ICL / Money Shop Scheme ends

A first payment of 4.31p in the £ was paid in May/June 2021.

A second, much smaller payment of 0.65p in the £ is being paid on 14 or 18 January 2022.

Background to the Scheme

This “Scheme of Arrangement” covers borrowers from the ICL brand names, Money Shop, Payday UK and Payday Express, who were given unaffordable loans.

ICL had two million customers, with three big payday lending brands:

  • The Money Shop was once Britain’s largest payday lender on the high street.  The Money Shop stopped making payday loans in August last year.
  • Payday UK and Payday Express were two large online lenders. These both stopped making new loans in October 2017.

In summer 2018, the number of affordability complaints about payday loans increased significantly. Paying refunds on these complaints forced Wonga and Wageday Advance to go under.

In the last half of 2018, ICL received 45,000 complaints. So ICL wqs facing escalating costs and it was closing shops. Now the business is being closed completely because of the cost of these complaints.

A Scheme of Arrangement is a legal device which limits a company’s liability to its creditors. See What is a Scheme? for more details. ICL is using this to limit the amount it has to pay out in refunds on unaffordable lending.

The Scheme was approved by creditors in September and by the Court on 8 October 2019.

4.3% paid in May & June 2021

A claims page was published and all Claims had to be in by April 9 2020.

The Money Shop home page said:

  • We have calculated the final dividend amount and you will be receiving 4.31p per £1.
  • Where you provided us your bank details we will commence making payments from 24 May 2021.

These payments were made by BACS. People will be paid in batches, once or twice each week through to the end of June:

  • We are unable to let you know the exact date of your payment.
  • You will receive an email before we make your payment with your calculation and cash payment amount.
  • If you did not provide us with bank account details, we have sent you a cheque.

The following details come from the March 2021 Scheme report:

  • 182,566 Claims were received;
  • the uphold rate was about 85%;
  • the total compensation people should have got was c. £340 million – now people will only get a tiny amount of that back;
  • it is now too late to submit a Claim.

No tax is deducted from the amount paid so there is nothing to reclaim.

Second, smaller payment to be paid in January 2022

After the first payment ICL was still receiving some money eg from a VAT recovery claim. This is being distributed to customers who had complaints upheld in the Scheme.

This will be 0.65p in the £. That is 0.0065% of the total redress that was calculated in your case.

This second payment will be much smaller than the first. If you got £100 on May 2021, you will get about £15 extra now in January 2022.

Customers were told by email about this on 12 January. The payments will be made on the 14 and 18 of January – your email says which date you should be paid.

Only bank transfers are being made – cheques will not be sent for this.

This second payment will be the final distribution. ICL will be liquidated – the company will no longer exist.

Was your ICL debt sold to PRAC/BW Legal?

Where you still owe ICL a balance on the last loan, this has been “set off” against your refund.

An example:

  • you should have had a refund of £2500 and you still owed £1000
  • then your balance is cleared, leaving you now being owed a refund of £1500
  • you then get 4.3% of the £1500

If your last loan was sold to a debt collector, in most cases ICL has arranged for you to still have this set off.

The exception is if your loan was sold to PRAC/BW Legal. Here you have been left owing the debt to PRAC/BW Legal and were only paid 4.3% on the redress ICL calculated.

PRAC/BW Legal is offering to reduce some customers’ balances, but see No set off in a Scheme/Administration when debt had been sold? for how you can complain and ask them to write off your whole balance.

5% in all – that is a very poor outcome for customers

When the Scheme was proposed in August 2019, it was suggested people might get back nearly 80p in the pound.

My first thought when I saw the 80p in the £ estimate was “and pigs might fly“… see Will the Money Shop really pay 80% of your payday loan refund?

And that has turned out to be spot on…

In September it admitted that:

  • it has decided to include all loans over 6 years which may reduce this to c. 44p.
  • it has decided to simplify the assessment in favour of the customers, which may further reduce this to 27p.
  • if twice as many people apply for a refund, this may go down to 14p.

By February 2020 in the previous quarterly report, the scheme administrators were warning this could be less than 10p.

So about 5% (4.3p + 0.65p)  is a dismal outcome for customers.

Why won’t the FSCS help these customers?

The Financial Services Compensation Scheme (FSCS) covered people making PPI claims if their firm had gone bust.

But the FSCS doesn’t cover payday loans. This was a very poor decision by the FCA.

Customers of the Money Shop, Payday UK and Payday Express have been let down badly by the UK regulators. The lenders were allowed to carry on giving loans that breached the affordability rules for years. And now there is no backup compensation scheme for when a lender goes under.

      So been patiently waiting on an email but alas nothing. Arrived home from work to a letter dated 8th with details of my redress and advised it will be paid within 7 days so am guessing will be 7 days from letter date? For those waiting for an email watch out for a letter instead. No idea why posted mind you

      You should do my work colleague had his email last week and he’s been paid into his account today. I’ve yet to receive my email but I’m just being patient as it looks like most are getting the verification as the days go by. Congratulations to all that have been paid so far. I mean it wasn’t in our favour to receive all that was due to us but like I mentioned to my friend who got his. Something is better than nothing. No matter how small. We just got to be humble on this one I think.

    I had my email last Thursday and got my redress £164 on Tuesday. I have just had another email from them telling me I am getting £23 within 7 days. No idea what it is for and why it wasn’t dealt with as one complaint. Thank you Money Shop, I will happily accept your additional payment!

        Hi Sara

        Just read my second email properly and it relates to a debt sold to PRAC, never heard of them and had no idea they sold on any part of the debt but I am not complaining about an extra £23.
        I also emailed Lending Stream and just had an email from them saying they dealt with my complaint in 2019 so wouldn’t revisit it. They sent me the response email and it wasn’t addressed to me, looks like a 3rd party complained on my behalf but I don’t recall instructing anyone or being told they rejected my complaint. Can I take this further as I don’t agree with their decision but it was made 2 years ago.

          I think you need to check with PRAC if they do have a debt in your name. You can then complaint to them: https://debtcamel.co.uk/no-set-off-scheme-administration-debt-sold/.

          This is best not ignored as PRAC/ BW Legal can be very litigious :(

            Hi Sara
            Received an email from PRAC today saying ICL email was generic and misleading by saying I did have a debt with them, they said it should have said I may have a debt with them and having checked their records they confirm I have no outstanding debt with them.
            Not sure if anyone else had the same email, not read newer posts.

            Yes several other people had this email from PRAC yesterday. In that case you don’t need to worry about the mythical loan! But I suggest you do keep the PRAC email, don’t delete it.

      A real insult to injury! Was totally (DUMBFOUNDED ) when i read my email saying that i will be receiving £8.86. Waiting all this time for a lousy few pence,unbelievable!!!

      It’s amazing how much they got away with I went through emails I’m still waiting but back in 2017 I put in a claim they denied they owed me anything but as soon as went bust admitted they owed me just under £400 so I assume I’ll be getting about 15 quid it’s a insult this stuff needs looking in to as it’s happening to often now it’s starting with guaranter loans as well look at amigo there mis sold custeomers will be screwed to

            Anyone who is happy to speak to journalists and have their name and photo in newspapers? That is what it takes to get coverage in the media I am afraid.

            Writing to your MP is much more likely to make a difference than signing any petition.

            Everyone can email Mel Stride MP (mel.stride.mp@parliament.uk) who is chair of the treasury select committee and copy it to their MP. Say how disgusted you are by the 4.3% payout and how you have have been let down by the FCA – point out that if a PPI firm went under, people got their full PPI refunds from the Finacial Services Compensation Scheme (FSCS) but the FCA decided that this should not apply when a lender went bust, so there is
            no help for you. Also point out the problems only occurred because first the OFT then the FCA failed to enforce their own rules – they allowed firms like ICL to carry on handing out loans with little or no checks on affordability. Ask for the Treasury Committee to look into this.

            You can also complain to the FCA – not about ICL but that the FCA itself has let you down. I don’t know how this would go, but if you don’t try, you will never find out. See https://www.fca.org.uk/about/complain-about-regulators.

It’s getting more disappointing each day, I’m obviously glad that other’s are getting their payouts just wish mine would come through as well!     Hi can sum1 tell me please how do they work out ur redress is it just the interest u have paid or do they also add interest onto that aswell so u get more, i paid £1,058 interest on 22 loans with lending stream if the do except all my claim which i know they wont would i get all my interest i paid back or would i be looking at more thank u

    received my emailed amount through via email yesterday evening but just my luck as have this week been approved for an IVA so HSBC has frozen my nominated account to all but deposits … So HSBC get my amount but fair enough and worth it to sleep at night again – never again playing pay day loan game !           Can I suggest you talk urgently to National Debtline. From the end of June the criteria for Debt Relief Orders is changing – if National Debtline assess your “spare income” at under £75 9which is possible if your IVA firm thinks it is £104) then you may be able to get a DRO – that costs £90 up front, then there are NO monthly payments and your debts are wiped out after a year. It has exactly the same bad effect on your credit record as an IVA.

          It may be best to let your IVA fail straight away and get a DRO…

          See https://debtcamel.co.uk/debt-options/dro/ for more about DROs. You may be happy your IVA has gone through but if you qualify for a DRO it is a MASSIVELY better options. A very large number of IVA fail (over 25%) which IVA firms don’t tell you.

    Sara, I wonder if you could advise.

    I had two debts (one PDE and one PDUK) sold to PRAC in 2017 – I haven’t made payments on them afaik (they have restarted sending me emails asking me to log into my account, but I am reluctant to do that at this stage) and they aren’t showing anywhere on my credit record.

    Moneyshop today have told me that I will receive £127.30 out of a redress payment calculated at £2953.53, and that PRAC will be in touch within 14 days. According to PRAC, I owe them £2399.15 for the two debts they bought.

    I was thinking I can offer them the redress I receive – which is on these two loans: but do you think they would accept it as full and final payment? As I say, these aren’t currently on my credit record in any way, shape or form – but I worry they will be more insistent following Moneyshop’s contact, and I don’t think they’ll go away until they are statute barred.

    Got email last Thursday 3rd June, still no money paid to me though! Has anyone else had this problem. Have emailed them and now they have stated it was paid on Monday 7th and today is 4 working days and still nothing makes me think I will not be getting it at all. No one answers when you try to call and 1 email in the space of a week absolute joke!

    I have been sent a cheque as I didn’t send my bank details, however the machine at the bank wouldn’t take the cheque.. my son took it for me and didn’t have time to talk to a cashier… he did try 4 times as he was on the phone to me whilst doing it so I know he had made the numerous attempts… what I would like to know is, has anyone else been paid by cheque ? And was it accepted by your bank and in your account?

      Seems very odd but it could have been a machine fault. Best to just present it to a cashier inside your bank.

      Not sure as it was my so that took it in .. he only tried the deposit machine so I will go in and try the cashier and see what they say.. the cheque does look a little dodgy though.. so that’s why I was asking if anyone else has had a problem.

        You can deposit cheques using mobile banking app by taking a picture and uploading it to them, only takes about 2/3 days to clear

      Banks changed a couple of years ago, you are no longer allowed to pay money into someone else’s account. New fraud rules, so this is probably why your son wasn’t able to do it for you

    Hi everyone,
    I just wanted to let you all know that I received my payment today and was taken completely by surprise as I didn’t get an email first.
    I logged into my internet banking and noticed a payment had gone in.
    I am happy to have received a payment, but ultimately the whole thing has been very unorganised and I get the sense that there is no consistency with how they are processing payments.
    Anyway, for all the people that haven’t heard anything yet, try not to worry. And maybe bear in mind some of you might not receive an email like me, and you’ll just randomly find a payment has gone into your bank account.

      I got £60 put into my account today and it doesn’t show who sent it or from where. My redress was £6001.11 so working it out off the top of my head I stand to get back around £240 or there about. But like you mentioned I didn’t get no email about anything and it’s baffling me as to where it’s come from. Has anyone got a number that I could call them on to enquire about this to check weather it was them that deposited the £60.

        That sounds very odd to me. I thought all bank statements show who has made a payment into your account. You don’t see any letters or anything at all next to the payment then?

          Nothing at all it doesn’t even show a payment being placed. But I know I had around £75 in this account the day before because I withdrew some money whilst I was at work but the next day when I checked to take some more out and to see if my refund had been sent back to me I realised I had an extra £60 in the account. 😲. Spooky I mean I’m not complaining but it’s just really weird. But will enquire with my bank later today about it.

        The payment should say Instant Cash Loans if its from these guys. I’d advise checking with your bank as they should be able to shed some light on who has deposited the money into your account.

          Yes I’ll give them a call later this afternoon as it’s puzzling me. I know I’m due a refund from a purchase I made online but the numbers don’t add up but I’ll definitely give my bank a shout and see what’s happened there.

    I hadn’t heard anything since I accepted their potential redress and read the letter on the portal last year

    Didn’t receive any emails or comms with updates or portal closing notification but……Thursday 10th June I finally received an email at 12:32 confirming my redress amount. The £15379 would have been very nice but I’ll happily take the £662 due in the next 7 days!

    Yes I was in payday loan hell for 4 years it all started with PaydayUK and at any given point I would have had 12 different loans and lenders. Yes it was my own doing but once your in it your trapped! So I’m just glad I can start finally closing this horrific spell and regardless of how much we all get (it will never be enough considering how much we paid) but then it’s better than nothing and a way forward.

    Hang in there everyone I didn’t have any comms or updates and honestly thought I would be forgotten about but fingers crossed it all comes through for everyone!

    Well. I have received a letter today with my payment & yes I’m very disappointed. Out of my potential redress which was £1624.27, I received £70!
    Is this actually right Sara?

      yes, that is 4.31% of the amount you should have got if your claim had been assessed before they set up this Scheme of Arrangment.

    I’m still waiting for my email, but that’s ok, I’m good at playing the waiting game. It has made me think about where I was and where I am now though. I got into a really bad cycle of payday loans, getting one to pay off another and I got to the point where I thought, no more. So eventually decided to do something about it. I lived a very paultry life for several years, and was in the lucky position to do some overtime and bit by bit paid off every last loan. I’ve got one default on my credit file and that will come off in August. No loans for over 2 years and I’m building a healthy savings account by adding each month. The cycle is so easy to get in to and so difficult to get out of. I take my share of responsibility of course, but it was irresponsible lending without doubt. I made a claim against quick quid and the FOS took so long, but was told I’d receive 2,500, but they went bust a week after me being awarded this amount, so got nothing. These lenders took advantage of people, and it’s good to see them closing one at a time. I’m lucky, but know lots of others still face hardship.

    Worked out form my redress amount being paid 4.31p in the £. I will get the grand total of £30. twas not worth my time and energies waiting and anticipating a big payback from these ruthless “humans” that run these companies.

    Hi Sara
    I am on a DMP and one of my creditors is ICL who passed my debt to Credit Resource Solutions a while ago. When all this redress started I thought they would offset this loan and at first so did CRS. I emailed for a settlement but they said they were not dealing with my debt and to speak to their client ICL. After a lot of emails with the Finance Bod at ICL they said this particular loan was missed because of a possible staff error (not matching the name snd address etc) and I still hsve to repay the debt as the deadline had passed for disputing such things. . They also said they wont accept anything less than 70% of the current balance. which is only £103 currently but it’s still a lot of money to me. I never knew this debt was missed and am quite mad about it. CRS are vile to deal with and the woman at ICL just isnt interested anymore. Its their mistake not mine. Do you think I should complain further and if so to whom? If the debt was passed to CRS as well how can ICL still be their client. Surely I am the problem of CRS not ICL? Thank you in advance x

      CRS has not purchased your debt, they are simply collecting on behalf of ICL.

      I think you should again email ICL and ask them to use their discretion in writing off this debt because of the possible staff error (give details about that).

      What is the rest of your financial situation like at the moment?

        Hi Sara, I have asked them a few times but they just ignore the request. My DMP finishes next October but I want to hopefully cut that if and where I can. It will be 7 years next year and Ive seriously had enough of being in debt. Ive managed to clear a couple of the smaller debts by offering settlements and ICL was the next on my list of creditors. I will go back to them again and see where I get this time but Im not hopeful as they are just interested in issuing the redress amounts. What I dont understand fully is if ICL are in administration does that mean they wont exist after all the redresses have been issued etc and if they havent sold my debt, how can I still be repaying them another 12 months plus down the line if they will no longer exist. Does that make sense?

          I suggest asking again. Put COMPLAINT as the subject and be clear you are asking them to use their discretion. Ask for a response to your request.
          (In saying this, I am taking your word that they have admitted there may have been an error by them.)

          If they won’t budge, then just leave the debt in your DMP. Use your money to try to settle people offering a more reasonable discount.

          At the end of this process, ICL has to either sell the remaining debts or just stop collecting them. If it can’t get a reasonable offer for the debts from a debt collector, it may do what Wonga did which was offer people a low F&F offer – Wonga’s was 20%. This may not happen with ICL of it may not be as generous, but I wouldn’t rush to pay the 70% they have suggested…

    Just ad my moneyshop letter basically £56 off a £1400 redress. Disgusting. Also through resolver ad communication from Amigo asking fill in a questionnaire re y I voted against the scheme. Surprisingly on last page, error can’t send.

      I had an email saying as I had a Scottish protected trust deed I need to show them that it’s finished it was 8 years ago and I don’t have any of the paperwork surely they have information of this

    How can i work this out myself as a calculation is it divide the potential maximum amount by the 4.31p?

    All as I thought redress over 7k and cash refund of £333.
    Thought I’d be waiting til the end of the month.

        These are being made in batches. There is still a couple of weeks before the end of the month and it’s not something to be worried about that you haven’t yet had an email about this.

    Good morning everyone,

    I have already received a small payment from ICL and I am due another one for approximately £280.00. My brother passed away June 2nd and his funeral is June 23rd. The £280 would enable me to get across the country to attend.

    I do hope that either today or tomorrow I receive “the” email telling me that I will get the money by this coming weekend. It would mean a great deal to me to be able to say my last farewell to my brother.

    Never, in a million years, would I have thought that this is what I would need the money for.

    I do apologise for posting this message and hope that I am forgiven by all who read it.

      Don’t apologise hun. It’s been a tumultuous year for a lot of people with what’s going on in the world, and my heart goes out to you and your family. God willing you will get the news your payment is on the way soon. I too am still waiting for mine but I’m not overthinking about it as it will drive you crazy. As others have received their emails today surely others are on the way too it’s just the luck of the draw I guess.     i received my email on3/6 to say payment wothin 7days i didnt recieve the payment but an email to say i needed to upate my bank details last wednesday i sent them over (which im sure they are the same as the ones i inputed on the portal but anyway) today i emailed to ask for confirmirmation they had been undated, i received confirmation an hour later.
    I then asked for an update on my payment an received this..

      No it’s not. ICL are not paying any money to BW Legal.

      If you hadn’t paid BW Legal, you could now have complained and asked for the right of set off (see https://debtcamel.co.uk/no-set-off-scheme-administration-debt-sold/) but as the BW debt has been repaid you can no longer do this.

    Can I complain about the CCJ I received on my credit report due to owing Instant cash loans? I am still receiving emails from BW Legal. I have been paying this back but I’m wondering if i can complain about it now and who i would contact.

    Finally received my email today, thanks for all the info and updates Sara. After reading advice and templates on here about refunds I made an affordability complaint with cash converters, they were really fast and received £2,600 in my bank within a week of sending my first email. Do you know if safetynet credit usually take the full 8 weeks? Thanks you

      Good afternoon

      Safetney net usually take about 5-6 weeks, as I have had 2 claims from them upheld. After you received the email of your upheld claim the money usually goes into your nominated account 1-2 days later. Hope that helps.

      Should be Wednesday I’m guessing as I believe they do Thursday and Fridays emails to be processed the following Monday by bacs to hit your account on Wednesday

    I got my letter on Friday, and presumably payment will be in the next week as stated. I would have received 5 grand, but ended up with £215. A huge differential. For me, it’s a bonus (I’d long forgotten about these loans), but I do feel desperately sorry for you who need the money and are ending up with very little due to the incompetence of regulatory bodies.

        Hahahaha that made me chuckle drew thanks for that much needed. I too haven’t received my email yet but like Sara said we have just got to be patient. It’s the 2nd week in the month and we have until the end of the month to either receive the email and payment. So with that logic in mind it stands that at the very latest all of us who have not yet received any communication from them yet should get some form of correspondence either this week or any day next week. Don’t make sense in constantly emailing or calling them as it just builds your anxiety levels up and your constantly refreshing your emails to see if you’ve received it yet lol. Just relax open a nice cool beverage on ice and listen to chill radio for a bit. It’s really therapeutic. 😉. But stay positive guys our times will come soon.
