had been previously sent to a wrong address, which Car Finance Company apologised for in their cover letter.
I contacted them and they are saying that I owe over £5000 as the car was repossessed! I have put in a complaint to the company and put in a Subject Access Request and have said that if need be, I will take them down the unaffordable lending route if my complaint does not go in my favour.
This has made me feel so ill as I have recently paid off all of my debts and I just feel I have taken a massive step backwards.
I don’t even have the car and haven’t done since early 2017 :(

That must have come as a big shock. It sounds as though you have taken some sensible steps. There isn’t much you can do now except wait until you get the SAR data and a response to your complaint. If your complaint is upheld, you also need to ask for your credit record to be cleared – it was not your fault you never had the letters earlier.

I need some advice for my mum about a leasehire car she has signed for. From October 2017 she nursed her husband through cancer until he passed away in February 2018. This was a reallystressful and sad time for mother. Fast forward a few weeks and mum took her 2015 plate car for a service. She bought a new car. Well she thought she had. She thought she had bought a newer (2017) car on HP at 0% interest, and that annual services were included as part of the deal. Now a year later when the car is due for it’s first service she has dicovered that not only is she paying interest on the loan, services are NOT incuded and worse of all she does not even own the car as it a lease hire not a hire purchase. I know the garage do not care about her personal circumstances when she signed the paperwork, but my mum is not a stupid woman. She never buys anything unless it is 0% interest. She is 63 years old. She thought that by the time she retires she would own the car outright. This is not the case, as she will never own the car unless she takes out a loan and pays a huge final payment at the end of the lease. Alternatively, after she has paid at least 50% of the value of the car she can return it and cancel the agreement. Is there anything we can do? My mum is mortified that she has been so silly, and I’m really angry that she has been taken advantage of. Any advice or help would be appreciated. Many thanks

I think you will find it hard to argue that the garage misled her about this. She can presumably afford the monthly payments?
What happened to her old car – there should have been a large PX value if it was only two years old?

I got a decision today regarding my complaint with FOS regarding The car Finance company.
They have upheld my complaint i currently have a default for over £5000 on my credit file and that has to be deleted.I am not allowed my payments back i paid for the car as i had use of it even though it had lots of problems and i spent many hundreds of pounds making it roadworthy.I complained to the Car finance company for a year regarding this beginning on the 3rd day after purchase and they did nothing i paid over £2000 in payments but i have lost those.They have to pay me £100 compensation for the problems and they have to take interest off and pay me any late payment charges and remaining interest with an extra 8%.I wont get much money back but i wasn’t bothered about that i wanted my credit file cleared of this finance and at least this will be done.

Could I ask you how long your complaint was with the FOS?
I have recently recieved my SAR request from the car finance company and they had falsely stated the amount of defaults on my credit report. They stated that I only had one default and one CCJ. However, I have been able to obtain my credit report for around the time I took the car out and I have 3 defaults and one CCJ but one of the defaults was from Blackhorse Car Finance for over £8,000 which was also still outstanding.
Also my ingoings and outgoings were wrong on the original agreement. It shows that my rent was £375 when I actually pay £700 a month and I have bank statements to confirm this.
Sara would you be able to advise on this?

I put my complaint in via email to CFC and it took them 2 hours to give me a final decision.When i took it o FOS its taken them 9 weeks to come to final decision.
I know what you mean about false things they did same for me my bank statements saved me and made them look like liars.Fight them if you have all the information to back you up i can’t see why FOS wouldn’t uphold your complaint

I have only recently complained to them last week about unaffordable lending.
I also complained to them about them putting a default on my credit report as I was under the impression due to there being so many faults with the car, I gave it back voluntarily. They havent upheld this complaint though and said the car was repossessed.
I feel in such a mess with all of this.

Re the defaults can you tell which credit reference agency they used? There are three, you need to be sure the three defaults showed on the one they saw.

No I cant see which credit reference agency was used but I’m pretty sure it was Experian as I remember printing off my credit report for them.
I did complete an income and expenditure form which shows the rent at £375. They told me to put this down instead of the full amount even though my bank statements would show fhe £700 coming out. I did sign the income and expenditure form though because I was so desperate for a car to get back and forth to work. I think this will go against me.

As expected, they have rejected the affordibility complaint after looking at it for a few hours.
I have just come off the phone to them and whilst on the phone, I asked why they told me to put my rent down at half what I was paying. He said, thats just how we do it if you are living with a partner, we half all the bills. I said that my partner was a student on a small bursary at the time she wouldnt have even been able to afford half of our rent. I also said that I was a sole applicant and that my partners income didnt even come into it. How can they get away with this?
I am in work today so will phone the FOS on my day off on Wednesday. I have bank statements and my credit report for that period so hoping this will be enough evidence.

Have you asked them to supply a copy of all your personal information? If not, ask that now – say you want all your information including all credit checks they made and copies of all phone recordings. So you can show that recent call to FOS.

I already have a copy of all the information from the SAR and previous phonecall correspondence. I have just emailed them again now for a copy of the phonecall I had today with them.
They have also admitted in their final response that they did not sent me any letters due to an administrative error hence why I never knew that I had defaulted (see previous post for what happened).
Keeping fingers crossed but my evidence is stacking up against them.

I have got the call recording from yesterday and was just listening back to it.
The advisor told me that it was standard practice to half the bill payments if I had a partner. When I questioned this and said that my wife was only earning a small bursary each month he still said it was standard practice.
I also said to him the only bank statements that they wanted were the ones showing the income, not the other account I transferred to for the bills/outgoings. He also said this was standard practice.
Do you think I have a strong case.

I think that call recording helps your case. They did not conduct proper affordability checks and told you what to write on the expenditure form. The call backs that up as showing that this was standard practice, not some unusual error. Your argument should be that this loan involved a significant amount of money over a period of years and the finance company should not have assumed that you were only paying half of the bills without any evidence that this was the case. Whether the loan was affordable for you will depend on the details of your case.

I had 8 defaults and 3 ccjs which the guy at FOS was concerned about i dont know what credit reference agency they used for the so called credit check.I use noddle to download my credit file and it had everything on it.
I bought my car from fowlersfinance and i really don’t think they did many checks if any for me otherwise the would have found problems straight away.

If I recently just got a car on finance but it’s unaffordable, if I make a complaint and win will I have to give the car back? It’s on a hire purchase agreement. I don’t want to give it back so debating if it’s worth complaining if I have to give it back. I’m about £400 into a £9000 total loan (£5000 loan £4000 interest)

If you make a complaint about unaffordable lending theres no way you can keep the car it is the property of the finance company.If you win your complaint you will more than likely just send car back and be debt free from them .

Probably way too late for me but Ford Credit run a credit check on me in 2006 for a £8500 Ford Focus. Apparently they could only give me finance for £6k so they reduced the car value to that and added extra interest on!
I was 22 at the time and this was my first financial credit agreement which I struggled with for 5 years.
So yes Ford did screw me BUT I had the car for 8 years and was brilliant until a tractor hit it :(

I’ve read online they ‘specialise’ in bad credit? Also I remember them going through my credit file with me and questioning the missed payments but I just put it down to switching jobs (which was a lie).

To win an affordability complaint, the monthly payments have to be unaffordable. They went through your credit record and you said you were paying those cards, so they should have checked that you had enough income to pay all those commitments and the new finances and essential expenses.

I took out a car loan with money barn in 2012 and bought a car from a main dealer. The value of the car was £7600. I didn’t have a large enough deposit, so they increased the car loan to £8500, and showed on the paperwork that I paid a £900 deposit so I would be approved for the finance. None of this was true, I only paid a £100 deposit to the garage, and the balance of the car was paid by money barn £7500. I have all the paperwork from money barn, the receipt for the car, and the deposit I paid. Do you think I could claim back the interest on the loan?

I haven’t come across a complaint about this before but it sounds unfair and at Moneybarn’s high interest rates will have cost you a lot. I suggest you complain ASAP, expect MB to reject the complaint and send it to the Financial Ombudsman. This is ver 6 years old, so it may be hard but it’s worth trying.

I took out a car loan with moneybarn in May 2019 for £10,970 over 5 years at a rate of £349pm. The problem is I already had several defaults in the 12 months prior and I am currently paying £395 to Amigo (which is with th FOS). For my Amigo loan the adjudicator has sided with me I am just awaiting a settlement figure they said this was completely unaffordable yet Moneybarn have given me an extra £10k of debt (my rating is so bad I couldn’t even get a payday loan when applying to moneybarn).
Do you think I have a valid affordability complaint? I have only made 5 payments which total £1745 but would like the massive interest reduced to a more affordable payment. I cant lose the car as I need a reliable car for work do you think if I win they will wipe off the interest or take the car back? TIA

It sounds as though you have a good affordability complaint.
I haven’t seen enough car finance complaints which are made very early on finish – there are quite a few in progress – to know how the redress will be handled. You can put in your complaint that you would like the interest removed and your monthly payment reduced so that over the current term of the loan you repay the amount you borrowed.
Will you be getting a refund from Amigo or just the loan wiped? If you get a refund, you could use that to buy a cheaper car…

In moneybarns t&cs it states if any terms are broken they will take back the car so would an affordability complaint where I am still paying count?

Hi Ben, no unfortunately Moneybarn are useless and rejected it almost straight away as they have said they are aiming their loans at people with a less than perfect credit record so they don’t see the problem. I then complained to the ombudsman who are still currently looking into the complaint so not expecting to hear back for a fair few months. My Amigo complaint took 18 months to come through from the ombudsman

They gave me the exact same response. Got my SAR and my statement showed income of £1230 one payment to a payday lender of £730 and another of £163 and another of £172. They clearly didn’t check affordability just income. Car payment was £221!!
I’ve sent mine to the FO but think it’s going to take a while with current situation.

It may take a long time. But you are no worse off than if you didn’t make the complaint and still have to pay…

I took a car loan out in February 2017 for 5 years. At the time I was in a debt Management plan and needed a car as I had just been offered a new job after redundancy but it didn’t come with a car. As the job was as an area manager covering a an extremely large area I had to have a car for the job and claim mileage back. The car was £7200 and the payments were £207 for 61 months giving a total to pay back of £12627. I am now approx half way through and can hand the car back to the finance company and walk away from the car. The question I am looking to be answered is if I terminate the car at the half way point, can I still chase the unaffordable finance complaint through the financial ombudsman? The grounds for my compliant are that I actually shouldnt have been loaned to as I was in a Debt Arrangement Scheme which was clearly visible on my credit file and the interest rate was unfairly high due to the poor state of my finances.

yes you can still make an affordability complaint. But by VTing the car, you will have paid a lot less interest. Also the mileage you received will have helped you pay for it. i don’t know how the Financial Ombudsman would allow for all that.

Had my answer form the adjudicator today and theyve found in my favour……all payments are to be refunded to me along with 8% per year interest. Letter has been sent to the finance company so now we wait to see what they reply with. To be fair to the to the adjudicator, the letter they have sent them is basically a four page lecture on irresponsible lending…the finance companies argument was that I was spending within my disposable income…….but once the payments came off the adjudicator worked out I was left with 27p to survive on. Hopefully they wont argue the point and drag it out.

Latest update is that Specialist Motor Finance have ignored the date that was set by the adjudicator…..so the adjudicator has given them another 8 days!!!!
What happens if they just ignore that one too? Anyone else had issues with Specialist car finance paying back the amount set by the Ombudsman?

I took out a 14000 car finance loan with moneybarn at 35% apr on a bmw, at the time I had a bad gambling problem and a string of payday loans, I missed a few payments and moneybarn repossessed the car, I saw this thread as I was putting together complaints for mid-sold payday loans, so I thought i’d make a claim against moneybarn for irresponsible lending, the claim was rejected by my adjudicator so I was gonna escalate it to the ombudsman, but just before I did moneybarn sent me a letter stating they were writing off my outstanding £8000.00 debt so thanks a lot, I’m not sure if moneybarn are still being investigated by the fca and that’s why the wrote off my debt because I was contacted by the fca but it’s definitely worth making a complaint to them about irresponsible lending/underwriting checks.

I currently have car finance with Moneybarn and i am currently on benefits.I have 2 cars on finance with them one for myself and a joint with partner.The cost of my aygo is currently standing at £11200 with a payment of £217 a month and also my joint currently stands at £22951 with a payment of £376 a month.
I am starting to struggle with these payments my first car they didn’t even ask for anything apart from my driving licence and then was accepted but did ask for proof of income with 2nd car for both of us.I currently receive approx £2000 a month but the car payments alone is nearly £600 as well as a lot of home credit,brighthouse,provident,perfect home,loans at home and morses my weekly costs is just under £300 a week and thats without normal living costs.
I feel maybe more checks should of been done.I was wondering if you think i have a case to maybe complain regarding this.I don’t want to lose my cars as i am paying and i am not in any arrears.

Is there a reason why you need two cars? I don’t think those cars are affordable – you have to add in the insurance, petrol, servicing, car tax on top of the car finance costs. But an affordability complaint so early may mean you risk losing the car, because you have paid very little to it.
It sounds as though you two have a LOT of debt. Can I suggest you talk to StepChange about a debt management plan and then get on with affordabilty complaints?

I’ve won all three of my payday loan claims and am pleased to say I’ve had 5 figures redress and am almost debt free! Feel like a long time to get here. I bought a car in amongst all the month on month payday loans. I had 49 Wonga loans and 12 pounds to pockets loans in 4 years. although I never missed a payment(because I was getting payday loans galore) I had all the payday loans and three bank loans a multiple credit cards when I took the finance out. I was never asked to provide evidence of my income or my expenditure, just asked what my salary was and that was it. Given the FOS has ruled all the other debt was unaffordable is it worth querying this? I paid over £3000 interest on a £6000 car (rolls eyes)

Thanks as always Sara. I have found the paperwork. Who do I complain to?? the dealership who sold me the car and finance or the actual finance company. I found the vehicle order agreement which mentions finance, the monthly cost and duration but no where does it mention the total price payable. Seems odd. The cost was £245 a month 35 months and final payment £543.42 so yes over £3000 the finance was!

I bought a car on credit through Moneyway in 2014 for £2995 on a hire purchase agreement. The interest was 34.99% apr totalling an interest payment of £1770 on top of the car value.
At that time I had several defaults and payday loans on open on my credit file. Would this be considered a mis selling issue?

That would depend on whether you could afford the monthly repayments. There is no bar to charging a high rate of interest because someone has a poor credit rating, but a poor credit rating will often reflect the fact that someone doesn’t have much spare income to make the monthly payments…

I have complained to the ombudsman regarding a secured car loan with Barclays (Clydesdale) and they have basically come back and said cannot see that anything was wrong. At the time of the loan, my husband who’s name the loan is in was not even working and had not been for years. He was in receipt of benefits so I truly believe that they should not have given him the loan originally which has since left to repossession of the vehicle.
There are lots of issues that I have with the ombudsman response (e.g. I’ve asked for proof of the value of what they’ve sold the car for so that we can check how much we supposedly still owe; amounts on the original loan agreement and what they say we now owe do not correspond)

There is no reason why someone on benefits can#t get car finance, the question is whether the finace company made checks that he could afford the monthly repayments.
Is this FOS decision from an adjudicator or from an Ombudsman?
You should be able to get proof of what the car was sold for by sending the finance company a Subject Access Request asking for a copy of all your personal data.

I am currently on benefits married with children my partner receives pip and we had a car that had a lot of problems so we decided to buy a car with Moneybarn in april.The cost of the car was £6500 and too date with no arrears the outstanding balance is £11,523.79 with a payment of £217 a month (as of now) and my partner decided he wanted a car couple months later and Moneybarn said that it was ok and gave him a loan for to buy a car and the outstanding balance £20,999.17 at a cost of £369 a month with arrears of £659.62 but we got a payment plan to pay £80 a month and have paid 1 payment.We are paying the cars but with other home collected loans and normal living expenses we are starting to majorly struggle we don’t want to lose our cars but would it be worth while putting in an affordability complaint.We don’t work i care for my partner and only receive benefits and he had a major heart attack 2 weeks ago and is awaiting more surgery i am very worried about the situation.

That all sounds very stressful for you, with health problems on top of big debt problems.
Could you change your life so you can manage with only one car? Even if you win affordability complaints, you would still struggle to repay the amounts you borrowed with no interest.
If you have been borrowing from Provident or another home credit lender for a long while, send them an affordability complaint now (see https://debtcamel.co.uk/refund-doorstep-loans/ for a template letter for this) and also ask them to reduce your repayments to a very low level because they are unaffordable.
Are you buying or renting? Do you have a lot of other debt as well as these car and home credit loans?

I would like some advice regarding a car loan through ‘family finance’ taken out via ‘can can car finance’.
I took the agreement out August 2018 when they offered me to borrow £8000 over 48 months paying back £290 per month, I stupidly agreed at this ridiculously high rate.
At the time I was working as an agency worker at JLR, I was laid off with a weeks notice 2 months later and had to take a job which is much lower paid. I have struggled to keep up payments over the past year and I finally called them today to see what could be done and their response was simply ‘I don’t know, there’s not much we can do’ – Very helpful. The settlement figure is still £7200 and the car is only worth £5000 maximum.
There has been a few times where I have had to delay payments but I have mostly kept up to date with payments.
Would anyone be able to give me any advice going forward?

I was last year and I still am in quite a bit of debt with missing payments on my report. I was also gambling ALOT last year but have since given up completely.

I have a car on finance and only had it a month. However, at the time I thought I could afford it but actually I can’t. I looked to cancel and the interest rate is huge at 45%. I cannot afford it and already no paid the council tax. They did not ask for wage slips or even any bank statements. I want to go down the affordability route to reduce the interest. I can’t VT the car due to the amount being horrendously high. I did look at the time after paying the deposit for the car to cancel but at the time they wanted £800 pounds to cancel the deal although no money was sent from them. It is with money barn which I have heard are notorious for not helping and whacking on huge charges. Please help.

I sent an email to Moneybarn citing that unaffordability as the reason. I was on a DMP at the time I took out the loan and needed the car for work (it was a requirement). No bank statements were requested, only 3 months wage slips – which had they requested the bank statements they would have seen previous payday loans and also that I was on a DMP. They have responded to reject my claim and cited various reasons, namely that I pay on time (so not unaffordable – but I am robbing Peter to pay Paul and as a car is necessary, I was paying them first) and also that they are a sub prime lender, so they do offer high interest rates. Should I send this to FOS? Unsure if it is worth the hassle as they’ve said I knew what I signed up for.

I think you should send it to the FOS. As you point out, the fact you are paying on time does not mean the loan is affordable.

GCC (The Car Finance Company) rejected my unafordibility complaint in early April 2019 and it has been with the ombudsman since this date.
The adjudicator has stated she agrees the agreement was unaffordable but has said that because I benefited from the car for 6 months (I didn’t because it was faulty) that I pay £1975 and the default to remain despite the fact the car was taken back in August 2016 under repossession for failure to make payment.
This decision was made by the adjudicator in August 2019. I disagreed with the decision and so did GCC so the case was referred to an Ombudsman to make a final decision. An Ombudsman picked the case up at the beginning of November and I was told that because all of the evidence/timeline is already there, I should have a final decision soon.
Because the car finance was found to be unaffordable by the adjudicator, is it likely that the Ombudsman will agree with them? I really hope that the decision goes in my favour and the best outcome for me would be for the debt to be written off and the default removed however, if the debt is reduced to the £1975 and the default remained, this wouldn’t be the worst scenario.
I was hoping that this wouldn’t be dragged into the New Year but it looks highly likely that this will be the case.
From experience, how long do Ombudsman decisions take once they are allocated?

I also have a complaint regarding GCC (trading as TCFC) .The adjudicator decided in my favor also and they were told that the balance they wanted to be wiped,default removed and £100 compensation.They also did not accept the decision and this has been with ombudsman since may i have heard that they are now in final stages with decision but TCFC are playing delay tactics and have taken a long time to give them information they have requested a lot longer than the 14 days they were allowed.So my guess is at least couple of months.

Any update with your case with the Ombudsman? I am still waiting a final decision because the debt was sold on to Arrow Global during the investigation, it has made things a bit more complicated apparently.
Complaint went to the FOS in April, picked up by an adjudicator in July. Adjudicator made decision in October that the debt be reduced to £1975 but GCC (TCFC) didn’t agree with them and it has been with the Ombudsman since November.
Cannot wait for this all to be over to be honest.

Arrow have been good with me as well. In fact because the adjudicator stated that the balance should be reduced to £1975 (they feel), Arrow have accepted partial settlement of £500.
If the decision is for the debt to be reduced to £1975, I have already paid and partially settled. If it is found to be unaffordable by the Ombudsman, I will get the £500 back and all negative information removed from my credit report so I cannot complain either way.

My partner got car finance through moneybarn in jan 2019 HP contract the car he bought was £8750 finance agreement as a whole £16000 he has paid 12 monthly payments of £335.85 mostly getting help towards the payments from family. The article above looks at his 3 options:
1) make an affordability complaint, ask for interest to be removed from the loan, and carry on making the payment while the complaint goes through Moneybarn and then the Ombudsman – which may take months
2) VT the car, handing it back, this will cap his liability at £8000 (half of the 16k total cost) and he has already paid about half of that. (A variation on this is to try to get through another year until he has paid £8000 and then hand the car back and owe nothing. Yes he will have paid a fortune to have a car for 2 years, but at least he wouldn’t owe any more.)
3) ask for a Time Order – but he has to be in arrears for that and he will need help with the court case.
What probably isn’t an option is trying to get through to the end of the contract – it doesn’t sound as though that is going to work if he is having to get so much help from family already, can he really hope to stagger through the next 3 years like this?
You haven’t said if he has other debts. Possibly a debt management plan for those would let him make the car payments earlier?
I suggest he phones National Debtline on 0808 808 4000 to talk through all his options.
If he cant’, thewn even though none of his 3 options sounds easy, he is probably better to choose one now, rather than later. His life isn’t

Hi Sara I had a car loan originally with function then it was transferred to moneybarn I paid 2500 trade in the car was 15000 total payback 27980 we signed it in 2009 and it was for 4 years we immediately strarted to struggle and they were never off phone and harassing us and threatening us to pay they even took us to court so that if we missed more payments they could repossess car we put in a complaint to them a few years back never got final response put in an affordable complaint 3 months ago they have sent final responses today and basically laughing at us saying it’s out with the time scale to complain should I escalate to ombudsman finally had to borrow money each month to pay it off finally paid off 2014

I wonder if you can help, I bought a car through VWFS 3 years ago for 55K, no affordability checks were made apart credit score which went through. Due to health reasons I stopped working, stopped paying for the car, the car was eventually repossessed.
VW are now chasing through their solicitors an 8K outstanding finance fee – even though the car was handed back. They are threatening charging order against my house :(

Were the repayments affordable at the time the loan was given, before your health problems?

The payments were a stretch at the time, but just about affordable.
Other debts all in arrangements, the solicitors representing VW are the only one’s refusing arrangement which I proposed to them to clear the debt. I am now back in work.

Putting in an affordability complaint would be one option as the article above suggests – while that is underway no court action should be started, including if your case is at The Financial Ombudsman. “Affordable” means in a sustainable basis over the lifetime of the agreement, not whether you could afford one months payment. If you were having to stretch each month and getting into debt elsewhere to make the payments, they were not affordable.
These complaints are not common at the moment and there is no way of me guessing how likely you are to win this.
If you feel the car finance was affordable, another option would be to talk to StepChange about an IVA – if that was set up the car finance could be included in it and there could not be a charging order. But it does mean you have an insolvency marker on your credit record for 6 years. I cannot guess whether an IVA is a good option for you, very often they are not. I got a moneybarn loan in June last year. Car was £5,500 and total to pay is around £9,500. I knew I would struggle but desperately needed a reliable car do room the loan. Really struggled with the payments from the start and having to use credit cards to see me through every month. Moneybarn did not do a full credit check, just a soft search through Clear Score. If they would have done a full search, they would have seen that I had a DMP (will finally be paid next year!), been taking out multiple cards and my monthly payments for everything are high (going through a relationship break up).
I’ve started to get my finances better but the high monthly payments are hurting. Do you think I have cause for a complaint and what likelihood of success would k have?

I can’t say what the chance of you winning is, but if you don’t complaint you have no chance! What you have described is well worth a try, expect it to be rejected and have to go to the ombudsman.
You need to keep paying the loan while the complaint goes through.

I purchased a car from Moneybarn in April 2014. Twelve months later my circumstance changed, I suffered from mental health and was unable to continue working full time so I switched to part time. I couldn’t afford the car so I voluntarily said I’d give it back. Moneybarn were horrid to me. They sent a chap to collect the vehicle who was very pleasant and said the car was in excellent condition and signed a form to suggest so. A month later I got a statement off Moneybarn with auction fees and repair fees for damage to the drivers door! There was no damage when I handed it over! The car sold at auction for £1600 but I was told I had to pay £6800!! I complained but heard nothing other than threatening phone calls and letters. A year later I’d been paying £20 a month but I sometimes miss payments due to a smaller wage. I only got the car based on I did huge amounts of overtime which of course I no longer do. In spring 2019 I received a letter from Moneybarn saying they’d made a mistake and I actually owe £2500. I feel if Moneybarn have admitted they’ve made a mistake it’s highly likely that the figure they have come too is still over inflated so I’ve sent this to the ombudsman as Moneybarn have sent the debt too moorcroft debt agency.
Do you think I’ve done the right thing Sara?

I did ask Moneybarn to send photos of the damaged door but they failed to reply to the recorded delivery correspondence.
At the moment I have small catalogue debts including the car which equates to less than £3000 including mortgage arrears. I’ve previously had payday loans refunded thanks to your help and at the time I purchased the vehicle I had several unpaid debts which I’ve now repaid or had written off.

Can a car finance company take back the car/cancel your finance if you make an affordability claim against them?
I took out a car loan last year and went through the only company who would lend to me. At the time I already had defaults on payday loans, an arrangement with a catalogue company and a joint loan. The monthly payment is a quarter of my take home pay. If some of the interest was removed it would make life a lot easier. I am up to date with my payments and have never missed any, but I struggle to get to the end of every month. I don’t want to give the car up as I need it for work and general transport as I live in the country and am not near transport links.

They can’t take it back if you carry on making the payments while complaint is being considered. It’s hard to say what the Ombudsman might decide if you win about the car, you can be clear you want to keep the car just need lower payments.
Ultimately you have to ask yourself if you can carry on with the current payments for the Next 3 or 4 years… that’s a very long while. Because if you know you can’t manage for that long, then you are going to lose the car anyway so yiu may as well complain now as this gives you the best chance?
Can I suggest you talk to National Debtline on 0808 808 4000 about your situation? They can help you look at other options to, eg handing back the cater after you have Paid half if at that point your credit rating will have improved and you can Get cheaper car finance for a new one.

Has anyone raised an unaffordable claim/late payment fees complaint against the car finance company (now gcc) and mallard car finance? I see some have had success with some lenders, my issue being car finance company sold up and changed to gcc, so not entirely sure gcc will acknowledge my complaint.

I have put in a complaint with TCFC (GCC).they will deny any wrongdoing and you will have to go all the way with FOS with them.I have had a complaint with FOS regarding this company for over a year and it’s now nearly complete.thw adjudicator decided in my favour but they didn’t accept decision hence why it’s with ombudsman now .hopefully it won’t take much longer

I took out car finance through motoonovo HP back in 2016 when I had outstanding payday loans and a few other debts. The car was 10.5k but with interest I’ll end up paying £15k for it, it’s only just gone into positive equity after all these years. Have I got a case? I’ve always been in full time employment on an ok wage.

It’s not the large amount of interest that matters, but whether the monthly payments were affordable for you. Have they cause you problems?

I had a car on finance over 4 years. Monthly cost £174.52 at the time i was working part time and £1600 into overdraft. Since i took the car finance i started with the payday loans. My parents had to pay my overdraft and paid me £100 off my car. I have finished paying for the car and have put in a complaint. Do you think i have a chance as it caused me alot of debt. Well the ombudsman has found in our favour regarding unaffordable car lending. The lender was Clydesdale financial services (Barclays partner finance). Very pleased. Anybody have any experience with them? Are they likely to disagree with the decision?

Do you mean the adjudicator or the ombudsman?
If you mean the adjudicator and the company disagree, it will be referred to an ombudsman for a final decision. If the ombudsman has made the final decision, it stands whether or not the company disagree with the decision.

Just began my initial complaint to Moneybarn after reading the fine they have received for miss treating customers. My agreement was terminated within the timeframe but I haven’t received any redress. I took out the loan whilst still paying payday loans to a total amount of £550 when my wages were only £1000 per month. The finance I took out cost £221 per month. My loan was terminated with a Balance of less than £10 in arrears. I thought this was harsh. I was took to court and had to pay court costs putting up the next 12 months payments to £272 putting me further in the red. I’m almost out of this nightmare with 3 payments left. I feel I could have an affordability complaint. What are your thoughts?

I think they should have checked the loan was affordable and it doesn’t sound as if they did. Send them a complaint and ask for a refund of the interest you paid plus the court costs and for the CCJ to be removed from your credit record!
And send it to the Financial Ombudsman if MB reject the complaint.

So I have received my final response from moneybarn rejecting my complaint that my loan wasn’t unnafordable.
They have written off the last outstanding balance of £425 pounds on the account. Should I go to the FO as are they trying to fob me off with a goodwill gesture?

It doesn’t sound a great offer. And if you can win your case at FOS and get the CCJ deleted, that would be good for you, so it’s not just the money.

So finally I’ve just had an email from FO and moneybarn have replied to them saying they didn’t carry out the correct checks and I will be due all interest charges and 8% interest also. Just one question when will the interest be calculated from is it from start of agreement or after final payment.
Just for anyone waiting for a response from FO it’s taken approximately 6 months for case handler to contact me but luckily it has been with an offer before it was fully investigated.

I took a car out on finance in jan 2016 and the account was fully paid up in jan 2019. I did struggle with some payments and did fall into arrears at times.
However , as my account is now fully paid could I put in an affordability complaint ?

I took out a car loan with Advantage Finance in Dec 20101, at the time I had 3 defaults on my credit file and debt of over 2k and was living inside my overdraft limit. They have stated they looked at my credit file and asked the amount I was earning before approving. No statements or other checks were done.
Needless to say, I struggled with making payments within a short period, I started going over my arranged overdraft almost monthly and ended up resorting to pay day lenders to cover the payments. I missed a payment in early 2012 and the house of cards came down mid-late 2012. I defaulted on the car payments, the payday lenders and credit cards.
I arranged for them to recover the vehicle which I believed was expressing my right to VT (I have the correspondents). I didn’t hear with Advantage finance after this until in 2018, I was getting my debts back into order when I noticed an outstanding debt of over 3k. I contacted them are they said it was outstanding despite my protests, they agreed they would accept £1000 to wipe it the debt and not take me to court. I accepted this and paid the fee to avoid an ccj.
They have refused my argument on the VT element and an irresponsible complaint. Do you think this is worth taking to the FOS?

Totally ridiculous situation with Barclays partner finance (Clydesdale). FOS found in our favour that Barclays should never have provided car finance to husband. They carried out almost no checks.
Barclays have said that if my husband is claiming their lending decision was unsuitable, the onus is on him to now provide clear details, backed by evidence, of what he’s now saying was his actual position prior to sale. [they want bank statements 12 months prior to the sale so going back to 2016].
Barclays have said that once they have this information – they will be able to advise our service as to whether or not my husband would have fulfilled their lending criteria. Isn’t this a little too late in the day. They are desperately trying to get out of taking responsibility for their poor lending.
Should they have not carried out their own affordability checks at the time of the sale? It is now almost three years since we had the car (it’s gone now).

Hi,
I recently took out a HP agreement for a car (Probably worth around £6500) but total was £9000 with a total of £15000 over 5 years. The payments are around £236 per month. After 12 days I decided that this was detrimental to my already poor credit and it was not viable. I sent a template letter from CAB website asking to cancel the agreement and I was called by the finance company (Oodle) advising this is not the same legislation for Car finance and I would still owe £9000 to the Car dealership.
Is this the case and is there anything I can do?

There are only limited reasons for cancelling a HP contract and they often don’t apply to cars, see https://www.citizensadvice.org.uk/consumer/changed-your-mind/cancel-something-being-paid-for-on-hire-purchase/ which lists them.
You can voluntarily terminate the agreement, then you would owe half, but it doesn’t sound as though that would be £9000.
I suggest you phone National Debtline on 0808 808 4000 to talk about your options for this car – have the car finance agreement in front of you when you call. And also tal about the rest of your finances as this may affect your options.

Read the “Getting a full refund” section in the Citizens Advice link I sent you – did you sign up in one of those 4 ways?
And please phone National Debtline about your options – they will tell you if you do have a right to cancel in 14 days.

I just paid of my HP agreement with moneybarn.
The car was worth 10k and I ended up paying 18k since 2014.
I really did struggle to pay over the last 2 years and asked for discount or reduction of intrest which was declined as I have to pay what I signed as per contract.
My question is since my car is now paid off can I put in a affordability complaint? Also I applied via carfinance247 who than referred me to moneybarn.

You can complain after a loan is repaid. I suggest if you want to complain you do not delay – complaints that are over six years old (from when the loan started) tend to go slower at the Ombudsman.
If the loan was unaffordable for you at the time you applied for it (not just that you ended up with problems after a few years) then send then a complaint now and send the complaint to the Ombudsman exactly on 8 weeks, even if you haven’t had a replay from Moneybarn.
Your complaint goes to the car finance lender, not any intermediate broker.

So annoyed with myself. I complained to MB and received a rejection citing that they aim their loans at people with less than perfect credit score and I knew what I was getting myself into. They didn’t ask for bank statements at the time and if they had, they would have seen that I had pay day loans and was paying into a DMP. I was going to complain to the ombudsman, but life took over and I finally sat down today to submit it, and the 6 months ran out yesterday :( They sent their response on the 18th October. I could literally cry!

My situation:
In December 2016, I applied for a car finance with 1st Stop Car Finance, through Car Finance 24/7, for £7,000. With the interest it came to £12,999. I began struggling with with the monthly payments of £264. My car insurance alone was £179.
£1200 Net income and I would be delirious if I’d £10 to my name come pay day.. Inevitably, the car was repossessed in March 2019 and I hadn’t realised I’d paid more than a third of the loan and could hand the keys back to the finance company. But I was too consumed mentally and physically to make ends meet. In the prior 6 months to the repossession.
I had 2 active CCJs (university tuition fee for the first semesters, albeit dropped out within their cooling off period) and bouts of missed payments from broadband and mobile providers; at the time of the car finance application. I’d checked my credit score beforehand and was amused that I was even provisionally approved, let alone given the loan.
I’d paid £6550 at the time of the repossession. I’ve used your template (goes without saying: Thank You!) and request SAR and all docs pertaining to my Car finance and waiting to hear back from them. What can I expect and are chances slim? what are my next steps?

If the lender rejects your complaint, send it to be looked at by the Financial Ombudsman. A lot of good cases are rejected by car finance lenders

I have received replied and they have NOT upheld my complaint. Stated that they’re subprime lender and specialise in lending to people who previously struggled. Goes on to state that my credit file was carefully reviewed and satisfactory. Which is odd because I’d an active CCJ (£2k) and five defaults est. totaled £1500+
Additionally, pointed at the fact that my two payslips preceding to the loan approval were both £1450ish (net income). Unfortunately, I had temporarily transfered to the nightshift a month before the application. Due to increased work volume (seasonal-Xmas) I was requested to change shift to assist. There was a night allowance and on top of that worked overtime (22hrs per month) on both months which gave them erroneous notion that this indeed was my monthly income (states on the payslip; Nightshift allowance & O/T 22 hrs for both months). At the time, they requested my employers nr. to confirm my employment and happily gave them my manager. But my manager informed me that they never phoned her; very odd indeed!
Gutted to be honest. I’ll give the FOB a go. Not optimistic in the slightest

Hi, I have sent a complaint of irresponsible lending to Moneybarn, just wondered what I should do next.
I had a loan with moneybarn for £4000 total payback £7950, the loan is now fully paid but it was never affordable, when I applied I had 2 and a half years of continuous missed payments on my credit report as well as defaults and a couple of ccj’s, the loan was for 36 months and I only made 9 monthly payments on time as shown on my credit report, the rest were made via a payment plan as I was in arrears from the 3rd month.
Also when I applied I had to show them 3 months of bank statements which showed over £2000 deposited to gambling sites and a water bill of nearly £3000, in hindsight I should have never applied but surely they should have never lent to me as it was clearly never affordable, my other bills have been affected and I now have more debts as a result.

Moneybarn specialise in bad credit loans, so that by itself is not a reason to decline. But it means they should be careful about affordability checks and if they have seen bank statements with gambling on them, surely they should have declined?

They have replied saying they need the full 8 weeks to investigate, but as I was going through the documents they sent me (sar request) I have seen that on my 3 month bank statement there was not only nearly £2000 in gambling but also 14 missed direct debits / standing orders, also during the loan there were 24 arrears notices, 11 default notices and 7 payment plans set up, which surely confirms this was unaffordable, how did they ever give me a loan……. The mind boggles.

Just recieved my final response, they have not upheld the complaint (surprise), they stated they performed all neccessary checks etc, but they also said they had no evidence of my gambling prior to them accepting my aplication even though it was on my bank statements, they then say they have since reviewed my bank statements and seen the gambling and that this would not have been enough to reject the application, they aslo state that over the 3 months of statements my income was £6427.65 and my expendature was £6400.49 and that means I was in credit, yet this just shows I had £27.16 spare over 3 months (the finance was £227.25 a month), this doesnt include the 14 missed d/d / standing orders including rent and water bill.
Anyway needless to say I will now refer this to the financial ombudsman and see what happens.

Just wanted to say definitely refer to the ombudsman however be prepared for a long wait. My complaint regarding unaffordable car finance went in April 2019 and was partially upheld by the adjudicator in October 2019. However as The Car Finance Company didn’t agree, it’s gone to an ombudsman for a final decision and that was in November 2019.

I have a query my partner got finance through Moneybarn on 4/1/2019 for a car sold at £8950 a capital repayment was made for £400 bringing it too the loan to £8550.00 since 4/2/2019 my partner has made payments of £336.83 per month. Moneybarn did not seek any affordability checks ie: wageslips etc even though he was working part-time and only earning about £750 a month. He has paid a total of £5373.76 and my partner asked for a settlement figure and was advised today 11/6/2020 to settle the car it would be £8361.79 to settle. Now my partner is finding it really hard to maintain this having to borrow all the time from family to cover payments as he is a carer and needs his car but he is at breaking point the car has been nothing but trouble since day 1 of getting it so its very unreliable. What can he do can you please advise.
