Quick overview

Provident’s Scheme of Arrangement is now in the final stages.

The Scheme was proposed because Provident could not afford to carry on paying full refunds to customers winning affordability complaints. The Financial Ombudsman was upholding 75% of complaints against Provident.

The FCA, Provident’s regulator, said it did not approve of the Scheme. But as Provident has stopped providing doorstep loans, the FCA did not object to the Scheme in court.

It started officially on 5 August 2021 after it was approved in court. The deadline for claims was the end of February 2022.

Provident has assessed claims and informed customers of their decision. The large majority of appeals have been held.

Provident is making payments to bank accounts or sending cheques:

  • it is paying 4.2557p in the £;
  • so if your redress was £1,000, you will receive about £42;
  • a final letter will be uploaded to your portal account setting out the payment;
  • the first bank payments will be arriving in accounts on Tuesday 5 July.

Here is confirmation from one reader (see the comments below for others):

FUNDS PENDING!!!

Hi all, I’m new to this to thread but just thought I would give an update.

I have a Monzo account, it is showing my Bacs credit as going into my account on Monday, for most people with standard accounts this means you will be be paid Tuesday 🙂

I can also confirm it is 4.2557% as stated.

Glad it’s eventually been sorted.

But no-one should assume they will get their payment next week.

They may be going out in batches. And in any mass payment, some of them fail. Do not plan your July finances on the assumption that you will get paid early in the month.

PThe Provident Scheme is paying out 4.2557p in the £

Which loans were covered by the Scheme?

More than 4 million people were given a loan by Provident that comes under the Scheme.

These loans were given between 6 April 2007 and 17 December 2020.

The loans came from four different brands:

  • Provident – often called “doorstep loans” or “home credit”;
  • Satsuma payday loans;
  • Greenwood – another doorstep loan brand that hasn’t been used since 2014;
  • Glo – a very small guarantor loan brand.

If you have an affordability complaint about Vanquis or Moneybarn, these complaints are NOT included in the Scheme. You can still make a normal affordability complaint and get a full refund.

The definition of “unaffordable”

A loan is only “affordable” if you could repay it on time and still be able to pay your other debts, bills and living expenses.

You may have paid the loan on time, but it may still have been unaffordable.

If paying Provident left you so short of money you had to borrow more or you got behind with bills then it was “unaffordable”.

If you had several loans without a break between them, then Provident should have realised you were trapped in a cycle of borrowing and that these expensive loans were not affordable. Even a single loan can be unaffordable if it is large.

How much will you be paid?

The next stage is for Provident to divide up the £50 million in the Scheme between the people who have had their complaints upheld.

Customers who made a claim have been told which loans have been upheld and what the total redress for these loans is. You will be paid a percentage of this redress number, not all of it.

When the Scheme was voted on, many people thought they were being told that the payout would be 10%, or 10p in the £. I said at the time that that looked unlikely and it could only have been based on an unusually low number of people making a claim.

For several months Provident has been quoting a range, saying:

Based on the claims that we have received to date, we estimate that the pence in the pound rate of compensation to be paid to each customer will be between 4-6p.

Now it is known that Provident will only be paying 4.2557p in the £.

A final letter will be added to your portal account setting out what you will be paid.

Credit records will be cleaned

In other schemes and Administrations, some people say getting rid of a default was the most important result for them. Not the small cash refund!

For upheld loans,  any defaults or missed payments will be removed from your credit record.

This clean up will be done at the end, when they can do everyone’s together. This is very annoying if you want to make a mortgage application, but there is nothing you can do to speed it up.

If your credit record is not cleaned in this process, there will probably be no-one to complain to about this. But there is process for resolving this sort of problem, see Correct credit records by “suppressing” them if the lender has disappeared.

Current loans

Loans that were sold to a debt collector

If your loan was sold to a debt collector, Provident is trying to get this settled. This seems to be taking some time, for example with Lowell saying they haven’t been given the right information from Provident. Several people are complaining about these in the comments below.

Loans that hadn’t been sold were written off in December 2021

In December Provident announced that it was no longer collecting any payments for existing loans:

There is nothing you need to do.  You can stop making payments on your outstanding loans owed to PPC and if your payments are taken by the Continuous Payment Authority (CPA), we will stop these for you. Any payments made after 31st December 2021 will be paid back to you.

If you’re in arrears or didn’t pay your loan within the time we agreed when you got your loan, we’ll update your file with our Credit Reference Agency to show the balance as zero and partially settled.

Your credit record is being changed to show that the loan is partially settled or partially satisfied.

If you are a Provident or Satsuma customer, you should have been told about this by email or letter.

That is a pathetic payout

Provident is a successful company with the profitable Vanquis and Moneybarn brands which are still in business. It is a disgrace that the regulator has allowed them to structure their business in a way that has permitted Provident to abandon all its doorstep lending customers and not pay them their proper redress.

If you are feeling mad that Provident has got away with paying you so little, this is the time to look at whether you can make other affordability complaints, not just for loans but for other types of credit.

I have a separate page for each sort, as they need slightly different template letters to complain:

  • refunds for large loans, including Moneybarn and other car finance;
  • refunds from catalogues and credit cards such as Vanquis;
  • refunds from overdrafts
  • Morses scheme
  • refunds from other doorstep lenders;
  • refunds from Lending Stream, Safetynet Credit and other payday lenders.

    Hi,

    I have just had an email saying my appeal was not upheld and has now gone to the independent adjudicator. What is the likelihood of the adjudicator going against Provident’s decision?
    Also when is it likely provident will stop talking to credit reference agencies?

      There is no track record with the Provident scheme for me to be able to guess what the likelihood is. In the Money Shop scheme quite a few were won on appeal.

      Possibly August/September?

    I have had the following email today

    You have a new message in your Portal account regarding the Outcome of your Scheme of Arrangement claim. Additionally, we are also issuing you a refund cheque. This refund is for any money you have paid to us after 27th August 2021.

    If you have any questions on the above, please call us on 0800 056 8936 or email us at soa@provident.co.uk. When emailing us please state your Scheme ID, full name, date of birth, address and post code.

    Regards,
    Provident SPV Limited

    However, one major problem, if i try to sign in it tells me there is an error and login failed.

    If i reset my password, i get the email to reset it, i go through to change the email, it even says co congratulations you have updated your password.

    try to log…….failed.

    try to crete a user, nope im already in the database.

    so i have emailed them, and awaiting a reply.

    1 small snag, i have never been able to log in to this portal despite 3 emails to them, and never had a reply.

    i have tried the free phone number……its a recorded message.

    so no idea what i am supposed to do now. this is the first communication i have had from them since i said no to the scheme over a year ago.

    is there something i am supposed to accept ? sign? or is it like the money shop and they just send it out to you?

    i cant update anything, and they are using the correct email address.

    Has anyone had any issues with sending medical evidence to provident scheme of arrangement? I had an absolute nightmare, I got asked if I had any medical conditions at time I took out a loan between roughly 2007 and 2010 and I had to obtain my medical records to send as evidence to prove I was suffering with ill health at the time I took out loan and I sent this a few days before the deadline and then get told they did not receive the email with the medical evidence I sent!! Which I still have proof on my phone I did send! I then had to file a complaint which got investigated and was not upheld as apparently they checked all the mail boxes and still could not find my email 🤔 so I obviously wasn’t happy about this so decided to contact the Ombudsman and then get told they do not deal with any complaints under provident scheme of arrangement. So where does this leave people who could be in a similar situation like myself?? I am still not happy about this so I will be looking into any possible way to get this further investigated as it’s absolutely ridiculous!!

In my case it turns out they had me on their database under my middle name, which I am known by and not my first name. It may just be a small detail like that that it stopping you. They just amended their database and I was able to log in after that.

Surprised a week left and still no decision. Could someone estimate how much I’m likely to receive. I was mislead I think when I voted for the scheme . 8 per cent redress . Which would be added each year. I actually thought a full refund would have been given . That’s how it was sold . Hope someone can help . Larna

      Indeed. Provident has screwed you. Legally. Blame the regulators for allowing the mis-selling to co tinge for so many years and for allowing Provident to structure its companies in such away that it can wash its hand of the money owed to doorstep lending customers and still continue to make profits for its shareholders from its Vanquis and Moneybarn businesses.

          You can’t go to the Ombudsman or to court. Once the Scheme was approved, that is it. There is nowhere else to go.

          Blame Provident for this. Decide to never have any to do with its other nicely profitable businesses, Vanquis and Moneybarn, that are charging horrible interest rates.

          Blame the FCA for allowing Provident to mis sell for so long, allowing Provident to get away with this Scheme, and failing to provide any backup for customers.

    My 79 yr old mum has received an email from Provident advising her complaint has been upheld and the estimated payment is £484 to £726 on a net claim of £12100. She had 50 loans between 2007 & 2020, 13 of which have been deemed affordable which I don’t have a problem with but could you help with the following queries please?
    Aug 19 complaint first sent to Provident
    Jan 20 reply received advising claim not upheld as loans were affordable
    Feb 20 claim referred to the FOS
    Aug 20 FOS requested a copy of business file from Provident. Provident refused stating complaint not referred to the FOS within the 6 months limit.
    Nov 20 further request from the FOS requesting copy of file again and stating complaint clearly referred to them within one month. FOS allowed 2 weeks for this.
    Aug 21 advised by FOS NFA to be taken due to scheme of arrangement.
    Apr 22 provident upheld the claim.
    If the complaint is upheld now should the same complaint not have been upheld in Jan 2020 in which case she would have received a full refund?
    Also, given the delay in the case being dealt with by the FOS but more so the obvious delaying tactics by Provident in August 20 do you think my mum has grounds for appeal?

    Hi. I appealed regarding unaffordable loans early in 2021, not long before them taking the compensation route. My claim was never agreed, but I was told it would be assessed as part of this scheme. I have heard nothing since and I assumed it was going to be a couple of years until it was sorted, so have not really paid attention.
    I was surprised to see that compensation is being paid now. What can I do to find out what is happening with my claim? Just to be clear, they said my claim was being assessed and kept extending the ‘investigation’. Then they announced the scheme and I have had no contact since then.

    32 loans in total all upheld as unaffordable , but then I was paying £180 every week so that be why
    Total amount of compensation had I gone to the ombudsman would have been 32thousand however under the scheme I will get somewhere between 1250-1800 it says , I’m not appealing I cleared my loans back in 2017 with the help of family and I’ve never looked back luckily I had always paid and never missed ( to the deferment of my family) and I now have a really good credit rating since they have all dropped off however back then in 2007 I couldn’t get mainstream as my rating was 200 took till I was in the 700 area to get a mainstream loan . It’s not worth appealing as they won’t change the amount they only have that pot and all that will be used

    Hi Sara, I had 12 loans and 3 not upheld. 2 in 2013 and one in 2014. they were
    all taken out 4 months apart. The amount of interest I paid on all loans not upheld, was 1846 + 8% – 9 years of interest.
    At the time I had quite a few defaults dating back to 2011. My account with them was opened in 2013. Do you think I should appeal on the basis, that I had numerous amount of defaults on my credit file? Thanks in advance.

          unless there were large gaps between the loans – from when you paid one o taking out the next, I think at least the 1000 loan should have been refunded. possibly the 800 as well.
          Up to you if you want to appeal to argue those loans were large and provident should have seen you were borrowing more and in trouble.

    It’s good to see further redress amounts being sent out. I too have had mine, out of 27 loans, 19 deemed as unaffordable. Getting a small percentage of the £12,500 total claim value is a bonus (approx £450 to £750) as I voted no to the scheme.

    It’s not worth my further stress to appeal even though the explanation makes little sense the way they have set it out, so I doubt it’s accuracy. Others will no doubt have good grounds and reasons to appeal.

    Provident have already won with the assistance of the High Court and the non-intervention of the FCA. Provident succeeded in having a pathetic scheme approved to share out a £50M pot amongst all claimants (the high court knew the scale of the potential claims as the Yes/No vote was weighted on potential claim values).

    All of us claimants are now arguing amongst ourselves for a slightly bigger slice of the compensation pie. Provident’s losses are capped at £50M after years of profiteering, You could argue that it’s a small price for them to pay when compared to the £-Billions they’ve made until the game was up. Possibly even pre-meditated based on risk/reward.

    A bit like getting fined £100 for stealing a thousand (£).

    I will be accepting the redress amount, and now put this behind me in the hope that at the very least it draws peoples attention to those who profit from those that are often desperate.

    FCA washed their hands of this matter and failed us all. I sincerely hope someone feels ashamed.

These 2 loans are the highest of loans taken out; is it possible that lesser amounts would be unaffordable but higher amounts ( £600 and £1400 higher) would be affordable?

    My case was looked at by the Independent Adjudicator who upheld all of my Provident and Satsuma loans unaffordable. (Total £14780.29), and that I overpaid by £338.40. This overpayment is being refunded immediately to my bank by BACS, and the figures of £578.11 or £867.17 will be paid into my bank abefore 1st June.
    A little more than the 1p I said I would be happy with.

        People are only being sent cheques if there was previously a problem and they overpaid a loan. This isn’t happening with many people.

        Everyone is only going to be paid a small percentage – about 5% of their calculated redress. This is how Schemes work. This is why provident set one up so it didn’t have to pay people like you £14,000 and can get away with paying a few hundred instead. It sucks but there is nothing you can do now about it.

Will they look at the total debt including costs as what I owe or just the loan amount.? I will be honest with you I’m not after compensation I would just like the ccj to be removed.

      Appeal went in 14th April , Response on 27th April.

      Not seen anyone with a successful appeal yet. I thought I had a strong case against a baffling decision but its been referred to the Independent Scheme Adjudicator who has 60 days to review and issue a final decision and then that’s it.

      I think what they are doing is resubmitting the information into the algorithm , which just spits out the same response before handing it off for a independent human review.
