And the deadlines have slipped yet again. There are just under 4,000 people still waiting for a decision, or a revised decision after winning an appeal, or a recalculation.
There are also now (21 August), about 8,000 people where Amigo has wrong or missing bank details:
- this includes £1.7m of redress to be paid “in full”, and
- £2.4m of Initial Scheme Payments.
Most of these are people with loans taken out longer ago, so their contact details may be out of date too. And some people are worried the emails or texts they are getting about updating their bank details are a scam.
If you haven’t already been paid, check and double check the bank account details on your Portal Account. If you can’t login to the portal, call Amigo on 01202 629798 and Amigo will reset your portal login.
If these amounts are not paid by the time the second payment is made later in the year, you can’t get paid afterwards as all the money will have been distributed.
24 June 2024 – my summary of the situation:
- People who have not yet had a first decision email (FRL) If you haven’t had a recent communications from Amigo apologising for the delay you should contact Amigo urgently.
- People who have escalated a decision No-one has yet had a revised decision after winning an appeal.
- People whose defaulted loans have been sold to Intrum before 2022 It still isn’t clear whether cash refunds will be paid by Intrum or Amigo.
- People who are waiting for a “full refund” to be paid Some dates seem to have not been paid. Some people are still waiting for recalculations of the 8% interest and any recent payments.
- People who are waiting for the first percentage payment to be paid Some dates seem to have not been paid here as well. Some recalculations seem to be being done – I don’t know why unless Amigo messed up the numbers the first time!
- People who do not understand what they are going to get
If you don’t understand your decision email (FRL) post a screenshot of it in the Facebook group. - People who have been paid “the wrong amount”
If you have been paid “too much” or had 2 payments, it may well be that you have had a full refund and a first percentage payment.
If you think you have been paid too little, post a screenshot of your decision email in the Facebook group or phone Amigo up. A few people have been paid too little and got this speedily corrected. - People who have been paid the first percentage payment (and the full refund if relevant) and are now waiting for the second one

29 May 2024 – first scheme payment will be 12.5p in the £
- Amigo says “substantially all” claims have been determined and adjudicated – 99.2%
- it knows enough to be sure it can pay 12.5p in the £ so that is what it has set the Initial Scheme Payment Percentage at.
- you will get 12.5% of the amount on your Amigo email decision labelled Total Cash Claim Value or Scheme Cash Claim
- you will be paid this first amount within the next 30 days, or within 30 days of receiving an accepted Scheme Outcome, whichever is later. So the large majority of people should get this in June 2024
- Amigo says it will prioritise payments based on correct bank details being provided and age of the Outcome Letter issued (oldest to newest).
- Amigo is still saying at least 17% for the total amount to be paid, so that means 4.5p in the £ will be paid late in the year
10 April 2024 – 94% of decisions issued
- nearly a month late, Amigo still hasn’t quite reached the target of 95% of decisions it is said it would achieve by mid March
- it now expects to have issued over 98% decisions by the end of April, with the rest coming in early May
14th March 2024 – Amigo gives a clearer payment timetable
Decisions:
- Amigo has now crawled up to 91% of decisions issued.
- they now say they expect to issue 95% of all decisions 22 March 2024, with the remainder being issued by mid-April 2024.
“In full” payments
- payments have started for the “In full” refunds;
- where a decision was issued on or before 1 February and you do not have a live loan, your payment should be made by the end of March
- where a decision was issued on or before 1 February and you do have a live loan with a balance outstanding, your payment should be made by the end of April
- where a decision was issued after 1 February, your payment should be made between mid April and end May
“Percentage” payments
- it still expects to be paying at least 17p in the pound to people expecting to get the “percentage” refunds
- it has rowed back from saying it expects the first instalment of the percentage payments to be made in April or May. It now says that it expects to “declare an interim dividend” in April or May – that is the percentage that it will pay as the first instalment, eg 10% or 12% say. And it expects payments of the first instalment to be within 30 days of making that statement about the amount.
- so they could be in June…
Appeals
- where there has been an appeal, the time will be confirmed in your decision letter.
27 February 2024 – another delay to decisions & payments
- Amigo has still only got up to 88% of decisions issued
- it now hopes to have issued over 95% of decisions by mid-March 2024, with the rest being issued in early April
- Amigo expects to start paying the “in full” refund amounts at the end of February, but these will be done in batches so not everyone will get theirs then
- the payment of the first installment of the “percentage payments” has been put back to April or May with the final installment about 6 months later.
A reminder of who may get some “in full” refunds:
You have to have repaid at least the amount you borrowed.
From that point, you may get a full refund, not at 17%, depending on the date of your complaint/claim:
- you will get a full refund of payments made after 1 December 2021, if you had complained before that date;
- you will get a refund from the date you complained if that was between 1 December 2021 and 26 May 2022;
- you will get a full refund of payments after 26 May 2022, if your first complaint was in the Scheme.
1) only the statutory 8% interest added is taxable. Not the interest paid that is being refunded – that is your own money that you are getting back.
2) the statutory 8% interest added is taxable as savings. BUT everyone has a Tax free savings amount of £1000 for basic rate taxpayers and £500 for higher rate tax payers in a year.
4) in previous administrations & schemes, I don’t recall anyone having tax deducted from the 8% part which is paid out as a percentage, expected to be 17%. If this happens, Amigo will have to inform you of the amount of tax deducted and you may be able to claim some of that back from HMRC.
Previous months updates
January 2024
- on 25 January Amigo admitted it has only sent out 75%
- of decisions. This is only 2% more than on 9 January.
- it says “We anticipated that all responses would be issued by the end of January 2024, however, the remaining work and complexities in assessing and calculating certain claims, especially for some claimants with outstanding loan balances, has taken longer than initially anticipated. Although responses are still being issued, and will continue to be, our intention is to issue all responses by mid-March 2024.”
December 2023
- the Amigo scheme page now says they have issued 71% of decisions
- Amigo has told some people with current loans to stop paying
- decisions for current loans are being sent out but not many so far
- if you have made recent payments, some may be refunded in full. In the decision you are sent, these are being called “set off refunds”. The “total cash claim value” on the decision is the amount that will be paid at a reduced percentage, expected to be about 17%.
- Amigo has issued 45% of decisions
- Amigo has been deleting a lot of loans from all three credit reference agencies . If your loans have been cleared, this is probably because your claim will be upheld. But this isn’t definite until you get the claim decision.
October 2023
- Amigo has issued 38% of decisions. It says almost all the rest should be issued by the end of December and they will all be issued by end January
- the process to remove CCJs will continue to March
- Amigo is confident the payout percentage will not be less than 17%
- it is now clear that Amigo not going to pay many borrowers where the loan has been upheld as unaffordable but the guarantor made some payments. This is ethically wrong and entirely unexpected – redress from mis-sold guarantor loans has never been handled like, by Amigo before the Scheme or by the ombudsman. You can appeal but it isn’t clear that this will succeed.
- the best estimate of the percentage payout is still at 17% but this can still change.
- Amigo now says: “We expect that the initial cash payment to customers will be in early 2024. We are unable to confirm the dividend and make interim payments until almost all claims have been decisioned in full, causing the delay from November, as previously expected. The final payment will be delayed until late 2024 (around the time that the business enters liquidation).”
September 2023
- the first rejections for current loans are going out. If this loan has caused you problems, appeal a rejection.
August 2023
- the first UPHOLD decisions are at long last being issued
- if only some of your loans have been upheld, look at an appeal. The first person has reported winning an appeal.
- some loans have been sold to Lantern. In most cases these are loans where neither the borrower or the guarantor made a claim.
March 2023
- Amigo has announced it cannot raise the money from shareholders so it will be liquidated
- this Scheme continues in “Fallback Mode” – see Amigo to close & Scheme goes into Fallback for details
- it is now expected that Amigo the first payments may be made in late 2023 and there may be a second, sm
aller payment in 2024.
December 2023
- The deadline for making claims to the Amigo Scheme was 26 November 2022. It is now too late to make a claim.

Amigo’s Scheme – the background
Amigo’s Scheme of Arrangement is now in operation after it was approved by the court on 23 May 2022.
The Scheme was proposed because Amigo couldn’t afford to carry on paying full refunds to its borrowers and guarantors who were winning affordability complaints.
Amigo had proposed a different Scheme in 2020 that was rejected in 2021. Amigo has now spent nearly a year getting its current Scheme proposed. For more details on the first Scheme, why it was rejected, how the second Scheme is different, and the voting on the second Scheme, see Articles on Amigo Schemes.
In the Scheme, Amigo makes the decision about whether your claim should be upheld. If it is rejected or only upheld for some of your loans, you can appeal this decision to the Independent Scheme Adjudicator. You cannot appeal to the Financial Ombudsman.
Which loans and customers are covered by the Scheme?
All loans made by Amigo before 2021, including those under its previous brand name FLM, are included in the Scheme. For loans that were settled more than seven years ago, Amigo may no longer have the loan details. You can still complain about these older loans but it may be necessary for you to produce evidence about them.
Both borrowers and guarantors could make a claim to the Scheme.
Amigo has started lending again with a pilot scheme under a new brand, Reward Rate. Any complaints about new loans will not be covered by the Scheme and customers will be able to make a complaint about them as normal – first to Amigo and then to the Financial Ombudsman.
The definition of “unaffordable”
A loan is only “affordable” if at the time the loan was given, it was likely that you could repay it on time and still be able to pay your other debts, bills and everyday living expenses.
If paying Amigo left you so short of money you had to borrow more or you got behind with bills then it was “unaffordable”. This often happened with Amigo loans as many borrowers were desperate to try to protect their guarantor.
Amigo should have checked that a loan would be affordable for both the borrower and the guarantor. For a guarantor, this would mean that they could make all the repayments out of their income and still be able to pay their own debts, bills and living costs. A guarantor who had a house may not have had enough spare income to repay the loan so it was unaffordable.
But Amigo’s affordability checks were very poor. That’s why they were losing 88% of cases at the Financial Ombudsman.
Amigo often offered top up loans and the checks on these weren’t any better, even though people were getting deeper into debt. Repaying the first Amigo loan may have left you in financial difficulty, so a top up loan may have appeared to be a good option, even though it made your debt situation worse.
What will you get if you win the claim?
When Amigo upholds a claim, it will tell you what the “redress” calculated is. You will only get paid a percentage of this, not the full amount (unless some of your payments are very recent).
Redress for a borrower who has a claim upheld
For a borrower with a repaid loan, redress will be:
- a refund of the interest they paid on the loan;
- plus 8% statutory interest;
- Amigo is making a deduction if your guarantor made any payments. If your guarantor has also made a claim, they should be refunded. If they haven’t then no one is being refunded for these amounts. You can appeal this decision, which is ethically very wrong, but it is not clear it you will win.
For a borrower with a current loan, redress will be:
- a refund of any interest if they have repaid more than the amount borrowed plus 8% statutory interest, otherwise, their balance will be reduced;
- their guarantor will be released;
- if there is still a balance after the reduction, you can make a lower affordable payment arrangement to clear it.
In addition, any problems on your credit record will be removed for loans that are upheld. This will include having any CCJ removed (the legal term is set aside) and removing the default showing on the debt with Intrum if your debt was sold.
Redress for a guarantor who has a claim upheld
A guarantor’s redress is the full amount they have paid to a loan, not just the interest, plus 8% statutory interest. And if there is a current loan, they will be released as guarantor.
Previously it had been expected that guarantors would be refunded if a borrower won a claim that the loan was unaffordable even if the guarantor had not made a claim. It has now become clear that Amigo is reducing the payments to the borrower and refusing to pay the guarantor where the guarantor has not claimed.
8% statutory interest
This number is NOT 8% of the interest you should get refunded.
It is 8% per year from the time of the repayments until 28 February 2022. So if your loan was settled several years before 2022, you may get 20% or more added.
BUT you will only get a % of this redress
That redress figure may look great. But you are not going to be paid that amount, just a percentage of it.
Amigo originally estimated that at 41p in the £. If your full redress is say £3,000 that would have meant you will be paid 41% of that – £1,230. But a lot more people made claims than Amigo expected – 210,000. That has reduced the amount you might get to 20p in the £.
And with the March 2023 announcement that Amigo has failed to raise the money from shareholders, there will be less cash to be refunded. The amount is now expected to be about 17p in the £.
So from a calculated redress of £3,000 you may get £510.
Exception – full refund for “continuing payments”
Some customers will get a “full refund” of certain payments they made to the loan provided that they have repaid at least the amount they borrowed and their claim is upheld. These customers are due a full refund of payments:
- from 1 December 2021, if they had complained on or before that date;
- from the date they complained, if that was between 1 December 2021 and 26 May 2022; or
- from 26 May 2022, if they did not complain before the Scheme started.
This is set out in full in 6.33 of the Explanatory Statement.
The purpose of this is so that if your claim results in a refund, payments you made after the relevant date will be refunded in full provided that you have repaid more than the amount you borrowed. For a guarantor getting a refund, the “repaid more than you borrowed” test does not apply.
Here are three borrower examples:
- a borrower who made a complaint in March 2021 (so before 1 December 2021) and who at 1 December 2021 had already paid back more than they had borrowed will get a full refund of payments they made after 1 December 2021
- a borrower who made a complaint in March 2022 (so after 1 December 2021) and who in March 2022 had already paid back more than they had borrowed will get a full refund of payments they made after that date
- a borrower who made a claim to the Scheme in September 2022 (so after the Scheme had started) who by 26 May 2022 had already paid back more than they had borrowed, will get a full refund of payments they made after 26 May 2022.
What happens after you make a claim
The deadline for making a claim has now passed
Keep an eye on your claim
When you have made a claim, you may not hear anything for months.
Amigo may send you an email when they have decided your claim saying you can log in to the portal and see the result.
But it is a good idea to check the portal every month or so even if you haven’t had an email. They may have sent you an email that you missed as it went into spam.

Working out how much people will get
When Amigo have decided all the claims and appeals they can then add up the total amount of redress. They then divide that amount by the money they have to distribute – this gives the “pence in the £” amount they will pay.
This will probably be done in two stages. There will be a first, larger payment possibly in the first quarter of 2024. And then a small payment in 2024 to pay out the remaining money.
Should you appeal a decision?
If your claim has been rejected or only partially upheld With some loans upheld and some rejected – you can appeal this decision.
You are the one who knows how much trouble the Amigo loan caused you.
The first Amigo decision will probably have been an automated “Computer says Yes/No” decision – they have had 200,000 complaints to decide. But in the appeal process, this will be looked at by a human.
You should also appeal if you don’t agree with the numbers given. If you think you had more loans than were listed. If you don’t know why the Total Cash Claim Value is less than the other numbers suggest.
Get more loans upheld
Getting more loans upheld will:
- increase the cash you are paid, or reduce the balance you owe
- if you get earlier loans upheld, the extra 8% added amount will also increase
- if your current loan is upheld, your guarantor will be released.
If you have bank statements or any other evidence about your finances at the time you took a loan, include that with your appeal. These will help your case.
Credit records
Getting more loans upheld will also clean any problems on them from your credit record.
If your credit report is wrong at the moment eg because Amigo did not add a default when you stopped paying, then it is important that in your appeal you say why the loan should be upheld. BUT ALSO say that if the loan is not upheld, you want a default date added to your credit record back in month/year “in accordance with the SCOR reporting rules”. Defaults drop off your credit record after 6 years – a non-defaulted debt will stay on your credit record for 6 years after the date it is settled.
HOW TO APPEAL
If you think the numbers are wrong, say why.
If you made all the payments but Amigo seems to think your guarantor made some, challenge this.
If you think more loans should be upheld: Get bank statement for 3 months before the loan started – these are the best evidence that a loan is unaffordable. You can get these going back at least 6 years even from closed accounts. Don’t assume you won’t be able to, ask for these immediately from your bank. If the loans are more than 6 years old and the bank account has been closed, look at what other evidence you have – payslips, P60s, tax returns, emails about missed payments or CCJs etc
Download & send a current credit report, eg TransUnions’ Statutory Report. If you have had loans deleted from your record because of winning other affordability complaints, send Amigo evidence about these.
Explain about recent problems before the loan application – only on benefits, health issues, gambling, economic abuse, recent missed payments, payments arrangements, DMP etc
And if you were topping up a previous loan, explain how that loan made your situation worse.
If all of your loans have been upheld and the numbers look right
You have no reason to appeal this decision just because you will only be paid a percentage of this. This would not get you any further money.
You should log in to the portal, accept the decision and give your bank account details.
Sale of loans to Lantern
In August and September 2023 some people have been notified that their loan has been sold to Lantern, a debt collector. The sale of loans to a debt collector is perfectly legal and you can’t challenge this.
In most cases these were loans where no one had made a claim to the scheme. If your loan has been sold and you had made a claim to the Scheme which has not been assessed, ask Amigo why.
The loans are being sold as guarantor loans – the guarantor has not been released and if the borrower doesn’t make an arrangement to pay the guarantor will probably be asked to.
We don’t yet know how “reasonable” Lantern will be in accepting low arrangements to pay. If you or your guarantor has a problem, leave a comment below here but also talk to a good debt adviser – your local Citizens Advice or if you prefer the phone National Debtline on 0808 808 4000.

Well this is another issue that hopefully you can advise on, I stupidly went through a claim company in Jan 21, so my complaint was made before the scheme and then added to the scheme when it opened. However the claim company Quanta are now no longer. Do you think. They will still come. For payment? I do have emails stating that I don’t want them to transfer to Ryan’s solicitors an that I would. Pursue myself and in th email. It said it would. Not affect claim with amigo, I am. Painicking incase there is some loop hole that they won’t process my claim?

I made complaint in jan21 before the scheme but through claims company which are now no longer, but I’m worried that they might still come. After money!! Quanta claims? Or worse amigo see some loop hole not to process! Although anytime iv phoned they have said all 5 loans have been looked at and they are nearing a decision!! I’m. Also a bit wary as I seen on the Facebook page someone got their loans wiped from credit file (like me) but then their clsoms weren’t upheld?

No problem cheeres it was 11000 interest for 5 years , can I ask you Sara on claim it says any interest you pay on loan you get for every pound 17 p that is one pay out 11000 x 0,17 and the second is plus 8 %statutory interest but that is seperate money ,that is yearly, how many year you got the loan multiplayer with calculating 8 %statutory interest per year ,or it’s that wrong or no and if your loan is paid in full several years you may get 20%or more on top of that that from time your loan settle until 2022 february what its say on update some pepole pay there loans like 8 years ago

you may have repaid 11k but that included repaying the loan, it wasnt all interest. On a 5000 loan over 5 years you would have paid less than 7000 in interest. and there would not have been much interest on the first loan as it was smaller and was settled after only a few months.

I’m still waiting too I’m in ESO and received the email from Amigo in December to stop making payments. I’m eager to know how Amigo will deal with claim. Im complained over the phone and maybe 1 informal email in 2020 and 2021 about the loan being unaffordable. I also raised a complaint in the scheme. I wonder if my case is classed as complex one. I still owe £2400 and l took the loan in 2018. I done 1 top up in 2018 and just can’t wait for this to be over and done with. I log in to my account everyday and check email inbox/junk/spam daily.

I called Amigo Loans today for an update on my sister’s case (she was guarantor).
After looking at the evidence put forward (medical, affordability and details of other companies decisions with regard multiple guarantor loans for the lady’s daughter to prove she was not able to understand what she had signed up for) Amigo have removed her from all liability.
Unfortunately the lady who borrowed the money is in arrears again and didn’t put her own case into the scheme so they are now chasing her.
I’d like to thank Sara for all her help to our family in helping us to fight off court letters and sort this mess out.
I hope everyone else on this journey has positive outcomes for their cases – never give up!

Hey can I ask are people receiving outcomes on weekends? Or is it just weekdays… i literally check multiple times everyday. It’s causing so much anxiety. When i called the scheme hotline the other day the man said all decisions have now been made it’s the refunds and redress that’s being calculated and that’s what’s taking so long… I am honestly so fed up with waiting checking and stressing over it.. I have become actually obsessed !! I’m expecting (if upheld) over 4k back and like other people really feeling the pinch in general at the moment… that money would take me out of a sticky spot… (cars at risk of being repossessed) so paying them arrears off would be priority amongst other things!! Aghhh I just want to know so I can plan other ways to repay my debt if not upheld… it’s come off my credit history and also was asked to stop making repayments back in November so I am hopeful

Sorry to be a downer. Majority of people who are waiting to receive an email put your account on notification and/or wait until the end of January. As long as you submit your appeal within the appeal period than you will be considered.
Checking your email every day is a waste of time as the website states by the end of Jan 24 decisions will be sent out. Also, the longer than the more interest added in relation to amount of days since loan was issued.
We are getting pettence so why get frustrated about max £3000. It is what it is, no matter how much I receive. Money is not everything.

people cannot rely on receiving an email. They need to be checking the portal as well. Especially as they may need to appeal a poor decision

Unless you are getting part of the repayments repaid “in full” the 8% interest stops being added in Feb 2022. So people are not getting any more because of these delays.

Everyone asking pointless questions should either wait until the end of January or a dept that taking out debt is a bad decision. If you use a debt charity then that is the best way forward.
The money will help me out but I have also made sacrifices to pay off existing debt rather than wait for 17p in the pound.
I need the full refund not 17p however know one thought to read terms and conditions of loans etc. this is stated but as usual money is everything

Hi Sarah it was entered by a debt claim company and rejected by Amigo. Then went to fos. The scheme was then opened before fos could make the decision. So thought it would automatically be entered into the scheme.

I was going through the ombudsman when all this started and the ombudsman told me that my claim would go back to Amigo and to follow their process again. My guarantor had to take over a year ago. They are still taking payments…just want the stress to end!

This thread really does make for interesting reading, seeing how different people/situations, how we’ve all been impacted. I do also think we are responsible here in a lot of ways, that money was not (in most cases) coerced or forced upon us, we did take it, alot of people seemed to keep going back for top ups and racking up higher debts, which i am sure were fully aware of interest rates and how much repayments would be and for that we can only accept responsibility. part of me feels guarantors deserve the refund more than we do especially if they have ended up paying some or most of this back, as they are the ones often pressured or guilted into taking out these loans on our behalf. yes amigo were in the wrong to do this, to prey on families and friends and charge them essentially crazy high loan rates against our bad credit score, horrendous calls if we fell behind, threats, not taking our financial situation into account, not doing correct background checks, offering funds to people who may be in addiction troubles and the list goes on, if our guarantors had taken out loans directly for most people here it would have been a very different situation most likely. but they cannot take all responsibility on this. i am very conflicted about the whole scheme after reading peoples stories and how many loans in short succession people, willingly, took out, amigo did not MAKE us take these.

Amigo consistently made few and inadequate checks that the loans would be manageable for either borrowers or guarantors. They were losing 85% of cases at the Ombudsman because of this and would have been fined £73million by the regulator if it wasn’t for the fact that they were going bust and this would only have reduced the money for refunds in the scheme.
They were a highly predatory lender, offering top ups to people who were desperate for money as paying the first Amigo loan left them short each month. They were also faster to go to court for a CCJ than any other lender I know.
Yes individually people would have been better off if they had never taken an Amigo loan, if they had never involved their guarantor in their financial difficulty, if they had taken debt advice, or… well almost anything except take a guarantor loan… but Amigo broke the rules to take advantage of them.
It would have been better if their regulator had intervened at an earlier point, reducing the harm that Amigo caused.

yes i agree, and for that amigo is very wrong and thats why we are in this situation with the claims but originally, those people who took out loans, and couldnt afford to pay the monthly payment back needing top-ups to cover- where is their accountability in the first place for agreeing to the very first loan? why is this not being acknowledged and people holding hands up saying yeah that first loan it is actually on me?

Because very often Amigo made entirely inadequate checks that the first loan was affordable too. there is no reason for people to have to agree that the first loan was all their fault – it very often wasn’t. That is why in the Ombudsman cases, Amigo was being told in almost all of them that all the loans were unaffordable, not just the top up loans.

I would like to add a response to this: many, many people who took loans were not in a mentality fit or financially knowledgeable state. I, for one, was not well at all and when I tried to make a payment plan with them because I knew I was struggling, they bullied, mocked, refused and tainted me. Instead, they told me I could get a top-up, which I did over and over again, when I realised I was in trouble. I couldn’t let it go to bankruptcy because I didn’t want that on my guarantor.
If anything, the above message sounds like it’s from another narked investor rather than anyone who actually experienced the ins and outs.
Amigo are fully to blame for their actions.

I took loans, topped up twice, missed payments on other debts because of the repayments I had to make and not wanting the guarantor to pay and my credit score was an absolute mess at one point. As it was on my guarantor’s house I ended up loosing my own and on the street. So You never know someone’s reason. So no need to be so quick to judge others.

It is quite interesting reading that post at the top as my first thought was they must be an investor or somehow involved in Amigo. If they are a borrower, and clearly don’t need the refund, then I’ll happily take it off their hands. The £8K I have calculated I could be owed will make a huge difference to my life.

I don’t think anyone has said that the money was “coerced or forced” upon them, but it is mainly the fact that people in desperate positions were preyed upon when applying, with no proper checks in place to see if the loans were affordable (which they weren’t), leading to more debt, more struggle and the only way out was to get more money out of Amigo in terms of a top up and it becomes a never ending death sentence paying a ridiculous amount of money back to them.

Sadly that is Amigo’s business plan. It sickens me to think that someone – knowing the psychology of money (the desperation debt engenders along with the shame and not to mention the stress) would set up a business that taps into all that for profit.
I worked for a lead credit checking company and don’t get me started on how your credit score can be severely affected if you never have any debt – try getting a mortgage when you come of age if you have never had a loan or a credit card.
From the moment we turn 18 the letters start coming in the list offering loans and credit cards.
I also think the poster D’s responding to isn’t taking into account the long months of COVID and the effect that had on people’s ability to earn a living and I bet these guarantor companies didn’t offer their borrower a holiday from paying.

I was a company director in an industry that was closed down at the first lockdown and stayed closed all the way through and never really opened for very long before being totally closed down again and was absolutely no point in taking orders as you would of had to refund and may of not got your money back from your supplier when it came to it. There was NO furlough for company directors. My partner who is self employed had to wait for i think for around 3 or 4 months before any furlough was paid i think in Aug 2020. So at some stage we had to prioritise . Others were extremely lucky. There’s another few factors. Meanwhile I had an issue with a car finance company who refused to give a payment hoilday on my credit file as they stated ‘officially’ the Covid period began sometime in February and I had missed / paid late the January installment so because I was already in arrears it wasn’t covid related and refused me a covid refered payment break .When it came to renewing they would not reaccept me for another car due to late payments. Would I have any grounds to complain to the Obsbundsman to have those negitive marks removed? Thanks

No i’m not an investor, im a customer just like you. I also experienced alot of threats and horrific phone calls when i too tried to make a payment plan, they were unhelpful the majority of the time. my point was that we all took those loans out willingly for whatever reason. the main highstreet banks most likely rejected everyone here and we needed funds for whatever reason, i had a gambling addiction, they did not or ignored that on my statements or bank when or if they even looked at them, i cannot remember, but i wanted that money. my mum was my gaurentor and she didn’t earn more than me at the time, she had a bad rating herself and i remember them telling her/suggesting she lowered her outgoings on their file so they could issue the loan. i guilted her into taking this out for me and for that i feel horrific. amigo were not to blame for me taking that loan, if another bank had offered me the money i’d have taken it from them, and most likely you would have also, and everyone else here. amigo offered funds and we accepted it, that was my point. regardless if they didnt do correct checks and everything else, we are still responsible to alot of degrees. we knew the interest rate and what the repayments came to, because we could see it and they also told us how much monthly repayments were.

The point about vulnerability is acurate – the ombudsman would say that a high cost guarantor lender has to make more detailed checks to verify an application than a “prime” lender lending to customers with low amounts of debt and a clean credit record.

But the whole point of regulation of lenders is to prevent lenders taking advantage of people when they are vulnerable, have mental health issues, are desperate, have a gambling addiction, whatever. The blame in my eyes is 50/50. it wasn’t free money, but yes whatever situation we were in contributed to that but it was CHOICE. i have put a claim in because i do believe they didn’t do their part correctly, other companies seen all the gambling and poopoo’d me, but amigo didn’t. the 50% is on me, is on all of us, that we took it out knowing all the amounts. there should have been a blocker in place on amigo to say no this person isn’t suitable for this loan/they cant afford it we don’t want to lend to, and they didn’t do that, but does that mean we were ‘ripped off’? this is happening in other places, look at BNPL or companies like b’house, they charge crazy prices for electronics on finance for people who cannot go out and buy a fridge freezer outright, or they can’t get finance at a low rate, so they offer their services to, potentially, people who will not pay them back,already in severe debt or people who have no jobs. is that right? yeah its not a great business model, but when people need the fridge and don’t have another option you bet they’ll take it, and then what complain later that it wasn’t fair or it was too high an APR? obviously the b’house example is different because that is taking the actual applicants bad credit score into account, and amigo kind of used our bad rating to let our guarantor take a loan out on our behalf, so for that amigo are very bad for doing that but it’s still similar

I’m surprised the board at Amigo aren’t in jail. No mistakes were made , they actively chose to conduct their business in this way and target desperate, vulnerable people.

its like blaming mcdonalds because you’re overweight, they offer a service, its unhealthy, its there and able to buy if you want to eat it, but its on you if you over indulge and end up obese. not them. we took out the loans, if we knew we if couldn’t afford to pay it back, and if so then have we not fraudulently taken money? i am sure everyone here cannot say hand on heart they believed or knew they could repay those loans when accepting them, especially those with no job? did people lie about outgoings, i have heard and read many say they did…
the only part amigo are responsible for and why this whole scheme has happened is because of their lack of correct background checks, issuing loans to people who did not have money to repay or even jobs, offering top ups, threatning ccj’s and everything else, abusive calls, harassing guarantors. this has happened with most payday loan companies out there, people want the money then the moment they have the chance to claim irresponsible lending, people are throwing in claims left and right. i’m trying to make people see a different perspective here and maybe hold some accountability for something they might repeat again in the future with other companies and services..

I too am a compulsive gambler and every single loan/overdraft I’ve had since I turned 18 has been gambled. The want for the loan could have been closed down by a rejection from amigo had they done proper checks… but they didn’t, so although yes it’s agreeable we all wanted the money, amigo should have never leant therefore becoming irresponsible lending!

i understand Lsa. i dont want to come off as some sort of hater towards everyone here, im not at all, i am in the same boat as you, but im also self aware to acknowledge my own wrong doings. i am sure there were/are customers of amigo who took out their loans, paid everything back no problem, and went about their life and haven’t thought about it again, but the fact is its most likely most people on this thread now are people, like myself, who fell into arrears/couldnt afford it/something happened to put themselves in a bad situation and unable to pay and here we are now. i hope you hear back with a response soon, i too haven’t had an outcome yet.

We are all victims of the vicious financial banking system. We are all victims of the credit scoring system and the panic to pay on time in order to keep a ‘ near perfect’ credit score. Loose your job , mainly through no fault of your own. Owed money as a sole trader or company went under due to others not paying their bills , unforeseen death or unforeseen crisis can all leave you short for repaying on time. All causes panic. if you know you need a new mortgage deal or need to rent privately, all those senerios install panic into people as they know they wont beable to meet the deadlines on time. Banks won’t touch you with a D for default on your record because you had 3 late payments over a period of a few years for a normal loan of 10% to 14% etc . We were also going through the lowest interest rates in modern history when these people were lending at 49.9% . They gave very little time for late payment before taking the money from guarentors and bullied them by calling their work numbers and sending emails to generic work email address such as info@ stating ‘ looking for this person who needs to contact us immediately because they owe us money’ if any guarantors dared not to take their calls during their working day. These people were out there preying on victims of the system until they broke you and they just spitefully added black marks to your credit file.

Now I put my complaint in in 2020 through resolver, months before they even discussed a scheme.

I called Amigo this morning and have been told that my claim has been decided upon, however, they’re just waiting for the letter to be sent. On tenterhooks now just waiting. Apparently there was an issue sending them last week, so this week there’s a lot to go out. Fingers crossed.

I had this via email today regarding payments, I take it all with a pinch of salt but it is something:
“We anticipate that payments will be processed by the end of February 2024, that’s when the full refund payments will happen alongside part redress payments. It will be followed by a second smaller payment 6-9 months later, once there is certainty around the timing of Amigo’s liquidation.”

Well the FCA guidance in April 2020 said “ This guidance applies where customers are already experiencing or reasonably expect to experience temporary payment difficulties as a result of coronavirus. ”

Thanks for your reply. Not so much that we had covid it was financial downturn immediately caused by covid. I was in the travel industry and because we dealt with a lot of clients in Italy , Spain and the USA for example and they locked down before us so you could see it coming. I had to find a new job directly from the issues the financial down turn of Covid as a whole.
No furlough or finacial help available for company directors for starters and my partner being self employed had a very partial income for the next 4 or 5 months until Furlough kicked in due to businesses not being open. From memory I was 7 or 8 days outside of the window.

You can make a complaint if you want take it to the Financial Ombudsman, but I suggestion you will have to come up with some very detailed arguments about why missing a payment in January can reasonably be seen as being related to covid.

I think they confirmed a covid payment hoilday when I requested one but later back tracked and sent me a later explaining they wouldn’t be apply a PH to my file. I complained and that was their response as officially the government announced the date as after my first late payment. I went along with their original confirmation of the payments being referred.

Hi there – I still have a current loan with amigo however looking at my payments I have paid £10187 back (my loan was for £10k) (interest owed is showing £11692)- I have not paid anything since march 2022 as per amigo advise as I had a valid claim – my credit report has been updated with my loans (original one was for £3000, then increased to £10k) so I would assume that means my claim is upheld and I am just awaiting my final letter – my question is would I be entitled to anything back as I paid £3750 from Jan 2021 to march 2022 ? Or would my loan now just be wrote off as I have technically paid the £10k back

It’s proberly true. I had 14.. yes 14 loans since 2009 including top ups, totalling to.over 45k borrowed. I know ridiculous. Anyway I been checking for the last year everyday and still I wait. I’m sure mine is proberly one of the worst cases and will be in the last 5 percent to be sorted.

But surely they look into each loan individually? Such as criteria checked at the time, time between each loan, information I provided regarding circumstances. A decision is then made and the computer then works out the finance after that.

They have a an automated decision tree that does it all – the time between loans is a simple bit of arithmetic, they will have stored the details of your application etc. They had 200,000+ claims and many of them will have had 2 or more loans – there is NO WAY that individual loans are being looked at.

Back in July they were telling people on the phone that most decisions would be out by the end of that month. Then the same in August and September and so on. They then said the majority would be out by the end of December.
Why say it. Now how could they possibly be making payouts in February if they still have 25 – 30% of claims to answer still .
Just Fobbing people off so I think we willneed to have a lot of patience as they will still need to shift through appeals to get to a final dividend payment

Hi Sara, is there no way we can get someone too intervene too see why amigo is taking so long, it seems too me they are sitting on the cash they already have been given too sort this mess out… 2 months ago they got 10 percent or more decisions made but last month they managed 2 percent… something doesn’t smell rite at all with there process.. I’m really getting irritated with this, it has become a obsession checking constantly.

Not really. I think they really underestimated the number of complaints and did a very poor job with the wording of the decisions going out – it is now probably wasting a lot of time having to field questions about these and handle appeals that may never have been needed if their comps had been clearer.
Getting answers on this won’t help speed it up.
They are not making any money financially from delaying the pay out.

I’ve received the below rejection from Amigo below. I would like to appeal this decision as I took two loans out with them in a space of a year and a few payments I missed and threatened that they would start asking my guarantor with making the payments.
So I’m not sure on how I would go about appealing this as clearly I couldn’t afford to maintain these payments.

Also I’ve just checked my old emails and I believe that I may have taken out four loans with them but they are only referring about two, as all four have different ref numbers and different loan amounts. So if this is the case I also took out a loans in
2013 – £4750 36 months
2014 – £5000 36 months

So you will need to appeal this because the latter two loans are missing.
I suggest you first phone Amigo up to ask why the loans haven’t been considered.

I gave them a call and explained to them about the two missing loans, gave them the reference numbers and also told them I sent the agreements to them via email back in May 2021 for her to tell me she can’t see anything on record.

They said they will raise a call back for a manager to call me but this can a couple of days,
and even then they wouldn’t be able to do more then what the man on the phone told me to do which was, in the meantime I can complete the appeal on the portal and add the other two loans they haven’t taken into account.

Going back to my previous correspondence with you. I’ve called again and asked to speak to a manager as no one still hasn’t called me back and I now have till the 2nd Feb to appeal their decision.
I’m now in desperate measures and do not know how to word my appeal.
Since then I’ve tried to do some digging into any paperwork/emails I could find, and I’ve noticed that I took out a a loan with them in 2011, 2012, 2013 and 2014. Which I’m guessing must of all been top ups. (If that’s what they’re called I can’t remember).
I also noticed that I took out a loan with them in 2011 when they were also called FLM Quick.
In 2015 I received the email below from them;
Hi Kelly, Reference number: WST8271
You had a loan with Amigo a little while ago. We’ve reviewed our records and you are due a refund of £1.88. As the amount is less than £5 we propose to donate this money to Julia’s House a children’s hospice based in Dorset) https://juliashouse.org/.

I suggest you list the loans you know youe had – Date, Amount, reference num bif you know it.
Then for each of the loans they havent given a decision on, list the evidence you have for it and attach that evidence – so the emails and photos of the paperwork.
Point out that the loan sizes were increasing, showing your financial situation was getting worse. And that the loan payment records will show missed payments.
if you have any information about your finances from that time such as bank statements, attache them

Above I have listed all my loans I have had with Amigo also FLM Quick (which it used to be called).
1. I would like to complain that three of my loans have not been considered which are reference numbers; WST12619528 – QKH16496710 –
ML043270. Despite that I sent across proof of these loans agreements to ‘hello@amigoloans.co.uk’ on the 05/05/2021, as requested. I have attached the emails and agreements again. So could I please request that these three loans also be considered.
2. I would like to point out that my loan sizes were increasing by taking top ups since 2012 till 2014. Showing my financial situation was getting worse.
3. Attached is a statement for WST827134 which I have been able to obtain. This shows missed payments which I have highlighted, this again shows I was struggling with my payments.

4. I would have been struggling financially because in 2010 I was signed up to a Debt Management agency (Gregory Pennington) which would have shown on my credit file. Attached is a list that Gregory Pennington provided to me with all the creditors I was in debt to.
5. In 2014 and 2015 I received CCJ’s which would have shown that I had previous debts that were long outstanding to creditors hence the reason they turned into CCJ’s. I have attached the CCJ paperwork.
6. I have attached an email showing, an email that I took a loan out with FLM Quick in 2011 showing that I was relying heavily on credit. I have attached a few statements showing debits from my account all the way up to 2013.
In this case I would say that the loans were unreasonable and unaffordable.

This is a joke
They were very quick to give out the loans without proper checks causing issues for thousands of people.
For those due a full refund these should be paid out once identified and then do what they’re doing with the scheme.
They were also very quick take repayments.
When I had a bereavement and needed a one month payment holiday they gave me it but then demanded a 40% increase on monthly repayments essentially making my situation much worse.
I managed to repay in full but the heel dragging is just taking the mick now, we all understand a few issues have come up but this something else.

Because Amigo has sent out only 73% of decisions. There is no indication that the remaining ones are complex – Amigo has just badly underestimated the work reiured.

I only ask because the reason I complained about them was because I know for a fact they didn’t ask for a payslip or bank statement at any point and I specifically remember th loan been in my gaurantoira account within 45 mins of a 2/3 min phone call/application… Just incase they are telling some lies.

Hi Lsa. I received my decision on the 3 Jan 24.
I previously provided a few bank statements and my original loan agreements.
I can remember that kind of set up from me as well and also they were more focused on my guarantor being able to pay the loan if I couldn’t. I’ll be seeing my guarantor later and I will see what documentation or emails she has because I remember missing payments and getting phone calls from her to make sure I make the payments.

Has anyone whose claim was initially rejected by Amigo but subsequently upheld by the Adjudicator been told not to make ongoing monthly payments? Has anyone received a revised decision from Amigo taking into account the findings of the Adjudicator?
My understanding is that Adjudicator’s decision is final and so Amigo cannot change it nor ignore it.

It’s so frustrating. My appeal was upheld by the adjudicator and I’ve heard nothing from Amigo. I asked when it would be removed from my credit file as I see people who haven’t had an initial outcome have had loans removed, yet mine is still on my credit file. I check everyday if I’ve had an update and nothing….its been over a month since my appeal was upheld.

I made a complaint to amigo a few years ago but that was declined be them and stupidly I didn’t take it any further and just accepted that.
Further on down the line I paid my balance in January 2022 just before all the scheme came into play.
I’ve had my letter to say that the interest is being refunded on all loans (or should I say, a tiny amount of it).
My question is, am I entitled to the big payment as a full refund as suggested in a couple of comments above?

Yes it will improve your credit score. Maybe not immediately but I was able to get better credit after it was removed and ClearScore do notify you. It’s a good idea to see what change has happened as the post below states that theirs shows closed on their credit score but in my case all trace has been removed and it does not show in open or closed accounts which would indicate I owe amigo nothing and my decision is fully upheld but I am still awaiting an outcome.

It is extremely difficult and expensive to sue for things that happen in a Scheme. Despite all the delays, very poor communication and nasty bits in the scheme, I haven’t seen anything that I think would be a case that could clearly be won in the High Court. And Amigo will be liquidated very shortly afterwards, after which there is no one to sue.

In November, we updated credit reports for customers with either a full or partially upheld claim.
As a result of this and the time that it takes to calculate your redress, you may notice a change in your credit file before receiving your claim outcome letter. In this situation, it is probable that your complaint has been either fully or partially upheld, and your letter will be sent shortly. Credit records will be removed if the loans are deemed to be irresponsibly lent and there have been any negative markers on the historic credit file or if the loan is still active.
In the case of adjudicated claims, credit records will have already been updated for any loans upheld as being irresponsibly lent and will be further updated once the Scheme Adjudicator’s final decision is communicated if any additional loans are deemed irresponsibly lent. This process will continue into the start of 2024.

Amigo has completely been removed from my credit record but I’m confused still waiting for outcome but I paid about 15000 on 10000 loan then went into eso very early probably about oct 21 still showing 7500 im arrears on account page am I right in thinking if mines upheld they will take the arrears of whatever my redress might be?

If you have paid 15000 on a 10000 loan and your claim is upheld (which it probably will be if the loan has been removed from your credit record) them you refund will be about 5000, whoch will be paid at about 17%.
The “arrears” here don’t matter at all as the outstanding balance, including the arrears, will be cleared.

Most interest is being refunded at a rate of about 17%. So if you paid £2000 in intereat you could get about £340 back as a refund from Amigo.
But some more recent payments are being refunded in full.

I got told to stop making payments in December 2023 and it came off my credit file in November 2023. I was making payments up untill December 2023 and made my claim in November 2022 would my recent payments been made back in Full ? Amigo did not normally allow people onto ESO unless they had paid more than the amount borrowed on the last loan. How large was the last loan and how much have you paid to it before you stopped paying?

I had paid exactly the amount borrowed, as I asked them for ESO and I made a small payment of £22 to ensure my payments including interest were more, they then let me enter the scheme. The arrears I am assumming have built up whilst in ESO and will be disregarded?

The “arrears” are fictitious once the loan has been decided to be unaffordable.
Did you have other loans before this one?
There should have been other numbers sent to you in the email about the balance on the loan being reduced. If you have paid more than you borrowed this should be to ZERO.

It said all of my three loans were upheld but this was the total cash claim for all three? I emailed Amigo and the response I received is that I was offered ESO by mistake and that they allowed it as a gesture of good will but I do still owe £996, I have asked for proof as I can see what payments I have made and worked this out. Apparently I was called and advised it was given by mistake, this is a lie….

Hi, I have done this and asked them to listen to the last call made, an agent called Lewis asked me to pay £15 which balanced my payments and made ESO possible, which I did. Lets see how long this takes to investigate. In any case, I am in a DMP, so would be offering a very small monthly amount if they persue the debt and I will ask them to reduce the balance. Really hoping that you can help… i read the section about changing the default date, does this work for ccj? Or does it only work for missed payments on your file.
Received an email today saying it can take up to 6 months for them to even apply for the ccj to be removed, they told me in november it would take three months!
Now im in a panic, im dependant on it for a mortgage.
i looked at my credit report, it drops off in november this year, at that time the account was already 14 months in default, i also looked back in my emails and i had offered smaller repaymnets, in march that year and they told me too late its going to court. 🫠 and now i read on redetermination, which i should have done!! Bit too late for that …but could i change the default age of a ccj? Is that a thing? Really hope so. Cant believe how long this has dragged. All for being a bloody guarantor.

No I am afraid you cannot change the date on a CCJ – it is always the date of the court judgment.
I don’t think you should plan on being able to make a mortgage application before November. It is NOT worth trying to get a “bad credit” mortgage now and switch to a mortgage with a high street lender in 2 years… far too often that goes wrong. It did in 2011-5. And it has been going badly wrong now for 18 months. People are left effectively mortgage prisoners as no-one will give them a remortgage even though their broker told them it would be easy after two years.

“Payments can only be allocated to the party that made them towards the loan. For example, payments made from a guarantors payment details can not be allocated to a borrower, and vice versa. ”

Ive looked into this further and heres what I have found.
You made a complaint in April 2020
This complaint closed in june 2020
You submitted a scheme claim on17/11 /2022
As your scheme claim was submitted after the scheme effective date you wouldn’t be entitled to the full refund element of redress.
I can see I looked into this for you back in November and advised that the FOS did noot escalate your original complaint correctly because they did not use the correct Amigo email address. I used the screenshots you provided and our records communication with the FOS to work this out. This is why the original complaint from 2020 remained closed. It is therefore separate to any scheme claim..
Before responding to you in November I did check with management if anything could be done but unfortunately not. Furthermore the scheme Adjudicators decision is final.

Hi Sarah 24/3 /2022 I paid £365.61 every month for 60 and it has been upheld in the scheme after initially being refused.
How can they say they refused it because the fos used a wrong email address how would they know the fos used the wrong email address.
Thats a fair ammount of full redress payment they are saving themselves. Stinks
