And the deadlines have slipped yet again. There are just under 4,000 people still waiting for a decision, or a revised decision after winning an appeal, or a recalculation.
There are also now (21 August), about 8,000 people where Amigo has wrong or missing bank details:
- this includes £1.7m of redress to be paid “in full”, and
- £2.4m of Initial Scheme Payments.
Most of these are people with loans taken out longer ago, so their contact details may be out of date too. And some people are worried the emails or texts they are getting about updating their bank details are a scam.
If you haven’t already been paid, check and double check the bank account details on your Portal Account. If you can’t login to the portal, call Amigo on 01202 629798 and Amigo will reset your portal login.
If these amounts are not paid by the time the second payment is made later in the year, you can’t get paid afterwards as all the money will have been distributed.
24 June 2024 – my summary of the situation:
- People who have not yet had a first decision email (FRL) If you haven’t had a recent communications from Amigo apologising for the delay you should contact Amigo urgently.
- People who have escalated a decision No-one has yet had a revised decision after winning an appeal.
- People whose defaulted loans have been sold to Intrum before 2022 It still isn’t clear whether cash refunds will be paid by Intrum or Amigo.
- People who are waiting for a “full refund” to be paid Some dates seem to have not been paid. Some people are still waiting for recalculations of the 8% interest and any recent payments.
- People who are waiting for the first percentage payment to be paid Some dates seem to have not been paid here as well. Some recalculations seem to be being done – I don’t know why unless Amigo messed up the numbers the first time!
- People who do not understand what they are going to get
If you don’t understand your decision email (FRL) post a screenshot of it in the Facebook group. - People who have been paid “the wrong amount”
If you have been paid “too much” or had 2 payments, it may well be that you have had a full refund and a first percentage payment.
If you think you have been paid too little, post a screenshot of your decision email in the Facebook group or phone Amigo up. A few people have been paid too little and got this speedily corrected. - People who have been paid the first percentage payment (and the full refund if relevant) and are now waiting for the second one

29 May 2024 – first scheme payment will be 12.5p in the £
- Amigo says “substantially all” claims have been determined and adjudicated – 99.2%
- it knows enough to be sure it can pay 12.5p in the £ so that is what it has set the Initial Scheme Payment Percentage at.
- you will get 12.5% of the amount on your Amigo email decision labelled Total Cash Claim Value or Scheme Cash Claim
- you will be paid this first amount within the next 30 days, or within 30 days of receiving an accepted Scheme Outcome, whichever is later. So the large majority of people should get this in June 2024
- Amigo says it will prioritise payments based on correct bank details being provided and age of the Outcome Letter issued (oldest to newest).
- Amigo is still saying at least 17% for the total amount to be paid, so that means 4.5p in the £ will be paid late in the year
10 April 2024 – 94% of decisions issued
- nearly a month late, Amigo still hasn’t quite reached the target of 95% of decisions it is said it would achieve by mid March
- it now expects to have issued over 98% decisions by the end of April, with the rest coming in early May
14th March 2024 – Amigo gives a clearer payment timetable
Decisions:
- Amigo has now crawled up to 91% of decisions issued.
- they now say they expect to issue 95% of all decisions 22 March 2024, with the remainder being issued by mid-April 2024.
“In full” payments
- payments have started for the “In full” refunds;
- where a decision was issued on or before 1 February and you do not have a live loan, your payment should be made by the end of March
- where a decision was issued on or before 1 February and you do have a live loan with a balance outstanding, your payment should be made by the end of April
- where a decision was issued after 1 February, your payment should be made between mid April and end May
“Percentage” payments
- it still expects to be paying at least 17p in the pound to people expecting to get the “percentage” refunds
- it has rowed back from saying it expects the first instalment of the percentage payments to be made in April or May. It now says that it expects to “declare an interim dividend” in April or May – that is the percentage that it will pay as the first instalment, eg 10% or 12% say. And it expects payments of the first instalment to be within 30 days of making that statement about the amount.
- so they could be in June…
Appeals
- where there has been an appeal, the time will be confirmed in your decision letter.
27 February 2024 – another delay to decisions & payments
- Amigo has still only got up to 88% of decisions issued
- it now hopes to have issued over 95% of decisions by mid-March 2024, with the rest being issued in early April
- Amigo expects to start paying the “in full” refund amounts at the end of February, but these will be done in batches so not everyone will get theirs then
- the payment of the first installment of the “percentage payments” has been put back to April or May with the final installment about 6 months later.
A reminder of who may get some “in full” refunds:
You have to have repaid at least the amount you borrowed.
From that point, you may get a full refund, not at 17%, depending on the date of your complaint/claim:
- you will get a full refund of payments made after 1 December 2021, if you had complained before that date;
- you will get a refund from the date you complained if that was between 1 December 2021 and 26 May 2022;
- you will get a full refund of payments after 26 May 2022, if your first complaint was in the Scheme.
1) only the statutory 8% interest added is taxable. Not the interest paid that is being refunded – that is your own money that you are getting back.
2) the statutory 8% interest added is taxable as savings. BUT everyone has a Tax free savings amount of £1000 for basic rate taxpayers and £500 for higher rate tax payers in a year.
4) in previous administrations & schemes, I don’t recall anyone having tax deducted from the 8% part which is paid out as a percentage, expected to be 17%. If this happens, Amigo will have to inform you of the amount of tax deducted and you may be able to claim some of that back from HMRC.
Previous months updates
January 2024
- on 25 January Amigo admitted it has only sent out 75%
- of decisions. This is only 2% more than on 9 January.
- it says “We anticipated that all responses would be issued by the end of January 2024, however, the remaining work and complexities in assessing and calculating certain claims, especially for some claimants with outstanding loan balances, has taken longer than initially anticipated. Although responses are still being issued, and will continue to be, our intention is to issue all responses by mid-March 2024.”
December 2023
- the Amigo scheme page now says they have issued 71% of decisions
- Amigo has told some people with current loans to stop paying
- decisions for current loans are being sent out but not many so far
- if you have made recent payments, some may be refunded in full. In the decision you are sent, these are being called “set off refunds”. The “total cash claim value” on the decision is the amount that will be paid at a reduced percentage, expected to be about 17%.
- Amigo has issued 45% of decisions
- Amigo has been deleting a lot of loans from all three credit reference agencies . If your loans have been cleared, this is probably because your claim will be upheld. But this isn’t definite until you get the claim decision.
October 2023
- Amigo has issued 38% of decisions. It says almost all the rest should be issued by the end of December and they will all be issued by end January
- the process to remove CCJs will continue to March
- Amigo is confident the payout percentage will not be less than 17%
- it is now clear that Amigo not going to pay many borrowers where the loan has been upheld as unaffordable but the guarantor made some payments. This is ethically wrong and entirely unexpected – redress from mis-sold guarantor loans has never been handled like, by Amigo before the Scheme or by the ombudsman. You can appeal but it isn’t clear that this will succeed.
- the best estimate of the percentage payout is still at 17% but this can still change.
- Amigo now says: “We expect that the initial cash payment to customers will be in early 2024. We are unable to confirm the dividend and make interim payments until almost all claims have been decisioned in full, causing the delay from November, as previously expected. The final payment will be delayed until late 2024 (around the time that the business enters liquidation).”
September 2023
- the first rejections for current loans are going out. If this loan has caused you problems, appeal a rejection.
August 2023
- the first UPHOLD decisions are at long last being issued
- if only some of your loans have been upheld, look at an appeal. The first person has reported winning an appeal.
- some loans have been sold to Lantern. In most cases these are loans where neither the borrower or the guarantor made a claim.
March 2023
- Amigo has announced it cannot raise the money from shareholders so it will be liquidated
- this Scheme continues in “Fallback Mode” – see Amigo to close & Scheme goes into Fallback for details
- it is now expected that Amigo the first payments may be made in late 2023 and there may be a second, sm
aller payment in 2024.
December 2023
- The deadline for making claims to the Amigo Scheme was 26 November 2022. It is now too late to make a claim.

Amigo’s Scheme – the background
Amigo’s Scheme of Arrangement is now in operation after it was approved by the court on 23 May 2022.
The Scheme was proposed because Amigo couldn’t afford to carry on paying full refunds to its borrowers and guarantors who were winning affordability complaints.
Amigo had proposed a different Scheme in 2020 that was rejected in 2021. Amigo has now spent nearly a year getting its current Scheme proposed. For more details on the first Scheme, why it was rejected, how the second Scheme is different, and the voting on the second Scheme, see Articles on Amigo Schemes.
In the Scheme, Amigo makes the decision about whether your claim should be upheld. If it is rejected or only upheld for some of your loans, you can appeal this decision to the Independent Scheme Adjudicator. You cannot appeal to the Financial Ombudsman.
Which loans and customers are covered by the Scheme?
All loans made by Amigo before 2021, including those under its previous brand name FLM, are included in the Scheme. For loans that were settled more than seven years ago, Amigo may no longer have the loan details. You can still complain about these older loans but it may be necessary for you to produce evidence about them.
Both borrowers and guarantors could make a claim to the Scheme.
Amigo has started lending again with a pilot scheme under a new brand, Reward Rate. Any complaints about new loans will not be covered by the Scheme and customers will be able to make a complaint about them as normal – first to Amigo and then to the Financial Ombudsman.
The definition of “unaffordable”
A loan is only “affordable” if at the time the loan was given, it was likely that you could repay it on time and still be able to pay your other debts, bills and everyday living expenses.
If paying Amigo left you so short of money you had to borrow more or you got behind with bills then it was “unaffordable”. This often happened with Amigo loans as many borrowers were desperate to try to protect their guarantor.
Amigo should have checked that a loan would be affordable for both the borrower and the guarantor. For a guarantor, this would mean that they could make all the repayments out of their income and still be able to pay their own debts, bills and living costs. A guarantor who had a house may not have had enough spare income to repay the loan so it was unaffordable.
But Amigo’s affordability checks were very poor. That’s why they were losing 88% of cases at the Financial Ombudsman.
Amigo often offered top up loans and the checks on these weren’t any better, even though people were getting deeper into debt. Repaying the first Amigo loan may have left you in financial difficulty, so a top up loan may have appeared to be a good option, even though it made your debt situation worse.
What will you get if you win the claim?
When Amigo upholds a claim, it will tell you what the “redress” calculated is. You will only get paid a percentage of this, not the full amount (unless some of your payments are very recent).
Redress for a borrower who has a claim upheld
For a borrower with a repaid loan, redress will be:
- a refund of the interest they paid on the loan;
- plus 8% statutory interest;
- Amigo is making a deduction if your guarantor made any payments. If your guarantor has also made a claim, they should be refunded. If they haven’t then no one is being refunded for these amounts. You can appeal this decision, which is ethically very wrong, but it is not clear it you will win.
For a borrower with a current loan, redress will be:
- a refund of any interest if they have repaid more than the amount borrowed plus 8% statutory interest, otherwise, their balance will be reduced;
- their guarantor will be released;
- if there is still a balance after the reduction, you can make a lower affordable payment arrangement to clear it.
In addition, any problems on your credit record will be removed for loans that are upheld. This will include having any CCJ removed (the legal term is set aside) and removing the default showing on the debt with Intrum if your debt was sold.
Redress for a guarantor who has a claim upheld
A guarantor’s redress is the full amount they have paid to a loan, not just the interest, plus 8% statutory interest. And if there is a current loan, they will be released as guarantor.
Previously it had been expected that guarantors would be refunded if a borrower won a claim that the loan was unaffordable even if the guarantor had not made a claim. It has now become clear that Amigo is reducing the payments to the borrower and refusing to pay the guarantor where the guarantor has not claimed.
8% statutory interest
This number is NOT 8% of the interest you should get refunded.
It is 8% per year from the time of the repayments until 28 February 2022. So if your loan was settled several years before 2022, you may get 20% or more added.
BUT you will only get a % of this redress
That redress figure may look great. But you are not going to be paid that amount, just a percentage of it.
Amigo originally estimated that at 41p in the £. If your full redress is say £3,000 that would have meant you will be paid 41% of that – £1,230. But a lot more people made claims than Amigo expected – 210,000. That has reduced the amount you might get to 20p in the £.
And with the March 2023 announcement that Amigo has failed to raise the money from shareholders, there will be less cash to be refunded. The amount is now expected to be about 17p in the £.
So from a calculated redress of £3,000 you may get £510.
Exception – full refund for “continuing payments”
Some customers will get a “full refund” of certain payments they made to the loan provided that they have repaid at least the amount they borrowed and their claim is upheld. These customers are due a full refund of payments:
- from 1 December 2021, if they had complained on or before that date;
- from the date they complained, if that was between 1 December 2021 and 26 May 2022; or
- from 26 May 2022, if they did not complain before the Scheme started.
This is set out in full in 6.33 of the Explanatory Statement.
The purpose of this is so that if your claim results in a refund, payments you made after the relevant date will be refunded in full provided that you have repaid more than the amount you borrowed. For a guarantor getting a refund, the “repaid more than you borrowed” test does not apply.
Here are three borrower examples:
- a borrower who made a complaint in March 2021 (so before 1 December 2021) and who at 1 December 2021 had already paid back more than they had borrowed will get a full refund of payments they made after 1 December 2021
- a borrower who made a complaint in March 2022 (so after 1 December 2021) and who in March 2022 had already paid back more than they had borrowed will get a full refund of payments they made after that date
- a borrower who made a claim to the Scheme in September 2022 (so after the Scheme had started) who by 26 May 2022 had already paid back more than they had borrowed, will get a full refund of payments they made after 26 May 2022.
What happens after you make a claim
The deadline for making a claim has now passed
Keep an eye on your claim
When you have made a claim, you may not hear anything for months.
Amigo may send you an email when they have decided your claim saying you can log in to the portal and see the result.
But it is a good idea to check the portal every month or so even if you haven’t had an email. They may have sent you an email that you missed as it went into spam.

Working out how much people will get
When Amigo have decided all the claims and appeals they can then add up the total amount of redress. They then divide that amount by the money they have to distribute – this gives the “pence in the £” amount they will pay.
This will probably be done in two stages. There will be a first, larger payment possibly in the first quarter of 2024. And then a small payment in 2024 to pay out the remaining money.
Should you appeal a decision?
If your claim has been rejected or only partially upheld With some loans upheld and some rejected – you can appeal this decision.
You are the one who knows how much trouble the Amigo loan caused you.
The first Amigo decision will probably have been an automated “Computer says Yes/No” decision – they have had 200,000 complaints to decide. But in the appeal process, this will be looked at by a human.
You should also appeal if you don’t agree with the numbers given. If you think you had more loans than were listed. If you don’t know why the Total Cash Claim Value is less than the other numbers suggest.
Get more loans upheld
Getting more loans upheld will:
- increase the cash you are paid, or reduce the balance you owe
- if you get earlier loans upheld, the extra 8% added amount will also increase
- if your current loan is upheld, your guarantor will be released.
If you have bank statements or any other evidence about your finances at the time you took a loan, include that with your appeal. These will help your case.
Credit records
Getting more loans upheld will also clean any problems on them from your credit record.
If your credit report is wrong at the moment eg because Amigo did not add a default when you stopped paying, then it is important that in your appeal you say why the loan should be upheld. BUT ALSO say that if the loan is not upheld, you want a default date added to your credit record back in month/year “in accordance with the SCOR reporting rules”. Defaults drop off your credit record after 6 years – a non-defaulted debt will stay on your credit record for 6 years after the date it is settled.
HOW TO APPEAL
If you think the numbers are wrong, say why.
If you made all the payments but Amigo seems to think your guarantor made some, challenge this.
If you think more loans should be upheld: Get bank statement for 3 months before the loan started – these are the best evidence that a loan is unaffordable. You can get these going back at least 6 years even from closed accounts. Don’t assume you won’t be able to, ask for these immediately from your bank. If the loans are more than 6 years old and the bank account has been closed, look at what other evidence you have – payslips, P60s, tax returns, emails about missed payments or CCJs etc
Download & send a current credit report, eg TransUnions’ Statutory Report. If you have had loans deleted from your record because of winning other affordability complaints, send Amigo evidence about these.
Explain about recent problems before the loan application – only on benefits, health issues, gambling, economic abuse, recent missed payments, payments arrangements, DMP etc
And if you were topping up a previous loan, explain how that loan made your situation worse.
If all of your loans have been upheld and the numbers look right
You have no reason to appeal this decision just because you will only be paid a percentage of this. This would not get you any further money.
You should log in to the portal, accept the decision and give your bank account details.
Sale of loans to Lantern
In August and September 2023 some people have been notified that their loan has been sold to Lantern, a debt collector. The sale of loans to a debt collector is perfectly legal and you can’t challenge this.
In most cases these were loans where no one had made a claim to the scheme. If your loan has been sold and you had made a claim to the Scheme which has not been assessed, ask Amigo why.
The loans are being sold as guarantor loans – the guarantor has not been released and if the borrower doesn’t make an arrangement to pay the guarantor will probably be asked to.

No – the interest waived is just one of the intermediate steps in working out your refund
total cash claim value £3.199.16 so why does it say total borrower refund being £16.314.61?
The common reasons why the total cash Claim value is less than the total borrower refund are:
– the guarantor has made some payments – did they?
– there is a balance still open which is being cleared – that doesn’t apply in your case
– there is an amount which is being refunded in full – that doesn’t apply in your case
– there was some write off due to the borrowers insolvency – you said you repaid the loans in full so that cant apply
– you have previously had some redress paid before the scheme – you complained too late for that…
So unless your guarantor has made some very large payments, this result looks odd – you should query it with Amigo

yes they made some payments on my final loan i repaid she just paid each month with her card but had the money from me during the month it was mainly because my bank account i had my original direct debit went into ovverdrawn status around the time, so i changed my bank account to ensure my wages/child tax credits etc wasnt going to swallowed up before making repayment with the bank itself so my guarantor rang up & paid the monthly installment via her debit card with the monthly payment id given her to pay it basically thier was mever any late charges kind of thing as we always rang & made the payment on the correct payment date it would of usually of been debited but no defaults/charges etc as the agreement was paid still on the agreed date
They have sent breakdowns for each loan which im unsure on aswell because x2 of them doesnt seem to have the 8% interest amounts they just say £0.00 on x2 of upheld loans but on the intrest waived amounts they state £ over a thousand on 1 & over2 thousand on the other but as these was repaid a while ago aswell i would if thought even a £1 figure aside the 8% interest would be visible not just £0.00 i will post the breakdowns in aseperats msg box

ok so the problem here is that Amigo is treating a LOT of the payments to your loans as coming from your guarantor. It will not refund you those amounts. Unless your guarantor has also made a claim, then no one is going to get those refunds.
the 8% is only paid from points where Amigo owes you money, not where you opwed Amigo. So it is normall for laons that were topped up to not have any 8% interest added.

There are two parts to the decision – the first is the decision on each individual loan whether it was affordable or not (Defend and Uphold in Amigo’s terms). So you may be happy with most of the decisions but one, which you can escalate.
The second part is the calculation of what the redress is. The claim value per loan is the interest waived plus any fee refunds plus any 8% interest.
But the summary takes into account not just the loan accounts, but who made the payments to it – and in your case Amigo will not refund you for the large amounts your guarantor paid.

How would i know if the guarantor had claimed any refunds on this as upto now ive asked but they said they hadnt as i had one of my monthly payments paid into thier account as a guarantee the payments each month wouldnt be missed then they used to transfer my payment over to my account on the direct debit date untill i ended up not banking with bank id set up my direct debit for, So then after this they would just call to pay the monthly repayment obviously back then i had no idea this would arise
as i would of thought it would of said on my loans that state upheld it would tell me theyve already been claimed for + amounts paid etc
but other than me asking them which i have already how else would i know?

I received my outcome this week. I was the guarantor, and made all payments from sep 2018 to may 2022. When the last payment was paid. It was closed in 2022. I paid over £10000 in that time with stepchange. On my outcome it says guarantor payments £0. And all there going to give me is £30 redness. Surely this isn’t right?? Please can you advise me.

No that isnt right. It sounds as though they have treated the payments from StepChange as not coming from you – but Amigo would have been informed by StepChange that to you were in the DMP and they should have treated the payments as yours.

Is the interest compound interest from when you settled the loan? I actually settled the loan quite a few years ago. It makes a big difference to my claim if it is.

The interest refund is the interest you actually paid. The 8% is “simple” interest, per year but not compounded

I complained in 2015 about affordabiliy and that Amigo only care about the guarantor ability to repay. It was not upheld. I then took to Ombudsman and againt not upheld. I also highlighted Amigo bad practises to FCA.

I’m sorry about that. In 2015 the very first affordability complaints about payday loans were just starting. Amigo was winning almost all cases at the Ombudsman until late 2018/early 2019 when the cases started to go to the affordability specialist team that didn’t even exist in 2016.

My appeal was upheld over two months ago and Amigo have told me they have no time frame for when upheld appeals will be looked at. I raised a dispute with transunion over Amigos reporting on my credit file, but it’s been unsuccessful. I’m guessing upheld appeals will be the very last thing that Amigo do. Really frustrating that they just say there is no time frame at all. Not even giving a ball park date.

2. I complained to Amigo Loans that in 2019 about my loan and told them that they should not have even approved the loan at the time as I had a DMP with Stepchange in place. I made the complaints using ‘Resolver’ – Amigo at the time refused my complaint. However, now with the redress, they have accepted responsibility, so am I entitled to somehow claim the full amount back?

I sent the claim in 2019 to the FOS, but they didn’t get back to me – I then chased up in 2021 and then they mentioned that I had to go through the redress scheme that Amigo were doing themselves.

I just checked my case with resolver and for some reason, there is a missing email to which I agreed for the FOS to look into my claim in 2019 – however, when chasing this up, it only shows when I resubmitted my escalation to the FOS confirming that I was happy for them to look into it. By then, they responded to tell me Amigo were looking to implement their scheme and there was nothing that I could do about it and have to wait for them.

So it’s FCA got involved and Amigo had more claims than they could deal with . Amigo stopped dealing with affordability claims and set up the amigo scheme of arrangement . They would have write to you telling you to lodge a complaint via the scheme .
Personally I think you may be too late at this stage. Phone Amigo and ask do you have any redress .

I have finally got the decision through re the claim
I lodged on behalf of my sister and I have been successful in getting her name removed.
Unfortunately it has highlighted there wasn’t one contact with Amigo Loans but four (totally £30,000 without the interest) that she was standing guarantor for.
In total my sister stood guarentor for various loans and top ups for two people she works with to the tune of just under £100,000 across five sub- prime lenders.
Is there any sort of national register of people who are not fit to stand guarantor that I can sign my sister up to?
It’s taken me six years to sort the loans out that I know about. There may be more and this has destroyed our relationship as I’ve found out she was still signing guarentor contracts as I was working to get her name removed from others.

I think guarantor loans should be banned for consumer lending . In hindsight the £24k I paid amigo would have been 1/2 the cost if my guarantor took out a loan on my behalf . There is no way my sisters family can get her to stop what she’s doing – even if we could prove she is mentally unstable because even this nightmare isn’t enough to be able to remove her name from the house deeds.
You only need some bitter spouse to do this to spite their partner during a divorce.
I’m contemplating seeing if I have a case against the guarentor loan companies that I’ve had to deal with for the distress this has caused me and continues to cause me.

Your sister has a Case against the borrowers as well as the lenders. But you do not.
I’m sorry but the simple way to extricate yourself from this situation is to stop helping your sister. As soon as she gets defaults and a CCJ the lending will stop. You re doing her and yourself no fvours by helping her to challenge the loans .
Alternatively look at selling the house – you cant want to live with your sister – owning a house jointly is not suitable.

With the sheer number of loans she was standing guarantor for (nearly £100,000 without the interest) I thought our house would be forfeit if it went to court.
I’ve stepped back now any way because the stress is doing me no good and am just trusting she doesn’t do this again.
Of course letting her get a CCJ would be for the best so if she does stand guarentor for a loan elsewhere to cover the £8,000 owed to Amigo Loans that might happen.

Houses aren’t “forfeit” automatically if a lender gets a CCJ. The lender can get a charge over the house, but as you own half, this would just be a restriction not a charge. See https://debtcamel.co.uk/charging-order-sale/ and talk to National Debtline for more details about this.
The lender could also apply to make her bankrupt. This is VERY rare. But if it happens, your share of the equity would be repaid to youafter the house is sold.

She’s told me she is debt again after my parents bailed her out again.
My Mother has since died and Dad is refusing to help her so she was never able to meet the repayments on all of the loans that were running concurrently for these two women. That was part of the argument that I put forward in the various complaints ive raised over the years.
Does she want to stop doing this? Thats anyone’s guess.
She didn’t stop even when our Dad told her he would disown her if she did it again – four months later she guaranteed the £10,000 loans through Amigo that is raised the claim for.
There is approx. £8,000 outstanding to Amigo and my fear is the borrower will now go to another subprime lender to raise the cash and ask my sister to stand guarantor again.
I don’t live with my sister so it was only through pure chance that I found out what was happening when a summons to court came through the door whilst I was visiting her at our house. So if she continues to do this I’ll have no way of knowing.
That’s why I’m hoping there is some kind of national register I can put her details in to stop lenders taking her on as a guarantor.
She did agree to taking her name off the deeds to the house (the only way we could think of to stop her) but has since refused two days ago when I sent her the decision from Amigo Loans.

I’m sorry but unless she wants to do to stop, there is nothing you can do. The best thing may be to stop helping. Getting a CCJ will probably end people being prepared to accept her as guarantor.
There are a lot fewer guarantor lenders these days thank goodness.

The deeds are in both our names but I moved away to live with my partner about ten years ago.
She has actually moved in with our Dad so I’ve been going to the house for a while now clearing out the loft and getting my stuff into storage boxes.
I’m also storing some stuff for a friend who was in an abusive relationship and I’m going to be hiring a van and moving all my stuff out.
I can’t trust her any more and I don’t want debt collectors taking my stuff if it gets to that stage.
She had a letter with a courts summons from one company and that was when I got involved and the borrower at Amigo stopped paying, was put on a payment plan and then stopped paying again last year so putting my sister into the claim scheme stopped them chasing her. She wasn’t opening the letters any way so I only found that when I finally hit access to her account there and read the letters there.
I am surprised there is nothing that can be done. There is obviously a problem. She was alway selfish and controlling but now seems to hate me and that goes back to when I moved away cuz she tells people I abandoned her which isn’t true. I paid my side of the mortgage down before I left.
I’m assuming if she continues to do this I will be contacted by the courts if it gets to the stage of the house becoming forfeit?
It’s been a nightmare.

We are too old now to be able to get mortgages even if we could afford to buy.
I’m not prepared to sell the house to cover her debts. She is in full time employment so can cover her debts. It’s the other people debts she wouldn’t be able to pay if she continues guaranteeing loans for people.
I’ve been successful in getting her taken off all the contracts I’ve found so far, including the one that had gone as far as a court summons. I’m just assuming if she continues doing this I can use the written judgements from those as evidence that the latest shouldn’t have taken her on as a guarentor – especially as it’s been the same two women she had agreed to do this for again and again.

I am quite confused regarding my outcome. My complaint was upheld (I complained to the Financial Ombudsman in July 2021, Aimgo confirmed that they received this complaint around a month later). I was told that part of my refund would be used to clear the remaining arrears and the other part would be a 17p to the £1 return.
What confuses me is that I complained before December 2021 – my loan was for £5000 and I repaid £7114.32 before stopping payments in August 2021. Am I due a full refund due to these terms, or as I stopped paying in August 2021 am I only entitled to the 17p to the £1 refund?

I actually got a response yesterday after sending this. I made a claim for two and both were upheld. I filled my mums claim in for more than that as she was a guarantor for my partner who passed away. Those were denied and one of the ones she was guarantor for me was upheld. The other wasn’t.

The Amigo Scheme website still states that it will be end of February. I have just tried to log into my scheme portal and after putting in the code sent to my mobile, it just takes me to a white page that says “Welcome to Amigo Loans” – so I assume that an update is underway on the portal?

Our plan is to begin processing the first payments from the end of February 2024 onwards. The first payment is the larger of the two, and will be followed by a second smaller payment 6-9 months later, once there is certainty around the timing of Amigo’s liquidation.
The redress process is done manually so this will take a few weeks to execute all redress payments for customers so please be patient during this time.
Our timeframes are estimates and we will contact you closer to the time with more information.

Hi all,
I had my decision on Friday and, unfortunately for me it was rejected. It stated that when the Loan was offered/taken out, it was affordable for me, however, the non affordability side of the claim was upheld and I have been offered £30 for this element.
I really do find it hard to believe how they have reached such a decision. I submitted lots of supporting documents (credit report/s, statements ect..)
Also, my guarantor’s liability was removed by Amigo back-in 2022, this due him lacking the mental capacity to fully understand his role at point of inception.
I have appealed their decision, however, I don’t hold much hope..
Lastly, I can confirm my credit file/s (across the board) have been wiped clear of Amgio. Currently I am in Equitable set-off status (£10000 lend; circa £12500 paid, with an outstanding balance of £7999)

I have one more debt as of now, £4250 for car finance, since 2009 as I had to Voluntary Terminate due to Fracturing my lower spine.
I am on repayment plan for this (2009), however, I was given a default for it. Tbf, the lender has been very understanding unlike Amigo.

Can I ask if you are buying or renting? If you are renting and you lose the Amigo appeal, then the balance will be sold to a debt collector abd you should talk to a debt adviser about a debt releief order or bankruptcy which would wipe out both the Amigo debt and the SMF debt.
If the Amigo appeal is upheld, you still need to consider what to do about the SMF debt. One option is for you to ask SMF to produce the Consumer Credit Act agreement for the original HP – this is now very old and I wonder if they can… if they can’t, then the debt is no longer enforceable in court (I am assuming they don’t have a CCJ for this)

Making and payments (even though I was in an ESO) the customer service agent said my loan is upheld they just working out calculations. Did they tell you to stop. Making payments too?? I should no better than. To. Trust them. Another 4 week’s of sleepiness nights no doubt? Feel. As though this week so far its been a lot of rejections

No, email was sent to I stating that I shouldn’t make any further payments on the account, why would they as I was already in ESO status.
However, when I call the scheme phone-line for an updated (last week-before my outcome), I was that the reason for the most recent delay for a decision was to do with calculating figures, due to my claim more than likely being upheld, obviously totally false information was provided.
Tbf, I am still very shocked and upset about the matter, however, I shan’t give-in until my claim is fully upheld..
Anyway, good luck with your decision and, try to worry too much..

Has anyone been contacted by impaktclaims? I remember years I go I put a complaint in for amigo years ago they said it would be unsuccessful. Now they have rang me asking me to email them the outcome letter to make sure I’m receiving the right amount back. I find it so strange and when I went back on to my amigo log in page my bank account details had been changed to some claim account for the owed money to go into there account. Amigo is saying the first loan was affordable – you can appeal this if you don’t think it’s right.
Your will only be getting about 17% of Total Cash Claim Value £502 – so roughly £85.
That is a lot less than the interest refund number – did your guarantor make any payments to this loan? If not, the Amigo figures may be wrong.

He may also be getting a percentage, probably about 17%, of another figure – is there a number described as Scheme Claim Cash Value? Or Total Cash Calim Value? (That may be the number you called “total cash claim”… Amigo has a lot of confusing terms – different terms for the same thing, similar sounding terms for different things…)
Is he going to give this money back to you? It is essential that he does not do this before the Trust Deed has finished, or you are likely to have to pay in the money to that… Ask him to hold on to it for a while!

Hi, this is probably a little different to what has been said so far and was wondering if anyone could shed any light?
Me and my partner are currently going through with buying a house and we have had a mortgage in principle. However the lenders have stated that one of the terms of getting the mortgage is that my loan has to be settled.
Now, I originally got my claim denied but then appealed it and it has been approved since. I haven’t had my final response letter and have £3180 left on my loan. I have Bren on the phone to amigo 2/3 times per day for the last week and I have asked them to look into if the claim would be enough to wipe the loan and then they could do that asap so that I can say to the mortgage lenders that it has been wiped and I no longer have any debt to them. I have been told that it is being looked at by a company director and I was originally told I would know the outcome they had reached on Monday. I think all these decisions are very individual. Knowing about someone else’s success or failure is unlikely to helpful as the chances of someone else being in this exact situation (claim upheld on appeal, Mortgage in principle) are really small.

My claim (as a guarantor) was upheld, which is obviously good, but I can’t help feeling like a mug… I paid the entire balance of £10.5K in May 2021, as the borrower wasn’t making any payments and the interest was insane. I couldn’t really afford to do it, but I couldn’t afford *not* to do it. Making the payment left me in a lot of debt.
So I get 17% back. If I had just waited until December 2021 or later to pay I would have got all the money back?

Hi Sara can you help me please I’d like advice.
I put in an unaffordablity claim and won with amigo but now they have said that I won’t get any of the redress due to 3,000 being paid off in a lum sum off the guarantors bank card. I rang them and asked to pay a large sum off and the adviser said it would have to be off the guarantors bank card, when I told this to them there’s no note of this being said so I can’t claim the redress and I can’t ask the guarantor due to family issues. I suggest you do two things.
First email Amigo at hello@amigo.me with PRIVACY – SUBJECT ACCESS REQUEST as the title. Ask for a copy of all the personal date that Amigo holds about you including recordings of phone calls.
Second reply to Amigo saying want to appeal this decision, you have just made a Subject Access request. And you also attach a abnk statement whoch shows the transfer of the 3000 to your guarator on dd/mm/yy which was then paid to Amigo as that is what Amigo had told you to do.

Hi Sara. I have phoned amigo this morning, regarding my claim. As guarantor I paid stepchange 10,558.96 this claim was upheld. Loan amount £10000
I guarantored this from April 2017. When the loan was paid. This was a top up, the first loan was 2016. £5000
From aug2018 to Mar 2022. I made all payments Man told me today that they don’t have any payments from myself. On the statement is say bank credit. Nothing from stepchange or myself
On my outcome it say guarantor payments £0.

Can I fight this?? I’m absolutely fuming

Our plan is to begin processing the first payments from the end of February 2024 onwards. We don’t have a specific date as yet, however we don’t expect payments in February. The first payment is the larger of the two, and will be followed by a second smaller payment 6-9 months later, once there is certainty around the timing of Amigo’s liquidation.
The redress process is done manually so this will take a few weeks to execute all redress payments for customers so please be patient during this time.

Absolutely nothing is definite about Amigo’s payout plans. people report what someone at customer services may have told them – that doesn’t mean it is accurate, indeed many reports are contradictory.
I have been saying for some time that no-one should make definite plans for what to do with the money until it is in your bank account.

Amigo sold my friends debt to Lantern, which I signed as a guarantor for, my friend defaulted in November 2022 and this was reported on his credit file which I was not aware of, just a couple of days ago I have seen a default reported on my file by Lantern. I have contacted Lantern to remove this since amigo had a policy of not reporting guarantors and this should be upheld but they have refused. Are they in the right?

I took out Amigo loan in 2019, it was unaffordable from the start and never should have been given, guarantor passed away Apr 2020.
I complained to ombudsman in 2021 and they agreed unaffordable, refunded all interest, no future interest and all marks removed from credit file.
There is still outstanding balance which i havent paid anything towards for 2 years as Amigo would not accept token payments as they said didn;t want to worsen my finances/put it on hold.
I just had email to say lantern have bought debt I am going to get in touch with them to work out pay arrangement to clear balance but before I do my question is as the debt is now sold can lantern add a marker to my credit report if Amigo were told to remove it?

Yes Amigo said attempts to collect payments had been turned off and I wasnt in a financial position after sending them I&E form to make any reasonable payments -balance still sits at about £7800. I have defaulted debts that I have arrangements on to clear with affordable payments each month, all priority bills inc my rent are up to date

I think you should talk to a debt adviser about your options here. I suggest you call StepChange on 0800 138 1111.
Ignoring Lantern is not a good idea – this week the first person has reported getting a letter from their solicitpors abput being tajen to court for a CCJ.
One option is to get a debt management plan from StepChange for all of your debts, including this Amigo balance – Lantern are likely to just accept whataver small amount that they would get in a DMP. See https://debtcamel.co.uk/debt-options/guide-to-dmps/ for info on DMPs.
Getting a DMP is likely to be a lot less stressful than negotiating with Lantern and also probably haveing to renogiate the payment plans with your other creditors.
Another is to get a Debt Relief Order that will clear all the debts including the Amigo balance. See https://debtcamel.co.uk/debt-options/dro/ for info on DROs. StepChange can advise if you would be eligible for a DRO.

Thanks Sara I have had a lot of debt written off already, the debts I have left with other creditors are nowhere near as large as the amigo one, they are timed to be cleared when all the defaults drop off my credit report in Sept 2028. I did ask Amigo to write the debt off a couple of years ago when they said I couldnt afford to pay anything towards it and sent them a letter my GP had written to support my request but they refused. I’m due to see my GP next week again, I will ask her if she can write me an up to date letter that I can send to Lantern and see what happens with that. In the meantime I will reply to Lanterns email and send them an up to date I&E form, my concern was they are going to add the debt to my credit report, a debt which the Ombudsman had told Amigo to remove and wondered that when a debt is sold it has to be sold like for like, i.e. lantern can’t put anything negative on my report.

Mine updates on the 18th but it says they get their info from Equifax and if I wanted to see the changes to log in there as it had already updated. So I did and it literally looks no different so I’m at a loss as to what they’re doing as well. Hopefully it’s a sign they’re looking at our claims

Been told to stop paying and had credit file wiped and both of which has came from them stating it is because you have a upheld or partially upheld claim.
Then for them to start adding loans back on is just not right.

Hi Sarah I made a claim before Amigo got into difficulties and they didn’t uphold my claim I escalated it to the FOS they took my claim onboard then emailed myself saying Amigo had got into difficulties so they would not be able to continue with it. Hi Mandy I had this also I was a guarantor and got fed up with the constant txt messages and emails so I took out another loan to repay amigo after FCO said they were arranging this scheme went through the scheme and I had the claim upheld I will be getting approx £2700 back of £16341. paid. Hi Sara, so I’ve been looking through old emails and found out that my 1st complaint about struggling too pay was actually 2018, I was given breathing space more or less on and off since then. I’ve bad adhd that leads too a lot of anxiety at times and lots of overthinking also… when I got my 1st loan on 2016 I was actually only started full time work 6 months. I applied too amigo and using my mum as guarantor they where happy too give me £10.000 which was paid back at 394.95 monthly, I never missed payments or even used my mum, I also had the loan topped up after 1st 1 as you do. over the breathing space parts which happened 3 times I think I never missed a payment or used mum. From 2021 I was told too pay £28.70 fortnightly which I did up until November last year, I was then told too stop payments plus the loan has completely disappeared from credit rating plus my credit rating has risen quite a bit since then.
Do you think the hold up on mine is possibly because this caused stress too me and was being looked at since 2018… This has took over my days a bit and it’s becoming quite sickening too be honest.
I hope this makes sense as I’m not the most literate person..

No.
Your last loan may have gone on for a long while but it is still simple to add up how much you have paid and do the calculation of what refund you should get.
Amigo is just using “they are complex” as an excuse for its very slow procession. Most of the remaining claims aren’t complex at all.

When I called in a month ago I was told a decision had been made. I called yesterday to be told I was a complex case. They advised I had 3 loans when I had 2 and only have paperwork for two. I confirmed with the guarantor there was only 2. You just don’t know what to think anymore.

Our plan is to begin processing the first payments from the end of February 2024 onwards. The first payment is the larger of the two, and will be followed by a second smaller payment 6-9 months later, once there is certainty around the timing of Amigo’s liquidation.
For those customers who are due a full refund, we will be processing these alongside the interim payments.
The redress process is done manually so this will take a few weeks to execute all redress payments for customers so please be patient during this time.
Our timeframes are estimates and we’re unable to give exact dates but we will aim contact you closer to the time with more information.

Can you paste in more of your figures please. This may be right but it may not be. Amigo has several templates for replies which use confusingly similar sounding terms for different things. And different sounding terms for the same thing.

It will probably be done like a payroll all the information will be there with the payment date they just need to push the button I’m sure they wouldn’t do every one individually. We can live in hope as it might be Thursday or Friday

I don’t think anyone should get payments until all responses have been issued.
The whole thing is unfair and I know for a fact I haven’t received a response when people who complained after me have. I’m not being horrible to anyone, I honestly just don’t trust that Amigo have everything in place ensure people are treated fairly.
Surely the right thing is to pay everyone together once all responses have been issued

You can equally argue that it is unfair to delay paying people whose decisions have been issued.
Sorry what you or I think of the fairness is irrelevant here – what matters is what Amigo will do. And there is no legal or practical reason for them to delay making payments until all decisions are issued.
