And the deadlines have slipped yet again. There are just under 4,000 people still waiting for a decision, or a revised decision after winning an appeal, or a recalculation.
There are also now (21 August), about 8,000 people where Amigo has wrong or missing bank details:
- this includes £1.7m of redress to be paid “in full”, and
- £2.4m of Initial Scheme Payments.
Most of these are people with loans taken out longer ago, so their contact details may be out of date too. And some people are worried the emails or texts they are getting about updating their bank details are a scam.
If you haven’t already been paid, check and double check the bank account details on your Portal Account. If you can’t login to the portal, call Amigo on 01202 629798 and Amigo will reset your portal login.
If these amounts are not paid by the time the second payment is made later in the year, you can’t get paid afterwards as all the money will have been distributed.
24 June 2024 – my summary of the situation:
- People who have not yet had a first decision email (FRL) If you haven’t had a recent communications from Amigo apologising for the delay you should contact Amigo urgently.
- People who have escalated a decision No-one has yet had a revised decision after winning an appeal.
- People whose defaulted loans have been sold to Intrum before 2022 It still isn’t clear whether cash refunds will be paid by Intrum or Amigo.
- People who are waiting for a “full refund” to be paid Some dates seem to have not been paid. Some people are still waiting for recalculations of the 8% interest and any recent payments.
- People who are waiting for the first percentage payment to be paid Some dates seem to have not been paid here as well. Some recalculations seem to be being done – I don’t know why unless Amigo messed up the numbers the first time!
- People who do not understand what they are going to get
If you don’t understand your decision email (FRL) post a screenshot of it in the Facebook group. - People who have been paid “the wrong amount”
If you have been paid “too much” or had 2 payments, it may well be that you have had a full refund and a first percentage payment.
If you think you have been paid too little, post a screenshot of your decision email in the Facebook group or phone Amigo up. A few people have been paid too little and got this speedily corrected. - People who have been paid the first percentage payment (and the full refund if relevant) and are now waiting for the second one

29 May 2024 – first scheme payment will be 12.5p in the £
- Amigo says “substantially all” claims have been determined and adjudicated – 99.2%
- it knows enough to be sure it can pay 12.5p in the £ so that is what it has set the Initial Scheme Payment Percentage at.
- you will get 12.5% of the amount on your Amigo email decision labelled Total Cash Claim Value or Scheme Cash Claim
- you will be paid this first amount within the next 30 days, or within 30 days of receiving an accepted Scheme Outcome, whichever is later. So the large majority of people should get this in June 2024
- Amigo says it will prioritise payments based on correct bank details being provided and age of the Outcome Letter issued (oldest to newest).
- Amigo is still saying at least 17% for the total amount to be paid, so that means 4.5p in the £ will be paid late in the year
10 April 2024 – 94% of decisions issued
- nearly a month late, Amigo still hasn’t quite reached the target of 95% of decisions it is said it would achieve by mid March
- it now expects to have issued over 98% decisions by the end of April, with the rest coming in early May
14th March 2024 – Amigo gives a clearer payment timetable
Decisions:
- Amigo has now crawled up to 91% of decisions issued.
- they now say they expect to issue 95% of all decisions 22 March 2024, with the remainder being issued by mid-April 2024.
“In full” payments
- payments have started for the “In full” refunds;
- where a decision was issued on or before 1 February and you do not have a live loan, your payment should be made by the end of March
- where a decision was issued on or before 1 February and you do have a live loan with a balance outstanding, your payment should be made by the end of April
- where a decision was issued after 1 February, your payment should be made between mid April and end May
“Percentage” payments
- it still expects to be paying at least 17p in the pound to people expecting to get the “percentage” refunds
- it has rowed back from saying it expects the first instalment of the percentage payments to be made in April or May. It now says that it expects to “declare an interim dividend” in April or May – that is the percentage that it will pay as the first instalment, eg 10% or 12% say. And it expects payments of the first instalment to be within 30 days of making that statement about the amount.
- so they could be in June…
Appeals
- where there has been an appeal, the time will be confirmed in your decision letter.
27 February 2024 – another delay to decisions & payments
- Amigo has still only got up to 88% of decisions issued
- it now hopes to have issued over 95% of decisions by mid-March 2024, with the rest being issued in early April
- Amigo expects to start paying the “in full” refund amounts at the end of February, but these will be done in batches so not everyone will get theirs then
- the payment of the first installment of the “percentage payments” has been put back to April or May with the final installment about 6 months later.
A reminder of who may get some “in full” refunds:
You have to have repaid at least the amount you borrowed.
From that point, you may get a full refund, not at 17%, depending on the date of your complaint/claim:
- you will get a full refund of payments made after 1 December 2021, if you had complained before that date;
- you will get a refund from the date you complained if that was between 1 December 2021 and 26 May 2022;
- you will get a full refund of payments after 26 May 2022, if your first complaint was in the Scheme.
1) only the statutory 8% interest added is taxable. Not the interest paid that is being refunded – that is your own money that you are getting back.
2) the statutory 8% interest added is taxable as savings. BUT everyone has a Tax free savings amount of £1000 for basic rate taxpayers and £500 for higher rate tax payers in a year.
4) in previous administrations & schemes, I don’t recall anyone having tax deducted from the 8% part which is paid out as a percentage, expected to be 17%. If this happens, Amigo will have to inform you of the amount of tax deducted and you may be able to claim some of that back from HMRC.
Previous months updates
January 2024
- on 25 January Amigo admitted it has only sent out 75%
- of decisions. This is only 2% more than on 9 January.
- it says “We anticipated that all responses would be issued by the end of January 2024, however, the remaining work and complexities in assessing and calculating certain claims, especially for some claimants with outstanding loan balances, has taken longer than initially anticipated. Although responses are still being issued, and will continue to be, our intention is to issue all responses by mid-March 2024.”
December 2023
- the Amigo scheme page now says they have issued 71% of decisions
- Amigo has told some people with current loans to stop paying
- decisions for current loans are being sent out but not many so far
- if you have made recent payments, some may be refunded in full. In the decision you are sent, these are being called “set off refunds”. The “total cash claim value” on the decision is the amount that will be paid at a reduced percentage, expected to be about 17%.
- Amigo has issued 45% of decisions
- Amigo has been deleting a lot of loans from all three credit reference agencies . If your loans have been cleared, this is probably because your claim will be upheld. But this isn’t definite until you get the claim decision.
October 2023
- Amigo has issued 38% of decisions. It says almost all the rest should be issued by the end of December and they will all be issued by end January
- the process to remove CCJs will continue to March
- Amigo is confident the payout percentage will not be less than 17%
- it is now clear that Amigo not going to pay many borrowers where the loan has been upheld as unaffordable but the guarantor made some payments. This is ethically wrong and entirely unexpected – redress from mis-sold guarantor loans has never been handled like, by Amigo before the Scheme or by the ombudsman. You can appeal but it isn’t clear that this will succeed.
- the best estimate of the percentage payout is still at 17% but this can still change.
- Amigo now says: “We expect that the initial cash payment to customers will be in early 2024. We are unable to confirm the dividend and make interim payments until almost all claims have been decisioned in full, causing the delay from November, as previously expected. The final payment will be delayed until late 2024 (around the time that the business enters liquidation).”
September 2023
- the first rejections for current loans are going out. If this loan has caused you problems, appeal a rejection.
August 2023
- the first UPHOLD decisions are at long last being issued
- if only some of your loans have been upheld, look at an appeal. The first person has reported winning an appeal.
- some loans have been sold to Lantern. In most cases these are loans where neither the borrower or the guarantor made a claim.
March 2023
- Amigo has announced it cannot raise the money from shareholders so it will be liquidated
- this Scheme continues in “Fallback Mode” – see Amigo to close & Scheme goes into Fallback for details
- it is now expected that Amigo the first payments may be made in late 2023 and there may be a second, sm
aller payment in 2024.
December 2023
- The deadline for making claims to the Amigo Scheme was 26 November 2022. It is now too late to make a claim.

Amigo’s Scheme – the background
Amigo’s Scheme of Arrangement is now in operation after it was approved by the court on 23 May 2022.
The Scheme was proposed because Amigo couldn’t afford to carry on paying full refunds to its borrowers and guarantors who were winning affordability complaints.
Amigo had proposed a different Scheme in 2020 that was rejected in 2021. Amigo has now spent nearly a year getting its current Scheme proposed. For more details on the first Scheme, why it was rejected, how the second Scheme is different, and the voting on the second Scheme, see Articles on Amigo Schemes.
In the Scheme, Amigo makes the decision about whether your claim should be upheld. If it is rejected or only upheld for some of your loans, you can appeal this decision to the Independent Scheme Adjudicator. You cannot appeal to the Financial Ombudsman.
Which loans and customers are covered by the Scheme?
All loans made by Amigo before 2021, including those under its previous brand name FLM, are included in the Scheme. For loans that were settled more than seven years ago, Amigo may no longer have the loan details. You can still complain about these older loans but it may be necessary for you to produce evidence about them.
Both borrowers and guarantors could make a claim to the Scheme.
Amigo has started lending again with a pilot scheme under a new brand, Reward Rate. Any complaints about new loans will not be covered by the Scheme and customers will be able to make a complaint about them as normal – first to Amigo and then to the Financial Ombudsman.
The definition of “unaffordable”
A loan is only “affordable” if at the time the loan was given, it was likely that you could repay it on time and still be able to pay your other debts, bills and everyday living expenses.
If paying Amigo left you so short of money you had to borrow more or you got behind with bills then it was “unaffordable”. This often happened with Amigo loans as many borrowers were desperate to try to protect their guarantor.
Amigo should have checked that a loan would be affordable for both the borrower and the guarantor. For a guarantor, this would mean that they could make all the repayments out of their income and still be able to pay their own debts, bills and living costs. A guarantor who had a house may not have had enough spare income to repay the loan so it was unaffordable.
But Amigo’s affordability checks were very poor. That’s why they were losing 88% of cases at the Financial Ombudsman.
Amigo often offered top up loans and the checks on these weren’t any better, even though people were getting deeper into debt. Repaying the first Amigo loan may have left you in financial difficulty, so a top up loan may have appeared to be a good option, even though it made your debt situation worse.
What will you get if you win the claim?
When Amigo upholds a claim, it will tell you what the “redress” calculated is. You will only get paid a percentage of this, not the full amount (unless some of your payments are very recent).
Redress for a borrower who has a claim upheld
For a borrower with a repaid loan, redress will be:
- a refund of the interest they paid on the loan;
- plus 8% statutory interest;
- Amigo is making a deduction if your guarantor made any payments. If your guarantor has also made a claim, they should be refunded. If they haven’t then no one is being refunded for these amounts. You can appeal this decision, which is ethically very wrong, but it is not clear it you will win.
For a borrower with a current loan, redress will be:
- a refund of any interest if they have repaid more than the amount borrowed plus 8% statutory interest, otherwise, their balance will be reduced;
- their guarantor will be released;
- if there is still a balance after the reduction, you can make a lower affordable payment arrangement to clear it.
In addition, any problems on your credit record will be removed for loans that are upheld. This will include having any CCJ removed (the legal term is set aside) and removing the default showing on the debt with Intrum if your debt was sold.
Redress for a guarantor who has a claim upheld
A guarantor’s redress is the full amount they have paid to a loan, not just the interest, plus 8% statutory interest. And if there is a current loan, they will be released as guarantor.
Previously it had been expected that guarantors would be refunded if a borrower won a claim that the loan was unaffordable even if the guarantor had not made a claim. It has now become clear that Amigo is reducing the payments to the borrower and refusing to pay the guarantor where the guarantor has not claimed.
8% statutory interest
This number is NOT 8% of the interest you should get refunded.
It is 8% per year from the time of the repayments until 28 February 2022. So if your loan was settled several years before 2022, you may get 20% or more added.
BUT you will only get a % of this redress
That redress figure may look great. But you are not going to be paid that amount, just a percentage of it.
Amigo originally estimated that at 41p in the £. If your full redress is say £3,000 that would have meant you will be paid 41% of that – £1,230. But a lot more people made claims than Amigo expected – 210,000. That has reduced the amount you might get to 20p in the £.
And with the March 2023 announcement that Amigo has failed to raise the money from shareholders, there will be less cash to be refunded. The amount is now expected to be about 17p in the £.
So from a calculated redress of £3,000 you may get £510.
Exception – full refund for “continuing payments”
Some customers will get a “full refund” of certain payments they made to the loan provided that they have repaid at least the amount they borrowed and their claim is upheld. These customers are due a full refund of payments:
- from 1 December 2021, if they had complained on or before that date;
- from the date they complained, if that was between 1 December 2021 and 26 May 2022; or
- from 26 May 2022, if they did not complain before the Scheme started.
This is set out in full in 6.33 of the Explanatory Statement.
The purpose of this is so that if your claim results in a refund, payments you made after the relevant date will be refunded in full provided that you have repaid more than the amount you borrowed. For a guarantor getting a refund, the “repaid more than you borrowed” test does not apply.
Here are three borrower examples:
- a borrower who made a complaint in March 2021 (so before 1 December 2021) and who at 1 December 2021 had already paid back more than they had borrowed will get a full refund of payments they made after 1 December 2021
- a borrower who made a complaint in March 2022 (so after 1 December 2021) and who in March 2022 had already paid back more than they had borrowed will get a full refund of payments they made after that date
- a borrower who made a claim to the Scheme in September 2022 (so after the Scheme had started) who by 26 May 2022 had already paid back more than they had borrowed, will get a full refund of payments they made after 26 May 2022.
What happens after you make a claim
The deadline for making a claim has now passed
Keep an eye on your claim
When you have made a claim, you may not hear anything for months.
Amigo may send you an email when they have decided your claim saying you can log in to the portal and see the result.
But it is a good idea to check the portal every month or so even if you haven’t had an email. They may have sent you an email that you missed as it went into spam.

Working out how much people will get
When Amigo have decided all the claims and appeals they can then add up the total amount of redress. They then divide that amount by the money they have to distribute – this gives the “pence in the £” amount they will pay.
This will probably be done in two stages. There will be a first, larger payment possibly in the first quarter of 2024. And then a small payment in 2024 to pay out the remaining money.
Should you appeal a decision?
If your claim has been rejected or only partially upheld With some loans upheld and some rejected – you can appeal this decision.
You are the one who knows how much trouble the Amigo loan caused you.
The first Amigo decision will probably have been an automated “Computer says Yes/No” decision – they have had 200,000 complaints to decide. But in the appeal process, this will be looked at by a human.
You should also appeal if you don’t agree with the numbers given. If you think you had more loans than were listed. If you don’t know why the Total Cash Claim Value is less than the other numbers suggest.
Get more loans upheld
Getting more loans upheld will:
- increase the cash you are paid, or reduce the balance you owe
- if you get earlier loans upheld, the extra 8% added amount will also increase
- if your current loan is upheld, your guarantor will be released.
If you have bank statements or any other evidence about your finances at the time you took a loan, include that with your appeal. These will help your case.
Credit records
Getting more loans upheld will also clean any problems on them from your credit record.
If your credit report is wrong at the moment eg because Amigo did not add a default when you stopped paying, then it is important that in your appeal you say why the loan should be upheld. BUT ALSO say that if the loan is not upheld, you want a default date added to your credit record back in month/year “in accordance with the SCOR reporting rules”. Defaults drop off your credit record after 6 years – a non-defaulted debt will stay on your credit record for 6 years after the date it is settled.
HOW TO APPEAL
If you think the numbers are wrong, say why.
If you made all the payments but Amigo seems to think your guarantor made some, challenge this.
If you think more loans should be upheld: Get bank statement for 3 months before the loan started – these are the best evidence that a loan is unaffordable. You can get these going back at least 6 years even from closed accounts. Don’t assume you won’t be able to, ask for these immediately from your bank. If the loans are more than 6 years old and the bank account has been closed, look at what other evidence you have – payslips, P60s, tax returns, emails about missed payments or CCJs etc
Download & send a current credit report, eg TransUnions’ Statutory Report. If you have had loans deleted from your record because of winning other affordability complaints, send Amigo evidence about these.
Explain about recent problems before the loan application – only on benefits, health issues, gambling, economic abuse, recent missed payments, payments arrangements, DMP etc
And if you were topping up a previous loan, explain how that loan made your situation worse.
If all of your loans have been upheld and the numbers look right
You have no reason to appeal this decision just because you will only be paid a percentage of this. This would not get you any further money.
You should log in to the portal, accept the decision and give your bank account details.
Sale of loans to Lantern
In August and September 2023 some people have been notified that their loan has been sold to Lantern, a debt collector. The sale of loans to a debt collector is perfectly legal and you can’t challenge this.
In most cases these were loans where no one had made a claim to the scheme. If your loan has been sold and you had made a claim to the Scheme which has not been assessed, ask Amigo why.
The loans are being sold as guarantor loans – the guarantor has not been released and if the borrower doesn’t make an arrangement to pay the guarantor will probably be asked to.
We don’t yet know how “reasonable” Lantern will be in accepting low arrangements to pay. If you or your guarantor has a problem, leave a comment below here but also talk to a good debt adviser – your local Citizens Advice or if you prefer the phone National Debtline on 0808 808 4000.

I took out a loan with amigo in June 2017 for £3500, and had 3 top ups within 4 months to take it up to £8000. I started struggling instantly with repayments, Amigo wouldn’t agree on a payment plan that was reasonable so they decided to take me to court. I was issued with a CCJ in October 2018 and ordered to pay £100 per month. I have been making these payments to Shoosmith LLP ever since and not missed a payment, but Amigo keep adding interest and charges, as it stands today I still owe £7681.00.
I have my complaint in as my credit file has taken a massive hit and I don’t think this will ever be paid off at this rate. As a CCJ is on your file for 6 years, it is due to drop off in October 24 anyway.
What are the consequences for me to stop paying? Can I be chased for the outstanding amount? Will I be brought back to court ?
I am unsure what action to take as I have reached out to several debt help agencies but even they are confused when it comes to Amigo and my particular situation.

If your claim is upheld– and with 3 top ups in 4 months it ought to be a strong one, then a redress amount will be calculated.
What this is will depend on how many of the loans (the top ups are actually separate loans) are upheld.
The redress will be used to reduce the balance owed.
It may clear it, I can’t guess. If it clears the balance then you will get some refund in cash.
If there is a balance left owing, then you have to make a payment arrangement to settle that but no more interest can be added, and your guarantor will be released.
The CCJ will also be removed from your credit record, but this may not be much sooner than it will drop off anyway.
If the current loan is not upheld then you should appeal this
What is the position of your guarantor? Have they been asked to make any payments? Were they also taken to court for a CCJ?
You can not be taken back to court for a second CCJ for the same debt. But a CCJ doesnt expire after 6 years when it drops off your credit record. Amigo or a debt collector they sell it to could look to enforce it in other ways – deduction from your wages or bailiffs – if you just stop paying.

I was a guarantor for a friend who sadly died. I paid her whole loan off and put it on a credit card to do so. This was probably 2011,,I’ve made a claim but will I be entitled to any money as compensation?

If your claim is upheld, yes. All the money you paid plus about 80% extra (if you are Right with the 2011 guess) will the the redress amount but you will only be paid a percentage of this amount. 17% is the only estimate given but it could be very different.

So if I guess you paid £5500 in total (and that is a complete guess – clearing the loan may have cost more or less than the amount borrowed) AND if I assume you cleared the loan in February 2011 then your redress total should be:
£5500 + (11 years at 8%) = £10,340.
But you will only receive a percentage of that amount. If that percentage turns out to be 17%, you would receive about £1,760.

Amigo had the cheek today to send me an arrears bill,not heard nothing for 12 months. Stuck it in shredder as they up held 3 of 5 loans just before scheme and I rejected it.

Received a redress value of 9.5k last week on 4 fully paid loans/top ups between 2017/18, all of which were upheld.
This whole process has taken an eternity but glad to finally be seeing some movement; now we wait to see if it’ll be more/less than the 17p to the pound that has been mentioned – hopefully we won’t have to wait an age for confirmation! Best of luck all!

I took out a loan in 2015 for 5k I was miss sold the loan and defiantly couldn’t afford to keep it up after things went bad with work, they absolutely terrorised me and refused to see any debt management plan
After years of regret and hiding away I missed the cut off date but I really want it off my record it’s gone next year and I have started paying small instalments but again I don’t feel I should or need to as I have only set up £70 a month,
Am scared they will pass it on to lantern but I have been told all debt will be wiped by the end of the year how true is this?

Hi Sara, i have a current CCJ from amigo which currently sits with Intrum which i pay monthly, if i am owed redress does the full amount goes to the balance meaning 100% of the £ or is that also 17p to the £ first then taken off the balance? I know cash owed is 17p to the £ just wondered if the balance owed gets £ to £ if that make sense? Have asked Amigo and they haven’t really confirmed. thank you as always

I think they will use the redress to first reduce your Intrum balance at 100%. the 17% only applies if you get cash because the redress is more than enough to clear the balance.

That is good – your case is much more complicated if a guarantor paid the loan off.
But I can’t start to guess what you might get back for two reasons:
1) I would need to know how much you paid to each loan and top up loan. And how much in cash you received from each of the top up loans.
2) Even if you can provide the numbers for (1), Amigo may not uphold all of your loans. In which case they make a deduction for “reinstated interest” and I cannot guess how much this may be.

Hi all, just received an email back from amigo saying that everyone should have a reply to their complaints within the next 3 months due to the fact that they received so many complaints. Doesn’t really help a lot of us who are in eso and our arrears continue to grow and our credit rating taking more of a hammering. Let’s hope this fiasco gets sorted asap

Finally I have received my outcome from Amigo today, original complaint was submitted back in Nov 2020. Amigo pushed and delayed my complaint until it went into the Scheme of Arrangment.
Shame, I will only receive 17p to £ hopefully it won’t change, go down too much, when they finally payout.
Claim Outcome: Upheld Total Cash Claim Value = £14546.69

Just had these extra bits of Info from amigo about an hour ago – these are my interpretations- I’m hoping Sara can clarify
The main dividend payment is due November/December 2023 – I presume this would be the 17p to the £ or whatever value they initially set
The dividend amount is subject to change which will be confirmed in Spring/Summer 2024 when we enter liquidation and the business knows exactly how much is left to pay creditors – I presume this is the extra payments that have been mentioned-
Ie if the initial payment is 17p in the £ but they actually could of afforded £22p in the £ then successful claims receive a smaller extra payment in spring/Summer 2024

They will come up with a new estimate of the likely total dividend. And then they will may most of that in the first payment.
There is NO reason to think they will pay 17% and then a bit more later. 17% was an estimate of the total about to be paid, not the first payment.
If 17% turns out to be correct then 15% could be paid at first and 2% more at the end.

First was £4000, then topped up to £6000 and then finally to £9000.

Then on the 19/06/2020 I topped up to £9000.
To date i have made 41 payments of £355.72 = £14,584.52

Get your bank statements going as far back as possible. Tell Amigo you want to appeal as you only took the top upm loans as you were struggling to repay the previous loan. Tell Amigo you are in the process of getting your bank statements.

Hi Sara, I logged in today and found Amigi rejected my claim. In February 2020, I made an affordability complaint and submitted bank statements etc in support. Amigo did not deal with my complaint and kept saying they are looking into it. In August 2022, Amigo automatically put my complaint as a claim in the scheme. Before the deadline for the scheme, I emailed my bank statements in support. I took out a £9k loan in July 2019 to be repaid over 5 years. At the time I was in receipt of ESA as I could not claim JSA due to ill-health (I was signed off since February 2018). My daughter is my guarantor. My am now a pensioner receiving pension credit since October 2022. My daughter has been paying towards my expenses for food, clothes, bills. She has helps pay my other debts (credit cards and another loan). My daughter has given me a lot of financial support – I feel ashamed to keep taking her help. I don’t know the exact date of when Amigo rejected my claim. The portal says I have 30 days to accept or reject the outcome otherwise they will treat my silence as “acceptance”. Please can you advise me on what I need to submit in support of rejecting and escalating my claim.

I suggest you reject this and appeal, pointing out to Amigo that your bank statements which you have supplied show you were on ESA and a 9K loan was simply unaffordable.

Do you mean buying or renting where I live? I don’t have a place of my own as I cannot afford the rent. So I live few weeks with my daughter who is my guarantor and then I stay a few weeks with my older daughter. I try to give my daughters some of my pension money whenever I can afford to. I feel so shameful that I am living on my daughters.

ok, I think you should talk to a debt adviser about getting rid of all of your debts through a debt relief order if they add up to less than 30,000 and bankruptcy if it is more.
It’s lovely of your daughters to put you up, but there is no reason why they should have to pay your non Amigo debts.
If your Amigo case is upheld, your daughter won’t have to pay that either as the guarantor will be released.
So phone National Debtline on 0808 808 4000 and talk about your options.

4 years since I made my affordability complaint (due to gambling problem) and Amigo rejected my claim. FOS made a decision before the scheme started that both of my loans were unaffordable and they supposed to took off interest and refund me the money. They never took this to consideration and never responded to this letter as they started all this circus. I have rejected their decision. Do I have to do something special to appeal or rejection on their scheme is enough?
Also I have another question. If I had decision made by FOS that my loans were unaffordable is possibility that now I will have to pay everything back to them?

You have to supply the statements to Amigo – they are vital evidence that will help your appeal. Ask Amigo if they have them. If not, you should be able to get them back from FOS but you need to move fast.

I have contacted amigo and they told me that I do not have to supply statements for now. They told me that they will contact me within next 30 days to discuss my appel and then if they need statements they will ask me to provide them. I have also contacted FOS and ai requested those statements.

Hi Sara, i have a current CCJ from amigo which currently sits with Intrum which i pay monthly, i am the guarantor as loan receiver defaulted and did not resoond or acknowledge Intrum. I made complaint in time and the loan receiver sais they did too. I am not sure i believe them as Intrum said they had no cobtacy with them acknowledging debt. So my question is if claim upheld would payments go to me or the origanl loan receiver?
Currently paying £100 monthly till 2029.
if i am owed redress does the full amount go to the balance and i am realeased from guarantor and stop paying? Have asked Amigo and they haven’t really confirmed. thank you as alway

if your claim is upheld (or the borrower’s if they actually made one) then your redress will be the total of the payments you made – but you will only get a percentage of this.

At time of standing guarantor i had 1 standard bank loan £8k and 4 credit cards total £17k. At time i had a great credit history and have now worked hard to clear loan and 2 of my credit cards. Even though i had all my personal loans i was reliant on a Family member helping me meet my committents whilst in a lower paid job. I also told Amigo when they did affordability check and saw i had more going out then coming in that my Aunt was helping me get on track.
Just for info Ccj applied to my record 2019. So paying £100 since then.

Just wanted your opinion on the comments in the thread that an interim payment would be made by the end of the year if feedback on the thread is that Amigo are not going to finish responses by Nov at the earliest. How could they make any payments before the final appeals have gone through which I assume will go into 2024?

Because the first payment will not be the whole amout.
Say they expect the final number to be between 14% and 18%. They would be safe to pay everyone 13% by the end of the year and then the remaining amount in 2024 – if a lot of the appeals are upheld the final amount may be about 1%, if a lot of the appeals are rejected then the final amount may be about 4%.
That is a very simplified example as there will be other factors as well as the number of the appeals that are upheld. But by November Amigo should be in a very good place to be confident about the range of outcomes, so it can safely pay out less than the bottom of the range. have a range

Has anyone with a current loan in eso or not had their claim upheld.
Think I have only seen rejections.
I borrowed 4500 in October 2017 and by October 2018 I had 2 top ups to take that to 9500.
In that same timeframe I received 1 ccj and 1 default for other debts as couldn’t keep up.
Prior to first top I missed 2 payments with 4 months with amigo and then after last top up was late with about 5 payments.
Paid circa 13000 still owe 9500 and in eso.

I don’t think I have yet seen a current loan accepted, in ESO or not.
It isn’t clear to me that being in ESO is at all relevant for whether a claim will be accepted or not.
From what you written, your case sounds a good one. Appeal if any of your loans are not upheld. If you are feeling worried, use this time to get your bank statements together for an appeal. You want them from July 2017 to Oct 2018 ideally.

I’m getting increasingly worried at the amount of people with current loans in ESO that are getting their claims denied. Honestly, reading some of these, I can’t work out on what grounds they could possibly be denied? I’m genuinely really concerned about it and it’s causing a lot of sleepless nights. If I do end up getting a denied claim, I know I can appeal, but what is the likelihood of that actually working? They already have all my bank statements, all my information, everything I could physically give them. How could they possibly go back on their decision when they already have the information? I am so confused about this and just so fed up of it.

They haven’t yet made a decision that your loans were unaffordable. being in ESO just means that you have repaid more than you borrowed.

i still have yet to hear anything from amigo, i have emailed multiple times,
sitll making my payments monthly,
i intially took out a loan in june 2019 for £10,000, i pay monthly £395,25, i have looked through my amigo statement and worked out that i have made 53 payments in total at that amount which works out at £20,948.25,
looking at the statments the highest intrest added one month was £328.03, i have emailed the claims line multiple times,
the main thing im stuck about is do i continue making my payments of the £395,25, my current balance is £2128.96,
which means i have 5-6 months left, do you think that my settlement would come before this so that i would not have to keep paying monthly ?

So the email that they sent to me yesterday, what does this mean and will they try and take money from me and put me back as the guarantor?

Amigo cannot be planning on asking you to repay money or put you back as guarantor. Even if they had previously made an error, you were entitled to rely on their decision.
I don’t think that is what they will suggest. I think the new “scheme decision” email is just very badly worded.
I suggest you email Amigo and say you did not make a claim to the Scheme, you had a complaint that was previously upheld by Amigo in mmm/yyyy, at which point they refunded you and released you as guarantor. Ask them to confirm that the previous decision stands.

Just want to say it as a word of caution that Amigo is being very crafty! I say this because I was not emailed about Amigo rejecting my claim and I only got to know they rejected my claim yesterday when I logged into my portal. The rejection notification says I have 30 days to either accept or reject their decision. If I don’t respond within 39 days they will treat my “silence” as accepting their decision. If I hadn’t logged in yesterday I would not have known my claim was rejected and I would lose on my right to appeal.

For those that are still waiting a response iv been told by amigo that it could take up to 6-8 weeks until you hear something. I initially called them because I was concerned that they didn’t receive my claim but they reassured me that they did receive my claim and that it has yet to be investigated.

I know there are many other guarantors like me who are waiting for an outcome. I had previously made a complaint before the scheme was set up and again via the scheme as the borrower should never have been accepted and if checks had been completed it would have been clear that he was never in a position to make repayments. I did not know that at the time and as I said in my complaints I thought Amigo had conducted a thorough assessment of the borrower income and credit history. This resulted in me having to make most of the repayments until I could no longer do so. According to the yearly statement there is still an outstanding balance but the interest was capped. Amigo has not contacted either the borrower or myself to make payments so I assume that the outstanding balance is the interest that was added. We have both made complaints under the scheme but still have not received any updates. I emailed today and was told there is no outcome yet but I should get one in the next 3months. So along with many others I just have keep hoping and waiting.

My update from Amigo when chasing as still not had an outcome.
We’re in the process of sending customers their claim outcome letters via email. Whilst we initially estimated that we would have sent them all in the first half of 2023, due to receiving more claims than anticipated, we expect to have sent them all within the next 3 months.

Hi, I had a loan with amigo. It was repaid by my guarantor. The guarantor has received his email that they upholding his claim and he needs to accept it on the online portal. There is nothing in his online portal it says there is no final response letter yet.
Also, I as a main borrower haven’t received any emails at all on regards to my loan.

The guarantor needs to contact Amigo and ask where he should accept this.
Hopefully your claim too will be upheld – it it isn’t, appeal. If that is refused, well this is just a normal very expensive bad credit loan once the guarantor is released – if you have difficulty paying it you can look at a debt management plan to pay it off at a low affordable rate or insolvency to clear the debt.

Hi, Part of the evidence I submitted was the amount of extra loans I had to take on between my second and third top up and one resulted in a CCJ 2 months before a took the third top up (the third and final, and double the amount of the 2nd top up). Is this something that you think would likely result in my claim being upheld due to unaffordability. Currently waiting like a lot of people so patiently holding my breath but any guidance (which I won’t hold you accountable for xD) to give some reassurance, I’m don’t completely understand the criteria as what constitutes as ‘unaffordable’.

How I can see Amigo telling one and same thing 8 to 10 weeks…. after 2 months (8weeks) they telling again same…. 8 to 10 weeks. I called to them in March and got answer after 8 weeks all complaints will be assessed, phoned again in June and again after 8 weeks at the end of August, phoned again in August and again in 8 weeks and plus now added extra 2 weeks and become 8 to 10 weeks as per curiosity call to them today and no changes still 8 to 10 weeks. Top up November 2017 £5,500 60 Months
Top up January 2018 £7,000 60 Months.

I went to the Ombudsman 2019 and they had the guarantor released.
The outstanding balance was then left to me to pay off.
I never heard anything from them and I entered into a DRO March 2022 which entered March 2023
All debt was entered into the DRO and my partner also entered one.
Yesterday I received a letter from Amigo loans saying I still owed them money and to make contact with them to arrange to make payments.
I emailed them with all the information from the Ombudsman and DRO They are saying that they have no records of the account being in a DRO.
All loans from Amigo loans have been closed on my credit file and marked as satisfactory.
I’ve looked on the list of creditors on the DRO and Amigo isn’t listed but there is an account with Lattern ?
I was sure it was included in the DRO as citizens advice sent letters to all credit references agencies asking for a list of all creditors on my credit file and Amigo was definitely on it.
Can you advise where I stand?
I’m an unpaid carer and out of work and I definitely can’t afford to make any payments.
I also had a appeal in with them back I’m 2019 for giving the loans unfairly.

When the DRO was put in place there was a list of creditors and now I’ve looked back there isn’t list of Amigo loans and I’ve just looked the one for Lantern isn’t for Amigo.
So I’m going back to citizens advice as they are saying that this debt is still in place and unless I can prove it was in the DRO I will need to make arrangements to pay. It was reduced after I went to the Ombudsman and there’s 2456 left to pay. Which I definitely can’t as I’m struggling to get back on my feet after DRO ended.

Loan was for £1000 I paid £1877 back something like that. Think I know what’s happened through I changed banks while paying the loan off, so rang halfway though and changed payment details to someone else’s and we just left it like that, so it came out of someone else’s bank but I sent the payment standing order to them, so although I paid it all halfway it was someone elses account, I’m assuming it’s that.

Hi please could you help. My son had an amigo loan which wS unaffordable and he was taking more loans out to pay others and it was spiralling out of control. I’m 2019 I paid his amigo loan off as I’d retired to care for my mother who had dementia and received a lump sum. I couldn’t handle the stress. My son and myself both made complaints for redress. My son has received his reply to say his claim has been upheld but he is not due to redress as he paid less than the loan was for himself. Does this mean the same for me as guarantor as I paid the full amount he still owed £5500 or may I still be entitled to some redress. I have not received my reply yet.

I raised my complaint with Amigo over two years ago now and I’m still waiting for the outcome. I have two more payments to make and the loan is paid off. I chose not to offset in case my claim was not upheld and did not want to harm my credit file any further or impact my guarantor. If they uphold my complaint then the payments for the last year or so would be returned / taken into account for the full payment due? And not limited to the 17p in the £? Is this correct or did the money that was supposed to be in trust only matter when they were hoping their preferred scheme would be in place?

I’ve just received my email, but slightly confused. Both claims have been upheld…..but it says Total Cash Claim Value = No Redress Due. I log onto the portal and it says interest payments refunded totals £1785, and I have the option to amend bank details. I have accepted decision for both loans and it just says thank you for submitting an acceptance……and not had anything in reply via email….
.so am I getting a payment or not ??. Thank you.

My Guarantor made no payments. I accepted because I have no further documentation to elevate the claim, and the portal said refund of £1785, so assumed I would get this…..but if not, then there is not much I can do.

You have no reason to appeal this decision. This would not get you any further money.
You should log in to the portal, accept the decision and give your bank account details.

So, I’ve accepted on the basis of your notes…..which infact are incorrect, and now I can no longer appeal as I’ve accepted. Don’t get me wrong, I’ve never really expected anything, but if the claims have been upheld and they have stated a refund ( not redress) of £1785, am I likely to get it. ?. I have no faith in actually getting hold of Amigo to question it with over 200,000 claims on their books…..lol

I think you need to ask Amigo why the portal says “interest payments refunded total 1785 but total cash claim value says no refund due. the normal explanation for this is that your guarantor made payments.

Under the terms of the Scheme, in order for a borrower to be entitled to receive any redress, they would need to have repaid more than the Loan Amount(s) you originally borrowed yourself. (this does not include payments from your guarantor.)
As we did not receive payments from you that exceeded the original Loan Amount(s) borrowed, I can confirm that you are not entitled to any cash claim under the Scheme. As your loan is settled and closed, we can confirm that no further payments are due or any balance is outstanding.

Specifically all the payments were made by you, not by your guarantor? I suggest you phone them up and ask to speak to a manager to get an explanation for they say No Redress Due, explaining that you made all the payments.

I give up !!!, Three emails sent, all requesting information regarding the interest refund. Not one answering the direct question as to what the refund is, and will I get paid it. Just the basically generic reply, no redress due. I have looked at the Summary and my guarantor did pay the remaining balance as she was fed up with the high interest Amigo were charging…………so I may understand why no redress is due…….BUT STILL do not understand the interest refund part ?, and no my guarantor has not made a claim. I have just looked at my credit score. I have noticed that it has been sold off to Lantern. It says that £400 is still owed. My loan was paid in full last year. Also I have looked at my payment history from now to when I took it out and every month says in default. I’m furious. I never missed a payment all the time of having the loan. Even though I was struggling to find the monthly payments. How can I get this removed.

I suggest you contact Amigo and ask why your loan has been sold to Lantern as you do not owe a balance and the loan was cleared in month/date. Also ask when you will get a repsonse to your complaint.

Were all your loans upheld? If a loan with negative marks on your credit record has been upheld, then they should be removed no timescale for this happening though

Yes – I only had one loan with them – although this was for £10k – this has been upheld in full, but does have negative impacts on my credit history – glad to hear that this will be rectified at some point!

No, it is only later payments that have been protected by the trust arrangement. If your claim is upheld, then you should be paid the same % that is paid to everyone else – the current estimate of that is 17% but that may change.

So my loan has been upheld, however no cash refund due. Original loan was 3.5k I have paid half of it and then the guarantor paid it in full. I have paid quite a lot of interest and still no refund due?!
Should I dispute it? Surely if it wasn’t affordable the interest I have paid should be refunded?

My claim has been upheld but zero redress because loan was paid in full by guarantor and the payments I made myself were not more than the loan amount.
Guarantor was unable yo submit a claim as the system wouldn’t let her as she wasn’t the borrower.
I’ve made an appeal but just wondering where we stand?

I’m still waiting. Wish they’d hurry up. I’ve won a complaint at the ombudsman and if the amigo outcome comes in my favour I will have a perfect credit file for the first time in ages. So frustrating to still be waiting after all these years.

I’m still waiting. I made my initial complaint August 2020. Then went to FOS and by the time it was seen by then Amigo had gone into this ridiculous system. So I’ve been waiting for this for over 3 years.

I made a claim and today received a email saying it was upheld but no redress because I paid back 5k of a 10k loan. My dad was the guarantor and he paid off 10k to clear loan. Total paid back 15k. My dad never made a claim as we thought it would all be under one claim and was never advised to make separate claims. Does this mean my dad won’t get paid any money back?

This is causing problems for a lot of people. I suggest you reject it saying that this was not properly explained to you or to the guarantor so wither the money should be repaid to you or to the guarantor

I called them today they said they texted and emailed my dad inviting him to make a claim. My dads 72 years old he don’t have an email and he does not use text on his mobile. He don’t know how to. I have rejected the outcome and emailed to complain explaining that we both thought that my claim was for the both of us but I don’t think we will get anywhere with this. Is it even worth it complaining to the ombudsman?

I had £4,991 interest refund but total cash claim value £0 and same comments saying

Had original loan then several tops ups, always paid but then went off work sick so made arrangement to pay with them and stuck to that until then my nan passed away so my mom (guarantor) paid of the outstanding

Hi Paul, I had the exact same response. Uphold but not entitled to redress on 3 consecutive loans. I selected escalate on the decision as I believe I should be entitled. Very frustrating as I believe if I accepted this decision I would receive nothing.

Hello, I had an affordability complaint upheld by amigo in 2019 and this resulted in the refund being taken away from the balance with leaving me £3243 to pay back. After this i made few payments of £144 which put the balance down to £1956 and then I stopped making payments in 2021.
I submitted a claim as soon as the opportunity became available and still waiting to hear back on this. However, I’ve noticed within the last week I’ve been receiving phone calls from amigo and today had an email stating that I haven’t made a payment since 2021 despite not hearing from them since then.. how can I go about this as I don’t wish to make any further payments and would like to know if my claim was upheld or not.

ok so your guarantor will have been released when the current loan was upheld. This is just a normal loan for you. Tell Amigo you are disputing the debt and ask them to make a decision on your claim.
If you have a lot of other debts, then this may be a good time to consider your debt options for all of them

I read in earlier comments that any money paid by guarantor does not count toward my total payments. My question if all or just some of my loans are upheld what happens to the money my guarantor paid. On those loans that are upheld.

I know amigo has all as I spoke to them a while ago. Just wondered if anyone else is still waiting.
