Amigo Scheme – final payment of 6.01% will be paid in April 2025

 

Amigo announces the final payments in its SchemeUPDATE

March 2025 – final scheme payment announced

Amigo has announced the last percentage payment will be 6.01%. Together with the first percentage payment, this takes the total up to 18.51%.

The amount you will receive will be a bit less than half the previous percentage payment you received. (If you have received 2 payments, the one from Amigo Loans was an “in full” refund for payments you made to Amigo after May 2022, and the one from ALL Scheme was the first percentage payment.)

These payments will be made in the next 3 weeks in batches. They will be paid in order of the date of the Amigo Decision email you were sent.

Mid August 2024

And the deadlines have slipped yet again. There are just under 4,000 people still waiting for a decision, or a revised decision after winning an appeal, or a recalculation.

There are also now (21 August), about 8,000 people where Amigo has wrong or missing bank details:

  • this includes £1.7m of redress to be paid “in full”, and
  • £2.4m of Initial Scheme Payments.

Most of these are people with loans taken out longer ago, so their contact details may be out of date too. And some people are worried the emails or texts they are getting about updating their bank details are a scam.

If you haven’t already been paid, check the bank account details on your Portal Account.

If these amounts are not paid by the time the second payment is made later in the year, you can’t get paid afterwards as all the money will have been distributed.

24 June 2024 – my overview:

  1. People who have not yet had a first decision email (FRL) If you haven’t had a recent communications from Amigo apologising for the delay you should contact Amigo urgently.
  2. People who have escalated a decision No-one has yet had a revised decision after winning an appeal.
  3. People whose defaulted loans were sold to Intrum before 2022 It isn’t clear whether cash refunds will be paid by Intrum or Amigo.
  4. People who are waiting for a “full refund” to be paid Some dates seem to have not been paid. Some people are still waiting for recalculations of the 8% interest and any recent payments.
  5. People who are waiting for the first percentage payment to be paid Some dates seem to have not been paid here as well. Some recalculations seem to be being done – I don’t know why unless Amigo messed up the numbers the first time!
  6. People who have been paid the first percentage payment (and any full refund) and are now waiting for the second one
    Nothing will happen until the end of the 2024.

29 May 2024 – first scheme payment will be 12.5p in the £

  • Amigo says “substantially all” claims have been determined and adjudicated – 99.2%
  • it knows enough to be sure it can pay 12.5p in the £ so that is what it has set the Initial Scheme Payment Percentage at.
  • you will get 12.5% of the amount on your Amigo email decision labelled Total Cash Claim Value or Scheme Cash Claim
  • you will be paid this first amount within the next 30 days, or within 30 days of receiving an accepted Scheme Outcome, whichever is later
  • Amigo says it will prioritise payments based on correct bank details being provided and age of the Outcome Letter issued (oldest to newest).
  • Amigo is still saying at least 17% for the total amount to be paid, so that means 4.5p in the £ will be paid late in the year

10 April 2024 – 94% of decisions issued

  • nearly a month late, Amigo still hasn’t quite reached the target of 95% of decisions it is said it would achieve by mid March
  • it now expects to have issued over 98% decisions by the end of April, with the rest coming in early May

14th March 2024 – Amigo gives a payment timetable

Decisions:

  • Amigo has now crawled up to 91% of decisions issued.
  • they now say they expect to issue 95% of all decisions 22 March 2024, with the remainder being issued by mid-April 2024.

“In full” payments

  • payments have started for the “In full” refunds;
  • where a decision was issued on or before 1 February and you do not have a live loan, your payment should be made by the end of March
  • where a decision was issued on or before 1 February and you do have a live loan with a balance outstanding, your payment should be made by the end of April
  • where a decision was issued after 1 February, your payment should be made between mid April and end May

“Percentage” payments

  • it still expects to be paying at least 17p in the pound to people expecting to get the “percentage” refunds
  • it has rowed back from saying it expects the first instalment of the percentage payments to be made in April or May. It now says that it expects to “declare an interim dividend” in April or May – that is the percentage that it will pay as the first instalment, eg 10% or 12% say. And it expects payments of the first instalment to be within 30 days of making that statement about the amount.
  • so they could be in June…

27 February 2024 – another delay to decisions & payments

  • Amigo has still only got up to 88% of decisions issued
  • it now hopes to have issued over 95% of decisions by mid-March 2024, with the rest being issued in early April
  • Amigo expects to start paying the “in full” refund amounts at the end of February, but these will be done in batches so not everyone will get theirs then
  • the payment of the first installment of the “percentage payments”  has been put back to April or May with the final installment about 6 months later.

A reminder of who may get some “in full” refunds:

You have to have repaid at least the amount you borrowed.

From that point, you may get a full refund, not at 17%, depending on the date of your complaint/claim:

  • you will get a full refund of payments made after 1 December 2021, if you had complained before that date;
  • you will get a refund from the date you complained if that was between 1 December 2021 and 26 May 2022;
  • you will get a full refund of payments after 26 May 2022, if your first complaint was in the Scheme.
Amigo refunds & taxation

1) only the statutory 8% interest added is taxable. Not the interest paid that is being refunded – that is your own money that you are getting back.

2) the statutory 8% interest added is taxable as savings. BUT everyone has a Tax free savings amount of £1000 for basic rate taxpayers and £500 for higher rate tax payers in a year.

3) Amigo will deduct interest from the 8% part where you are being refunded money “in full” – these are being described as “set off refunds” in the decision you get. If the 8% on this “in full” part is more then £1000 (for a basic rate tax payer) then Amigo will be deducting too much interest… and you should be able to make a claim to HMRC for a refund. 4) in previous administrations & schemes, I don’t recall anyone having tax deducted from the 8% part which is paid out as a percentage, expected to be 17%. If this happens, Amigo will have to inform you of the amount of tax deducted and you may be able to claim some of that back from HMRC.

January 2024 

  • on 25 January Amigo admitted it has only sent out 75% of decisions.  This is only 2% more than on 9 January.
  • it says “We anticipated that all responses would be issued by the end of January 2024, however, the remaining work and complexities in assessing and calculating certain claims, especially for some claimants with outstanding loan balances, has taken longer than initially anticipated. Although responses are still being issued, and will continue to be, our intention is to issue all responses by mid-March 2024.”

December 2023

  • the Amigo scheme page now says they have issued 71% of decisions
  • Amigo has told some people with current loans to stop paying
  • decisions for current loans are being sent out but not many so far
  • if you have made recent payments, some may be refunded in full. In the decision you are sent, these are being called “set off refunds”. The “total cash claim value” on the decision is the amount that will be paid at a reduced percentage, expected to be about 17%.
November 2023
  • Amigo has issued 45% of decisions
  • Amigo has been deleting a lot of loans from all three credit reference agencies . If your loans have been cleared, this is probably because your claim will be upheld. But this isn’t definite until you get the claim decision.

October 2023

  • Amigo has issued 38% of decisions. It says almost all the rest should be issued by the end of December and they will all be issued by end January
  • the process to remove CCJs will continue to March
  • Amigo is confident the payout percentage will not be less than 17%
  • it is now clear that Amigo not going to pay many borrowers where the loan has been upheld as unaffordable but the guarantor made some payments. This is ethically wrong and entirely unexpected – redress from mis-sold guarantor loans has never been handled like, by Amigo before the Scheme or by the ombudsman. You can appeal but it isn’t clear that this will succeed.
  • the best estimate of the percentage payout is still at 17% but this can still change.
  • Amigo now says: “We expect that the initial cash payment to customers will be in early 2024. We are unable to confirm the dividend and make interim payments until almost all claims have been decisioned in full, causing the delay from November, as previously expected. The final payment will be delayed until late 2024 (around the time that the business enters liquidation).”

September 2023

  • the first rejections for current loans are going out.  If this loan has caused you problems, appeal a rejection. 

August 2023

  • the first UPHOLD decisions are at long last being issued
  • if only some of your loans have been upheld, look at an appeal. The first person has reported winning an appeal.
  • some loans have been sold to Lantern. In most cases these are loans where neither the borrower or the guarantor made a claim.

March 2023

  • Amigo has announced it cannot raise the money from shareholders so Amigo Loans will be liquidated. the Scheme continues in “Fallback Mode”
  • Without the £15m from creditors, there will now be less money available for cash refunds.
  •  

    When the Scheme was proposed in early 2021, Amigo said it expected people would get paid 41p in the £. So if the refund on your Amigo loans was calculated at £1000, that suggested you would get £410.

    That never looked likely to me. Amigo always refused to say how it calculated the number and, crucially, how many complaints it expected to receive.

    So I wasn’t surprised when the November Scheme Supervisor’s Report said that 210,000 claims had been received and that this was a lot more than Amigo had expected. With more claims and the same amount of money to divide, the estimate of refunds had halved to 20p in the £.

    That November report also contained a new estimate of what may be paid in the Fallback option – 17p in the £. This is the best indication we have of what may now be paid out.

  • it is now expected that Amigo the first payments may be made in late 2023 and there may be a second, smaller payment in 2024.

December 2023

  • The deadline for making claims to the Amigo Scheme was 26 November 2022. It is now too late to make a claim.

Amigo’s Scheme – the background

Amigo’s Scheme of Arrangement is now in operation after it was approved by the court on 23 May 2022.

The Scheme was proposed because Amigo couldn’t afford to carry on paying full refunds to its borrowers and guarantors who were winning affordability complaints.

Amigo had proposed a different Scheme in 2020 that was rejected in 2021. Amigo has now spent nearly a year getting its current Scheme proposed. In the Scheme, Amigo makes the decision about whether your claim should be upheld. If it is rejected or only upheld for some of your loans, you can appeal this decision to the Independent Scheme Adjudicator. You cannot appeal to the Financial Ombudsman.

Which loans and customers are covered by the Scheme?

All loans made by Amigo before 2021, including those under its previous brand name FLM, are included in the Scheme. For loans that were settled more than seven years ago, Amigo may no longer have the loan details.

Both borrowers and guarantors could make a claim to the Scheme.

The definition of “unaffordable”

A loan is only “affordable” if at the time the loan was given, it was likely that you could repay it on time and still be able to pay your other debts, bills and everyday living expenses.

If paying Amigo left you so short of money you had to borrow more or you got behind with bills then it was “unaffordable”. This often happened with Amigo loans as many borrowers were desperate to try to protect their guarantor.

Amigo should have checked that a loan would be affordable for both the borrower and the guarantor. For a guarantor, this would mean that they could make all the repayments out of their income and still be able to pay their own debts, bills and living costs. A guarantor who had a house may not have had enough spare income to repay the loan so it was unaffordable.

But Amigo’s affordability checks were very poor. That’s why they were losing 88% of cases at the Financial Ombudsman.

Amigo often offered top up loans and the checks on these weren’t any better, even though people were getting deeper into debt. Repaying the first Amigo loan may have left you in financial difficulty, so a top up loan may have appeared to be a good option, even though it made your debt situation worse.

What will you get if you win the claim?

When Amigo upholds a claim, it will tell you what the “redress” calculated is. You will only get paid a percentage of this, not the full amount (unless some of your payments are very recent).

Redress for a borrower who has a claim upheld

For a borrower with a repaid loan, redress will be:

  • a refund of the interest they paid on the loan;
  • plus 8% statutory interest;
  • Amigo is making a deduction if your guarantor made any payments. If your guarantor has also made a claim, they should be refunded. If they haven’t then no one is being refunded for these amounts.

For a borrower with a current loan, redress will be:

  • a refund of any interest if they have repaid more than the amount borrowed plus 8% statutory interest, otherwise, their balance will be reduced;
  • their guarantor will be released;
  • if there is still a balance after the reduction, you can make a lower affordable payment arrangement to clear it.

In addition, any problems on your credit record will be removed for loans that are upheld. This will include having any CCJ removed (the legal term is set aside) and removing the default showing on the debt with Intrum if your debt was sold.

Redress for a guarantor who has a claim upheld

A guarantor’s redress is the full amount they have paid to a loan, not just the interest, plus 8% statutory interest. And if there is a current loan, they will be released as guarantor.

Previously it had been expected that guarantors would be refunded if a borrower won a claim that the loan was unaffordable even if the guarantor had not made a claim. It has now become clear that Amigo is reducing the payments to the borrower and refusing to pay the guarantor where the guarantor has not claimed.

8% statutory interest

This number is NOT 8% of the interest you should get refunded. It is 8% per year from the time of the repayments until 28 February 2022. So if your loan was settled several years before 2022, you may get 20% or more added.

BUT you will only get a % of this redress

That redress figure may look great. But you are not going to be paid that amount, just a percentage of it.

Amigo originally estimated that at 41p in the £. If your full redress is say £3,000 that would have meant you will be paid 41% of that – £1,230. But a lot more people made claims than Amigo expected – 210,000. That has reduced the amount you might get to 20p in the £.

And with the March 2023 announcement that Amigo has failed to raise the money from shareholders, there will be less cash to be refunded. The amount is now expected to be about 17p in the £.

So from a calculated redress of £3,000 you may get £510.

Exception – full refund for “continuing payments”

Some customers will get a “full refund” of certain payments they made to the loan provided that they have repaid at least the amount they borrowed and their claim is upheld. These customers are due a full refund of payments:

  • from 1 December 2021, if they had complained on or before that date;
  • from the date they complained, if that was between 1 December 2021 and 26 May 2022; or
  • from 26 May 2022, if they did not complain before the Scheme started.

This is set out in full in 6.33 of the Explanatory Statement.

The purpose of this is so that if your claim results in a refund, payments you made after the relevant date will be refunded in full provided that you have repaid more than the amount you borrowed.  For a guarantor getting a refund, the “repaid more than you borrowed” test does not apply.

Here are three borrower examples:

  • a borrower who made a complaint in March 2021 (so before 1 December 2021) and who at 1 December 2021 had already paid back more than they had borrowed will get a full refund of payments they made after 1 December 2021
  • a borrower who made a complaint in March 2022 (so after 1 December 2021) and who in March 2022 had already paid back more than they had borrowed will get a full refund of payments they made after that date
  • a borrower who made a claim to the Scheme in September 2022 (so after the Scheme had started) who by 26 May 2022 had already paid back more than they had borrowed, will get a full refund of payments they made after 26 May 2022.

Sale of loans to Lantern

Many remaining loans have now been sold to Lantern.

The loans are being sold as guarantor loans – the guarantor has not been released and if the borrower doesn’t make an arrangement to pay the guarantor will probably be asked to.

        Same here. Waiting for nearly 3k, which although at the start of the year I had no realistic expectation of timescale, knowing it COULD be any day is torture. Everyone on here has/had financial issues, hence using Amigo and not a bank etc… so it must be rubbish for everyone knowing they may or may not get money that helps our situations, just waiting for someone to click a button.

        Hopefully over the coming days, we see a lot more happy stories of people getting their money.

        Can you please help i have had my claim upheld i first complained in 2020 i have had several loans since 2014 -2020 all were fully repaid by 2020 do i get pence in the pound or full refund // Claim Outcome: Upheld Total Cash Claim Value = £16358.62

      It will be random. This is not an odd choice by Amigo – I have seen about 10 major administrations / schemes go through and everyone one of them has allocated people to payment batches at random

    Hi Sarah
    I hope all is well,
    I have a claim in the scheme I’m yet to receive my out come letter I was wondering if I still have a balance on my loan but I have payed back all what I borrowed and the rest is interest does that mean if my loan is upheld I won’t have to pay the rest back and any amount I payed over what i borrowed and it’s within one of the requirement, time frame set by amigo will I them payments back in full?

      If you have already repaid more than you borrowed then the balance will be cleared if the claim is upheld.

      The extra amount you paid will be refunded, in full for recent payments (rules in the article above) or at about 17% otherwise

    Hi can anyone help me with this had a loan upheld amigo letter says that the loan was taken out for 4.000 pounds on the 6/6/2013 it is a gaentor loan amigo have been in touch and said total paid £8.353 £3923.19 comp total case claim£12 276 57 plus 8% comp l can’t understand it would anyone explain please l think it might be a refund of £500

      Same! I emailed them to complain about how long it’s taking given I put my original complaint in to the fos in 2020 and I’ve literally just been ignored 😂

    Not had my outcome e mail yet I borrowed 6500 in June 2019 paying 256.91 per month I had to reduce payments down to 100 a month in 2021 can I expect full refund of the 2900 that I paid over the loan amount or will they deduct money off for me reducing my payments

      Assuming your claim is upheld, Your balance will be cleared and the amount you paid over the 6500 will be refunded. Some will be “in full” ans some may be at 17%, it depends when you had finished repaying the 6500 borrowed nd when you made your claim.

      You will get a PERCENTAGE, currently expected to be about 17%, of the Total Cash Claim Value of £5203, so roughly £850

      This will be paid in two instalments. Amigo hopes to make the first instalment which will be larger in April or May, the second one will be towards the end of the year,

    Just to say, I received this as a reason to delays. Getting quite fed up now.

    I’m still waiting for my response. Initial complaint made March 2020 and FOS agreed that all loans were unaffordable however as per many of you my complaint was then put on hold and pushed into the ‘scheme’ before I recieved any update from Amigo or payment.

    Feeling frustrated this morning I called Amigo and spoke to a less than helpful gentleman who gave the usual chat to be told I would have response by mid March hmmm. Upon asking in he could check the status he then advised it had been reviewed and awaiting my calculations but I would have response by the end of May to which I challenged and asked why he had just said mid March? He sounded as though he had confused himself and then said definitely by the end of April. I ended the call more frustrated than I was before and even more confused on when the last 15% of us will receive a response ad apparently they’re 85% complete (although I’m not sure if that’s true).

      I’m the same, Kelly. I am incredibly frustrated now. My claims were all upheld my FOS and relentless emails and calls to amigo – from fos – to get them to pay. And yet, we’re the last. They should pay out ours in full.

      I got told mid-March, which would be this week, so I’m not expecting it.

        I’m in the same boat as you guys it’s soul destroying really isn’t it. I received an email today stating they expect to have decided on 95% of claims by mid march and the rest will be done by early April. They said if I’m struggling mentally or financially to contact Samaritans or step change 🙄 you couldn’t make it up could you.

            Well I’ve just checked my credit report and my first amigo loan (which they already upheld in 2021 before the scheme but did nothing to action any redress) has gone! Hoping this is a good sign I’ll let you know if anything else changes.
            Closed loan number 2 which they upheld but also did nothing about, and the open loan with a balance on which they didn’t uphold is still there.

    Had such a strange response from Amigo about my claim. I explained my guarantor had received their outcome and when can I expect mine and they said: ‘We have a number of accounts, like yours, that relate to older data, that are struggling to progress through our systems and need their data cleansed and refreshed before we’re able to confirm their outcome and issue their response. We’re actively working to fix these and hope to have this completed soon.‘

    Is this just corporate nonsense speak?

    Received the below from Amigo when chasing on an update on payments in full. Just the same old usual generic response:

    Thank you for your email.

    We have started making full refunds of loan payments made by customers to Amigo, either before (in certain circumstances) or after the Scheme Effective Date (26 May 2022) and where their Scheme Claim has been upheld, however, I am unable to confirm when yours will be paid. This is a manual process so this will take several weeks to execute all redress payments for customers so please be patient during this time. As soon as there is an update on your individual payment, you will be the first to know.

      Is there a box at the bottom of the email which has a line that says Total Refund Value (1+2+3 minus 4)?
      Or is there a balance being written off?

    Hello Sara, my claim was upheld by the Adjudicator but Amigo has not yet informed me of their updated decision.

    Amigo emailed me today advising me to enter into ESO so that I can stop paying. I understand the ESO will affect me because Amigo will report non-payments to the credit agency as “missed payments”.

    Will ESO affect my guarantor and compromise her position, in that will the missed payments be reported to her credit file too since she guaranteed to pay if I didn’t?

      I assume the current loan has been upheld.
      At last Amigo is doing something about upheld appeals.

      Amigo wants you to stop paying as every payment you make means Amigo have to rework the numbers. I suggest you do this,

      Your guarantor will be released. They may be notified that you haven’t paid but they should not be asked to pay.
      Amigo loans don’t appear on a guarantor’s credit record.
      The loan will be removed from your credit record so any missed payments will just be temporary

    Hi, I accepted my outcome last week, I was wondering if the refund is being sent as a transfer, ( I.e will randomly appear in the bank ) or if its coming through like a refund ( so will appear when my bank resets) ? Also, not to sound impatient, but does anyone know the average time between agreeing and actually receiving their refund?

      Other people have reported that they are being sent by BACS transfers.

      There is no link between when you accepted the decision and the order that they are being paid in.

    Amigo contacted the borrower and upheld two claims, only waiving the balance of interests. The principal borrowed was £4500. The guarantor made the repayments in full plus £500 towards the interest, but did not make a complaint. I made the complaint in October 2022.
    I gave the power of attorney with an Affidavit to a third party and Amigo refused to let me log in my portal, as they replied by email, it is the third party who is engaged in the complaint. When the third party tries to log in in the portal, she cannot log in either, as she does not have a code to allow her to do so. My third party is now conducting the appeal. She had emailed Amigo to appeal the decision and asked Amigo at the end of the email, to forward the email to the Adjudicator. They did not do so and continue refusing to accept my appeal. We read the minutes of the High Court and it transpires that Amigo is wrong in refusing to transfer to the adjudicator. Is there an email address for the adjudicator or is the appeal going to Amigo first? Is the FCA competent in dealing with Amigo’s refusal and putting obstacles to both myself and my third party to log into the portal and to refuse passing my appeal to the adjudicator?

      You can tell the FCA here consumer.queries@fca.org.uk and ask them to pass the problem onto the Amigo supervision team. I would be surprised if this works, but you can try.

      Amigo must have told your third party why they will not pass the appeal on. If they haven’t your third party should get on the phone and ask to speak to a manager.

      From the loan details it looks as though some loans were settled very quickly, probably with a top up. If that is correct, you will have paid little interest on them to be refunded.

      However the summary figures don’t add up:

      Interest refund 5558 should be used to clear balance (149), refund in full recent payments (2722), and pay redress at a percentage (the Scheme Cash Claim of 244 which will only be about £40 at 17%).

      But 149 + 2722 + 244 only equals 3165. So where is the rest of the interest refund? there is about £2,400 missing.

      Did you guarantor make a lot of payments? Have you had a previous refund?

    I received my outcome within the first week of December last year (2023) I am still awaited my next email to confirm my refund is being paid into my bank. I am Just wondering if anyone around the same time has received what they are owed?

    It was suppose to be the end of February that I would receive my refund, but as you guessed… NOTHING! 🙄

            You need to look at the accounts for the loans and check how much you paid and work out the interest from that.
            Also check that the £24,803.30 interest refund number is the sum of the interest waived numbers on each individual loan.

    My interest refund states I will receive £20,966.97.

    £12,152.75 to settle my outstanding loan.

    £7, 052.21 scheme cash claim which I understand is paid roughly 17p in the pound.

    The numbers above do not add up to the total interest refund of £20,966.97.

    It is a shortfall of £1,762.01.

    Do you have any idea of where that shortfall could be??

      The usual answers are
      – the guarantor has made some payments
      – there is an amount which is being refunded in full, which will be in a separate box at the bottom of your decsion email
      – there was some write off due to the borrowers insolvency
      – you have previously had some redress paid before the scheme.

      If you are getting a refund “in full”, tax will already have been deducted from the 8% parts. See the box at the bottom of your decision email. Yopu may be able to reclaim this tax deducted back from HMRC, see https://debtcamel.co.uk/ppi-payday-refund-get-back-tax/

      We do not yet know if Amigo will be deducting any tax from the “percentage” refunds. If it does, it will have to inform people of how much.

    Hi Sara, great news that refund payments are finally being arranged! I’ve noticed on the scheme portal my name as appears on b/a was incorrect and instead it had the name of bank. My a/n and s/c were correct – I’ve now updated the name field but I’m hoping that this would not have stalled my refund so far, I would have had an email to say refund payment sent first right? I see amigo stress the importance of bank details being correct and seems they can’t/won’t do much if a refund payment fails due to incorrect bank details. Hopefully I’m just in the queue like everyone else but this might have caused a problem if they sent refund without emailing me like some reports suggest?

      Amigo want the bank accounts correct so that they have fewer problems to sort out. They should try again if the payment went wrong but this is best avoided.

    I am still waiting for an email, check online and junk folder, nothing. I am worried that the claims like mine will be rejected and I have waited such a long time for a refund. I cannot understand why mine would be complicated and I did send in all evidence at the very beginning.

        I rang my hem tonight as I’m still waiting on my frl , I got a man who was so so so helpful I explained my reasons for concern and he put me on hold . He came back and he told me that all 5 of my loans where upheld and they were finding it hard to calculate my redress .i asked was he sure they were all upheld and he said 100 percent so I will wait patiently lol . I’m also due part full redress I hope to hear soon xx

        I’m pleased for everyone getting their money back I really am, but it’s heartbreaking to see. I put my claim for 3 loans in back in 2020 and amigo upheld 2 in 2021. FOS upheld all 3, a decision which was ignored by amigo as the scheme was incoming. And now IF my claim is upheld I’ll get little to nothing back 😩

      I cant see anything obviously wrong with the numbers. I am assuming all the loans were upheld.

    Contacted them yesterday and this is what they’ve said:

    In order to issue refunds on claims where we are paying 17p per a pound, we need to have issued all outcomes to customers and we have not completed this process as of yet. For this reason we can not be more accurate at this time in terms of when these payments will start. As the Scheme is a legal process, we must review each claim in full to reach the correct outcome and this process has taken longer than expected, particularly with more complex claims.

    Your claim will be paid in two instalments in potential April/May and another in approx 6mths time. your claim will be approx £667.00, some of this will be sent to you in approx April/May and the other part at a later time

      Amigo first calculates what the redress would be if there was no scheme. There a borrower gets the interest refunded and a guarantor gets all the payments refunded.

      But in the scheme only some recent payments by borrower or guarantor are refunded in full. All the rest of the calculated redress is refunded at a percentage, expected to be about 17%

    What u dint understand is …the miney for full refunds was placed into a sperate account .why is it then taking so long to refund monies back to people.now I got my outcome on the 6th Feb and accepted the same day ..I still had a balance but had been paying in full until they told me to stop. So now I have to wait another 2 months for my money back I dint get it ..the money is sitting there earning amigo more money.. they have already calculated Interest etc …I’m now losing out on interest surely this is not right

        This is just disgusting! I just do not understand why it would take them so long to refund our money back which is in a separate pot from the scheme!!! Surely this isn’t legal for them to do this?? This is just unbelievable and I cannot believe that they are allowed to get away with this!
        I also accepted mine on the 6th February, So it now continues for another 2 months, I’m sick of the whole process it’s totally disgusting!
        Also I feel so upset for the people still waiting for there final responses, totally awful what this company is allowed to get away.

    I don’t understand how Amigo, are taking so long to send full refunds to people.

    Considering that upon admitting they mis-sold the loans to people, the funds they are holding are being illegally held.

    It is so simple to setup a mass payment with BACS, they know the customers who are owed and the amounts they should be paid, so setting all that information into the system and pressing pay would complete the process over the course of a few days at the most.

    I believe there’s more to this than they are letting on. Presumably money’s held, would accumulate interest, and perhaps aid in making sure they can still stick to the 17p in the pound payments, as we’re advised by the high court.

    Absolutely spot on. How can organisations with huge number of employees manage to pay their staff on all the same day. It’s simple to set up a BACS payment for multiple people, as you say they have all of the numbers and account details already. Nothing surprises me with amigo anymore. I accepted my outcome on 7th feb. I am due a refund but by their estimates it’s going to take almost 3 moths to refund me. Incredible

    He has a LinkedIn as well other pwc workers.

    I have asked why the delay and as soon as a claim is upheld the refund should be paid no reason not to.

    It makes no sense to me that they are waiting to declare an interim percentage. If they are still confident of a total of 17% at this stage, then they could easily declare and interim percentage of say 10% right now. This still leaves a huge margin for error in the second declared percentage.

    Also how do they plan to hit 95% in 1 weeks time if its taken them 2 weeks to only creep up by 3%?
    Sounds optimistic/like a bunch of arse to me!

      I said exactly the same thing a couple of weeks ago. The problem is they just keep giving excuses and don’t have to answer to anyone. They could start paying out percentage payments for upheld claims immediately at 10% and they wouldn’t be a problem. I think there’s more to it than just pure incompetence.

      If Amigo had gone bust in December 2020, then in an administration the rules say payments someone makes have to be refunded in full if they no longer owe that debt eg their loan is found to be unaffordable and they have repaid what they borrowed. If this had happened a LOT of people with current loans would have been much better off.
      There was no provision for this in the first scheme Amigo introduced. Which was rejected by the court.
      As a sop to help get the second scheme approved, Amigo introduced a provision saying that from December 2021 people who had complained would be able to get a full refund of payments if they had repaid more than they borrowed. Of course Amigo never told people clearly about this so many people didn’t complain….

    Me too! I’m a guarantor still waiting to hear. The account holder did not make a claim and he hardly made any payments. Amigo took out a CCJ on me which I’m still paying through a DMP. They sold the account on to Intrum. They also put a charge on my house. I just want the CCJ and charge on my property to be gone. Seems like I’ve waited forever.

    I am due a full refund as guarantor, my daughter is subject to a debt recovery order so she gets nothing and I have been removed as guarantor, there is still an outstanding balance in the current loan, I received my outcome in December 2023, will I get my money refunded by the end of this month

          Amigo says guarators are not treated as having a live loan. But some other people say they have been told differently on the phone so I have queried this…
